What about daily deals? By Lex Nepomuceno, Executive Editor Are daily deals sites like Living Social and Groupon still relevant? From a customer’s perspective, the answer would be an emphatic “YES,” but from a business owner’s perspective it is closer to “Uff da!” Just in case you don’t know what the latter expression means, Wikipedia states: “Uff da is often used in the Pacific Northwest as a term for sensory overload. It can be used as an expression of surprise, astonishment, exhaustion, relief and sometimes dismay.” This “all-purpose expression with a variety of nuances, and covering a variety of situations” effectively summarizes the range of emotions many restaurateurs go through whenever they hear the term “daily deal sites.” As one who occasionally uses daily deals when planning vacations and weekend outings, I have found that the viral nature of these sites has not died down one bit. If anything, I have noticed friends and relatives point out offers they feel I might be interested in more than ever. I also notice more people reference these sites as part of their daily or weekly ritual – similar to how they peruse news sites and sports scores. Hence, regardless of whether business owners like it, daily deal sites are here to stay and likely flourish. Fortunately, there is more competition in this coupon space than ever. Major players such as Google and Amazon.com have come in to provide more options for restaurants. Trends for niche sites like ManDeals continue to pop up and allow business owners to target their marketing efforts. More choices mean more flexibility in how businesses take advantage of daily deals to attract new customers. Thus, proactive restaurants need to look at ways to get the most out of daily deals instead of having an “Uff da” moment whenever the topic comes up. According to a survey that the National Restaurant Association partnered in, “restaurateurs who had successful daily deal experiences stood out as experimental marketers that use a variety of different channels and tactics to drive customer acquisition and retention:” 94 percent engage with customers via social media (vs. 75 percent of non-daily deal users) 77 percent have run more than one daily deal 73 percent connect with customers via email (vs. 59 percent of non-daily deal users) 79 percent monitor online review sites to see what others are saying about their business (vs. 68 percent of non-daily deal users) 71 percent have promoted their business with traditional newspaper and magazine ads (vs. 58 percent of non-daily deal users) In addition to the aforementioned traits of successful daily deal restaurants, here are some industry best practices to help ensure daily deal success: Prepare staff to focus on customer service, look for upsell opportunities and track offer redemption Schedule daily deal timing based on business needs and seasonality Estimate and understand the promotion’s impact on profitability Measure success by using free tools provided by daily deal company Encourage repeat visitors with a customer loyalty program The most important thing to remember when considering (or reconsidering) daily deals for your business is to commit fully, or just not do it at all. Results from the above survey clearly indicate the restaurants that implement daily deals, do so as part of a more thorough online strategy. These types of sites continue to be viable marketing avenues that can generate a steady stream of new customers. However, businesses need to go all-in when they go down the path of the daily deal. Take heed in a fictional character’s famous words: "Do or do not. There is no try.” -  Yoda

Primary Source of Information | News Briefs Health care notice language released In May, The Department of Labor released model language and a template for the written notice that almost all employers will be required to provide to their employees about how to access health care coverage through new “exchanges” created by the 2010 health care law. The notice also lets employees know they may be eligible for tax subsidies to buy insurance through exchanges. Employers will be required to provide the notice to current employees by Oct. 1, and at the time of hiring for employees hired on or after Oct. 1, the DOL said in IRS Technical Release 2013-02. Starting in 2014, employers meet the notice requirement if they provide written notice to employees within 14 days of the employee’s start date. For more information, go to http://wra.cc/hc050913. 

NTSB proposes lowering legal blood alcohol limit for driving to .05 The National Transportation Safety Board (NTSB) yesterday voted to recommend that states reduce the legal blood-alcohol content level for impaired driving from .08 to .05. However, the NTSB has no authority to order changes to state/federal laws; it would be up to individual states to change their laws. “As responsible members of the community, our industry is very concerned about drunk driving,” said Scott DeFife, executive vice president, Policy & Government Affairs for the NRA. “However, we feel measures addressing it should be focused on repeat, chronic offenders who drink excessively, then drive — and not the millions of Americans that enjoy an adult beverage in a responsible manner with their meal.” 

