The Anatomy of a DUI An Overview of Alcohol By Manuel J. Barba, DUI Defense Attorney Over the past few months I have been asked by many individuals various questions relating to DUI. I believe that knowledge is power, and when you have the knowledge you are in a better position to protect yourself. Therefore, I decided to write this column to provide information relating to DUI so to educate and inform and to help individuals have a better understanding of DUI. Before I discuss the anatomy of an actual DUI arrest, I believe it important for the reader to have a basic understanding of the physiology of alcohol itself. By understanding how alcohol works within our body, and how it relates to ones blood alcohol concentration (BAC), one can better understand how the consumption of alcohol can lead to a DUI arrest, or even avoid a DUI arrest by controlling behaviors related to the consumption of alcohol. Overview of Alcohol Arguably, alcohol is the most abused drug in the United States. “Alcohol” is the name given to a family of closely related and naturally-occurring chemicals. Alcohols are molecularly very similar and produce similar effects. They produce intoxicating effects when ingested into the human body. Only one of them, Ethanol, is meant for human consumption. However, when ingested in substantial quantities it too can cause death. Two of ethanol’s best known analogs are methyl alcohol (or methanol), commonly called “wood alcohol”, and isopropyl alcohol

(or isopropanol), also known as “rubbing alcohol”. As for human consumption, Ethanol is what interests us, because it is the kind of alcohol that features prominently in impaired driving. Ethanol is beverage alcohol, the active ingredient in beer, wine, whiskey, liquors, etc. Ethanol production starts with fermentation. That is a kind of decomposition in which the sugars in fruit, grains and other organic materials combine with yeast to produce the chemical we call ethanol. This can occur naturally, as yeast spores in the air come into contact with decomposing fruit and grains. However, most of the ethanol in the world didn’t ferment naturally, but was produced under human supervision. When an alcoholic beverage is produced by fermentation, the maximum ethanol content that can be reached is about 14-15%. At that concentration, the yeast dies, so the fermentation stops. Obtaining higher ethanol content requires a process called distillation. This involves heating the beverage until the ethanol “boils off ”, then collecting the ethanol vapor. It is possible to do this because ethanol boils at a lower temperature than does water. Distilled spirits is the name we give to high-ethanol-concentration beverages produced by distillation. These include rum, whiskey, gin, vodka, etc. The ethanol concentration of distilled spirits usually is expressed in terms of proof, which is a number corresponding to twice the ethanol percentage. For example, an 80-proof beverage has an ethanol concentration of 40 percent.

LEATHER REALM by Dave Murdock Sometimes I get stumped when people ask me why I’ve been in the Leather scene for over 35 years and why I continue to be active. To me it’s just such a no-brainer that I have a hard time coming up with the words. It’s just such a part of my life that it’s like asking someone why they continue to breathe. It’s not a hard question, only one that you sort of take for granted and then get befuddled when asked the obvious. Of course there are those terms like Trust, Honor and Respect, but one would hope the rest of the world would live by those 3 watchwords (especially politicians, I don’t think very many of them have any concept of what those 3 words mean anymore, but I digress). One could also say that’s it about the play, hard, rough, all out sex. But, one would hope even the non-Leather community (usually referred to as vanilla) has that kind of sex at least once in a while, and, face it, it’s not a bad reason <grin>. And then there’s always tradition, living up to the code laid down by our forefathers (well that makes them seem ancient, you have to realize that we’re only talking about an “organized” Leather scene as being around for 50-60 years). And I like all the protocol and pomp and circumstance. Guess it’s just a left-over from my days as a Catholic, I always enjoyed High Mass much more than the regular every-day Mass. The swirling smoke, the candles burning at the altar, people dressed up in their finest…. WAIT, my god, I’m describing a dungeon 26

