Tasila Tembo death shocker By KALOBWE BWALYA POLICE in Lusaka have picked up the body of Ministry of Health deputy director technical supports, Dr Tasila Tembo in a decomposed state covered with leaves in Nanking Army Training Centre in Mikango Barracks area, acting police spokesperson Danny Mwale has disclosed. Mr Mwale said police have since launched a man-hunt for the suspect identified as Lieutenant Nigel Mwaba aged 33 of Zambia Army in Lusaka. Mr Mwale has appealed to anyone who may have information about the whereabouts of the suspect to report to any police station. He said the body was temporarily buried at a traditional burial site in Mikango area and is awaiting post-mortem to be conducted at the University Teaching Hospital. Mr Mwale said after police instituted the investigations into the matter, they discovered the body of a woman who was later identified as Dr Tembo. Police in Lusaka received a report of a missing person in which it was reported that a female identified as Dr Tasila Tembo aged 47 of plot number 1732 Meanwood, Ibex Hill went missing.
HE China Development Bank (CDB) has deferred Zambia’s interest payment which was due on October 25, this year to April 25, next year. The deferred interest payment is now payable on April 25, 2021 and the deferred principal rescheduled over the life of the facility. Government external debt service on Chinese loans amounts to approxi-
mately US$426.3 million in 2020 and US$428 million in 2021. Secretary to the Treasury, Fredson Yamba, said Government had reached an agreement with the CDB to defer debt service in respect of a commercial loan facility insured by Sinosure. Main Chinese creditors include the Export Import Bank of China, CDB, the Industrial and Commercial Bank of China and a few other commercial entities including the Bank of China. Mr Yamba said such interim debt service defer-
ment would provide the government with the necessary time to focus efforts on completing its overall debt strategy aimed at restoring public debt sustainability. He said in a statement that reaching this agreement was an important milestone for Zambia in debt relief efforts. He explained that this was made possible by CDB’s and Sinosure’s collaborative and cooperative approach. “Under the terms of our agreement with CDB, interest and principal due on 25th October 2020 will be deferred, Mr Yamba said.
Forest 27 case not dead - Harrington By SILUMESI MALUMO THE Forest 27 issue is not dead and we are seeking other ways to handle the matter, former Tourism Minister William Harrington has said. "Following the latest article in Daily Nation of 27th October 2020 on discontinuation of the judicial review process in the matter of Forest 27, an unfortunate perception has been created that it is now a dead issue, far from it. “It is just a deliberate move and we are strategising the way forward details
of which I cannot reveal at the moment. We will issue a statement in due course after we conclude consultations with our lawyers," he said. Mr Harrington said in an interview that taking the matter before the Constitutional Court could not be ruled out. "In the meantime, we advise and caution all developers of Forest 27 that the whole matter of degazetting this strategic national forest reserve is an illegality and a serious breach of the Constitution. He said that housing de-
velopment on such a huge scale in a water aquifer and river catchment and headwaters would deprive affected citizens of their constitutional right. "You may wish to know that the Chalimbana Headwaters Community has already taken the whole de-gazetting of Forest 27 before the Constitutional Court. “Illegal developers should be well advised to tread with extreme caution as they risk demolition of their structures in future in line with the applicable laws,” Mr Harrington said.