More on health care: FLSA exchange notice temporary guidance released The Department of Labor (DOL) released temporary guidance regarding the Fair Labor Standards Act (FLSA) notice required by the health care law that employers subject to the FLSA provide notice of the exchanges to their employees. The DOL also has released templates employers can use to comply with this requirement – one for those who offer coverage and another for employers who do not. Employers are required to provide this written notice to current employees by October 1, 2013, and thereafter to new hires. For 2014, the Department will consider a notice to be provided at the time of hiring if the notice is provided within 14 days of an employee’s start date. NLRB poster rule invalid In a major victory for restaurants and other employer groups in May, a federal appeals court threw out a National Labor Relations Board (NLRB) rule that would have required all businesses to post workplace notices advising employees of their union-organizing rights. The regulation violated employers’ rights to cont. at top right

free speech, the appeals court said. The mandate has been on hold since April 2012. The restaurant industry, through the Coalition for a Democratic Workplace, was one of the parties to the legal challenge. 

Employers must use revised form I-9, employment eligibility verification U.S. Citizenship and Immigration Services (USCIS) reminds employers that they now must use the revised Form I-9, Employment Eligibility Verification (Revision 03/08/13) for all new hires and re-verifications. All employers are required to complete and retain a Form I-9 for each employee hired to work in the United States. The revision date of the new Form I-9 is printed on the lower left corner of the form. Employers should not complete a new Form I-9 for existing employees, however, if a properly completed Form I-9 is already on file. For more information, go to http://www.uscis.gov/I-9. 

Three Cheers for Oak Harbor High ProStart! Once again the Washington Restaurant Association Education Foundation (WRAEF) is pleased to congratulate the Oak Harbor High School ProStart culinary team on its fifth place win at the National ProStart Invitational in late April. Oak Harbor won top honors in Washington State’s Boyd’s Coffee ProStart competition in March, advancing to the April 19-21 national competition in Baltimore, Md., where culinary teams from 43 other states prepared meals for the judges. The winning Oak Harbor team consists of seniors Haley Garden, Joanna Leete, Racheal Balasa and Sara Jackson; with culinary teacher Mary Arthur and mentor Scott Fraser of Fraser’s Gourmet Hideaway. 

Just another way we’re helping you succeed — meet our new local government program

At a recent conference, I was asked what keeps me up at night on behalf of the restaurant industry. The answer was easy. My biggest anxiety is caused by the explosion of traditionally state and federal issues at the local level. While menu labeling and the proposed bans on to-go packaging created significant concern in the restaurant industry, the Seattle City Council’s decision last year to move forward on paid sick leave was particularly disconcerting—as was the process used to create the policy. It was the first time a municipality in King County (or Washington state, for that matter) had decided that labor issues were no longer going to be exclusively mandated at the state capitol or in D.C. It was a move that signaled a real shift in authority, in terms of how this industry could reasonably expect to be regulated moving forward. Just imagine your city and county tackling, negotiating, adopting and enforcing differently the 400-some labor rules currently regulated by the state and federal governments. The WRA’s board of directors was equally troubled by local-level developments and decided we needed to move aggressively to protect your business. The result? This month, the WRA is rolling out a new local government program, based in King County and the cities within— because we are confident the movement toward tighter local regulation in this part of the state isn’t going to slow down any time soon. A recent example? In May, a proposal introduced in the City of SeaTac seeks to require all employers in the city to provide paid sick leave and a living

