Phuket‘s Most Exciting & Stylish Contemporary Luxury Yachts Explore the Andaman Sea, one of the most beautiful yachting grounds in the world Andaman Cruises is a synonym for "Phuket‘s Most Exciting & Stylish Contemporary Luxury Yachts" and the leading luxury yacht charter company on the island. The fleet includes seven vessels in total: the flagship MY Olympia 76, a 23-metre fly-bridge motor yacht for up to 20 guests, or the MY Mayavee 60, a 19-metre motor yacht of the renowned English family of Princess, for example. Due to the top standard of the yachts as well as the outstanding service onboard, Andaman Cruises is highly appreciated by international stars such as football player Cristiano Ronaldo, UEFA President Michel Platini, the German top model Heidi Klum and Hollywood actor Dolph Lundgren. In addition to the private luxury charters the company is also focused on yacht incentives. Among the corporate clients are BMW and Panasonic for instance. Andaman Cruises hosted their management incentives onboard the yachts. “Our company stands for luxury

experiences, lifestyle and premium hospitality. Today, people of all nationalities come from all over the world to enjoy the peaceful and pristine waters of Phuket and the Andaman Sea,” says General Manager Christian Schwind. The archipelagos of the Andaman Sea and its maritime national parks are renowned as some of the most beautiful yachting grounds in the world. Many people say that there is no better experience than to go onboard a yacht and see the breathtaking scenery of limestone rocks, white sand beaches and crystal clear waters around Phuket and the South of Thailand, including Phang Nga Bay and the coastline of Krabi. Guests are able to discover unique destinations and unspoiled spots. And a luxury charter with Andaman Cruises is the most exclusive and most personalised way to do that. These yachts offer all the benefits and facilities of a floating villa – luxury, comfort and privacy.

RICHARD POPE

Richard Pope Developer of the newly-opened Kata Rocks, Richard describes the joys and challenges of leading a project to completion, and how settling in to island life has coaxed him away from his London home. Tell us how you found your way to Phuket. I came at the end of 2006 for the King’s Cup Regatta and ended up looking at property. I found this site in the middle of 2007. We bought it, completed the deal in December 2007 and launched Kata Rocks in February 2008. For at least two years, I spent three weeks here, then three weeks in the UK. Now I’m here about 85 or 90 per cent of the time. Kata Rocks recently opened. How has that been going so far? We’ve taken some early bookings at quite a big discount for our soft opening phase. But we’re not trying to get too many bookings until we’ve built up the team for the grand opening, later this year. It’s good for the staff and their training. We don’t want them overwhelmed, and it’s more important to get the correct procedures in place first so our guests will enjoy a six-star experience. How are people finding out about Kata Rocks? Mostly word of mouth so far. We’ve got a database of about 12,000 that’s organically built up of people who have inquired about Kata Rocks over the last few years. Plus we’ve got about 36,000 on Facebook following us. It just spreads from there. A lot of people have come to do photo shoots for magazines because it’s so photogenic. And we do a mailing every now and then. We did one the other day with nine photos, including a really good one with a “wow” view of the island and the pool. It got a massive response. Do you have any other projects in the works, in Phuket or elsewhere? I’ve got a business in London, which is now mainly rental properties in Notting Hill. In Monaco I’m a partner in Hemisphere Solutions, a recruitment business for superyachts. We provide the captains, crew and many other solutions for the superyacht industry in that region. London, Monaco and Phuket are not bad places to do business. Quite nice actually! I’m looking for the next property to develop. I’d like to do another one in Phuket because I’ve got a great team here, but finding a prime site like this is hard. It needs to be a six-star experience so it needs a sixstar location. Design and build quality, staff and service are important, but if the location is second-rate you can never achieve any of that. What have you learned developing your project on Phuket? How does it compare to your experience in the UK? Many people think it’s very different from Europe but it’s not really. Business anywhere is fairly similar. You’re always just dealing with people, and people the world over are generally quite similar. You get frustrations in London and you get slightly different frustrations in Thailand. In London, regulations are very strict to a point of over-regulation; in Thailand, things are a bit more flexible but there is the big issue of language and communication, which make the job harder. Have you had any difficulties working in a different culture? You’ve got to appreciate the Thai way. If you’re someone who loses his cool with people that’s not going to help you in Thailand. They don’t respect that. I’m not really like that anyway, but some people try to shout and scream and wonder why they just get a smiling face back and nothing happens. I’m still useless at speaking Thai, but I’ve got some very good people who do that I can really trust, and that’s important. I think probably one of my biggest achievements in doing this project is that the first six people who came to work with me all are still here, apart from one who left to live in America. You can create an enduring business with that. They trust me to sort things out and they sort my problems out with language.

