Jacqui Slack is a four-time World Tour Champion, a British National Elite Triathlon Champion and has competed in five XTERRA World Championships. Ben Allen is a two-time XTERRA Asian Triple Crown World Tour Champion, a tentonne XTERRA World Tour Race Champion and a XTERRA Warrior Award Champion. Cultural Festival • 21 August 2013-27 September 2013 @ Phuket City Por Tor Festival 2013. The 'Hungry Ghosts' festival is an important merit-making event for ethnic Chinese. Special food, flowers and candles are offered to ancestors’ altars to 'feed the ghosts' that are said to have been released from hell for the month. Relatives pay their respects and appease them with gifts of food, with turtle cakes being the most popular offerings. The turtle symbolises longevity and by giving these cakes, the worshippers believe they will prolong their own lives. Family Festival • Till-31 August @ Laguna Phuket Summer Family Festival. During July and August, Latitude Marquee is transformed into a carnival playground with a range of free activities for youngsters and parents – including art classes with Artist-inResidence, Zumba, fitness sessions in Latitude Marquee, theme parties and more. Surf Camps • Till 31 August @ Skyla's Beach House, Kamala Kids Day Surf Camps 4. The kids can have three days of fun and learn surfing and ocean safety. POR TOR FESTIVAL

With its spirit-possessed mediums performing shocking acts of self-flagellation, the Phuket Vegetarian Festival is a colourful spectacle that’s become famous around the world. But a month before the Veg Fest is a more gentle, yet no less important, event for the island’s Hokkien Chinese community: the Por Tor Festival. The Por Tor Festival has a long, rich tradition in Phuket and similar festivals are held throughout Southeast Asia, China and Japan. Known also as the Hungry Ghost Festival, it starts on the first day of the waxing moon on the seventh lunar month of the Chinese calendar. This year it runs from August 21 till September 27, with ceremonial events taking place on the first 10 days. During this month it’s believed that the gates of hell are opened, allowing ghosts trapped inside to return to earth to enjoy feasts prepared by their living relatives. It’s also a time to help those

who may be wandering lost in a deathly realm: the forlorn spirits of those who died suddenly or died away from family, or otherwise missed the chance for a proper send-off. The festival’s first day is typically spent at the family home, where an elaborate feast is prepared. The table is set with all the dishes placed in the middle, plus a plate of rice for each of the departed relatives. Sticks of incense speared into each serving of rice are lit, then all the family members sit off to the side or go to another room. When the incense is burned through it indicates the ghosts have finished dining, allowing the living relatives to come to the table to start their meal.

POR TOR FESTIVAL

Feeding their forsaken dead relatives gives the living a chance to show respect to their ancestors. Preparing meals and making offerings at the Chinese temples are acts of loving kindness and mercy, giving shelter and sustenance for suffering, starving spirits. The name of the festival in Phuket originates from the Chinese god Por Tor, who is the king of hell. He’s the gatekeeper and judge to whom the recently departed must make their case in their quest to reach heaven. At the Por Tor Gong shrine near Saphan Hin in Phuket Town, temple walls are lined with murals depicting this entrance to hell, as well as gruesome scenes of the punishments Por Tor metes out to hell-bound spirits. Every Chinese shrine around Phuket stages ceremonial offering events, but the Por Tor shrine is the main one since it’s dedicated to the Por Tor god. Red turtle cakes, called ang ku in the Hokkien dialect, are the most vivid offerings prepared for the festival, and Phuket is the only known place where such turtles play a ceremonial role.

The turtles, which represent longevity, are made with glutinous rice flour and decorated with a fondant icing. The colour red is chosen for good luck, success and wealth, while some turtles are in white for purity and others are in yellow to represent high status and royalty. Phrases like ‘good luck’ or ‘good health’ are inscribed on the cake as well as name of the person, family or business making the offering. Several shops around Phuket Town specialise in making the turtles, and some order very large and elaborate turtles, costing 50,000 baht or more. Local historian Khun Chaya NaTakuathung, who offers culture tours with Phuket Heritage Trails, says some believe the inclusion of turtles in the festival originated from early Hokkien migrants to Phuket, who had a difficult passage by sea from the Fujian region of China. The journey reminded the migrants of a story in Buddhist legend about a Chinese Taoist monk who made a journey to India to learn more about the Buddhist teachings that were spreading across the region. While at sea a storm swept up. The monk began to pray and a huge turtle rose up out of the sea. Some believe the turtle led the ship to shore while another story tells about how the turtle lifted the ship on its back and carried it to safety. In addition to the turtle cakes, an abundance of food dishes are proffered for the famished lost souls. The temples are brimming with bags of rice, whole roasted ducks, pork and chicken, piles of fresh fruit and vegetables. Even whiskey and wine cooler bottles are on offer, keeping things festive. Despite the seemingly dark themes of death and hell, the Por Tor festival is a lively, family-oriented event. Not only is it a feast for the ghosts, but a fascinating feast for the senses that offers an inside peek into Phuket Hokkien culture, perhaps in more accessible and palatable ways than the better-known Vegetarian Festival.