scene aren’t I, hmm, this bears some more thought.... But before I explore that I think that, for me, one of the main reasons I’m active is it comes down to something as simple as one word – COMMUNITY. When you truly join the Leather Tribe you find out that you have instant brothers and sisters around the world. Like all families you don’t always like one another, and there’s tiff ’s and feuds, but underneath it all you know that there is someone at your back who’ll stand up for you, help you, nurture you, rejoice in your victories and help you through the defeats. I think that much of that happens naturally because we’re a minority within a minority. Our numbers, though large, aren’t legion. So it leads to a 6 degrees of separation type of thing. I may not know you, but I’ve heard of you because so-and-so was in a contest with you, or met you at a play party. Believe me this is true, and here’s proof. Several years ago I had a boy who lived in The Netherlands. Soon after I moved to Palm Springs and bought The Barracks he was attending a party in Paris. And as he was wandering around he overhears two men from Germany discussing this new bar called The Barracks in Palm Springs. OK? Point proven! And that sense of community is heightened because we all come together in common cause for many reasons, contests, play parties, etc., but one major Continued on page 41

Over the millennia people have used and abused ethanol, and some standard-size servings of the different beverages have evolved. Beer, for example, is normally dispensed in 12-ounce servings. Since basic beer has an ethanol concentration of about 4%, the typical bottle of beer contains a little less than one-half ounce of pure ethanol (now keep in mind that craft beers can have alcohol concentrations as high as 8-9%, and some higher). A standard glass of wine has about four ounces of liquid. On average, wine is about 12 percent alcohol, so the glass of wine also has a bit less than one-half ounce of ethanol in it (some wines have a much higher alcohol concentration). Whiskey and vodka and other distilled spirits are dispensed by the “shot glass”, usually containing about 1 ¼ ounce of fluid. At a typical concentration of forty percent ethanol (80-proof), the standard shot of whiskey has approximately ½ ounce of ethanol. Therefore, as far as their alcoholic contents are concerned, a can of regular beer, a 4 oz. glass of wine, and a shot of whiskey are all about the same. JERSEY’S JOURNAL by Jersey Shore If you looked up “vain” in the dictionary you will see a picture of a gay man. I find a large majority of gay men are very vain, especially when they aren’t all that. I understand confidence, but vanity is another thing. Nothing turns me off more than a vain person, but a confident person can make me tingle. Are you wondering if there is a difference? Then you must be a vain person. The definition of confidence is: full trust; belief in powers, trustworthiness, or reliability of a person or thing. While the definition of Vanity is: excessive pride in one’s appearance, qualities, abilities, achievements, etc.; character or quality of being vain; conceit. So, would you rather be trustworthy and reliable OR vain and conceited? I believe that confidence gets you further is life in the long run. Vanity eventually catches up with you in the long run. It’s like Karma. What you put out, you get in return. It may take time, but eventually you learn your life lessons. I’ve been continuous in my career for the small fact that I am not a vain and egotistical person. I am confident, as I watch the new batch of wanna-be’s thinking their shit doesn’t have stinky glitter, but when they fall, it will be a hard fall and it will smudge their makeup! And it took two hours to do!!!! It’s not fair that it takes time to backfire while the good have to suffer through 40

their realm of dumb-ass-ness! Fortunately, I can move on in my own direction, while they are dependent upon others to fill their heads with ego colored fairy dust. reason we’ve all come together is to help out the community. The Leather community has a big heart, just look at the Leather Pride flag! I’m constantly amazed at the outpouring of support from our community. Look at people like Dick Haskamp, and Michelle Cinque who continue year after year to give back to the community, and organizations like Palm Springs Leather order of the Desert and the Palm Springs Sisters of Perpetual Indulgence who work tirelessly to help out others through their programs. But those are only a few of the larger players. There are many others that you may not have heard of, like Clifton Tatum, Mr. Palm Springs Leather 2015. Since last November he’s been working his ass off raising money for his 5 LGBTQ charities: The Trevor Project, For The Children, The Center’s suicide prevention and anti-bullying campaign, The American Suicide Prevention Center and Sanctuary Palm Springs. To date Cliff has raised over $17,000 towards his goal of $25,000 during his title year.
