An Ode to My Big Brother Kimberlee S. LaClair I hate to write with a heavy heart when I write of my brother, Todd, he would hate that, but as time has passed since his death, I can’t help but notice the rain more. He and I spoke of the rain in a positive light; we spoke of rain in music, speaking of the different and unique rhythm each storm offered. As we exchanged poetic ideas of the drops hitting the windows or pavement, we’d exchange song titles about rain. Each time we learned a new song, we’d ode to each other when it played. Sometimes our conversation of rain would turn to shoes that still styled well drenched in water, trench coats with popped collars and matching umbrellas to accessorize our outfit and save our excellent hair day. We found in our “darkest” times the rain served as a sign of washing into a new beginning, sharing aspirations and the steps we planned to take and already started to reach our vast and unending goals. As Todd spent more time in the desert, I’d send photographs of rain and he’d long for the weather I experienced, imploring me to enjoy every second of every storm. Two days after Todd’s death, rain soaked my skin and the streets of New York for forty eight hours. I sat on the porch and watched the other side (whatever that may be) cry tears of joy over the bounding character they acquired. I hopped on my bicycle, put my headphones in and listened to the Mama’s and the Papa’s, Celine Dion, Cher, Judy Garland and many other “Todd favorites” and cried in mourning. Despite my sorrow, I sang and thanked the rain for the conversation it sparked between us. I begged the clouds to take care of my big brother and listen to his lovely voice in song and conversation.

Then I laughed, ‘cause I know the first thing Todd did when he hit the other side was dye his hair blonde and put on a pair of Steve Maddens. I’m not gonna dwell on the “demons” that caused Todd to make ill and interesting decisions in his short life. I’m being practical and accurate in saying no human holds perfection in their hands. I tried like hell never to judge a decision Todd made that I didn’t care for, and as I reflect personally and in memory, I realize I have no place to do so. I can say, however, with complete certainty that my big brother lived a remarkable life. I could go on for pages about him, and I can guarantee you’d be “wow’d” by his character. I grew up seeing Todd not as a gay man or any label, but as a lovely man who shed positivity in the dimmest of light. I remember as a child hearing Todd was coming to visit and pacing the house at his scheduled time of arrival. Todd was always late, but his tardiness only increased my anticipation and excitement rather than annoying or upsetting me. When I was nine years old, he came into my room and taught me to defend myself when someone was stealing food out of my lunch bag. When I stated my concern at the dinner table that evening, he rested his hand on my knee in support. He hated when any of us cried at any age, but I always remember that night he walked into my room unannounced. He saw tears in his little sisters eyes and helped her. Todd was like that with all of us every day I knew him. Todd suffered discrimination and bullying like no man should, but always lifted his head in those shameful situations and spoke with knowledge of brighter days. He didn’t believe in hope, only the act of one foot in front of the other. When sorrow filed him, he sang and smiled. Even on 9/11 when he lost close and personal friends, he dressed like Judy Garland and sang “God Bless America” for those who could only know to grieve.

The Anatomy of a DUI An Overview of Alcohol By Manuel J. Barba, DUI Defense Attorney

Chiefs of Police (IACP) - DWI Standardized Detection Protocol. All police officers are trained in these protocols at the police academy during their initial training.

My previous articles on the subject of Driving Under the Influence (DUI) have focused on a basic overview of alcohol, how it is absorbed, distributed, and eliminated from the human body, and how alcohol affects a person both mentally and physically.

In my articles to come, I will be discussing each of the above three phases in detail, along with the clues that law enforcement officers are looking for, so that you will know what law enforcement officers are looking for as you drive down the roadway.

Now the focus of my articles will shift to the actual DUI arrest from an arresting officer’s initial observations through the actual arrest. As an overview, a DUI investigation is divided into three (3) pre-arrest phases. Phase one is Vehicle in Motion – this is where an officer first notices a car as it is driving down the roadway. Phase two is Personal Contact – this is after the officer has decided to stop the moving car and will now contact the driver for an up close evaluation. Phase three is Pre-arrest Screening – this phase is where an officer attempts to evaluate if a driver is impaired or not to determine if an arrest for DUI should or should not be made.

