Till 13 October 2013 @ VR Gallery, Mom Tris Villa Royale, Kata Noi Phuket Artists on Show. Three local Phuket Thai artists and two resident artists will be displaying some of their favourite works at VR Gallery. Pieces include combinations of oil on canvas, mixed media and wood with themes ranging from nature, nautical, nude and abstract. It's a fascinating and multifaceted display of art work.
5-13 October 2013 @ Boathouse Wine & Grill Phuket Vegetarian Festival. An annual event held during the ninth lunar month of the Chinese calendar and lasting for ten days, the festival celebrates the purification of the mind and body and merit making through a vegetarian diet. Early morning processions from Chinese temples present devotees, possessed by spirits, piercing their tongues, cheeks and other part of the body with sharp implements. Not for the squeamish!

Summer Family Festival • Till 31 October 2013 @ Laguna Phuket Laguna Phuket Summer Family Festival 2013. The four-month long event offers daily Kidz Fun Zone programmes, discounts on tours, spas and golf and is followed by casual evenings of family entertainment featuring a BBQ Beer Tent (operates daily) with televised major international sports events on the big screen. Cliff Diving in Krabi for the 2013 World Series 21-26 October 2013 @ 4 dive sites from monolith cliffs, Krabi The best high divers in the world compete in the final of the 2013World Series in cliff diving. Divers will compete across four unique cliffs facing a steep rocky ascent, tides and currents. First a 24m dive from Wang Long Bay on Phi Phi Don Island where there are two opposing cliffs, guarding a narrow inlet of crystal blue water 10m deep. Next Maya Bay, with a 27m dive from a special platform allowing divers to perform more complicated arrangements of somersaults and twists. At Viking Cave, accessible only by boat, athletes dive from atop a gigantic stalactite jutting out a 90° from the cliff. The fourth site, Lading Bay, hosts a 28m dive to the water below. Ben Gale Owner, 69SLAM When did you set up the business? And why? 69 Slam opened its first shop in September this year. Having a Thai wife, Boo, and being a previous resident and regular visitor of Phuket, it was always in the back of my mind to return one day. The 69 Slam brand is famous in Bali with over 10 shops. On a recent trip to Phuket I was surprised they did not have a presence in Phuket despite being in over 27 countries. What were you doing / where were you living & working before? In 2011 we spent four months sailing our boat from Cairns, Australia to Bali where we've been living for the last two years. Work-wise we've had a rather diverse experience, including a pearl farm in the far north of Queensland (loss-making), A walk-through bird aviary tourist attraction (profitable), various properties (losing and making money on these). It's certainly been a bouncy ride. Where are you from? I'm originally from Cairns Australia. My wife and partner is a local Phuketian. What’s special / different about 69SLAM? What are its unique points? Most of the large beachwear companies employ fashion consultants to advise them on what's going to be the next trend and often all go to the same conferences and get the same information. Consequently their products are homogenous and conservative. The 69slam designers go out of their way to ignore what these so-called gurus are saying and design unique, vibrant, sometimes in-your-face and occasionally controversial, but never boring designs. What's your role in the business? Boo and I are the big kahunas over a massive staff of 4! What are the main challenges as they relate to your role? Creating brand awareness initially, but apart from that the same as any small business: cash flow, staff issues, inventory control and the like. …and what are the biggest difficulties you have to overcome? Packing up our life in Beautiful Bali and transporting it over to beautiful Phuket. What's your main target market? Boys, girls, men and women under 35 is the core market, but really anyone who wants to wear fun, comfortable beach wear. Marketing is obviously an important part of every business – what's your approach? Creating brand awareness is the first big step – through advertising in publications like Window magazine, social media etc – and creating a loyal following. What do you like most about what you do now? The brand is fun, we always enjoy starting new projects and there's that constant nervous excitement wondering how successful the venture will be.
And what do you like least…? Driving over the Patong Hill on a regular basis in traffic. What do you (and the business) hope to achieve within the next 3-5 years? If Bali has 10 successful shops and Phuket has a similar tourist profile then we hope to have at least four outlets here, plus some wholesaling through the rest of Thailand. What do you see as your biggest successes to date? Pulling the venture off in six months from the time we had the idea To what extent does the current global financial mess affect your business? Phuket seems to be bouncing back albeit with a different mix of nationalities. Russians love the brand and are one of our biggest customer groups. Is 69SLAM involved in any CSR (Corporate Social Responsibility) programmers? When I lived in Phuket in 2006, I was an active member of the Patong Rotary Club and I will certainly be contacting them when the dust settles What tools (if any) do you use to schedule your time? I am a big fan of Google Calendar and a simple 'to-do' list. How would you describe your leadership style? I'm a great delegator. What's your over-riding ambition at this stage in your life? Educating my kids, growing our businesses and giving more to the less fortunate than ourselves. If I achieve a modicum of success in this, then buy a bigger boat and keep sailing west!