Privatisation: diversionary tactics won’t work By AARON CHIYANZO DESPERATE attempts by UPND to shift attention from the privatisation scandal and plans to institute a commission of inquiry by raising non-issues against President Edgar Lungu will not work, a consortium of political parties has said. Consortium spokesperson, Spuki Mulemwa said nothing would stop Zambians from seeking answers as to why a hotel worth US$26 million was sold for US$6 million. Mr Mulemwa said the cries of suffering pensioners would not shift attention from the need to institute a commission of inquiry into privatisation of state-owned companies. He said in an interview that answers must be provided as to why individuals who were given the mandate to sell the public assets ended up being co-owners without declaring interest prior to the sale. Mr Mulemwa said desperate attempts by UPND to shift attention from the privatisation would not work. “All these accusations that President Lungu is a dictator, are just meant to shift attention from the privatisation issue. But it will not work because we want answers why a hotel worth US$26 million was sold for US$6 million,” he said. And Mr Mulemwa said
President Lungu was a true democrat who tolerates divergent views and even harsh criticism than the current crop of opposition leaders who do not tolerate criticism. He said his firm belief in the collective decisions arrived at by consensus of Cabinet and the ruling PF Central Committee was inspiring. “We have observed with dismay how opposition leaders in Zambia are masquerading as party presidents when they have never been elected by their own members at a convention. “As for the outspoken UPND president Hakainde Hichilema, who is masquerading as the country’s messiah when in fact not, he has never been endorsed by a party convention since the controversial 2006 convention that ushered him into office,” he said. Mr Mulemwa observed that Mr Hichilema dictates to his elected Members of Parliament, council chairpersons and councillors to stoop only to his interests and not of the people they represent. THE national land titling will be done with the land audit to curb illegalities in the country, Lands and Natural Resources Minister, Jean Kapata has said. The initiative is backed by Government’s resolve to accelerate social and economic development through regularising ownership of untitled properties in towns and cities as well as eradicating inequalities in gaining access to land. Ms Kapata said Government would not allow people to build their structures on any open space, without establishing what the land was reserved for. The minister observed that many people were taking advantage of the fact that, some squatters had been given titles so that they could legally own the pieces of land, a situation that would no longer be the case. The national land titling programme would also help promote security of tenure of land in the country and at the same time ensure that land was documented fairly. According to the Ministry of Lands, there had never been a comprehensive regularisation of informal settlements and
systematic land registration in Zambia. "Illegalities of land will not be tolerated in this country, not anymore. A lot of people have been disadvantaged by criminals who sell land through dubious means and leaving them on the street. We want to create the path that will lead people to doing the right thing," she said. Ms Kapata called on all citizens to always verify with her ministry to establish true ownership of land before making any transactions. And the ministry working with Medici Land Governance yesterday launched the issuance of four million titles to Zambians under the national land titling programme. Ms Kapata said the initial period for the programme was seven years. She said the project would be undertaken by her ministry with Medici Land Governance on a fee-based contract. Meanwhile, Medici Land Governance country director Didier Sangashya said the programme would be done in phases. He said during the first phase about 1.5 million titles would be issued and 2.5 million would be issued in the second phase.

TRIBALISTS AGAINST BILL 10 From Page 1 Mr Musoma said a horde of individuals who had been brainwashed into rejecting Bill 10 were from the same regional. He said that a progressive national matter had been turned into a tribal warfare. “For once traditional leaders should tell the UPND to support bill 10,”he said. ALL those claiming that there was no consensus building in the constitution amendment process are only trying to cover their failure to participate in the process after opposing every reasonable step taken, Kabwe Central Member of Parliament Tutwa Ngulube has said. Mr Ngulube said there was no way they could start raising issues on consensus when they had all along been
opposing everything else the government was proposing. Mr Ngulube, who is also Deputy Parliamentary Chief Whip was speaking in an interview yesterday. Some political parties, the Law Association of Zambia (LAZ) and other stakeholders have accused Government of coming up with Bill 10 without consultation and consensus. Others that were making the claim are Church Mother Bodies and some non-governmental organisations. Some stakeholders had boycotted National Dialogue Forum among other processes leading to the amendment of bill number 10 on grounds that the process was unconstitutional and infringed on people’s rights. They also claimed that the amendment was a Patriotic Front-driven process.
But Mr Ngulube parried the accusation, insisting that the process was all-encompassing and that Bill 10 would be subjected to the second reading today. Earlier this year, Justice Minister, Given Lubinda, reaffirmed Government’s commitment of ensuring trust and consensus building in the legislative process. Mr Lubinda said Bill 10 had been the most inclusive and comprehensive Constitutional refinement process in the country’s political history. Meanwhile, Government Chief Whip Brian Mundubile said all political parties had gathered in Siavonga to discuss the Constitution amendment including the UPND and wondered why statements had changed. WINNER TAKE ALL WE are greatly disappointed that the government capitulated and removed the proposal for a coalition government, in Bill 10. This would have provided the perfect solution to our deeply polarised political circumstances, where hypocrisy, emotionalism and at worst tribal factionalism are ever present and at play to wreak havoc with any cogent planning or practical national ethos. For all practical purposes, the National Dialogue Forum (NDF) validated a raft of proposals and recommendations that dealt most comprehensively with issues and concerns that caused disaffection in the country and in many respects dealt with national polarisation based on the two-party hegemony that has gripped the country. To add credibility to the process the resultant draft bill from the NDF was further subjected to submissions through the Parliamentary Select Committee that scrutinised it and as a result greatly modified, and in our estimation completely eliminated the most contentious sections of the Bill, one of them being the issue of coalition government. We would have wished the committee not only adopted that provision but would have in fact made it stronger by insisting that the party that comes out second in the elections should have been given a role in the governance of the nation because it had a following and therefore influence in national governance. Sadly, both the parliamentary committee and the government capitulated to selfish and greedy people intent on a “winner take all” model which has proved disastrous in many nascent democracies around the globe where alliances and loyalties are often divided by sectarian tribal or indeed religious considerations. The failure to craft a constitution that unifies across the various divides takes away any focus towards a national ethos that bestows rights and responsibilities among the citizenry in terms of national development, commitment to national values and above all the maintenance of law and order. In the debate in parliament today, the nation is likely to witness a display of fragmentation exhibiting a lack of sense of united direction. The division will not be on the nuance and importance of issues but purely on a regional divide, which if perpetuated beyond 2021 will be a source of great friction, animosity and regrettably disintegration. The greatest elephant in our country is the regional divide which has forced the creation of an artificial and yet content conglomeration of divided interests based purely on regional or indeed personalised politics. The emergence of so many political groupings with no clear ideological positions portends a resurgence of political agitation and activism that will haunt and perhaps even hound out a government that will be put in office from the 2021 elections. An examination of the characters that are involved in this political groupings gives an array of individuals that are selfish, criminals, tax evaders, forgers, conmen and all manner of riff raff that are posing as saviours of the nation and are somehow gaining traction and a following by an adoring public that is often mesmerised by empty rhetoric and messianism that will lead the country nowhere. As we have said before, Zambians in general maybe poor but the country as a whole is rich endowed and favoured with abundant mineral resources unsurpassed and unmatched by many developed countries which if properly exploited would give the country economic sustenance, growth and socio economic acceleration But this is only possible if we enjoy peace in a united nation that is devoid of conflict and divisive political argumentation. Bill 10 is just a start. We should aspire for a greater nation in which all interests are knit into a common endeavour. This we pray for.

