D

ear Members, As one of the most uniquely challenging and tumultuous years in our lives comes to a close, I would like to thank all of you for your continued membership and support of the Apartment Association of Orange County (AAOC). It has been an honor to serve as your president this year, as I have witnessed and been inspired by the resilience demonstrated by the AAOC membership. Despite the adversity that we have encountered both individually and as an industry, we have remained strong and resolved to get through this difficult season, pivoting, adapting and continuing moving forward, albeit differently and out of our comfort zones. The same holds true for

AAOC and how it has risen to its challenges as an association and service provider. In this most unique and challenging of years, having the opportunity to serve as AAOC president through this experience has been a gift. What has also been a gift is the support that AAOC received this year from its Product & Service Council (PSC) members who, while facing their own COVID-related business challenges, stepped up in a big way and continued to invest in the association. When inperson meetings and events stopped after February, AAOC had to quickly transition as many member programs online as possible. This transition was made easier thanks to so many PSC members remaining at AAOC’s side,

willing to make their own transitions, from “in-person” event sponsor to “online” webinar sponsor. Again, an example of how we have all pivoted, adapted, and continued to move forward. To the PSC members who have continued to support AAOC through this most difficult and challenging year, I would like to gift the balance of my President’s Message to them, as a thank you and recognition of their generosity. And to the entire AAOC membership, I want to wish you a happy and healthy holiday season, and let you know how grateful I am to be able to continue serving as your president in the coming year. Year End Reflection and Gratitude

I

n a year that has been filled with challenges, frustrations, and uncertainty due to the coronavirus pandemic, there is much for which I remain grateful. For my final Executive Director’s Message of 2020, I thought I would share a few of those things, with the hope that it might inspire you to do the same.

AAOC Pivoting from In-Person to Online

AAOC successfully pivoting almost all member services and programming this year from in-person to online delivery is something for which I am extremely grateful. It was no small undertaking. I am grateful to our members who adapted quickly, flexibly, and supportively to conducting business with AAOC via phone, fax, email and web, as well as “attending” meetings and educational programs (some for the first time) via Zoom. To our event sponsors, I am grateful that you stood with AAOC and chose to invest your sponsorship dollars in our online programming when coronavirus health directives made our in-person events infeasible. To the board of directors, I am grateful for the support and confidence that you placed in the association’s professional staff to pivot and make the magic happen, and also for also offering your experience and assistance, as needed, along the way. Defeat of Proposition 21

2021 Trade Show & Conference

California voters in last month’s General Election again rejected the expansion of rent control in our state by an overwhelming margin. As of the writing of this column, 59.8 percent of voters statewide (66 percent in Orange County) opposed Proposition 21, which is a slightly greater margin than the 59.43 percent (65.5 percent in Orange County) who opposed Proposition 10 just two years ago. I am grateful that an even greater percentage of voters in this election recognized that rent control is not the answer to our state’s housing affordability and supply challenges — and voted “No.” I hope our state legislators take note of this latest election outcome and that they consider more equitable and reasonable policy solutions in 2021. Likewise, I hope the rent control advocates and others who support expanded government regulation of the rental-housing industry learn from this second failed effort and do not attempt a third. Yes, hope springs eternal. I am also grateful that the rentalhousing industry and its coalition partners were successful defeating this latest statewide rental control measure, and that so many AAOC members stepped up and collectively contributed close to a half-million dollars to help the “No on Prop 21” campaign. Finally, I am grateful that AAOC is moving forward with its plans to present its 50th Annual Trade Show & Conference on Thursday, March 4, 2021 at the OC Fair & Event Center. We are anticipating that COVID-19 health guidelines will continue to change and that the show may not be able to be presented inside the exhibition hall come March. That is why staff is actively exploring ways to present it as an outdoor event that facilitates safer physical distancing without compromising quality, in-person interaction. Barring a worsening of conditions and more restrictive protective health measures being implemented, AAOC has every intention of presenting the show — perhaps a little differently than that to which you are accustomed — but still focused on showcasing the latest and greatest products and services, the best service providers in the multifamily industry, and dynamic seminars aimed at keeping you informed and educated on the issues of the day. Impact and Results of Key Real Estate Related Ballot Measures

