Zambia a beacon of peace - Kasonde CHAPTER One Foundation Zambia says it recognises the efforts of various individuals who have contributed to the promotion and protection of human rights, constitutionalism, the rule of law and social justice. Foundation Executive Director, Linda Kasonde states that Heroes and Unity days are holidays that were created by the nation’s forebearers to honour those who fought for freedom and encourage unity following independence amongst the 70‐plus ethnic groups that represent the Zambian people, as a means of fostering long‐term solidarity. Ms Kasonde says the spirit of unity must be maintained and to not only honour those who fought for a free Zambia, but also ensure that the vision for a free and peaceful Zambia is maintained. In a statement issued in Lusaka yesterday, Ms Kasonde pointed out that Zambia continues to maintain relatively high levels of peace since its independence but that the emergence of heightened modern‐ day economic, political, religious and tribal divisions have resulted in increased threats to national unity, giving the commemorations of Heroes and Unity days more importance than ever
before. “Given the polarisation seen in recent years, Chapter One Foundation recognises that the definition of ‘heroes’ has expanded beyond those who fought for Zambia’s independence and now includes people from all walks of life who contribute to the nation’s advancement and the protection of our unity. “Chapter One Foundation calls on the government to develop and implement national policies that address the increasing economic, political, religious and tribal divisions,” the statement read in part. She urged all stakeholders to reflect on the roles they can play towards enhancing the peace and unity enjoyed to promote inclusive multi‐ sectoral strategies that will address the economic, social, political and environmental triggers of the country’s civil disunity. Ms Kasonde called on the government to continue promoting unity through working with people across the political divide, as the State plays an important role in continuously showcasing the unity agenda to the public. THE clergy have been urged stay away from partisan politics but pray for the government of the day to run the affairs of the country. Evangelical Youth Alliance president, Reverend Moses Lungu, said the role of the clergy was well defined in the word of God which was to pray for the peace, unity, and prosperity of the nation. Rev Lungu said in an interview that when the clergy prays for the peace, success would come to the Church and the country at large. “The effective role we have as the Church is to pray for the nation because we have a higher calling and politicians respect us, they have come to us and have consulted with us,” Rev Lungu said. He said the clergy needed to ensure that they play a supportive role to those mandated to rule the country as opposed to attacking them unnecessarily. Rev Lungu noted that because of human nature, the clergy have along the way lost it and failed to understand their role of effectively pursuing their calling in the nation. He said the role of the church should at all times reflect well on the political leadership and general citizens. “Because of our human nature, the clergy along the way have lost it, the church is not effective, the church has fallen,” Rev Lungu said. He urged the clergy never to downplay God’s sovereignty with regard to political leadership because God allows a sitting government to rule over the people, hence the need for spiritual support.
TWENTY-FIVE people in Ndola were at the weekend apprehended for venturing into bars during the lockdown while 10 bars have been shut. The Ndola City Council in the company of state police conducted an operation to clamp down on people and premises flouting regulations regarding to COVID-19 preventive measures. Council Public Relations Manager, Tilyenji Mwanza, said the operation was conducted in various areas of the city including townships. The 25 patrons were found drinking beer in bars and were bundled in vehicles and whisked away to police stations. As a result, the local authority has urged members of the public not to relax in observing COVID-19 preventive measures in order to curb escalating pandemic levels. She reminded all food places to ensure that dinners wore masks as they waited for their meals as well as observed social distancing. “We would like to remind all eating places that do not have liquor licenses not to allow dinners to consume alcohol from their premises,” she said. ‘PROBE FAKE COVID TESTS’ From Page 1 Private hospitals are not swabbing patients for Covid-19 and yet they keep on losing patients with chest symptoms. “They are misdiagnosing respiration infections and sending people to their early graves. “Their health workers are not being swabbed routinely like in government hospitals. In short what is happening in the public sector is not being replicated in the private sector,” the source said. According to a senior medical officer at one of the private hospitals, patients with respiratory issues were being released without being swabbed for Covid-19 testing and only to die a few days later at home from the same disease. The source emphasised that it was mandatory for all private health institutions to take the Covid-19 testing seriously and ensure that not only patients and staff are regularly swabbed and tested. Health workers are swabbed and tested every seven days to prevent the spread of Covid-19. However, it appears these protocols are not being observed in private facilities thereby exposing patients with underlying illness to Covid-19. And Change Life Zambia has urged Government to probe private health institutions for compliance before more lives are lost due to negligence. Change Life Zambia director, Joseph Kasongo said it was worrying that some private health institutions could be issuing fake Covid-19 test results as they are not authorised to carry
out tests. This could be the reason that the country was witnessing an increase in cases of brought in dead (BID) Covid-19 positive at the University Teaching Hospital. Mr Kasongo has demanded for an investigation of all BIDs to ascertain which health facilities were handling the patients that eventually collapsed and died at home after being declared Covid-19 free when in actual fact they were positive. According to Mr Kasongo, apart from some government institutions only two private entities, the CIDRZ and Medilab were authorised testing facilities for Covid-19, yet many private health providers are conducting tests. He said, it was baffling how a patient with all the symptoms could be discharged but die within days of being discharged and later test positive for Covid-19. He said Government should probe all private institutions conducting covid tests to ensure that they are following the laid down protocols and using the right methods. “It is painful to be told that your relative died from Covid-19 when the attending hospital had certified someone as not having Covid. Whom are we going to believe?” he asked. Mr Kasaongo observed that unless this mishandling of patients is sorted out, people will continue to doubt the Covid prevalence and testing in the country. “People deserve to know that when they pay money at a private facility, they are receiving a credible service and not what we are seeing now,” Mr Kasongo said.