LUSAKA pastor has been sentenced to five years and six months simple imprisonment for swindling his female church member out of K86, 000 on pretext that he had a government road contract. Before Lusaka Magistrate Alice Walusiku was Sydney Mwandu, 36, of house number 1015 Mbawa Road in Chelston Township. Mwandu was facing four counts of obtaining money by false pretenses and one count of obtaining credit by false pretenses from Tina Tissi Phiri. In the first count particulars of offence were that between November 1, 2012
and November 30, 2012 with intent to deceive or defraud, Mwandu obtained K15, 000 from Ms. Phiri by falsely pretending that he had a road contract on which he needed to partner with her when in fact not. In the second count particulars of offence were that between September 1, 2015 and September 30, 2015 with intent to deceive or defraud, Mwandu obtained K32, 000 from Ms. Phiri by falsely pretending that he had bought a tipper truck for use in the purported contract and needed money to pay import duty to the Zambia Revenue Authority when in fact not. In count three, particulars of offence were that between
December 1, 2015 and December 31, 2015, with intent to deceive or defraud Mwandu obtained K30, 000 from Ms. Phiri by falsely pretending that he needed the money to pay owners of the truck which he hired for use in the construction work when in fact not. In the fourth count, particulars of offence were that between October 1, 2017 and October 30, 2017, with intent to deceive or defraud Mwandu obtained K3, 500 from Ms. Phiri by falsely pretending that he needed the money buy spare parts for the purported tipper truck when in fact not. Expose the gassers, UPND challenges govt By SILUMESI MALUMO GOVERNMENT must expose perpetrators behind the gassing incidents instead of just mentioning that they are appearing in court, UPND spokesperson Charles Kakoma has said. Mr Kakoma said Zambians needed to know the identity of the people who were involved and what their motive was. Africa GreenCo Group, together with its Lusaka-based operating company GreenCo Power Services announced the investment. The investment completes GreenCo’s operational establishment in Lusaka as an intermediary renewable energy buyer/supplier and power
services provider and is a precursor to the 2021 capitalisation of credit support for Independent Power Purchasing Supply (IPPs). GreenCo and its investors are focused on supporting Government, as well as the governments of other countries in the Southern African Development Community (SADC) region, in the opening of their electricity markets. The company’s operations will contribute towards the implementation of Zambia’s vision for the electricity sector as set out in the National Energy Policy 2019 and subsequent new energy sector legal

