Special delicacies with specific ingredients added for a little extra luck during the coming year are eaten and the colour red, considered a lucky colour to the Chinese plays prominence with money in red envelopes are given to family members and close friends. Our 39ft Catamaran “DaVinci” is named after our iconic Italian restaurant in the south of Phuket Island. This locally built catamaran can take up to 12 passengers comfortably for a day trip or sleep up to eight people for overnight stays. This magnificent vessel is equipped with three cabins, two doubles and a twin with two bunk beds. DaVinci S50 is equipped with a fully functioning galley with an air conditioned dining area which can seat up to eight people. The dining room is also a lounge equipped with a large screen TV, Bose sound system and DVD player. There is a large foredeck with lots of room to relax on the comfy cushions and enjoy the cruise while admiring the scenery. Up on the flybridge there is seating for a further eight people. This high powered yacht can take you on a wonderful day trip around the islands or an overnight trip for those hideaways further away.
The dinghy ramp at the opposite end of Soi Sukee and close to “The Lighthouse” makes for easy collection and delivery subject to tidal restrictions (see page 22 for tide tables).

150 individual races a new record for the region’s most revered international yachting spectacle In honour of the birthday of His Majesty the King of Thailand, the 2014 Phuket King’s Cup Regatta has staged another world class sailing event at its home – Kata Beach Resort on the island’s southwest coast. New class ratings delivered exceptionally close racing this year, with some epic confrontations across the fleet. In many classes, racing came right down to the wire, with seconds between first and second throughout the week, and marginal point scores determining winners and runners-up.

Phuket Island, and more specifically Kata Beach, delivered a week of beautiful weather, albeit a little short of the necessary wind at times. This, together with the great hospitality and camaraderie, contributed yet again to the enviable reputation of this regatta – one of several in Thailand that, together, enhance the reputation of Thailand as a great sports sailing nation.

Accor Hotels have recently opened Pullman Khao Lak Katiliya Resort & Villas – a new resort in Khao Lak. This new property destination required a new set of imagery to showcase its attractions. Helicam flew into action to capture the required images for marketing – photographing its lifestyle and interiors, with an interactive 360-degree tour and a new photographic map to be used for navigation purposes showing the entire grounds. The Helicam hexocopter is operated from a ground station computer to fly a programmed grid over the resort grounds at a given altitude. The onboard camera maps the area and the resulting images are stitched together to provide a detailed map featured below.

To bring in glamour and lifestyle The Model by Top – a modelling agency supplied four professional models to be photographed – Nikki, Linda, Chris, and Raffel. High-speed flashlights with diffusers provided soft lighting to photograph these beautiful models posing around the sumpuous resort. Not only that, but 360-degree images were also taken in each of the room types to be programmed into an interactive tour. These images allow viewers to decide on which room they prefer to book online.

Where are you from? I’m from Cooma, Snowy Mountains, Australia. When did you move to Phuket? I first arrived in 1993, I went away in 1997 then came back in 1999 but when I first came to Phuket I stayed in Holiday Inn, looked out of the window and thought, “Why on earth do people come to this place?” But then I came back!

How does doing business here compare to back home? Well, maybe there’s not so much red tape here as back home, or maybe I haven’t noticed it. People say there’s a lot of red tape in both places but I’ve never been in business in Australia so I’m not sure. Where do you live in Phuket? I live in Kamala. What determined your choice of location? Well, I originally lived in Chalong but my husband Harry got a job in Kamala so we moved up north. Do you own your house or do you rent it? No we rent it for only 8,000 baht a month but we’ve probably put in over a million baht worth of renovations to it. We adore it because it’s right near the beach. What kind of car do you drive? A Mazda 3 hatchback because it looks sporty, it can go fast, and I can do pie deliveries with it as the back seats fold down. What do you like most about living in Phuket? The people that I meet and the friends you can make here. The people who live here are, for the most part, interesting and different from the types you’d meet back home and that’s nice.

This small family run restaurant is one of Phuket's older Hokkien noodle shops. Inside is a collection of old Chinese ceramics and silk flowers on the shelves. What did you do before you came to Phuket? I was a bank manager then I was a business development manager.
Tell us something about Lady Pie and how it evolved I believe Lady Pie became successful by me being totally and utterly ignorant of Thai laws so I’ve sort of stumbled on through the years and learned a lot from it. “Ignorance is bliss,” if you want, like when I applied for licenses that are needed if you produce food to sell in supermarkets. I went along to the Department of Health to get the necessary papers and I had to go back countless times. To cut a long story short if I’d have known back then what I know now (how complicated paperwork can be here) things maybe would have been a bit different.

