The Anatomy of a DUI An Overview of Alcohol By Manuel J. Barba, DUI Defense Attorney In the last article I continued the discussion of Phase Two of a DUI stop – personal contact – focusing on the on the officer’s use of sight, hearing, smell during the personal contact phase as well as the officer’s pre-exit interview techniques. Here I will continue that discussion with the exit sequence and the law relating to reasonable suspicion to detain and probable cause to arrest. Remember, Phase Two focuses on the officer’s observation and interview of the driver which begins as soon as the suspect vehicle and the patrol vehicle have come to complete stops. Face-to-face observation and interview of the driver allows the officer to use his senses to determine if evidence of driving under the influence of alcohol and/or drugs exists. After the initial contact with the driver, the officer decides whether he/she will instruct the driver to exit the car. The officer’s decision to instruct the driver to exit the car usually is made after he/she has developed a suspicion that the driver may be under the influence. (Note that often times an officer will ask a driver to exit the vehicle for officer safety reasons). Nevertheless, even though the officer’s suspicions may be very strong at this point, usually the driver is not yet under arrest, but is only detained for further investigation. 20

When the officer instructs the driver to exit the car, the officer is trained to observe how the driver steps out and walks from the car and any other actions or behaviors during this exit sequence that may provide further evidence of being under the influence of alcohol and/or drugs. For instance, a driver may exhibit anger or other unusual reactions, the driver may not follow instructions, the driver may not be able to open the door, the driver may leave the car in gear when he/she tries to exit, the driver may try to get out of the car with the seat belt still fastened, the driver may lean against car to maintain his/her balance, and the driver may keep his/her hands on the car to maintain balance. A trained officer will observe any of the above and note it in his/her arrest report. After the officer has asked the driver to exit the car, he will usually have the driver stand on the sidewalk or some other safe area. Now, up to this point, the officer has only gathered “clues” from phase one – vehicle in motion, and from phase two – personal contact. These clues raise the officer’s suspicion that the driver may be under the influence of alcohol and/or drugs. The clues from phase one and phase two provide the officer with the reasonable suspicion necessary to detain the driver to further conduct a DUI investigation. Here’s the law: “A temporary detention requires a reasonable suspicion the person detained may be involved in criminal activity. Reasonable cause demands some minimum level of objective justification, but considerContinued on page 45

For Immediate Release Mayor-Elect Rob Moon Thanks the Residents of Palm Springs November 5, 2015, Palm Springs, CA - I want to thank the residents of Palm Springs for electing me to be your next mayor. I am humbled and honored by the trust you have placed in me. The time for campaigning is over. It is time to put away the yard signs, ads, and social media postings and work together on our common goal to make our great city of Palm Springs even greater. Early in our campaign I made a “Pledge to the Residents of Palm Springs”. I renew my commitment to that pledge and commit to working closely with all members of our City Council individually and as a team to address the many challenges facing us as a city.

a permanent solution to our homelessness situation, and protect the precious Palm Springs brand. We must also make our city government decision making more transparent and allow for more engagement and input from our residents. We can begin by implementing effective checks and balances into our budget and contracting practices. I am optimistic and hopeful about the future of Palm Springs. Our wonderful city motto, “The People are the City”, will be my theme. I am confident that with all of us working together our best days are ahead. In the near future, I will begin a regularly scheduled series of “Meet the Mayor” sessions at coffee shops throughout Palm Springs. I will also be out in our community on a daily basis and I look forward to meeting as many of you as possible. Thank you again for your trust and support. As I noted in one of my TV ads, “I won’t let you down”!

As your mayor I will work hard to improve the quality of life for all our residents, diversify our economic base, balance development with preservation, implement 26

LEATHER REALM by Dave Murdock “And the new Mr. Palm Springs Drum roll please…and the new Mr. Palm Springs Leather 2016 is Christopher Durbin. Christopher entered the contest as Mr. Hot Rodeo 2015 and competed against 6 other great contestants, including 1st Runner Up – Steve Juneau – Mr. Off Ramp Leathers, 2nd Runner Up – James Bork – Mr. Chill Leather, Mr. Copa Leather Aaron Jones, Mr. Tool Shed Leather Jeff Maxwell and Mr. Barracks Leather Mark Austin. Christopher will go on to Chicago to represent the Palm Springs community at the International Mr. Leather contest next Memorial Day (see www.imrl.com for more details). The leather weekend festivities began with the meeting of contestants and judges at Hunters Nightclub on Thursday night. It was here that the contestants drew their numbers for the order they would compete on stage during the contest. The prestigious judging panel consisted of (in alphabetical order) Esteban Bartholo – Mr. Bullet Leather 2015 and community activist, Randy Carmenaty – American Leatherman 2008, Randall “Bear Man” Klett – owner of the Werks company’s and Stompers Boots and a C.L.A.W. board member, Sandy “Mama” Reinhardt whose “Mama’s Family” of over 2000 men and women raise over $3,000,000 a year for various charities (and a family yours truly is proud to be a part of as Mama’s PS Leather Daddy), Patrick Smith – International Mr. Leather 2015, Clifton Tatum – Mr. Palm Springs Leather 2015 (who raised over $20,000 for his 5 youth charities in his title year, and last but not least Dan Woodward – San Diego activist. The contest this year