TCZ cautions teachers against exam leakages By KALOBWE BWALYA THE Teaching Council of Zambia (TCZ) has warned teachers against involving themselves in examination malpractices. TCZ registrar, Ebby Mubanga, has called on all teachers and administrators to be alert at all times and report any examination malpractice, failure to which they would be cited for professional misconduct. Dr Mubanga, speaking at
a media briefing in Lusaka yesterday said teachers must treat examination records and information at their disposal confidentially and must not aid a person in an examination. Dr Mubanga said that the occurrence of examination malpractice at any level of education posed a great threat to the authenticity of credentials for teachers involved. Dr Mubanga said examination malpractice also compromised service delivery as graduates from various
schools and training institutions would lack essential skills. "TCZ, therefore remains committed to bringing sanity to the profession with the focus to protect the interest of parents, society and the nation at large. “Further, teachers should never at any given time get involved in partisan politics, but continue supporting the implementation of policies for the Government of the day," Dr Mubanga said.

Chief Sandwe cited insubordination and lack of seriousness as the main reasons why the Ministry of Mines and Minerals Development should revoke the mining licence. "The mining company has been around and mining gold but they are not following the mining laws of this country and for this reason, I want Government to revoke their licence and give chance to serious investors,” he said. According to the chief, the company had not submitted any recovery of ores and mine products, production cost and sales, leaving the community to assume that the licence area was held for speculative purposes. “Information from reliable sources shows that the company has not been submitting on any recovery of ores and mine products, meaning the licence is for speculative purposes and what they are mining is benefitting their selfish interest,” Chief Sandwe said.-ZANIS.

