WRA experiences the value of a good vendor— meet The Silver Agency By Lex Nepomuceno An often overlooked aspect of a restaurateur’s operation is the important role vendors play in the success of the business. Everything from advertising, to equipment, to software, choosing the right person or company to do business with has tremendous bearing on a company’s well being. Getting food delivered on time impacts customer service, and making sure transactions are PCI compliant helps protect against future liabilities. Finding the right partners is often the determining factor between success and failure. Consequently, the Washington Restaurant Association has enlisted its own vendor to manage advertising sales for this magazine—The Silver Agency in Centralia, Wash. Selling and managing advertisements for a statewide industry trade publication is no small task, so it was important for the Association to partner with an able and experienced advertising firm. The Silver Agency currently manages ads for AWB’s Washington Business Magazine, the Centralia – Chehalis Chamber Directory and the Lewis County Visitors Guide. This partnership with The Silver Agency is integral for the future growth and sustainability of Washington Restaurant Magazine. By working with an agency, WRA staff will be able to focus on the quality and relevance of the content that is delivered to its members and the rest of the industry. Already, letting Silver Agency focus on advertisements and WRA focus on quality content, the June 2011 of the magazine is the largest issue the Association has published to date. It is jam-packed with 32 pages of vendor information and 32 pages of magazine content, for 64 pages total. Moreover, the 2011-2012 Buyer’s Guide includes some of the top companies in the region that serve the restaurant industry. Every company listed is an allied member of the WRA, which means providing first-rate products and services for the industry is a major, if not top, priority. Every business owner spends valuable time wading through offers and product information, but the 2011-2012 Buyer’s Guide aims to serve as a filter for the clutter. Primary Source of Information | News Briefs Colin Powell applauds restaurants at National Restaurant Show Gen. Colin Powell spoke to a rapt, standing-room-only crowd of restaurant professionals as the keynote speaker at the 2011 National Restaurant Show in May. He delivered insights on everything from the “Arab spring” revolutions in the Middle East to the information revolution. He started off his remarks by noting he’s a huge fan of restaurants. “With 13 million people in your industry, you provide jobs that allow people to learn what discipline, hard work, commitment and doing the right thing are they all about. People can go up in those careers or take those basic principles and move into other fields.” He said he also admired the way restaurants interacted with guests each day: “You provide an indispensable service to the American people. You are serving your fellow citizens in a way nobody else can.” For the rest of the story, go to http:// wra.cc/wra0611e WRA part of new liquor privatization initiative The WRA has teamed up with a coalition including Costco and the Northwest Grocery Association in filing a ballot initiative that will privatize the distribution and sale of liquor in Washington state and provide hundreds of millions of dollars in additional revenues to state and local governments. “By allowing competition in the distribution and sale of any product, including liquor, you bring about efficiencies, better product availability and more choices for customers,” said Anthony Anton, president and CEO of the Washington Restaurant Association. “We think this initiative improves upon previous liquor privatization proposals, and we are confident that we have developed a measure that most voters will support.” Now that the initiative has been filed, it must go through the state process to establish an official ballot title before petitions can be printed. Supporters say they expect signature gathering to begin in roughly a month, and they are confident the initiative will qualify for submission to the voters on the November state ballot. http://wra.cc/wra0611a Speaking out on Seattle paid sick leave proposal If you’re running a restaurant anywhere in the Seattle area, you’ve no doubt heard about a proposal to require that you provide paid sick leave to your employees. While no formal ordinance has been drawn up, the City Council is examining the idea, which surfaced last month from the Economic Opportunity Institute (EOI). The bad news is that it’s an alarming proposal. The good news is that the WRA has been aware of it since it emerged, and we’ve been interacting with City Council members and media outlets to explain why this proposal would be detrimental to the city’s business community and its ability to maintain and create new jobs. WRA deployed an action alert in May, asking our Seattle members to call their City Council member regarding this proposal. So far, more than 100 Seattle restaurant operators have responded to the alert by asking city leaders to reject the EOI proposal. Puyallup ProStart team at the state’s Boyd Coffee ProStart Invitational Puyallup ProStart team honored at national competition Puyallup High School ProStart students Taylor Thompson, Amanda Bradeen, Casey Halifax, Rachel Shaffer and Nick Fox grabbed fifth place in the culinary competition at the National ProStart Invitational in Overland Park, KS. The Puyallup team, which took first place earlier this spring in the state’s Boyd Coffee ProStart Invitational in Spokane, competed against 315 students in teams from 38 other states Guam and Puerto Rico. Overall, $1.1 million in scholarships was awarded to the five winning teams in each category. Additionally, several culinary schools and colleges offered scholarships to the top three teams in each category. For more details, go to http://wra.cc/wra0611d. Attorney General talks openly with Seattle restaurateurs Washington State Attorney General Rob McKenna lent his ear and offered advice to the Seattle Restaurant Alliance at the groups may meeting, recalling his own teenage restaurant employment, weighing in on the city’s proposal for mandatory paid sick leave and offering his assessment of the special session of the state Legislature. “The state Restaurant Association does a fine job, and you’ve certainly got your work cut out for you in Olympia, not to mention in Seattle now with this new proposal for mandatory paid sick leave,” McKenna told the group. Recently I was visiting with one of our restaurant members, and when I asked her how business was, she told me an interesting story. Turns out, this operator had been struggling. Cash flow was a problem, and her outlook was pretty bleak. During that time, one of her suppliers made an observation that she now says saved her business. The supplier noted that her menu was way underpriced for the market where she operates. The supplier adamantly encouraged her to check out her competitors and take a hard look at prices. This gave her the courage she needed to explore the prices her peers were charging and adjust her own prices accordingly. In the first quarter since she made the modifications to her menu, her numbers have improved dramatically and she’s back on track.