BANYAN TREE PHUKET

California Maki Created in the 1960s by a Japanese chef in Los Angeles, California Maki has become a favourite of sushi lovers around the globe. Banyan Tree Phuket’s Japanese Master Chef Shiraishi revealed that the secret to his celebrated sushi rolls lies in the correct preparation of the sushi rice and the freshness of all ingredients. Ingredient For 8 California Maki pieces 1 Nori (dried seaweed) 2 slices of ripe avocado Thin cucumber slices 2 pieces of prawn 1 crab stick 60g cooked sushi rice 20g spicy mayonnaise 10g shrimp eggs 15ml soy sauce 10g wasabi Pickled ginger

For 1 cup Sushi rice 1 cup sushi rice 1 cup water 2 tablespoons rice wine vinegar 1 tablespoon sugar ½ teaspoon salt

Method: Sushi Rice Wash the sushi rice thoroughly five times before cooking. While the rice is cooking, blend the rice wine vinegar with sugar and salt and stir it until the sugar dissolves. Mix your cooked sushi rice with the freshly prepared vinegar blend and continue stirring until the rice has cooled down.

Method : California Maki California Maki gets rolled inside out, so you first have to cover your Sushi rolling mat with plastic wrap. Next, carefully break the Nori seaweed into half and place it towards the bottom of the Sushi mat. Spread a handful of cooked Sushi rice evenly onto the Nori, making sure all the edges are covered with a thin layer. Then flip the Nori over so that the rice is at the bottom facing down and the Nori is facing up. Next, lay out all the ingredients, including crab stick, prawn, avocado and cucumber strips along the bottom edge of the Nori, side by side and lengthwise. Top them with spicy mayonnaise. To form the California roll, use your bamboo mat and roll the bottom edge of the Nori over the filling in the center. Gently apply pressure and tuck the filling in firmly as you shape and seal the sushi roll. To finish, cover your sushi roll with orange shrimp roe and cut it into eight pieces. When serving, be sure to add a little spice to your California roll with wasabi, soy sauce and pickled ginger as garnish.

Sukko means "Beyond Happiness". My first feeling when I stepped through the impressive gates of Sukko Spa was, "I’m in paradise". The Sukko staff are dressed beautifully in traditional Thai style and the spa design, influenced by the ancient Siamese capital, creates a haven of calm yet regal serenity. I felt I had left all my troubles behind.

Chilled out by the soothing background music, my mind was filled with a peaceful wellbeing as I enjoyed the warm traditional welcome (again from Sukko culture) of the ‘Flower Floating Ritual’ – similar to ‘Loy Kratong’, where the idea is to float away past stresses and wish for luck and joy from that moment on. A variety of 40 spa treatments – prepared by Sukko's certified Thai Herbalist and based on ancient Thai medical theory – is offered at Sukko, in packages lasting from 2 to 4 hours. Each package has a specific purpose and can be selected to suit your lifestyle or the way you feel on the day. These herbal recipes and procedures have been handed down through generations and are totally free of petrochemicals, synthetic perfumes or colouring. I like being involved in developing strategies for everything from sales and marketing to human resources, as well as the challenge of being part of a team responsible for business growth. What do you and Twinpalms Phuket hope to achieve within the next 3-5 years? We plan to grow the brand aggressively over the next three years, increasing the number of Twinpalms hotels to two or three by 2016. We expect to be one of the most successful

and most talked-about small luxury hotel brands and anticipate being approached by resorts ripe for conversion into Twinpalms branded resorts. What are your biggest successes to date? Achieving a faster rate of growth and greater success than other similar businesses. To what extent does the current global financial mess affect your business? This has affected almost every business in the world and this time it's worse than before as the economic downturn is expected to last longer than previous recessions. For sure it has affected the tourism industry but that just means we have to adapt and look for new, less affected, markets. We cope with the situation by adopting a different strategy. Is Twinpalms Phuket involved in any CSR (Corporate Social Responsibility) programmes? If so, please outline briefly. We have a 'public cleaning' day every week, when our staff help to clean the public areas outside the hotel property, helping keep the beach and the park clean and tidy. We also join government-initiated festivals, such as Children's Day, participating and providing resources for activities. What is your over-riding ambition at this stage in your life? To run the business successfully by achieving the highest goals that we set and to make sure that it we not only maintain our market position, but see it continue to grow.

