,&%& &DSV RQ ,QMXU\ &ODLPV 7KLQJV <RX 6KRXOG .QRZ In February 2018, the Attorney General of BC, David Eby, announced that ICBC would be instituting a cap on pain and suffering for “minorâ€? motor vehicle personal injury claims. Effective April 1, 2019, “minorâ€? injury claims for motor vehicle collisions that occur after April 1, 2019 will have their compensation for pain and suffering capped at a maximum of $5,500. Injuries sustained in motor vehicle collisions that occur prior to April 1, 2019 will not be subject to this new cap on compensation for pain and suffering. What does this mean for you? Here is a summary of 5 things you need to know about this change: 1 ) Caps will be implemented to injuries classiďŹ ed as “minorâ€? ICBC has declared that the cap will apply to injuries FODVVLĂ€ HG DV ´PLQRUÂľ 7KLV LQFOXGHV ZKLSODVK DFKHV DQG sprains, cuts and bruises, as well as anxiety resulting from an accident. Important to note is that broken bones or concussions are automatically not considered to be “minorâ€?, and therefore outside the cap. Any “minorâ€? injuries that persist beyond 12 months and continue to seriously impact the victim’s daily life will also be considered outside the cap. 2) Doctors will have the ďŹ nal decision on the classiďŹ cation of an injury. 7KH JRRG QHZV LV WKDW RQO\ GRFWRUV ZLOO EH DEOH WR PDNH the determination as to whether an injury is “minorâ€? or not. Although ICBC will not make medical determinations, if they disagree with a doctor’s assessment then the decision will be made through a new civil dispute resolution process.

3) Innocent victims of accidents will no longer be eligible for fair compensation from injuries resulting from a motor vehicle accident. One reason that most lawyers and medical practitioners have opposed the implementation of a cap is that it could force the not at fault victims of collisions to potentially bear the subsequent costs. Some “minor� injuries may have losses and/or expenses that exceed the maximum FRPSHQVDWLRQ DOORZHG XQGHU WKH QHZ OHJLVODWLRQ 7KH result under the cap system may leave you, the victim, undercompensated. 4) Cap on injury claims can limit your ability to have access to resources needed to properly heal. 7KH UHDOLW\ LV WKDW IROORZLQJ DQ DFFLGHQW YLFWLPV RI PRWRU vehicle collisions require medical attention and access to resources that will carry additional costs beyond what LV SURYLGHG XQGHU WKH %& 0HGLFDO 6HUYLFHV 3ODQ 7KHVH costs, that would otherwise eventually be paid in full by ICBC under the current law, will now be at least partially the burden of the not at fault victim if their injury claim falls within the cap for motor vehicle collisions that occur after April 1, 2019. 5) What Can You do? 7KH EHVW ZD\ WR SURWHFW \RXUVHOI DIWHU D PRWRU YHKLFOH collision is to have yourself assessed by your doctor and to ensure you meet with an experienced personal injury lawyer. Your doctor will provide a diagnosis on the extent of the injuries, and the steps you can take to ensure they heal properly. Meeting with your lawyer will give you context as to whether your claim is more than a “minor� injury, or could result in more than a “minor� injury due to the extent of the treatments that will be needed to heal.

FXS J R] H[WUD À QH VXJDU 1/8 cup / 40g / 1 1/3 oz cold butter, chopped 1/2 tsp ground ginger 1/2 tsp ground cinnamon 3 large pears, peeled, cored and cut into wedges 375g / 13 1/4 oz all-butter puff pastry Double cream, to serve

Method

Preheat oven to 400F / 200C / gas 6. Put a 8 inch / 21cm diameter frying pan with an ovenproof handle (this bit is important!) on a burner over a medium heat. Add the sugar to the dry pan and heat, stirring constantly until it turns a lovely caramel coloury. Add the butter, ginger and cinnamon and stir well to combine. Place the pears in the caramel and spoon over the mixture.

Turn the heat down and cook for 5–10 minutes until the pears are just tender and cooked but retain their shape. Remove from the heat and cool slightly. Arrange the pears to form an attractive pattern in the pan. Roll out the pastry to about 1/4 inch / 5mm thick and cut a disc slightly bigger than your pan (about 10 inch / 24cm). Place the pastry disc on top of the pears and caramel, then carefully tuck it snugly around the outside of the pears and down into the sides of the pan. Bake the pie in the oven for 30–40 minutes, or until the pastry is golden brown and puffed up. Remove from the oven and leave for 10 minutes. Run a knife around the edge, place a large plate over the top and carefully turn the tart onto the plate. Serve with cream. 23

rinity Western assistant captain Jarrett Fontaine, who hails from Humboldt, Sask. is in his second year with the Spartans after leading the BCIHL in goal-scoring last year, registering 15 goals while adding 13 assists in just 18 games. This year, the 5-foot-5, 162-pound forward is back and ready to take his game to another level and help his team to is first ever league championship. It’s early in the season, but how would you describe this year’s team? “We have a really good squad this year. I think we made some upgrades from last year. With the success that we had last year, almost winning it there, it’s a pretty exciting time for Spartan fans and for us. Our team is looking better and I think we have a really good opportunity to win it all this year.” How do you build off of last year’s BCIHL championship series appearance? “You can talk about winning a championship, but once you’ve been there and come so close, I think that gets the guys a little hungrier. Now you know what it takes. It takes a little bit more than what you gave last year. I think that experience of almost getting there is going to carry us this year. We don’t want to feel that again.” After your first year with TWU, scoring a league-leading 15 goals to go with 13 assists in 18 games, how do you approach your second year? “You know the first year is a bit of a feeling out year. I had a little bit of luck on my side. I worked hard and got a few bounces. This year, it’s a little bit more structured.

I’m coming in with more confidence. I know what the league is like and I know how to play the team’s style. Every year you’re in the league you get a little bit more experience and that’s big coming down the stretch.” What’s it like to once again get to play with Evan Last, who led the BCHIL in scoring last year? “I love playing with Evan. He has a lot of speed out there. We really haven’t missed a beat. It’s really nice to come in and know that you have that solid chemistry and at any point in the game, you can be like, ‘let’s score one,’ and go out and get one.” What have you learned so far this year about your line? “It’s about not complicating things. Last year, a lot of our success was because we kept it simple and we need to carry that over into this year.
