The Anatomy of a DUI An Overview of Alcohol By Manuel J. Barba, DUI Defense Attorney Last week I discussed the effects of alcohol from a clinical perspective showing the various stages of intoxication at various Blood Alcohol Concentration (BAC) levels. Why is this important information to know? When a person is arrested for driving while under the influence of alcohol, the arresting officer will note the persons symptoms and behaviors in the arrest report, thus knowing what an arresting officer is looking for is important to possibly avoid a DUI conviction. For example, a person who has a BAC level of 0.09 to 0.25 would very likely appear to be intoxicated as they would likely exhibit symptoms of mental impairment - impaired perception, memory, comprehension, and physical impairment – impaired motor skills, coordination, and balance.
son who has a 0.20 BAC, thus there was a “disconnect” when comparing the person’s behaviors to the 0.20% BAC. For example, the arrest report had no indications of mental and physical impairment. Signs of mental impairment: the person fumbled to get his driver license out of his wallet, or had a hard time finding his registration, or asked the police officer to repeat a question, or did not know where he was, etc. Signs of physical impairment: a person lost his balance while exiting the vehicle, swayed while standing, slurred speech, could not perform field sobriety tests, etc. Because the arrest report did not indicate symptoms of mental and physical impairment consistent with a person that has 0.20% BAC, there must be something wrong with the 0.20% BAC result. Recently, I was talking with a person (who shall remain nameless) that had been arrested for DUI and was represented by the public defender. This person told me that the public defender advised him that his BAC result was 0.40% and that the public defender advised him to plead guilty, so he did. This person also told me that at the time of his arrest, he thought he did well when performing the field sobriety tests that were given by the arresting officer. I was amazed when I heard this story, because it would be impossible for a person with a 0.40% BAC to perform ANY field sobriety tests. A person with a 0.40% BAC would likely be in coma and near death, so there had to be some Continued on page 34

LEATHER REALM by Dave Murdock “Dame Inuendo and Miss Smear”.
I guess it’s just because the desert is a relatively small community, at least compared to New York or Los Angeles, but I have become very aware over the past few years of the dangerous effects of gossip and smear tactics practiced by small people in our community. No, I’m not going to name names, you all know who you are. And I guess to a certain extent I understand the urge, after all, who doesn’t love a juicy bit of gossip? BUT ”Did you see what she was wearing last night?” is a far cry from “Do you believe what I heard about Mr. X?” and then go on to repeat it, probably inaccurately. In most cases I believe that the sticks and stones theory is the best method for dealing with these people, because the more their campaigns are talked about the more power they perceive they have. Now please note that I’m not talking about responsible journalists who research their articles and make sure that what they are repeating have a basis in actual fact. In those cases, if someone writes (or says) “Mr. X is causing a problem in our community and I have the facts to back that up, and the facts are…” and goes on to prove his or her point, then I don’t 28
have a problem with it. If their facts are wrong and they haven’t done their job then they deserve to be called out in front of the entire community and exposed. Unfortunately the pervasive trend seems to be of the “When did you stop beating your wife?” variety. There is no answer that can possibly be given that will sound credible because the underlying question is malformed. This type of sleazy FB post or malicious gossip has no place in any part of our community and certainly not in the Leather community. Leather starts off with the basic credo’s of “Trust, Honor and Respect”. And if those credo’s aren’t followed then the person writing the article has absolutely no valid reason for calling themselves part of the Leather community because they have violated the basic credo of the Leather clan. So, here’s a challenge to all of you. Before you blatantly blather on about things you haven’t done research on, in which case cite your sources or say “This is only what I’ve heard, I’ve been unable to verify the accuracy of the statements, and as it stands now it’s gossip”. That way, at least if you’re go-

Because police officers are looking for “symptoms and behaviors” indicating impairment, I advise persons to always take a blood test and NEVER take any breath tests (unless the person is under 21 years of age or on probation for a prior DUI conviction). When a person takes a blood test to determine their BAC level, the arresting officer will not know the results of the test for weeks, and the report will have been written without the arresting officer having the knowledge of the BAC result in mind. Thus the arrest report will likely be more “objective” and honest. If an arresting officer knows the BAC result because the driver agreed to take a breath test, the arresting officer will write his report having the BAC breath result in mind. So now the officer will list symptoms and behaviors that correspond to the known BAC result. You might be thinking “would a police officer write things in an arrest report that didn’t happen?” My response is “umm, what do you think?” Attorney Manuel J. Life should be fun and not a sphincter tightening experience. Just like farting, you always feel better afterwards. Let out those toxins. Better if you expel closer to someone you dislike. My list is growing, so time to stock up on beans! Most people must have shitty lives. Equal amounts of fiber and cheese will keep life regular. Cuts down on life’s way of crapping on you. So keep on flushing! The way I describe things might seem a little too much for some, but if that visual proves a point, then it worked. I watch people continuously make the same mistakes over and over and NEVER seem to learn from them, so if you put a spin or a flush then maybe one person will learn something? Oh heck, who am I kidding? People are creatures of bad habits! If the car isn’t totaled then you have another opportunity to see what you can get away with before someone dies from your stupidity.

That’s where this articles title comes from because it’s not reality it’s only innuendo and/or smear tactics and the harm can become irreparable. And when someone passes on a bit of gossip, ASK THEM WHERE THEY GOT THEIR INFORMATION, AND HOW RELIABLE IT IS. I know, somehow that takes all the fun out of it, but it also doesn’t risk a persons standing in the community. The transgender woman, Shadi Petosky, said Tuesday in an interview that T.S.A. officers at the Orlando International Airport calibrated the full body scanner for a woman, and the device flagged what officers called an “anomaly” in the groin area. even though she had explained that she is transgender. THE LAST WORD by George W. Zander The codes of conduct for complaints is pretty clear. Signs can go on private yards at the will of the owner. That is up for a constitutional visit, maybe the SCOTUS. Signs that appear on the side of the road without checking with the owners is a violation...This includes Indian and private ownership, as well as signs displayed that are put up by businesses, Sun Line and other government signs. Including signs where the Planning Dept posted signs and the candidate put you a political sign. These rules are set and not subject to the law suit. Irony. J.R. Roberts Campaign is putting up campaign signs that are illegal. They are too soon (before Oct 3) and on places they cannot be. Some signs are protected...They are signs that are in residents’ yards or on buildings where owners have given permission. It appears Roberts campaign is putting signs on locations where they are trespassing. They are on land where property owners have not been asked, in public right of way, such as Sun Line and other signs that are not allowed. For someone who sat on the PS Planning Commission, this is particularly egregious. They are a blight on our historic districts .
For someone who received a campaign donation of $20,000 from the Palm Springs Modern Heritage Fund and there has been no press release for the huge contribution, you would think that this campaign would be more careful with blight. The PSMHF can do whatever they wish, they are a C4 lobbying group. But this campaign is put on notice to take down those illegal signs or expect code enforcement to be alerted.
