The Anatomy of a DUI An Overview of Alcohol By Manuel J. Barba, DUI Defense Attorney My last article was an initial overview of a DUI investigation and explained how the investigation is divided into three phases: Phase One – vehicle in motion, where a law enforcement officer observes the vehicle while it is driving down the roadway; Phase Two – personal contact, after the officer has stopped the vehicle, the officer takes this opportunity to observe and speak with the driver face-toface looking for clues of impairment; and, Phase Three – pre-arrest screening, where the officer actually has the driver conduct various tests to try to determine whether the driver is under the influence. This article will focus on Phase One - vehicle in motion. In Phase One – vehicle in motion, a law enforcement officer’s attention is drawn to a car that is driving down the roadway. Something caught the officer’s attention, something unusual. There are various clues a law enforcement officer looks for as he/she is looking for DUI drivers. The clues help the officer make the Phase One decision: “should I stop the vehicle?”

vehicle in operation and note any clues of a possible impaired driver. At this point the officer must decide whether there is reasonable cause to stop the vehicle, either to conduct further investigation to determine if the driver may be driving under the influence of something, such as alcohol, but also possibly drugs, or both. At this stage the officer is not committed to arresting the driver, but he/she will concentrate on gathering all evidence that may support the officer’s conclusion that the driver may be DUI. The officer’s attention may be drawn to the moving car by such things as a traffic moving violation such as speeding, failing to use proper turn signals, or failing to stop at a stop sign or even rolling through a stop sign. The officer may see an equipment violation such as a broken tail light, an expired license plate tag, the officer may see unusual driving actions such as weaving or drifting within a lane or crossing over the lane line. The car may be driving slower than the normal flow of traffic. Or, the officer may see evidence of possible drinking – such as seeing a person drinking something covered in a paper bag or even throwing a beer can out the window. The reality is, after dark police officers are searching for a reason to stop a car to see if the driver may have been drinking.

LEATHER REALM by Dave Murdock “Leather/Drag/Whatever”. Can you smell the leather and the testosterone in the air? That must mean that Palm Springs Leather Pride is just around the corner, October 29 – November 1. Make sure check out all the new events and buy your tickets today at desertleatherpride.com. I thought this might be a good time to go over the 3 immutable watchwords of the Leather community. I’m sure you’ve heard (or read) the terms Trust, Honor and Respect, but what do they mean? This week we’ll talk about Trust. The dictionary tells us trust means “reliance on the integrity, strength, ability... of a person or thing”. Usually, if a trust is broken it’s just a small number of people hurt, and most times just one or two. The big problem with that is that the person that is hurt is usually extremely vulnerable to the hurt because the person that betrayed their trust is someone they looked up to as a mentor or teacher (or at the very least a hot sex partner during a BDSM scene). AND, many times that person is a newbie or relative newbie to the Leather Scene and if they unknowingly place their trust in someone that isn’t trustworthy it can turn that person off to the Leather Scene, at least until they meet someone who can rebuild the Trust. But, what exactly is the person trusting? Well, I’ll posit that Trust, in the Leather meaning of the word, means that the Top, Master or Daddy, whatever dominant personality is in charge has the well being of their charge at the forefront of their thought processes. And that means their physical AND mental well being. It also means that the dominant has adequate skill in whatever fetish has been mutually decided upon in order to play safely. That is in addition to the traditional dictionary definitions. Trust is especially important to Leather leaders

because they are seen as people who tell the truth and work hard to make their community better. One of my pet peeves is when someone who SHOULD be a unifying force as an elder in the community acts like a narcissistic asshole and only is out to further their own personal gain, inflame their ‘fame’ or protect their cronies. I’ve seen it in happen in geographic communities like NYC or LA, and also in organizational communities like clubs. They can be very divisive and dangerous if left unchecked. I’ve seen it happen where butter wouldn’t melt in the mouth of a supposed elder, but as soon as peoples backs are turned the knives come out. Luckily those people are soon found out and are treated as outsiders by most people in the Leather community, and that is a universal truth, trust me. But when Trust is upheld, as it usually is in the Leather scene, (and that’s one reason I love it so much) it is the linchpin of a couple, group, organization or community. With trust we all have each others backs and it helps us all stand straight and tall. Next week we’ll go on to discover the meaning of Leather Honor. Until then play safe and have fun.