C

alifornia voters saw more measures than usual on the 2020 General Election ballot, affecting commercial, industrial and residential real estate. The ballot, this year, proved that a fight against a progressive agenda remains relevant and special interest groups have no intent on relenting the push for more and higher taxes or further restrictions on the residents of California. An intent that should motivate the residential rental industry to oppose a government stronghold. The three major real estate related ballot measures in 2020 were Propositions 15, 19, and 21. Voters rejected Propositions 15 and 21 and approved Proposition 19. Proposition 15 was put on the ballot by petition signatures and would have taxed properties based on the current market value, instead of the property’s purchase price; and as of November 14, 2020, 52% of the vote (8,553,731 votes) were against passing this initiative.1 It was not marketed as a massive tax increase by proponents. It was pushed by the sponsors as “Schools and Communities First.” It was claimed as… “Thousands of progressives and leaders across California and the country have said it’s time to close corporate tax loopholes so we can invest in what we all value: strong schools and healthy communities.” It was a strategic approach to put

this measure on the ballot due to the political climate in 2020 in that the supporters knew there would be more voter turnout than in the primary election that would favor a change to Proposition 13, but what the supporters failed to realize is that voters are also business owners with commercial properties who are struggling to even meet their personal financial goals based on the economic climate. Supporters spent $10 million educating voters because it projected a revenue exceeding $10 billion (a number that does not sit well with commercial property owners — especially because the market value rate continues to increase in California). This measure ought to be a learning lesson to voters in the state of California because the language of this proposition was masterfully crafted by a myriad of experts to test words and phrases. The supporters of this measure went the extra mile to practice psychological word play on the voters to determine how it will more easily bait voters in subsequent elections with contentions of being good for school and teachers. The saving grace for commercial property owners, this year, has been the impact of COVID-19 on the citizens of California to maintain a sense of financial stability and ability to meet obligations. However, head the warning that a similar measure will undoubtedly be on the ballot again in the near future,

based on the shear amount of financial backing of this issue, especially by teachers and their union. Proposition 19 was put on the ballot by the Legislature and generally allows homeowners who are 55 years of age, disabled, or wildfire/disaster victims to transfer a primary residence’s tax based to replacement residents and it changes taxation of family-property transfers; and as of November 14, 2020, 51.1% of the vote (8,217,377 votes) were in favor of passing this initiative.2 If property is inherited by an heir through estate but the property is not used as the heir’s domicile (primary residence) then the property taxes will be based on the fair market value of the property at the time of transfer. This was the legislature’s last-ditch effort during the 2020–2021 legislative session to amend a bill, which seeks to modify Proposition 13’s right of inheritance. The money raised as a result of the change in state law is alleged to partially assist the government in maintaining wildfire management and control. The California Association of REALTORS® sponsored the measure and spent over $40 million to ultimately assure passage. Proposition 21 was put on the ballot by petition signatures (led by Michael Weinstein) and would have permitted local governments to establish rental control on residential properties over 15 years old. Proposition 21 was a third

attempt by California tenant’s rights’ groups and California’s government in two years to establish statewide rent control. The first attempt made to establish rent control laws was through Proposition 10, which was also put on the ballot by petition signatures in the November 2018 General Election. Its purpose was to repeal state law that restricted the scope of rent control policies that cities and other local jurisdictions may impose on residential property. Proposition 10 was defeated with 59.43% of the vote (7,251,443 votes).3 The second attempt made to establish rent control succeeded during the 2019-2020 Legislative Session through the legislature and finally with Governor Newsom’s signature with the passing of AB 1482, which is defined in Civil Code section 1947.12. AB 1482 provides that residential real property in California shall not increase the rental rate for that property in an amount that is greater than 5% more than the lowest rental rate in effect for the preceding 12 months, plus the percentage change in the cost of living — and shall not exceed 10% rate increase within any 12 month period. These restrictions, however, are subject to exceptions and one such exception is the prohibition of Section 1947.12 on residential rental units over 15 years old. The third attempt made to further rent control restrictions through Proposition 21 defined an intent to “plug” a

