Police looking for robbery suspects
Be alert:
Burglary increase at Despatch “If you see any suspicious person or vehicle in your neighbourhood, please phone the police.” This message comes from Superintendent Vivian Vuyisiwe Tembani, Station Commissioner of Despatch in an effort to combat the increasing number of housebreakings in the Windsor Park and Azalea Park areas in Despatch. According to police spokesperson W/O Marianette Olivier, most of the the burglaries occurred during daytime with a few incidents during the night.
“We are doing everything in our power to curb these housebreakings. My members performed extra duties and had many successes, but it still continues. Therefore we need the public to play an active role in preventing crime by being the police’s eyes and ears,” said Supt. Tembani. Police in Kwanobuhle are searching for three suspects who allegedly were involved in two robberies on Monday morning. According to police spokesperson Lt.Col. Priscilla Naidu, a bread deliverer stopped at a Somalian owned shop in Matana Street and when the owner opened the door a teenager appeared and threatened both men with a firearm. “Two other men joined their accomplice. An amount of R4 000 and an unknown amount of airtime was taken.
Four hours later another Somalian owned shop was robbed at gunpoint by four men in Bantom Road,” said Lt.Col. Naidu. A witness saw the suspects get into a “jikeleza” (local taxi) which, still in Bantam Road, allegedly stalled. In the meantime the robbery was reported to a passing police vehicle. As W/O Christoffel Thomas approached the “jikeleza” a suspect fired a shot at the police. “The police retaliated by firing three rounds. The men then got out
and started running in different directions. W/O Thomas managed to arrest one of them. No money or firearms were found on the arrested man,” said Lt.Col. Naidu. Police have linked both cases of armed robbery. Anyone who can assist the police with information regarding the suspects are asked to contact Captain Mai from the Uitenhage Cluster Task Team on 0082 697 5914. Any information provided will be treated in strict confidence.
Traffic official arrested Detectives in Uitenhage were investigating fraud cases at the traffic department in Kirkwood and had a breakthrough last week when they arrested three suspects. According to police information two of the suspects took vehicles, even though they were not roadworthy, to the test station and then issued roadworthy certificates. A 49 year-old woman was arrested at her home in Kirkwood and her husband (53 years-old) was arrested on charges of fraud and corruption. The third suspect, a 56 year-old traffic official from Uitenhage, was also arrested. All three appeared in the Kirkwood Magistrates Court on charges ranging from fraud to corruption.

Samuel Rossouw (66) van Despatch, is deur die olieherwinningstigting Rose Foundation en die National Oil Recycling Association (NORA) aangewys as die Oos-Kaap streekswenner nadat hy met sy 1 ton Nissan-bakkie 360 000 liter gebruikte olie in ‘n jaar gekollekteer het. Dit is sowat 62 810 liter meer as die begrote hoeveelheid wat hy moes inwin. Hierdie prestasie het hom ook ‘n algehele derde plek op nasionale vlak besorg uit ‘n totaal van 69 olie-kollekteerders. “Vuil olie is swart goud. Dit is harde werk, maar ek het vir my ’n sisteem uitgewerk wat
die proses om olie te suig en uit te pomp silwerskoon hanteer,” het Samuel Rossouw gesê. Hy is die enigste geregistreerde Rose Foundation lid in die Oos-Kaap en lewer gebruikte olie wat hy kollekteer aan FFS wat dit verwerk vir ketelbrandstof. “Daar word sowat 120 miljoen liter olie per jaar in die land verbruik en slegs 80 tot 90 mijoen liter word herwin. So, tussen 30 en 40 miljoen liter word onwettig gestort of kan nie rekenskap van gegee word nie. “Oliebesoedeling is erg want 1 liter olie kan ‘n miljoen liter water besoedel.” Rossouw het al tot 5 000 liter olie op ‘n dag gekollekteer. Sy seun, Samuel Rossouw junior, het intussen by sy pa aangesluit om die dienste van hulle maatskappy, Algoa Bay Used Oil Collectors uit te brei.