22

You live in one of the penthouse villas here. What’s that like? You wake up, push the button on the iPad and the curtains open and you see that view. The other great thing about being in Kata Rocks is to have all these services just on tap. To be able to have full room service whenever you like, or to walk down to the gym. I’ve got no excuse now not to go to the gym, and the spa as well. It’s all on the doorstep. What do you do with your free time, if you have any? There hasn’t been a lot lately. Before Kata Rocks I got my life to quite a nice stage. I had developments in London, but I had a good team, so I got to a stage where I was working three or four days a week, with a nice house down in the country, an Aston Martin, a couple of boats … I had a nice life. Then I came out here to do this project and basically swapped three days a week for seven days a week, and swapped the Aston Martin for a Fortuner. My aim going forward is to get more of a life balance back again. What do you tell clients with concerns about Thailand’s political troubles? They haven’t even asked! I think it’s well known that Thailand has seen numerous political issues over the years, most of which have minimal impact on wider society. It doesn’t even come up in conversation. We’re dealing with clients who would typically be worth at least 10 million dollars, and they’re not going to be frightened by a bit of protesting in Bangkok. They probably already love Thailand and understand that this sort of thing goes on. What do you think are the greatest challenges facing Phuket in attracting high quality visitors and investors? They’ve got to sort the traffic out. You don’t come to a holiday island to sit stationary in a traffic jam. They need to encourage clientele at a higher level, and such clientele will be put off if there are a whole load of cheap package tours here. What, in your opinion, are Phuket’s greatest strengths as a luxury destination? I’ve always thought of Phuket as one of the main holiday islands for Asia. When you look at the Mediterranean you’ve got Minorca, Ibiza, places like that where Europeans go for their island holidays. For America it’s the Caribbean. For Asia, Phuket and Bali are the two main islands. Half of the world’s population is within a five-hour flight, which is quite extraordinary when you think about it. And many would generally agree that most of the world’s growth will come from Asia in the next 20 years. Phuket has obviously changed a lot from its backpacker days. Some people don’t like that progress, but 25 years ago you couldn’t go to great restaurants like you’d find in the South of France, with great wines and that level of service. And what’s really good about Phuket is you can come in and have a six-star holiday, but you can also nip over to somewhere like Ko Yao Noi and have the old Thailand as well. When you look at it overall, where else do you get 28-30 degrees all year round, lovely beaches, sea the temperature of bath water, great food, perfect massages and spas, and a very friendly, peaceful environment? All of these things add up to a great place.

High Heels on board Superyacht BIG FISH

When you step on board a luxury yacht, etiquette dictates the removal of your shoes to ensure the exquisite decks remain in perfect condition. However, for this Helicam photo shoot, Captain Winston of motor yacht Big Fish actually requested the wearing of stiletto heels. The Helicam team were brought in to capture a set of images demonstrating the benefits of granite decks. Flash speed lighting and umbrellas were set up for the Helicam photoshoot. Posing on the granite decks, the stunning Yulia modelled a selection of high heels. Additional aerial imagery was shot using the new 6-rotor drone hexocopter fitted with a gimbled steady-cam to ensure the shoot was perfect.

BRASSERIE PHUKET OYSTER-WINE-BEER BAR

Alain Tabruyn Owner of Brasserie Phuket Oyster-Wine-Beer Bar When did you set up the Brasserie? What was behind your decision to set up this business in Phuket? I founded the Brasserie more than three years ago. The main attraction was to open a venue in phuket town that would become a benchmark in Phuket – “incontournable” in French. The decision to set up a business in Phuket came because I was missing something that I loved in Europe: a classical, informal yet chique brasserie like you can find in Paris or Brussels. It didn't exist in Phuket What were you doing before? I was living and running my company in Hong Kong and China (which I still do). Where are you from? I come from a country where we like to live the 'Burgundy style': Belgium. My hometown is Sint Truiden: the center for apple, pears, strawberries and much more. Go and visit! It's small but you'll be surprised. You should go in April/May, when all the cherry trees show their magnificent snow-white flowers... What’s different about Brasserie Phuket? What are its unique points? When you enter the Brasserie, you feel something different. It hits you: am I in Paris, Brussels? The unique thing about the Brasserie is that we serve only the best and freshest ingredients. And where can you find fresh inmported game meat or live crayfish from France? Also unique is that everything is home-made, from the bread to every dessert. But the Brasserie is not only about eating – it's about atmosphere and drinking at our famous bar. And there again, we're unique. It's not just drinking, but savour one of our 50 Belgian beers. Why would someone choose the Brasserie compared to your closest competition? To be honest I don't think the Brasserie has any competition yet. It's unique in its concept. One thing that makes us different is the consistancy of the dishes. Tell us something about your role in the business? My role is to be there every day and to make sure that everything goes smoothly. The kitchen, the restaurant, the athmosphere – and to chit-chat with my customers. What are the main challenges? To improve every day and never think that you're at the top because that's when you go down. …and what are the biggest difficulties? The biggest difficulties were adapting to work with local staff. We're so different. But then it's a challenge not to give up. When you see some of my staff today, they are top! That gives me a wonderful feeling.