In each of the three pre-arrest phases of DUI detection outlined above, law enforcement officers are trained to determine whether there are sufficient clues (evidence) to establish the “reasonable suspicion” necessary to proceed to the next step in the DUI detection process.

According to the “DWI Detection and Standardized Field Sobriety Testing” student manual, published by the National Highway Traffic Safety Administration (NHTSA), it is the officer’s “duty to carry out whatever tasks are appropriate to make sure that all relevant evidence of DUI is brought to light.” Unfortunately, some officers interpret that passage as “the end justifies the means.” Next week, Phase One- vehicle in motion in detail. LEATHER REALM by Dave Murdock “Leather/Drag/Whatever”. OK, now this is going to stir some feathers…. I mean stir some sh*#. It all begins with a question? What’s the difference between a drag queen and a Leatherman? Well, boys and girls, put your hands on your hips, turn your upper body side to side and say “Absolutely nothing!” OK, obviously one is a masculine representation and one is a feminine representation of the human spirit. But that begs the question. Deep down, what is the difference? Aren’t they both representations of a fantasy? The answer is, without a doubt, YES. I think that the major problem comes about because a Leatherman is ultra-masculine and the drag queen is ultra feminine (well, for the most part anyway) and it seems as though never the twain shall meet. Well, one place they dovetail together perfectly is, get ready for it, here it comes, The Sisters of Perpetual Indulgence. The Sisters aren’t drag queens, and they’ll be the first ones to say so, but they do dress in feminine style clothes and wear makeup (albeit it’s more like clown make-up). But, guess what? I don’t have solid figures for the worldwide order, but many of the Sisters I know from Palm Springs, LA, SF and Phoenix, are, when they’re not dressed as a nun, full-fledged Leathermen! In fact The SF Eagle was the first establishment designated an official Sanctuary by the SF Sisters for their frequent hosting of their beer busts. 28

So, let’s take a look at what a Sister of Perpetual Indulgence is. If you go to the San Francisco Sisters (the founding order of The Sisters) website (www.thesisters.org) you’ll find that they describe themselves as “... a leading-edge Order of queer nuns. ... (who) have devoted ourselves to community service, ministry and outreach to those on the edges, and to promoting human rights, respect for diversity and spiritual enlightenment.” Many nuns simply say that their quest is to spread universal joy and expiate stigmatic guilt while raising money for worthy charities or educating people about MRSA, AIDS, safe sex or whatever. The Sisters opened their Palm Springs chapter in 2007 if I remember correctly, and have been spreading their glitter all over our area ever since. In 2008 I had the good fortune to be at a grant dispersal for Gay Associated Youth (sadly now defunct). Picture it, G.A.Y. was putting on an art show when, who to their wondering eyes should appear, not 8 tiny reindeer but 3 nuns and a guard, done up in all their finest, and bearing a check for $4000. No one from G.A.Y. had any idea this was going to happen so it must have seemed truly like manna from heaven, because it allowed them to hold a GLBT Prom for teens and those that missed out on their own proms because they never got a chance to appear at their own prom with the date of their choice. Despair was not in Todd’s wardrobe; he preferred the sun behind the clouds; like the sun, Todd was always there to shine. My big brother was a diamond in the rough. I don’t look at his short years on earth and fixate on flaws. I can’t, he really was much better than the flaws he carried. I share the sorrow he insists we don’t have in is passing and miss him. For those who read his words in this paper, you know he held a remarkable talent with words. I speak for him when I insist to you that he adored sharing his words with you. As we grieve over his departure, I beg of you to join in taking what he left with you. I’ll never wear a pair of heels better than Todd, but I’ll consult my every outfit with him in prayer. When I lose track of my surroundings ‘cause a good song came on iTunes, I’ll know he’s lost in music with me. Pee Wee Herman’s laugh will always sound like Todd’s voice, and when I cry, I’ll think back to when I was nine years old and Todd told me exactly what to do to lighten my dark hour. When it rains, I’ll know he’s here with me. Todd’s chasing whatever dream he has no problem dropping everything for and he’s wrapping his arms around the family he adored every chance he gets. He’s watching over his friends too while reading this newspaper every day. No, we can’t hear him call and tell his story, but we can carry his stories with us, because in forty two years my big brother left us with high quality literature to add to our memory’s anthology. I love you big brother, your family loves you and the world you lived in love you too. I’ll honor your life with honest intentions and good music in my ear. JERSEY’S JOURNAL by Jersey Shore Who can turn the world on with a smile? Especially when you sit down upon it! And if that starfish is too tight, then you must learn to loosen up. Life should be fun and not a sphincter tightening experience. Just like farting, you always feel better afterwards. Let out those toxins. Better yet, if you are close to someone you dislike. My list is growing with people who stink, so time to stock up on beans! Most people must have shitty lives. Equal amounts of fiber and cheese keeps life regular. It cuts down on life’s way of crapping on you. So keep on flushing! Enough of that shit. Pun obviously intended. They say you’re never fully dressed without a smile, so if you wear one piece of clothing then let it be a smile. And like an STD a smile is contagious as well, so smile at everyone you see like a grinning idiot and let them wonder, what the heck is wrong with you”. The point is to spread cheer, but also keep people wondering. People will walk across to the other side of the road when they see a crazy person walking towards them. It helps when you need that well deserved alone time. 44

