The Anatomy of a DUI An Overview of Alcohol By Manuel J. Barba, DUI Defense Attorney In the last article I began the discussion of Phase Two of a DUI stop – personal contact. Here, I will continue that discussion focusing on the officer’s use of his/her senses of sight, hearing, and smell during the personal contact phase as well as the officer’s questioning techniques. Remember, the officer’s first task of Phase Two is observation and interview of the driver which begins as soon as the suspect vehicle and the patrol vehicle have come to complete stops. Face-to-face observation and interview of the driver allows the officer to use his/her senses of sight, smell, and hearing to gather evidence of alcohol and/ or other drug influence. With regard to the officer using his/her sense of sight, there are a number of things the officer might see during the interview that would be describable clues or evidence of alcohol and/or other drug influence. The officer may see red, watery, bloodshot eyes, soiled clothing, fumbling fingers, or alcohol containers in the car, drugs or drug paraphernalia, bruises, bumps or scratches on the driver’s body (indicating the driver may have fallen down at some point), or other unusual observations.

With regard to the officer using his/her sense of hearing, the officer might hear the following describable clues or evidence of alcohol and/or other drug influence: slurred speech, admitting to drinking (umm, I had two beers), inconsistent responses, abusive language, or other unusual statements. And, with regard to the officer using his/ her sense of smell, the following are things the officer might smell during the interview that would be describable clues or evidence of alcohol and/or other drug influence: the odor of an alcoholic beverage, marijuana, “cover up” odors like breath sprays, the odor of vomit, or other unusual odors. While the officer is using his/her senses of sight, hearing, and smell to gather information, the officer is also asking questions to test the drivers “divided attention” abilities. The officer does this by asking distracting questions while asking the usual questions. For instance, after asking for the driver’s driver license, the officer may immediately ask the driver for proof of insurance and then registration. The impaired driver may produce the license, but not the insurance document, or may not find either as the driver becomes confused while fumbling through the glove compartment. Essentially the impaired driver may forget what he/ she was looking for. Another example of asking an interrupting or distracting question is, after asking for the driver license, the officer might ask the Continued on page 49

LEATHER REALM by Dave Murdock “And the new Mr. Palm Springs Drum roll please…and the new Mr. Palm Springs Leather 2016 is Christopher Durbin. Christopher entered the contest as Mr. Hot Rodeo 2015 and competed against 6 other great contestants, including 1st Runner Up – Steve Juneau – Mr. Off Ramp Leathers, 2nd Runner Up – James Bork – Mr. Chill Leather, Mr. Copa Leather Aaron Jones, Mr. Tool Shed Leather Jeff Maxwell and Mr. Barracks Leather Mark Austin. Christopher will go on to Chicago to represent the Palm Springs community at the International Mr. Leather contest next Memorial Day (see www.imrl.com for more details). The leather weekend festivities began with the meeting of contestants and judges at Hunters Nightclub on Thursday night. It was here that the contestants drew their numbers for the order they would compete on stage during the contest. The prestigious judging panel consisted of (in alphabetical order) Esteban Bartholo – Mr. Bullet Leather 2015 and community activist, Randy Carmenaty – American Leatherman 2008, Randall “Bear Man” Klett – owner of the Werks company’s and Stompers Boots and a C.L.A.W. board member, Sandy “Mama” Reinhardt whose “Mama’s Family” of over 2000 men and women raise over $3,000,000 a year for various charities (and a family yours truly is proud to be a part of as Mama’s PS Leather Daddy), Patrick Smith – International Mr. Leather 2015, Clifton Tatum – Mr. Palm Springs Leather 2015 (who raised over $20,000 for his 5 youth charities in his title year, and last but not least Dan Woodward – San Diego activist. The contest this year was very ably helmed by Drew Kramer with MC duties again being taken on by one of the best MC’s in the Leather Community, Lenny Broberg. The

