Opposition inciting youths - Veep By NOEL IYOMBWA
SOME youths are being used by opposition politicians to discredit Government, VicePresident Inonge Wina has told Parliament. Ms Wina said that since 2016 some politicians had been using youths to discredit the current Government, but that they would not manage to dent the image of the State. She was responding to Livingstone Central MP, Matthews Jere, who alleged that youths were protesting because of corruption in the country. Mr Jere had asked if Government was in order to award a $17 million contract to Honey Bee Pharmacy before it was operational. But Ms Wina said youths were being persuaded to paint Government as a corrupt because they misinformed by some politicians and resorted to sending erroneous posts on social media. The Vive-President said that some youths go as far hiding in the bush just to portray Government as corrupt with statements that could not be verified thereby misleading the nation. She said that Government would not condone corruption. Meanwhile, Ms Wina warned that any restaurants selling alcohol and entertaining a crowd of patrons will be face the law. She said that Government appreciated the frustrations by bar owners association, but that the directive to close their premises was for the interest of the large masses. “Bars owners at the moment should abide by the directive especially this cold weather. For now, they should be patient because it is in the interest of people’s health and restaurants selling alcohol are doing so illegally, “she said. She was responding to a question from Chimwemwe MP Mwila Mutale who wanted to know what sanctions Government would impose on Lusaka City Council for allowing selective bars to be operational.
By PETER SICHALI GOVERNMENT will not offer subsidised maize to millers once current contracts under the tripartite agreement expire due to the availability of the commodity on the local market, the Food Reserve Agency (FRA) has said. FRA public relations coordinator, John Chipandwe said the agency was currently fulfilling contractual obligations entered into when maize was scarce on the local market and has not signed any new contracts. Mr Chipandwe said the 2018/19 agricultural season when the agreements were signed was characterized by low production of maize due to prolonged drought and floods in some areas. Either party especially the Millers are free to source alternative maize from what is available on the market and as such, FRA may not dictate to the business decisions made by individual millers,” Mr Chipandwe said. He said the agency will not continue with the tripartite agreement once the current running contracts expires. Mr Chipandwe said the agency has so far released 274,701 metric tonnes of maize from January 1, 2019 to June 19, 2020 under the tripartite agreement.
Graft in tender awards irks youths By GRACE CHAILE LESOETSA THE rampant corruption in the awarding of tenders has irked youths who told Government on Thursday that the vice is a hindering factor to empowerment. Speaking during an engagement meeting with the Minister of Information and Broadcasting Services Ms Dora Siliya at her office yesterday, the over 20 youths revealed that their companies were not getting tenders because they were unable to pay a bribe. Yamaguyz organisation secretary general, Edgar Kalunga, pleaded with Government to investigate the tender awarding process because those entrusted mostly demand for bribes. “We had applied for a tender to paint in Eastern Province, but we were told to say, if we give you this tender, how much are we going to benefit, this is an issue of tulyemo (a bribe). That is the reason why most youth groups don’t apply because there is an issue of tuleyamo which we cannot afford,” Mr Kalunga said. MAIZE TRIPARTITE DEAL WON’T BE RENEWED
CHISHIMBA Kambwili and two Lusaka lawyers have told the Lusaka High Court that Lusaka Principal Magistrate, David Simusamba cannot hide under the wing of judicial immunity for him not to be sued. This is in a matter where Mr Kambwili, the leader of the defunct National Democratic Party (NDC) together with his lawyers Cheelo Mwiinga and Christopher Mundia have sued Simusamba for defamation of character. Mr Kambwili and his two lawyers have sued Mr Simisamba who they have accused of soliciting over K300,000 bribe from Kambwili in order for him (Simusamba) to enter judgement in his favor. They sued Mr Simusamba also for alleged defamation for allegedly accusing them of attempting to bribe him in order for him to deliver