What is your main target market? Our main target is expats who loves their food but also local Thais – who represent 50% of our customers! What is your approach to marketing Brasserie Phuket to your target? We do adverstise in a few magazines, but we really believe in word of mouth. Especially in such a small community. And it works! What do you like most about what you do now? What I like the most is seeing a customer going out with a smile and saying: "Thank you so much for the wonderful food and evening. And what do you like least…? Arrogant customers who don't have a clue what they're talking about! What do you expect to achieve within the next 3-5 years? The next two years we will concentrate on all the small details to make it even better. Then we'll open our new venue next door: 'High Definition' which will be my new challange, together with Dutch top chef Thomas Diepersloot and my daughter Babette. Again this will be unique in phuket. What do you see as your biggest successes to date? That I'm happy with what I'm doing. All the rest is not important. To what extent did the global financial mess affect your business? Difficult to say because Asia is doing well. I suppose we would have more customers from Europe, but I'm not complaining. We're doing very well Please give us an overview of your typical day ‘at work’. A typical day at work is to have a briefing with our chef and staff. Have a look at the kitchen. Then I check the computer for reservations. My lovely wife takes care of operations. How would you describe your leadership style? I'm hard but correct. Seventy percent of our staff left (except in the kitchen) after one or two days. The ones who are still here today are exactly the ones we want! What is your over-riding ambition at this stage in your life? Again, it's not really about me – it's the people close to me. Without my wife (Lin Kwanjai) the Brasserie would not be what it is today. If you aim too much for something, you won't get it. Concentrate on your work and love what you do – and people will come to you. Enthusiasm is contagious, you know... Hawaiian barramundi lean fillet wrapped in paper-thin potatoes and baked. Served with stewed Italian Lentils. Ingredients (serves 4)

The barramundi fillet

1kg Barramundi fillet 300gm fresh potatoes Salt to taste Pepper to taste 40ml extra virgin olive oil 40gm onion 40gm celery 40gm carrot 40gm Italian lentils (Lenticchie di Castelluccio di Norcia) 2 litres vegetable stock

Clean the fillet and divide it in four portions. Pat dry the fillet with a clean, odorless kitchen cloth. Peel the potatoes and slice them very thin with a slicer machine, wash the slices very well and pat them dry – also with a clean, odorless kitchen cloth.

Method The lentil stew

Presentation

Chop the onion, carrot and celery with the food processor and strain them well. In a large skillet, pour extra virgin olive oil and when hot, add the chopped vegetables. Fry until there is no longer water. Add the dried lentils and double the volume with vegetable stock, which it has to be at room temperature. Bring to boil and simmer until the lentils are soft.

Season the fillets with salt and pepper, wrap them one by one with the potato slices. In a non-stick pan, sear the fillet with extra virgin olive oil, until the potato is golden, then move the fillet into an oiled baking tray and bake at 180° C (356° F) until well done.

Place the fillet on a large plate and, on a side, make a “turret” of lentils, with the help of a cup. Sprinkle the fish with extra virgin olive oil and serve hot.

Gullible’s Travails

A roadside wine tasting?

Herbal sauna... and enema Deciding to try a herbal sauna, you arrive at the ramshackle establishment feeling rather vulnerable as you change into a flimsy cotton wrap and plunge into the steaming jaws of the sauna shed. It’s extremely hot and it takes a while for your vision to adapt, so that only gradually do you realise that you’re sharing the sauna with six large Thai ladies sitting around enjoying a huge joke at your expense. About the same time, you notice a blast of furnace-like steam attacking your sensitive parts. You dash from the sauna and pour lashings of icy water over your toasted backside.

Roadside wine tastings They appear at dusk, invitingly illuminated along dusty roads, inches from marauding pick-ups. Gleaming bottles of ruby and amber on little wooden tables... neatly displayed wines you might think, so busy husbands can grab a bottle on their way home.

Oops... you’ve learned the hard way never to take the vacant seat in a packed Phuket sauna... that’s the one directly over the steam vent! Sauna you than me!

Then you notice the parked motorcyclist enthusiastically emptying a bottle into his gas tank and you begin to wonder. When you inspect the bottles closely, you’ll find that the bouquet has less of a hint of ripe plums about it than a blast of Saudi crude. The amber 'vino' is 91 octane and the ruby is 95 – just the thing to make that dinner party go with a bang.

Farang phet

Gender offender You’re in a bar on Patong's infamous Soi Bangla, enjoying a few beers, and then comes the time when you need to return some of your purchases. So you stagger off in search of the bathrooms, finding them in a pair, one male and one female, as is so often the case.