was very ably helmed by Drew Kramer with MC duties again being taken on by one of the best MC’s in the Leather Community, Lenny Broberg. The tally masters duties were filled by Karen Atkins and Tom Pardoe. Friday afternoon was the opening Pool Party at InnExile, hosted by Clifton Tatum, Friday early evening was the Formal leather Dinner at the beautiful Hilton Hotel, and the day was capped off by the huge crowd of about 1800 people checking out the items at the vendor market (and each other at one of our favorite events, the Cruise Party/Vendor Market at the Tool Shed. Saturday afternoon saw cigar and pipe aficionados at The Barracks enjoying their smokes and showing off their gear, and Saturday evening was the capstone event of the weekend, the Mr. Palm Springs Leather Contest in the scenic Grand Concourse at the Palm Springs Convention Center. Finally, later that evening, and sure to be an event that will continue, the Victory Dance and Cruise Party at The Barracks which was literally balls to the walls with hot men cruising drinking and dancing. Sunday was the annual BBQ and wet t-shirt contest helmed by Christopher Durbin who did an amazing job with what seemed like half the attendees entered and which saw the current Mr. Regiment from the Regiment of Black and Tan’s walking away with the top prize. Running concurrently was a first this year, a Leather Women’s Continued on page 38 brunch hosted by

AdamsArtExpos’e Art and Politics George Washington was the first president of the United States, he was chosen without opposition and was president for two terms from 1789 - 1797. During this time two political ideologies were forming. Thomas Jefferson believed in power being held more at the state level. Those who agreed with him formed the Democratic-Republican Party. Alexander Hamilton, who was Secretary of The Treasury under Washington wanted a national bank and was a strong believer, along with his followers, in a dominant Federal government. This political faction became known as the Federalists. They can be compared with the Tories after England’s sect of government with the same name.

candidates for president of the two parties. Jefferson won the election of 1800. The campaign was contentious with many personal insults, outrageous newspaper articles and predictions of war fare and national collapse. The artists who designed the newspaper cartoons and posters are basically unknown today. However their creativity in visually interpreting the political propaganda had obvious influences on the outcome of what our democracy has evolved toward. Today the contentious and outrageous is found in a television network known as Fox News, that has become the propaganda machine of the Republican Party, which today is more representative of the Federalist Party of Washington and Jefferson’s time. Today’s Democratic Party more represented by the Democratic-Republican Party, does not have a media outlet devoted to their ideology with as broad a propaganda outlet

The Jeffersonians, as the Democratic-Republican Party came to be called, developed an effective network of newspapers in major cities which helped them get their message out effectively. George Washington was against a party system. He said it would “fractionate” the nation and turn people against one another when they should be working together for the common good. This is reflected in the Federalist poster from the year 1800 which shows Washington who had died prior to the publishing of the poster, depicted in a cloud in heaven warning the two conflicting parties of division. The Parties are represented by two men each pulling in different directions on the legs of a table. VETERANS NOTES

Veterans Groups Are Worried About Privatization Of The VA Nearly two-thirds of veterans oppose “privatizing VA hospitals and services,” according to a poll released Tuesday by the Vet Voice Foundation. And some 80 percent of the veterans surveyed believe veterans “deserve their health care to be fully paid for, not vouchers which may not cover all the costs.” The survey reveals that veterans, regardless of age, party, or branch of military, oppose privatization of VA hospital programs and services. Overall, 64% of veterans oppose privatization (54% strongly oppose it). Not only do veterans strongly oppose this proposal, they see it as a potential voting issue. 42

JERSEY’S JOURNAL by Jersey Shore What do you think of when you hear backstabbing, gossip, cut throat, egos, and manipulation to name a few? Did you guess Drag Queens? Well then you are correct. There is a Tsunami coming through Palm Springs and along with it is a big crash of EGO on that wave. I don’t know what’s in the water, but suddenly most these queens have become obsessed by some satanic god of drag. Maybe he was buying souls for fame and success. Of course with all deals with the Devil you end up paying at the end.