Your needs are beyond just the Ministry of Youth, Sport and Child Development because you have needs in agriculture, needs in land, in transport and various ministries. This can’t be the end of the engagement, we need to have a roadmap going forward,” she said.
Kambwili, 2 lawyers take on Magistrate Simusamba
judgment in favor of Kambwili Mr Kambwili is facing offences of fraud, uttering of a false document and giving false information to a public officer before Magistrate Simusamba in the Subordinate court, a matter which commenced in 2018. Earlier, Mr Simusamba urged the court to dismiss the case, arguing that he was not the right party to be sued but the Attorney General. He said since he was employed by the government and the alleged crimes were committed during his official duty. because corruption was not one of the functions of a judicial officer. In a joint affidavit in opposition to Simusamba’s affidavit in support of summons for an order to dismiss an action on a point of law and or irregularity, the trio stated that Mr Simusamba has not been sued in the proceedings on issues which arose in his performance of work as an adjudicator or magistrate in the matter between the People Vs Chishimba Kambwili. “It is not true that the defendant has been sued on the issues which arose in a strictly private and confidential correspondence to the honorable Chief Justice of the Republic of Zambia as the

The sad development has incensed the Customs Clearing and Freight Forwarding Agents Association of Zambia. The association’s president, Mr Bruce Kaemba, said about 40 percent of the fuel on the Zambian market was smuggled, resulting into loss in revenue through unpaid taxes and duty. Mr Kaemba warned that the association would not hesitate to withdraw services of clearing at points of entry if the situation was not addressed as it bordered on economic sabotage. He said in an interview that the increase in the number of filling stations in the country had resulted in the upsurge of illegal fuel dealings. “There are unscrupulous fuel importers who are in the habit of de-
canting the commodity in Zambia when on entry they declared that the product was destined for the Democratic Republic of Congo (DRC) as its final consumption country. They end up paying less taxes and deny the state colossal sums of money,” Mr Kaemba explained. He said the perpetrators were evading payment of tax and duty to the government by declaring that the fuel was in transit (RIT) but ended up being offloaded in the country. Mr Kaemba said the unscrupulous fuel importers present their documents to the clearing agent on entry at the border showing that the fuel was for export to the DRC but offload the commodity into Zambia at some filling stations. He said the vice was affecting clearing agents who handle the consignment because ZRA demanded that they account for the details of the transactions they were involved and end up being implicated in the scams. “Some clearing agents have had their licences suspended because they were not able to account for the transaction owing to the fact that the importer decanted the fuel within Zambia without their knowledge,” Mr Kaemba complained.

VARIOUS stakeholders have commended President Edgar Lungu for presiding over a country that has been ranked the 4th peaceful in Africa and 44th globally. Zambia’s favourable rankings are contained in the 14th edition of the Global Peace Index (GPI). The GPI, which is the world’s leading measure of peacefulness for the universe, ranks 163 independent countries and territories around the world as per their levels of peacefulness, and is conducted by the Institute of Economics and Peace (IEP). Among those commended President Lungu are Southern African Centre for the Constructive Resolutions of Disputes SACCORD, Healthy Learners as well as ordinary citizens. SACCORD executive direc-
tor, Boniface Chembe, called on Zambians to jealously guard the peace that the country had continued to enjoy since independence. A senior citizen, James Mando, also observed that Zambians where free people. “We have countries in Africa and in the world where freedoms have been curtailed but in Zambia people are free some even reaching an extent of insulting their own elected leaders including the President on Facebook and other social media sites,” Mr Mando said. Mr Mando however called for the respect and responsible use of social media especially among the youth population. OVERNMENT through the Ministry of Justice is in the process of recovering over US$ 9 million for undelivered dredgers from MCD Civil and Mechanical Engineering. By November 2015, Government had paid the supplier amounts totalling US$9, 240, 370 leaving a balance of US$2, 635, 430 but has to date failed to deliver the dredgers, prompting the State to cancel the deal. Ministry of Communication and Transport Permanent Secretary, Misheck Lungu, said the process of recouping the paid funds had begun and that the Ministry of Justice was han-
dling the matter. Mr Lungu said in an interview that Government was now procuring the dredging equipment directly from a Netherlands-based manufacturer. Mr Lungu said Government has so far procured eight dredgers from Big Machinery and that three had been delivered while five have been manufactured but yet to be delivered. He said the five would be delivered as soon as Government pays for shipment costs. Mr Lungu said the Ministry of Justice was working towards ensuring that funds were recouped from MCD Civil and Mechanical Engineering. According to the Auditor General’s report, the ministry
entered into a contract with Herpworth Supplies and Innovative Materials System JV on October 17, 2014 to supply five dredging machines. The supplier was given a delivery period of four to six months, effective June 1, 2015. Consequently, the ministry paid the supplier US$6, 426, 000 leaving a balance of US$1, 134, 000. The AG’s report, however, points out that a review of records and a physical inspection carried out in the districts revealed that only two dredgers had been delivered while the remaining three had not been delivered as of July 2016. The report also disclosed that the ministry also engaged MCD
Civil and Mechanical Engineering on January 13, 2015 to supply 12 dredging machines at a contract price of US$11, 875, 800.

