Our 39ft Catamaran “DaVinci” is named after our iconic Italian restaurant in the south of Phuket Island. This locally built catamaran can take up to 12 passengers comfortably for a day trip or sleep up to eight people for overnight stays. This cruising catamaran is equipped with four cabins, two doubles and two singles as well a sleeping area for two in the main cockpit above deck. Gulu Lalvani One of Asia’s leading businessmen and the UK's fourth wealthiest Anglo Asian, Gulu first came to Phuket on holiday in 1991 and fell in love with the place. He decided to retire here but, typically for Gulu, retirement meant hard work. Where are you from? I was born in Karachi in Pakistan and raised in Mumbai the capital city of the Indian state of Maharashtra. What made you decide to move to Phuket? For a long time my hobby was visiting three new destinations each year, chosen according to the four "S" factors: Sun, Sand, Sea and Sailing. In 1991 someone told me about a new resort in Phuket called Amanpuri, so I decided to try it out that Christmas. I took my wife and my family out on a yacht trip and what I saw that day was so mind bogglingly beautiful that before the end of the holiday I'd bought a villa at Amanpuri and stopped looking for new places to go. You could say that was the beginning of my love affair with Phuket. It was therefore a logical choice, when I retired in 2002, to move here. What did you do before you came to Phuket? I was the founder and chairman of Binatone, the world’s second-largest manufacturer of cordless digital phones. I founded the company in 1958 and went on to consumer electronics and to telecoms in 1983 when telecoms became deregulated in the UK and Europe. At that time the company was based in the UK, but I moved the HQ to Hong Kong for the tax advantages and also to design, develop and manufacture the products in China for export all over Europe. What do you like most about living in Phuket? Well, first of all its accessibility. Within three or so flying hours of Phuket you have 40% of the world’s population, with both China and India enjoying a GDP well above average. And I’m not alone in my ‘love affair’ with Phuket. When my daughter saw how romantic it is, she asked if she could get married here. “Well of course,” I replied, “but first there’s the small detail of finding a husband!” Anyway, it’s a wonderful wedding destination and yes, she did hold her wedding here – she married an Englishman. What’s the most frustrating thing about living here? That’s a good question. I think the political divide sometimes seems insurmountable – the yellow shirts and the red shirts is a difficult situation and can seem frustrating. How do you spend your time? I’m retired but I'm not the sort of person to spend all day every day on a golf course or diving or in a casino. I like to be 'doing' things. My hobby is boating and one of the first things I noticed here was the astronomical import taxes on boats; they added up to more than 240%! An imported million-dollar yacht would have had a ridiculous price tag. So I approached the then Prime Minister and was allowed a 15-minute slot with him. I told him that Thailand was in danger of losing out to Malaysia, where foreign yachts can can stay indefinitely without attracting import duties or taxes. Plus, unlike Phuket, Langkawi Island was a 100% duty free destination. I pointed out that in the last two years of my research, I'd found that not one single person had imported a yacht; 240% of nothing is nothing, I told him. I also said that if he brought the taxes down, I would build a world class marina here on the island.

