The Anatomy of a DUI An Overview of Alcohol By Manuel J. Barba, DUI Defense Attorney In my last article I provided a brief overview of how alcohol affects Men different than Women. In this writing I will discuss dose-response relationship of alcohol. Dose-Response Relationships People sometimes ask, “how ‘high’ is ‘drunk’?” What is the “legal limit” for “drunk driving”? How much can a person drink before becoming “impaired” or “under the influence”? There is no simple answer to these or similar questions, except to say that any amount of alcohol may affect a person’s ability to drive to some degree. It is true that California has established a BAC (blood alcohol concentration) limit of .08 (grams of alcohol in every 100 milliliters of blood) which makes it explicitly unlawful to operate a vehicle at the .08% BAC level (Vehicle Code §23152(b)). But California also makes it unlawful to drive when “under the influence” of alcohol, (Vehicle Code §23152(a)), thus the law admits the possibility that a person may be under the influence at much lower BAC. How much alcohol does someone have to drink to reach these kinds of BACs? Obviously, it depends on how much time the person spends drinking, on whether the person is a man or a woman, on how large the person is, on whether the drinking takes place on an empty stomach, has a full meal

before drinking, and on certain other factors. For example, if an average 175-pound man drinks two beers, or two shots of whiskey in quick succession on an empty stomach, his BAC will climb to slightly above 0.04% on average. Two more beers will boost him above 0.08%. In one respect, then, it doesn’t take very much alcohol to reach the illegal BAC level or to reach a level that impairs someone - a couple of beers can do it. Keep in mind that although the above example assumes an average 175-pound man, there really is no average person as each of us metabolizes alcohol at different rates at differing times. Practical Application It is important to understand the information provided in this article (and the previous articles) because it sets out the factors that affect a person’s blood alcohol concentration in relation to their alcohol consumption. By understanding these factors, a person can better control his/her own behavior relating to alcohol consumption and their resulting BAC. For example, if a person sips two drinks (one drink per hour) after eating a high protein meal, the digestion process will break down some of the alcohol thus lessening the amount of alcohol that enters the blood stream. In addition, absorption of alcohol into the blood stream will take longer, thus allowing the body to burn off the alcohol that has already entered the blood stream. Assuming the 0.015% BAC burn off rate per hour, if a person absorbs 0.015% BAC per hour (two-thirds of a drink per hour for males, one-half a Continued on page 42

LEATHER REALM by Dave Murdock Coming up on September 27th is Folsom Street Fair (http://www.folsomstreetfair. com/), advertised as the “The World’s Largest Leather Event” and that’s no hyperbole! With over 400,000 attendees and covering 13 city blocks, and it’s a wild, hot ‘n sexy event, dripping with Leather with lot’s of primal energy and testosterone floating about. (Some baby strollers too, go figure!) In fact that leads right in to what I wanted to talk about this week. Today’s America is oh so civilized. We don’t talk about primal urges in ‘polite’ society. But as homo-sapiens we all have dark desires, and sometimes even darker thoughts. No one wants to talk about them because we might have to come face to face with our darker selves. We can’t let those feelings out because they aren’t ‘civilized’. But just scratch the surface of that veneer on any one of us and you’ll find a beast waiting to escape from its cage. Love/Hate, Life/Death, Pleasure/Pain are all divided by very thin lines. Each positive primal urge has it’s opposite side, and not understanding the dividing lines between them can, in some cases, lead to events like mass shootings and serial killers. Not learning to deal with raw issues forces us into a pressure cooker of primal instincts that would best be dealt with on a psychologists couch. Well, I’m no psychologist, but I think that because we, as a society, repress all of the 28

darker urges they just lay there, simmering away, waiting to boil over or explode. As a society we have no safety valve to blow off the steam created by the pressure cooker of our ancient urges or our present day ones for that matter. But as Leather folk we actually have a mechanism to do just that. Our play, by definition, centers around pain and pleasure, we deal with possible life and death issues every time we play. The submissive may hate the pain (or not), but love the pain-giver (or not). However, the Leather community gives permission to us, and we have given permission to our play partners to scream out loud whether from pain or pleasure it matters not. What matters is the scream, the release of all those daily tensions we build up each minute of our waking lives. Once drinking stops and all alcohol is absorbed into the blood stream the BAC will have reached its peak (represented by peak on the bell curve), and will then start to decrease because the burn off rate (0.015 per hour) will burn off the alcohol in the body until it is all metabolized and BAC reaches 0.00%. A person that peaks at .15 BAC will return to 0.00 BAC in about

THE LAST WORD by George W. Zander For so many reasons, I am thrilled at the early progress of the Palm Springs Homeless Task Force. Yesterday was the second meeting. David Ready attended the entire meeting. The Police Chief Al Franz and three officers were there. Representatives from all the Sub-committees gave progress reports. The sub-committees are Housing, Youth, Mental Illness and Addiction, and Jobs. The PSPD is now training two new community officers that are trained in social needs and skills. The group is just what many of us have envisioned for nearly a year. All aspects of this issue represented by experts in the field. I was pleased, with the recognition from the Riverside County outreach folks that recognized that between 40-50% of homeless youth are LGBTQ. Equality California has been working all year on many Youth issues and this is one of our city’s most brutal statistic. The discussion ranged from how to help Homeless folks deal with petty tickets, to finding jobs and housing and food and a clean place to be safe. For those who see this group as an upcoming city commission, that is exciting. Finding resources from the City, County, State and Federal government that are available was exciting as well. David Ready and Ginny Foat actually mentioned that City Hall is ( even I teared up) Measure B funds can be allocated to many aspects to help our homeless residents. WOW! There are millions of B tax generated dollars out there

from Measure B. Many folks discussed how to educate the community at large to engage in this project and eliminate Nimby reactions. So many wonderful ideas, but not pie in the sky. Practical substantive work is being done already by many. Thanks to all including Ginny Foat, Joy Brown Meredith, Arlene Rosenthal, Doug Hairgrove, Maureen Ferriter, Lisa Middleton and many more. The other exciting thing was about 15 residents showed up, joined in the discussion, and a few joined us on sub-committees. The action and the professionalism and determination will prove that our city can be a shining example of how to work together with this very important issue to he benefits of all!!