Finsec launches portal for SMEs HARARE - The first ever Growth Enterprise Market (GEM) portal in the region by Financial Securities Exchange Limited (Finsec,) is now available and ready for small to medium enterprises (SMEs) in need of raising funding via capital markets. Launched last December, the GEM portal is a dedicated online platform designed for SMEs in need of raising capital for retooling operations, increase productivity, or to increase their product range and or to expand into diversified markets. Implementation of the GEM portal follows feasibility studies that commenced in January this year with various stakeholders such as their development partners - the United Nations Capital Development Fund (UNCDF). Despite the delays caused by Covid-19 pandemic, the pilot programme enabled FINSEC to fine tune the platform based on feedback from targeted SMEs and other market participants.
A total of 17 SMEs across various sectors, two fund managers, four nominated advisors, two commercial banks and one mobile money operator registered on the platform during the pilot phase to play various respective roles in facilitating, identification and funding of deserving high growth SMEs. FINSEC general manager Garikayi Munema said the positive outcome from the feasibility study informed the implementation of the platform - an initiative to help enterprises raise capital through a safer and regulated market. “There are different enterprises that are driving the economy and in need of capital for expansion. But these are not big enough to list on the stock exchange. “Capital raising options for these companies are limited yet these are the ones driving the economy. So we are trying to come up with a platform suitable for them to raise capital for their expansion,” he said. The GEM portal enables enterprises to apply for funding and possible listing online. African Bank starts retrenchment process affecting over 1, 200 employees JOHANNESBURG - One of South Africa’s new banking challengers, African Bank has joined a long list of companies who have to let go of their staff because of Covid-19. African Bank announced on Tuesday that it has started retrenchment consultation processes with the banking sector union, Sasbo. The bank anticipated that the Section 189A consultations will affect 1, 269 of its 3, 728 employees. The bank said it anticipates
a job loss ratio of approximately 25 percent of those number affected meaning that ultimately around 317 people or eight percent of its staff members may be out of jobs at the end of these consultations. “The Covid-19 outbreak and the associated protracted lockdown intensified the dire state of the economy. Given the financial pressure faced by our customers the bank has recorded a reduction in sales as well as collections, which has created excess capacity across
the different business units,” wrote the bank in a statement on Tuesday afternoon. The bank had just entered the transactional banking space in 2019, trying to diversify its revenue streams beyond investments and loans that it was traditionally known for. But the state of its lending book took the limelight away from the new venture in this year’s interim results when the bank announced that it had already experienced a 25 percent reduction in debt
collections. But on Tuesday, African Bank said the automation of its businesses processes also played a role in considering retrenchments. Mpezeni is right on Lungu
Dear Editor, EASTERN province should give President Edgar Lungu the highest number of votes because that is his own province just like Southern Province gives Hakainde Hichilema the highest number. It is not tribalism. It is just something we have to accept that the local people might like their own son more than the neighbour’s child. This is simple logic. And if it is accepted that Southern Province does it, then it should be done in other provinces. Unfortunately this may mean that some quality leaders may be affected by this. For this reason, I support Paramount Chief Mpezeni, Nkosi yama Nkosi,
for urging his people to vote for President Lungu. It is only right after all Senior Chief Mukuni has been campaigning for HH all the time - 2021 is a battle of minds and this is just the beginning. Easterners have watched Southern Province towns vote ridiculously high for HH and almost next to nothing for President Lungu. For this to end, it means each region should be allowed to give preference to their own people. ‘ZAMBIA MUST FULLY EXPLOIT MANGANESE’ T By BUUMBA CHIMBULU
HERE is need to fully exploit manganese mining as it has potential to increase Zambia’s export earnings, says Centre for Trade Policy and Development (CTPD).
CTPD Senior Researcher Extractives, Webby Banda, said despite the country being endowed with several mineral resources, Zambia’s mining sector had been heavily dependent on copper mining. Currently, mining is the mainstay of Zambia’s economy contributing around 14 percent
of gross domestic product (GDP) and over 70 percent of export earnings. “This has dwarfed the exploitation of other minerals and has put the country in a high-risk position owing to the fact that whenever copper prices plummet adverse ripple effects are sent across the economy. “Thus, it is important that
Zambia embarks on a robust diversification programme within and outside the mining sector,” Mr Banda said in a statement. He said minerals such as manganese could be fully exploited if systems were put in place especially in the artisanal and small-scale mining . “Since artisanal and smallscale miners have a strong
presence in areas holding manganese reserves such as Serenje and Mansa, it is important that they are supported to increase production,” Mr Banda said. He said manganese could be used to achieve forward vertical linkages by using it in battery manufacture, glass, fertiliser, ceramic, and steel industry.
Mr Banda said this could contribute to the industrialisation agenda and also lead to improvements in human development via employment effects. He said Government can partner with industries to see to it that the industrialization agenda through the vertical linkage process comes to fruition.
Standard Chartered completes $40m complex THE construction of the US$40 million Standard Chartered Bank Zambia new head office in Lusaka has been completed. Standard Chartered Bank head of corporate affairs, brand and marketing, Christine Matambo, said the imposing building boasts energy-efficiency features, including an on-site water purification system, an automatic energy saving lighting system. Ms Matambo said in a statement that the building’s critical installations would be powered via solar system, and it would be a
plastic-free environment, amongst many others. “This US$40million investment is testament to Standard Chartered Bank’s long history and continued commitment to Zambia for the long-term. We are very proud of our new Head Office building, which sits in the heart of Lusaka,” Ms Matambo said. She said Standard Chartered Bank staff would soon move from Cairo Road to the new building within the next six weeks, which has brought much excitement. By NATION REPORTER A TEAM of engineers from the Road Development Agency (RDA) has been dispatched to Petauke to conduct a comprehensive technical assessment on the rickety Mvuvye Timber Bridge. Petauke Central Member of Parliament, Dora Siliya expressed disappointment at the collapse of the bridge, barely two months after it was rehabilitated by engineers from RDA. RDA director communications and corporate affairs, Masuzyo Ndhlovu, said the team had been tasked to come up with a temporary intervention that would facilitate the flow of traffic even during the rainy season. Mr Ndhlovu said RDA would upgrade the structure at Mvuvye Bridge, and it would soon embark on preliminary design reviews and procurement processes. He said the bridge was located in an economic area which was approximately 20Kms South of Petauke in Chieftainess Mwanjabantu
and Chief Mumbi’s Chiefdom. And according to ZANIS, Ms. Siliya said it was disappointing that the bridge, whose rehabilitation works had gobbled about K129, 000 a few months ago had already become a death trap, as its deck was falling apart. She said Government was spending a lot of money to rehabilitate the bridge and it was sad that the works by RDA engineers did not solve the problem. Ms. Siliya who is Information and Broadcasting Services Minister was speaking in Petauke. Meanwhile, RDA has awarded 12 sub-contracts to local contractors to be attached to China Geo Engineering Limited for the construction of 100 kilometres of road from Katoba to Chirundu through Chiawa. The awarding of the sub-contracts follows government’s mandatory policy for a minimum of 20 percent of all road contracts awarded by RDA to be given to local contractors.