I like my alone time as I am always “on” as Jersey. So, if you decide to cross the road when you see me, it’s all good. I probably farted and my insides are always entertaining! that anyone could have made joy more universal that evening. So, here’s the quiz. Which group does outreach, which group educates, which group does community service, which group embraces diversity, and which group frees the human spirit? If you had said “The Sisters of Perpetual Indulgence” you’d be right. But guess what, if you’d said Leathermen you’d also be right. In the Leather community I’ve taken part in countless fundraisers for a plethora of causes. So have the Sisters. As a Leatherman I champion the right of each human being to find his or her enlightenment in whichever way they find the most pleasing, so do the Sisters. As a Leatherman I find that a good play session releases the human spirit from the chains of day to day living. For the Sisters they accomplish the same thing by dressing up, wearing outlandish outfits and make-up and putting on a persona that isn’t their normal outward manifestation. So, the next time someone asks you the difference between a drag queen and a Leatherman, rather than get mired down in symbology and long-winded explanations, just say “The Sisters of Perpetual Indulgence”!

THE LAST WORD by George W. Zander The codes of conduct for complaints is pretty clear. Signs can go on private yards at the will of the owner. That is up for a constitutional visit, maybe the SCOTUS. Signs that appear on the side of the road without checking with the owners is a violation...This includes Indian and private ownership, as well as signs displayed that are put up by businesses, Sun Line and other government signs. Including signs where the Planning Dept posted signs and the candidate put you a political sign. These rules are set and not subject to the law suit. Irony. J.R. Roberts Campaign is putting up campaign signs that are illegal. They are too soon (before Oct 3) and on places they cannot be. Some signs are protected...They are signs that are in residents’ yards or on buildings where owners have given permission. It appears Roberts campaign is putting signs on locations where they are trespassing. They are on land where property owners have not been asked, in public right of way, such as Sun Line and other signs that are not allowed. For someone who sat on the PS Planning Commission, this is particularly egregious. They are a blight on our historic districts .

For someone who received a campaign donation of $20,000 from the Palm Springs Modern Heritage Fund and there has been no press release for the huge contribution, you would think that this campaign would be more careful with blight. The PSMHF can do whatever they wish, they are a C4 lobbying group. But this campaign is put on notice to take down those illegal signs or expect code enforcement to be alerted.