tally masters duties were filled by Karen Atkins and Tom Pardoe. Friday afternoon was the opening Pool Party at InnExile, hosted by Clifton Tatum, Friday early evening was the Formal leather Dinner at the beautiful Hilton Hotel, and the day was capped off by the huge crowd of about 1800 people checking out the items at the vendor market (and each other at one of our favorite events, the Cruise Party/Vendor Market at the Tool Shed. Saturday afternoon saw cigar and pipe aficionados at The Barracks enjoying their smokes and showing off their gear, and Saturday evening was the capstone event of the weekend, the Mr. Palm Springs Leather Contest in the scenic Grand Concourse at the Palm Springs Convention Center. Finally, later that evening, and sure to be an event that will continue, the Victory Dance and Cruise Party at The Barracks which was literally balls to the walls with hot men cruising drinking and dancing. Sunday was the annual BBQ and wet t-shirt contest helmed by Christopher Durbin who did an amazing job with what seemed like half the attendees entered and which saw the current Mr. Regiment from the Regiment of Black and Tan’s walking away with the top prize. Running concurrently was a first this year, a Leather Women’s brunch hosted by PSLOD members Nina Ruedas and Karen Atkins CONGRATULATIONS again to Christopher Durbin, and his hot and sexy band of competition brothers. AdamsArtExpos’e THE HISTORY OF THE STRIPES OF GAY PRIDE The struggle for Gay rights in the Western World is now epitomized by the rainbow flag. During the 1940’s, 50’s and 60’s, the pink triangle signified gay recognition and rebellion. Borrowed from the Nazis who forced gay people to wear this symbol to identify and persecute. During the 1970’s a young gay artist named Gilbert Baker in San Francisco was inspired by Harvey Milk. Milk is well known as the first openly gay polititian and activist elected to the Board of Supervisors of the city of San Francisco. Milk challenged Baker to design a symbol of gay hope to represent equality and acceptance. Baker selected the rainbow, which he arranged in stripes of the spectrum. Originally the design included eight colors. Each color was to represent a meaning. At the top of the design was hot pink representing sexuality. next, red, representing life: orange, healing; yellow, sunlight; green, nature; turquoise, magic and art; indigo, serenity and harmony; and violet, spirit. These colors were used in the first flags flown in the 1978 San Francisco Gay Freedom Day Parade in June of that year.

Riots in 1994, Baker was commissioned to create the worlds largest rainbow flag. It used the six colors and was 30 feet wide. It is recognized today as the world’s largest flag by the Guinness Book of Records. The flag was reduced to six colors in 1979, which is used most widely today. These colors are: red, orange, yellow, green, blue, and violet. This design is recognized today as the symbol of gay pride and recognition. It is used in varied creative applications such as bumper stickers, jewelry, clothing, etc. as well as the flag. Undoubtedly we will see other applications during Gay Pride Week in Palm Springs. In June of this year, 2015, The Museum of Modern Art adopted the rainbow flag as part of it’s official design collection.

JERSEY’S JOURNAL by Jersey Shore I don’t expect a lot from people these days. I aim low and just expect to worst treatment and if someone does a good thing, like keeping their word or opening a door for you. I’ve had door slammed on me from inconsiderate people or opened door with not even an eye glance never mind a simple Thank you. Small things mean a whole lot more than you realize. Common courtesy doesn’t exist. When I find someone acting like a courteous human I am more shocked than I would by the lack of decency. Now what does that say about us as human beings sharing the earth? It’s interesting that we have LOL, BRB, LMAO, TTYL, and JK as the ever so popular text abbreviations, but I have NEVER encountered a TY. Did I just make up the code for Thank You? If it exists I’ve never seen it on my phone. We should be Thanking people more than Laughing out Loud. If we do LOL shouldn’t we Thank them for the laugh? So LOL, TY? We are just a rude and inconsiderate society. It’s sad. Everyone is ME, ME, ME! Well, cohabiting with others involves team work, so the me, me, me needs to be ALL, ALL, ALL or we’ll end up at war or something like that. Oh, wait, we are still in a war. Fancy that??? Why are the easiest things to follow through on the most effective? Yet we feel the need to complicate things. I live a simple easy life with no stress or com-

plication. I’ll probably out live the overly stressed and complicated person, but why would I want to live in this disgruntled, negative world any longer. I figured if you screwed it up then you should have to suffer through it. I wonder if there is an island of Happy, naked, kind men somewhere that I can escape to while people in this space slam doors and screw people over for a dollar. Where a Manwhich is a manwhich and a thank you is ideal. You spread STD’s around without an ounce of consideration so what’s a Thank you every leap year? before, therefore the officer can not compare the alleged impaired behavior from the driver’s normal behavior. Perhaps the driver always behaves that way or perhaps the driver is simply nervous.