wage of $15 per hour. The proponents of this initiative claim to be targeting big businesses; but the reality is that this effort, if successful, would devastate small business operators. This is just one reason why enabling the WRA to establish a stronger presence at the local level is so crucial. The Association’s current GA team was built to protect and enhance Washington’s restaurants in the state policy arena—not locally; and it is clear that the areas most at risk are inside King County. As such, the Board has directed us to establish this local government affairs program for King County. And to help make that possible, the Board approved a nominal and mandatory contribution from all King County member-operators, per location, to support the necessary costs of a King County local government program. This new approach will afford restaurants the benefit of increased WRA staff time and resources, focused on the mission of monitoring the regulatory landscape in King County, establishing relationships with elected leaders and ensuring that restaurants always have a seat at any table where issues detrimental to the industry are being discussed. The Board and the WRA team very much recognize that the restaurant dollar is tight and that there are no welcome new costs. Please believe us when we say that if there were not thousands of dollars at risk for every King County restaurant we would not be asking. We believe strongly that this is the right time and the right way to defend your business from the type of regulatory action that could ultimately determine the success or failure of your business. And notably, we believe that by establishing a strong voice in King County, the needs, expectations and unique challenges of this industry will be more clearly understood with local governments throughout the state. Beginning this month, the Washington Restaurant Association is significantly changing the way it represents restaurants at the local level—specifically in King County. This was a big decision, fueled by a rapidly changing regulatory culture. Over the past five years, the WRA has witnessed the alarming rate at which state and federal issues have been taken up as matters of local authority. Under the previous model, the WRA had been diligent in educating policymakers, and giving the restaurant industry a voice during discussions surrounding issues such as menu labeling, the togo packaging bag ban and, most recently, paid sick leave. However, when the Seattle City Council approved the sick leave measure last year, it became clear that the WRA needed to establish a more preemptive dialogue within King County’s policy-making community. That’s why the WRA has decided to invest in a strategy designed to proactively protect restaurants from harmful local government regulations, and give those businesses a stronger voice in the regulatory process. This new plan will allow the WRA to establish a more deliberate and calculated approach, via increased staff time and resources, coalition partnerships, polling, tactical communications and extensive industry-issue education for elected officials. The new King County local government program will give restaurants a consistent seat at the table with Seattle and King County’s governing bodies, by way of a dedicated WRA staffer. The Association believes in the importance

of addressing these issues before they become too big to curtail. Influencing decisions, guiding policy direction, negotiating compromises and educating leaders proactively are the WRA’s best defenses at the local level. Political advocacy is a vital part of the WRA’s mission to help its members succeed, and based on member feedback, we know that it’s one of the main reasons many restaurateurs join the WRA in the first place. For years, the Association has had one of the most respected and effective lobbying teams in Olympia. This group of five skilled lobbyists has the benefit of longstanding relationships in the legislative community, a vast understanding of Washington’s policy landscape and the influence to affect policy decisions. The WRA’s objective with this new local government program is to continue that standard in King County. The effort will place its initial focus on the Seattle City Council, Seattle Mayor’s Office, the King County Council and the Seattle/ King County Department of Health. These local elected regulatory bodies have shown to be the most active in recent years regarding new financial and regulatory policies that affect businesses. The WRA’s efforts up to this point have shown that if we work to influence decisions made by these entities, we can have a resounding effect on neighboring local communities where similar discussions take place. The Washington Restaurant Association (WRA) has worked for 84 years to help foodservice businesses across the state to run successful operations. While the organization has evolved over the years, today’s WRA is focused on four key areas: political advocacy & representation, news & information, training & education and cost-saving programs. When it comes time to make important decisions, the WRA relies on the restaurant industry’s wisdom and priorities to determine its direction as an organization. Every decision is influenced by the needs and challenges of the WRA’s more than 5,000 members. WRA Government Affairs Team protects your business, so you can focus on the bottom line By Heather Donahoe, managing editor Washington Restaurant Association members and their businesses are represented by one of the top political lobbying organizations in the state. The WRA government affairs team’s helps the organization’s 5,000-plus members succeed through proactive, responsible political representation. The GA team works daily to mitigate harmful legislation and regulatory changes, while promoting and advocating beneficial new laws and amendments. Every year, it becomes more important to our industry for legislators to understand the challenges restaurant operators face in this volatile business climate. The WRA is committed to representing the restaurant industry before the Washington State Legislature, and the GA team is committed to promoting restaurants’ interests year-round. Grassroots Network The WRA has one of the state’s most sophisticated and effective grassroots networks, thanks entirely to members’ participation. The Grassroots Network is made up of members representing all sectors of the industry. Grassroots volunteers vary in time commitment and duties, ranging from a Grassroots ambassador to a Grassroots phone contact. While the WRA lobby team works closely with state legislators and agencies throughout the year, it is crucial to remind elected officials who the WRA represents: real people and real business operators. Putting a business operator in front of an elected official and allowing a dialogue to unfold is one of the most effective forms of communication this organization can facilitate. Action Alerts Part of what makes the WRA’s Grassroots Network so effective is the use of action alerts. The WRA relies on a sophisticated grassroots tree, separated by business type and legislative district, to place 14 | warestaurant.org