Nomazotsho Mbasa Swartbooi’s musical career may have only begun in her 30’s, but this gospel singer has a long musical career ahead of her. At the age of 35 Mbasa felt that she needed to use her talents and put pen to paper to write some of her own songs. She will be launching her debut album in Uitenhage on Saturday at the Babs Madlakane Hall in Kwanobuhle. Entitled “UJesu Uyandibiza” (Jesus is calling me), Swartbooi regards her album as a combination of relief, comfort, continuity and en-
couragement. Written in both Xhosa and English, the album was produced by prominent mentor Siyabonga Hlekani who has worked with national artists such as hip hop band “Teargas” and former Pop Idols stars “Jamali”. Swartbooi’s will and determination can be heard in her songs with hits like “Imvana”, the title track “UJesu Uyandibiza”, and “You Are Worthy”. SEBENZA SUPPORTS TB ORSMOND ;Sebenza, a community based organisation with the objective to provide sewing and embroidery workshops for those less fortunate, donated shorts to the TB Orsmond hospital in Kamesh. Apart from developing skills the organisation will follow a holistic approach looking after the physical, emotional and spiritual needs of its members. Leerders van HTS Daniel Pienaar het onlangs deelgeneem aan die OP brugboukompetisie wat deur die Suid-Afrikaanse Instituut vir Siviele Ingenieurs aangebied word. DP het drie spanne ingeskryf en al drie het die res van die provinsie se spanne uitgestof en die eerste drie plekke in die kompetisie verower. Die brug wat deur die wenspan, Nicholas Coetzee, Anroe SteynClulow en Frank Ferreira gebou is het ‘n gewig van 85kg gedra. Die span wat die tweede plek behaal het was Tiaan Share, Arno Lotter en Francois Nel en in die derde plek was Steven April en Dillyn Coetzee. Die wenspan van DP sal later vanjaar die OP verteenwoordig by die nasionale brugboukompetisie in Johannesburg.

Trustees accountable for complex repairs This week the Property Poser panel deals with a sticky situation relating to the trustees’ responsibilities when it comes to repairs and maintenance in a sectional title complex. In this instance, the driveways of the complex had to be resurfaced with tar and a special levy was raised to cover the cost. The reader reports that the first section was very poorly done and it was not long before the tar started lifting and sticking to car tyres. In the end, only a small number of the driveways were completely retarred, with the rest of the surfaces simply being patched, leaving unsightly areas of tar. Despite complaints from the residents, the trustees have not held the contractor accountable for his poor workmanship. He has already been paid in full and the reader would like to know what recourse residents have against the trustees for being remiss in their duty to ensure that the work was done properly. The trustees are in a fiduciary relationship to the body corporate, says Charlotte Vermaak from Chas Everitt in Nelson Mandela Bay. “This implies that every trustee must act honestly, in good faith, and in the best interests of the owners and the body corporate at all times.” Vermaak says trustees must understand the consequences of their control and management of the sectional title scheme. “If a trustee is found guilty of gross negligence, he or she can be held personally liable for the financial damages.” If one considers the trustees’ fiduciary re-

sponsibility to the body corporate, it becomes apparent from the common law that they have a duty of trust, as well as a duty of care and skill, says Vermaak. “Our reader and the other residents may therefore rightly ask whether the trustees have properly exercised the duty of care and skill in accepting the workmanship of the contractor.” As elected officials, the body corporate may demand that the trustees remedy the current situation, says Rian du Toit from DTS Attorneys in the metro. “Of course, if they’re not satisfied with the manner in which the trustees deal with it, the body corporate may choose not to re-elect them or even to remove them at a special general meeting.” Only where it appears that the trustees had acted with mala fides (bad faith) or gross negligence can they be held personally liable for their actions, says Du Toit. “In the absence of further evidence it is very difficult to determine whether that was indeed the case in this instance.” Du Toit says the trustees’ documentary evidence in the appointment of the contractor and their endeavours to enforce the warranty should provide some assistance in this regard. =André Ferreira in action WERNER OLIVIER The newly formed East Cape Off-road Club (ECOC) held its first ever race over the past weekend and it was a huge success! The club now also runs under the World of Motorsport South Africa (WOMZA) banner which is also a first for an Eastern Cape offroad vehicle club. This year’s championship will be known as the Data Scout Challenge thanks to Riaan Mulder, also club treasurer, jumping in to sponsor the competition. The guys from Cenic Garden Services in Jeffreys Bay assisted in sponsoring the trophies as well. Racing started at midday with the hot Autumn sun beating down but that did not keep the supporters away from the action as they watched the 8 cars line up and pull away in a cloud of dust. There was no real wind to speak of and this proved quite a challenge as the dust was hanging in the air in some places in the bush. Pieter Lombard and Stefan Potgieter came out eventual winners in their VW Sandmaster. Second spot was fiercely competed by 4 competitors who all finished under time bar and within minutes of each other. Father and son pairing of Ian and Eben van Eeden finished second with Werner and Mariska Olivier taking 3rd. It was a successful day with no major incidents apart from one car flipping on its side and now being dubbed “Tolbos”. There are already more competitors who have entered for the next race which will be