Her story reminded me of one of my articles from my first year as CEO of the WRA that I still get comments on today. Thank you for allowing me to rerun a portion of the article and remind you of a key tool for success in our business.

Though he would certainly never admit it (Greek pride and all), you could tell my dad had enormous respect for these people. He was loyal to them and, as long as they remained loyal to him with great service, he would never leave them. Representatives like “Melody,” “Jim” and “Rick” were as important to my dad and uncle’s success as a great recipe, a phenomenal cook or an engaging bartender.

At the WRA we call our supplier members “allied members.” Why? Because they are our allies in helping you succeed, as they helped my dad and our family’s restaurants succeed for more than 40 years. Growing up, I would often get to listen to my dad fume about his love/hate relationship with suppliers. Often, he would gripe about the mentality of bad suppliers: rotten produce and late deliveries. But it was the “it’s not my problem” mentality would send him through the roof. His frustration centered around the lack of understanding from certain sales people that his success equaled their success. If his operation ran smoothly, his prices were competitive and his food quality was high, then customers would return in greater numbers, which would equal greater sales for the supplier. Every so often, my dad would run across someone who “got it.” Suppliers who checked in to ensure orders were accurate and of high quality. Suppliers who took personal responsibility for mispicks, poor product or other mistakes that inevitably happen. Suppliers who reacted quickly to fix these types of issues so there was minimal impact to the

These types of suppliers were one of the key reasons my family was successful in the industry for so long. These responsible suppliers would leave family events on Saturday to run last-minute product to the restaurant for weekend catering jobs. They would come to the bar or spend an hour on the phone on a Friday night to fix the pre-checker. They would voluntarily suggest more affordable products to my uncle, even though it would lower their order. They would drive to their warehouse to pick up new glassware, on two hours notice, when a busser tipped over a stack of wine glasses needed for a party that night.

At the WRA we call our supplier members “allied members.” They are our allies in helping you succeed. And why wouldn’t they be? Suppliers have a ground-level view of the industry. They know what the restaurant next door to you is doing, what they’re ordering every week and how customers are receiving it. Because of their constant interaction with restaurants, suppliers are uniquely equipped help you gain a comprehensive view of the industry in your own backyard. Don’t ignore that resource—it could save your neck someday. As this culture grows, the WRA is altering our strategy to better engage quality suppliers in its quest to make you more successful. In the meantime, continue to be loyal to those suppliers who truly are partners in your success, and don’t forget to thank them for all that they do. Our grassroots network is made up of members representing all aspects of the industry. Government Affairs Team Bruce Beckett Government Affairs Director Bruce Beckett joined the WRA in January 2009 as director of government affairs. Bruce’s experience in public affairs spans nearly 30 years, including 17 years leading Weyerhaeuser Company’s Western Region and Legislature public affairs teams. Bruce is accountable for the overall leadership of the government affairs team, provides strategic direction to the lobby team, and ensures WRA members are fully informed and engaged in the development of WRA positions and strategies. Josh McDonald Local Government Affairs Josh McDonald joined the WRA government affairs team in September of 2007. Before joining the WRA, Josh worked alongside our contract lobbyists Denny Eliason and Kim Clauson-Hoff, building relationships that help make him a strong asset to the WRA. Josh focuses the bulk of his attention working on behalf of WRA members on local government issues, engaging with city and county leaders to make sure restaurants in every community are represented when a new ordinance

or resolution is introduced that may impact our industry. Josh also works on a handful of issues at the state level such as nutrition/obesity, food safety and the environment. He received his B.A. in political science from the University of Puget Sound. Julia Clark Government Affairs Manager Prior to coming to the WRA in 2006, Julia studied state and local politics at Western Washington University in Bellingham, Wash. Julia received her B.A. in political science and social studies from Western Washington University. This past session, Julia made the transition to full-time lobbyist and already has enjoyed quite a bit of success in defending restaurants from harmful legislation and promoting the passage of bills that benefit WRA members. Lobby Team