OVER K2 million has been raised by the State through inspection and escort fees for trucks carrying Mukula logs transiting through Zambia from the Democratic Republic of Congo (DRC). This is according to the Ministry of Lands and Natural Resources Status Report on the Harvest, Trade and Export of Mukula Tree Species for period ending December 2019. According to the report, Government entered into a deal with DRC to transit 3, 400 forty-foot containers laden with Mukula logs for a period of six month effective December 28, 2018. With the smart meters, we will be able to deal with a customer’s response ourselves as Zesco, says Company Managing Director, Victor Mundende. “What we meant is that we will be able to, if we have less power giving to an area, we will be able to switch off other appliances that you have like
geysers without the customer intervention. “From the comfort of our offices, we will be able to deal with certain appliances in order to share the little power that we have,” Mr Mundende said yesterday in Lusaka at a press briefing. UPND DRAMA IT is more than clear that there is a lot of hypocrisy involved in the conduct of some of our political leaders in the manner they want to run the affairs of the nation. It is sad that they prefer to play to the gallery and show that they are true patriots. Yet they are not. They want to take advantage of the gullible few in the country and mislead them, forgetting that they are not helping their cause. The disclosure by Justice Minister Given Lubinda about the events leading to UPND Members of Parliament walking out of the National Assembly makes sad reading. It is sad reading how the Honourable members in the House can immediately they leave parliamentary grounds behave so dishonourably and twist facts. They appear not to have learnt a lesson that the truth will always prevail in the end, as has been proved. According to Mr Lubinda, the House Business Committee convened a meeting on Monday, June 22 and was attended by the two Deputy Speakers, the Vice-President, the Chief Whip Brian Mundubile, leader of the Opposition Jack Mwiimbu, the opposition Whip Dr Situmbeko Musokotwane, Maxaz Bweupe Ngonga (MP), Boyd Hamusonde (MP) and Professor Geoffrey Lungwangwa. At this meeting, Mr Mwiimbu raised a concern about the new environment. “I am informed that he used words close to ‘Why don’t we hive this item (referring to Bill 10) from the Order Paper until there is some semblance of normalcy in the system (referring to the new Parliament environment). “When this was brought to my attention, I inquired among a number of colleagues in Parliament many of whom agreed with the concerns expressed by the leader of the Opposition. Mr Lubinda, after consultations and permission from President Edgar Lungu agreed to the suggestion, believing that the move would allow all MPs to get used to the technology being used. But surprisingly on Wednesday, Members of Parliament from the UPND trooped out of the National Assembly when Bill 10 was being debated with Chipata Central MP Moses Mawere on the floor. Shortly after this drama, Mr Mwiimbu addressed the press at the UPND secretariat claiming that Bill 10 was dead. He claimed that according to parliamentary rules, Bill 10 was supposed to have been concluded in the same session it was introduced, that the continued appearance of the bill on the order paper beyond June 4, 2020 when parliament adjourned was illegal. “Bill 10 lapsed on the 4th of June. It died and was buried on the 4th of June, there is no such Bill anymore. Whatever parliament and the PF through the Ministry of Justice is doing is illegal and we are not going to be part of the illegality,” said Mr Mwiimbu. It is quite obvious that the UPND was just trying to derail Bill 10 as it has been doing all along, especially since the Covid-19 pandemic broke out. It is pleasing though that Mr Lubinda has assured Parliament that Bill 10 will be back in the House soon. We hope Zambians will see how they are being taken for a ride by the UPND and its surrogates. But the nation should be able to tell the party that enough is enough.