KABWE RESIDENTS COMPLAIN OVER NRCs ISSUANCE

The residents in Chinyanja ward in Bwacha constituency said they were surprised that officers who were conducting the mobile exercise at Nyama Primary School had demobilised after being in

One of the affected residents, Recent Mweene, said many people in the area had not obtained the NRCs because officers had left. “Most of us didn’t get the NRCs, the officers ran away, they were just here for three days instead of five days,“ he said. This came to light when Member of Parliament, Sydney Mushanga, conducted a voter registration sensitisation meeting in the area.
Ward councillor, Gabriel Chikalipa, and Ward Development Committee (WDC) chairperson, Thames Mbukwa told the Daily Nation that officers had left. The residents have since appealed to Mr Mushanga who is Central Province minister, to help them acquire the NRCs so that they could take part in the 2021 general elections. Mr Mushanga assured the residents that he would engage the Ministry of Home Affairs on bringing the officers back in the area to capture the remaining population.

THE directive by Secretary to Cabinet Dr Simon Miti to civil servants intending to run for political office to resign is a timely development, former FDD spokesperson Yotam Mtayachalo has said. He said the action would de-politicize and protect the integrity of the civil service. Mr Mtayachalo said it was unfortunate that some individuals in the civil service and quasi government institutions had been promoting their political interests. He said Dr Miti’s action was good notwithstanding that it contradicted the Republican Constitution. “Some stakeholders have opposed the move because it is not backed by any law, needless to say that there is a moral aspect in this matter because the directive has more advantages to the nation than disadvantages. “The move shall safeguard the credibility of the civil service the way it was during the UNIP government more importantly that the civil service is the engine which drives public service delivery,” he said. Mr Mtayachalo said the circular must be implemented across the board so that it was not seen to be targeting opposition members from exercising their fundamental and democratic rights. “We need to bring back professionalism in the civil service the way it was in the past and it is just necessary that those harbouring political interests but are currently serving in public service should resign so that the playing field can be levelled,” he said. Mr Mtayachalo charged that some District Commissioners, Permanent Secretaries and parastatal had been using their offices to gain political mileage against would-be political competitors.
‘ECZ should build consensus’ By NOEL IYOMBWA THE Electoral Commission of Zambia (ECZ) should build consensus with all stakeholders on a number of issues such as the nomination fees, the online voter registration and implementation of inmates’ right to vote before the 2021 elections, the Golden Party (GPZ) has advised. The party has also called on ECZ to remain professional as opposed to siding with individual politicians especially as the nation prepares for the 2021 general elections. GPZ President, Jackson Silavwe, noted that mismanagement of electoral processes had been the major cause of conflicts in Africa. He noted that despite opposition political parties
being available for dialogue, ECZ had always opted to engage in half-hearted dialogue and later impose resolutions on the rest of the political players. “With less than 10 months left before the 2021 general elections, ECZ has failed to build consensus with all its stakeholders on a number of issues such as the Nomination fees, the on-line voter registration as well as the implementation of inmates’ right to vote during the 2021 elections. Mr Silavwe implored the ECZ to use the extended period for the voter registration to engage stakeholders and iron out concerns once and for all. “As a party, we are not in any way hijacking the roles and responsibilities of the ECZ but we are concerned with the political temperatures raising as a result of a number of unsettled concerns by many Zambians. “We, therefore, call upon the Electoral Commission of Zambia to give an ear to the demands of political and governance stakeholders and more so as the general citizenry,” he said.