What made you decide to live here? Well, I sailed here, dropped anchor and that was that!
Did you come here to set up a business? Then supermarkets started expressing interest in my products and that grew bigger and bigger until nowadays where we find ourselves very busy indeed.

And what’s the most frustrating thing about living here? Well, people talk about the traffic and they do go on grumbling and groaning but I never complain about anything! I just adore living here! It’s as simple as that. How old are you? And what do you think the future holds for you? I’m 61 and a half… The future? I’ll always live in Phuket but now that the business is established I can leave that in the hands of my coworkers and go off and do trips – sailing, road trips upcountry. Both Harry and I love the north of Thailand. And we have just come back from Krabi where we escaped the Christmas and New Year madness. We have a trailer sailor that we can unpack anywhere and head off out to sea. We spent a week there and Krabi is stunningly beautiful. We were in Ao Luk which is totally away from everything.

Papaya Chutney Ingredients: Serve 8
Chicken liver parfait to serve 10 Ingredients: ½ a green apple 20gm butter Orange zest Thyme Rosemary 100ml red wine Ginger
200gm chicken liver 150gm goose liver 250ml cream 300gm butter-melted 2 eggs Nutmeg
1tsp chili sauce 1tsp Tabasco ½ onion-cut into brunoise ¼ whole papaya-peel, peeps out, slice in cubes ½ red pepper
200gm honey ½ cup red wine vinegar ¼ cup ginger cubes 1 clove garlic-chopped Salt
Rye bread crostini Take five slices of rye toast bread, cut into round molds, sprinkled with walnut oil and bake slowly in the oven until golden brown and crispy. Cool down.
Foie gras (portion approx. 50gms)
*Sauté the ginger, apples in a hot pan with butter. Add thyme, rosemary, orange zest. Deglaze with red wine and reduce.
Season the foie gras with salt and pepper and grill on both sides. Deglaze with brandy.
Mixed into the livers and put in the food processor. While processing, add melted butter, eggs, cream and nutmeg. Pass through a fine strainer and place into dariole mold. Bake in the oven 100 degrees for 50 minutes.
*To assemble the dish, take out the liver parfait from the molds and put in the side of the oval plate. Line them up with papaya chutney, crostini. Garnish with tendrils and edible flowers. To finish the dish add some drops of the chili-balsamic reduction to give a colour contrast to the plate. It’s then ready to serve.
Refrigerate and let it set.
About Chef Ronnie S. Macuja Ronnie graduated from a Marine Engineering course back in the Philippines and found himself working in a hotel a few months later... so bizarre that until now he finds it hard to believe . He was offered a two-year apprenticeship by the Manila Hilton International and was part of the team that won top prizes two years in succession in international culinary events. When he was offered work in New Zealand , he took the opportunity and never looked back . He was employed by Hyatt Regency in Auckland and from being commis chef climbed his way up to be Chef de Cuisine at the Top of the Town restaurant, the hotel’s famous fine-dining restaurant. Ronnie is known for his inventiveness in preparing seemingly ‘simple’ dishes in a completely different way. What to say about Paul Ropp? He’s been there , done that: he was the first in Bali to open an innovative clothing store, and so on – all the bases have been covered, so let’s start off with a bang with the man himself. S.B. Tell it like it is Paul. P.R. One of the great pleasures of Bali has given me of course, is my family. Both of my daughters were born here, with an Italian lady who was gracious enough to share them with me, Susanna Perini, from Biasa. What I enjoy most is going out in Bali, and for someone who’s been here for 38 years, is it doesn’t have the magic it used to have, because we didn’t have the people we have now, but the kind of people we had back then were kind of interesting, because they were more adventurous and they were travellers. Now the traffic is what it is and people are of course coming in droves and droves. What stands out the most is that I see generations of kids, I see people like myself, people who came here 40 years ago, their children and their children’s children, and the amazing quality is, all these generations seem to get along very well together; the amazing qualities of people forging in new directions of relationships and concepts of family. It’s not the traditional family anymore but a turbid family that I’ve seen on this island of Bali, great friends of mine, three different wives, four different children, grandchildren, everyone gets along with each other, it’s an amazing quality. The concept of love is there, ever prevalent and this adds to the colour of Bali, because the quality is so special, to be able to go to a party and have the kids turn around the next morning at breakfast and say, “Boy the dinosaurs, we can’t keep up with them when they get up on the dance floor.”
S.B. All in Asia? P.R. Well, we export to 35 different countries; miraculously we haven’t had a trade show or a salesman in 13 years, it’s all word of mouth, very grass rooted and our developments stem from the visualizations of these colours and textures, details, and we take it forward in order for it not to be fashion, but lifestyle. People can wear their garments during the day, take them to the shower, put them on the floor, dance on them, hang them up and they’re pretty much ready to wear the next day. S.B. Are you adding anything new to the fashion link?
S.B. I presume you’re also talking about the overall energy you put into your products as well; they’re forever young, with a creative mind, and individual in the fashion industry’s marketplace over the years. You’ve never been influenced by other fashions, so what’s new for 2015? P.R . I have always been affected by creative direction. I’ve been inspired, and when I see it, I do it in my version of it. It instills something in me and wakes something up, but I don’t want to do what has been done but I can certainly do something with what I’ve seen and take it forward. Over the years it’s been given the name Paul Ropp we don’t knock it off but we ‘Roppify’ it! Inspiration is in the air, it’s in the smile. With me, I create colours that give people a different experience, because I traditionally use the same colours that people are accustomed to seeing. I like to create new colour combinations – a method which has a tendency of programming a feeling, and the feeling I go for as a designer. Correction, excuse me, I’m not a designer, what I do myself is more of an artist, I don’t think of myself and what I do as going into fashion or wanting to be in fashion, I have no desire for that whatsoever. When I approach my work I use colour combinations to get reactions from people and the reactions I get are of a positive nature. Therefore we like to say that our clothes are less expensive than therapy! S.B. How many stores do you have to date? P.R. All in all, 32.

