Work On, Not Always In, Your Business Last month I wrote in this column about the importance of taking time to think through your business strategy. Hopefully, you’ve had a chance to do that or are planning to do it, and hopefully you are investing part of your strategic conversation in figuring out how to best use your time and expertise. As you do this, it might help to keep the story about Albert Einstein and his phone number in mind. There are a lot of variations of that story, but the one I’ve heard is that at the end of an interview with a science reporter, the reporter asked Einstein for his phone number in case he needed to ask him follow- up questions. Einstein got up and brought back a phone book, looked up his own number and read it out loud. The stunned reporter asked why the smartest man in the world couldn’t remember his own phone number. “Why should I memorize something I can so easily find in a book,” was Einstein’s famous response. Einstein’s biggest value to our society was staying in the strategic space of math and science, and he wisely chose to not clutter his amazing brain with details easily taken care of by others. If you think of yourself as your business’s most important intellectual asset, as its Einstein, it will be easier to recognize that you are of greatest value when you stay in the strategic space of innovation, efficiency and the success of your workforce. What are the things that you can leave to others or to technology? Do you really need to be doing your own payroll down to the tax calculations, or can you use one of our allied member services to free up your time for larger purposes? Do you really need to be spending hours trying to figure out how the Affordable Care Act (A.K.A. Obamacare) applies to your business, or can you use our consulting network to get quick answers? Your most valuable resource is not always your money, but your time and your leadership. I hope you’ll use this year’s Buyer’s Guide to make good on this idea. Think of it as a phone book of trusted partners who can help you improve your operations and find the time and space you need for big ticket items, like reinventing your business model. Build strong relationships with these partners and tap into their expertise and interest in helping you be more successful. Ask them where they see the market going and get their thoughts on increasing your revenue and reducing your costs. Even better, include a few trusted vendors when you sit down to strategically think about changes you may or may not need to make. And as you have that strategic conversation, be sure to think about where you bring the most value and where your talents are most needed. Efficiency isn’t only about how well you schedule your team or how carefully you monitor your product. It’s about being an effective, forward-looking leader. FDA Will Enforce New Menu Labeling Rules Starting May 5 After two years of delays, on May 5, 2017 U.S. Food and Drug Administration enforcement of the new federal menu labeling rules kicks off. The regulations were adopted as part of the Affordable Care Act in 2010. The FDA released the final regulations in December 2014, but bipartisan pressure in Congress led to two extensions of the enforcement date. Although the menu-labeling regulation is expected to cost restaurants an estimated $315 million, the final rules represent wins for the industry. They were drafted with restaurants’ concerns taken into account, and the federal regulation preempts any state or municipal menu-labeling laws, avoiding a confusing patchwork of local rules. In general, the rules cover restaurants and similar retail food establishments if they operate 20 or more locations under the same name with substantially the same menu items at its locations. If you are subject to the rules, you must clearly and prominently display calories on menus, menu boards and drive-thru displays for standard menu items. On buffet, cafeteria and self-service lines, calorie information must be displayed on signs near the menu items. You may use the term “calories” or “Cal” as a column heading or adjacent to the number of calories for each standard menu item. Other nutrition information, including data on calories from fat, total fat, saturated fat, trans fat, cholesterol, dietary fiber, sodium, sugars, protein and total carbohydrates, must be made available upon request.

Washington State Visitors’ Guide is Finalist for Prestigious Publishing Awards The recently published 2017 Washington State Visitors’ Guide is a finalist for a Maggie Award in the category of best visitor guide with a circulation over 75,000. “Maggies” recognize world-class publishing and are presented each year by the Western Publishing Association to promote the pursuit of excellence among publishing and media professionals. Past winners include publications such as Sunset and Backpacker magazines and Visit Seattle. The Washington Visitors’ Guide is owned by the Washington Hospitality Association and published in partnership with the Washington Tourism Alliance. Sagacity Media, Inc, the award-winning publishers of numerous city magazines such Seattle Met and Portland Monthly, produces the popular guide. It has a circulation of 375,000 and is distributed for free at tourist locations across the West, mailed upon request to prospective travelers, and sent to 65,000 subscribers of Seattle Met and Portland Monthly. The Visitors Guide was first published in 2000 by the Washington Lodging Association, and has been the go-to guide to Washington experiences for visitors and residents alike for 17 years. Innovative Hiring Event Returns to Seattle May 5 Washington Hospitality Association has invented a new kind of hiring event powered by a public-private partnership that connects employers with readyto-work candidates and King County residents with real opportunities in our industry. This is the third hiring event hosted jointly by the Washington Hospitality Association, the DSHS Employment Pipeline and Employment Security Department. It is different from typical job fairs as it removes roadblocks to employment such as lack of transportation, certifications, permits uniform needs, food assistance, and much more. During similar event last year, hospitality employers hired more than 60 individuals went home with a job the day of the event. Top Trends in Hospitality Automation By Lex Nepomuceno