“hole” left in the language of AB 1482 as it pertains to residential rental units over 15 years old; it sought to end vacancy decontrol, which is extremely important in residential rental housing; and the language of the measure imposed severe caps and permits market rate rental rates, while remaining empathetic to the low-income tenant, which does not raise rent. As of November 14, 2020, 59.8% of the vote (9,710,653 votes)4 were against passing this initiative. If the real estate industry could co-opt the narrative regarding the impact of restrictive rental housing issues, it could have a major impact on future proposals. It is also worth noting that the City and County of San Francisco voters were the only electoral to approve the ballot measure. At this juncture, the tenant groups are making the loudest noise — but we all know what is meant by the old adage, “the squeaky wheel gets the grease,” meaning if the industry does not make a better attempt to fight against the tenants, the rental housing industry is likely to collapse based on the inability to pay its mortgages, or a more deleterious prospect could be on the horizon — state run housing. Let’s take, for example, the passing of AB 3088, which forces a landlord to permit a tenant to live effectively rent free during from March 1, 2020 through January 31, 2021, if that tenant was adversely affected by COVID-19 — with some notable exceptions. What would happen if this type of

measure passes sometime in the future? There effectively becomes no more incentive to building residential rental units within the state of California. But if there is no new rental housing being built, then where are Californians supposed to live? If there is such an impact, will the government attempt to pass subsequent measures permitting the government to slowly take control of the housing market? Are the residents of California going to permit the state legislature and the governor to completely ignore the Fifth Amendment of the United States Constitution, which prohibits this act (barring scrutinization of very specific guidelines, which includes “just compensation”)? Based on this measure’s failure — and its back-to-back general election failure with Proposition 10 — there is hope that this issue will not be headed back to the ballot in the near future. However, if the pendulum does not begin to swing the other way to rebalance equality between tenants and landlords, at what point does statewide rent control run amuck. “If you don’t stand for something then you will stand for anything.” Ron Kingston is President of California Strategic Advisors and Legislative Advocate for the Apartment Association of Orange County. ORANGE COUNTY LEGISLATIVE WATCH B y B ill C hristiansen , V ice P resident of G overnment A ffairs

General Election Recap

T

he 2020 General Election brought some significant change to the Orange County political landscape. Upon the Orange County Registrar of Voters certifying the county-wide election results by December 4, our new state legislators will be sworn-in to office in Sacramento on December 7 and Orange County’s 34 cities will seat their new city council members within the first three weeks in December.

Orange County State Legislative Delegation

Orange County welcomes four new members to its state legislative delegation. In the State Senate, former Senator Josh Newman will again represent the 29th Senate District after defeating Senator Ling Ling Chang. You may recall that Newman lost the seat to Chang when he was recalled from office in June 2018 after voting to increase the state gas tax (SB 1). Additionally, UC

Irvine professor Dave Min will now represent the 34th Senate District after defeating Senator John Moorlach. Not surprisingly, shortly after conceding the senate race, Moorlach signaled his intention to run for the soon-to-bevacant Second District County Supervisor seat currently held by Michelle Steel. Supervisor Steel won her election to Congress, representing California’s 48th District, after defeating Congressman Harley Rouda. You may recall that Moorlach served as Second District Supervisor immediately preceding his election to the State Senate. In the State Assembly, former Garden Grove city councilmember, county supervisor and state senator Janet Nguyen won her election against current Garden Grove councilmember Diedre Nguyen to represent the 72nd Assembly District. Nguyen replaces outgoing Assemblyman Tyler Diep. Additionally, Laguna Niguel Mayor Laurie Davies defeated local business owner Scott Rhinehart to represent the 73rd Assembly District. Davies replaces outgoing Assemblyman Bill Brough. AAOC is already making arrangements to meet and forge new relationships (or continue existing ones) with these legislators as we move into the 2021 state legislative session which convenes on January 4, 2021. Members of the State Legislature were frustrated at the end of the 2020 session by the Capitol closures due to the COVID-19 shutdown of the state government. By summer, only COVID-

19 related bills were moving through the legislative process and many were killed due to the fractious infighting of Senate and Assembly Democrat leaders. Pent-up tensions from the 2020 session may very well spill over into the 2021 session, and many unresolved housingrelated bills this year may be reintroduced quickly. Also, there is the looming January 31, 2021 expiration deadline for AB 3088’s eviction moratorium which was enacted as a stopgap measure in the final hours of the 2020 session. We expect the State Legislature to weigh-in on this issue early in January, so keep your eyes open for RED ALERT emails from AAOC, keeping you apprised of any early activity in Sacramento.

Notably, the city of Anaheim will have a solid, prohousing and pro-business majority, while the city of Santa Ana will have a more progressive council majority. The cities of Costa Mesa, Huntington Beach and Irvine are also three rental-property heavy jurisdictions where AAOC will be looking to forge relationships with the contingents of newly elected and primarily first-time city council members. Questions & Answers I understand that my options are still limited when dealing with a non-paying resident, but there must be something that can be done. I can barely make my mortgage payment yet my resident still lives in my rental without paying a dime. What should I be doing now?