THE Zambia Revenue Authority (ZRA) has impounded three trucks, one with fuel worth over K1 million in a highly-organised smuggling scam. The trucks were impounded at the ZRA Makeni Enforcement Centre and were declared as transit cargo to the Democratic Republic of Congo (DRC) by Fedrol Cargo Logistics, a Zambian clearing agent. ZRA Corporate Communications Manager, Topsy Sikalinda, said they were closing in on fuel smuggling syndicates. Mr Sikalinda explained that one of the trucks carrying fuel worth over K1m was being monitored to appreciate and understand how exactly the scam was happening. “The ZRA officials had to wait for the truck to start off-
loading the consignment in the light industrial area for them to impound and document the evidence. “This consignment was declared as transit fuel going to Congo DRC but was offloaded in Zambia without paying any taxes,” Mr Sikalinda said in a statement issued in Lusaka yesterday. He said ZRA had also suspended the Tax payer Identification Number (TPIN) for the clearing company. Mr Sikalinda said ZRA was aware of transit fraud that was happening and warned those involved that the long arm of the law would soon catch up with them. He said the ZRA was monitoring and gathering all the evidence to ensure that prosecution in the courts of law was successful.

CRIMINALITY AT HEALTH CENTRES WHAT is happening is not only criminal but inhuman behaviour from some private-owned medical institutions. And the earlier that Government steps in, the better for what is at stake is human life that is being sacrificed for monetary gains. For the past two days, we have been reporting on the controversy that has erupted over reports that some people who tested negative at private hospitals where blood samples were taken, turned out positive when swabbed at Government health facilities. What obtains in these private hospitals is that patients with chest complications are not swabbed yet one of the basic symptoms involves breathing problems. One might as well ask why someone who tests negative for Covid-19 ends up dying a few days later, often ending up as a “BID” (Brought in dead) case at hospital. And as Change Life Zambia director Joseph Kasongo notes, this could be the reason that the country was witnessing an increase in the brought in dead cases at the University Teaching Hospital. It is a fact that private hospitals are not swabbing patients but keep on admitting people with chest complications. What this boils down to is that patients are being treated for wrong ailments and not Covid-19. Added to this serious breach is the fact that even the hospital workers are exposed, as are their families and other contacts outside their working environment. The medical authorities in these instances would not even know where to start investigating for the source of the infection because of the many contact persons who have intermingled with the hospital worker for example. The Ministry of Health must move in quickly and stop the rot. Mr Kasongo is right to demanded for an investigation of all BIDs to ascertain which health facilities were handling the patients that eventually collapsed and died at home after being declared Covid-19 free when in actual fact they were positive. According to Mr Kasongo, apart from some government institutions only two private entities, the CIDRZ and Medilab were authorised testing facilities for Covid-19, yet almost all private health providers were conducting tests. Like Mr Kasongo, we find it baffling how a patient with all the symptoms could test negative for Covid-19 but die within days of being discharged. “What is even more confusing is that the same patient upon being swabbed at UTH, would test positive but this would be too late because they would be dead,” Mr Kasongo said. This controversy over Covid testing should not be there for the public must have confidence in the nation’s health system that whatever figures they are given regarding the pandemic are true. There should be no room for doubts among the public. On Tuesday, Health Minister Chitalu Chilufya reported that the country has recorded a surge in the number of Covid-19 cases in the past 11 days as 324 new cases have been recorded with 18 Covid-related deaths, of which 14 were BID. This is the more reason the government should probe all institutions conducting Covid tests to ensure that they are following the laid down protocols and using the right methods. If any institution is found wanting, there must be no compromise if it means closing the facility, so be it, for human life is sacred.