Automation integration into the hospitality industry is an inevitability. Not just because of cost, but because of competition. Why does a potential customer choose to patronize a restaurant or hotel? Sure, cost may be a factor, but there is also cleanliness, safety, ambiance, quality of the product and customer service to name some of the most obvious reasons. It is in these other areas that automation can help the most.

HVAC systems, thermostats and even coffee makers that are connected to the Internet, thereby enhancing customer experiences and optimizing energy efficiency. Companies like DTT (dttusa.com) are emerging players in the loss prevention space for business by tying in video surveillance with point-of-sale systems. Through a combination of technology and human auditors, DTT is able to flag potential employee/customer theft and staff efficiency management. The company uses real-time store data and visual cues to help hotels and restaurants get the most out of their staff and make sure guests are being properly tended to. Mobile integration into hospitality has also seen a steady

Let’s talk first about Interactive Kiosks, which take different forms depending on the venue. In grocery stores, these are the self-checkout lines; in airports, these are the self-check-in terminals. More recently, these are the kiosks being rolled out in quick-serve locations like McDonald’s and in some hotel lobbies. In every instance, the technology helps staff focus on customer relations and heightened user experiences. Case in point: I typically shop at Fred Meyer which has self-checkout systems. I mostly use the regular lines and occasionally use the checkout scanners when I only have one or two items and the other lines are full. Generally speaking, my experiences at Fred Meyer locations are positive, and none of the lines ever get too long. Then I started going to a competing supermarket and the experience was pretty miserable each time. The lines were at least 15 minutes long, and I’ve wondered why. Is it mismanagement? Poor training? It’s actually that this store doesn’t have self-checkout kiosks, which apparently have a cascading effect on checkout efficiency. Regardless, automation made my experience at Fred Meyer positive and my experience elsewhere negative. The next trend has to do with the Internet of Things (IoT), which is most commonly related to the “smart home” revolution. Millions of homes use some form of “smart home” technology, such as smart light bulbs, video monitoring, remote switches and Amazon Echos. Now “smart restaurants” and “smart hotels” are using light bulbs,

uptick since the introduction of smartphones over a decade ago. Customers are able to check into their rooms and purchase to-go items before they even arrive at the business location. This greatly increases efficiencies with order management and customer expectations. I use this myself whenever I go to Panera Bread. Instead of waiting in a line (drive-thru or in-store), I plug in my order using the Panera app on my phone and the order is prepared during my 10-minute drive to Panera Bread. By the time I get there, my order is hot and ready and I just pick it up and take it to my car because I had already paid for everything. Since using this app, my patronage of Panera Bread has increased tenfold.

There are many other automation trends to keep an eye on, such as robotics, marketing automation and SaaS (Software as a Service), but the ones I mention are the ones I am seeing more readily used right now. Don’t turn a blind eye to these developments, typecasting them as only cost-saving measures. By increasing efficiency, they are also improving the guest experience. And these kinds of technology developments in restaurants, hotels, and casinos will eventually become ubiquitous. Don’t wait to find out how these tools can help your business. Local Government Affairs Seattle and Spokane Eyeing Soda Taxes Seattle, and possibly Spokane, could very well join the handful of U.S. cities that tax sweetened drinks and drink syrups as a way to raise revenues. Berkeley, California, has had a one-cent-per-ounce tax since 2015; and in November 2016 voters approved a one-cent-per-ounce tax in Cook County, Illinois, including Chicago; and in San Francisco, Oakland and Albany, California. Also in 2016, Boulder, Colorado, voters approved a two-cent soda tax and the Philadelphia City Council approved a 1.5 cent tax on sugary drinks.

about $76.80 to the price of a five-pound bag of syrup which currently costs about $75. This tax would cost more than the product itself and would have a significant impact on small restaurants.