phone calls to legislators when a bill is reaching action in the Legislature. The WRA Political Action Committee The WRA Political Action Committee (PAC) is one of the leading political action committees in Washington state. As representatives of the state’s hospitality industry, the WRA knows how important it is that restaurant operators’ voices be heard in Olympia. The WRA PAC’s purpose is to: Educate campaigning candidates on hospitality industry issues Support candidates who take the time to understand and work with the restaurant industry Utilize statistics and resources to incite change WRA members’ PAC contributions shaped the political outcome for restaurants in Washington by educating lawmakers. Government Affairs Team Bruce Beckett Government Affairs Director Bruce Beckett joined the WRA in 2009, bringing with him more than 27 years of public affairs experience, including 17 years leading Weyerhaeuser Company’s Western Region and Washington State public affairs teams. Prior to joining the WRA, Bruce served as the director of public affairs for the Cascade Land Conservancy’s $20 million Cascade Agenda campaign. He has served on the boards of numerous business organizations, including the Association of Washington Business, as a Deputy to the Washington Roundtable, TVW, the Washington Forest Protection Association, Northwest River Partners and the Washington Research Council. Bruce is accountable for overall leadership of the WRA government

affairs team, provides strategic direction to the lobby team, and ensures WRA members are fully informed and engaged in the development of WRA positions and tactics. Josh McDonald State and Local Government Affairs Josh McDonald joined the WRA government affairs team in 2007. He has contract lobbying experience and has worked on numerous congressional, state and local campaigns. In addition to his work at the state level on such issues as nutrition/ obesity, food safety, tourism and the environment, Josh focuses much of his attention on building and maintaining a strong industry presence at the city and county level, as well as cultivating an ongoing dialogue with local health departments. In the coming year, Josh’s work will be focused largely on representing King County foodservice operations to local policymakers. Julia Clark Government Affairs Manager Julia Clark has been a member of the Washington Restaurant Association’s Government Affairs team since 2007. Julia significantly grew and strengthened the WRA’s Grassroots Network, which was directly responsible for the WRA’s protection of the pop syrup tax credit and Retrospective Rating program. Additionally, Julia was responsible for establishing the WRA’s Ambassador training program – giving restaurateurs tools to communicate with their elected representatives. As a lobbyist, Julia has worked to achieve a tax exemption for free employee meals, as well as granting restaurants the privilege of selling growlers to-go. She works closely with state regulatory agencies, particularly the Liquor Control Board, and continues to play a vital role in

monitoring and guiding policy decisions around the state’s evolving liquor privatization issue. Contract lobbyists Denny Eliason Denny Eliason is regarded by much of Washington’s legislative community as one the most accomplished lobbyists on the hill in Olympia. Among other significant wins, Denny’s hard work yielded the B&O tax credit on pop syrup taxes that saves restaurants across the state an average of $3,000 annually. Denny is the founder of Alliances Northwest, a businessoriented government relations firm emphasizing representation before the Washington State Legislature and local governments in Washington state. Denny has experience working on a number of issues, including banking, energy, employment, environment, finance, growth management, health care, insurance, pharmaceuticals, retail, securities, taxes and transportation. Some of Alliances Northwest’s other clients include Puget Sound Energy, Nintendo and Amazon.com. Kim Clauson-Hoff Kim Clauson-Hoff is a partner with Denny Eliason at Alliances Northwest. Kim’s primary focus is workplace and labor issues. She is also a strong force on the front lines for the Washington Restaurant Association on some of the industry’s toughest issues. She routinely delivers results on issues that affect restaurateurs’ bottom lines. Kim has landed the state’s restaurateurs their biggest proactive wins in the past five years, which include tackling issues such as workers’ comp, gift certificates and pushing the obesity lawsuit prevention bill past the governor’s desk. Kim has defended WRA members against a series of bills that, if enacted, would have increased the overall costs of benefits for UI, thereby leading to higher UI taxes for employers. 