TWO NDOLA MPS IN LAND FEUD

A WRANGLE has erupted between Ndola Central Member of Parliament Emmanuel Mulenga and his Chifubu counterpart Frank Ng’ambi over the demolition of structures. The feud between the two Patriotic Front MPs erupted following Mr Mulenga’s action to
demolish structures on his farm through a court order. Mr Mulenga through a court order, demolished the structures that were built illegally on his land, a decision that infuriated Mr Ng’ambi whose constituents were affected. According to Mr Mulenga, the court order was obtained on September 3, last year to have the structures demolished,
stating that he immediately issued the developers a notice to vacate. He said that despite being issued with the notice, the developers continued growing vegetables as well as building their structures. “I am very disappointed that Mr Ng’ambi is accusing me of having demolished over 50 structures and that more than

The app “TaxOnApp” was developed by the Zambia Revenue Authority (ZRA) for Android and iOS devices. The app shall bring ZRA’s services closer to small and medium taxpayers in Zambia. While the launch of the app is expected for October, the knowledge of the taxpayers about using the app is limited. In order for the app to reach its full usability, it is crucial to allow the taxpayer to learn about it. This shall be addressed through the development of a free e-learning course that taxpayers can complete and that explains all functionalities of the app. The materials to be used in the e-learning course shall also be used individually by ZRA, i.e. to be featured on the ZRA website or be featured in print, TV and radio adverts as well as on the authority’s social media channels. GIZ wishes to invite proposals for developing the e-learning course as well as the promotion materials. The assignment will consist of, but will not be limited to the following tasks: 1. Develop the contents for the course and the materials 2. Design the course and the layout of the materials 3. Conduct the production and post-production of all materials

During a Sun FM special radio interview on Sunday, Mr Ng’ambi said it was shocking and inhuman for Mr Mulenga to demolish 50 houses affecting
Mr Ng’ambi over 600 families without notice. Mr Ng’ambi accused his Ndola counterpart of de-campaigning him, stating that the action was uncalled for. And the victims of the demolitions claimed that their structures were on legally owned land offered by the Ndola City Council. But the council said officers were studying the claims and that the outcome of the investigations would be communicated in due course.

A NDOLA based clergy has advised youths in the city not to engage in violence ahead of the 2021 general elections. Reverend Lucy Mwale noted that the trend by some politicians to engage youths in violence should be stopped. She noted that youths could not engage in violence on their own but were enticed by some politicians. Rev Mwale emphasised the need for election stakeholders to uphold the Christian principles on which the country was founded. She was speaking in an interview in Ndola. “Our country is founded on Christian principles, we have enjoyed peace from time immemorial, so my appeal to the senior politicians as well as youths is to please uphold the Christian principles on which our country is founded even as you start campaigning for next year,” she said. Rev Mwale said leadership was given by God and that even now God knows who would emerge victorious in 2021. She urged all stakeholders, particularly election candidates, to respect and accept whoever would emerge victorious. - ZANIS

BRE CORONATION CEREMONY GIVEN A GO AHEAD

HE 2020 coronation ceremony will take place next month at Lealui summer palace, the Barotse Royal Establishment (BRE) has announced. This is an event to celebrate the Kingship of the Litunga Lubosi Imwiko II, which was
put off due to the COVID-19 outbreak. After consultations, the Ministry of Health has sanctioned the event proceed. BRE Prime Minister, Nyambela Manyando Mukela, said the event would held from November 13 to 17 this year and that it would be a special

Register en masse, youths urged YOUTH Alliance for Development (YAD) has called on youths to register in large numbers during the voter registration exercise. YAD Executive Director, Ziwase Mulenga, said in Solwezi in an interview that it was cardinal that youths participated in the governance processes of the country. “I’m urging all youths to go out there and participate in this duty which each and every Zambian who is at the rightful age must participate,” she added. Ms Mulenga has since appealed to the youth not to cause voter apathy during next year’s general elections. “I am also encouraging the youths to vote, they should not contribute to voter apathy because youths are the leaders of today and tomorrow, so if they do not vote then they are not setting a right pace for the elections to take place,” she said. Ms Mulenga encouraged the young people to avoid engaging in violence during the election period. “Youths should desist from taking part in acts that will bring harm to the nation,” she said. Meanwhile, Ms Mulenga has commended the Electoral Commission of Zambia (ECZ) for shifting dates for the voter registration exercise, saying it would enable more youths get registered. “The fact that the ECZ has extended the voter registration exercise is a very welcome move and we are really grateful to the government, many youths will now register and participate in the governance process,” she said. She also commended the ECZ for the online voter registration initiative as it will capture more youths. The mobile voter registration exercise was being conducted by the ECZ) in readiness for the 2021 general elections, targeting to register nine million eligible voters. UIDELINES for the proposed Church empowerment fund have been formulated, National Guidance and Religious Affairs Minister, Godfridah Sumaili has said. The formulation of the guidelines follows a directive by President Edgar Lungu to craft modalities for a Church empowerment fund. Reverend Sumaili said the Covid-19 outbreak had affected