He cancelled his following meeting and we ended up talking for a lot longer than 15 minutes. At the end of an hour he stood up, shook my hand, and said, “You can go ahead and look for the land.” Tell us about Royal Phuket Marina. We're in a premium spot – right in the middle of the island on the main road and within minutes of the top international school and a short drive from the airport – but the biggest challenge we've had is access for larger vessels at low tide. Finally, we've been able to get dredgers working on deepening the channel but, because of various factors outside our control, it's best not to try and predict when the work will be finished. I'm hopeful, though, that we're nearing the day when the channel into Royal Phuket Marina will be fully open and accessible 24 hours a day. Also we’re in phase three of our property development – introducing a new batch of more affordable one- and two-bedroom homes. Are you involved in any local charities? Yes, I am but prefer to donate and support them rather than sit on committees. I simply don’t have the spare time. How do you evaluate success? I enjoy my life and what I do and aim, as my legacy, to put Phuket on the map as a top yachting destination. I'll be happy to be remembered as the man who built Phuket's best marina and who got yacht import duty down to zero. POSTSCRIPT: During 2002 / 2003, a group of expatriates in the marine leisure industry, headed up initially by then UK Hon. Consul Alan Cooke MBE, formed the Marine Alliance of Thailand (MAT) and worked tirelessly with the Ministry of Tourism and Sport as well as with TAT and senior officials in the Customs, Marine, Revenue and Immigration departments, to create, and 'sell' to stakeholders, a convincing case for reduced import taxes on yachts. There's no doubt that the initial impetus for change came from the very top – and there's equally no doubt that there were several 'fingers in that pie'. While congratulating Gulu Lalvani on the major part he played, we should not forget the others who gave huge swathes of their time, talent and energy. After all, as Gulu himself says, he doesn't "sit on committees". Unfortunately, in government, the only way to get things finalised is by finding the time to work with, and convince, the people who have the power to block results. MAT comprised Alan Cooke, Kevin Quilty (then Sunsail), Andy Stephens (then Royal Phuket Marina), Grenville Fordham & Andy Dowden (co-founders of the Phuket Boatshow) and Vincent Tabuteau (Asia Marine). PAUL POOLE 10 YEARS ON strong position as they could negotiate the price of sponsorship down and it made rights holders wake up to the fact that they needed to go the extra mile in delivering benefits to sponsors.

Paul Poole Paul Poole (PP), founder of ‘The Sponsorship Experts’, hit the scene 10 years ago to mixed reviews. He’s been accused of fostering the commercialisation of sporting events – an accusation that he’s proud to acknowledge is true. “That’s what we’re here for!” he says with his trademark knowing grin. Far from the early days (when many – particularly regatta organisers – viewed the man with deep, dark suspicion), PP is now firmly entwined in pretty much every significant sporting or lifestyle event in Thailand, from marathons and triathlons in Phuket, to football and motorsports in Buriram, to muay Thai and mixed martial arts in Bangkok, to boat shows and yacht races in Pattaya, to the recent 4th Asian Beach Games 2014. If there’s a whiff of sponsorship in the air, you can be sure PP will be in the middle of it. But who is PP…?

Where are you from and how long have you been living in Thailand? I’m from the UK and have been living here for exactly 10 years. Why did you decide to make your home, and base your business, in Thailand? Why Bangkok? I fell in love and followed my then (Thai) wife, who I met in London in 2000 while she was completing her PhD. I’m a city boy and Bangkok is one of the ‘coolest’ cities in the world, alongside London and New York. What was your last job before moving to Thailand? Client side, from 1988-2000 I held senior (through the line) marketing positions at Wrangler, Levi Strauss, Polo Ralph Lauren and Diesel. Agency side

What do you think is your most significant personality trait that has contributed to your success? TENACITY! What do you see as your three biggest successes to date? Working with leading brands from Jaguar Land Rover to Pepsi-Co; working with government bodies such as SAT, TAT, TCEB; launching the Football Studio with our European partner, Purple Tangerine.

10 YEARS ON from 2000-2002 I held Board Director positions at PR21 (Edelman) and Cohn & Wolfe (WPP), with a creative development brief for clients, including Orange, Coca Cola, Cadbury Trebor Bassett and Guinness UDV. Since 2002, I consult for a number of the world’s leading brands, agencies and cultural organisations, focusing on North America (New York-based), Europe (London-based) and South East Asia (Bangkok-based). I’m also a founding member of the ‘Culturepreneur® Network’, an initiative designed to improve the dialogue between the arts and business, which was acquired by London-based Cult.Brand in 2012. What influenced your decision to set up a sponsorship marketing business? On arriving in Thailand in 2005 I saw that experiential marketing was the tool of choice for most marketers across the region. But I was surprised to see that – although the majority of experiential marketing was being implemented alongside events that were 100% reliant on sponsorship – there wasn’t an agency focusing in this area. So we filled the gap, specialising in commercial sponsorship and partnership marketing.