Washington Restaurant Association Education Foundation By David Faro, contributing editor The Washington Restaurant Association Education Foundation (WRAEF) is a 501(c)3 charitable organization helping the hospitality industry grow through training and education for current and future employees. ServSafe Manager Certification ServSafe Alcohol (mandatory server training) ProStart school to career training. The WRAEF Supports the Industry! Restaurants base success on the skills and knowledge of their employees. The WRAEF provides the industry with the highest quality certification programs so establishments remain at their best. The WRAEF offer the following training programs with significant member discounts: ServSafe Manager ServSafe Manager is a national restaurant association (NRA) training program for food service and hospitality personnel. Serve Safe allows you to offer the highest standard of advanced food safety training to you and your staff. This manager-level certification not only keeps customers safe with advanced safety knowledge, it also helps food service establishments comply with the Demonstration of Knowledge requirement within the Washington State Food Code. Training is available online or in a classroom setting. Q: I’ve been thinking about using a consultant to help me with my business. How do I know if one is qualified, and what are some advantages of using a consultant?

The field of consultancy is a wide open field without regulation. One day it will be regulated, but until then, there are certain qualifications to look for that will help you find a qualified, legitimate consultant who can help with your business. These criteria include certifications, a high level of education, prior experience in a professional services firm, a solid client base, a specialist not a generalist, a thirst for knowledge, a gift for teaching, a decade or more of industry experience in the consulting area, a systematic approach and a high hourly rate. The following are some advantages of using a trained professional consultant: Consultants have an independent viewpoint. Consultants tell the truth without worrying about long lasting consequences. Some owners are not prepared to hear the realities of their businesses. Near midnight, after assessing the business of a client, I sat with him to recap my findings. Finding number one, two and three were unpopular, I could see my client getting agitated, squirming and turning red. I stopped the recap and looked him straight in the eye. After a long, uncomfortable pause I told him, “This may be the only time I’m going to meet with you. I’m not looking for a contract or more work. I’m going to tell you the truth and whether you want me back is irrelevant. You hired me to give you advice and I’m going to give it. Your decision-making and behavior are producing poor results and behaviors in your business.” He sat back in his chair and stared at me. “Good thing you explained,” he said, “I was just getting ready to punch you.” There was plenty of work to follow. A great consultant will never be afraid to tell a client what he/she needs to hear even if that means getting fired. The consultant’s job is to present data and remain independent. Consultants will help improve your business. Because a consultant has a rich history in your industry, a wide client base and a narrow focus, a consultant can perform an assessment, help with organizational strategy and structure, make recommendations to processes to improve productivity and help you implement recommendations. Professional consultants have tried and true practices and processes and

will have worked with businesses that are likely further along, more productive or have better systems of organization than yours. The result is often an expanded view of the business with much more upside than originally imagined. Consultants bring best practices, are specialists and can solve a specific problem. Consultants practice their trade much as a CPA, an attorney, a physician or any other professional. Many needs in a business come and go, and having someone on staff to address all emerging issues requires a broad staff. A consultant can fix problems by assessing and scoping a work plan, focusing in on the highest and best work and motivating and inspiring the organization. Perhaps you need help managing a labor or product cost issue or need your menu engineered or new menu items developed. Maybe your lease is coming up for renewal or your business has grown to the point of expansion or you’re having an employee issue. Perhaps your market share is slipping and sales are declining. Using a consultant specialized in these areas will more than pay for itself. Consultants are hired to increase revenue, reduce cost, create organization or change, or drive strategic development. Notably, using a consultant likely will be less expensive in the long run than hiring employees. Most importantly, to make the most of your consulting experience, define your reason for using a consultant. Without a defined scope of work, you’ll waste time and money; with it, you’ll save both. There is an old saying, “If you think hiring a professional consultant is expensive, wait until you hire an amateur.” Save yourself some money and hire a professional consultant.
