Mor Mudong

Yoonique Music Cafe

Hen Chef

10am-9pm Drive past Phuket Zoo and keep going east for a couple of kilometres, then turn left and continue almost to the end of the road.

Open til 2am Opposite Nai Harn lake located directly behind Reggae Bar in Nai Harn Beach. Although you'll often find the bar empty, it's still a quality bar that's worth a look and to grab a beer... or something stronger (but not food.) Yoonique regularly features live music from local musicians. There's a stage set up with a bunch of instruments that you're welcome to use if you have any skills.

11am-10pm Viset Rd, 500 metres south of the Sai Yuan Rd. junction.

Mor Mudong is a great place for a relaxing lunch or dinner. The restaurant is simple and rustic but really good with a feel of simple enjoyment. You can chose to eat in a small private sala built over the mangrove, or under the trees. The food is the main reason people travel such a long way. Steamed Fish In Salt Crust is recommended. Pak Miang Goong Siah (Fried leaves with dried shrimps) is a must. 104 F4

Rom Dee 7pm til late Yaowarat Rd. between Talang & Dibuk, Phuket Town. A small bar and live music venue in Phuket Town. Rom Dee is simple and inexpensive with just a couple of a small tables catering to young Thais. Live music every night and it gets quite busy. Nothing fancy but worth a look, a perfect place for drinks and cozy conversation with a laid-back approach. Cheap beer of course.

Serving a range of Thai and International dishes, Hen Chef is a great place for a quick meal. Although the décor may seem simple and unpretentious, the food is not. Salads, pastas and steaks are the highlighted items on the menu with Thai dishes being favourites amongst the patrons. 120 F4

122 H3

The Recycle Fa Mai

6pm -10pm Rawai Beach Rd. across from the Rawai Subdistrict Admin Organization.

5pm til late Chaofa Road East beside 7-11, just east of Fisherman Way Business Centre, Chalong. A DIY meal! Enjoy an interactive and all-you-can eat dinner at a 'Moo-Kra-Tha' or the Thai variation of a Korean Barbecue restaurant. Sit at a table that has a charcoal-flamed grill surrounded by a 'canal' filled with broth. Grab some chopsticks and choose from the selection of meats, seafood, vegetables and noodles available. Grill your selection and make a soup of noodles and vegetables and complement them with the sauces available. It's a healthy and fun meal that is modestly priced at only 129 baht.

81 B4

102 G6

What is striking about The Recycle in addition to its amazing Thai food is the décor. Made entirely of used and recycled items this venue offers the diner a treat to the eyes with its varying and unique hangings and furniture. The restaurant is a conversation piece on its own with the various items adorning the walls and tables. And there’s always something new to spot! 123 B5

The definitive Sailing Guide to Southeast Asia “Not often am I enthused about reading through a pilot; generally they tend to be dry and technical – boringly accurate in detail. Feature

Each year,at this time, the area around Phuket’s Fresh Market becomes congested with food stalls and everywhere is festooned with red lanterns and Chinese dragons, all centred on the Jui Tui shrine. One of the fascinating aspects of Phuket’s cultural traditions is the complex fusion of Chinese religious beliefs, with those of the original inhabitants of the island. It all began in the early 1900s when tin ore was discovered in the Kathu area and hundreds of Hokkien Chinese were drafted in to do the mining. They either brought their families with them or intermarried with the locals. A thriving community blossomed, and in 1825 the Governor Praya Jerm moved the capital town from Ta Reua to Kathu. The Chinese community had such critical mass that an itinerant Chinese opera company visited to entertain them. Here the story gets a little confused, but basically the whole area was struck by a major epidemic and almost everybody except the opera players became sick. Following their beliefs, the players had stuck to their religious calendar, which at this time of year required that they observe a strict vegetarian diet and offer prayers to two Chinese gods, Kiew Ong Tai and Yok Ong Sone Teh. The residents attributed their invulnerability to these religious observances. An alternative explanation may be that since Kathu was a swampy jungle and it was the time of the monsoon rains, the visitors may have introduced a malarial strain, to which they themselves were immune, to the local mosquitoes which thrived in the damp conditions. When the rains stopped the insects’ breeding ponds disappeared and the epidemic abated naturally. Be that as it may. The following year, the Haio Lan and Lian Tui regalia and sacred scripts were brought from China. When this precious cargo arrived at Bang Niao, the whole community went there to welcome the ship. The tradition of processions was thus born.