Seattle Mayor Ed Murray wants to use a soda tax to fund new initiatives to eliminate racial disparities in education. He is calling for a two-cent-per-ounce tax on beverages with added sweeteners with a goal of raising nearly $16 million per year.

The proposal, as outlined by the Mayor’s Office in February, exempts 100-percent fruit juice, in-store prepared coffee beverages, infant formula and medicine, and would not apply to diet beverages.

If approved by the city council, the tax would be levied on all distributors who sell drinks with added sweeteners within city limits. The Seattle tax would also be levied on the syrups restaurants use to make drinks. Because the proposed tax would be on finished ounces, it would add

The Association’s local government affairs team is working on behalf of members in Seattle to educate the city council and Mayor’s Office on the impacts this tax would have on Seattle restaurants. Legislation is expected to come before the council this spring with the goal of passing an ordinance in June. For the most updated information, visit wahospitality.org. Spokane City Council members have also been talking about a soda tax, which they would use to fund an expansion of the city police force. Under discussion is adding a tax of two cents to each finished ounce of sugar-sweetened beverage. There has not yet been a bill submitted to the council, but council members have made public remarks regarding the possibility of the new tax. Seattle’s Secure Scheduling Rulemaking Nearly Finished The Secure Scheduling Ordinance passed by the Seattle city council in September 2016 is set to take effect July 1, 2017. The ordinance requires businesses to provide two weeks advance notice of schedules, premium pay for changes after posting schedules, and extra pay when there are fewer than 10 hours between shifts. It also requires available hours to be offered to existing employees before hiring new employees. A few exceptions are permitted and are outlined in the ordinance and rules. The ordinance applies to retail and food service establishments with 500+ employees worldwide and fullservice restaurants with 500+ employees and 40+ locations worldwide.

In March, the Seattle Restaurant Alliance submitted its feedback on the draft rules. The Office of Labor Standards staff members said rules were to be published by mid-April. Paid Family Leave: Focusing on Olympia On March 22, Seattle Councilmember Lorena Gonzalez presented ideas supporting paid family leave in Seattle and led a discussion on it in the Gender Equity, Safe Communities & New Americans Committee. The government affairs team is closely following the discussion in Seattle, while efforts remained focused on supporting the progress being made in Olympia on a statewide paid family leave policy.

Walla Walla Short Term Rental Legislation Walla Walla has moved their short-term rental (STR) legislation discussion into city council. After several months of working with community members and local business owners, a plan has been submitted that would establish a multitude of guidelines for formerly unregulated rentals. In the proposed legislation, rentals are divided into Type 1 rentals defined as a rental that is the owner’s primary residence and Type 2, which is not the owner’s primary residence. Both rental classes would be required to pay a proposed $150 application fee to become licensed. If passed, both Type 1 and 2 rentals will need to have: • • • •

A local, 24/7-contact if the STR is not owner-occupied. One additional off-street parking space on-site. Property insurance and liability coverage. Verification that lodging taxes have been/are being paid to the state’s Department of Revenue.

The proposal also calls for graduated fines for violations that would be structured to make the STR owner responsible for their tenants' actions. Additionally, Type 2 rentals would have to notify residences around the rental unit that it is being used as a vacation rental. State Government Affairs At the time of this writing in mid-April, negotiations on the two-year biennial budget have begun in earnest. The House (lead by Democrats) and the Senate (lead by Republicans) have passed proposed budgets in their respective houses with few approved amendments. Now each chamber has to approve or amend these budgets in order to move forward. Both plans would put about the same amount of new money into K-12 education in the next two years — about $1.8 billion. But, both of the proposed budgets are very polarized at this time and negotiations will likely be intense. The budget proposal passed by Senate Republicans: • • • •

Imposes a property tax swap, by establishing a statewide levy rate in exchange for local property tax levies that fund basic education. Rejects new collective bargaining agreements and gives flat raises to limit spending to $240 million compared to the $1.7 billion proposed by Gov. Jay Inslee. Includes the existing exemptions for restaurants using flavor-imparting products to cook. Includes a proviso that instructs the Department of Labor and Industries to consider how to include a teen wage in the new minimum wage.

