The Anatomy of a DUI An Overview of Alcohol By Manuel J. Barba, DUI Defense Attorney My last article was an initial overview of a DUI investigation and explained how the investigation is divided into three phases: Phase One – vehicle in motion, where a law enforcement officer observes the vehicle while it is driving down the roadway; Phase Two – personal contact, after the officer has stopped the vehicle, the officer takes this opportunity to observe and speak with the driver face-toface looking for clues of impairment; and, Phase Three – pre-arrest screening, where the officer actually has the driver conduct various tests to try to determine whether the driver is under the influence. This article will focus on Phase One - vehicle in motion. In Phase One – vehicle in motion, a law enforcement officer’s attention is drawn to a car that is driving down the roadway. At this stage the officer is not committed to arresting the driver, but he/she will concentrate on gathering all evidence that may support the officer’s conclusion that the driver may be DUI. The officer’s attention may be drawn to the moving car by such things as a traffic moving violation such as speeding, failing to use proper turn signals, or failing to stop at a stop sign or even rolling through a stop sign. The officer may see an equipment violation such as a broken tail light, an expired license plate tag, the officer may see unusual driving actions such as weaving or drifting within a lane or crossing over the lane line. The car may be driving slower than the normal flow of traffic. Or, the officer may see evidence of possible drinking – such as seeing a person drinking something covered in a paper bag or even throwing a beer can out the window. The reality is, after dark police officers are searching for a reason to stop a car to see if the driver may have been drinking.

With regard to Phase One, law enforceContinued from page 45 ment officers are trained to observe the 20 Your weekly LGBT Gay Desert Guide. View our Free Digital Version on-line.

I DID NOT KNOW!

Thomas Nast, the German-born political cartoonist include our versions of Santa Claus and Uncle Sam that e know today, drew a cartoon for Harper’s Weekly titled “A Live Jackass Kicking a Dead Lion.” The donkey was a stand-in for “Copperhead Democrats” (the Northern Democrats that opposed the Civil War), and the lion represented Edwin M. Stanton, Abraham Lincoln’s recently deceased Secretary of War. Nast thought of the Copperheads as anti-Union and believed the Democratic press’s treatment of Stanton was disrespectful.

JERSEY’S JOURNAL by Jersey Shore Well, it’s that time of year. The holidays are approaching as the weather changes, giving us a sigh of relief from the heat. Maybe it will loosen up the stick deeply embedded into most people’s assholes. I feel all I write about is the stupid behavior of people. I need to move on to a new topic, so with that said, cut the crap and act like a civilized human. Okay, now that it’s getting cooler we must take the time to enjoy life. I for one have missed a lot of life, and now that I’m feeling human, watch out!!! I’m gonna be stumbling up and down Arenas drunker than.... well everyone on Arenas! In reality I would be dead from alcohol poisoning!!! As you know Arenas is Liquor City. You can get drunk from breathing in the air! Why am I not hanging out there more often??? I do realize I need to live life more. Now that I’m done with surgeries and I got the right mix of happy pills, and once I finally clean the drag in my home, life will be mine! If you want something you have to 44

grab it. Maybe that’s why Jersey’s hands are always directed towards men’s crotches! I want it, so I’m gonna grab it! Taking life by the balls in my own fabulous Jersey way!!! Peace, Love, and Balls, Jersey Jersey Shore can be followed on Facebook or email @ Dragapalooza@aol.com

If the officer decides to stop the car he/ she will usually turn on the red emergency lights to signal the driver to stop. Once the red lights go on, the officer is trained to observe the manner in which the driver reacts or responds to the officer’s red lights flashing, and to note any unusual reactions that may suggest that the driver is under the influence of something. For instance, the driver may be oblivious to the police car’s red lights (doesn’t notice the lights), or stops in the middle of the lane, or doesn’t park on the shoulder correctly, or hits a curb, etc. The National Highway Traffic Safety Administration (NHTSA) sponsored research to identify the most common and reliable initial indicators of a possible DUI driver. This research identified 24 clues, each with an associated probability that the driver exhibiting the clue is in fact DUI. These 24 clues which police officers are trained to use to detect nighttime under the influence drivers are divided into four categories. The first category, problems maintaining proper lane position (such as weaving, drifting, crossing over the line that divides one lane from another). The second category is associated with speed and braking problems (the driver is driving to slow for the traffic flow, the driver’s speed fluctuates such as