ORIGINAL CARBONARA RECIPE FROM ROMA Serve in pasta ball with fresh grated Pecorino cheese on top
Ingredients for 4 People 400g pasta/spaghetti 30ml/2tbsp olive oil 4 eggs (at room temperature) 150g smoked bacon cut into matchsticks 75g freshly grated Pecorino Romano cheese Salt and freshly ground black pepper
Method • Bring a large pan of water to the boil. In a medium frying pan, heat the oil and sauté the bacon until the bacon renders its fat and starts to brown. Keep the bacon and its fat hot until needed. • Add salt and the spaghetti to the boiling water, and cook until it is 'al dente'. • While the pasta is cooking, prepare (NOT WARM) a large serving bowl and break the eggs into it. Beat in some of the Pecorino Romano cheese with a fork, and season with black pepper. (NO SALT)
• As soon as the pasta is done, drain it quickly, and mix it to the eggs mixture. Pour on the hot bacon and its fat. Stir well. Add more Pecorino Romano cheese. Be careful that the heat from the pasta and bacon fat DOES NOT cook the eggs. • Serve immediately.

Lemongrass founder, Bobby Duchowny, studied aromatherapy – a healing art that promotes massage, when combined with specific herb and spice oils, as a method to reduce stress, boost energy and heal certain physical ailments – at the American Aromatherapy Association. “The Best Spa In Southeast Asia”
Sukko means "Beyond Happiness". My first feeling when I stepped through the impressive gates of Sukko Spa was, "I’m in paradise". The Sukko staff are dressed beautifully in traditional Thai style and the spa design, influenced by the ancient Siamese capital, creates a haven of calm yet regal serenity. A variety of 40 spa treatments – prepared by Sukko's certified Thai Herbalist and based on ancient Thai medical theory – is offered at Sukko, in packages lasting from 2 to 4 hours. Each package has a specific purpose and can be selected to suit your lifestyle or the way you feel on the day. These herbal recipes and procedures have been handed down through generations and are totally free of petrochemicals, synthetic perfumes or colouring. Laguna Lang Co Golf Club is a 18-hole, par-71 championship course designed by Sir Nick Faldo. Mr. Tim Haddon, General Manager, commissioned Helicam as they required aerial photography of the golf course as well as a Video Course Guide (a hole by hole fly over of the complete course). Once on location the Helicam Team (Phil & Mhu) got straight on with the shooting. At strategic points around the course, using the remote controlled helicopter, the pilot / photographer (Phil) proceeded to capture the required still imagery. For the Video Course Guide the team started with video of the golf pro hitting the ball from the tee then, launching the helicopter, the team use a golf kart to stay ahead of the helicopter that Pilot Phil is flying and Mhu operates the camera. The idea is that the camera is the ball in flight. The completed stills and video material is then system worked / edited together on location and then back at the Helicam office in Phuket. The video has information graphics and a descriptive voiceover of each hole that will help the golfer plan his game.

The historic district of Phuket Town is called ‘Old Phuket’, but some of its oldest buildings are now sporting fresh new looks. Forward-thinking, stylesetting entrepreneurs have been steadily injecting new flair into the Old Town, transforming its centuriesold shophouses into vibrant, modern hotspots.

In delving into the new Old Phuket, a must-visit is the Memory at On On Hotel, Phuket’s oldest hotel that has recently reopened after an extensive makeover. It’s still owned by the same family that founded the hotel back in 1929, but after decades of being a rather dismal backpacker hotel, management was turned over to a Bangkok hospitality company, The Treasury Village Group. A multi-million-baht upgrade restored this faded beauty’s shine with the help of Phuket native Namfon Kanchanasaya, who is well known for her skilled eye for colour and design as the founder of Ceramics of Phuket.