For the people who truly know me know that I stray from that crap. I WILL speak my mind and speak up and defend myself if need be. I actually don’t “defend” myself because that would mean that what they are mentioning is hardly true and blown out of proportion. I just got into a blow out with some dumb queen telling me where I can and can’t be on Pride. When it’s not her decision and she doesn’t know her fact because I am in a WHOLE DIFFERENT place. It’s just plain jealousy. I get what I get because I put the work in. Instead of being a backstabbing dough bag get off your egotistical ass and wonder what am I doing correctly and learn. Two or three years of drag makes you an expert, right!?!? I’ve been seeing this same pattern reoccur over and over and over. ALL 44

the crap you young bitch queens are putting out into a fun atmosphere, I’ve seen play out in my 20 plus years of this style of entertainment. We are Men in DRESSES. Our job is too spread happiness. Get over yourself. Instead of competing with me, compete with yourself! Peace, Love and Fun Drag, Jersey

ably less than is required for probable cause to arrest.” (U.S. v. Sokolow (1989)490 U.S. 1, 7; Terry v. Ohio (1968)392U.S. 1, 22) NOW TAKE NOTE: up to this point the officer usually only has a suspicion (clues from phase one and two) that the driver may be DUI, but nothing more. Suspicions alone are NOT enough to arrest a driver for DUI. To arrest the driver for DUI, the officer must have probable cause that the driver was driving while under the influence of alcohol or drugs, or the driver has a blood alcohol concentration of .08% or more at the time of driving. Here’s the law on probable cause: “Cause to arrest exists when the facts and circumstances within the officer’s knowledge and

of which they had reasonably trustworthy information would lead an officer of ordinary care and prudence to entertain an honest and strong suspicion that the person arrested is guilty of a crime.” (Beck v. Ohio (1964) 379 U.S.89, 91; People v. Price (1991) 1Cal.4th 324, 410) Next week I will begin discussing Phase Three - Pre-arrest Screening and why you should never agree to participate in field sobriety tests. DUI defense attorney Manuel J. Barba can be reached at 760-770-3377 or 951-680-9125. For more information visit www.PalmSpringsDUI.com.

THAT IS FUNNY It’s hard to explain puns to kleptomaniacs because they always take things literally. What does a nosey pepper do? Get jalapeño business. The dyslexic devil worshiper sold his soul to Santa. So this guy with a premature ejaculation problem comes out of nowhere. I bought some shoes from a drug dealer. I don’t know what he laced them with but I’ve been tripping all day. I know a lot of jokes about unemployed people – but none of them work. What’s the difference between ignorance and apathy? I don’t know and I don’t care

WEEKLY GUIDE TO THE STARS ARIES (March 20 - April 18): Be careful about issuing a “nowor-never” ultimatum because nerves are frayed right now and somebody might take you up on it. TAURUS (April 19 - May 19): You and a certain someone belong together, but how are you going to make it work? Begin with a list of what you can live without. It’s longer than you think. GEMINI (May 20 - June 19): A sibling needs to talk, so make time. What this person shares will give you an entirely different slant on recent events. CANCER (June 20 - July 21): Sleeping dogs that have been lying around since April are up and barking. Lucky for you you’re feeling more confident. Tell them to “heel.”

46

LEO (July 22 - Aug. 21): A sob story is meant to melt your heart. That’s why it’s called a sob story. It’s not unfeeling to probe for specifics. In fact, it’s smart. VIRGO (Aug. 22 - Sept. 21): You have to decide about a matter that’s been on hold since April. Circumstances are different and the players have changed but your feelings are still the same. LIBRA (Sept. 22 - Oct. 21): You’ve rarely felt taken for granted by loved ones but try to remember that they have a lot on their plates. Take feelings of insecurity off the table. SCORPIO (Oct. 22 - Nov. 20): Ruling Planet Pluto turns direct today. And it’s a good thing, too, because you can use the mojo, which always helps out.

SAGITTARIUS(Nov. 21- Dec. 20): After months of saying you couldn’t deal, guess what? You can deal. Proof again that adversity introduces you to yourself. CAPRICORN (Dec. 21 - Jan. 18): It’s unlike you to hold out this long for something you took on faith. Hold on for a little longer and you’ll see that your faith was well founded. AQUARIUS (Jan. 19 - Feb. 17): In recent weeks some friends have become enemies while rivals became supporters. Believe it or not the signs have been there all along. PISCES (Feb. 18 - March 19): Does a friend know that it’s a loan and not a gift? Make it clear now before things get too awkward and go beyond any sort of repair.

THE LAST WORD by George W. Zander

NOTICE

Desert Stonewall Democrats are working to raise money to match $5000 offered as a reward to apprehend and convict the perpetrators of a hate crime against 2 members of the Palm Springs LGBT community. The email I received (and of course confirmed) said this: “Two of Hunters patron’s (Chris Zanders and George Zanders) part of the gay softball league on the Piranha’s (orange jerseys) were assaulted after leaving Hunters last night about 8:15 pm. They were holding hands and were called “faggots” and the aggressor got into an altercation with Chris. After stating that he did not want to fight, Chris released him. The instigator then came back with two buddies and snuck up and hit Chris on the back of the head with a bottle. Chris suffered a concussion and was knocked partially unconscious and needed staples in the back of his head and stiches to his lip.
