The Anatomy of a DUI An Overview of Alcohol By Manuel J. Barba, DUI Defense Attorney In my last article I discussed the concept of divided attention where a person affected by alcohol or drugs loses their ability to divide their attention between multiple tasks. The person under the influence tends to focus on one task and paying less attention or ignoring other tasks. Driving requires a driver to divide attention between a number of tasks all at once. Think about it. When a driver is driving down the roadway, the driver’s foot is on the gas pedal, the driver is looking in the rear view mirror scanning things behind, also looking ahead and scanning the roadway and potential cross-traffic ahead, etc., and processing all of that information and making decisions accordingly. Do I take my foot off the gas pedal? Do I apply the brake? Do I turn on my turn signal to change lanes or turn? Should I speed up? Slow down? In essence the impaired driver loses the ability to do these things thus causing driving safety problems or even a collision. Many of the clues outlined in my previous article discussing Phase One: Vehicle in Motion essentially are caused by divided attention problems. Once the officer determines (based on observing one or more of the 24 clues previously discussed) that he/she has reason20
able cause to stop the vehicle for further investigation to determine if the driver is under the influence, the officer will then “red light” the vehicle to signal the suspected driver to stop. The officer will then carefully notice the stopping sequence of the suspect vehicle looking for more clues of impairment usually due to the driver’s failure to divide his or her attention. Again, “divided attention” is the ability to concentrate and act on two or more things at the same time. Once the suspected driver stops his car, the officer’s DUI investigation focuses on Phase Two: Personal Contact. Phase Two focuses on contacting the driver to gather more evidence. The officer’s first task is to approach, observe and interview the driver while he/ she is still in the vehicle to note any face-toface evidence of impairment. The officer may say: “How are you this evening? Do you know why I stopped you? Where are you coming from? Where are you going? (Note that a driver has no obligation to answer any of these questions). During this face-to-face contact the officer may administer some simple pre-exit sobriety tests to gain additional information to evaluate whether or not the driver is impaired. Remember any tests are voluntary and a driver has no obligation to do them. After the initial contact, the officer must decide whether to request the driver to exit the vehicle for further field sobriety testing. In some jurisdictions departmental

LEATHER REALM by Dave Murdock “Leather/Drag/Whatever”. Before we begin this weeks regularly scheduled column I wanted to put on my hat as the Media Chair for PSLOD and remind you to get your tickets TODAY for Palm Springs Leather Pride. Last week I talked about Trust being the 1st leg in the tripod of words that support the Leather Community. In this weeks column we’re going to be talking about the 2nd and 3rd legs, Honor and Respect, in our continuing quest to understand the Leather Scene. To start off, the dictionary defines honor as “honesty, fairness, or integrity in one’s beliefs and actions”, and its means that to the Leather community as well. We strive to act with honesty and fairness in our dealings with our fellow beings. Trust you can build and Respect you can earn, but Honor is something that you either have or you don’t. It means keeping your word, showing up for things you have committed to (even if a better offer comes along) and honoring those who came before us and paved the way for the freedoms we enjoy today. It means that you have integrity in all your dealings, and I think it’s probably the hardest of the 3 words to live up to. We all face daily challenges where it would be easier to tell that little white lie, easier to go along with the pack rather than stand up for your principles and easier to embellish your own self-worth. It’s easy to hoodwink someone, especially if that person trusts you, but it’s also totally dishonorable. It’s easy to publicly say one
28
thing and then, in private, totally reverse course. No problem, no one will ever know… you think. However, in this wonderful instantaneous world we live in it only takes a moment for someone to find out that you have been deceitful, or hurtful, or prideful. Where is your honor then? Do we all live up to this hard task every moment of every day? Probably not. Being human is to fail occasionally, But the continual striving to be honorable in all things is what you should be striving for. Onto the 3rd and final leg of the tripod, “R-ES-P-E-C-T, find out what it means to me”!. Sorry, channeled Aretha there for a moment, but Respect, in the Leather Community, means several things. First off it means that you have respect for those that came before you. The 30 something’s don’t really have a visceral understanding of what it meant to grow up gay preand post-Stonewall. We didn’t enjoy most of the freedoms most take for granted today (although there’s still a lot more work to do). And that was especially true of the fledgling Leather community. A minority within a minority, there were no support groups, no clubs, and very few bars that catered to them. But the rebels persevered, inventing things like the hanky code that quietly advertised what you were into. And they were the ones that eventually founded many of the Leather organizations like GMSMA in NY, and Avatar in Los Angeles. It took guts to be out in Leather for many, and for that alone they deserve respect. They not only survived, they made improvements possible. In addition, Respect also encompasses respect for each other. Not all of us like each other (duh), but we all need to respect each Continued on page 34

JERSEY’S JOURNAL by Jersey Shore As I write this column I am sitting in a Coffee shop. Not so shocking for those who know me and my drug of choice, caffeine. The woman next to me has the cutest little Chihuahua pug dog named Stella. Stella is a shy and quiet little dog the kind you can’t resist petting and giving belly rubs and kissing! Give me a Dog over a baby any day. Stella was once owned by a homeless man and through good will, Stella’s owner finally agreed to let Stella have an actual home instead of living out in the streets not knowing what each day will bring. The love I received from Stella as I pet every inch of her warm soft fur was such a blessing. Unconditional love is such a wonderful gift. Animals don’t go out of their way to manipulate a situation to benefit from it. All they want is belly rubs and love. Like me! All I want is belly rubs and love. It’s not a lot to ask for. I think people should learn a lesson from animals. Their appreciation for small things like a meal and a treat to a free belly rubs. Touch alone is therapeutic, so with that said, who wants to give me therapy? It’s the small things that mean a whole lot, well to me. Money and mansions

It is important to note that by instructing the driver to exit the vehicle, the officer is still not committed to an arrest; this is simply another step in the DUI investigation process. Note that an officer may initiate Phase Two: personal contact, without Phase One: vehicle in motion. THE LAST WORD by George W. Zander Governor Jerry Brown today signed legislation authored by Senator Mark Leno and sponsored by Equality California that provides new protections for transgender foster youth. Senate Bill 731 ensures that all foster youth, including those who identify as transgender, are placed in appropriate homes where they feel safe and accepted. It requires caregivers tasked with placing foster youth in homes to take a young person’s gender identity into consideration when making this critical decision. “Young people have a better opportunity to thrive in situations where they are fully accepted and supported for who they are,” said Senator Leno, D-San Francisco. “Entering the foster care system is challenging for all youth, but it can actually be damaging for young people whose identities are not affirmed by their caregivers and peers.”