For the WRA, Denny works with the government affairs team to coordinate overall strategy and directly oversees issues relating to taxes, syrup tax, the Retrospective Rating program, health care, minimum wage and tips as wages. Kim Clauson-Hoff Kim ClausonHoff is a partner with Denny Eliason at Alliances Northwest. Kim’s primary focus is workplace and labor issues. Kim has taken a leadership role on workplace safety, labor, unemployment insurance, workers’ compensation and sustainability issues for the WRA. Over the years, Kim’s efforts have resulted in lower unemployment insurance taxes, restraints on workers’ compensation costs and positioning restaurants favorably on emerging sustainability issues.

Denny Eliason Denny Eliason is the founder of Alliances Northwest, a businessoriented government relations firm. Denny has 25 years experience working the halls of the Capitol, and during that time has engaged

WRA iPhone app As the first restaurant association in the U.S. to launch an iPhone app, the WRA has taken advantage of one of the best ways to communicate with members - through their smartphones. With more than 85 percent of mobile users expected to access the Internet in 2011, it was vital for the WRA to be cognizant of these trends and the tools members are using. Plans are underway to scale out the WRA’s application to other mobile devices, such as Android. However, with 100 million iPhones sold through March 2011 and a nearly 500,000 apps available, Apple continues to lead the way in user adoption and ease-of-use.

As with many programs a key component of the learning experience is the connection between the student and those who are already working in the field. ProStart is an advocate of this philosophy and has incorporated a mentor program and an intern element of the curriculum. Our mentors have made a significant impacts on lives and their business have thrived as a result. What is a mentor? Mentors come from a variety of backgrounds, time commitment levels and businesses. Typically mentors break down into two different categories, culinary and management, just like our ProStart program. Expertise can range from marketing and business skills to culinary techniques and menu engineering. Mentorship takes form in a variety ways as well. “Economic Realities” test determines worker status in Washington

Here Diana discusses the appropriate test, as determined by a recent Washington state appellate court decision, to decide whether a worker is an independent contractor or an employee.

HISTORY: In 2004, three FedEx drivers filed a class-action suit against the company on behalf of themselves and approximately 300 other drivers for payment of overtime wages (under the Washington Minimum Wage Act (“MWA”)) and reimbursement of uniform expenses (under the Washington Industrial Welfare Act). Although the drivers had signed contracts with FedEx stating they were “independent contractors,” their complaint alleged that they were actually “employees.” The trial court certified the case as a class action and split it into two phases (liability and damages). On the liability issues, the jury decided that the drivers were independent contractors, effectively ending the case. The drivers appealed and Division I of the Washington Court of Appeals reversed, finding that the trial court had incorrectly instructed the jurors to decide based on FedEx’s “control” or “right to control” the manner in which the drivers performed their work.

Whether the service rendered by the worker is an integral part of the alleged employer’s business. In reaching this conclusion, the court noted that the MWA is patterned after the FLSA. The court also noted that the Washington State Department of Labor and Industries uses six similar, but not identical, factors when determining whether a worker is an employee or an independent contractor. The court of appeals also confirmed that the belief of the parties as to whether a worker is an independent contractor or employee is not a relevant factor to be considered.

THE UPSHOT:

It is critical that Washington businesses properly classify OVERVIEW OF THE DECISION: workers as employees or In reversing the trial court, the court of appeals stated that independent contractors. the proper standard in Washington for determining whether a worker is an independent contractor or an employee is the “economic realities” standard. It is the same standard used by most federal courts for the purposes of determining employee status under the federal Fair Labor Standards Act (“FLSA”). The “economic realities” test includes six factors: 1. Permanence of the working relationship between the parties 2. Degree of skill the work entails

If a worker is mistakenly classified as an independent contractor when she does not meet the test, the business can face significant liability down the road, including in the areas of employee benefits, wage/hour violations and tax issues. With the recent FedEx decision, Washington businesses now have more clarity on what factors to examine in deciding whether a worker is properly an employee or independent contractor.

