The Anatomy of a DUI An Overview of Alcohol By Manuel J. Barba, DUI Defense Attorney The Anatomy of a DUI – Phase Two: Personal Contact (continued) By Manuel J. Barba, DUI Defense Attorney In the last article I discussed “divided attention” - the ability to concentrate on two or more things at the same time, as well an overview of Phase Two of a DUI stop – personal contact. Here, I will continue to the discussion of Phase Two in more detail. The officer’s first task in Phase Two is to observe and interview the driver, which begins as soon as the suspect vehicle and the police vehicle have come to complete stops. It continues through the officer’s walking up to the suspected DUI driver’s car and involves all conversation between the officer and the driver prior to the driver’s exit from the vehicle, as well as any observations made by the officer. The officer may have developed a strong suspicion that the driver is impaired prior to the face-to-face observation and interview by observing something unusual while the vehicle was in motion, or during the stopping sequence, or the officer may have developed NO suspicion of DUI prior to the face-toface contact. For instance, the vehicle operation and the stop may have been normal, and the officer may have seen no actions suggesting DUI. The officer may have sim20

ply stopped the vehicle for equipment or a registration violation, or some vehicle code violation such as speeding or failing to use a turn signal. I will note that in a large percentage of the DUI cases I’ve defended, there was no evidence of DUI prior to the driver’s face to face contact with the law enforcement officer. Thus, had the driver not been speeding, or failed to use a turn signal, etc., the driver would not have been stopped by the officer and thus not arrested for DUI. Therefore my advice is simple: Don’t give them a reason to pull you over! You can view my web site at www.BarbaLawyer.com and read one of my blog articles for ten tips to avoid a DUI conviction. Regardless of the evidence of DUI that may have been observed by the officer during Phase One while the vehicle was in still in motion, the officer’s initial face-to-face contact with the driver usually provides the first definite indications that the driver is under the influence. Face-to-face observation and interview of the driver allows the officer to use his/her senses to gather evidence of alcohol and/ or other drug influence: the sense of sight; the sense of hearing; and the sense of smell. Proper face-to-face observation and interview of the driver requires the officer to have the ability to recognize the sensory evidence of alcohol and/or other drug influence; and that the officer have the ability to describe that evidence clearly. The high holy days are upon us, no not Hanukkah, not Samhain, not Diwali, not Christmas (although there may be things we’d like to unwrap when we see them) or even Mabon, the pagan feast of the ingathering (although I think that one is the closest, described as “a thanksgiving for the fruits of the earth”). No dear readers I’m speaking of Palm Springs Leather Pride. Can’t you begin to smell it, the aroma of leather, the musk of testosterone and hot, sweaty bodies? Well it all starts this Thursday at 9 pm at Hunter’s Nightclub and wends its way through 4 days and 12 events guaranteed to make you thankful to the Leather gods for bringing us this celebration each year. Since last January Palm Springs Leather Order of the Desert has been planning and preparing, getting everything perfect for attendees from 26 states, Canada, France, Germany, the UK and Australia to come together for one weekend to celebrate all things Leather. Since back in the ‘90s when they hosted the first “Sweating Bullets” Run, PSLOD has invited Leatherfolk from around the world to gather in our Desert Oasis each year for a hot, sexy weekend celebration of Leather/Fetish fellowship and fun. Today, Palm Springs Leather Pride is one of our city’s most popular LGBT events and one of the largest, longest-running, and most successful Leather/Fetish Events in Southern California. This year start your weekend with us at Hunters Nightclub for the annual Meet and Greet where you can get an up close and personal look at our contestants and cruise/dance the night away. JERSEY’S JOURNAL by Jersey Shore Well, I’m realizing that most people in the public eye should have a platform. I actual do have a few platforms, and I don’t mean shoes. Well I do have platform shoes, so instead of a soap box to stand on, I’ll just rely on my shoes to be heard. Well, I’m sure you are wondering what a Jersey Shore platform would be? Well the less shocking would be Medical Marijuana legalization. I am a proud stoner. Oh no!!! A pot head!!! Pot is a gateway drug. NO it’s not!!! If anything I am amazed that medical marijuana is not being used more for research. I use it for just that reason. Medical. I suffer from Depression and Anxiety; I’ve had multiple major abdominal, knees, arm surgeries. I’ve been cut up and dragged through more physical and emotional stress than a victim of a Friday the 13 th Movie in the opening scene. We all need coping mechanisms to help up deal with pain and to get through life, and Marijuana is mine. It works for me. I am a proud pharmacy member, so I get it as legally as I can get it, but apparently there is more legal action to make it a done deal. I don’t really do the whole political thing, but I was approached by a nice man named Craig as he is trying to get the initiative on the ballot or something political like that. I’m just the pretty stoned face of it all. So, with that said on 48

THE LAST WORD by George W. Zander An estimated 6000 Californians are newly diagnosed with HIV. . These 6,000 annually will cost nearly $4.5 billion dollars. A significant reinvestment in HIV/AIDS funding now- to implement new prevention interventions and increase new HIV awareness linages and retention in care. The Elton John AIDS Foundation (EJAF), a leader in the global effort to end AIDS, announced Wednesday a new series of grants totaling $4.4 million to support organizations fighting the HIV/AIDS epidemic in critical and innovative ways. The Foundation is renewing 16 grants and funding nine new organizations to scale up programs that address societal trends driving the HIV/ AIDS epidemic. This is one of EJAF’s largest grant cycles to date.