The country’s largest supermarket chain Kroger KR -2.78% will now offer its transgender workers full benefits, including surgery and drug therapy for gender reassignment, as part of its employee health plan. The move is especially significant given Kroger’s size and impact: the Cincinnati-based retailer is the fifth largest private employer in the U.S., with some 400,000 workers on its payroll across 2,500-plus stores. Kroger is now the largest retail chain to offer trans-inclusive health coverage to its workers. JERSEY’S JOURNAL by Jersey Shore Why is everyone so concerned about what everyone else is doing? Worry about yourself! You wouldn’t need to keep up with the Jones’s as they don’t exist. The only person you should compare yourself to, is yourself! I am not a competitive person, but if I had to compete with anyone, it would be myself. If you are only competing with yourself, then even on a bad day, you are a winner. You beat out EVERYONE in your race. It’s a simple concept where everyone is a winner, unless you are hard on yourself. We are human and no one is perfect. A lot of people think they are perfect, but you know what? They aren’t. That’s what makes the world interesting. Imperfections in life are learning curves. I find myself preaching about life. To get the most of life you need to treat it nicely. Like a new born baby, you need to learn and grow and nurture it, so it grows to be amazing as it makes the most out of life! If you throw it into a snake pit with no education or life strategies then life will bite! The effects are poisonous. I don’t have poison in my blood. I have glitter and fairy dust flowing thru my veins. It probably explains why I can’t donate blood. Or choose not to. If I cut

myself and bleed, then I’m detailing a dress and making it sparkle! So, this proves my point. It’s what’s on the inside that counts and we sparkle from the inside out! Man, I am brilliant. If the officer decides to stop the car he/ she will usually turn on the red emergency lights to signal the driver to stop. Once the red lights go on, the officer is trained to observe the manner in which the driver reacts or responds to the officer’s red lights flashing, and to note any unusual reactions that may suggest that the driver is under the influence of something. For instance, the driver may be oblivious to the police car’s red lights (doesn’t notice the lights), or stops in the middle of the lane, or doesn’t park on the shoulder correctly, or hits a curb, etc. The National Highway Traffic Safety Administration (NHTSA) sponsored research to identify the most common and reliable initial indicators of a possible DUI driver. This research identified 24 clues, each with an associated probability that the driver exhibiting the clue is in fact DUI. These 24 clues which police officers are trained to use to detect nighttime under the influence drivers are divided into four categories. The first category, problems maintaining proper lane position (such as weaving, drifting, crossing over the line that divides one lane from another). The second category is associated with speed and braking problems (the driver is driving to slow for the traffic flow, the driver’s speed fluctuates such as

slowing down and speeding up for no apparent reason, the driver waits for the last minute to apply the brakes when coming to a stop sign or signal). The third category deals with vigilance problems (the driver seems to not be attentive, almost causes an accident, etc.). The fourth category of clues deal with judgment problems (the driver is taking unusual risks such as turning in front of oncoming traffic, or the driver makes unusually wide turns, or turns too sharp, etc.) Often a driver who is under the influence will exhibit various clues – not just one. After dark, a police officer will usually stop a car if they see just one clue because they are looking for DUI drivers. If you have had any alcohol to drink, pay great attention to how you are driving. I guarantee you that law enforcement officers are watching. THAT IS FUNNY A man goes swimming in the ocean but gets sucked out to sea. A boat passes by him and tells him to climb aboard but he says “I have faith, God will save me.” The Coast Guard comes by with a rescue helicopter and tells him to climb the ladder up, but he says “I have faith, God will save me.” The man is now getting tired but thankfully a dolphin swims under him and starts to carry him to shore, but the man pushes the dolphin away saying “I have faith, God will save me. The man dies and goes to Heaven. He asks God “Why didn’t you save me?” God replies “I tried! I sent a ship, a helicopter and a dolphin!” Two men are out hunting when one of them suddenly drops dead. He calls 911 immediately. The operator says “Can I help you sir?” The man replies “I think my friend is dead! Get an ambulance! What should I do?” The operator replies “Okay, calm down sir. First we have to make sure he is dead.” There is silence, then a gun shot, then the man comes back on “Okay, what now?”