Sapam Shrine Samkong Shrine Ban Tha Rue Shrine Bang Neow Shrine, Cherng Thalay Shrine Jui Tui Shrine Kathu Shrine, Yokkekeng Shrine Sui Boon Tong Shrine

On the first night of the ninth lunar month (October the 20th in the Christian calendar), the sacred 10-metre lantern pole is raised to facilitate the arrival of the gods, and at midnight, nine lanterns are suspended, one for each god. In a slightly anomalous add-on, the Hindu god Shiva is also believed to be present, and just to be on the safe side, offerings are made to Lam Tao and Pak Tao. The festival then continues for nine more days with much burning of incense, banging of drums and letting off of fireworks to ward off evil spirits. One of the strange and even controversial aspects of the various processions (see the timetable above) is the activities of the Ma Song or ‘possessed horses’. These religious zealots transform themselves into a trancelike state and perform acts of mortification which range from climbing ladders with steel blades for rungs, walking across red hot coals and immersing themselves in hot oil. In a further rather gruesome practise, adherents pierce their faces and tongues with everything from skewers to bicycle spokes. Oddly enough, this self mutilation results in little bleeding or subsequent scarring. Stranger than fiction. However it’s not for the queasy so it’s probably best not to bring the kids! For most, however, the festival isn’t so fraught. Many restaurants and stalls all over the island will fly yellow banners decorated with red script, proclaiming that they are offering authentic vegetarian dishes, and they are delicious. Somehow the cooks manage to prepare dishes which are just as tasty as the normal fare which includes meat.

If you wish to practise a strict observance during the festival, here are the ‘rules’: Maintain maximum body hygiene • Use specified kitchen utensils only for the festival • Dress in white or in very light colours • Behave yourself: physically and mentally • Abstain from eating meat, fish, eggs and milk • No sexual intercourse • Stay away from alcoholic beverages and tobacco • People in mourning should • not attend any ceremonies • Pregnant women should not attend any ceremonies

This year the festival will be held from 15-23 October. For more info on dates and events contact: TAT Phuket office, Tel: +66 (0)76 211036, +66 (0)76 212213. www.phuketvegetarian.com.

Patong Seafood

International

Baluchi

Indian

Take a journey into the home of real Thai food! Patong Seafood Restaurant was the first seafood restaurant to open in the then village-like Patong. It has changed very little from those days except for a major refurbishment after the 2004 tsunami in which major damage was sustained.

Baluchi is located in the heart of Patong and in Karon yet the relaxed atmosphere of both restaurants with soft background Indian music, creates a great ambience to relish a hearty meal with your family or to entertain your friends or clients.

The restaurant was rebuilt as it was in original Thai style with open dining area and a high circular design ceiling. Only the freshest seafood is brought straight from the boat and market to give you the finest selections, which are on display – chilled and ready to eat. The kitchens at Patong Seafood Restaurant are a place to behold, where their chefs with simply so many years of experience, prepare your seafood and other Thai delicacies to perfection.

They take pride in using only authentic and fresh Indian spices, freshly ground in their kitchen and fresh, not frozen, meat. Homemade paneer (cottage cheese) and yoghurt, tandoori kebabs, naan and rotis, Mughlai curries and the best Indian long grain basmati rice dishes are just some of the specialties which their Indian master chef serves daily. One can taste the most mouth-watering tandoori kebabs in town, not to mention the variety of breads baked freshly in the tandoor or a delicious variety of prawn, chicken, mutton or vegetable biryani.

The first thing that you will notice are the friendly staff. The smiles, the attentiveness and the helpfulness in making your choice are something you will appreciate and you will then know why many visitors and locals come back time and time again to enjoy this real taste of Thailand.

Baan Rim Pa

Thai

'Location, location, location' as the saying goes. It doesn’t matter how good you are, if you’re not in the right location, forget it. Baan Rim Pa has become one of Thailand’s best-known restaurants, with a reputation stretching much further. It is perched on a cliff, with teak floors and the constant swish of the surf ‘downstairs’. There are some restaurants that just encapsulate the word ‘romantic’ and here, with Tommy Doyle playing classics on his grand piano, the sea breeze and the delicate aromas of world-class cooking in the air, this House by the Sea is one of the most romantic places to eat in Phuket. Situated on a rocky outcrop, overlooking the Andaman Sea, Baan Rim Pa prides itself in superb, authentic Royal Thai Cuisine, an ambience second to none and the most spectacular views on the island. Baan Rim Pa is the winner of the prestigious Wine Spectator Award of Excellence nine years in succession.

The International and Thai at Rice in Baan Yin Dee Boutique Resort come alive in the dishes so delicately prepared and presented. The White Snapper in crispy Pancetta skin served with warm lentil salad and potato basil straw and the BYD Fusion, chicken breast stuffed with scallops and served with herb gnocchi and asparagus scented cherry tomato lay testimony to Chef Ta’s creativity in preparing delectable delights.

SCENE Tropical Phuket is most famous for its beaches, but to experience the real heart and soul of the island it’s essential to delve into its local food culture. Throughout Thailand, eating is a joy and an all-day topic of conversation − and Phuket is no exception. When Thais are not busy eating they’re often talking about their last meal . . . or their next one. This is just a theory, but we believe that if people were to learn the vocabulary for Thai food only, they’d be able to follow 80 percent of the chatter here. From the lively markets to street stalls, to tiny family-run eateries with three or four tables, fresh fare is inexpensive and easy to find in every town on Phuket. And with so many roving motorbike food carts, lazy gourmets could just stay home or find a shady spot along the road and wait for the food to come to them! There’s no shame in eating cheaply here. We’ve seen some prominent local businesspeople and politicians happily slurping up 30-baht bowls of noodles at no-name stalls on several occasions. Immaculately dressed office ladies can often be seen at street-side food shops tucking into a plate of khao kha moo (stewed pork leg) or a similarly cheap rice dish, their designer handbags delicately balancing on a plastic stool beside them. Takeaway is also popular, and most every food vendor here will be able to box up and bag their meal offerings and assorted condiments with great skill and lightning speed. Their ability to cinch a plastic bag airtight with a quick wrap of a rubber band is impressive – we’ve never had a leaky bag of fish sauce yet!