Distinctive design pieces including an antique gramophone, vintage photographs and painted wooden shutters evoke the feeling of a romantic era of travel, while crisp white bed linens, ceramic bathroom basins and a bold use of bright colours throughout add a modern look. The inner courtyard, which uses the original open-roof architecture to allow in fresh air and sunlight, gives the downtown hotel an ambiance of a private garden space.

Just across the road from the On On is Siam Indigo, now a hub for great food and glamour since the 100-year-old shophouse was given an alluring uplift by Celine Masson and her partner in the business, architect Pisit Aongskultong, seven years ago. Khun Pisit said the design was inspired by tin mining in the old days and Baba-Peranakan culture. On On Hotel
In the seven-month renovation of this former travel office, partitions were removed to open the interior space and the back area developed into an enchanting garden patio, complete with an elaborate statue of Hindu God Ganesha created by Khun Namfon, the same designer who directed the On On’s upgrade. Parts of the wall are artfully broken away to reveal the original brickwork. Other original elements including the roof were restored to their former glory, while the interior was converted into a vivid and welcoming space adorned with rich red velvet curtains, glitter balls and a series of shimmering ceramic mosaic pictures of Hollywood starlets by Chiang Mai artist Surachai Sripaiboon.

Housed in a shophouse originally built by the powerful Tan family 100 years ago, and since bought by Khun Wiwan’s family, Kopitiam opened three years ago and quickly became the go-to spot for authentic local food. The Brasserie
Another restaurant in Old Phuket that’s become a talked-about spot to enjoy a dressed-up evening out is The Brasserie, which is housed in 110-year-old shophouse originally built for much less elegant purposes: a shop selling spare parts for tractors. When Alain Tabruyn and Phuket native Kwanjai Wonglee took over the building three years ago, the couple created a chic bar and restaurant that blends classic Old Phuket style and the traditional design of a Parisian brasserie. Bathed in the warm glow of stunning chandeliers handmade in Phuket, the restaurant is divided into different areas, each with a distinct mood, from the bright oyster bar to a cosy bar designed to resemble a copper brewing pot just behind it, to the swanky main dining area lined with a long red leather bench, to the romantic enclosed garden terrace tucked away at the back. Alain reveals that they will soon open a high-end restaurant next door with only 25 seats and a noted chef will create his artful dishes in a specially designed kitchen at the centre of the dining room. As the evening progresses, the chef’s table will be converted into a DJ station and diners will be free to dance the night away. Perhaps the best example of the old town segueing into something new is the Kopitiam cafe on Thalang Road, run by the affable Wiwan Bumrungwang, the great-granddaughter of the founder of the

Covering the walls of the low-key yet inviting interior are several photographs of Phuket through the ages, which Khun Wiwan brought out from her uncle’s extensive historical photograph collection. Kopitiam’s warm decor with Baba-Chinese touches immerses diners into the local Phuket scene as much as the delicious Hokkien noodles it serves up. Another Phuket-born entrepreneur, Watinee “Ann” Keatipanpatana, whose grandfather settled in the Thalang area after emigrating from China, has given new life to an old shophouse on Soi Romanee. Aptly named The Rommanee, this boutique guesthouse was a true labour of love for this computer programmer-turned-hotelier, who opened it late last year. Many modern touches were added to the 80-year-old building, while its teal green exterior blends in well with the historic street’s pastel-toned buildings. With only four guest rooms to work with, Khun Ann designed each in a unique and whimsical style: a modern Chinese room in red and black tones, a ‘colourful’ room, a retro room and a minimal room. Phuket Town is getting older but with the help of some creative minds and fresh ideas it continues to be reborn anew. It’s now emerging as a place where the hip and historic intermingle, as a new generation finds ways to honour the town’s past while adding up-to-date appeal. Within each of these historic buildings many stories and surprises continue to unfold, which reveal as much about Phuket’s future as its past.

