Tip pooling clarity is here! In hospitality, we are just as passionate about our team members as we are any other part of our business. Our industry is not successful unless our employees are successful. A federal spending bill in March said employers are once again allowed the opportunity to expand tip pools and share the tips among a broader range of employees in states where tips are not recognized as wages. This change allows tip sharing among both customarily and non-customarily tipped employees, like dishwashers and cooks. It also provides clarity for hotels that have operations, and employees, that receive tips such as bell staff, valets and baristas. We have been working for 21 years to clarify that heart-of-house team members can be included in mandatory tip pools. I was a young staffer at the Washington Restaurant Association in 1997, just four years out of college, the last time the business model was going through a major reconstruction. That year, a new minimum wage initiative was in front of us. Members were considering all options amid the changing the dynamics of the industry including new positions, new hours and bussing stations. Amid these new considerations, operators were calling the Association to get clarity and a better understanding of what their options were around tip pooling. It became clear to our attorneys that the U.S. Department of Labor’s interpretation of the tip pooling law should not apply where there is no recognition of tips as wages and an operator can’t take a tip credit. We began working to build a legal construct and find a case to get this interpretation clarified. Our partners in Oregon worked with us the entire 20 years. The National Restaurant Association secured matching funds and strong legal support for our attorneys. Other states joined with us in this effort. We share this tip pooling win with them. How tips are shared in your house is ultimately your choice. You get to decide what the best model is for you. Tip pooling may not be the right answer for you. As you decide, please work with your lawyer and check out clarifying resources the association provides. This is a win for teamwork. This is a win for legal clarity. This is a win for wage equality in the house.

A note on managers and supervisors As we were fighting to clarify that our cooks and dishwashers can benefit from tip pools, we were not fighting to share tips with owners and managers. We’ve known for 20 years that managers and owners cannot benefit from a tip pool. Tip pooling case law is absolutely clear, both in Washington state and at the federal level. Tips are the property of the employee and not the property of owners and management. Whether a case involved servers or parking valets, the precedent was clear. This was reiterated in Initiative 1433. We recognize some in our industry may like the idea of flexibility for management to benefit from a mandatory tip pool – especially for managers and supervisors in crossover roles. This has never been legal. The new legislation makes it clear at the federal level that tips belong to the workers who receive them and that owners, managers and supervisors are prohibited from sharing in tip pools.

federal overtime rule, which would have doubled the minimum salary threshold for the “white collar” overtime exemption from $23,660 per year to $47,476. Washington state’s salary threshold requirement is set by administrative rule by L&I, and the department has indicated it intends to update the rule to be more consistent with current workforce demands. This signals the possibility that the state’ minimum salary exemption threshold may be increased, and some stakeholders are suggesting a new threshold at or above $60,000 annually.

In May, Washington Hospitality and Seattle Restaurant Alliance member Edouardo Jordan won two James Beard awards, earning well-deserved national recognition for his innovative work at JuneBaby and Salare. He and his team at JuneBaby won the Best New Restaurant Award, often likened to one of the top Oscars, and he was awarded Best Chef: Northwest for Salare. Both restaurants are located in Seattle’s Ravenna neighborhood. Jordan and the acclaimed JuneBaby have gained significant other accolades this year, including Food & Wine magazine’s Restaurant of the Year award and a three-star review in The New York Times which put it in the ranks of the nation’s top restaurants. JuneBaby is Jordan’s tribute to Black southern cooking and an introduction to the foods his mother and grandmother served. Guests not only explore the tastes and ingredients that define home Southern food, they also have the opportunity to explore the historical context of those ingredients and learn about the experiences that went hand in hand with the evolution of family cooking in the South. L&I looks at overtime salary exemption threshold The Washington State Department of Labor & Industries has begun holding stakeholder meetings to implement rulemaking on the salary threshold for Executive, Administrative and Professional exemptions from the Minimum Wage Act. This is important because like the federal government, Washington state exempts specific types of employees from the overtime requirements and the new paid sick and safe leave law. The Washington Hospitality Association believes the current exemption is based on the type of position (administrative, executive, professional) and not based on the salary level of employees. Earlier this year, the Democratic chairs of the House and Senate labor committees directed L&I to establish state rules that mirror the overturned 8  │  wahospitality.org

Best practices for mandatory tip pooling policies and procedures On March 23, 2018, the U.S. Department of Labor issued a new tip pool rule that allows employees who do not traditionally receive direct tips, such as restaurant cooks and dishwashers, to participate in mandatory tip pools. These heart-ofthe-house employees contribute to the overall guest experience, and under the rule they would also be able to benefit when guests reward for that experience. As Anthony Anton explains in his President & CEO column on page 6, this is an important win for our industry and one that the Association has worked long and hard to achieve. The Association has also been working hard to make sure members understand the new rule, providing numerous resources and announcements including a best practices document. Primary Source of Information | Association News Congratulations, 2018 Washington Restaurant Neighbor Award Winners!