Hokkien soup

40

One of the easiest ways to find a tasty variety of cheap eats is to visit a local festival, of which there are many throughout the year in Phuket. Some of the best events for satisfying your local food cravings include the Phuket Old Town festival in January-February, the Chalong Temple Fair held annually during Chinese New Year and the Patong Beach Carnival in December. In Saphan Hin public park in Phuket City, there’s usually a festival of some sort or another about every month. The festival themes may vary, but they’re always teeming with food vendors. And for meatless but not toothless food choices, numerous stalls will be set up during the Phuket Vegetarian Festival this month from October 15-23.

Here’s a sampling of some of our favourite cheap Phuket dishes, none of which will cost you more than 50 baht Hokkien noodles. When served in a soup, this is a refreshing dish with round noodles, thinly sliced pork, shrimp and a delicious egg-noodle dumpling stuffed with herbed minced pork. Also in hot demand for the lunch set are ‘dry’ Hokkien noodles, usually stir-fried with a mix of pork and seafood – very hearty and filling, especially if an egg is thrown in.

Dim sum. For most dim sum shops you need to arrive early in the morning to avoid missing out on the best of these tiny servings of steamed pork, seafood and vegetables. Diners are charged by the bowl, about 10-15 baht per serving. To find a dim sum shop, look for an open restaurant with either huge metal pots with rounded lids or stacks of bamboo steamer bowls.

Haw mok. This spicy crab mousse cake steamed and served in banana leaf makes for a rich and zippy complement to any meal, especially kanom jeen. Roti. A Thai-style pancake. This fried dough is served either sweet with banana and sweetened condensed milk or savoury with a small curry dish at the side. It was an earlymorning beef curry roti that convinced us of something that the locals have long known: spicy breakfasts are a true delight. Continued on page 42

Kanom jeen

Satay. Grilled lightly curried meat (usually pork) on a stick served with a spicy peanut sauce plus a side of sliced onion and cucumber soaked in vinegar. If you turn up at a party with a bagful of satay, you’ll be very popular indeed. Kanom jeen. This is a Phuket breakfast favourite, and it should be noted that ‘some assembly is required’ to fully enjoy this dish. You first need to select your curry – beef, chicken, fish, crab – which is put in a bowl with rice noodles. Then you’ll find a selection of crunchy vegetables including radish, sprouts and green beans, plus sauces, spices and herbs at your table, which you add and mix according to your taste. Artful eating at its best.

The Good and the Cheap Some of our favourite Phuket local restaurants Aroon Restaurant, Thalang Road, Phuket City Serves all kinds of roti, plus noodle and rice dishes. If this is too busy, try Abdul’s next door – also very good! Mee Ton Poe, at the Clock Tower circle opposite the Metropole hotel, Phuket City Open daily from lunchtime. Get there early because it can be difficult to find a table. Its speciality is Hokkien stir-fry noodles and a stall out front sells pork satay at 50 baht per 10 pieces.

And no meal is complete without a selection of sweets or snacks!

Here are some of our top choices: Salapao (steamed Chinese buns stuffed with BBQ pork or bean), khao tum mud (banana and sticky rice wrapped in banana leaves – only 8 baht per piece!), kanom krok (little round servings of coconut pudding, often topped with corn), kanom buang (crispy wafer with coconut cream and shredded coconut), sangkaya fuk tong (pumpkin and coconut custard), khao lam (sticky rice in bamboo – the black rice variety is our favourite), sakoo (steamed tapioca balls stuffed with pork and peanut, served with lettuce and chili). One sweet that’s almost too pretty to eat is luk chub, a sugary bean candy skilfully shaped to look like tiny fruits, vegetables or chillies. These are just a few of the endless choices of fresh ’n’ cheap eats on sale around the island. With only a few baht to lose if you don’t like a particular snack or meal, there’s no excuse not to be an adventurous and exploratory eater in Phuket. Happy dining!

N.C. Restaurant, opposite Royal Phuket City on Phang Nga Road in Phuket City With ultra fresh veggies, this is one of the best spots for kanom jeen. It’s also a one-stop shop for many cheap eats including Hokkien noodles, haw mok, any kind of rice dish, baked goods and sweets − and excellent massaman curry. Ko Yoon, Yaowarat Road at the Suriyadet fountain circle, Phuket City The best Hokkien noodle soup shop in Phuket, or so claims a sign hanging in the restaurant’s entrance. It’s like a sauna inside and rather eccentric in design, with dusty Chinese ceramics and silk flowers on the shelves, but it’s a great spot to watch all the comings and goings of the tourists and market people. Jade Restaurant, opposite the police station, Chaofa East Road, Chalong There are many dim sum shops in Phuket but one of our favourites is Jade. They also make a huge and tasty khao thom. Baan Sukapun on Thepkrassatri Road in Phuket City (just south of Nissan) also does a good dim sum, and we love its vegetable sakoo.