Saunas are not the only hot things to avoid as the local cuisine, while delicious, can be positively volcanic. The handy phrase “farang phet” is worth remembering. Say it when ordering food and the accommodating locals will spice up your dishes only to a level acceptable to foreigners rather than to their own terrifying standards. Just say "farang phet" for a perfect

meal

Back home, bathroom doors boast clear signs alerting you to which entrance is the right one for your gender, but like so much in Phuket this straightforward way of doing things would be just a bit too easy. You find yourself confronted by two almost identical pony-tailed and pantaloon-wearing symbols on the doors, so you’ve no idea which is yours. Then a mini-skirted creature breezes through one of the doors. Clearly your gender belongs through the other and so in you plunge... to be confronted by the screams of startled females. In your haste you forgot that Phuket’s most beautiful 'girls' are often expert gender benders. Quickly saying “goodbye” to your new friends in the girl’s bathroom, you pop next door where you belong with Miss Mini-Skirt.

While Phuket undoubtedly harbours pitfalls that you need to be wary of, with a good sense of humour and a ready smile just like the locals, you’ll have a great time negotiating the island’s 'travails'.

33

Gullible’s Travails

Many hapless visitors discover the hard way that there’s often more to Phuket than meets the eye.

Touch down! Stumbling jet-lagged into the startling tropical sunlight, Phuket greets you like a slap in the face. The blinding sun has you squinting like a near-blind old lady as you stagger from the airport to be surrounded by an army of touts offering a delightful assortment of the sins for which the Orient is infamous. “Is there a bus to Patong Beach?” you shout into the cloud of cigarette smoke hovering above the greedy grins of the touts.

The unseen world Once settled into your hotel, you may be woken early next morning by a huge series of explosions. Investigation will tell you that firecrackers, hung from the prow of a long-tail boat, are being let off to disperse evil spirits before the captain and crew set off on their seaward journey.

Indeed there is, and before you can say, “How much?” you’ll be jammed into a crowded mini bus with an collection of other novices and their mountains of baggage.

In Phuket the supernatural is everywhere and influences everything – so must be placated and venerated at all times.

This is mistake number one and should be avoided.

Zen and the art of road madness

This cramped mini bus will eventually get you to Patong, but only after endless detours and unscheduled stops. Far better is to look for signs for the airport bus to Phuket Town, or catch a metred taxi by turning right as you leave the concourse.

To understand the mania that passes for driving in Phuket, it helps to grasp that Buddhism recognises the inherent one-ness of all things and sees supposed opposites for what they truly are: facets of the unity of existence. Road madness

"Look Mom, no hands!" During your white knuckle taxi ride to your hotel you may be shocked when your driver takes his hands off the wheel and offers a ‘wai’ with palms pressed together, to the statue of two strangely-clad ladies at the Heroine’s Monument. These revered figures are the sisters Thao Thep Kasattri and Thao Sri Soontorn who, according to legend, saved the island by crossdressing, thereby fooling the gullible Burmese invaders after the fall of Ayutthaya in 1767. The Heroine's Monument is highly And, while in no way connected with revered by all Phuketians the revered ladies, the biggest billboard you’ll see driving from the airport advertises Simon Cabaret, Thailand's famous transvestite show.

Both these celebrations of gender-based deceptions serve notice that Phuket can be a realm of trickery, where duplicity is not only practiced, but actively celebrated. Gullible be warned!

32

To follow the way of the Thai driver, you too must cast off illusions of duality, such as the duality of two traffic lanes moving in opposite directions. Are both lanes not part of one road? Are both directions not still expressions of the eternal flow of all things? When you've grasped this obviously simple concept, you’ll understand why Thais naturally swerve into oncoming traffic to overtake and why they are completely serene as they travel along a road the wrong way!

Lemongrass House

Lemongrass founder, Bobby Duchowny, studied aromatherapy – a healing art that promotes massage, when combined with specific herb and spice oils, as a method to reduce stress, boost energy and heal certain physical ailments – at the American Aromatherapy Association. Some years ago while on holiday in Thailand, he visited an organic farm in Petchaboon province and became interested in the natural healing properties of Thai herbs and spices. “I was particularly attracted to lemon grass as it was used in many popular Thai foods, as a medicine for stomach disorders and even as a repellent for mosquitoes,” he recalls. Bobby used lemon grass as his signature herb to create a line of essential oils, face and body creams, shower gels and bath crystals, which he and his wife Palita sold at Bangkok’s world-famous Weekend Market. What started, several years ago, as a modest enterprise has blossomed into a successful operation offering over 90 oils and a wide range of body care products through many outlets, as well as supplying many of Thailand’s top resorts and spas with aromatherapy oils.

Sukko Cultural Spa

“The Best Spa In Southeast Asia”

SPA & BEAUTY

Sukko means "Beyond Happiness". My first feeling when I stepped through the impressive gates of Sukko Spa was, "I’m in paradise". The Sukko staff are dressed beautifully in traditional Thai style and the spa design, influenced by the ancient Siamese capital, creates a haven of calm yet regal serenity. I felt I had left all my troubles behind.