The Washington Hospitality Association is proud to announce the Washington state winners of the Restaurant Neighbor Award: Arby’s of Spokane, the Boat Shed Restaurant, Ethan Stowell Restaurants, the Mill Creek Pub and Mitzel’s American Kitchen. The award, created by the National Restaurant Association in partnership with American Express, honors restaurants across the country for their outstanding community service and involvement. Restaurants have a well-deserved reputation for going the extra mile to make their communities a better place, and these five winners are excellent examples of how restaurants are making a positive difference. Here are some highlights of how they are supporting their communities: Arby’s of Spokane, owned by Jerry Pederson, makes an important contribution to its community. During the past year, Arby’s of Spokane, which has four locations, gave $10,283 to Feed Spokane, $6,167 to Big Brothers and Big Sisters, $6,542 to the Children’s Miracle Network and $21,452 to the Arby’s Foundation and its No Kid Hungry program. $15,000 of this generous donation supported a local weekend backpack feeding program. The Boat Shed Restaurant in Bremerton makes giving back to its community a priority. The Boat Shed participates in several local fundraising projects, including Race for a Soldier and the Gig Harbor Film Festival. Coowner Kathy Davis-Hayfield also started Music in Manette, which brings eight weeks of live music to the park above the restaurant. The Boat Shed staff and the Manette Business Association work

on sponsorships throughout the year to underwrite performances by talented local musicians. Boat Shed employees also volunteer and participate in several community events, supporting the community and strengthening the restaurant team. Ethan Stowell Restaurants Angela and Ethan Stowell, co-owners of 15 Seattle restaurants, give about $250,000 in time, material and money each year. “We love our city and care about how it’s growing,” Ethan Stowell says. “Instead of buying ads to promote our restaurants, we make donations. It’s a win-win.” The couple also served as co-chairs of the United Way of King County’s campaign this year. “I’m so pleased that Angela and Ethan Stowell are leading our fundraising campaign this year,” says United Way CEO Jon Fine. “They bring great energy and passion in engaging people in a new way.”

The Mill Creek Pub, in Battleground, is well known for its community involvement. During the six years the restaurant has been open, it has clearly made an impact on its community. Among the contributions of the restaurant and its owner Russell Brent is support for the Rocksolid Community Teen Center. The Mill Creek Pub has given time, talents, food and funds. It has also made many connections for the organization, and has helped it raise more than $350,000 over the last five years. Other community activities include raising more than $50,000 for the Battleground Education Foundation and managers organizing free meals for needy families and veterans. Staff members are also frequent volunteers for community causes. The Restaurant Neighbor Award adds to the 68 awards Mill Creek Pub has already earned for its outstanding community service. Jack Emmons, owner of Mitzel’s American Kitchen in Kent, has a special heart for foster children. After adopting a foster child, he and his wife Kim, realized how much kids in the foster system are lacking. They started Foster Champs of Maple Valley, a nonprofit that provides foster kids muchneeded school supplies, toiletries, blankets, toys and funding for special activities such as sports and proms. Foster Champs also runs a monthly support group for foster families and is making a tangible difference in the lives of foster children and their foster families. 2018–2019 Buyer’s Guide  │ 9

Government Affairs | Local GA Update

Seattle passes $50 million tax on jobs On May 14, the Seattle City Council voted unanimously to tax jobs to increase city spending on affordable housing and homelessness. The tax will raise between $40-$50 million per year by assessing a tax of $0.14323 per hour, equivalent to $275 per FTE, at businesses with more than $20 million in annual taxable gross receipts in Seattle. The new tax will go into effect on Jan. 1, 2019 and sunset on Dec. 31, 2023. This controversial new tax comes after a lengthy and contentious public debate that has increased scrutiny over the City Council’s fiscal accountability, its lack of progress in dealing with the homelessness crisis and the fear that its policies will reduce employment opportunities in Seattle.

Look for final rules for Seattle’s Hotel Employees Health & Safety Initiative ordinance The Seattle Office of Labor Standards was scheduled to release the administrative rules for the Hotel Employees Health & Safety Initiative (HEHS) ordinance on May 17, but announced a delay shortly before this magazine went to press. In the announcement, OLS said that an additional two weeks were needed to finalize the rules and prepare materials for implementation, and that the final rules would be published on May 31.