P.R. Strangely enough I started doing a men’s collection five years ago, parallel to the women’s collection which is number one. The men’s collection is really doing well, but what is new is that we started taking scraps from the cutting table (scraps which I used to pay people to take away) and we have utilized them in the making of accessories; they could be bags, shoes, gloves, earrings, necklaces, belts, any type of accessory and today, after two years, it’s the number two outlet. It’s overtaken the men’s collection and the waste or the recycled items stay in the factory, then they go to the villages and that adds labour so that the mothers can stay home with their children, as they have something to do in the house. It’s a form of domestic lineage, of keeping people working within the village and it’s a blessing. Now they have an opportunity to stay at home and not to go to a factory to work.
S.B. What is your schedule like? P.R. One thing I can share with people reading this is, you got to watch out forr what you wish for when you’re e young, because ause I’m a good example: I’ve got it, and now w that ou. I’ve got it, I’d like to slow down, thank you. S.B. So what you see in the future? P.R. I would like to do a Paul Ropp Hotel, something based on colours, the textures, the details, and we’ve proven that we are able to do in multiples, something dedicated to the creativity that we’re having here in our organization and the creativity I find ng outside. Young people today are looking for a way to express themselves. S.B. Haven’t they always? P.R. Always, always, always, but now today people are learning how to do it commercially. Young people are learning how to make a way to support themselves off their art and we get interns from universities and colleges from all over the planet and they come to us and they really don’t know too much, but as they start to get into it, we give them programs to work with, this individual, that individual and they start to come out, they have to use their fingers and their minds, their creativity and you just watch them open up. If we approve, then we will design a Shop in the Box Store for them. We build them and it comes out like a Lego set, out of a container, quick, quick, quick. Our newest one is out in the Maldives. S.B. Are you still doing fashion shows? P.R. Doing fashion shows is like giving birth; it takes a lot of preparation, lots of fiscal labour, a lot of love and a lot of money. We’re very committed to the expansions of our retail chain and online marketing and it’s been something that we’ve been learning to do over the last past decade.

Some years ago while on holiday in Thailand, he visited an organic farm in Petchaboon province and became interested in the natural healing properties of Thai herbs and spices. “I was particularly attracted to lemon grass as it was used in many popular Thai foods, as a medicine for stomach disorders and even as a repellent for mosquitoes,” he recalls. What’s your approach to marketing? How does advertising figure in that approach? We give our full support to local and international agents by investing the biggest portion of our resources in this area as we understand that multilingual intermediaries still play a fundamental role in the market. Advertising is very important to build brand awareness and confidence in the brand so we keep investing in the internet and local media. Has the political situation in Thailand, including martial law, affected your business? No. The Phuket beach clean-up and the anti corruption project has been much appreciated by our customers and fortunately we haven’t received any cancellation. What changes have you seen in the market in your business sector since you started? How have you responded to them? I have seen a rapid emergence of new market segments. There are many different types of customers now, all of whom have their own distinct needs, requirements and preferences. We have responded by launching new projects in different areas; our products now range from 1.7 to 16 million baht. What do you think about the changes to Phuket’s beaches? Is this good for Phuket’s target tourism? I personally believe that Phuket’s beaches simply need to be rethought allowing tourists to choose between organized and free beaches.