Chilled out by the soothing background music, I was filled with a peaceful wellbeing as I enjoyed the warm traditional Sukko welcome of the ‘Flower Floating Ritual’ – like ‘Loy Kratong’, where the idea is to float away past stresses and wish for luck and joy from that moment on A variety of 40 spa treatments – prepared by Sukko's certified Thai Herbalist and based on ancient Thai medical theory – is offered at Sukko, in packages lasting from 2 to 4 hours. Each package has a specific purpose and can be selected to suit your lifestyle or the way you feel on the day. These herbal recipes and procedures have been handed down through generations and are totally free of petrochemicals, synthetic perfumes or colouring. Some of the herbs and spices are grown in Sukko’s own herb garden and picked just for your treatment, ensuring they are as fresh as can be. I was pampered with the “Be Balanced” package; a 3-hour experience that left me feeling relaxed and refreshed. This 3-treatment combination began with 30 minutes in the steam room and the Jacuzzi, followed by a Thai Turmeric Body Scrub designed to soften your skin and awaken your senses. The scrub was followed by Sukko Synergy Body Massage (see description opposite). “Is this pressure okay? Too strong? How are you feeling?” my therapist asked me from time to time. “Mmm…perfect…” were the only responses that seemed to suit how I felt. Sukko Spa’s restaurant, Suk Savoey Spa Cuisine, presents a unique concept: "Menu by Blood Types" and "Menu by Elements". For those who want to exercise, the Suk Sanan Club provides a myriad of fitness opportunities, including ‘Rue Sri Dat Ton’ (the hermit self stretching), a traditional Thai exercise or, for something more strenuous, try ‘Thai Martial Arts’, a traditional and effective art of self-defense.

The cleverly arranged tiers of units and blocks represent the graceful curve of a wave and its continual movement.

Architectural Style “Living with Vision The low-density, low-rise architectural style is a modern tropical contemporary design with strong and deliberate emphasis employed to maximise the view, whilst protecting personal privacy. Careful selection of appropriate materials helps to ensure the practicality and durability of the construction without compromising the aesthetic or function of the units. Each block is constructed in light bright white allowing excellent natural light, whilst the generous windows and full height doors allow optimum ventilation reducing reliance on air conditioning and maintaining our commitment to greener sustainable development. The Wellness Center with spa, fitness gym and sauna is part of the facilities, as well as the restaurant and two swimming pools.

Right from the arch at the entrance of the estate, we use large trees for the main structure so that true relaxation begins there. We go the extra mile to keep the plants and natural habitat in its original state when working on landscaping around the estate.

Specification: This project occupies a large area and there are three modern tropical house designs to suit. Topaz has 3 bedrooms 3 bathrooms in 170 sqm, Sapphire has 3 bedrooms 3 bathrooms in 201 sq.m., and Jasper has 4 bedrooms, 3 bathrooms in 272 sqm where the 4th bedroom is on the ground floor (which can be adapted for use as a small office). They are all designed especially for the slope of the hillside, categorised into ‘Up’ and ‘Down’ style. Every house is constructed under the theme of ‘Baan Sabai’ (comfy house) using Q-con lightweight concrete panels and solar reflective tinted glass windows to lower temperature in the house. Bathrooms are clearly separated dry and wet areas, while the cold pantry is separated the hot pantry. There is air-conditioning in every bedroom, a water retreat, water pump and water tank underground and a finished garden.

About the Developer: Land and Houses is a real estate company of choice for over 30 years with an enviable reputation for providing high quality homes in beautifully maintained surroundings which are ideal for families and couples.

matters HUGHESKRUPICA CONSULTING

Injunctions and their practical limitations The scenario is all too familiar – a disgruntled party goes to a lawyer’s office with an urgent request for legal assistance to stop another party’s wrongdoings. The disgruntled party then asks the lawyers if they can file for an immediate order from a court ordering the other party causing harm to ‘stop’ their actions. Such orders in ‘common law’ jurisdictions are known as ‘injunctions,’ and come in different ‘legal forms’ : preliminary (meaning before judgment); permanent (at the time of judgment); mandatory or preventative; and restraining orders. For those not so keen on legalese, an injunction generally refers to an order of a court of law preventing a person/company from continuing an action, or compelling them to act in a certain way. Recently, Samsung and Apple made global headlines in their intellectual property litigation, with such cases highlighting the role of injunctions in litigation. However, injunctions are not limited to major court battles and are often sought in much smaller disputes, including breach of contract, damage to property, and small company shareholder litigation. In Thailand, ‘injunctions’ are known as ‘provisional measures before judgment’ (i.e. preliminary injunctions), or for the permanent types, final judgment orders. They are commonly alleged in complaints, but are they commonly granted as a remedy in a dispute? Generally, the answer lies in the type of ‘provisional measure,’ ‘order,’ or ‘injunction’ a party is seeking to obtain from a Court. Provisional measures before judgment Section 254 of the Civil Procedure Code of Thailand sets out the basic rules for ‘provisional measures before judgment,’ and expressly excludes so-called ‘petty cases’ – which is defined to be a small value case under Section 189 as less than 40,000 THB, but can be in practice discretionary and taken on a case-by-case basis. Thus, for the disgruntled party seeking such court sanctioned relief, the case generally needs to be of fairly significant value, or there needs