To find all these great places get yourself a copy of STREETS of PHUKET 188 pages of detailed street maps, landmarks and local information - with a series of comprehensive indexes. It’s the easiest way to find your way around Phuket. Check www.streetsofphuket.com to find out where to get it – at only 399 Baht it’ll save you time and fuel.

Spa

Lemongrass House To visit this home of award-winning spa oils, creams, soaps and so many other exquisite products is a delight. The aromas are enchanting. At Lemongrass, you can enjoy a spa treatment to sample and choose from their huge range, then take home your choice to enjoy at your leisure. They even have a great range of kid’s spa products.

Bobby Duchowny studied aromatherapy – a healing art that promotes massage, when combined with specific herb and spice oils, as a method to reduce stress, boost energy and heal certain physical ailments – at the American Aromatherapy Association. Some years ago while on holiday in Thailand, he visited an organic farm in Petchaboon province and became interested in the natural healing properties of Thai herbs and spices. “I was particularly attracted to lemon grass as it was used in many popular Thai foods, as a medicine for stomach disorders and even as a repellent for mosquitoes,” he recalls. Bobby used lemon grass as his signature herb to create a line of essential oils, face and body creams, shower gels and bath crystals, which he and his wife Palita sold at Bangkok’s world-famous Weekend Market. What started, several years ago, as a modest enterprise has blossomed into a successful operation offering over 90 oils and a wide range of body care products through many outlets, as well as supplying many of Thailand’s top resorts and spas with aromatherapy oils. “Our advantage is that we produce the freshest spa products and our stock is never kept longer than three months; using fresh spa products can be likened to eating fresh food rather than processed food.”

Based on his years of experiences at some of the top spas in Southeast Asia, Bobby has developed a full line of healthy skin care products. For example, his hydrating face and body creams have 25 per cent aloe vera, white orchid and cucumber extracts. And he’s developed a revitalizing mineral muscle soak made from Andaman Sea salt crystals, blended with white orchid and chamomile extracts, to help draw out impurities and soothe and revive tense muscles. “People are sensitive to different scents at different times of day. It’s a good idea to get a variety of essential oils and experiment with what smells and feels good to you,” he says. “Our aromatherapy massage and body oils can be either uplifting or calming to the spirit. They’re carefully balanced handblended oils created by adding pure essential oils to nourishing, vitamin E enriched, sweet almond and jojoba base oils. Lemongrass has won many awards, including Condé Nast Hot List 2007, and has been featured in several top magazines, including Time Magazine’s “Best of Asia”. According to Time, “If you want to smell like no one else, try mixing a selection from the more than 90 natural scents at Lemongrass House.” Lemongrass House is located in Cherngtalay, Surin Beach and Chalong, where you can buy their full range of spa products at modest prices, making perfect gifts for friends and family who can enjoy the aromatic scents of Asia in the privacy of their homes – no matter where in the world they live. Spa

The Royal Spa To experience The Royal Spa is to feel the true beauty of nature and reflect on the power of body, mind and spiritual connections.

The Royal Spa and Health Club In the heart of bustling Phuket Town lies a quiet haven of heavenly peace. With the continuous sounds of water, trickling, bubbling and steaming, and with the sweet fruity scents that fill the air, the being is enticed into a flowing stillness of body and mind. The Royal Spa and Health Club is a popular tropical day spa with both locals and visitors alike, which is managed by the Royal Spa Development and Management Company. With an excellent reputation in the spa development industry through its experience and attention to detail, the Royal Spa and Health Club offers a distinctly personal experience. Of the signature treatments, the Royal Stone Therapy is one that is particularly interesting. The Hot Stone massage technique, founded 5000 years ago, uses black volcanic stones, which are heated and placed on the body, producing a profound effect, stilling the mind and easing the body. Unlike many of the high-end spa complexes on the island, which market themselves exclusively to tourists, the reasonable prices and relaxed but professional staff at the Royal Spa, means that many local Thais, as well as tourists, are beginning to use the spa. This has helped to erase the often stiff, and over-formal atmosphere at many of Phuket’s spa resorts, giving the Royal Spa an ambience of authentic relaxation and pleasure. All the therapists working at the Royal Spa have been trained at the in-house 'Phuket Spa Academy', established in 2004, to provide a comprehensive spa training course. The curriculum and assessments provide a measurement of therapist expertise and knowledge within the Thai spa industry. Since then, the Royal Spa Development and Management Company have provided comprehensive and professional spa management, and development programs, for spa retreats throughout Thailand. Their aim is to provide a standard of service and expertise throughout the Thai spa industry, to ensure a high quality of service and standard of treatment, throughout Thailand. It truly offers the ‘one stop services for Thai spa business’ and a quality of relaxed professionalism, rarely found in luxury spa resorts. Right now The Royal Spa have 12 branches that are managed in resorts in Patong, Kata, Karon, Panwa, Ao Chalong and Phuket Town and you are welcome to experience our spas with us anytime. As a special for our 8th year anniversary, we offer 'BUY ONE GET ONE FREE' value.

