The Anatomy of a DUI An Overview of Alcohol By Manuel J. Barba, DUI Defense Attorney In my last article I discussed the dose-response relationship of alcohol. But before I move the discussion to the mechanics of an actual DUI arrest, I believe it is important to give readers an understanding of the effects of alcohol from a clinical perspective. As you’ll see, throughout the various stages of intoxication discussed below, overlap in the blood alcohol concentration (BAC) levels will occur because alcohol does not affect every person the same at any given point. BAC Levels/Effects From 0.01 - 0.05, a person is considered to be in the “subclinical” stage. In this stage a person’s behavior is nearly normal by ordinary observation; a drink or two for most people. From 0.03 - 0.12, this is considered the “euphoric” stage, with a person’s symptoms being that of mild euphoria, increased sociability, talkativeness, increased self-confidence, and decreased inhibitions. Symptoms also include diminution of attention, judgment and control, which can affect safe driving. This stage is also the beginning of sensory-motor impairment and the loss of efficiency in finer performance tests, which can also affect safe driving. I am certain that we’ve all experienced persons in this stage. In fact, it is likely that many of us can attest to being in this stage! From 0.09 - 0.25, a person is considered to be in the “excitement” stage. Symptoms in this stage include emotional instability and loss of critical judgment. Also, impairment of perception, memory and comprehension can

also result at these BAC levels. A decrease in sensory response, reaction time, reduced visual acuity, peripheral vision and glare recovery also occur. In this stage, a person can also experience sensory-motor in-coordination, impaired balance and drowsiness. All of the foregoing symptoms can affect a person’s ability to drive a car safely. This stage is where an individual would be considered “drunk.” From 0.18 - 0.30, referred to as the “confusion” stage, a person’s symptoms include disorientation and mental confusion; he/she can experience dizziness as well as exaggerated emotional states. In this stage a person’s vision, perception of color, perception of form, perception of motion and perception of dimensions becomes impaired. Symptoms also include an increased pain threshold as well as increased muscular in-coordination, which includes staggering gait, slurred speech, and lethargy. Apathy is also a present in this stage. Can you say “really drunk” or perhaps “trashed”? And yes, the foregoing symptoms make a person unsafe to drive a car. From 0.25 - 0.40, a person is said to be in the stage of “stupor.” In this stage, symptoms include a loss of motor functions and a markedly decreased response to stimuli. In addition, muscular in-coordination including the inability to stand or walk also occurs. Vomiting, incontinence, impaired consciousness, sleep or stupor can also result. Here, the term “wasted” comes to mind. And yes, a person is not safe to drive a car with these conditions. From 0.35 - 0.50, a person is considered to be in the “coma” stage, wherein he/she is completely unconscious. The person experiences depressed or abolished reflexes, subnormal body temperature, incontinence, and impairment of the circulation and respiratory systems. LEATHER REALM by Dave Murdock “It’s all up to YOU!”. Coming up on September 27th is Folsom Street Fair (http://www.folsomstreetfair. com/), advertised as the “The World’s Largest Leather Event” and that’s no hyperbole! With over 400,000 attendees and covering 13 city blocks, and it’s a wild, hot ‘n sexy event, dripping with Leather with lot’s of primal energy and testosterone floating about. (Some baby strollers too, go figure!) In fact that leads right in to what I wanted to talk about this week. Today’s America is oh so civilized. We don’t talk about primal urges in ‘polite’ society. But as homo-sapiens we all have dark desires, and sometimes even darker thoughts. No one wants to talk about them because we might have to come face to face with our darker selves. We can’t let those feelings out because they aren’t ‘civilized’. But just scratch the surface of that veneer on any one of us and you’ll find a beast waiting to escape from its cage. Love/Hate, Life/Death, Pleasure/Pain are all divided by very thin lines. Each positive primal urge has it’s opposite side, and not understanding the dividing lines between them can, in some cases, lead to events like mass shootings and serial killers. Not learning to deal with raw issues forces us into a pressure cooker of primal instincts that would best be dealt with on a psychologists couch. Well, I’m no psychologist, but I think that because we, as a society, repress all of the 28