The budget proposal passed by House Democrats: •

Enacts a 7 percent tax on capital gains, affecting individuals and businesses in Washington, and exposing our industry to a new tax resulting from the sale of your business, raising $715 million over two years. Creates a 20 percent hike on B&O tax rates for service and retail sector businesses with gross receipts of more than $250,000. Ends a tax exemption for online sales. Fully funds all $1.7 billion in labor contracts proposed by Gov. Inslee.

Legislators have three weeks to hammer out their differences to arrive at a compromise solution within the 105-day session. If they do not, a special session will be added which can last 30 days. As budget writers come together to find a compromise, the budget remains a fluid document with bills and concepts being added and removed as they try to reach a final proposal.

Progress on Other Fronts Skilled Worker Outreach Senate Bill 5713 has passed both the Senate and the House. Now the bill goes to the governor’s desk to be signed. The Washington Hospitality Association has been in full support of this legislation and most recently testified in its favor on March 21, 2017. This is a great success for our industry and our workforce. This bill creates a grant for skilled worker outreach and training, and several of our Education Foundation programs that help employees advance their careers would be eligible for these grants. Paid Family Leave The Washington Hospitality Association has been leading positive negotiations on this topic with other business associations, labor groups and legislators. Topics of discussion include portability, options for small businesses, wage replacement, employee training credit and more.

Get to Know Your Area Coordinator: A Big Benefit of Association Membership By Paul Schlienz

Restaurateurs and hoteliers across our state know there are many benefits to membership in the Washington Hospitality Association. And one of the biggest benefits of all is access to the Association’s area coordinators. “Who are the area coordinators?” you may ask. Well, area coordinators (or ACs) are the first point of contact with the Association when members have problems or questions. “ACs are the face of the Association,” said Steven Sweeney, the Association’s director of membership. “They're the ones who get the call when members need advice or help. They are what our members see as who represents us.” Each area coordinator is assigned a geographical territory. Currently, our area coordinators are Mallory Campbell (East King County), Tamorro Farrell (Pierce County), Cathy Fox (Seattle neighborhoods), Suleima Guzman (Southeastern Washington), Donna Haskell (Chelan, Douglas and Snohomish counties), Kim Hildahl (Island, Okanogan, San Juan, Skagit and Whatcom counties), Monica Hollar (Downtown Seattle), Shawna Mendenhall (Kitsap and Thurston counties, and Olympic Peninsula), Casaundra Robinson (South King County) and Donna Tikker (Spokane County and Northeastern Washington). Soon there will also be area coordinators for our members in Southwestern Washington. Meanwhile, Anna Lee, our area associate is serving our members in that part of the state, starting in June. “A lot of our members realize this, but not everyone knows of the ACs passion for their work,” said Sweeney. “They love being in the hospitality industry and they take their job personally. It makes them feel good to help members. They love doing it. And they really are all about customer service and being the face of our Association. It's all about service, service, service and hospitality. They're here to help our

members succeed. They want to show them the full value of membership.” Members know the area coordinators are in their corner – and they appreciate it. “I’ve only been a restaurant owner since 2014,” said Mercedes Fulwiler, co-owner of Oak Harbor’s Rustica Café. “My area coordinator, Kim Hildahl, has been a real help to me. If I have a question, that woman always gets back to me, always. And if she doesn't know something, she'll find out. She made me aware of what my benefits are as an Association member. I particularly appreciate the way she set up appointments with the Association’s Advisory Network.” And Fulwiler is not the only member with rave reviews of our area coordinators. “We haven’t been members long,” said Ruth Little, coowner of the Dockside Grill on Sequim Bay. “Our area coordinator, Shawna Mendenhall is just right on top of everything. Before I talked with Shawna, I never knew about the RETRO program. Once we needed to talk with an attorney. Shawna set us up with an attorney through the Advisory Network, which led us in the right direction. She directs us toward great resources and information. She’s awesome.” “Use your area coordinator as a resource,” Fulwiler urges her fellow Association members. “If you have questions, if you've heard rumors or if there's something going on in the Legislature you want to know about, ask them. Even if they don’t immediately know the answer to your question, they’ll get back with you. You’re really getting your membership’s worth with them.”

