Rolly Tasker One of the world’s top yacht racers and founder of the successful Phuket sail-making company in his name, died on June 22 at his home in Australia. His long racing career took him to the top of elite sailing, winning numerous international races and an Olympic silver medal on yachts that he built and designed himself. Rolly first established Rolly Tasker Sails in Phuket in 1994 on the top floor of a shopping centre, which has since moved into a 100,000 square-foot sail manufacturing loft, exporting to more than 60 countries. He was an avid collector of sailing memorabilia, and built the Australian Sailing Museum in Mandurah, Western Australia, in 2006, which was officially opened by the Governor General of Australia in April 2008. Rolly Tasker’s fascinating life story is chronicled in the biography, Sailing to the Moon by Roland Perry. Rolly had battled skin cancer since the age of 40, enduring some 100 operations on his face alone, but the disease never quelled his fighting spirit. He was 86 years old. IMAGE asia is honoured that Rolly, with the help of his wife Kerry, spent time during his difficult final weeks to answer our profile questions from his home in Australia. We received Rolly’s interview text via email just 10 days before his death. Where are you from? I was born in Victoria Park, Western Australia, 21 March 1926. As a child, what did you want to be when you grew up? I always wanted to work with my hands; from a young age I was building model aeroplanes and model yachts as a hobby. At the age of six, I built my first canoe and at the age of 10 I built my first 10’ft skiff, which I sailed on the Swan River in Perth. When did you first come to Phuket? I arrived in Phuket around December 1993. What made you decide to live in Phuket and start a business here? I had taken over a bankrupt sail-making business near Bangkok and decided to move to Phuket, which was zoned 'Tourist' and allowed me to own all the shares. Can you tell us more about your family? My wife Kerry has worked beside me throughout the almost 20 years spent in Thailand. Between us we have four children, five grandchildren and two (and-ahalf ) great-grandchildren. My son Barry runs his own small business, daughter Sophie is an engineer with Woodside. Dallas runs his own small transport company and Martene is Manager of the Australian Sailing Museum cafe. Could you tell us more about Rolly Tasker Sails? Rolly Tasker Sails was founded in 1949 with the sail loft in Claremont, Western Australia, followed by two more in Claremont. In 1961 I moved to Hong Kong. In 1964 I moved to La Rochelle in France and then I built two lofts in Fremantle, Western Australia, and three lofts on Phuket.

What has been your most challenging time in life and how did you overcome it? I have challenging moments every week of my life and my instincts and perseverance have helped me to overcome the many challenges. Your biography, Sailing to the Moon, by Roland Perry, came out a few years ago. Do you think the author described you and your life accurately? Yes, I would say he described my life accurately. However, the biography covers only 25% of my sailing history. Do you know where people in Phuket can find the book? Do you currently have any museum items/displays in your Phuket factory for visitors to see? The Australian Sailing Museum is located on the Mandurah waterfront. The display is in two sections: the History of Australian Sailing from 1860 with 160 models of Australian Class Yachts on display. The second section is the America’s Cup Museum, which tells the history story of the America’s Cup since 1851 with an additional 60 models of America’s Cup yachts. There are 12 wax figures of the famous skippers, commodores, etc, of the America’s Cup (all made by Thai craftsmen and clothed by a local Thai tailor). It also features a silver replica of the America’s Cup trophy, extensive nautical art work collection and the work of American artist John Mecray. The Phuket sail loft features the Rolly Tasker prints of the America’s Cup, the John Mecray collection, five history boards all located in the foyer.

What’s your view on how to be successful in business? To be at work every day. Tell us about your style of leadership. Training the staff the techniques of making sails by example. What one word would you use to describe yourself? Innovative. What are you most proud of? I'm proud that I started all the factories (12) with a capital of $200 (loaned to me by my father and paid back within 12 months) to $2,500 in capital. All the businesses have been highly profitable.

What was your most challenging moment in sailing and how did you get through it? Managing to finish over 2,000 races without a retirement.

You built your house in Phuket next to your loft. Can you tell us more about it? All the panels for the Thai house were made in teak wood in Chiang Mai and trucked to Phuket for erection. It is a lovely home, very simple and homely – we both love living in it. We have staff quarters below and several staff reside there.

What personal quality do you believe has helped you the most in life? Instinct and perseverance gained by my early training.

What do you think about Phuket’s development as a sailing destination? Do you think it’s developing in the right direction? I hope it is developing in the right direction. I think it is a wonderful place to sail.

What life event has hurt you the most? The 1956 Olympics in Melbourne, Australia, when I was disqualified in the seventh race and lost the gold medal.