Spa

Sukko Cultural Spa Sukko means "Beyond Happiness". My first feeling when I stepped through the impressive gates of the Sukko spa was, "I’m in paradise". The Sukko staff are dressed beautifully in traditional Thai style and the spa design, influenced by the ancient Siamesee capital, creates a haven of calm yet regal serenity. I felt I had left all my troubles behind.

Chilled out by the soothing background music, my mind was filled with a peaceful wellbeing as I enjoyed the warm traditional welcome (again from Sukko culture) of the ‘Flower Floating Ritual’ – similar to ‘Loy Kratong’, where the idea is to float away past stresses and wish for luck and joy from that moment on. A variety of 40 spa treatments – prepared by Sukko's certified Thai Herbalist and based on ancient Thai medical theory – is offered at Sukko, in packages lasting from 2 hours to 4 hours. Each package has a specific purpose and can be selected to suit your lifestyle or the way you feel on the day. These herbal recipes and procedures have been handed down through generations and are totally free of petrochemicals, synthetic perfumes or colouring. Some of the herbs and spices are grown in Sukko’s own herb garden and picked just for your treatment, ensuring they are as fresh as can be. I was pampered with the “Be Balanced” package; a 3 hour experience that left me feeling relaxed and refreshed. This three-treatment combination began with 30 minutes in the steam room and the Jacuzzi, followed by a Thai Turmeric Body Scrub designed to soften your skin and awakening your senses. The scrub was followed by Sukko Special Body Massage, performed by hands, using finger pressure on energy points and smooth strokes along energy lines. During the movements of the massage, the molecules of

“The Best Spa In Southeast Asia”

essential oils in Sukko elegant aromatic massage oils will be absorbed through the skin and into the bloodstream to benefit the nervous system and other parts of the body. “Is this pressure okay? Too strong? How are you feeling?” my therapist asked me from time to time. “Mmm…perfect…” were the only responses that seemed to suit how I felt. Sukko Spa’s restaurant, Suk Savoey Spa Cuisine, presents a unique concept: "Menu by Blood Types" and "Menu by Element". For those who want to exercise, the Suk Sanan Club provides a myriad of fitness opportunities, including ‘Rue Sri Dat Ton’ (the hermit self stretching), a traditional Thai exercise or, for something more strenuous, try ‘Thai Martial Arts’, a traditional and effective art of self-defense.

To re-balance the body elements traditionally. According to traditional Thai medical theory, the human body is composed of five fundamental elements: Prithivi (Earth), Apa (Water), Vayu (Wind), Tejas (Fire) and Akasha (Space). LABOR LAW IN THAILAND

Whether a foreign investor is in the form of a large multinational or a small enterprise, doing business in Thailand requires a basic knowledge of the country’s labor laws and practices. Thailand’s labor regulations often differ quite significantly from Western jurisdictions, and even from other neighboring Asian countries, such as Singapore. Employers who are ignorant of the law may think they are acting perfectly within their rights, only to find themselves on the end of a costly legal dispute. In addition, when formulating a long-term labor plan, account of the upcoming changes under the Asean Economic Community in 2015 must be taken, the basis of which will form another article in due course. This article provides a brief overview of the minimum requirements that employers should be aware of with regard to Thailand’s existing labor regime. Employment Contracts It is strongly advisable that employers enter into formal written employment contracts with their employees. While employment contracts in Thailand are not required to be in writing, oral agreements are not recommended. Unwritten employment contracts are considered “implied”, and the terms will be drawn from the law which often do not cover the detail necessary to govern the nature of an employee’s duties, working hours and other relevant details. It should be noted if a vital element of an employment agreement is missing, even if it is in writing, the basic implied terms of labor law will still be deemed included. All employment contracts are required to contain basic conditions of employment, including wages, annual leave, confidentiality, and the notice period that the employee and employer must provide to terminate the contract. Therefore, an employer should ensure, at a minimum, that its labor contracts cover these points. Such contracts should of course also contain details as to the employee’s duties, working hours, benefits and other key components of employment. The greater the contract’s detail, the less that is open to interpretation from the parties or a judge. Employers should resist the temptation to omit detail merely to make the contract look smaller and more manageable, because this approach can often create an issue when the employment agreement actually needs to be examined due to a dispute. Working rules and minimum requirements An employer with 10 or more employees is required to establish written work rules. These rules must cover items such as working days, holidays, disciplinary action, sick leave, maternity leave, termination, grievances, and severance pay, among other things. Many of these items are required by law to meet minimum entitlements. For example, the law states that the maximum number of working hours should not exceed eight hours per day or 48 hours per week. In practice, an employer has the right to demand an employee to work 48 hours per week, which usually means working on Saturdays. Regarding overtime, an employer must pay an overtime rate of not less than one and a half times the hourly wage. Overtime is considered to be anything over 48 hours per week. However, if an employee is considered part of a company’s “management”, then overtime benefits do not apply. “Management” is defined in the law as someone with the authority to terminate an employee and make decisions on the terms of employment, among other things. It should also be noted that overtime cannot be imposed mandatorily. Caution should also be applied to minimum wage requirements, which is a hot topic in particular for hoteliers and tourism based businesses in Thailand and in resort areas like Phuket where a large number of employees are affected, adjustments to a combination of basic salaries; service charge and overtime must be calculated carefully to adhere to the laws. Furthermore, employees are entitled to a minimum of 13 public holidays a year. For annual leave, employees are entitled to six days’ holiday, so long as the employee has been working for the same employer for not less than one year. If the employee has been working for less than one year, the number of annual leave days is fixed on a pro rata basis. The best approach is to ensure this is covered in the employment contract. Employers should also monitor announcements for additional national holidays which are frequently issued