As of this writing, second week of November, Governor Newsom’s declaration of a state of emergency is still in place, the controversial CDC Order has not been vacated, and AB 3088 is still restricting our ability to remove nonpaying residents. Essentially, those housing providers with non-paying residents have been involuntarily placed in the role of lenders with non-performing assets. Most courts are now open, albeit with reduced schedules, mandatory video appearances and trials, all fraught with delays and disfunction. Going forward, continue to communicate with your residents, thank the ones that are performing, continue to allow payment plans for those making the effort. For

those residents who are violating the terms of their lease, i.e. by subletting without your consent, maintaining a pet without your consent, have altered or damaged the premises, you do have a remedy. Identify the material breach, prepare and serve a three-day notice to perform conditions or covenants or quit. If the resident has not cured the material default within three business days, then you are able, thank you AB 1482, to prepare and serve a three-day notice to vacate. If the resident has not vacated within three calendar days, then you may file an unlawful detainer action to recover possession. This process is available whether the resident has a month to month tenancy or a fixed term lease. Alternatively, many housing providers may form the intent to ‘withdraw the rental unit from the housing market.’ Not surprising when a resident is in possession, not paying rent, and causing wear and tear to the rental property. Talk with an experienced attorney, one intimately familiar with

AB 1482, AB 3088 and the CDC Order before proceeding down this path. My new tenants just moved in a month and a half ago. The lease requires that the tenant pays for all utilities, and must put the utilities in their own name prior to moving in. Well, I just received the electric bill, and it’s still in my name. I’m thinking about not paying it, just letting it get shut off. Maybe when the lights go out, they’ll take care of it. Can I do that?

No, you can’t let the utilities be shut off. Your tenant’s actions are a breach of the rental agreement and must be addressed in compliance with California law. You should immediately prepare and serve a Notice to Perform or Quit — Breach of Covenant notice. The notice should identify the specific breaches, the failure to place the electric utility in their own name, and their failure to pay the utility charges incurred since taking possession. The notice should be specific as to


how they must cure the breach, namely, they must put the utilities in their name, and reimburse you for the amount of utility changes that have been billed and incurred post tenancy. Note that some jurisdictions may require that you include a statement identifying a witness who observed the breach, as well as the date and time of the breach. In such a jurisdiction, you or your manager would suffice as the witness, and the breach would be considered ‘ongoing’ as it continues to occur. In the event of non-compliance, you would be entitled to file an unlawful detainer action to recover possession of the premises. Rarely though is that necessary, as the vast majority of residents will immediately comply. I can’t seem to keep my apartments maintained. Lately, it seems like they are falling apart. I do the best I can, I fix most stuff myself, and contract out some, but it seems like some of my tenants are sabotaging the apartments. I’ve replaced the smoke detectors in one of my rentals three times in the last year. I know something’s up, what do I do?

It’s more important now than ever before that you establish and follow an operations and maintenance plan when managing and maintaining your rentals. Not only is it just good business sense to maintain your rentals properly, but also the law mandates your prompt response to complaints of serious habitability defects. It is critical to identify tenants who engage in damaging and destructive conduct. Although the code specifically precludes a tenant from benefiting due to his inflicting damage to the apartment, often it is difficult to prove the tenant caused the habitability defect. A good practice to enact is to create a maintenance log of repairs to each unit. Many owners will require a tenant “sign off ” when the repair is completed, other owners photograph the repaired item upon completion as proof of completion.

Several pieces of legislation have been enacted to crack down on the small minority of landlords who fail to properly maintain their buildings. Depending upon the severity of the defect, and providing that it is not tenant caused, a landlord may be cited by one of several governing agencies and given a period of time, ten to thirty-five days to make the repairs. If the repair is not completed as required, there are provisions that would allow the governing agency to make the repair and add the fees and costs of correction as a lien against the property. Additionally, legislation eliminates the tax benefits to the owner during the period of non-compliance, and in extreme circumstances precludes an offending owner from demanding or accepting rent. Now, more than ever before, it is critical that

you document your repairs and identify the residents who are engaged in sabotage or other destructive conduct. I am a very conscientious landlord. I want to ensure that my rentals are well maintained and that any maintenance issues are addressed immediately. Every year, I send a notice to my residents informing them that I will inspect each unit. I have been doing this for years without any problems. This month, I received a letter from one of my tenants telling me that I had no right to enter his apartment to look around and that he would not let me in. What do I do? Can I force my way in to do the inspection?