I first met Rolly 20 years ago when he gave me a new sail, free of charge, to test out on our fleet of yachts that had just arrived in Thailand. Since then we never looked backed and Rolly Tasker still delivers. Rolly’s passion and enthusiasm for everything he has done has been a great inspiration to me and I have spent many happy hours being shown around his loft and have always been drawn in by his commitment to sailing and his great stories. I was very sad to hear of Rolly’s passing even though I was aware of his condition and it did not come as a shock. I have been a customer and dealer for Rolly Tasker for many years. He was a good friend and a kind man and will be missed by those who knew him. I enjoyed his yarns about his sailing adventures, such as the Fastnet '79, and sometimes he would be spinning out his memories after the doors to his loft had closed and his staff had gone home. He loved to share tales and was always thoughtful and thorough when asked a question about his favourite sport and passion. His contributions to sailing, the Australian Sailing Museum and his history as a sailor and sail-maker leave a venerable legacy for those to remember him by. He was a legendary man and will be greatly missed.

Always found Rolly a dynamic and energetic person on the go but still with time to chat to anyone about his life, business and especially his love of yachting. A past conversation I had with Rolly was about his museum in Australia, which he had a long battle with the local council for permission to build. If he had developed the same block of land for residential purposes it would have been processed much quicker/easier and he would have made a good profit. Undeterred, he took the difficult path for the better of the community building his museum. A great loss to the sailing community and to Phuketians. Celebrating Phuket Mother’s Day On August 12, at precisely 7.19pm, millions of candles will be lit up in homes and public places across Thailand in honour of the 80th birthday of Her Majesty the Queen. The Buddha, in his teachings about compassion, described the special kind of love that mothers have for their children: “Love the whole world as a mother loves her only child.” Stemming from this is the belief that children should do everything they can to repay their mother for her unconditional love and care. From an early age, children are encouraged to show their gratitude and respect for their mothers in their daily actions, words and deeds, from the simple yet poignant ‘wai’, or bow, of respect when greeting her, to sharing their home and income with her when she reaches old age.

Mosaic of tuna and swordfish with mullet bottarga, marinated cherry tomatoes and Sicilian capers.

50 gm fresh blue fin tuna 50 gm fresh swordfish 10 gm gey mullet bottarga 5 gm Sicilian capers 50 gm ripe cherry tomatoes

• 10 gm fine extra virgin olive oil • 5 gm juice of yellow lemon • mixed young salad leaves • salt • black pepper

Method • Cut the tuna and the swordfish into square strips, than slice thin square pieces and put on the plate alternating as a mosaic. • Whip the extra virgin olive oil and the lemon juice with a whisk in a bowl, until you get a solid dressing, add some black pepper and salt to taste.

• Slice the bottarga very thinly and cut the cherry tomato; marinade with the extra virgin olive oil and the salt. • Arrange the plate, dressing the mosaic with the extra virgin olive oil and lemon sauce, add the cherry tomatoes on top, then the bottarga and capers. • Decorate the top with nice young and crispy herbs. The most important element is the freshness of the fish and the elaboration of the ingedient. With this dish I recommend a nice Vermentino from Sardinia, 'Costamolino' from Argiolas winery.

Bobby Duchowny studied aromatherapy – a healing art that promotes massage, when combined with specific herb and spice oils, as a method to reduce stress, boost energy and heal certain physical ailments – at the American Aromatherapy Association. Bobby used lemon grass as his signature herb to create a line of essential oils, face and body creams, shower gels and bath crystals, which he and his wife Palita sold at Bangkok’s world-famous Weekend Market. What started, several years ago, as a modest enterprise has blossomed into a successful operation offering over 90 oils and a wide range of body care products through many outlets, as well as supplying many of Thailand’s top resorts and spas with aromatherapy oils. “Our advantage is that we produce the freshest spa products and our stock is never kept longer than three months; using fresh spa products can be likened to eating fresh food rather than processed food.”

Based on his years of experiences at some of the top spas in Southeast Asia, Bobby has developed a full line of healthy skin care products. For example, his hydrating face and body creams have 25 per cent aloe vera, white orchid and cucumber extracts. And he’s developed a revitalizing mineral muscle soak made from Andaman Sea salt crystals, blended with white orchid and chamomile extracts, to help draw out impurities and soothe and revive tense muscles. “People are sensitive to different scents at different times of day. It’s a good idea to get a variety of essential oils and experiment with what smells and feels good to you,” he says. “Our aromatherapy massage and body oils can be either uplifting or calming to the spirit. They’re carefully balanced handblended oils created by adding pure essential oils to nourishing, vitamin E enriched, sweet almond and jojoba base oils. SECURING ACCESS: SERVITUDE OR RIGHTS OF WAY?