Police public relations officer, Esther Katongo said 236 RTAs were recorded countrywide of which 14 were fatal and 18 persons were killed. She said Lusaka Province recorded the highest number of accidents with 117, one death, three persons seriously injured while 22 suffered slight injuries, followed by Copperbelt which had 33 accidents, two deaths and nine persons slightly injured. Ms Katongo said Eastern Province recorded eight deaths, Central five, Muchinga one and Northern one death. She said Muchinga Province recorded the least with five RTAs with one death, four persons seriously injured while one was slightly injured.

Ground caving-in at Nchanga Open Pit - KCM By SIMON MUNTEMBA THE caving in of ground following slope instability within a section of the Nchanga Open Pit (NOP) Cut 2 in Chingola has started occurring as predicted, but there is no threat to the safety of employees or people in nearby communities, Konkola Copper Mines (KCM) has announced. KCM chief executive officer, Christopher Sheppard made the announcement yesterday. “KCM wishes to inform all its stakeholders that the sloughing (Caving in of ground) following slope instability within a section of the Nchanga Open Pit (NOP) Cut 2 in Chingola started to occur as predicted, and there is no threat to the safety of employees or people in nearby communities,” Mr Sheppard. In a statement by KCM General Manager – Corporate Affairs Shapi Shachin-
da, Mr Sheppard said the geo-technical team monitoring the sloughing following a series of multiple tension cracks at the Open pit noticed visible ground failure during the night of Tuesday, July 7. He said the team had continued to monitor ground movement and KCM would provide further details on the occurrence at a later stage. Mr Sheppard assured stakeholders that they should not have any safety concerns about the sloughing and continue with their businesses or activities, but avoid attempting to enter in the hazard exclusion zone. He also assured the people in nearby communities that there would be no sound of ground fall during the period when the ground continues to fail as it was a gradual process with the ground sliding towards the Open pit.

The 22 flood victims of Ndobela village of Mwela Wa Mangu ward of Lupososhi district lost their houses and property following a heavy downpour in the last rain season. And the PF government under the Disaster Management & Mitigation Unit provided 20 tents for them while World Vision Zambia provided 22 mattresses for them.

PND leaders should stop threatening people who do not agree with them because soon they will taste their own bitter medicine, Copperbelt Province PF youth chairperson Don Mungulube has warned. Yesterday, Copperbelt UPND chairperson Elisha Matambo warned Lusaka Province Minister, Bowman Lusambo, to stop declaring that Copperbelt was a no go area for their leader Hakainde Hichilema. Mr Matambo warned that Mr Lusambo will have himself to blame because the Copperbelt was not his. But speaking to the Daily Nation yesterday, Mr Mungulube warned that the UPND would have a taste their own bitter medicine should they transfer their mediocrity to the Copperbelt. He said the PF had remained peaceful even under grave provocation but that its tolerance had been tested beyond limit. Mr Mungulube said if the
UPND did not desist from antagonistic approach, the Copperbelt would become a difficult turf for them. “Not long ago, our national vice chairperson for mobilisation, Geoffrey Mwamba, was attacked in Monze. Just last week, UPND cadres attacked President Edgar Lungu. As if that is not enough, Mr Matambo even has the guts to warn Mr Lusambo. “As youths on the Copper-