Zambian DNA spokesperson, Spuki Mulemwa, yesterday however said that the formation of OCIDA or Third-Force was a scheme orchestrated by President Edgar Lungu’s enemies to scale-up their aggressive agitation for a regime change ahead of 2021. LAWYER Muna Ndulo is a political charlatan hiding behind the veil of the legal profession, Kabwe Central Member of Parliament Tutwa Ngulube has said. Mr Ngulube said Professor Ndulo’s attacks on the Speaker of the National Assembly Dr Patrick Matibini, therefore, were not justified as they were a political weapon to please his political allies. On Wednesday, Dr Matibini said he did not agree with the Constitution at Court that he exceeded his constitutional powers when he declared the Roan Parliamentary seat which was held by Chishimba Kambwili, vacant. Dr. Matibini said he had
powers and jurisdiction to interpret the law and Constitution, as well as to preside over some of the internal matters arising from the proceedings of the House. However, Prof Ndulo described the ruling on the matter as one that could only come from a confused individual, saying his pronouncement projected himself above the Constitution and wondered “what he has fed on that he has grown so arrogant.” But speaking to the Daily Nation yesterday, Mr Ngulube asked Zambians not to take Prof Ndulo seriously because he was just a UPND surrogate who had ill-advised the party to a point of losing all court cases he had an input, including the 2016 presidential
petition in the Constitutional Court. “Professor Ndulo has lost his values in the academic circles and he is trying to gain relevance by becoming political. We want to urge him to just be man enough and join politics because we all know the party he belongs to and we all know that he cannot win any election here in Zambia unless they just give him the seat. “The Speaker’s credentials and qualifications are actually far much higher than those of Muna Ndulo. He has never been a judge or State Counsel and even in the legal profession, he is only known to students and academicians. Let him not attack the Speaker,” Mr Ngulube said. He said Prof Ndulo should

Tukuta granted bail FREELANCE photographer, Chelan Tukuta has been granted bail of K 5, 000 in his own recognizance with two sureties by the Ndola magistrate court. Tukuta who is charged with four counts pleaded not guilty to three counts and the fourth was not plead, because it was triable in the High Court before Ndola magistrate, Misogi Banda. This was after his lawyer Chimera Magubbwi applied for bail. In response Magistrate Banda said all the four counts before him are misdemeanors and therefore bailable. "I should state that all counts including the fourth are misdemeanors are bailable. I must also state that it has become quite fashionable for police to over hold suspects that can be bonded, " said magistrate Banda. Mr Magubbwi earlier told the court that his client was charged on Tuesday and law demanded he be brought to court immediately. He said his client had spent 10 days in police cells for misdemeanors and that was why police needed guidance from court on the need to bond people with such charges. "All the four counts including the pending instruction are bailable offences. My client is of established abode and a family man. He also stands ready to provide traceable sureties. The State Counsel did not object to the application. Magistrate Banda later adjourned the matter to July 10 for mention and July 15 for commence of trial. Facts before the court are that, Tukuta is in the first count charged with publish-