Access rights are just as critical for landowners in Thailand as they are in other jurisdictions around the world. However, if you are unlikely to be a ‘landowner’ in Thailand, these types of rights are still relevant, if you own a property or lease a property on the relevant land. Frequently, we are asked what is the best method of securing access rights to a parcel of land that is landlocked and not connecting to a public road so as to ensure that the owner of the landlocked land, and his or her guests, can freely access the land by vehicle or on foot. There are several possibilities for ensuring or acquiring access for a landlocked parcel of land, and the Civil and Commercial Code of Thailand (“CCC”) specifically provides legal rights, but depending on the particular circumstances and the intended access use, certain rights of access may prove to be better options than others. Generally, however, landowners opt for so-called ‘rights of way’ or registering an access ‘servitude’ across an adjacent parcel of land that does provide access to a public road. This article provides an overview of the differences between a ‘right of way’ and a ‘servitude’ under the Thai law and their circumstantial uses. Legal ‘Rights of Way’ In Thailand, so called ‘rights of way’ are essentially governed by Section 1349 of the CCC which provides that, where a parcel of land is “surrounded by other pieces of land that it has no access to the public ways, the owner may pass over the surrounding land to reach a public way.” The key issue under this provision of the CCC is that the land seeking access to the public ways must actually be landlocked from the public way, that is to say it must not have itself any access to any public way in order for a legal ‘right of way’ to be created under Section 1349. The only other circumstances where a ‘right of way’ is created under Section 1349 is where the parcel of land seeking access to a public way cannot reach the public way without crossing over a “pond, marsh or sea”, or “if there is a steep slope with a considerable difference of level between the land and the public way.” Should, however, a ‘right of way’ be legally available to an owner of a landlocked parcel of land for any of the circumstances provided under Section 1349 of the CCC, the ‘right of way’ is legally granted without compensation (unless otherwise agreed privately between the relevant landowners) and the owner has the right to cross the adjacent parcel of land to access the public way. Furthermore, the landlocked owner may even legally construct a roadway at such owner’s expense where necessary, provided that the owner does not cause damage to the adjacent land connecting the access. Although Section 1349 provides a significant right to owners of landlocked parcels of land, it should be noted that the Section also provides for liability in compensation for damage caused by the owner utilizing any such ‘right of way.’ As such, any land owner who elects to exercise a ‘right of way’ under Section 1349 of the CCC where available should be aware that they could be liable for damages caused to adjacent land from their crossing of the land to access any public way.

Every registered servitude should also be accompanied by a servitude agreement setting out the detailed scope of the servitude. It is therefore key for dominant landowners seeking to secure a registered servitude to determine the precise scope of the servitude to be registered with a servient landowner. The scope may include matters such as whether the servitude is for compensation or no compensation; whether the servitude covers the entirety or a portion of the servient land; expenses for maintenance and upkeep of the servitude; and whether the servitude is strictly for access for the dominant landowner, or also for the landowners invitees and others. Each such agreement setting our the scope of the servitude should be registered with the land office in the event there is ever a dispute in relation to the use. The details of such agreements are frequently overlooked, causing disputes later on when uncertainty is challenged by abuse of a right or denial of it. The main benefit of a servitude over a ‘right of way’ is that is often a more flexible option for landowners, covering a larger scope of access matters such as utility connections and specific access rights. Moreover, servitudes are also available for landowners who are not landlocked and may already have access to public ways, but wish to have access across another parcel of land. However, landowners seeking to obtain servitudes should be aware that servitudes are registered by the mutual agreements of the dominant landowner and the servient landowner and as such, may ultimately involve the dominant landowner paying some compensation to the servient landowner for the servient landowner’s agreement to register the servitude. Conclusion Whilst there may be many options available to landowners for access matters, including private access agreements, the two predominant legal rights available to secure under the Civil and Commercial Code are ‘rights of way” under Section 1349 of the CCC, and servitudes under Section 1387 of the CCC. Rights of way can be legally obtained in favour of a parcel of land which is landlocked from access to the public ways, whereas servitudes provide flexibility dominant and servient landowners to agree to a specific scope of a registered servitude in a servitude agreement. If you are purchaser, thinking about buying a property in a project or development, you should ensure your advisers are checking, to a high level of detail under your agreed retainer with them, these types of rights if they apply to the land of the relevant project, and the nearby public highway. Servitudes Given the narrow conditions necessary to obtain a legal ‘right of way’ under the CCC as discussed above, for many landowners, and of course for developers who are preparing project land professionally, an access servitude often provides a more practical and flexible legal option. Servitudes are legally registered rights of land (or immovable property as it is referred to in the CCC) whereby the land in which the registered servitude benefits is known as the dominant land, and the land on which the servitude in registered against is known as the servient land under Section 1387 of the CCC. As such, servitudes are real registered rights for a parcel of land and may include a number of benefits, or rights, in favour of the dominant land based on the particular scope of the servitude. Such benefits typically include rights of the dominant land to have vehicle, pedestrian and utility access connections across the servient land. Once registered at the Land Office, a servitude is documented against the title deed of the servient land in favour of the dominant land and lasts in perpetuity unless extinguished by mutual agreement of the dominant and servient landowners, or by operation of law for non-use for a period of 10 consecutive years.