Manganese firms urged to bury disused pits By PETER MALASHA THE Local authority in Mkushi has directed investors dealing in mining to start burying disused quarries as they are posing danger to society. The directive follows complaints from communities where manganese mining was taking place such as in Kasalamakanga, Funda, Kabufumu and Chiponya areas. In an interview, Mkushi District Council chairperson, Evans Bwalya, said mining firms should ensure that they bury
open pits after extraction of the minerals unlike leaving the quarries open. Mr Bwalya noted that there were a lot of illegal and legal miners who were not following procedure as well as the law. He warned that those found wanting would be dealt with according to the law. Mr Bwalya said the local authority was losing out a lot of money in uncollected tax from manganese mining that could otherwise be used to provide services to the needy communities.
"Once miners do mining and excavate they get what they are trying to get, they are supposed to burry and plant trees. My humble appeal is that they should bury open pits where they mine from," Mr Bwalya. He added that there was need for the council and the Ministry of Mines and Mineral development to work together and harmonise the situation. Mr Bwalya said sanity should be brought to the district, stressing that the local authority would soon start inspecting mining premises.

‘UTUNENSU’ TRENDING PHRASE AND PARTISAN OCIDA Dear Editor, IN this write up, we will address two issues and these are; the trending political terminology “#Utunensu.� We will also address the inability to condemn violence against President Edgar Lungu by the newly formed partisan CSO called OCIDA. The word “#Utunensu� has been coined by online bloggers to depict their admiration of their neighbouring countries at the expense of theirs. It is the expression of the sworn belief that Zambia does not have a competitive belief over other countries. However, this popular expression lacks basic research and is made without any discernment of the strides we have collectively achieved by the Patriotic Front administration under President Lungu. In all spheres, the transformation agenda has been implemented to give effect to the aspirations that our forefathers fought for. We challenge the proponents of “#Utunensu� analogy to tell us as to why Zambia has been the destination and home of many foreigners irrespective of their nationality. We also challenge the apparent UPND South Africa branch chairman and selfstyled Seer-1 to explain his obsession with Zambia even after being rendered unwanted. We also challenge the opposition sympathisers to explain why multinational corporations continue to pursue economic fortunes in Zambia and not those countries they have chosen as their reference cases. We challenge the proponents of “#Utunensu� to explain why the nationals of the named country have not gone back to their country but instead loitering in the streets of Lusaka in search of greener pastures. Why have those nationals not gone back to their country if it has better comparative advantages over Zambia? Why are the proponents of the “#Utunensu� analogy more upbeat in the foreign democracies when prevailing realities are circumstantially distinguishable with Zambia? For argument’s sake Zambia’s ruling party does not have the same characteristics with the deposed Malawian ruling party. The PF has a deep rooted relationship with the Zambian people. Like we have said in the past, while the UPND is craving for alliances, the PF has formed a greater alliance with the Zambian people. Any discerning mind can relate that the sudden obsession with the happenings in another country is a desperate attempt for political gains. This is the new way of seeking for political sympathy in favour of the unsellable political candidate who has never won elections. We are also taken aback by the dead silence by the new politicallyinclined CSO with regard to the incident which happened in Monze. We have carefully studied their objectives and our preliminary thoughts are that if the organisation was formed in good faith, it should condemn the lawlessness and the Presidential jeering. Like we have said in the past, OCIDA is an association of frustrated political retirees who are disappointed and allergic to progress. We are gravely shocked that they have concealed their voice at a time it was needed the most. OCIDA cannot claim to be nonpartisan by words, we are the rightful people to deduce a rational conclusion after evaluating their deeds. We have studied their objectives and it is clear that they are championing regional superiority of three opposition dominated provinces at the expense of territories commanded by the ruling party. We have also scrutinised the members and close associates of OCIDA and we are satisfied that they are people who have cursed their relationship wirh the PF-led government. Therefore, their preoccupation is serial divergence against the ruling party. Having said that, we are persuaded by the arguments of those who hold the view that OCIDA is a politically-biased entity whose preoccupation is to champion regime change. IN Africa, Zambia is amongst the top 10 countries to record a drastic face lift in terms of infrastructure. The level of maturity in doing things in Zambia is quite advanced as compared to other similar countries unless one has never travelled. We don’t need to change this trajectory. All we now need to figure out is how to fund more such projects!! A country is all about infrastructure (development of things): - Water - Power - Education - Roads - Hospitals - Air transport Etc A country is also about wealth creation (development of people): {Antonio Mourinho Mwanza)