Are you prepared for an I-9 audit? By Douglas Rector, contributing writer

Are you compliant in having your I-9s in order? Whenever you hire an employee, you must fill out an I-9 verifying the identity and employment eligibility of your employees. The original I-9 is to be kept on file for all employees. In the case of former employees, these must be kept on file for at least three years from the date of hire or from one year after the employee is no longer employed, whichever is longer. The Obama administration has pledged to uphold federal immigration laws by targeting and investigating employers who employ illegal immigrants. This includes a comprehensive review of Forms I-9, which all employers are required to complete and retain for each employee. U.S. Immigration and Customs Enforcement (ICE) sent out thousands of Notice of Inspections (NOI) to companies throughout the U.S. Small business owners also are vulnerable. If you receive an NOI, you have three days to submit your I-9s for inspection. So far ICE has assessed $5.3 million in penalties (2010), up from $1,033,291 in 2009 and $675,000 in 2009. The number of criminal arrests is also on the rise. The agency is holding employers accountable for their hiring practices and efforts to ensure a legal workforce.

So, how does a typical audit work? You will be served with an NOI. The inspection may be at your location, or you may be required to go the nearest ICE office. The following will be requested:

I-9s for all current and terminated employees for the previous 12 months

Employee roster or payroll report for all persons

employed for the previous 12 months Monthly payroll reports with wage detail for the previous 12 months Four most recent unemployment quarterly tax reports and wage detail reports Copies of the four most recent quarterly tax statements Independent contractor roster, listing dates of hire and termination Copies of 1099s filed for the previous year Copy of articles of incorporation, business license and most recent annual report Employer Identification Number Names of temporary staffing agencies used in the past 12 months Fines for not producing an I-9 can range from $110 to $1,100 per violation. Monetary fines for knowingly hiring and continuing to employ range from $375 to $16,000 per violation. A well-known sub sandwich franchise was fined $111,000 (reduced to $27,000) for not properly filling out I-9s or for not having I-9s filled out at all. Are you in compliance? It is a good idea to conduct an I-9 review and get set up with electronic I-9s to schedule alerts for managing work authorization expirations. Q: I’m convinced our restaurant has good food and

good service. I don’t understand why our restaurant isn’t busier. What can be done to grow our business?

A:

To begin, document how much time you’re spending working ON your business and how much time you are working IN your business. When one works IN their business too much he/she has a job not a business. Business owners are often caught in a trap of doing the wrong work. To be successful, the owner of the restaurant must lead. If no one is leading, the restaurant is doomed to slow growth, if any, and a higher level of failure. Leaders set direction, spur action, coach, monitor results and reward performance. 1. Set direction with an honest assessment of the strengths, weaknesses, opportunities and threats (SWOT) of your business. Look at strengths and weaknesses as internal issues such as great food or poor facilities. Opportunities and threats are external factors such as a great location or heavy construction in the area. Be brutally honest with your assessment, look at your restaurant with fresh eyes and be intensely critical. The only way to improve is to evaluate your business by exploiting strengths and opportunities and minimizing weaknesses and threats. 2. Once your SWOT is complete, decide which critical actions will lead to the biggest change over the next 12 months. Pick a “critical few” of the most important action items and several less-important items, and document them with deadlines for when they will be complete alongside the expected impact/return they will have on the business. For example, a new menu is necessary if an honest evaluation shows your food is good but not “blow the doors off” great, and ticket times take too long out of the kitchen. Implementing a new menu will take a few months of development, testing and training. Write a goal with the action steps needed to complete the task, the dates on which they will be complete, who is going to complete the work and any required additional resources. 30 | www.WRAhome.com

Once you have compiled the list of action plans that are necessary to drive your restaurant forward, communicate the goals with each and every person in the restaurant. Get staff buy-in, build excitement and start implementing your action plans. When everyone is on the same page, it will build energy and do wonders for morale. 3. Once your action plans are set in motion, coach every step of the way. Stay involved and help your staff overcome obstacles. Provide the resources necessary to accomplish the goals and develop a staff of problem solvers. Your goal as a coach is to establish trust, build confidence and unleash potential. One of my favorite quotes is from one of the most successful operators in the business, “My job is to make you the best manager you can be—not make you feel good all the time.” Alongside your daily coaching, monitor progress and performance. Make sure all deadlines are met or new ones are negotiated. This is an area that will determine the success of the business. Assess whether your business is full of reasons, stories and excuses or pig-headed discipline and determination. Your business can improve greatly by holding people accountable to results. 4. Lastly, reward those who deliver on their commitments. Not every reward includes money. Sometimes a simple “thank you” may be all the reward someone needs. Great businesses have leaders that work ON their business. The more work ON your business, the busier your restaurant.