I am creative person, my passion is projecting and designing so developing homes seems to be the perfect job for me. And what do you like least about living here? Phuket traffic, rainy season and non-respect of deadlines by suppliers are my nightmares. Please give us an overview of your typical day ‘at work’. How do you schedule your time? Overseeing the construction site on a daily basis is my priority then I distribute the time left between sales, finance and research of new products and materials. Condominiums: What is Common Property? ur firm has recently seen an influx of enquiries in relation to the question of what constitutes ‘common property’ vis-à-vis ‘personal property’ in a condominium registered under the Condominium Act of Thailand. Potentially one reason for the increase in such enquiries is due to the rise in the number of condominium projects in and around Phuket, but another more probable reason is because, as Phuket’s condominium market matures, and more condominium projects and private condominium units are sold out to purchasers, the issue of use of the common property is becoming more prevalent.

Completed condominium projects often have common area space that is not ‘allocated’ as a residential or commercial unit in the registered condominium plans, and the use of such space is potentially a source of revenue for a condominium, or otherwise could be set aside for some specific purpose for the benefit of the so-called ‘joint owners.’ However, as one can imagine, there are regulatory requirements about the use of condominium ‘common property,’ in addition to potential joint owner approval requirements under the Condominium Act – as well as the registered rules and regulations. Given this reality, use of the ‘common property’ can be a point of contention between joint owners, with various joint owners having differing ideas about how the unused property of a condominium should be allocated. One such point of contention we have heard recently is that it is unclear whether a particular part of a registered condominium is ‘personal property’ or ‘common property,’ and thus a proposed use of certain condominium property is stalled on the main question of this article – What does, in fact, legally constitute ‘common property’ of a registered condominium? To be clear, ‘common property’ has a specific legal exhaustive definition set out in Section 15 the Condominium Act. In this author’s view, the definition of ‘common property’ can be summarised as follows: ‘Common Property’ is those parts of a registered condominium, including land and buildings, that are NOT registered on the public files at the Land Office as ‘Personal Property.’ An even shorter way of saying this might be: anything outside of the defined ‘personal property’ of a condominium is ‘common property.’
(Advertorial) (Advertorial) One might point out that my summary definition is merely a ‘negative’ one, and still leaves open a grey area for interpretation. However, the Condominium Act provisions on what constitutes ‘personal property’ supports this summary definition. Under the Act, ‘personal property’ means the registered condominium units, which can be (and are) sold to purchasers, because they have their own condominium unit title deeds, which define the individual ownership of the area defined on the unit title deed as the condominium unit. Thus, anything outside of the such individually owned ‘personal property’ is the ‘common property' and is jointly owned proportionately by all individual owners of the ‘personal property.’ Do the walls that separate ‘personal property’ condominium units constitute ‘personal property’ as well? The short answer is no, not in the strictest sense. However, such ‘partition walls’ are also not necessarily ‘common property’ jointly owned by all joint owners either. In fact, the Condominium Act (Section 13) defines the partition and walls between ‘personal property’ condominium units as jointly owned by the relevant condominium units divided. However, the Act goes on to say that the exercising the rights in relation to such partition walls shall be subject to the Rules and Regulations of the condominium. Does ‘personal property’ include the structures/buildings of a condominium?

As a corollary to the umbrella question under this article, we are often asked whether the structural buildings of a registered condominium could also constitute ‘personal property?’ The answer is generally, no, and is often confused with the area within the buildings that are registered as a condominium unit with a unit title deed.

Building structures of a registered condominium do not have ‘title’ that is transferable on any record at the Land Office, and are therefore clearly ‘common property.’ They are the ‘frame and structure’ of the registered condominium, and indeed, under section 15 (3) and 15 (4) of the Condominium Act are part of the ‘common property,’ subject to regulation by the Act and the registered Rules and Regulations.

An area within the structural buildings that does not have a condominium unit title deed would therefore also be ‘common property’ (a common example of this would be elevators or stairwells), because such area likewise does not have an individual unit title deed. An important consideration for condominiums it that individual condominium unit owners are prohibited from doing anything with their ‘personal property’ apartment units that would affect such buildings, frame, structure and stability because they in fact constitute ‘common property.’ What are the requirement for setting aside use of the ‘Common Property’ of a condominium? Under the Condominium Act, ‘common property’ can not merely be used without the proper consent of the joint owners. Section 46 of the Act states that a resolution must be obtained from the joint owners requiring at least half of the total votes of all joint owners of the condominium. Thus, the voting requirement to agree a specific use of a part of ‘common property’ is quite high.