LAZ AND SHOSHO STUDIES LAST week, the Constitutional Court dismissed a petition by the Law Association of Zambia (LAZ) to have the Constitution Amendment Bill Number 10 of 2019 withdrawn from Parliament. The ConCourt ruled that the petition by LAZ lacked merit because they did not show how Justice Minister Given Lubinda breached constitutional procedure when presenting Bill 10 to Parliament. The ConCourt said it cannot intervene in the matter as the arguments by LAZ did not show how the mandatory formalities as prescribed in Article 79 of the constitution, where offended by Bill 10 LAZ was seeking a declaration that Government’s decision to amend the Constitution in the manner set in Bill Number 10 of 2019 is illegal. In case you didn’t know, LAZ is an architect of Bill 10, they were the key participants at the National Dialogue Forum (NDF) which came up with Bill 10. In fact LAZ even warned political parties and all the citizens not to shun the Constitution making process initiated by the NDF. The question is why has LAZ u-turned; why is LAZ, which is supposed to be the creme-de-la-cream on legal matters taking USELESS and FRIVOLOUS petitions to court; Why is Mr Eddie Mwitwa and SOME of his colleagues at LAZ wasting the court’s time challenging Parliament to stop debating Bill 10 when they fully know that no one, not even the Court can stop parliament from passing Bills and enacting Laws? You don’t need to be a lawyer, you don’t need to know Civics, in fact you don’t have to study SHOSHO STUDIES for you to understand that it is the right and constitutional mandate of Parliament to make laws. Parliament ni Nyumba ya Malamulo, it is Ing’anda Ya Mafunde. The primary objective of parliament is to make laws. This is what the Republican Constitution says in Article 62: 1. The legislative authority of the Republic is vested in and exercised by Parliament. 2. A person or body, other than Parliament, shall not have power to enact legislation. And Article 63 of the Constitution seals the argument, it says: Parliament shall enact legislation through Bills passed by the National Assembly and assented to by the President. And LAZ like everyone else knows that the Courts have ruled and ruled again on this matter; there is sufficient Case Law that has repeatedly stated that no one, not even the Courts can stop parliament from conducting its business. Examples of these rulings include the court judgments in the following cases: 1. Nkumbula v Attorney General where the Court of Appeal had occasion to pronounce itself on the propriety of challenging proposed amendments to the Constitution. 2. Hem Chandra Sengupta & Others v The Speaker of the Legislative Assembly of West Bangal & Others in which some parties sought to restrain the Chief Minister from pursuing a resolution approving the union of two States as well as to restrain the Union of India from bringing or initiating any bill or legislation in parliament
for purposes of uniting the two States 3. Re: Nalumino Mundia where the High Court was moved to quash the decision of the Chairman of the Standing Orders Committee to suspend a Member of Parliament from the National Assembly. In all these cases, it was held that the court did NOT have the power to interfere with the exclusive jurisdiction of the National Assembly in the conduct of its internal proceedings. The Courts ruled that Parliament enjoys exclusive cognizance over its internal proceedings. Hence, the Courts cannot interfere with the internal affairs of Parliament which it enjoys or has the Constitutional mandate or authority to legislate. Clearly, even my grandmother in the village knows that it is the duty of Parliament to pass Bills and enact Laws so why should LAZ, of all institutions, embark on a vexatious and futile exercise to petition the Court to stop parliament from debating Bill 10 when they fully know that such a demand is unattainable at law? The answer is simple, LAZ is compromised and it has reduced itself as an appendage of a legal department of a known opposition political party. LAZ must redeem itself and recommit to its core values of being a professional corporate body as established in Act Chapter 47 of the Laws of Zambia and stop being used as a door mat of an opposition political party. Zambians want LAZ to be the torch-bearer of justice and the rule of law and not to reduce itself to a “vuvuzela� of an opposition political party. Lastly, let LAZ elect a new Executive since the mandate of the current one expired a long time back. LAZ should be an example to all of democracy and good corporate governance.