in Thailand from year to year. Once an official announcement is made, this is an additional public holiday and employees have the right to take leave that day. Finally, it should be noted that female workers are entitled to take maternity leave for a maximum of 90 days, and can receive their regular salary for 45 of those leave days. Termination and Severance Under Thai law, an employee can be terminated either with or without cause. However, termination for cause is only applicable under certain conditions. These include: committing negligent acts which cause serious damage to the employer; willfully causing damage to the employer; performing work dishonestly; violating a “just” work rule after receiving a written warning not later than one year prior to the violation (in very serious cases, such as theft of substantial property, or committing violence, for example, the written warning requirement is waived); and being sentenced to prison for a serious offense. When an employee is terminated for cause, the employer must notify the employee of the reason. If no reason is provided, then, if the employee makes a claim for severance, the employer would not be allowed to contest it. Note that employees terminated “for cause” are not entitled to severance. However, employees dismissed for any other reason, including mutual termination of the contract, are eligible for severance. In such cases, the employee must be given notice of at least one pay period or one month in advance of termination, whichever is shorter. The actual amount of severance pay an employee may receive depends on the length of time that the employee worked for the employer. Employers from other jurisdictions may have experienced a fairly efficient process for termination without cause. However, in Thailand, employers should note that this power should be exercised carefully, properly, and under advice, as the first port of call for an employee can be the Labor Office to report the employer for improper procedures with regards to termination. The correct document backed processes should be available as evidence to prove appropriate procedures have been followed for termination without cause. Conclusion Thai labor law is extensive, and the information provided in this article is only an overview of certain minimum requirements. Employers must also consider issues such as workmen’s compensation; social security; unions and labor relations; employment of foreigners; and labor dispute procedures. However, these regulations can be successfully navigated with full knowledge of the law. It is therefore important for investors with small, medium and potentially large workforces to monitor new labor developments and legislation that can impact their business.

According to the YouTube ‘hits’ (over 2m), Phuket-based singer Gig (Warunee Suwannurak) attracted a lot of attention and curiosity after she appeared on the Thailand’s Got Talent contest’s ‘Season 2’. Window on Lifestyle went to meet her to find out what all the fuss was about.

PHUKET’S Where are you from? Betong in Yala, Thailand’s southernmost province bordering Malaysia. Tell us briefly about your background? My parents were day labourers and I went to school only up to Grade 6 (about 12 years old) because I had to work so that my four younger brothers could continue their studies. I worked as housekeeper, delivering newspapers, a waitress and so on. What is your first memory of being inspired by music? I sang in school performances from a very young age and loved it! When did you realize you could make a career singing? When I was 18, I started working as a singer in local restaurants. That was the first time I got paid to sing! When did you move to Phuket? Why? In December, 2006, I left my life in Yala and came to Phuket where there are more opportunities to work singing western songs. How and why did you start to sing western songs? I met a singer called ‘Cake’ at one of the places I was working in my hometown. She was doing western songs and, although I couldn't understand what she was singing, I could feel her power and I thought, “I could sing like that!” So I started to try it myself, without knowing the meaning or even what it should really sound like. I just wrote down the lyrics in Thai.

68

Was it easy? No! One day, I’d just finished a song called ‘Cha-la-la’ when a Malaysian guy came up to me and asked, “What were you singing? I couldn’t understand anything!” I felt so ashamed that I changed my technique. I started listening to the songs carefully and writing the lyrics in English – but also writing in Thai how it should sound – and checking the meaning of the lyrics with a dictionary. It took me about two weeks to master just one song! Do you still do it this way? Yes I do. But I also watch YouTube videos and study how the singers control their voices and how they use their mouths. I’ve never had singing lessons, so this is the best way for me to learn and improve. Tell us about your work. Up to two years ago, I used to take jobs as a cashier or waitress if I had no singing work. But my boyfriend doesn’t want me to do that any more, so now I’m a professional singer. Basically that means I don’t have another job; singing is the only work I do, although I don’t have a regular singing job. I’m more of a freelancer going where the work is, often for events. I’ve also just started studying through the Non-formal Education (NFE) system. What songs do you include in your performances? I can sing more than 100 western songs; I’ve got quite a few Tina Turner songs in my repertoire, but a lot of others too. My real favourite is the 1993 hit “What's up?” by 4 Non Blondes.