David Brook David Brook moved to Phuket in 1998 with the aim to retire from his fast-paced UK corporate life, but 15 years on he’s as active as ever. Here, he reveals more about the people he’s met and adventures he’s had in launching a local beer brand and a bar in Patong. Where are you from? I was born in 1943 in Yorkshire, England. Educated at Leeds Modern Grammar School, Sheffield University (BA Econ) and Bradford University Business School (MBA). What did you do before you came to Phuket? I have over 22 years experience in the UK brewing, and drinks supply and distribution business and some 15 years experience in the Thailand drinks industry, with 17 years at Managing Director/Chief Executive level. UK Companies have included Scottish and Newcastle and Lonrho, prior to joining Federation Brewery, the tenth largest brewery in the UK, as Chief Executive for some 13 years. When did you move to Phuket? I was a regular visitor to Thailand for 20 years before deciding to live permanently in Phuket in 1998. What was it about Phuket that made you decide to live here? I’d been to Pattaya and Bangkok many times but first came to Phuket in January 1998 to see the Johnny Walker Golf Classic at Blue Canyon. I thought the island was fantastic and fell in love with the place instantly. I had an opportunity to take an early retirement deal from my employers, which I did, and that was it. By the end of 1998, I’d sold everything in the UK and came here: lock, stock and barrel. Two years later you founded Phuket Island Lager. When did you get the idea to make a local beer? It came out of one of the early conversations I had on my first trip. I had dinner with Tom McNamara, founder of Baan Rim Pa restaurant, on a few occasions and I mentioned that Europe and every part of the UK have different local beers, and I didn’t see that in Thailand. I saw only national brands like Singha, which had dominated the industry for so long, and one or two imports. Tom said, ‘Yes, you’re right. What can we do about it?’ That was where it started. What’s happening with the beer company now? It’s still going, but I’m not involved with it anymore. I ran the company initially as managing director but then found myself working 15, 16, 18 hours a day. I didn’t want to do that anymore as I’d come to Phuket to enjoy my life and play a little golf. Tell us more about Phuket Island Lager Bar, which you opened in Patong soon after the beer launched. The first bar was a big operation and quite successful, until the tsunami came along in 2004 and decided to change all that. We moved to a couple of different locations after that, but when the lease was up for renewal this year we decided to stop, as we fully anticipated that something would happen with the property. The owners of the land decided they wanted to repossess the site and what was there was demolished. You must have met many interesting people over the years. Tell us about your network of friends and acquaintances. I used to be well known in UK government circles, including numerous Lords, MPs as well as former Prime Minister Tony Blair. In 1994 I was awarded The Freedom of the City of London for services to the brewing industry. The Phuket Island Lager Bar received many visitors from around the world, including a number of celebrity friends, such as Jimmy

White, John Virgo and Pete Conway, who is Robbie Williams’s dad. I’ve also been a close personal friend of three-times World Professional Darts Champion, John Lowe, for some 28 years. John is a regular visitor to Phuket. How does doing business in Phuket compare to back home? It’s the coming to terms with the pace of doing business in Thailand, and the pace of getting things done. The legislation’s obviously different, in some cases for very good reasons. Working through the legislation to actually make something happen can be extremely lengthy and sometimes frustrating. And of course the worst thing in Thailand is to get frustrated because then nothing gets done. Tell us more about your family. I met my wife Kanchana on my first trip to Phuket. We’ve been together ever since and were married about five years ago. I have two children back in the UK from a previous marriage. My daughter Helen, 40, lives in Scotland and is a teacher and mum of two. My son Richard, 42, lives in London and is a professional musician of repute being a tour drummer for a number of groups, having backed the likes of Posh Spice, Ozzie Osbourne, Roger Daltrey among others. Richard has one daughter and another on the way later this year. You have supported a number of charities over the years. Can you tell us about them? In the UK we sponsored the UK Celebrity Golf Tour, raised funds for the Special Olympics, Children in Need and variety of local events. In Phuket, I organised the John Lowe Golf Classic to raise funds for the British Business Association of Phuket charity, the Asian Celebrity Tour 2008 for a charity in Patong, and was involved with The Irish Times Charity Golf Event to assist the Life Home Project. I also helped organise the 2011/2012 Poppy Appeal for Phuket. What have you been up to since closing the bar? I was a guest presenter on 91.5 FM Phuket Island Radio (Mr B) and am a regular column writer for The Phuket News (Grapevine). As for starting another business I would simply say, ‘who knows’. Something may be around the corner. I said I’d retire 15 years ago but I’m still as active as ever. I don’t have time to retire! What are you most proud of? Surviving till I’m 70 years old. My health is good, touch wood, and I have just one ambition left in life: to wake up every morning for another 10 years.