The hotel and restaurant community has been particularly concerned about the impact of a jobs tax on labor-intensive hospitality businesses, which would be hardest hit by the tax.

HEHS went into effect in November 2016 shortly after Seattle voters approved Initiative 124, establishing additional safety, health and insurance requirements for Seattle hotel employers. The administrative rules, which are intended to clarify the ordinance, will come one and a half years after the initiative became law. Look for information on the final rules in the Weekly and in Seattle Hotel Association communications.

Jobs in hospitality are part of the solution to homelessness. Our industry is able to provide low-barrier employment and second-chance jobs that help people gain skills and financial stability. These positions lead to greater opportunities and life-long careers, and they are critical to helping people stay in housing or to transition back into stable housing.

New multi-purpose field house coming to downtown Spokane The Spokane County Commissioners approved the sale of $25 million in bonds to build a brand new SportsPlex in downtown Spokane. The cost of the Spokane Regional Sportsplex is estimated at $41 to $42 million.

A signature gathering effort is underway to repeal the tax through a referendum to voters. Businesses and community members are supporting the referendum; as of press time, neither the Seattle Hotel Association nor the Seattle Restaurant Alliance has taken a position on the repeal effort.

Plans for the proposed 180,000 square-foot multi-purpose field house could include a 200-meter, six-lane indoor track and the ability to accommodate up to 17 volleyball courts, 10 basketball courts or 21 wrestling mats. It may also include an NHL-sized ice sheet.

Washington State Convention Center Addition gets green light The expansion of the Washington State Convention Center moved past its final legislative hurdle in May when the Seattle City Council voted to approve the street and alley vacations required by the project.

Once completed, the SportsPlex is expected to bring in 26,000 to 46,000 new hotel stays and between $19 million and $33 million in direct tourism spending a year, according to an independent feasibility study.

The WSCC Addition is an important win for hospitality, and one that our Seattle members worked hard to achieve. The project will double the overall space of the Convention Center by adding 440,000 square feet of new spaces and the capacity to accept significantly larger meetings and conventions. It will boost business travel to the city and will benefit other parts of the state as visitors take advantage of all Washington has to offer. Construction is expected to begin this summer, and the project is scheduled to be completed in 2021. 2018–2019 Buyer’s Guide  │ 11

Government Affairs Committee: Candidate Endorsement Meeting June 26 in Seattle 2018 is going to be a critical election year. Currently, Democrats in the Washington State Senate hold a one-seat majority, while Democrats hold a two-seat majority in the House of Representatives. This, plus the fact that more than 10 members of the House are retiring or stepping down, means that state races in this year’s mid-term elections will be very important to the future of the Legislature. The Government Affairs Committee: Candidate Endorsement Meeting will offer further insight into the candidates in critical legislative races across the state.

Meet the new chairs of the Government Affairs Committee In July, the Washington Hospitality Association will welcome the new co-chairs of the Government Affairs Committee. Ahead of this transition, the State Government Affairs Team wants you to get to know the incoming co-chairs of the GAC: Full Service Representative: Russell Brent Russell uses his business as a vehicle for his real passion, community building. He has a bachelor’s degree in hotel restaurant management and a master’s degree in service management. Russell spent years in the corporate world up and down the West Coast with as many as 10 restaurants under his purview. He feels it wasn’t until he opened Mill Creek Pub, after 36 years in the restaurant business, that he really hit his stride. Mill Creek Pub has allowed him the opportunity to explore his gift of community building. The pub’s mission is to connect the community with food made from the heart. The recognition he receives serves to fuel his passion 12  │  wahospitality.org

to do more. The restaurant business provides for his family; the community building provides for his soul. Quick Service Representative: Brian Moreno Small business owners in Othello, Washington, the Moreno family has been in the McDonald's brand for 26 years. Brian’s passion for government affairs comes from working with multiple stakeholder groups to pursue positive policy solutions. He has been a board member since 2013, when he joined the then Washington Restaurant Association Board. His work with Hospitality has included serving on the Board of Directors, the Member Services Corporation (MSC) sub-committee, the Government Affairs Committee, the Editorial Committee, and the Education Foundation Board. Brian also serves the LatinX community as chair of the Washington State Commission on Hispanic Affairs. Hotel Representative: Ron Oh, CHA Ronald H. Oh is the general manager of the Holiday Inn Express Hotel & Suites North Seattle – Shoreline. He has been in the hospitality industry and actively involved in the local community for 22 years. He has been a board member since 2014, when he joined the then Washington Lodging Association Board. He also serves on the MSC Board and the Government Affairs Committee. He is currently the president of the Washington Korean American Hotel Association, and he serves on the Board of Directors for Unibank the South Seattle College Technical Advisory Board for their Hospitality Program and on the Envirostars Business Advisory Board. He is a Certified Hotel Administrator through the American Hotel and Lodging Education Institute and a RMEC through InterContinental Hotels Group. Ron holds a B.S. in psychology from the University of Oregon.