darker urges they just lay there, simmering away, waiting to boil over or explode. As a society we have no safety valve to blow off the steam created by the pressure cooker of our ancient urges or our present day ones for that matter. But as Leather folk we actually have a mechanism to do just that. Our play, by definition, centers around pain and pleasure, we deal with possible life and death issues every time we play. The submissive may hate the pain (or not), but love the pain-giver (or not). However, the Leather community gives permission to us, and we have given permission to our play partners to scream out loud whether from pain or pleasure it matters not. What matters is the scream, the release of all those daily tensions we build up each minute of our waking lives. stage. From 0.45 and above, death is likely from respiratory arrest. What many people don’t realize is that one’s BAC level continues to climb even after we stop drinking. Consider our hypothetical friend Jack, who starts the evening off with 2 or 3 beers, then he adds 3 or 4 more cocktails, and perhaps 4 or 5 of his favorite shots along the way. As Jack’s BAC rises, he will pass through each of the stages of intoxication discussed above until his BAC peaks. The danger is, because of Jack’s impaired judgment (that can begin as early as the “euphoric” stage) Jack may not make the best decisions and may jeopardize his own safety or someone else’s. Perhaps Jack gets home after the bar closes and decides to go for a swim to cool off. If Jack’s level of intoxication reaches the “confusion” stage while in the swimming pool, he could very easily drown. Remember, once the alcohol is in your stomach, it will continue to absorb into your blood stream causing your BAC level to continue to climb. It is not until after your BAC level has peaked, that it will start to decrease. Cinema Diverse: The Palm Springs LGBTQ Film Festival Returns with more films in more theatres, and adds New Media Component Cinema Diverse: The Palm Springs LGBTQ Film Festival, opens its Eighth Edition on Thursday, September 17th and runs through Sunday, September 20th at the Camelot Theatres in Palm Springs. This year the festival is a third larger than ever before, and includes a New Media Spotlight on Saturday, September 19th. “We are very excited to have been able to grow the festival, and increase our total number of screenings again this year,” said Michael C. Green, Festival Director. “”Last year we hosted a record number of screenings in two theatres, and this year we’re taking all three theatres at the Camelot, plus we’re adding the New Media Spotlight that Shann Carr from Moxie Productions created for us with the help of Brett Chatelain. It’s all about the variety of LGBT content that’s available on the internet.” Cinema Diverse, which began in 2008, was one of the first programs produced by the Palm Springs Cultural Center, and continues to be one of the most popular programs the local nonprofit produces. “The festival ran into some bumps in the first couple of years,” Green continued. “But over the past five years, the community has really come out in force to embrace it. And that’s not surprising, given the large LBGTQ population in the valley. There’s quite a demand for this type of entertainment, and we’re thrilled to be able to bring the films and the filmmakers to our local audience.”

So, whatever issues you have with me, keep them to yourselves. It doesn’t concern me and I am FINALLY going to celebrate the small gifts given to me. I’ve been working hard for 20 years and been thru a lot. I don’t lie, steal, hurt, etc., etc. . . . Let me do my little shows and live my little life with my dog and my friends! It’s not easy being pleasant when you suffer depression and anxiety, but I try hard. Just because everyone else acts like an asshole doesn’t mean I must. It’s not easy being nice. I’m horrible behind the steering wheel. Either do the speed limit or drive faster or I will be honking you right into the slow lane. And they invented blinkers for a reason. They serve a purpose. They prevent accidents, so get off your cell phones, yes you knew that was coming, and click the conveniently located blinker so I know which way you are going so I don’t run into you. I’m sure you knew this was coming…Cell phones!!! Just today two cars reared into the curb down Palm Canyon because of texting. It takes 10 to 20 minutes to go most places across the desert. Quit being an impatient self-centered shmuck and remember what it was like in the 1970s. You had to actually be at home to get a phone call. And that is as it should be. We may live our daily lives encased in suits and exchange the harness for a tie, but when it comes to play time we have learned to rip off, sometimes literally, those veneers and get right into the meat of the matter. We tear at societies boundaries, chewing off the leg irons of civilization. It gives us the release that we all want, but seldom take advantage of. By understanding the desires, and giving into them in a controlled manner we have created our own pressure valves to blow off the steam that builds up from living our daily lives.