COLIN MACKAY

Colin Mackay Colin, author of A History of Phuket and the Surrounding Region, describes how a globetrotting life took him to Phuket with a view to write, where for the past five years he’s worked to uncover more about the remarkable past of his adopted island home. Where are you from? I’m Scottish, but I was born in Kenya and grew up in Dar es Salaam in Tanzania. What did you do before you came to Phuket? I studied history at the University of Edinburgh, then when I finished university I went to Hong Kong and was a journalist. I was adventurous, going to Cambodia to cover the war, among other things, but I soon realised that as a journalist you’re basically a prostitute. You don’t have the freedom to write what you want because you have to write what the market needs. You’ve got to have money to do that. I saw that lawyers and stock brokers had all the beautiful girls and the nice houses. So that’s when I slipped into the financial markets. My main dream was to salvage shipwrecks, so when I made my first million at the age of 28, I went off for five years salvaging shipwrecks until all the money was gone. I worked mainly in the Domincan Republic and salvaged 32 ships, we found bronze cannons, porcelains, silver coins, and many other valuable old artefacts and we filled two maritime archeology museums. I then returned to making money and started a fund in Germany and raised over 100 million USD to invest in Asia. I was based in Hong Kong again but when the baht collapsed in 1998 I moved to Phuket as I loved the place and saw opportunities here. I eventually sold my fund company and next became one of the first foreign property developers in Phuket, completing several trendy beach developments. Your book, A History of Phuket, was recently published. Please tell us more about this project. I love history. Everywhere I go I read up on its history because that's my first love. When I started researching more for my own education, I realised there’s little you could find out about what really happened here. I thought, hold on, we’ve got eight million tourists here and no history. What I did find reading Thai history is how turgid it was. So I looked at how I could make this interesting without changing it, so that you actually want to read it. There are lots of gory stories about just how awful people were to each other here. For example, you never hear about how the Burmese did take this island, which they did on six occasions. You hear only about the one battle where they saved the fort. That’s how it came about. I didn’t realise it would be five years’ work. I never set out to make money. It was a labour of love. Whereabouts do you live in Phuket? What determined your choice of location? I live in Baan Manik, which is between the Heroines’ monument and Cherng Talay. I used to live in Surin, then in Bangtao because when you first live here you want to live near the beach. But then we got a nice plot of land near the reservoir and it’s nice and quiet. Most importantly it’s in a central location. I have to run my kids to school at Phuket International Academy every day, and it’s near my wife’s office. Can you tell us more about your family? My wife, Ana, is from Ao Leuk, Krabi. She has an accounting and law office and is doing very well. We have two daughters, aged three and six, and I have a 22-year-old daughter (from a previous marriage) in the Dominican Republic, who will finish university next year in hotel management.

What do you do with your free time, if you have any? I take my kids to do fun things, I run with the hash house harriers, play golf, drink and party way too much, go travelling and read a lot. I also go mountain biking with a group of friends and once or twice a year we do mountain bike tours. Over the last few years we've cycled across Madagascar, Hispaniola and Burma. I’m 53 now and I had heart surgery a couple of years ago, but before that I was doing triathlons. I think I did eight Phuket triathalons. Ill do it again, but I’m waiting till I’m 55 and in an even older age bracket before I do another one! I also go boating. I have a hobie cat but it was just destroyed on the beach. Some ya bah boys cut everything up and stole the mast. I’m waiting till the kids are a year or two older then I’ll get a speedboat. But I don’t really want to squander my own money on boats as I’ve got plenty of friends who squander their own money on them. So how do you squander your money? Travelling, bad investments and partying. What do you think the future holds for you? I’d like to keep doing what I’m doing, which is travelling with the family, doing some investments to make some money and keep my brain going. I’m an investor in a new steam train project from Danang to Hue in Vietnam. I’m investing in coal mining in Kyrgyzstan. I’ve got agarwood trees up north and mahogany trees in Sri Lanka, and I trade in the stock markets. I’m looking at companies and I’m always looking at deals. I want to keep writing. I'm now working on a new novel set in this region in the 1780s. I’d like to have 20 novels out before I’m done. I’d like to work more with the history of the island, such as discovering the location of the fort that was so well defended, nobody can tell me where it is. We all know roughly where it was but no one knows exactly. It should be found and it should be promoted. There should be archaeological digs. What are you most proud of? I’d say my colourful life. I’ve had a very colourful life. I love my kids and family, and I’m pretty proud of achieving this book, too. But more than that I’ve really enjoyed my life and got around. I could have stayed in Hong Kong and made several more millions, but instead when I had what I perceived as just enough money I'd go off to do interesting things. I’ve visited nearly every country in the world – about 175 so far. I'd like to have visited every country in the world by the end of my days. Cutting Off Services in a Condominium – Not an easy choice In many condominiums throughout Thailand, laypersons struggle to get to grips with the details of the real rights and remedies under the Condominium Acts. There are website forum opinions, socially provided opinions, urban myth stories uttered between acquaintances and friends, and seemingly a divergence of opinions between different law firms – all of which can simply confuse developers, management companies and anyone involved in a condominium project.