It is clearly in the best interest of all to ensure that any maintenance issues are promptly addressed, and that a spirit of communication and cooperation exists between a landlord and his residents. Trouble is, your resident is right. There is no specific provision in California law requiring a resident to allow the landlord access to merely “inspect” the premises. California law states that a landlord can enter a rental unit only for certain reasons. Those reasons are in an emergency, when the tenant has moved out or abandoned the premises, to make necessary or agreed repairs, decorations, alterations, or other improvements, to show the unit to prospective purchasers, tenants, or lenders, to provide entry to contractors or worker who are to perform work on the unit, or to conduct a pre-move out inspection at the end of the tenancy, pursuant to court order, or to inspect the smoke detector or inspect the installation of a waterbed. Conspicuously absent from this body of law is the unfettered right of a landlord to just inspect for the pure sake of just making sure everything is all right. You cannot force your tenant to allow access for the purpose of inspection. This article is presented in a general nature to address typical landlord tenant legal issues. Dear Robin:

That is a very good question. The list below should be considered as the minimum needed to be a well-rounded maintenance technician who wants to be excellent at their job. 1. Have problem solving abilities. We believe a good maintenance mechanic needs a bit of “detective” in them. In other words, get to the root of the problem and don’t just fix the issue at hand. Find out what caused the issue in the first place. 2. Care about the details. The details can include anything from noticing something out of place to having the right tools for the job at hand. Detail oriented means having a keen eye on what is going on around you and

3. Technical aptitude or technical abilities. Learn the system you are working on. Become proficient by attending training programs and getting hands-on training on the systems with which you are unfamiliar. 4. Learn organizational skills. Being organized will save time, money and will create efficiency to get more out of each day. 5. Ability to work under pressure. In other words: get in, get out, and get the job done quickly and correctly, the first time. 6. Be versatile. Don’t be scared to try something new. Don’t get bogged down. Learn to think outside the box to find solutions. Not everything is black and white.

Dear Maintenance Men:

We tried to replace an angle stop valve under the kitchen sink but found a brass collar around the copper pipe, which traps the nut behind it. The new angle stop threads are incompatible with the old nut. What can I do? Also, how often should I routinely replace my under-sink water flex lines? Roland

Dear Roland:

On the first question, it is always best to remove the old collar, but that is easier said than done. You cannot pull off the collar with your fingers, it is too tight. Pliers will damage your soft copper pipe. Cutting the line behind the collar is o.k. IF you have enough pipe to spare. In most cases, however, space is limited and cutting the line won’t work. Thankfully, the hardware or plumbing store sells a compression “Sleeve Puller” (around $20) that is designed for this job and will not damage your pipe. You can now install your new angle stop valve. An alternative once you remove the collar is to solder a male or female ½” fitting to the end of the copper pipe. Install a male or female angle stop valve and never again deal with a stubborn brass collar. If you ever need to replace the valve, just twist it off and install a new one. On the second question about replacing under sink water lines, if any of your lines are the white plastic lines, replace them immediately as they are a flood waiting to happen. A way to spot a bad flex line, before they leak or burst, is to look for telltale signs of rust, calcium build-up, loose or broken braids, tight kinks, brown spots or they just look bad. While you are replacing those water lines, be sure to also replace the angle stop valve.

How do I get oil or grease stains out of concrete? I have both a concrete patio and a parking area with grease stains. Soap and water does not get them clean. Brenda

Dear Brenda:

Go to your local grocery store and pick up the cheapest brand of cat litter you can find. Spread the cat litter over the oil-stained concrete and grind it in with

your shoes. Leave the litter in place for a minimum of an hour (24 hours is best) and then sweep up the litter and the stain should be gone. Cat litter is an absorbent that helps draw out the oil or grease. If you have a large area to clean, you may want to go to the hardware store or industrial supply house and purchase 50-pound bags of Absorbent. The cost is a little more than a regular sized bag of cat litter at the supermarket or pet store. We need Maintenance Questions! Family Traditions and Legacies