‘Day-light’ thieves emerge By MUYANI SHINJABALE
THIEVES in Ndola have devised a new system of stealing from households in Mitengo during the day by impersonating police officers. An alert has since been raised in Mitengo among residents, who have suffered housebreakins and thefts at an increasing rate since last year. According to information gathered by the Daily Nation, thieves were going to people’s homes pretending to be police officers as well as workers from the water utility company in the area. More than 12 houses had been broken into while water pumps and other valuables had been stolen in a similar manner and resident suspected that it was the same group terrorising innocent people On Tuesday, two men entered a premises in Mitengo during the day, pretending to be police officers on patrol and asked the children on the whereabouts of their parents. Many families have complained of seeing strangers, moving about suspiciously and suspect that it was a mission to spy
on them during the day before they could strike in the night. One resident, who declined to be named, said thieves had been striking during the day if they notice that owners of the house were not around. Chifubu Member of Parliament, Frank Ng’ambi, said he was aware about the rising theft cases in Mitengo and that a police post project would commence. But another family in Mitengo told the Daily Nation that another group of men entered the yard, telling the children that they were police officers and that they had received complaints from the neighbours that they were making too much noise. But when the men sensed that the children were becoming suspicious, they left quickly down the road and joined other stretches so that they could not be seen. The family went to inquire about the issue at Chifubu police station on the same day, but officers denied conducting such activities or patrols during the day. When contacted over the matter, Copperbelt Commissioner of Police Charity Katanga said she had not received any such report at the moment.

GOVERNMENT has made a radical shift in health policies to invest more in disease prevention to save lives as well as costs on curative and care expenses, North-Western Province Permanent Secretary Willies Mangimela has said. He said sound investment in health would lead to a healthy population necessary for the country’s economic prosperity. Mr Mangimela said this in a speech read by his deputy, Douglas Ngimbu, in Solwezi during the launch of the National HIV AIDS Communication Advocacy Strategy (NACAS). “To this effect, the ministry of Health has embarked on a robust universal health coverage program premised on empirical evidence that a health population is a positive game changer for economic growth,” he said. Mr Mangimela said the National HIV/AIDS/STI/TB council has developed a multi-sectoral national HIV and AIDS Strategic Framework (NASF) 2017 to 2021to guide the country on the execution of high impact interventions. He said that the NASF clearly identified key intervention areas and appropriate strategies to achieve intended results of attaining epidemic control and ultimately ending AIDS as a public health threat by 2030. Mr Mangimela that the development of NACAS was purely born out of the realisation of the need to target different sub populations with the most appropriate social and behaviour change communication materials according to needs. And Breakthrough Action Zambia Social and Behaviour Change specialist, Steve Sichone, said the NACAS was designed to engage all stakeholders involved in Zambia’s HIV response. Mr Sichone said the strategy identifies how social and behaviour change communication could be most effectively used to increase HIV related health seeking behaviour through a variety of approaches. Meanwhile, Provincial AIDS Taskforce chairperson Dickson Mtonga urged health promotion officers not to leave out young people and other groups in communities in order to prevent the spread of HIV.

A KAONDE traditional group has given the North-Western Provincial Medical Office a 24-hour ultimatum to pull down a bill board displaying child health week messages written in Bemba and replace it with one written in one of the local languages of the region. Nsakwa Yaba Kaonde demanded that the billboard near Kapiji Mall in Solwezi must be pulled down as it was written in Bemba instead of the local languages spoken in the area. The organization chairperson, Milton Mukwasa, appealed to Government to engage the health office in the province and ensure that the billboard was pulled down immediately. This is contained in a letter to North-western Permanent Secretary, Willies Mangimela, obtained by the Daily Nation in Solwezi yesterday. “We strongly appeal to your office to engage the provincial medical director to urgently pull down the billboard by close of business today 25th June 2020,” he said. Dear Editor, IN Africa, corruption seems to have overshadowed integrity, accountability, fairness, and morality. The persistent failure of most countries to curb corruption, is contributing to a crisis of democracy around the world. Corruption strives well in countries that are battling with political, social, and economic instability. Here are the most corrupt countries in Africa; 1. Somalia (CPI 10): In Somalia, there is a huge gap between the rich and the poor. Bribery and corruption is so rampant in the country, forcing almost everyone to meet up, thus, engaging themselves in bribery and corruption practices. Since 2006, Somalia has consistently ranked last on Transparency International’s list, which indicates that it is the most corrupt country, not only in Africa, but also the world. There is no accountability on what is spent or received from trade in the country, making it even easier for embezzlement to take place.

