Now, we can expect a number of different iterations in our relationships: we may choose not to marry but opt for a common law arrangement; we may divorce/separate and end up being alone; we may divorce/separate and become single parents; we may divorce/separate and marry another; we may divorce/ separate and marry multiple times more; we may divorce and choose a committed but unmarried (boyfriend/girlfriend only) relationship; we may divorce/separate and never marry again but adopt a child; we may stay married with the person we married but may opt to live apart (the arrangement is called LAT or ‘living apart together’). Something similar can be said for career paths. It used to be that people’s career path, more or less, followed a simple and relatively linear trajectory. We go to school to earn a degree or learn a trade, find employment in a company and work there till we retire happily in old age. Back then, people can proudly proclaim that they have a job for life. A guy started working in a car manufacturing company in his teens and retired after 40 years of working there. A woman taught high school kids for the whole of her adult life till she died of old age. A long-time federal employee eventually went on early retirement at age 55, with a fat pension. Now, there is no more employ-

ment for life. There may be some stable private companies that can offer longterm, secure, regular and full time employment with benefits. The government could also be a constant employer, especially in a unionized environment. Yes, there could still be places of long standing jobs but those are no longer the norms. This is because of the rise of what is called the ‘Gig Economy’. According to WhatIs.com, “A gig economy is an environment in which temporary positions are common and organizations contract with independent workers for short-term engagements.” Linda Nazareth has written this in October 20, 2017 issue of the Globe and Mail: “The transformation to a gig economy is happening at an astonishing speed in Canada. According to staffing company Randstad Canada, if you add up all the contingent workers, freelancers, independent contractors and consultants, you are talking about 20 to 30 per cent of the Canadian workforce being “non-traditional workers” already. That percentage is only going higher. Eighty-five per cent of the companies surveyed by Randstad figure that they will increasingly move to an “agile workforce” over the next few years.” Different terms have been used to describe ‘gig economy employment’: non-traditional, precarious, short-term, contingent, contractual, temporary, parttime, on-call, free-lance and independent arrangement. So what does this trend mean for newcomer job seekers? This is a topic worth exploring in following issues.

When Marriage Turns Sour: Why Violating the Law on Foreign Land Ownership in the Philippines Within Marriage Does Not Pay Off

F

or decades, we have seen an increasing influx of foreigners settling in the Philippines after marrying Filipino citizens. They are enticed to relocate to the Philippines by its relatively low cost of living compared to its wealthier Asian neighbors as well as the friendly and easygoing culture of the Filipinos. Foreigners uproot themselves from their home countries and re-establish their lives in the Philippines. One of the most common ways by which foreigners married to Philippine citizens re-establish their lives in the Philippines is to purchase pieces of land to be used for businesses or for investment purposes. But Philippines remains to have a protectionist policy in terms of property rights and thus strictly prohibits, as a general rule, foreign ownership of land. To be able to acquire land to be used for business, foreigners willingly put the title of the land solely on their Filipino spouse’s name so it can be registered without question with the Register of Deeds of the city or municipality where the property is located. But as they say, there is no marriage made in heaven and when marriage breaks down, the issue of whether the foreigner spouse may compel reimbursement of the value of the real property from his former Filipino spouse on the ground that the true agreement was that the latter would only hold the title in trust for the foreigner spouse? The answer is no. The prohibition against foreigners owning lands in the Philippines is absolute. The only exception is that which is provided in the Constitution or in cases of hereditary succession when the foreigner is a legal heir. Even the law on implied trust does not apply because trust cannot be established in favor of anyone who violated the law. This is the ruling of the Supreme Court of the Philippines in the case of In Re Petition for Separation of Property of Elena Buenaventura Muller v. Helmut Muller, a 2006 case. The consequence is that the Filipino spouse is free to do whatever with the land as

it was validly registered in his or her name. After a marriage breakdown, it is too late now for the foreigner spouse to recover the land or the money that was spent to purchase it. One obvious way to prevent this unfortunate situation for the foreigner spouse is to acquire Philippine citizenship. Foreigners married to Filipino citizens must comply with only the 5-year residence requirement as opposed to the 10-year requirement in other situations. Philippine laws, however, do not recognize dual citizenship for citizens of other countries who desire to become naturalized Filipinos. Foreigners must renounce their original citizenship to acquire Philippine citizenship by naturalization. If the foreigner anticipates a significant amount of land acquisition, a good business move is to form a corporation in the Philippines or a domestic corporation. Foreigners are however restricted to owning only up to 40% of its capital stock while the 60% of must be owned by Filipino citizens and foreigners cannot constitute more than 40% of the members of its board of directors. Under the current legal landscape, Filipino spouses may be considered invincible in this kind of situations. But there is nothing in the law that gives to foreigner spouses any right of action to recover the money they parted or sue their Filipino spouse on other grounds such as torts for civil fraud for example such as misrepresenting to the foreigner spouse that the Filipino is holding legal title only in trust for the foreigner spouse.The foreigner spouse cannot even validly feign ignorance of the law. If you believe that marriage is a union of everything including money, then there is nothing to resent about in case marriage falls apart. But if you don’t, the only practical solution is to keep your eyes wide open before marriage. It is hard enough to plunge into the deep dark abyss that is marriage moreso, if you have decided to live in another country of totally different set of rules.