The other ‘essential’ services, which Co-Owners receive, are electricity and water. The question as to whether or not such services can simply be ‘cut off ’ as part of common services delivered to the Private Property of Co-Owners through the Common Property is not as straightforward as a first glance at the Condominium Act might imply. ‘Degrees of Common’ Upon a blunt reading, all services supplied by the CJP to the CoOwner can simply be cut off, after 6 months of delinquent CAM Fees, under section 18(1) of the Condominium Act. However, if Co-Owners pay for and receive their water and electricity directly from the relevant government authorities, then what rights does a CJP Manager have to interfere with such supply? Well, the matter is debatable and can depend very much on the circumstances – which is why sometimes there is confusion on the application of the rules. The following matters should be applied when considering any potential decision to cut off such services: 1. Are there any infirm, elderly persons or children occupying the property as owners, occupiers or visitors?

Under Thai law, a registered condominium must have a Condominium Juristic Person (CJP) Manager and there are duties and liabilities attached to such a position. If a non-professional is appointed to such a position, and if funds are limited to seek legal advice at every turn, certain common problems can rear their ugly head, time and time again.

2. Are the meters inside the Private Property or on the Common Property? 3. Have the proper notices of default been served and have last known addresses for service been checked? 4. Are all Co-Owners in default being treated equally?

The most common problem in a condominium is when Co-Owners don’t pay their Common Area Management Fees (“CAM Fees”). This can, amongst many possible reasons, be due to lack of funds due to a change of circumstance, laziness or apathy, lack of understanding of duties as a Co-Owner or a hard-nosed decision not to pay CAM Fees if not in occupation of the unit, deciding only to pay the overdue Cam Fees upon sale. Co-Owners who do pay their CAM fees on time can then suffer, because if there is not enough money to pay for all the Common Area Facilities and Services, suppliers of such services may cease and the Condominium Building itself can start to look dilapidated. It should be noted that fixing capital or ‘major’ parts of the Condominium Building might require use of the ‘Sinking Fund’ – which is a fund designed to ensure that costs for such items are covered. CAM Fees can be distinguished by their frequency and nature. Some select examples of CAM Fees are: refuse collection; cleaning of the common areas; maintenance of any landscaping; maintenance of swimming pool or clubhouse; lighting; security; and perhaps an access road if that lies over the common area to the public road.

5. If one unit is cut off, can it be cut off in isolation from other units? 6. Do the Rules and Regulations re-enforce Section 18(1) and do they explicitly state the potential sanction of disconnecting utilities? 7. Have less severe, but possibly effective sanctions been considered, such as cancellation of security pass rights, denial of lift access and notification of non-payment upon entry to and exit from the Common Property, each time? Any other Relevant Laws? It is a mistake to read a law or an Act in isolation. Often, other laws can give guidance on the position generally, which might not be clear in a more specific law or statute. To select one example in this short article, the Penal Code of Thailand is clearly an act with criminal consequences for breach. That means that a person believing he or she is in a civil situation, may accidentally fall foul of the provisions of the Penal Code without being aware of having done so. Generally speaking, lack of knowledge is no excuse for infringing provisions. Title XII ‘Offence Against Property’, Chapter 8 “Offence of Trespass” deals with ‘entering into’ property, but caution should be applied as to what is ‘property’ when someone co-owns common property, and privately owns private property. Some might argue that if there is no entering of the property, then there can be no trespass, and of course in the context of a condominium and a dispute, the argument might be held and decided, at every party’s expense, in the Court. Summary Therefore, it isn’t simple to simply ‘cut off ’ services to a unit without regards to several steps, and seeking advice on the circumstances and context. All documents, including bye-laws or rules and regulations, should be drafted consistently and clearly, and it is recommended that even the softer measures of caution are included to ensure it is clear that thorough steps have been taken before exercising fairly draconian measures. However, there are circumstances where such measures may be entirely justifiable.