Don’t discriminate against mental patients

The crux of the matter is that the disabled people have the right to employment just like the able bodied ones. Kudos to Pick n Pay management for the commendable job the institution is doing of empowering the dumb through offering them employment opportunities.
BESIDES people living with HIV/AIDS, the mental patients are discriminated against as they are perceived to be insane or mad. This is wrong because mental illness is a disease like any other. The mental patients deserve to be respected by every member of society. Discrimination against someone on the basis of mental illness is violation of human rights. Zambia is a signatory to the United Nations Charter on Human Rights and as such, there is need for the country to ensure that human rights, including those of the mentally ill be respected. Any form of discrimination against the mental patients should not be condoned discriminating against anyone on the basis of illness is an offence punishable by law. Mental patients are treated at Chainama Hills Hospital. Mental illness is curable once detected early. The disease can be caused by depression, drug and substance abuse among other causes. Let me hasten to mention here that mental patients are human beings who deserve respect and we should not discriminate against them.

3. Sudan (CPI 16): In Sudan, corruption is substantial, as it is considered one of the most corrupt nations in the world. Corruption in Sudan takes the form of financial and political corruption, nepotism, and misuse of power. 4. Libya (CPI 17): After the death of former Libyan leader Muammar Gaddafi, the country has plunged into serious cases of bribery and corruption. Most of the journalists are bribed from reporting the truth, about what’s happening in the country. There was a time, when a newspaper editor was sentenced to 15 years imprisonment, because he published the list of 84 corrupt judges in the country. 5. Burundi (CPI 17): Corruption is on the rise in Burundi and is not finding it easy to fall. In 2015, Transparency International declared Burundi, as the most corrupt country in East Africa. Burundi is also among the top 10 most corrupt countries in the world. 6. Angola (CPI 19): In the past 10 years, Angola has lost over US$5 billion to corruption. A vast majority of government officials engage in the use of fraudulent ways, to collect funds, for their personal use. Furthermore, due to 30 years of civil war, which left the country in destruction, Angola needed a social-economic comeback, which caused the nation to fall into an infrastructural corruption drive. There has been a high level of corruption in Angola, since the early 2000s. 7. Democratic Republic of Congo (CPI 19): In the Democratic Republic of Congo, corruption is described by one word, as it has maintained a strong reputation, as one of the most corrupt countries in the world. Almost every sector suffers from rampant corruption. 8. Chad (CPI 19): In Chad, corruption is systematic and often takes the form of nepotism. It prevails in all sectors of the economy, and is perpetrated by weak laws, and lack of security. Corruption is on the rise at all levels. 9. Zimbabwe (CPI 22): Corruption is said to be on the rise in Zimbabwe, due to the hardship, which the citizens face. Hence, they need to find a way to survive. 10. Mozambique (CPI 23): In Mozambique, corruption is particularly prominent in public sectors, and tax customs administration. Companies planning to operate in Mozambique, face a very high risk of corruption. Although, there is a standing legal framework, to curb corruption, there are still many loopholes, as it doesn’t cover all forms of corruption. “CONCERNED ZAMBIAN.”