How did you come to enter the Thailand's Got Talent contest? I saw the American and UK versions on YouTube and found out that the show had just come to Thailand. I watched it and one of the acts was really inspirational. I thought, “Why not me?” Of course, there’s the prize money too. If I won, I’d be able to buy a house for my parents and my daughter. Were you confident? No! Not at all. I didn’t think I’d pass the audition because there were 20,000 candidates from all over Thailand and they needed only 400 contestants. But I did it; believe me, I was in shock for a while after being selected. Why did you choose to sing “What’s Up?” in the audition round? Because I like it and it's the one I do best – and I can remember the lyrics without having to read them. As simple as that! Do you think you made any mistakes in the contest? Yes. In the semi-final, I chose the wrong song! It didn’t really suit me or my voice and I wasn’t able to get much feeling into it. Also, I didn't warm up my voice beforehand, so I couldn’t achieve the power I usually have. I was probably thinking too much and I know I was a bag of nerves. Did the talent contest provide you with a trainer? Yes they did, but it was a bit of a mixed blessing. Having someone tell you what you should and shouldn’t do is OK – but the problem was I got really nervous if I couldn't do what they told me to do, like in the semi-final. If there’d been no trainer, I’d have just been myself – and maybe I’d have done better...

After the contest will your life change? Will you still sing in Phuket? Win or not, I’ll keep singing. I really don't know what's going to happen. The TV production company might offer me a five-year contract but if they don’t, then my commitment to them finishes with the last show. Whatever happens, I love to sing in Phuket so I’ll probably go back and forth between Phuket and Bangkok. Who knows? You’ve become a ‘favourite’ at the Phuket Raceweek regatta, organised every year by the publishers of this magazine? Will you still have time for that kind of thing? Will you be there next July? Sure I will – if the organisers still want me! Is there anything about your performance that you’d like to improve? My biggest problem is lack of English language skills. I need to work on that. What's your goal? As I mentioned, I’m studying Non-formal Education and I want to get a degree. I was thinking about studying engineering, but I accepted that wasn’t practical for me. My dream is to graduate as a singing teacher and open my own school. But that’s a long way in the future as I’ve just started to study and I still don't have enough money for the investment. People may think that because I’ve got foreign boyfriend, I’m already rich... Not true! I still have to work. Can you tell us a bit about your personal life? Sure. I’m 32 years old and live in Naiharn with my Danish boyfriend who I met two years ago when I was singing in a restaurant in Rawai. I’ve got a 10-yearold daughter who lives with her father, my Malaysian ex-husband, in Ubon Ratchatani. How do you approach life? We never know what’s in the future, so make the most of today. Do you have any hobbies? I’m lucky. My hobby is singing, so I get to work at what I love doing. How do you see yourself? I think I’m an easy person. My regular routine is to stay home and surf the internet looking for new techniques from my favourite singers. I also practice a lot at home. I’m definitely not a beach person! I like to wear T-shirts and jeans, but nowadays I’ve changed a bit. My boyfriend says that I’m not a young girl anymore so I need to look smarter… This interview was conducted before the final of ‘Thailand’s Got Talent, Season 2’. Gig came sixth in the contest out of 400 contestants from all over Thailand.

Check out Phuket's

View Points If you are looking for a change from the beach, why not check out the views from Phuket's hilltop view points? You will experience magnificent vistas, cool breezes and most view points have refreshments available. Don't forget your camera. Phromthep Cape (Laem Phromthep): This is the most popular and largest of all the view points. The area has been developed to offer extensive views over the sea and there are walking paths from the cliffs to the water's edge for the adventurous. The sunsets are absolutely breathtaking and never the same two days running. If you are romantically inclined this is the place to come in the evenings and hold hands as the setting sun paints the evening skies in towering kaleidoscopes of light and shade.

Rang Hill: Rang Hill lies to the northwest of Phuket City. The hilltop has been landscaped into a park and fitness facilities are offered. A winding treelined road takes you right to the summit where a sala offers shade during the day. Once there you can enjoy views of the city and beaches on the south and southwest of the island. Try a visit at night when the lights of the city are like a million diamonds scattered on night blue silk.

On top of Promthep Cape is a very pretty structure, the Kanchanaphisek Lighthouse which doubles as a museum. It was constructed in 1996. If you want to check the times of sunsets, ring the Phuket Meteorological & Radio Station on +66 (0)76 211494. How to get there Phromthep Cape is a headland on the extreme southern end of Phuket about 19 kilometres from Phuket City. You can drive there via Chalong Junction along Highway 4024 to Rawai Beach, and then follow the signs for 2 kilometres.

Karon Viewpoint: Sometimes referred to as the Three Bay Viewpoint. View point is located between Nai Harn and Kata noi Beaches. This is a very tastefully developed facility with a Thai-style sala, which offers superb views on several levels. From here Kata Noi, Kata and Karon beaches can be seen and out to sea is Koh Poo Island. It is one of the island's best views. How to get there Kata Viewpoint is located along the road between Kata Beach and Nai Harn Beach, just 5 kilometers from Kata Beach.