THE EDUCATION FOUNDATION:

SUPPORTING YOUR CURRENT AND FUTURE WORKFORCE

The Washington Hospitality Association Education Foundation is a 501(c)3 charitable organization dedicated to helping the hospitality industry grow through training and education for current and future employees. It offers a rich array of programs that support the success and safety of Washington’s hospitality employees and businesses. Programs are offered as in-person classes or online. Here are some highlights. Hiring Events This year, the Education Foundation has been co-hosting a new kind of hiring event that connects hospitality employers eager to hire and work-ready candidates looking for position in the industry. Several highly successful events in King and Pierce counties have been powered by a partnership with the Washington Department of Social and Human Services Employment Pipeline and the Employment Security Department. Hospitality Workplace Safety Program In 2014, the Education Foundation launched one of the most comprehensive safety initiatives ever aimed at the hospitality industry in Washington state—the Hospitality Workplace Safety Program. This program was developed by the Education Foundation as a tool for owners, managers and supervisors in the hospitality industry who are responsible for training their employees. The purpose of the program is to help improve employee safety in the workplace with the goal of reducing injuries and decreasing workers’ compensation premiums. The guide is available in English, Spanish and Korean, and in print and online. ServSafe® Manager This advanced food safety certification is a National Restaurant Association training program for foodservice and hospitality personnel. ServSafe® allows foodservice establishments to offer the highest standard of advanced food safety training to their staff. This manager level certification not only keeps customers safe with advanced safety knowledge, it also helps food service establishments comply with the Demonstration of Knowledge (DOK) and Person in Charge (PIC) requirements within the Washington State Food Code. Training is available online or in a classroom setting. 20  │  wahospitality.org

ServSafe® Alcohol (mandatory alcohol server training) EF partnered with the NRA to create a Washington-specific ServSafe® Alcohol program that is approved by the Washington State Liquor and Cannabis Board (WSLCB) and is designed for restaurants and hospitality businesses. This award-winning program can be administered in a classroom setting at a member location by either an EF instructor or an in-house trainer (approval required), or taken online at www.SSAwashington.com. All students who successfully complete the training will receive a Class 12 or Class 13 permit and a nationally-recognized ServSafe® Alcohol certificate. Certifications are valid for five years. ServSafe® Allergens Developed by ServSafe®, the name our industry has trusted for over forty years, this online food allergy program is available to your employees 24/7. Interactive, comprehensive and completed in about 90 minutes, this program is a great starting point for both front and back of the house employees. Topics covered include defining and recognizing food allergies, proper cleaning methods and the dangers of cross-contact. First Aid/CPR/AED Training Employers in Washington are required to have first-aid trained personnel available on all shifts, if the business is not in near proximity to an infirmary, clinic or hospital. The trainers for these classes are actual First Responders with real life experience and certified by the American Heart Association. Completion of the course provides all the necessary certifications to meet state requirements, in a fun and engaging four-hour course. Bloodborne Pathogens Training The objective of this course is to ensure the safety of workers exposed to bloodborne pathogens and fulfill the training requirement of WAC 396-823. This course is for employees that may potentially become exposed to any body fluids, whether it is on a daily basis because of their profession or through applying first aid to another person in need. Incipient Fire Fighting Training The skills required to fight incipient fires, such as using portable fire extinguishers, will be covered in hands-on training by instructors who serve as certified fire personnel. Employees will learn the different characteristics of fire behavior and be trained on appropriate response skills to fight and control fires that are in the beginning or