(Advertorial) to be a serious issue at stake in which imminent harm is likely to be inflicted on the party seeking the relief if the ‘provisional measure’ is not granted. In fact, the request for provisional relief must generally be related to – (1) seizure of property in dispute; (2) a request to restrain another person from continued wrongful acts, or to restrain the transfer or disposal of property in dispute; (3) to request the extinguishment of an act to register rights against the property in dispute; or (4) to request a warrant to detain a defendant. Additionally, any application for a ‘provisional measure before judgment,’ must be submitted with an actual complaint (i.e. lawsuit). Accordingly, a plaintiff cannot just merely request a court to issue pre-judgment remedial measure. The plaintiff must ultimately prove that they have been harmed at trial on the merits. Clearly, the statutory requirements for ‘provisional measures before judgment’ are intended to streamline the number of requests to the court for ‘provisional measures before judgment.’ The courts do not wish to see on overabundance of such requests filed for each and every small dispute. However, in practice, the courts are often reluctant to grant such measures even in large cases. The reason is that under the Section 254, ultimately the courts have the power to grant or dismiss these requests, and therefore have broad statutory discretion. Furthermore, in our firm’s experience, there is often a sense that the case needs to be proven first, prior to action being taken by a court ordering parties to act in a certain way. This isn’t to say that courts never grant provisional measures. They are just rarely granted, and only in cases where clear evidence is shown by the party seeking the ‘provisional measure before judgment’ is necessary to protect clear interests, and where ultimately court ordered compensation on the case may not be sufficient. Final judgment orders On the other hand, judgment orders (which are essentially ‘permanent injunctions’) are of a different nature and status than ‘provisional measures before judgment,’ and are frequently granted as part of a judgment in a case. Parties filing court cases in Thailand can allege both damages (i.e. compensation) and request a court to issue a final order compelling a party to act in a certain way (i.e. to remove a building encroaching on another person’s property). One apparent reason for courts being more willing to grant final orders preventing or requiring other parties to act in a certain way, is because the case has already been tried on the merits, and evidence presented and questioned by the litigants and the judge. Furthermore, to obtain such orders, the plaintiff actually has to request in the complaint the specific order of relief, and it is therefore thought that the request is made clear for the defendant to counter in trial. To not request an order, can ultimately preclude the order from being granted. Conclusion ‘Injunctions’ are available as a remedy in cases filed in Thailand. However, the likelihood of obtaining an injunction depends on the case and the type of injunction sought. Generally, ‘provisional measures before judgment’ are difficult to obtain as courts are reluctant to grant them. On the other hand, judgments frequently order litigants to take actions in a certain manner or way as a result of the trial of the case on the merits. Any parties considering seeking to stop another party from taking certain wrongful actions, should seek legal advice to determine if an injunction is a viable remedy to seek in a court case.

The need for integration. The key systems of security are intrusion detection, access control, and video surveillance. If each of these systems is installed separately, administration and training can burden a company or property owner. Intrusion alarms occur on one system, access badges are administered in a stand-alone database, and intelligent digital video technology runs on dedicated computer equipment. PAUL ROPP : WHAT’S IN A NAME – BY SALVADOR BALI

PAUL ROPP what's in a name I met Paul Ropp during the '60s in New York City, the time Positively 4th Street and Like a Rolling Stone, and for sure the times, were a changing; attitudes, revolutionary thoughts and spirituality and creativity abounded – uptown, down town, across town and, not unlike myself, here there and everywhere. Greenwich Village scene, the music scene, theatre district, the night club scene, Woodstock, or just

carousing the streets of New York, all of a sudden there was Paul Ropp, always Paul Ropp, making a showing without anybody knowing, and always with a positive humble sponge giant ego, a man who lived way beyond his means, but somehow always made it work, again which always led to the legend, the mystic... who the hell is this guy? One day he’s the road manager for the Paul Butterfield Blues band and running all around Woodstock, then another day friends of mine were smoking marijuana cigarettes with rolled cigarette papers bearing the American Flag or US dollar bills, passing the joint. Hey, who came up with this crazy idea, Paul Ropp, ha, seriously... so on and so forth as the legend persists. Off to India Paul goes, presumably to find Baba Awesome and to become a groovy guru, but not this time, Paul is right on target with the fashion trend with the Chinese Tibetan T-Shirt company, amazing variations of colors, creativity and style, pictures of the Hindu Elephant Gajha, Buddhas and the like; wish I had a few of those today. Then comes another legend in his own right, John De Coney who invented the word 'Volumetric' for the hair industry, the cutting sculpture of men’s long hair, and there was Paul working with Paul Mitchell, the icon of hair. John as well took off to Goa, India, then to Bali, follow-up in Paul’s own words. A couple I'd introduced in Brazil, and then married in Central Park, New York, helped deliver their baby in Goa, India in 1976, and having their second child in Bali asked me if I could help deliver that one. Not having enormous amounts of money, I decided to put it together with a business trip. Bali offered me the opportunity because there were so many creative people here that I used my creative nature and my abilities to bring hand-made fabric from India and started to develop a handloom industry. OK, a decade has passed and I'd encountered Paul on occasion in New York, always with some new handy craft or at the fashion trade shows, but never really