Museums by their nature tend to be fusty and odd and Phuket's two largest museums are no exception. Informative? Sure. Eccentric? Definitely. Let's take a stroll through time...

Housed in a large pink Sino-Portuguese style building with a courtyard and fronted by a park and lagoon, it's a rather incongruous sight in this remote, jungle-clad area of Kathu. From the space hall you enter a cave-like tunnel lined with pictures of prehistoric creatures until you come face-to-face with a hominid – well, an ape-like, wild-eyed mannequin with matted black hair, crouched in a cave, stone-age tools in hand. Further along there's a more modern caveman clad in a rather fashionable-looking leopard-skin loincloth, holding a spear, looking none too pleased to see you. The next hall featuring the museum's best installation, an elaborate miniature diorama of an open-pit tin mine operation in action. Hundreds of tiny workers are seen working busily on the site, illustrated in great detail and whimsy. A small but informative place, the museum highlights the geology, geography and people that have shaped the culture of Phuket and the Andaman region. The main entrance hall features exhibits of Thai history in general, including its ties to the ancient Khmer Kingdom, as well as the Indian influence on the Andaman region’s culture and religion. Standing in the main hall is a 2.35-metre, 9th century statue of Vishnu, found in the forest of Kapong district of Phang Nga, a stunning example of India’s ancient link to the area. In one hall highlighting the arrival of the Chinese by sea, you walk a plank between two large wooden ship models. Peek inside one of the boats, and you'll spot a layabout, having a snooze on the deck. Further along in the Chinese culture hall there's a man lazing on a platform bed, sucking on an opium pipe. The oldest Chinese school in Phuket, Thai Hua School was built in 1911, and has now become the Thai Hua Museum serving as a community and exhibition centre for baba arts and culture. The museum is a two-storey building with the upper level balconied internally to look down on the ground floor. Many of the exhibits and artifacts relate to the art and culture of China. Some of the old schoolrooms still remain as they were in the past, with old school desks and photographs of former students. The Phuket Thai Hua Museum is on Krabi Road. It’s open daily from 9am-5pm. Trends & Progress Now shall it be the latest iPhone 5, Samsung IV or HTC... or maybe wait for the next iPhone5S… decisions, decisions, decisions… Whatever the latest trends are, even in real estate, it’s a tough choice – and now with the arrival of the property developer 'big boys' from Bangkok, Phuket has gone 'condominium-mad'. So what is this craze all about? The condominium fever extends to property booths in every corner of every mall, signboard advertisements littering both sides of the road, flyers at car parks and so on. We're continuously assailed with offers “Get the latest Samsung IV when you purchase a condominium unit”, “Free furniture package”, “Free three year’s maintenance cost” etc, etc, etc… all for a 30sqm apartment??? Who would buy a 30sqm apartment in a complex of over 300 units? Many apparently, from the 'sold out' claims of the developers and also the continuous mushrooming of even more condominiums from Kathu to Bang Tao to Kamala. A trip to one of these developments was definitely long overdue, so off we went on a 'learning trip'. It started off with the security guards at the development who were quite diligent as they asked for some ID before we could drive inside. After promptly handing over a driving license and informing them of a unit number, we were waved through….so far so good. Now which block is the unit in? It actually took us several minutes to find out which block it was as there was no clear signage to indicate where to go. The second thing we noticed, while trying to park, was the limited amount of parking space around the complex. Where do the residents park? Or are you not expected to own a car?

If there are 300 units surely there must be at least 300 parking spaces, with more for guest parking. That would have been at least two football fields in space, which we'd have surely noticed. There was a lovely reception and sitting area with the added security of a key card needed to access the elevators to the units. Up we go in the lift, where it opens onto a long corridor with units on both sides. Upon entering the unit there's a compact living area with sofa, TV and a dining table for two. Just off the living area is the bedroom, separated by a sliding glass door. Off to the right of the bedroom are the bathroom, an open kitchenette and balcony. We then proceeded for a tour around the complex which had a common pool, gym and an open grass area around it. If you're single, into minimalistic style and just want a pad to crash in, hate housework or couldn’t care less about tending to the garden and don’t do much entertaining, then this is 'the' property that may be right up your alley. Within a few steps you can be in the kitchen, bedroom, living area and bathroom as the unit is compact enough for easy reach to your most important worldly belongings – like your mobile phone, TV remote and laptop. Phuket’s ever-growing landscape will soon be littered with condominiums and apartments like any big city; it's estimated that as many as 5,000 units have entered the Phuket market in the last 24 months. Well... I guess this is progress and something we'll all have to get used to as Phuket continues to grow in leaps and bounds.