incipient stage. Employees are also given tools to assess whether or not it is safe to stay and fight or evacuate. Hazardous Communications Training This course is designed to protect employees from hazardous chemicals used or stored in the work setting. It satisfies the current training requirement under WAC 296901-14016 and must be repeated annually or when a new physical or health hazard is introduced into the work area. Participants are able to train on industry- and workplacespecific hazard labels, as well as safety data sheets (MSDS/ SDS). Spill response and pre-incident planning guidelines are also included in the course. Harassment & Discrimination Prevention DVD Do your employees know what is illegal and what is not when it comes to harassment and discrimination? This 15-minute DVD will help employees identify and prevent harassment and discrimination, focusing on four key training areas. Customer Service Training DVD Satisfying your customers and making them want to return is an essential part of your restaurant’s success. Employees may not always have the skills needed to provide exceptional service. Restaurant scenarios will teach employees how to listen to customer needs, handle difficult situations and demonstrate outstanding service. Social Media Training DVD Embarrassing photos or confidential information that could harm your business can quickly become public through social media. Can employers prevent employees from sharing inappropriate photos or sensitive company information? “Being Social Media Smart” teaches employees how to be responsible when representing themselves or their company on social media platforms.

ProStart® is a national, two-year hospitality program that develops culinary techniques and management skills in high school students. Each year, with the help of community-minded industry partners, Washington’s ProStart program reaches more than 1,500 high school students. Students in the program gain practical, employable skills and are empowered to achieve long-term success in a career in the restaurant and foodservice sector. Make a Difference. Get Involved. The success of ProStart depends on restaurant leaders who, as teachers, role models and mentors, play important roles in the lives of ProStart students. What’s New in Regulation? It’s All in the HERO Manual By Paul Schlienz

There are all kinds of reasons to be a member of the Washington Hospitality Association. The HERO Manual is one of the big ones for restaurant owners and operators. The Association has worked long and hard to be the hero of Washington’s hospitality industry. We champion your interests in the political arena and work to be your guide to laws and regulations that can make running a restaurant complex. To this end, we produce the HERO Manual— your Handbook for Excellent Restaurant Operations—and we hope it becomes invaluable to running your business. The HERO Manual contains information, supplies and opportunities to promote, protect and improve your business. And as your business grows, we hope this manual grows with you. The Association wants to maximize your success. We hope the HERO Manual helps you do just that. “The HERO Manual is a valuable resource for restaurant members regardless of what stage their business is in,” said Lex Nepomuceno, the Association’s director of communications and technology. “We work closely with agencies and other government entities to make sure we provide the most concrete information available to our members.”

What’s New in the 2017 HERO Manual? This year we have made extensive updates to the HERO Manual – everything from completely new sections to revisions of old sections to reflect changes in law and agency rulemaking. Additionally, we have undertaken a thorough survey of the entire manual and made typographical, spelling and formatting changes where necessary. Among the new or updated sections in the HERO Manual are the following:


Minimum Wage In November 2016, Washington voters approved Initiative 1433, which institutes these significant changes to the state minimum wage:

Paid Sick Leave Initiative 1433 also mandates that Washington employers provide paid sick leave benefits. Here are the main details of the new law:

Increased to $11 per hour in 2017. Increased to $11.50 per hour in 2018, $12 per hour in 2019 and to $13.50 per hour in 2020. Initiative 1433 reinforces that tips and service charges cannot be counted towards meeting minimum wage requirements. Local minimum wage ordinances that require wages higher than the state wage remain in effect.

Employees will accrue one hour of leave for every 40 hours worked. Employees will be able to carry over up to 40 unused hours of paid sick leave into the following years. Employees will be eligible to use benefits after 90 days of employment. Employers will not be required to cash out unused leave when an employee leaves or is terminated. The paid leave requirement takes effect Jan. 1, 2018. Local paid leave ordinances will remain in effect unless the local government opts to make changes.

Playing Music in Your Business Thanks to our Association’s government affairs team, Washington now has a law that regulates the business practices of music licensing agencies. As of Jan. 1, 2017, music licensing agencies cannot collect licensing fees in Washington unless they: • •

Have a valid Washington UBI number. Register with Washington’s Department of Licensing May 2017  │ 23


and annually file an electronic copy of each performing rights agreement they use for royalty payments. Make available to business operators the most current list of each performing work to which they hold copyright.

The law also establishes a code of conduct for music licensing agencies. Under this code, licensing representatives operating in Washington: • • • • • •

Must identify themselves and disclose that they are agency representatives. Must disclose the purpose of being on your property. May not engage in any coercive conduct or be “substantially disruptive” to your business. May not use obscene or abusive language when communicating with you or your employees. May not use or attempt to use any unfair or deceptive acts or practices in negotiating with you or your representatives. May communicate with you or your representatives during non-business hours by telephone or in person at a location other than your business location only if you authorized them to do so. Must address all communication to your attorney if directed to do so by written notification from that attorney.