Mr. Michael O’Neill of Ultimate Luxury Villa Rentals commissioned Helicam to obtain cutting edge promotional material for their six properties in Phuket and Marbella (Spain). The properties included three luxury Spanish villas, a villa at Sri Panwa Phuket, a condominium at the Royal Phuket Marina and a luxury Princess yacht. At each property Helicam produced aerial and ground photography, an interactive virtual tour and a promotional video. A complete set of multimedia promotional material provides many different avenues for advertising exposure – websites, agencies, YouTube etc. The Helicam team first flew off to Marbella where they were located for 10 days to capture all imagery required. The remaining photography was completed at the Phuket-based properties and the 23m Princess yacht out in the Andaman Sea. Priority is given for helicopter aerial work since rough seas and high wind can make things tricky to operate the 5ft Helicam helicopter. A selection of models were chosen from a Spanish model agency to be filmed for the promotional videos. Post production and editing were undergone at the Helicam office in Phuket.

My mind recently has been on my ever-expanding stomach, and fitness and sports in Phuket. But what is available as staying fit and healthy in Phuket can be a chore, as the availability of facilities is seen as limited, and the prevailing heat when exercising outdoors, restrictive to some. With a little planning and awareness, it’s possible to get the most out of life here without damaging your health in the process. There are a number of places and groups on the island that are committed to helping people keep fit, as well as having a great time often with a few beers to polish off the exercise afterwards. If doing exercise solo is your thing, lately there’s been a large increase, all over the island, of health and fitness gyms. Gym work is an excellent way of maintaining fitness, particularly for those who wish to exercise

and work out in air-conditioned comfort, whilst watching TV. There are too many gyms to mention here in this article, so ask around in your area for what’s available. Most offer day, monthly or yearly membership and many have a Thai, resident or tourist pricing policy. Useful info Keeping Fit badminton courts, football pitches, a gym, as well as daily classes of tae kwon do. Membership is available; as are casual visits. It’s a challenge to find out what is open and when, and how much things cost, so I suggest you have a native speaker call or, better still, go with you to inspect facilities and discuss options. There are also some good jogging trails around the area. For running, and you need to keep away from the traffic or off the beach, try Suan Luang Park which also has t’ai chi, or the Hash HouseHarriers (HHH) – dubbed ‘the drinking club with a running problem’. HHH organizes weekly runs and meets every Saturday at the Expat Hotel, Patong. See www.phuket-hhh.com. For some beach exercise and those wanting to try beach volleyball, an informal group has played on Karon Beach just north of the circle, for several years. Drop in on a game on Friday afternoons at around 5pm. For rugby there’s the local club, Phuket Vagabonds, which organizes regular matches and tournaments. www.phuketvagabondsrfc.com. Upping the excitement level, and for those looking for an adrenaline rush, kite surfing is available for all ages at Nai Yang Beach during low season, and Chalong Bay during the high season. Mostly played by friendly Thais, the actual games can be competitive and most will welcome a foreigner to join in for a kick-around. Aerobics, the exercise of choice for many Thai ladies, appears to change homes frequently, although you can usually get a good workout during the evenings at the main Tesco superstore car park and at Suan Luang Park. There’s also golf, and with an increasing number of courses on the island, it can be expensive; much cheaper if you leave the buggy in the shed and walk the course. The Phuket Expat Golf Society has regular tournaments and can offer discounted green fees for residents. There are also regular tournaments, some serious, some more fun and Loch Palm has a discount yearly membership program for Phuket residents. Taking part in the mini- or full triathlons is another option, and I see the interest in bikeriding expanding on the island. Finally, there are the pubs which organize a range of sports more suited to lounge lizards and couch potatoes. Whilst darts and pool may not get you fit, it can take you away from watching the TV.

Muay Thai is also popular and there are about four or five Thai boxing centres in Phuket, mostly in the Chalong Kata area and one near Phuket Zoo. They not only provide instruction in this art, which is rapidly increasing in popularity with clients from overseas, but also offer fitness programs.