Crawling into high season For a start, the high season in Phuket this year has been a little unusual. The usually dependable weather has not been itself, and is not even trying to be co-operative. Early mornings are cool and windy and we continue to have rain showers every evening while the days are cloudy and even a peak of the sun is brief. There are more than a few hundred thousand tourists in Phuket this season that have travelled a few thousand miles to enjoy the sun, sand and sea. Well, it looks like they will have to make do with only the sand and sea as the sun continues to play hide and seek. Another difference is that the amount of Russian tourists has dwindled dramatically compared to the same time last year. The fall of the Russian ruble has obviously made a significant impact on the bitter-cold winter travelling plans of many of its citizens. The tour companies who solely cater to Russian
tourists are now bemoaning their fate and are complaining that this high season might be a total washout for them. Surprisingly, they have not seemed to have learned or to have remembered the age-old lesson of not putting all your eggs in one basket.

Pattayaâ&#x20AC;&#x2122;s property market also seems to be the first to feel the ripple effects of the falling ruble. The Russian buyers who have bought property off-plan are now having extreme difficulties in meeting their monthly repayments. Cancellations of property bookings and forfeiture have also increased. As the ruble has dropped so dramatically, the repayments are now close to double of what they originally had to pay. Some developers have extended the loan period to assist their clients in the short term in the hope of holding on to the client but some clients have defaulted completely. In Phuket, we have heard of clients cancelling their booking and forfeiting the deposit for two-month holiday villa rentals while some clients, instead of staying the whole two-month period, just turn up just to stay for two weeks and leave. Both seaside resorts of Pattaya and Phuket will no doubt feel the swift effects of the falling ruble. Itâ&#x20AC;&#x2122;s been a bumpy 2014 year all in all for Thailand and the hopes of a good high season may now be dampened both by tourist arrivals and the weather. According to the Ministry of Tourism and Sports, the number of international arrivals till Oct 2014 has dropped 3% to 19.7 million from 21.6 million during the same period last year. It would probably be impossible to achieve the targets for 2014 set by the ministry in terms of arrivals & revenue.

Try Muay Thai (Thai boxing) Saphan Hin Stadium in Phuket City stages regular demonstrations by well-trained martial arts experts and there are plenty of schools on the island offering training in Muay Thai. If you prefer a quiet gym, then Rawai Muay Thai Camp or Tiger Muay Thai & Mixed Martial Arts on Chaofa West Road in the south of the island might be suitable for you. If you plan to watch a Muai Thai fight for real, you should visit the boxing stadium located in Bangla Road, Patong. Bouts are held every Friday evening from about 8pm.

The Mining Museum Housed in a large pink Sino-Portuguese style building with a courtyard and fronted by a park and lagoon, it's a rather incongruous sight in this remote, jungle-clad area of Kathu. From the spacious hall you enter a cave-like tunnel lined with pictures of prehistoric creatures until you come face-to-face with a humanoid – well, an ape-like, wild-eyed mannequin with matted black hair, crouched in a cave, stone-age tools in hand. Further along there's a more modern caveman clad in a rather fashionablelooking leopard-skin loincloth, holding a spear, looking none too pleased to see you. The next hall featuring the museum's best installation, an elaborate miniature diorama of an open-pit tin mine operation in action. Hundreds of tiny workers are seen working busily on the site, illustrated in great detail and whimsy. While this and other, larger scenes depict some hard-working souls toiling in the mines – others show those who obviously didn't pull their weight in Phuket's drive to tin-toned glory. In one hall highlighting the arrival of the Chinese by sea, you walk a plank between two large wooden ship models. Peek inside one of the boats, and you'll spot a layabout, having a snooze on the deck. Further along in the Chinese culture hall there's a man lazing on a platform bed, sucking on an opium pipe. The Museum is on KathuNa Koh Road about 3.5km west of British International School on the way to Loch Palm Golf Club. Open Monday-Saturday 9am-4pm. Admission: 100 baht adults, 50 baht kids.

Koh Siray Temple Siray attraction is Wat Koh Siray, a hilltop temple with a golden reclining Buddha, from which there are spectacular views of Rassda Harbour and adjacent islands on the one side and views of rubber plantations on the other. It also overlooks the picturesque Sea Gypsy village called Laem Tuk-Kae. From the road you climb up a staircase flanked by huge dragons. The outside temple hall is surrounded by other Buddha images that you can walk around. To do: When you visit a temple remember to remove your shoes, hat and sunglasses before entering the temple building and to dress modestly. If you sit in front of any religious artifacts such as a Buddha image, you should not point your feet towards the object. Importantly, women should not attempt to touch a monk. Dress appropriately.