The Cost of Litigating – Time and Money When disputes over commercial agreements arise, or there is a clear breach of a duty or obligation by a party under contract, legal advisors are often approached for advice on filing a case in a civil court to seek compensation for losses. Filing a civil claim in any jurisdiction requires not only a legal analysis as to whether a case has the likelihood of success on the merits, but also whether carrying out a court case is commercially sensible. Not every dispute over a commercial agreement is worth pursuing from a commercial point of view, even where the facts are so favourable to the party filing the case that success by final judgment seems inevitable. As a general ‘rule of thumb,’ if the total compensation plus other relief to be obtained by pursuing a case to a satisfactory conclusion, whether by obtaining a favourable settlement or ultimately a judgment by the Court, does not substantially outweigh the costs in both time and legal fees, then it is advisable to consider other options to civil litigation. Other options could include alternative dispute resolution, such as mediation or direct negotiation to settle the dispute on an amicable basis. Experienced and commercially practical lawyers often advise their clients that civil litigation, although an option that should be considered in the right circumstances, should really be a last resort option after other viable options are considered in full. In Thailand, law firms are approached to assist clients with resolving disputes in the same manner as other jurisdictions around the world. Where there is a serious breach of a duty, clients often think first to call their lawyer to intervene if they are unable at first to obtain a resolution on their own. Generally, however, legal professionals in Thailand find that the appetite of a client to litigate in a Civil Court of Thailand is often lessened by the belief (often mistaken), that the time of a case will be far too long to complete. In reality, the Thai Civil Courts can move quite quickly through a case with competent legal counsel willing to pursue a case through the civil procedures fervently, objecting to repeated requests for delays or other tactics by other litigants in the case. Furthermore, the Thai Courts have implemented policies to encourage parties to resolve their case to a conclusion through settlement and mediation
prior to allowing the case to proceed with a trial on the merits. Indeed, court sanctioned mediation is now the rule rather than the exception, notwithstanding the type of claim or action filed. As in other jurisdictions, competent legal counsel in Thailand should advise a client whether the cost of the case in legal fees and time make the case worthwhile to pursue in a court. Clients should be aware that litigation in Thailand, although markedly improved with court-implemented policies and sophistication, still takes time as there are motions, filings, hearings, and examinations to prepare for an attend, and all such procedures naturally have an associated legal cost. Clients should therefore ask their legal counselor to provide them a full analysis of the costings and timing generally applicable to a Civil Court case before deciding to file. Court Case Timeline Overview A client can typically expect a case for a dispute over a commercial contract in the civil court to have the following ‘general’ procedures and timeline from commencement to conclusion after appointing legal counsel to assist: 1. Review of Evidence and Determining Cause of Action to File – 3 to 5 days; 2. Drafting and Filing of the Complaint and Service; Submission of Reply to Complaint– 30 to 45 days; 3. Mediation Sessions (generally 1 or 2 court appointed) – Within 3-6 months from filing; 4. Trial and Witness Examinations: At least two Court Dates – One for Plaintiff and One for Defendant – 6-12 months from filing (can be much longer if parties delay or request additional settlement negotiations); 5. Judgment Hearing and Post-Trial Motions – 60-90 days after the last trial Hearing; and between 12-24 months from commencement of the case. 6. Appeals Of course, the above outline is a general court procedural timeline, which may vary depending on the parties litigating and the complexity of the law and issues. The timeline and procedure set out above is therefore meant to be a guideline for clients. It should also be noted that an appeal may be filed after judgment is handed down by the judge overseeing the case in the court of first instance. The grounds for appeal are generally limited to errors in law and/or fact in the trial case, but typically new facts cannot be introduced. An appeal can substantially increase the time of conclusion of the case and increase costs to litigants. As such, the possibility of an appeal must be included in the analysis of the law firm and the client when considering the full costs of filing a case. Conclusion Resolving a dispute and seeking compensation for a breach of a duty through litigation in Thailand requires a full analysis of the costs, including the time to carry out the case from start to finish, in the same manner as in other jurisdictions. Clients are advised to seek a full analysis of the cost, time, and potential for success on the merits of a case from competent legal advisors well versed in both the relevant and applicable law, and commercial and practical aspects of carrying out a court case. As a guideline, the potential for compensatory recovery plus other relief should substantially exceed the costs in both time and legal fees and other costs of pursuing the case.

