The Anatomy of a DUI An Overview of Alcohol By Manuel J. Barba, DUI Defense Attorney Top Four Reasons to NEVER, EVER Blow into an Alcohol Breath Testing Machine - Instead, Always Request a Blood Test! It has always been my opinion that one should NEVER-EVER blow into an alcohol breath testing machine if you are being investigated for DUI by a police officer. Having said that there are two exceptions: (1) if you are under the age of 21, you must blow into a breath testing machine if requested by an officer, because if you refuse you could lose your driving privilege for one year. The second exception is if you are currently on probation for a prior DUI conviction, you must also blow into a breath testing machine. This is because one of the terms of probation is that you not drive with any measurable amount of alcohol in your blood. Again if you refuse to blow into the breath testing machine you could lose your driving privilege for one year, plus you may get additional punishment from the court for violating the terms of your probation. Unless one of the two exceptions above applies to you, here are FOUR reasons why you should NEVER blow into an alcohol breath testing machine when asked to do so by a police officer: Reason #4: You don’t have to. Usually while conducting a DUI investigation, the officer will want you to blow into a Preliminary Alcohol Screening (PAS) machine. You have the right

to decline this test. Specifically, Vehicle Code 23612(i) requires that the officer advise the person that the PAS test is voluntary and the person has the right to decline the test. So if you have the right to decline the test, why would you do it? Unfortunately, many officers won’t tell you this and instead say “you must blow into this” and then later claim that he/she did advise you that it was voluntary - yes, they do lie! So know your rights! Reason #3: If you blow into a Preliminary Alcohol Screen (PAS) machine, or even an Evidentiary Breath Test (EBT) machine, the officer will know the result immediately and will have that result in mind when writing the arrest report, which will likely now be written more creatively with embellished observations to support his arrest. If you don’t blow into an alcohol breath test machine and instead request a blood test, the officer will have no idea what the result is because it takes time for the blood sample to be analyzed. By the time the blood test result is available, the officer’s report will likely have been written and its content will likely be more objective since the officer wrote it not knowing the blood test result. Reason #2: As discussed in my previous articles, some of the alcohol may never reach the blood system due to it being broken down in the stomach, assuming one has food in the stomach. If a person has eaten before drinking, or eats food while drinking, this will slow down the absorption of the alcohol. Remember food has to be digested in the stomach before it can pass to the small intestine, where most of the absorption takes place. If alcohol is in the stomach along with the Continued on page 34

Leather Pride weekend preparations are in their final stages, YOU can read all about the weekend at www.desertleatherpride.com. All of the feeder contest dates are now set (mostly) in stone, and the individual bars/organizations are getting ready to host their contests. So, what’s left? Hmmmm? Well, how about contestants? All any event producer can do is try their hardest to make an event interesting and worthwhile participating in, past that it’s up to YOU, John Q. Public, to make the event happen. This year we have 6 bars or businesses or organizations participating, ranging from Leather/Levi bars to nightclubs. YOU probably frequent at least one of them, and YOU probably frequent 2 or 3, depending on the night, your mood or the phase of the moon. As I said, there’s a wide range of bars holding contests this year so YOU can pick and choose which bar/business YOU would like to represent at the Mr. Palm Springs Leather Contest on October 31st. “OK” I here YOU ask, “Why should I enter a contest?” Well, I hope to convince YOU of that in the next few paragraphs. 28