For two years in a row, the team has created and produced Hospitality Summits to bring all of the above down to a local level. This year the summits were in Tacoma, Seattle, Bellingham and Bellevue. Next year they will expand again. Hospitality Summits are a new model that combines an innovative small setting with imaginative thinking. The goal is a deeper connection between businesses and local issues. Through panels, breakout sessions and presentations from local leaders and merchants, attendees help define the hospitality space as it evolves on the main streets of their own cities and towns. This year a highlight has been the discussion regarding thirdparty delivery. Leaders from both restaurants and hotels conversed with representatives from leading service providers like Uber Eats. new technologies to provide improved service to their customers. This is exactly what the Association intends with these events. The businesses that attended now have a distinct advantage over their competitors who did not. As the Hospitality Summit brand grows, the number of local events will grow as well. And for now, until the foreseeable future, this is where initiators of fresh hospitality ideas will meet each year to share them. they made a mistake it was so cheap!” Turner said. Shawn Tibbits, owner of Tibbits@ FernHill remarked about the Association credit card processing program recently. Shawn just started using our program, and when asked about it, his response was, "It's going wonderfully. The program is small business-minded and I get my deposits on Saturday morning now which is great!” Many members also list the Retrospective Ratings Program (RETRO) as an example of a program that performs. Immigration and Employment Verification: Know the Rules By Paul Schlienz

Immigration is a hot button topic. It is also one that can expose hospitality employers to great liability if they don’t handle it right. “This is a growing issue under Trump,” said Davis Bae, attorney with Fisher Phillips. “He wants to quadruple the number of immigration enforcement actions against employers. And hospitality is a target industry because of the substantial number of immigrants employed by restaurants and hotels.” The U.S. Citizenship and Immigration Services (UCIS) is responsible for the administration of immigration and naturalization adjudication functions and establishing immigration policies and priorities. While many foreign nationals are legally working in the U.S., businesses and business owners that have actual or constructive knowledge of a worker’s lack of employment authorization or who do not comply with I-9 Employment Eligibility Verification rules could be subject to penalties, fines and even imprisonment. I-9 Forms “The I-9 form has been around since the Immigration and Custom Reform Act in 1986,” said Bae. “What the Act said was if you have employees, it’s your responsibility to check your employees’ work authorization through Form I-9. Fines and threats were there, but no one ever actually paid attention to it until Obama really started kicking in the enforcement as it applied to employers. Now if you talk to people in HR, everyone understands the responsibility, but maybe not how to execute it properly.” The purpose of the I-9 form is to verify and document that each new employee is authorized to work in the U.S. If your I-9 forms are audited and the investigation turns up unauthorized workers on your staff, be on notice that you could very quickly, without warning, lose some of your employees. Follow the proper procedures for completing the I-9 forms for every new employee. Check the documents submitted by an employee carefully for forgery, changes or duplication rather than original issue, and do not accept expired documents. When reviewing the submitted documents, ask yourself: Does the document reasonably appear on its face to be genuine and relate to the person presenting it? You should not specify which documents employees may present as this could be considered discriminatory. If your business is audited and there are errors or omissions on any I-9 forms, it may be subject to fines or other penalties even if the employees whose forms contain the errors or omissions are legally authorized to work in the U.S. “The most common mistakes I see with employers, when it comes to I-9 forms, is that they’re sloppy with I-9 protocol,” said Bae. “They’re not filling out paperwork or they’re filling out the forms sloppily. This potentially creates liability. I highly recommend training for your staff on filling out these forms. Make sure at least two people on your staff know how to fill out I-9s properly. Take storage and retention seriously and treat each I-9 form as a potential $2,000 liability.” And don’t forget that even though the I-9 forms are fairly simple, there are many ways to potentially fill them out wrong and get in trouble. Social Security Numbers After you have hired a new employee, you can verify his or her Social Security Number (SSN) by using the online Social Security Number Verification Service (SSNVS) or Telephone Number Employer Verification service (TNEV) provided by the Social Security Administration (SSA). Information about registering for SSNVS and TNEV is available at the SSA’s website: www.ssa.gov/employer. The Social Security Administration (SSA) will verify that the employee’s SSN matches a name/SSN combination in its database. The SSNVS and TNEV do not provide information about immigration status or work authorization and you may not request a copy of the employee’s Social Security card. Keep in mind that if you choose to use SSNVS or TNEV, you should do so for all new employees who are hired after you put this practice into place; you should not use it selectively. If you do institute this practice and you receive a response from the SSA that the information provided about an employee does not match the information contained in the SSA’s database, you should follow the “no-match” letter process outlined below. No-Matches You may discover that the SSN provided by the