(3) If at the initial ballot, a presidential candidate does not receive more than fifty percent of the valid votes cast, the candidate with the highest number of vote cast shall, within fourteen days of the declaration by the Returning Officer of the presidential election results negotiate and form a coalition government with a presidential candidate that participated in the initial ballot, except that the combined votes of that presidential candidate and the preferred presidential candidate forming the coalition government meet the threshold of more than fifty percent of the valid votes cast. (4) Where the candidate with the highest number of votes fails to form a coalition government within the period specified in clause (3), a second ballot shall be held within thirty-seven days of the initial ballot, where the only candidates shall be the presidential candidates who obtained-

(b) an equal number of the valid votes cast in the initial ballot, being the highest votes amongst the presidential candidates that stood for election to the office of President. (5) The Returning Officer shall declare as President-elect (a) the presidential candidate who obtains more than fifty percent of the valid votes cast; (b) in the event of the formation of a coalition, the presidential candidate who obtains the highest number of valid votes cast; and (c) in the case of a second ballot, the presidential candidate who obtained the majority of the valid votes cast in the second ballot. (6) A losing candidate may petition a presidential election in accordance with Article 103. Disqualification for run-off

144. (1) The removal of a judge may be initiated by the Judicial Service Commission or by a complaint made to the Judicial Service Commission, based on the grounds specified in Article 143. (2) The Judicial Service Commission shall, where it decides that a prima facie case has been established against a judge, submit a report to the President. (3) The President shall, within seven days from the date of receiving the report, submitted in accordance with clause (2), suspend the judge from office and appoint a Tribunal. (4) The Tribunal shall consist of a Chairperson and at least two members, who all hold or have held the office of judge. (5) The Tribunal shall, within thirty days of the judge being suspended from office, under clause (3)(a) hear and determine the matter against the judge on the grounds specified in Article 143 (b), (c) or (d); or (b) constitute a medical board, in consultation with the body responsible for regulating health practitioners, to inquire into an allegation based on the ground specified in Article 143(a). (6) Where the Tribunal decides that an allegation based on a ground specified in Article 143(b), (c) or (d) is (a) not substantiated, the Tribunal shall recommend, to the President, the revocation of the judge’s suspension and the President shall immediately revoke the suspension; or (b) substantiated, the Tribunal shall recommend, to the President, the removal of the judge from office and the President shall immediately remove the judge from office. (7) The proceedings under clause (5) (a) shall be held in camera and the judge is entitled to appear, be heard and represented by a legal practitioner or other person chosen by the judge. (8) The medical board, constituted in accordance with clause (5)(b), shall consist of not less than three registered health practitioners. (9) The medical board shall, within thirty days of being constituted, examine the judge and report to the Tribunal on the judge’s capacity to perform the judicial functions.

229. (1) The Auditor-General shall(a) audit the accounts of(i) State organs, State institutions, provincial administration and local authorities; and (ii) institutions financed from public funds; (b) audit the accounts that relate to the stocks, shares and stores of the Government;

Where the Auditor-General is absent from Zambia or is unable to perform the functions of office due to illness or other cause, the President shall appoint a person qualified to perform the functions of the Auditor-General until that appointment is revoked or until the AuditorGeneral returns to office. 231. (1) Subject to this Article, the AuditorGeneral shall hold office for a term of seven years or retire from office on attaining the age of sixty-five years, whichever is earlier.

“adult” means a person who has attained, or is above, the age of eighteen years;

“chief” means a person bestowed as chief and who derives allegiance from birth or descent, in accordance with the customs, traditions, usage or consent of the people in a chiefdom or is recognised as prescribed;
“public body” means the Government, a Ministry or department of the Government, the National Assembly, the Judicature, a local authority, parastatal, Commission or other body appointed by the Government or established by or under, any law, except a private body and “public bodies” shall be construed accordingly;

“devolution” means a form of decentralisation where there is a transfer of rights, functions and powers of an office from the central government or State institution to a province or district authority and the word “devolved” shall be construed accordingly; “pension benefit” includes a pension, gratuity or compensation in respect of a person’s service; “province” means an administrative division of government at provincial or district level; “public office” means an office whose emoluments and expenses are a charge on the Consolidated Fund or other prescribed public fund; “public officer” means a person holding or acting in a public office and includes state officer;