First of all YOU don’t have to be an Adonis to enter any of these contests. In fact just a very small portion of the contest is scored on appearance. Nor do YOU have to have a talent, there’s no baton twirling or tap dancing. What contest producers are looking for is a genuine person who is willing to whore himself out for the good of the community. Naturally an outgoing personality helps, but I don’t see too many wallflowers at our local bars, so that shouldn’t be a problem. Maybe it’s stage fright? Well, I tell YOU what, when YOU get up on that stage just picture the audience naked…. (well, maybe not, YOU might get too excited to continue). Just make believe you’re talking to a friend on one of our noisy local patio’s. Speak up Louise! Other than that the main thing is to have fun! If you’ve got a smile plastered on your face and a good heart, a modicum of public speaking ability, and the willingness to help out our community then YOU have what it takes to be a winner. YOU also don’t have to memorize every bit of Leather history. Naturally it’s a good idea to have the basics down, things like who designed the Leather Pride Flag? (Tony DeBlase (and no, he never told anyone what the colors meant)). Who is the current International Mr. Leather? Gee, that’s a toughy, it’s LA’s own Patrick Smith! food, the alcohol will also remain in the stomach while the food is being digested. Thus, some of the alcohol trapped in the stomach will begin to break down chemically before it ever gets into the small intestine and the blood stream. In time, as the digestive process continues, some of the alcohol and food will pass into the small intestine and absorb into the blood stream. Because the alcohol only slowly gets into the blood stream, and because the body will continue to process and eliminate the alcohol that does manage to get into the blood stream, the drinker’s blood alcohol concentration (BAC) will not climb as high as it would have if he or she had drank on an empty stomach. The longer alcohol remains in the stomach during digestion of the food, the more alcohol will break down chemically and will never get to the blood stream. Thus it is important to always eat before drinking alcohol if you want to lessen the amount of alcohol that gets into the blood stream. Reason #1: Breath testing machines try to determine how much alcohol is in your blood, by testing your breath. The science of alcohol breath testing and the machines themselves have many problems, but the worse problem, in my opinion, is that the device will overstate the result by 200 to 300% if a person is still absorbing the alcohol that they drank. Among other assumptions, the science of alcohol breath testing assumes that the individual has fully absorbed all of the consumed alcohol before taking the breath test. of the alcohol that was drank is no longer in the stomach or in the small intestine – all the alcohol has absorbed into the blood stream and has reached “equilibrium” in the body. Equilibrium means that the alcohol content is the same throughout the entire body. Thus if a blood sample was drawn from your big toe, and one from your ear lobe, and both samples were analyzed for alcohol content, the results would be the same. The problem is it can take up to 6 hours to become fully absorbed, especially if the subject had food in the stomach. Food in the stomach will slow down the absorption rate of the alcohol. The point is no one knows if they have fully absorbed the alcohol that they drank, so by blowing into a breath test device you are taking a huge risk because if you are not fully absorbed, the machine will overstate the results by 200-300%. This means that if someone in reality has a blood alcohol concentration of .05%, the machine can give an overstated result of .10% to .15%. The reason for the overstated results deals with a number of complicated factors that are too lengthy to discuss in this article. The point is, the science of breath testing has many flaws. Therefore one should never blow into a breath testing machine. Always request a blood test. Next week, I will discuss the effects of alcohol on the human body at various stages. THE LAST WORD by George W. Zander The Assembly on Wednesday, passed two bills authored by Sen. Mark Leno that provide protections and equal benefits to transgender Californians. The first bill, SB 703, prohibits state agencies from doing business with companies that fail to offer transgender employees the same health care coverage and benefits they provide all other workers. The second bill, SB 731, requires caregivers who are tasked with placing California foster youth in homes to take a young person’s gender identity into consideration when making this critical decision. Both bills return to the Senate for a vote on amendments taken in the Assembly before heading to the Governor’s desk. Both of Sen. Leno’s bills are co-sponsored by the National Center for Lesbian Rights, Equality California and Transgender Law Center. “Denying a person’s gender identity at any age has lasting harm on our health, happiness, and ability to thrive,” said Kris Hayashi, Transgender Law Center’s Executive Director. “These bills take important steps to ensuring the state supports transgender people of all ages and respects our need to live as our authentic selves.”

a state agency from entering into a contract in the amount of $100,000 or more with any company that does not offer equal benefits based on an employee’s gender identity. “SB 731 provides direction to welfare workers and caregivers who are tasked with choosing an appropriate placement for a transgender child who enters California’s foster care system. “For transgender kids in foster care, SB 731 is vital to ensure placements where they will be safe, accepted and respected,” said Rick Zbur, Equality California’s Executive Director. “Collectively these two bills are significant advances for transgender people, and we applaud the Legislature’s leadership for moving these pivotal bills forward.” Be sure to register to vote.