PAUL ROPP : WHAT’S IN A NAME

"I watched Paul Ropp grow and grow into a fashion icon constantly coming up with designs and products ranging from handicrafts, jewelry and all kinds of accessories – and all set in Paul Ropp fashion style"

knowing what he was about in Asia, especially Bali, which he always taunted me with to come, and get a look at something other than the rat race of New York. The time had come and I found myself in Bali in 1987 at Made’s Warung, sitting there Paul with John de Coney, well, well look who’s here. I was immediately taken under their wings and never looked back; look what turned out from a two week vacation. Over this time I watched Paul Ropp grow and grow into a fashion icon, constantly coming up with designs and products ranging from handicrafts, jewelry and all kinds of accessories – all set in Paul Ropp fashion style. Then events, runway shows never seen in Bali before and the beat goes on to stores in Thailand extending internationally. Hard to imagine Bali these days without Paul Ropp fashion. Since my arrival in Bali, I've established myself as something of a journalist under the pen name Salvador Bali, and I've interviewed the rich and the famous and the sick and the shameless, but there's only one Paul Ropp, honest, integrity, man of his word, always there to extend a helping hand, all behind this exterior of having to be strong willed in the crazy world of production and fashion. But dig a bit and you'll find a heart of gold. I'd like to visit Paul in his dreams; for sure it would be one hell of a whacky universal theme park with a never ending circus

mind. I once asked Paul, when is enough, enough? Never was the answer, its fusion, one thing leads to another, I stop, I die. It’s all about creativity, that’s what keeps you young and enthusiastic. I would say Paul went the mountain and met them all. What did they all have in common? The view, in short, that art is life. Full thrust and on with every endeavor of production, detail, and that my friends is called passion. So what’s in a name? Do you think it just happens like some magical gift looking towards the universe in a colourful way, one, two, three and Shazaam? No way honey! Find and bring the fabric from around the world, design, produce, detail, overseeing, manufacturing, production, on and on in third world countries requiring patience, then sales, shops, marketing, staff, ups and downs, frustration , deadlines, ah, I could go on and on; we're talking major pressure here. Whatever people may say, and they always do, here’s Paul Ropp, and smiling.

Rent

Holiday Villa Rentals Holiday villas have become a very popular alternative to hotel rooms in recent years, hence the increasing demand and supply of holiday rental properties. This is especially so if the party is a group of more than two adults and a couple of kids. Just the thought of squeezing everyone into standard size hotel rooms is not a good start to a great holiday. Therefore the option of renting a villa has become very appealing in recent times. Firstly, a holiday villa is very much like a home-away-from-home. It has virtually everything your home has – or more. Holiday villas can range from 2-7 bedroom villas and can cater from two up to at least 15 in-house guests at any one time. Therefore if it’s an extended family affair, 2-3 families or a group of friends holidaying together then a holiday villa is the perfect solution. High end holiday villas can be from USD 3,000 to USD 5,000 per night over the high season. This would include a full service personalised staff that will look after your every whim and fancy – including a villa manager, maids, chef and even a driver or nanny on request. To command such a price, these high-end villas are usually in the best locations around the island boasting spectacular sea views. A swimming pool in such villas is a standard facility, but most of the views from these pools are quite breathtaking and worth more than an Instagram photo. Swimming in an infinity edge pool dramatically overlooking a cliff to the Andaman sea is quite an

experience. Some villas even come complete with a fully equipped gym, massage and sauna room, entertainment room with pool table or even a soundproof cinema room for 15 pax with its own pop corn machine. The other popular holiday rentals are longer term, between 1-3 months, and are now increasingly favoured among holiday makers escaping from frigid temperatures back home who would like to stay in an all-year 'hot and sunny' location like Phuket. Depending on location, bedrooms required and also the rental period, monthly rentals could start as low as THB 45,000 to THB 350,000 per month, excluding utilities like water and electricity. However the monthly rental price would normally include wifi and pool, garden and maid services. Due to the popularity and demand for villa holiday rentals, it is advisable to secure a booking as early as possible. This will afford you with more choices as well as flexibility when choosing the appropriate property early. We are starting to get enquires for short term villa rentals for the year end 2014 and as early as for 2015. So if you are thinking of being in Phuket for your next holiday and would like to rent a villa instead of a hotel room, drop us an email Phuket@engelvoelkers.com and we will assist you in renting that holiday villa.