employee does not match a name/SSN combination in the SSA’s records. You may learn of the discrepancy through your use of SSNVS or TNEV. If you do not use those services, you may find out later, upon receipt of a “nomatch” letter from the SSA. There are several reasons why an employee’s SSN could result in a no-match. You should not assume that an employee who triggers a no-match is not authorized to work, nor should you treat a no-match as a reason to immediately terminate, take other adverse action or reverify an employee’s I-9 form. Taking any adverse action against an employee on the assumption that a no-match letter means the employee is not authorized to work could violate federal anti-discrimination laws. Rather, you should review your records and respond to SSA as requested in the no-match letter. You should also inform the employee of the no-match letter, ask the employee to confirm the information reflected in your personnel records, advise the employee to contact the SSA to correct and/or update his or her SSA records, and give the employee a reasonable period to address the no-match letter. Additionally, you should follow the same procedures for all employees who trigger a no-match letter, regardless of citizenship status or national origin. If the employee who triggers a no-match letter does not take corrective action within a reasonable time, you should give him or her a final warning and a specified period by which the no-match must be remedied. If the employee still fails to correct the no-match within the specified time,

termination for insubordination may be warranted. E-Verify The Department of Homeland Security (DHS) offers a web-based verification system, called E-Verify, which confirms employees’ I-9 form and verifies work authorization in a matter of seconds. Although the I-9 form is mandatory, E-Verify is not, unless your business is in a state that mandates use of E-Verify (Washington does not currently require use of E-Verify.) or you are a contractor with a federal contract that contains the FAR E-Verify clause. If you enroll in E-Verify, you must use it for all new hires— you may not use it selectively. If the E-Verify database is unable to immediately confirm a new employee’s work authorization, it will provide steps to guide the employer and employee toward resolution. More information about E-Verify is available on DHS’s website: www.dhs.gov/everify. “E-Verify will be required nationally eventually,” predicts Bae. “If you misuse E-Verify, you can be liable. Keep in mind that a misuse of using E-Verify on existing employees can leave you liable to discrimination lawsuits.” Bae urges hospitality employers to take immigration and employment verification seriously. “The best thing an employer can do is really keep their eye on these issues and to train themselves for compliance and maintain an awareness of what the administration has in store for us.”

Outsource Key Areas to Minimize Risk and Maximize Return By Rick Braa, CHAE

As I look at the structure of our company, I realize I don’t have my arms around all of it. What is the best way to get and keep everything under control? Growing a business is complicated. The crucial decision in business is deciding what NOT to do.

There are many moving parts, and no one is an expert in every area. Owners that start restaurants are predominately operators, eight of ten of whom got their start in the industry at the entry level. They’re wonderful at engaging employees and guests and reacting to and fixing issues. As a business grows, the needs of the business will outpace its founder(s). Staying current in all areas simply isn’t practical and it draws away from what makes a business successful, which is great operations. Entrepreneurs have weaknesses in key areas and need to depend on experts to advise and guide on processes and procedures. If the decision is to hire and staff administrative functions internally, the owner is dependent upon the knowledge and honesty of the people hired. If key people were to quit or not work out, the owner is right back in the same vulnerable spot of hiring for positions that draw away from operations. To stay current and follow best practices, consider outsourcing in the following areas: Human Resources: In 2018 the job market is the tightest it’s been in over a decade and on track to be the tightest ever. While being tight, the employee base is also the most knowledgeable and litigious of any generation in the past. The complexity of the HR function requires more than one person to keep in compliance with all rules and regulations. Having a full-time HR department can be expensive and living without a team while relying on one affordable person is risky. The needs of every company are different. The larger the company, the larger the team needed and vice versa. Information Systems: The liability associated with protecting consumer and company data are real.