Windmill View Point: As the name would suggest this hilltop boasts a modern windmill – the only one on the island. It can be found on the south of Phuket between Nai Harn and Promthep. This isolated spot offers superb views of the tiny Ya Nui Beach and the main Nai Harn Beach. There are always boats moored off both beaches and in December the anchorages really come alive as the Phuket King's Cup Regatta gets under way. How to get there Drive from Nai Harn Beach towards the highest hilltop and take the first road on the right. You will spot the windmill on your right hand side.

Khao Kad 360° Viewpoint: Khao Kad offers wonderful views of the Andaman Sea beaches and neighbouring islands from a different perspective – from Cape Panwa in Vichit district. Sunsets are on a par with Promthep. Visitors are faced with a stiff climb up 138 steps. Once there the fresh breezes and tranquil surroundings are a sufficient reward. The viewpoint has good parking facilities and services. How to get there Take Sakdidet Road as far as Baan Muang Thong (Muang Thong Village) or follow the signs to Makham Bay and turn right just before arriving at Panwa Cape. The turning is well signposted.

Blood Donations The start of the tourist season and the associated influx of visitors to Phuket results in an unfortunate trend; an increase in trauma, accidents and hospital admissions. Hospitals therefore face an increasing need for more supplies of the vital fluid of life, blood.

Media announcements calling for urgent blood donations are not new in Phuket, and the hospitals and blood banks regularly ask for donations. It’s just that as the number of foreigners on the island increase, blood supplies, and particularly those blood groups that are rare, become scarce.

from Thai donors because for every 1,000 donors, statistically, only three will donate Rh negative blood. That is clearly not enough; particularly when only about 1,000 Thais donate regularly, each month in Phuket.

Your blood is grouped and categorised by its makeup. All of us, Thai and foreigners have a blood group which is A, B, AB or O. This classification is then further defined as either positive or negative; more correctly termed Rh positive or Rh negative.

Foreigners have a much higher incidence of Rh negative blood, at around 16%. So for every 1,000 donors, blood banks would collect about 160 units of blood. The other side of the coin, of course, is that for every 100 foreign accident patients who need blood, 16 of them will require Rh negative blood. With only around 20 foreigners who donate blood regularly each month in Phuket, and the limited number of Rh negative blood collected from the Thai population, the hospitals never have enough stock of this type of blood.

Most Thais, that is 99.7% of the population, have Rh positive blood. It becomes immediately clear that the blood banks in Thailand therefore have extreme difficulty getting Rh negative blood

Facts • You can’t give blood from one person to another unless it’s a match. A person with Rh negative blood can’t receive Rh positive blood. • When people donate blood, they usually give one unit, around 500ml. • Many accident patients need many units of blood to survive; some as many as 10-15 units. • Rh negative blood is rare, very rare, not just in Phuket but all over Thailand. • We can’t get Rh negative blood from the Thai population, they don’t have it. • Only a very few foreign people who live in Phuket with Rh negative blood are regular donors. When a foreign patient is admitted to hospital and requires Rh negative blood, stocks can be exhausted quickly and urgent calls are then made through the media to obtain more.

DESIGN CENTER PHUKET

Chanintr Living takes 792 square meters at Hafele Design Center Phuket.

Chanintr Living, the leading high-end furniture retailer from Bangkok has leased 792 square meters of space at the Häfele Design Center in Phuket. After a 1-month trial period in which the company held a special event this past August, the company has decided to sign a longer-term contract with Häfele. ‘Given the very positive response during our special event here at the Häfele Design Center last month, it has convinced us of the potential of the Phuket market. The Häfele Design Center makes it very convenient for customers to visit and retailers like ourselves to operate from’ said Khun Chanintr Sirisant, CEO of Chanintr Living. The company, having serviced the crème de la crème of Bangkok for over 18 years, has agreed that it is the right time to pursue growth in the Phuket market. Khun Chanintr added, ‘Although we supplied projects and a few residences in Phuket through a small rep office in Surin for several years, we saw increased demand from both foreign residents in Phuket, villa owners, as well as, locals to Phuket.’ With large developers from Bangkok launching more projects on the island, it appears that there should be ongoing demand for furniture and interior products.

Chanintr Living is known for its attention to service and its stable of the very best imported furniture brands. The company started in 1994 with the opening of the first Baker furniture showroom at Gaysorn Plaza. Today, the company has over 10 showrooms in Bangkok alone and represents more than 30 brands of furniture and accessories. Its main showrooms are located at Siam Paragon, The Promenade on Wireless Road and Noble Solo on Thonglor. Khun Chanintr said that with a large space like the one at Häfele Design Center the company will be able to showcase a wide range of products and try out new formats and solutions for the Phuket market. ‘The Phuket showroom will serve as a snapshot for what the company can offer both homeowners and developers as a total solution.’ Visit chanintrliving.com for more information.