This is where a coordinated approach towards job creation is needed. In an interview, Mr Sikazwe indicated that several roads in Chifubu Township had been lit using solar energy. He said the street lighting project was progressing well with phase one already completed while works had already began in phase two. He said the project was being funded under the Ward Development Fund. Mr Sikazwe said the project had gobbled K110, 000 in phase one while K98, 000 had been spent on phase two had so far. He stated that the street lights would supplement the efforts aimed at curbing rising crime levels in Chifubu and surrounding areas. He said the project was a good measure to protect the people and their properties in the area as it would not be affected by load-shedding. Mr Sikazwe, appealed to residents of Chifubu constituency to guard the project jealously and warned against vandalism. And the residents of Chifubu Constituency had applauded the initiative to install solar street lights stating that it would help curb the rising crime wave in the area.

THE Association of Vendors, Traders and Marketeers of Zambia (AVTMZ) has re-launched the fight against Covid-19 following the declining levels of compliance in markets and other public places. AVTMZ Kitwe chairman, Henry Mutambo, said his organisation had relaunched the Covid-19 fight and enhanced sensitisation in markets. Mr Mutambo regretted that people were taking the fight against the disease casually and compliance levels had continued to decline. The chairman was speaking in an interview before re-launching the fight at Chamboli market in Kitwe where the association donated 4 x 210 litres of drums to be used for hand washing, liquid soap, 20 litres of hypocloras acid, disposal overalls and disposable gloves worth K5,000. THE Copperbelt Taxis and Drivers Association (CTDA) has opened operations on a new route to Luyando community in Kitwe, which has had transport services since its establishment. Luyando community is a big settlement in Kitwe's Mindolo area that has seen a lot of settlers from all walks of life putting up their structures. The area was not serviced for a long time now due to the bad state of the road. CTDA arrived at the decision after consultations with various stakeholders who saw it fit to open a new route to Luyando community from town. Having observed the hurdles residents were facing in terms of transport, it came to the executive’s attention to have a new route opened so that the residents were serviced. "The association therefore wishes to inform members of the general public and the residents of Luyando Community that a new route to their locality from Oxford Station in the town centre will be opened on Wednesday 8th, July, 2020," CTDA Secretary General Kelvin Kanyanda said. Mr Kanyanda assured that CTDA would continue to supplement Government's efforts in the transport sector.

Malawi cancels CJ’s forced leave
LILONGWE - Malawi’s new government has revoked an order telling the Chief Justice to go on leave before retirement. PRESIDENT Edgar Lungu says he is excited that Patson Daka is making the country proud with his exploits in the Austrian Bundesliga. Daka has meanwhile scooped the Redbull Salzburg player of the champions round award for his seven goals and four assists in the final 10 matches for the Austrian Bundesliga champions. Lungu who had earlier encouraged Zambians to vote for Patson Daka after he took part in the voting conducted on the Red Bull Salzburg’s website, said he was happy for the Chipolopolo striker who has continued to make the country proud.
Daka, who scored 24 goals and seven assists in the Bundesliga beat competition from team mates Dominik Szoboszlai who scored nine goals 14 assists for Red Bull. Others who missed out on the award include Albert Vallci and Andre Ramalho who were also deemed as strong contenders for the award. Meanwhile, Daka who arrived in Zambia yesterday said being nominated for the Player of the Season accolade for Red Bull Salzburg is a great honour because it gives him faith that his efforts on the pitch are not in vain. He said he is not disappointed at missing out on the Bundesliga golden boot award after netting an incredible 24 league goals in the 2019/2020 season in the Austrian Bundesliga.
In an interview with FAZ Media at Kenneth Kaunda International Airport upon arrival from Austria, Daka described the 2019/2020 Bundesliga season as a successful season because he did a lot of things right. “It has been a great season for me personally. It was not really easy but it has been a season to remember. It has been a breakthrough season, I have done a lot of things right and there are a lot of things that I have to work on. I think it has been a great season and stepping stone for the future,” he said. Daka expressed disappointment after missing out on the Bundesliga golden boot which was scooped by Wolfberger talisman Zalman Weissman who finished the season on 30 league goals with Daka in second on 24.