slowing down and speeding up for no apparent reason, the driver waits for the last minute to apply the brakes when coming to a stop sign or signal). The third category deals with vigilance problems (the driver seems to not be attentive, almost causes an accident, etc.). The fourth category of clues deal with judgment problems (the driver is taking unusual risks such as turning in front of oncoming traffic, or the driver makes unusually wide turns, or turns too sharp, etc.) Often a driver who is under the influence will exhibit various clues – not just one. After dark, a police officer will usually stop a car if they see just one clue because they are looking for DUI drivers. If you have had any alcohol to drink, pay great attention to how you are driving. I guarantee you that law enforcement officers are watching. In next week’s article I will discuss the clues associated with Phase Two – personal contact. Until then be safe. DUI Defense Attorney Manuel J. Barba can be reached at 760-770-3377 or 951-6809125. THAT IS FUNNY Two boys argue over whose parents are better. The first boy says, “My dad’s better than your dad.” The other boy says, “Well, my mom is better than your mom.” The first boy pauses, “I guess you’re right. My dad says the same thing.” An old man walked into a dentist’s office, took off all his clothes and bent over. The dentist said, ‘’I think you have the wrong room.’’ ‘’You put in my husband’s teeth last week,” he replied. “Now you have to remove them.” A Twinkbgoes to a soda machine. he puts in a dollar and gets a soda. he does this again and again. A man in line behind her asks why she is taking so long. he says, “Can’t you see I’m winning?” A recent worldwide survey showed that out of 2,146,703,436 people, 94% were too lazy to actually read that number. Dont worried we didnt either.

WEEKLY GUIDE TO THE STARS ARIES (March 20 - April 18): It’s never easy when someone you look up to disappoints, but it’s only human to have feet of clay. We’d be pretty boring without them. TAURUS (April 19 - May 19): What you have to offer doesn’t meet demands. So do you cop to it or bluff? Sometimes you need a little finesse, but today you’re going to need a lot. GEMINI (May 20 - June 19): The person challenging you may huff and puff, but he won’t be able to blow your house down because your foundation is solid. Hang tough and you’ll prevail. CANCER (June 20 - July 21): Avoid arguments today because people’s wordplay is better than yours and you’ll only get flustered.

46

LEO (July 22 - Aug. 21): Try not to look bored when sitting through the long life lecture. It will only make this pedantic type stop and start again from the beginning. VIRGO (Aug. 22 - Sept. 21): Are you speaking to people’s higher or lower nature? Lamenting the state of affairs is easy. Doing something constructive about it is the true creative challenge. LIBRA (Sept. 22 - Oct. 21): There’s no talking reason to a relative. It’s not your job to get him to face facts. Life will do that soon enough. SCORPIO (Oct. 22 - Nov. 20): You’re getting too fixated on others’ successes. Don’t you recognize window-dressing when you see it? Be proud of your own gains.

SAGITTARIUS (Nov. 21- Dec. 20): Fear of making the wrong move could lead you to do exactly that. Do what you want. That way any consequences that arise will be worth the aggravation. CAPRICORN (Dec. 21 - Jan. 18): Things feel pretty nice and square and that makes you feel like you still have something to prove. You’re already in the driver’s seat. Sitting there says it all. AQUARIUS (Jan. 19 - Feb. 17): This time it’s you - and not a loved one who’s being irrational. It’s OK. You’re allowed to get loopy every once in a while. PISCES (Feb. 18 - March 19): The best way to deal with a loved one’s crisis du jour is to Let them throw a hissy fit. After that time’s up.

THE LAST WORD by George W. Zander Equality California is pleased to announce its 2015 legislative package which would improve and advance equality for lesbian, gay, bisexual and transgender Californians and their families. In September of 2014, Equality California adopted a new mission statement which is to achieve full and lasting equality, acceptance and social justice for all people in our diverse LGBT communities, inside and outside of California.