H

olidays are a time of family gatherings and upholding longheld traditions. However this year, as we all acknowledge, is apt to include a lot of change. On the bright side, perhaps, new traditions will emerge. The same also might be said for your legacy plan. Many of the articles written by Bill Gorman, Tim Gorman and I have addressed the dollars and cents aspects of apartment ownership. We have covered a host of topics related to income property investing, but the bottom line comes down to your personal goals and vision for the future. What is it that you really want your ownership to accomplish? For many apartment owners, they see their rental properties as their legacy. Years ago, they purchased maybe just a rental house or condominium, a duplex or a fourplex. Some have never sold that original property but have continued to purchase more. Others have used the 1031 exchange process to obtain more and larger buildings. Over the years, the cash flow from those properties often helped to pay for college educations, provide a down payment for a son or daughter’s first home, and offer the security of a good retirement income. In many instances, the properties themselves became a second or — as their spouses might claim — a full-time job. But what about now? For Orange County apartment owners, the past year has presented challenge on top of challenge. First there was statewide,

mandated rent control and everyone had to learn new regulations as well as deal with potential income limitations. Then the coronavirus arrived, along with another new layer of complexities. Back in the beginning of the year, Tim Gorman wrote a series of articles on “How to Survive and Thrive with the New Norm.” He imparted a lot of very good, pertinent steps that owners could take to understand and evaluate how well their properties were serving their goals. The only problem is that the “new norm” has continued to change and it is becoming more and more difficult to know what to do. But, as Tim and Bill will both tell you, now is the time to go back to the basics. And the very first step is to evaluate how your properties are performing in fulfilling both your near-term needs and your long-term objectives, which have, undoubtedly, been evolving over the course of your lifetime. If your goals involve your family, particularly in regard to having your children inherit your properties and carry on the tradition of wealth building through real estate, now is also the time to do a check-in with them. As you sit around the table (inperson or virtually) during this holiday season, do some observing and some asking. Just as you have met and adjusted to challenges in owning and operating your apartments, your children have probably faced an equal if not greater number of changes within their own personal and professional lives.

Maybe this is not a bad time to ask about goals and bucket lists. Although no one has the answer as to what the future will bring, especially with all of the disruptions that are happening at the moment, planning a path forward is one way to gain a sense of control over one’s life. The key will be to listen as well as to share your own hopes and aspirations. No decisions need to be made. But what you learn may help guide you in your own evaluation and planning regarding your properties and your legacy. Perhaps your children and their children’s paths are heading in a different direction than your own vision for their future. Maybe taking over your properties is not going to turn out to be the right answer for what they can and even want to accomplish. Now is a great time to do a little thinking and looking into all of the possibilities. Creating a world of possibilities might just be a wonderful way to start a new tradition as well as leave a lasting and meaningful legacy. 2020 AAOC Legislator of the Year Senator Melissa Melendez

T

he Apartment Association of Orange County (AAOC) is pleased to announce Senator Melissa Melendez as AAOC’s Legislator of the Year for 2020. Senator Melendez has been a stalwart champion of the rental-housing industry, previously as a member of the State Assembly and now as a member of the State Senate. In 2019, Melendez gave a strident Assembly Floor speech against rent control bill AB 1482. This year, she was equally vocal on the Senator Floor against the last-minute eviction moratorium bill AB 3088 and the fact that debate was severely limited due to COVID-19. Melissa Melendez was elected to represent California’s 28th Senate District in a May 2020 special election to replace Senator Jeff Stone who resigned to accept a federal appointment to the U.S. Department of Labor. The Senate district is entirely in Riverside County and includes the cities of Blythe, Canyon Lake, Cathedral City, Coachella, Desert Hot Springs, Indian Wells, Indio, Lake Elsinore, La Quinta, Murrieta, Temecula, Palm Desert, Palm Springs, Rancho Mirage, and Wildomar. A number of these cities are part of AAOC’s Riverside County territory, meaning that Melendez is also one of the association’s state legislative representatives. Prior to her election to the Senate, Melendez represented California’s 67th Assembly District from 2012 to 2020, and before that she served on the Lake Elsinore City Council from 2008-2012. She is also a United States Navy veteran.