If the agency or its representatives violate any of the above, they are subject to a $1,000 fine. The law also calls on agencies to conduct outreach campaigns to educate businesses on their rights and responsibilities regarding copyrighted music.

Food Trucks and Trailers A new law that went into effect June 21, 2016, requires L&I to inspect all food trucks. Previously, food trucks used outside Washington for six months or more were generally exempt from state standards. The new law, SHB 2443, removes the exemption. Service Charges In addition to its increase of the state minimum wage, Initiative 1433 contains an express prohibition on the use of tips and service charges to offset state minimum wage requirements. It also states that service charges are payable to the employee except when service charges are itemized as not being payable to the employee or employees serving the customer. In fact, Washington’s Disclosure Law requires employers who impose a “related to food, beverages, entertainment, or porterage provided to a customer” must disclose, in an itemized receipt and in any menu provided to the customer the percent of the service charge that is payable directly to the employee or employees serving the customer.


This law defines “employees” as “non-managerial, nonsupervisory workers, including but not limited to servers, bussers, banquet attendants, banquet captains, bartenders, barbacks, and porters.” This law defines “service charge” as “a separately designated amount collected by employers from customers that is for services provided by employees, or is described in such a way that customers might reasonably believe that the amounts are for such services.” It includes charges designated as a “service charge,” “gratuity,” “delivery charge,” or “porterage charge.” To help avoid potential claims for breach of contract (express or implied) or unjust enrichment, employers should consider advising employees in writing as to whether and to what extent service charges are paid to employees, and to obtain written acknowledgment regarding the same. Leverage Three Ready Resources for Your Restaurant By Rick Braa, CHAE

I often feel as though I’m the only person in my business that understands it. Where can I turn for advice and help? It’s lonely at the top. Often the owner or CEO of a business has few, if any, people to speak with about his or her business. Family is wonderful, but dragging your business into your family is a guaranteed way to invite unsolicited, often frustrating, advice. So, where should you turn? Here are three underutilized resources at your disposal:

Your vendors are ready to help. Understanding your vendors’ businesses will yield unexpected benefits. They have a vested interest in your success and want you to succeed more than you might expect. Work closely with your vendors in the following ways: 1. Ask how your vendor how they can be successful with your account. For foodservice vendors, the best clients are those who have complete and accurate ordering, large drop sizes, convenient delivery options and trained staff to receive product. This leads to more participation from the vendor, recommendations to others in the community and most important of all, better pricing. 2. Be clear on the pricing of all your different products. Sit down quarterly to review pricing and ask your vendors what they foresee in the market and get their recommendations on you can be proactive around your core products to limit your expenses and maximize your profitability. 3. Plan six months out. Your vendors know what products will be abundant or limited well in advance. The information available from your broad-line food purveyor is beyond your imagination. Typically, only the best run companies take advantage of this type of planning, and as a result they thrive when others are struggling. 4. Review vendor purchases and product volume usage annually. Business owners are usually shocked to know how much of each product they use and how much price varies during the year. Working with your annual volume will allow you to work with your vendor for better sourcing, perhaps directly from the manufacturer or producer. 26  │  wahospitality.org

Your customers are ready to provide insight. Customers pay the bills, and they have ideas as to what they want to see on the menu, the service package and the atmosphere. Pull together a focus group annually and get their input on the quality of your business. Make sure you provide a guide to be completed prior to the meeting and keep the meeting to two hours or less. At a minimum, ask your focus group to talk about: 1. The value your restaurant provides in terms of product quality and service quality. 2. The quality of the atmosphere including facility cleanliness and design. 3. New ideas that entice them to come back more often and to bring their friends. 4. Where they dine when not at your restaurant and why. 5. What makes your restaurant and other restaurants special. 6. How likely they are to refer your business to a friend or colleague and why? Your customers can provide keen insights and are more than willing to participate. Reward them with a gift card substantial enough to bring their friends and/or family in for a special meal.