We’ve packaged, sold and managed sponsorship and partnership opportunities for a wide range of rights holders and worked with many of the world's leading brands to source and engage the right sponsorships and partnerships. How big is your team? We have a core team of 10 sponsorship consultants and sales experts, all hand-picked. Tell us something about your own role in the business? As the lead sponsorship consultant / sales expert, I’m hands-on across the business, and close almost all deals personally. Describe your leadership style. Somewhere between Ari Gold (Jeremy Piven’s character in the television series ‘Entourage’) and Genghis Khan. What’s your target market? Do you face much competition? How do you reach out to your target? We focus on marketing to many different industries. We’re unique in Thailand so we have little or no local competition. We’re part of an independent international network of strategic alliances specialising in commercial sponsorship and partnership marketing and we’re a member of the Asian Sponsorship Association. We also subscribe to Asia Sponsorship News, the leading market intelligence service for the sponsorship industry in Asia, which provides us with unrivalled market intelligence, insight, reports, analysis and case studies.

Explain briefly what sponsorship marketing is, how it works – and why there’s a need for companies like yours. We act as a catalyst, bringing together rights holders and brands and maximising the relationship. Over the years Helicam has been assigned many different types of photo/video productions including tourism, leisure, property, and industrial businesses. • Wash the potatoes, cut into wedges, season with some salt and drizzle with olive. Place on a baking tray and roast slowly in the oven until golden and crispy on the outside and fluffy on the inside • Season the flank steak and grill on both sides to your liking and set aside to rest in a warm place for about 10 minutes • Melt butter in a frying pan; add garlic, chopped anchovy filet and cherry tomatoes. Season to taste (be aware that the anchovy filet is salty) • Make sure the heat is not to strong otherwise the butter will burn, add lemon juice for acidity and set aside. • Use a glass bowl or stainless steel bowl add the melted butter with the cherry tomatoes, and anchovy, add spring onions and fresh herbs • Slice the beef into ½ cm strips and add into the butter with half of the rocket salad and stir well • Choose your desired plates for presentation • Place the potato wedges freestyle then top the beef with anchovy butter equally on top • Top with the rest of the rocket leafs and the parmesan shavings and decorate with lemon wedges

Not far away at the Surin (clock tower) traffic roundabout, diagonally opposite the Metropole Hotel, stands the Mee Ton Poe restaurant – another Phuket Town old timer that is easily recognised as it’s the busiest restaurant in the area. Here, from early morning to mid-afternoon, savvy locals enjoy rice vermicelli with fiery curries, and delicious egg noodles with vegetables and meat in a sweet oyster sauce – all at very reasonable prices. 81 D6 Mee Ton Poe restaurant

The cheapest of cheapest eats For rock-bottom-priced food you simply cannot beat the local fresh markets operating all over the island on each day of the week. You can get a complete meal at a market: papaya salad at one stall; deep-fried or barbecued chicken at another; tasty banana pancakes at the next, as well as fresh exotic tropical seasonal fruit. Bag it all up and enjoy the whole lot on the beach or your hotel balcony with a few icecold brews – all at a fraction of the cost of a restaurant meal.

Other places When it comes to getting a reasonably priced meal, resort destinations are notorious for overpricing. But the good news is that Phuket Island is large enough to absorb both tourists’ and locals’ culinary needs so it’s perfectly possible to get cheap nosh on the island without slumming – but you’ll have to go looking for it. For most Phuketians, westcoast restaurant prices are prohibitively high but, for visitors to the island, east-coast eateries are enticingly cheap compared to the prohibitively high costs of dining out back home.

Further to the west of town along Phang Nga Road and near to the famous On On hotel (featured in Hollywood’s The Beach) is The Cook, where the genial owner, an ex-resort chef, serves up healthy dishes – many for less than 100 baht. Again, frequented by lunchtime office workers but, unlike Kota Khao Man Gai and Mee Ton Poe, The Cook stays open for dinner and has English-language signage so it’s easy to recognise.

Patong The best cheap eats in west-coast Patong come in the form of food halls. Above Banzaan Market near Jungceylon, in Jungceylon itself, and on the top floor of Ocean department store on the Beach Road, you’ll find these bazaar-like affairs with food stalls hawking chicken, duck, noodles, and rice dishes at affordable prices. Scattered throughout Patong you’ll come across many mid-range restaurants, almost always with a picture menu outside with price listings so you’ll have no problem identifying which are the ones to go for. 75 D3 Banzaan Market

On the east coast of the island, Phuket Town has lots and lots of cheap eateries, some of which have been around for many years. On Soi Surin Montri, just steps away from the Robinson department store is find Kota Khao Man Gai, a family-run restaurant that has been open since the 1960s. Here, three basic dishes are served up; the eponymous and delicious khao man gai – steamed chicken with rice; rice with crispy pork (moo krop), and red pork (moo daeng), as well as a combination of the three. Tremendously popular with the lunchtime crowd, the 50-baht dishes are served up with a small bowl of clear soup and a plate of garlic, coriander, spring onions and chilies along with complimentary Chinese tea or water. It’s best to go there just before or after lunch.