JOHANNESBURG - More than 700 teachers and school staff and 88 pupils have tested positive for Covid-19 in the Western Cape to date according to this week's provisional stats, Education MEC Debbie Schäfer has said. This was according to initial reports this week, she confirmed during a briefing to the National Council of Provinces on Thursday. According to the verified cumulative total released a week ago, 375 staff members and 61 pupils had tested positive, Schäfer's spokesperson, Kerry Mauchline, said. "This includes staff members who tested positive before the reopening of schools on June 1. The majority of schools that have reported cases have only reported one or two cases, so we are not seeing evidence of mass spreading at schools." She explained that districts have until every Friday to verify each and every case for accurate reporting purposes. A report is then compiled, with figures not considered final until after verification. According to the most recent figures released by Health Minister Zweli Mkhize, the Western Cape accounted for 56, 780 – or 48 percent – of the total national infections.

CHICAGO - Scientists are only starting to grasp the vast array of health problems caused by the novel coronavirus, some of which may have lingering effects on patients and health systems for years to come, according to doctors and infectious disease experts. Besides the respiratory issues that leave patients gasping for breath, the virus that causes Covid-19 attacks many organ systems, in some cases causing catastrophic damage. “We thought this was only a respiratory virus. Turns out, it goes after the pancreas. It goes after the heart. It goes after the liver, the brain, the kidney and other organs. We didn’t appreciate that in the beginning,” said Dr. Eric Topol, a cardiologist and director of the Scripps Research Translational Institute in La Jolla, California. In addition to respiratory distress, patients with Covid-19 can experience blood clotting disorders that can lead to strokes, and extreme inflammation that attacks multiple organ systems. The virus can also cause neurological complications that range from headache, dizziness and loss of taste or smell to seizures and confusion. And recovery can be slow, incomplete and costly, with a huge
impact on quality of life. The broad and diverse manifestations of Covid-19 are somewhat unique, said Dr. Sadiya Khan, a cardiologist at Northwestern Medicine in Chicago. With influenza, people with underlying heart conditions are also at higher risk of complications, Khan said. What is surprising about this virus is the extent of the complications occurring outside the lungs. Kahn believes there will be a huge healthcare expenditure and burden for individuals who have survived Covid-19. Patients who were in the intensive care unit or on a ventilator for weeks will need to spend extensive time in rehab to regain mobility and strength. “It can take up to seven days for every one day that you’re hospitalised to recover that type of strength,” Kahn said. “It’s harder the older you are, and you may never get back to the same level of function.” While much of the focus has been on the minority of patients who experience severe disease, doctors increasingly are looking to the needs of patients who were not sick enough to require hospitalisation, but are still suffering months after first becoming infected. – REUTERS.

NAIROBI - Kenyan police have killed three people when a crowd of motorcycle taxi drivers protested against the arrest of a colleague for ignoring coronavirus restrictions. Police shot at the crowd in the western city of Lessos after clashes, a police statement said. The police have ordered the arrest of the officers involved. Kenyan police face increasing scrutiny over accusations they are excessively enforcing the coronavirus restrictions. A cobbler reportedly tried to intervene when police were harassing a motorbike taxi driver for not wearing a mask, reports the Standard newspaper. The Daily Nation newspaper adds that the police were arguing over a bribe of 50 Kenyan shillings. The police then shot dead the cobbler, named as 40-yearold Lazarus Tirop. The crowd started protesting against Tirop’s death. Hundreds of villagers followed the police back to their police station and set alight a police officer’s house, reports the Daily Nation. The police statement says two more people were then shot dead. JOHANNESBURG - The Electoral Commission of South Africa (IEC) has asked Parliament to start working post-haste on amending legislation to allow independent candidates to stand in provincial and national elections. Two weeks after the Constitutional Court delivered a landmark ruling, declaring the Electoral Act unconstitutional and ordering Parliament to amend it within 24 months, the IEC delivered a presentation to the Portfolio Committee on Home Affairs on the ruling on Thursday evening.