To rent or not to rent As property agents, we get asked this question pretty often and really there’s no hard and fast rule; rather it’s more a chicken and egg kind of question... For certain owners who have purchased a property in Phuket as a pure investment while using it as a holiday home, they have no qualms about renting their property out, whether for short term or long term rental. During the peak season on the island (over the Christmas and New Year), a 3-bedroom pool villa could (key word here is could) fetch up to USD$ 700 (THB 22,000 approx) per night and a 4-bedroom villa up to USD$ 900 (THB 29,000) per night – more or less depending on the location and facilities available. For these owners, just a short term holiday rental through the high and peak season is sufficient to pay off most of the maintenance costs of the property throughout the year. Such owners forgo coming to Phuket over this time, opting to holiday somewhere else or even spend time with family back home. Renting out a property and making some money on an asset is the ultimate goal of any good investor worth his or her salt. However it’s not all that easy for a property owner; a little homework and some effective management skills are required. Firstly, to rent out a property means that it has to be showcased or presented to agents and clients, so it must be maintained and looked after by a maid or villa management company who can come by to show the villa – sometimes at the drop of a hat. To effectively rent out a property, rental agents must be contacted and a system worked out for checking availability and rates, through to booking the property, collecting and refunding a deposit.
Setting up a website showcasing the property is recommended, where clients and agents can browse through pictures and view what the property has to offer. Once a booking is secured, it's always advisable to have a villa manager (who speaks a reasonable amount of English) to check in clients on arrival and to be the point of contact in the event that, during their stay, clients have any issues with the property or require any assistance. This is a vital part of the services provided by a villa manager to ensure a memorable and enjoyable stay, helping to ensure repeat clients as well as new clients by word of mouth. On the other hand, there are some owners who refuse to rent their property out for varying reasons – from not having someone else sleep in their bed to deterioration and lack of care of the property by clients or basically just not interested in the headache of managing clients in their property. For this group of owners, it’s very clear that they are not renting out their properties. For those still mulling the question “To rent or not to rent?" the answer is maybe a combination of both: selectively rent your property out to the “right” clients. A little background information on the clients from the agent is helpful, as well as a reasonable refundable deposit to cover damages. There's no sure way to safe-guard a property from damage when renting, but taking certain precautionary measures helps. Any antique pieces or valuable articles, furniture or family crystal should be safely kept under lock and key when the property is rented out. So, you’re set to rent your property out provided you've done your homework and have arranged someone to manage the clients.

Phuket has plenty of choices when it comes to places to see and things to do. This month we’d like to offer you a guide to some activities which will give you an insight into Phuket’s cultural side, away from the usual tourist attractions. We hope that this may enhance your holiday experience and perhaps persuade you to return in the future. Join the Phuket Vegetarian Festival Phuket still has a large Chinese community, so the Phuket Vegetarian Festival is a major event on the island’s calendar. The festival occurs on the first day of the ninth month of the lunar calendar (usually around late September or early October). This year it runs from the 5-13 October. The festival mostly takes place within Phuket Town. Enjoy the amazing street processions which usually occur early morning around the town. At the same time, you can sample a wide range of vegetarian food. Many restaurants and stalls all over the island will fly yellow banners decorated with red script, proclaiming that they’re offering authentic vegetarian dishes. It’s all part of the festivities.
View Antique Buildings A hundred years ago, Phuket City had a prosperous economy based on tin mining, and even back then was an international centre with a large expatriate community of Chinese and Europeans. They built beautiful homes in the style called Sino-Portuguese – terraced townhouses with narrow frontages and accommodations which stretch back from the road. The interiors often include walled gardens and fountains, and are beautifully furnished with antiques and Chinese inspired decorations. Rommanee Road is a fine example which has been fully restored. Visit Talang Road, Yaowarat Road and Dibuk Road. Nowadays, these streets in the Chinese quarter have transformed themselves into busy thoroughfares featuring antique shops, speciality restaurants and more. The Provincial Hall, the Phuket Courthouse and the town branch of the Siam City Bank are further examples of architecture from the past. All well worth a visit.