In Chalong, some 11km south of Phuket Town, next to the police station on Chao Fa East Road, a raft of food stalls open just before lunchtime and serve food until supplies run out, mostly past eight o’clock in the evening. You can choose from at least 15 curry and fish dishes here, all displayed in what look like baine maries but without a heating flame underneath (Thai dishes are equally delicious served piping hot or cold as long as the steamed rice is warm) and there’s great little phad thai outlet there, as well as papaya salad stalls. The fan-cooled seating arrangements are a little unconventional but fun, and of course takeaways are part and parcel of the this form of eatery. Island-wide you can get cheap eats similar to the Chalong setup where it’s entirely normal to indicate at (but not point with your finger) dishes you’d like to order without having to name them; even Thais do this.

Overall To cut a very long story short, the best advice for folks looking to find a cheap meal in Phuket Island is, ‘don’t be afraid to have a good look around.’ Read through the restaurant’s menu beforehand and don’t be afraid of street food as long as the makeshift setup is busy, even if it seems quirky; there’ss safety in numbers. You won’t however, find cheap eats in a hotel, so you’ll have to hoof it a little to discover the best places around it. But that’s half the fun in this friendly and welcoming ing country, isn’t it?

Phuket Botanic Garden should be on a list of attractions to visit while in Phuket! The site is in the Chalong area not far from Chalong Temple. The garden features an amazing horticultural display split into 30 zones, each containing different species. The site contains a butterfly garden in addition to various other gardens: Herb Garden, Orchards, Sufficient Garden, Orchid Garden, Fern Garden, Cactus Garden, Rainforest, Japanese Garden, English Garden, Bali Garden, Water Lily Garden and a Palm Garden. The Phuket Botanic Garden also serves as a research centre for many rare plant species. Take a picnic lunch and enjoy these immaculately kept tropical gardens.

If you are here with your family, horse riding is a relaxing and romantic way for you all to explore Phuket's natural scenery. In contrast, a brisk canter along the beach is most invigorating.

A hundred years ago, Phuket City had a prosperous economy based on tin mining, and even back then was an international centre with a large expatriate community of Chinese and Europeans.

There are two clubs on the island: Phuket International Horse Club, easily spotted at the entrance to Laguna Resort, is open seven days a week from 8am until 6pm. Phuket Riding Club is located in the southern part of the island on the road to Rawai Beach, and offers riding tuition for all levels of ability including children. The Club is open daily from 7am until 6.30pm.

They built beautiful homes in the style called Sino-Portuguese – terraced townhouses with narrow frontages and accommodations which stretch back from the road. The interiors often include walled gardens and fountains, and are beautifully furnished with antiques and Chinese inspired decorations. Rommanee Road is a fine example which has been fully restored. Visit Talang Road, Yaowarat Road and Dibuk Road. Nowadays, these streets in the Chinese quarter have transformed themselves into busy thoroughfares featuring antique shops, speciality restaurants and more. 81 B4

The oldest Chinese school in Phuket, Thai Hua School was built in 1911 and has now become the Thai Hua Museum, serving as a community and exhibition centre for baba arts and culture. The museum is a two-storey building with the upper level balconied internally to look down on the ground floor. Many of the exhibits and artifacts relate to the art and culture of China. Some of the old schoolrooms still remain as they were in the past with old school desks and photographs of former students. The Phuket Thai Hua Museum is on Krabi Road. It’s open on Tuesday through Friday from 1 to 8pm and Saturday and Sunday from 9am to 8pm. Entrance is free. It's certainly worth a visit.

Will BOI attract more interest from foreign investors in 2015?