Melendez served her country for 10 years during the Cold War, and Operations Desert Shield and Desert Storm. After retiring from the Navy, Melissa started her own small business providing transcription services to high-level Pentagon officials. During the 2019 Assembly Floor debate on AB 1482, Melendez was quoted as saying, “The voters said ‘NO’ to rent control last [2018] election. So today the legislature signaled they couldn’t care less about the will of the voters and passed rent control anyway. This is a disincentive for people to build, and what we need is to build.” During the final week of the 2020 State Legislative Session, the Republican Senate Caucus was prohibited from entering the State Capitol due to a positive COVID-19 test of one Republican Senator. Cast from the chamber and told that their input would be limited, the self-quarantined Republicans staged a remote revolt via Zoom. “So, you’re just going to shut Republicans out of debate?” said Melendez. “Not only are you going to kick us out of the chambers for no good reason, but now you’re not going to allow us to debate and speak on behalf of our constituents?” Senator Melendez went on to famously say on Twitter, “Senate Democrats just voted to limit the number of speakers on a bill to only two speakers. This silences the voices of millions of people so Democrats have enough time to pass their crappy bills before midnight. This is outrageous and is Complete Bull***t.”

Melendez is an outspoken leader who stands firmly upon her principles in support of housing, small business, and private property rights. Reverse Trade Show Recap

N

early 10 months since presenting its last “in-person” member event, due to the COVID-19 pandemic, the Apartment Association of Orange County (AAOC) was thrilled to bring 17 property management companies and Product & Service Council (PSC) members together for its Reverse Trade Show on November 11, at Morton’s The Steakhouse in Santa Ana. For many of the attendees, the show

provided them their first face-to-face new business development meetings since the beginning of the year. It was clear by the enthusiasm and energy inside Morton’s outdoor dining tent that everyone was glad to be at the show and interacting with “real people.” That enthusiasm, however, even carried over to the property management company representatives who were unable to physically attend the show but did par-

ticipate remotely via Zoom. Orange County Shows Fire Resilience, but What About Earthquakes?

O

range County can be proud! In October, we saw fire conditions that in other areas could have caused widespread destruction and horror: violent winds gusts of up to 90 miles per hour whipping up flames and embers in Silverado Canyon and the Blue Ridge region of Yorba Linda. Quickly encroaching precariously near suburban tracts, these fires had the potential to take out dozens of homes, if not more. Evacuations were widespread — with 60,000 people advised to pack up their bags and leave their homes. It was terrifying, but Orange County was prepared. Most homes threatened by the fires were built under the state’s most recent fire codes. Public education about the importance of brush clearing was emphasized in neighborhoods, and — as the Los Angeles Times reported —“the largest regional firefighting force

in the world was at the ready and just a phone call away.” This is what resilience looks like. Resilience comes when people do their part to protect themselves, their properties and businesses from disaster. It comes when communities support public safety services and policies. And it comes when buildings are constructed to withstand the natural threats facing them.

Earthquake preparedness

We have all practiced ducking under desks and putting together emergency preparedness kits for our homes, cars and children’s schools — protecting ourselves in case something topples toward us from above, and making sure that we have supplies on hand if we need them. But how many of us have taken our buildings into account during this preparation?

How vulnerable is your apartment to earthquake damage? Is it located within a fault, landslide or liquefaction zone — where the ground reacts like Jell-O to seismic waves — jiggling, undulating and putting the structures built upon it in jeopardy? Active earthquake faults run along the coast and mountain ranges, hitting places such as Huntington Beach and Yorba Linda. And the hillside communities of Laguna Beach, San Clemente and Santiago Canyon are prone to landslides that can be triggered in a major earthquake, potentially undermining the foundation of a home or sliding into one. If your apartment building is the type proven to be vulnerable to earthquake damage, consider having a complimentary property assessment performed by an experienced retrofit engineering and construction company such as Optimum Seismic to determine whether any retrofitting work should be done. California Renters Will Owe $1.7B in Back Rent by Year End: Report Statewide, renters on average owe their landlords just under $7K each

alifornia renters will owe their landlords a total of nearly $1.7 billion by the end of the year. That’s according to a new study by the Federal Reserve Bank of Philadelphia, which estimates 240,000 renter households statewide are behind on rent, with an average debt of $6,953, the Los Angeles Daily News reported. The state’s eviction moratorium runs through Feb. 1. It allows landlords to pursue back rent through small claims court starting in March. Tenants are required to pay at least a quarter of their rent between Sept. 1 and Jan. 31 to qualify for eviction protections. Back rent owed by California renters accounts for more than a quarter of all back rent owed nationwide, which the report concluded will total $7.2 billion by the end of the year. Californians on average owe about $1,500 more than the national average. California’s eviction moratorium is meant as something of a stopgap while state lawmakers draw up a more permanent solution to the question of evictions and foreclosures. There are statewide concerns that a wave of foreclosures and evictions could hit once