Safer Phuket hotel partners spearhead drive to world class beaches

Phuket’s beautiful beaches are an essential asset for the island's long term prosperity – they attract millions of visitors annually. However competition for these tourists is increasing and so Phuket’s tourist industry recognises the need to adapt and respond to the growing consumer demands in this area, which is why Safer Phuket is working with its partner hotels to bring the new ISO 13009 Beach Management standard to Phuket’s beaches. It may come as a surprise to many but there has been no international standard for beach safety and management. In Europe there has been the Blue Flag scheme, which has achieved success, but the absence of a single worldwide standard has made comparisons difficult. Now, the ISO 13009 standard establishes the general requirements for beach operators. It provides advisory guidance regarding the delivery of sustainable management and planning, beach ownership and legislative responsibilities, sustainable infrastructure and service provision needs (beach safety, information and communication, cleaning and waste removal). The overarching aim is to provide beach operators with recommended advice towards delivering a quality service and experience for all. Martin Carpenter, one of Safer Phuket's founders, states, "There is increasing pressure from tour companies, embassies and other stakeholders to reinforce guest safety in Phuket. Safer Phuket is spearheading the drive to deliver international safety standards which is why we are working with hotels in this transition to ISO 13009 status." It is of utmost importance that our beaches and coastal waters are well managed and maintained and hotels play a key role in this. Safer Phuket Hotel Partner Programme gives them a voice and influence. Co-founder, Duncan Stewart, adds, "Hotels that join our Hotel Partner Programme can focus on guest care and engagement, while Safer Phuket facilitates a safer coastal water environment, from beach management with professional lifeguards to tour boat skipper training and accreditation. Many hotels consider that control and administration of beaches is outside of their influence. But as a Safer Phuket partner collaborating with other

safety conscious hotels, we can establish safety and standards that guests need and will increasingly demand." Safer Phuket is an internationally recognised not-for-profit social enterprise that is privately funded, therefore independent. It has been recognised and supported by the Thai Interior Department, Phuket Governor Maitri and the British Embassy, Bangkok, as well overseas expert organisations such as RYA (Royal Yachting Association), RNLI (Royal National Lifeboat Institute) and SLSA (Surf Lifesaving Australia). They are attracting an increasing number of commercial sponsors as a part of a collaborative effort. Phuket Lifeguard Club recently received an AED (Automatic External Defibfrillator) from USA company, Zoll, one of the world’s leading defibrillator manufacturers. This will be based at the Nai Harn beach project and, with its installation, there will be Advanced Life Support training given by Bangkok Hospital experts for to all lifeguards so that they can operate the full ‘chain of survival’. Phuket can be the first island in the world to have all its beaches ISO certified and after a bleak period of bad news and visitor reductions, this has to be a move to demonstrate a commitment to a brighter future. Phuket can set world benchmarks by being the first to gain this beach management and safety standard. www.saferphuket.org www.facebook.com/saferphuket IMAGE asia welcomes the opportunity to partner with Safer Phuket to help bring about improved safety on Phuket's beaches and the surrounding waters.

THINGS TO DO

Phromthep Cape Viewpoin

Things to do in Phuket If you would believe the brochures, Phuket is about beach, beach and more beach, with a leavening of late-night parties. However, this island of ours has lots of other activities. Here’s a selection of these which we hope will enrich your holiday experience, and they won’t break the bank.

Phromthep Cape Viewpoint

125 C2

This is the most popular and largest of all the view points. The area has been developed to offer extensive views over the sea and there are walking paths from the cliffs to the water's edge for the adventurous. But do take care close to the cliffs! This is nature. The sunsets are absolutely breathtaking and never the same two days running. If you're romantically inclined, this is the place to come in the evenings and hold hands as the setting sun paints the evening skies in towering kaleidoscopes of light and shade. How to get there: Phromthep Cape is a headland on the extreme southern end of Phuket about 19 km from Phuket City. You can drive there via Chalong Junction along Highway 4024 to Rawai Beach, and then follow the signs for 2 km.

Songkran in Phuket No visitor who has ever been here during the month of April can have avoided coming into contact with the enchanting, hilarious, and occasionally exasperating and downright dangerous watery explosion of public celebration which is Songkran. Songkran – the Thai new year – is Thailand's most celebrated festival is. It starts on April 13 and lasts for between three and 10 days, depending on where you’re resident. For most, it’s lots of fun and an excuse to cool off at what is usually the hottest time of the year. A mass water throwing in Phuket is generally confined to a single day (13 April), and to specific zones − in Phuket City at Saphan Hin and at Rawai Beach, Kata/Karon Beaches, Nai Yang Beach, Surin Beach and Patong Beach. Songkran in Patong usually begins the evening before – April 12, when normal activities in the bars cease, and the world's biggest water carnival begins. If you’re staying in one of the tourist centres like Patong, there really is no way of avoiding a soaking, unless you stay in your hotel. For more information: on Songkran festival contact: Tourism Authority of Thailand Phuket office, Tel: 0-7621-1036 or visit website: www.tat.or.th/phuket.