W

ith the recent news in the Bangkok Post (and other national media platforms) that the Thai government is largely considering a change to the provisions in the Foreign Business Act (FBA) in relation to the definition of a ‘foreign’ Thai limited company, one begins to wonder whether the Board of Investment of Thailand (BOI) will attract more interest from foreign investors looking to do business in Thailand in 2015 and beyond.

Make no mistake, the BOI and its investment incentive programmes have, in the past, been one method for foreign companies and foreign investors to obtain control over their business affairs in Thailand. However, if the FBA is amended, the BOI may attract more interest than it has in the past, even for much smaller businesses which have in many cases, up to now, relied on the existing rules (under the FBA) on foreign control over Thai limited companies, often viewing the BOI in many cases as more difficult and impractical to seriously consider as a realistic option. For those that are not familiar with the proposed changes to the FBA, it has been recently publicised that the Thai government is strongly considering changing provisions of the FBA that would affect the definition of a foreign owned or controlled Thai limited company, requiring a foreign business license to operate in Thailand. Essentially, the proposal is to change what is considered by some in various professional circles to be a ‘loophole’ in the current law. Currently the FBA primarily restricts the ‘shareholding’ element of a Thai company only. That is to say, the famous (and current) 51/49 rule that most professionals and foreign investors in Thailand are keenly aware of. Under the proposed amended rules, the FBA would extend restrictions to include ‘foreign controlled’ Thai companies, meaning companies even with 51% Thai majority shareholding

(Advertorial) would be deemed to be ‘foreign’ under the FBA if actual control – either though adjusted voting structures or directorships – is in the hands of foreign nationals or foreign businesses. Of course, previous Thai governments have reviewed the FBA (most recently in 2007) and similar amendments have been considered in the past. However, steam seems to be gathering this time around to finally pass an amendment and put the amended FBA in place with at least some of the publicised proposals.

COMPLY WITH THE NEW RULES

Whether existing Thai companies with ‘foreign control’ that do comply with the existing FBA would be ‘grandfathered in’ to the new amendments is yet to be seen, but we have heard ‘rumours’ that this may be the case, or that the government may alternatively provide a transition period to comply. In any event, it is yet to be seen what the actual final bill will look like, and what exact provisions it will contain. But it does seem likely that a final bill will be put forth in the very near future. Existing and future planned businesses will therefore likely need to be reviewed for corporate structure compliance under any amended FBA.

Increased BOI interest in the wake of the new FBA? In light of the proposed changes to the FBA, it is possible the BOI will see increased attraction to foreign investors, even amongst smaller businesses that are eligible for investment ‘promotion.’ Recently, the newly appointed members of the BOI, chaired by Prime Minister Prayuth Chan-ocha, announced its so-called ‘Seven Year Investment Strategy’ for SMEs (small and medium sized enterprises). As stated in the BOI press release dated 25th November 2014, the “vision” of the ‘Seven Year Investment Strategy’ is “To promote inbound value-added investments and Thai investments overseas to enhance the country’s competitiveness and overcome the so-called middle-income gap. The new investment promotion policy will give priority to investments that are beneficial to and supportive of the country’s overall development strategy.”

The ‘vision’ and the emphasis on ‘SMEs’ in the press release seem to at least imply a strong welcoming to small businesses to apply for a BOI ‘license.’ However, as with the proposed changes to the FBA, it is not yet known for certain which types of businesses would be targeted by the BOI for promotion, although the BOI press release goes on to vaguely state businesses that could be promoted, including – "high tech and creative industries, service industries that support the development of a digital economy and industries that utilise local resources.’" The reality is that BOI benefits could potentially supplant the proposed changes to the FBA if implemented properly, and ease of access to the foreign investment community is also made a priority of the Board. Obtaining a BOI license may permit a large category of exceptions to the FBA – including permission for 100% foreign controlled and/or owned companies, reduced work permit requirements, and other benefits permitting foreign control over Thai limited companies. That said, foreign investors will need to monitor the final FBA bill, if it indeed becomes law, and ultimately the promoted categories of businesses under the announced BOI policies to assess whether existing businesses should be restructured to comply with new laws and policies, and furthermore how planned businesses should structure their corporate affairs, whether under the amended FBA provisions or consider more carefully the BOI as a realistic option.