The Law Association of Zambia (LAZ) is a statutory body created under section 3 of the LAZ Act, Chapter 31 of the Laws of Zambia. Among our objectives and mandates under the said Act, is to promote the rule of law, seek the advancement of human rights and to further the development of law as an instrument of social justice and as an essential element in the growth of Zambian society. Within our objective, is the overall duty to ensure constitutionalism, constitutional legitimacy and Democratic governance in Zambia. Our objectives beckon us to be mindful and take keen interest in the Constitution of Zambia. The process of making a Constitution, or indeed amending one, is a very delicate matter that ought never to be taken lightly. A Constitution should never suffer amendment on political lines. We would borrow the text from the International Round Table on Democratic Constitutional Development, employed by the renowned Constitutional Lawyer Muna Ndulo and say that: “the process of constitutional-making is crucial. The Constitution is no ordinary law to be modified or replaced by ordinary legislation. It must be perceived as a higher law, authorizing and governing ordinary law and commanding adherence to constitutional precepts. While ordinary law may be adopted and altered by legislative majorities of whatever size, the adoption of a constitution and its amendment requires much more, widespread participation by the citenzenry and the achievement of a broad-based consensus.” (Ndulo and Kent, 1996) Though the process surrounding Bill 10 has been unduly politicised, LAZ is without doubt that the process lacked the critical ingredient of broad-based consensus. For so long as no consensus exists, it is immaterial how good or progressive the contents of a proposed Bill to amend the Constitution may be because the enactment would have failed the test of constitutionalism.
LAZ is dismayed that notwithstanding the apparent lack of a broad-based consensus, the constitutional amendment process will proceed to second reading and voting on Thursday, 29th October, 2020. This is despite many calls from the general members of the public, civil society organisations and many other stakeholders that the Constitution of Zambia (Amendment) Bill (Bill 10) be withdrawn. As Members of Parliament, we remind you that your primary duty is to the people of Zambia who elected you into office. Article 5 of the Constitution states that the sovereign authority lies with the people of Zambia and yours is the delegated power to implement the will of the people. It is unnecessary to go into specific provisions of Bill 10 to conclude that there is no consensus amongst the People of Zambia over Bill 10. We therefore, urge you to put the concerns of the Zambian people above all party or political interest. We implore you to do the right thing. Bill 10 must be taken off the floor so that an opportunity is given for broad-based consensus on the provisions contained therein. LAZ believes that there is still time to build consensus if Members of Parliament from across the political divide put the people of Zambia first. OHANNESBURG - Four new Special Commercial Crimes Courts will be established to deal with cases of Covid19-related corruption, President Cyril Ramaphosa announced in the National Council of Provinces (NCOP) on Tuesday. In response to a question from ANC MP Maurencia Gillion, Ramaphosa said the government had "responded swiftly and decisively to allegations of corruption in the awarding of Covid-19-related contracts." He added the Special Investigating Unit (SIU) was currently looking into 932 cases under the proclamation issued in July and all were at different stages of investigation. "The SIU has, to date, provided me with two interim reports which outline the progress in the investigations, including where
President Cyril Ramaphosa investigations have been finalised." He said: The reports of SIU investigations will be made public once all the necessary processes have been completed and there is no risk of jeopardising ongoing investigations. Ramaphosa said the SA Revenue Service (Sars) had established a Covid-19 project team to investigate and audit cases. At the end of September,

WHO warns getting Covid-19 under control may require tougher lockdowns GENEVA - The World Health Organisation (WHO) warned on Monday that the world was "well behind" where it should be on Covid-19, and that getting the crisis under control "may require sacrifice for many, many people." "We're well behind this virus," Dr. Mike Ryan, executive director of the WHO's health emergencies programme, said at a press conference in Geneva. "We will have to get ahead of this virus, and (that) may require sacrifice for many, many people in terms of their personal lives," he added. His warning came as Covid-19 cases surged, particularly in the US and Europe. WHO officials said some countries may have to consider closing down non-essential businesses again to stem the tide. "It may require shutting down and restricting movement and having
stay-at-home orders to take the heat out of this phase of the pandemic," Ryan said. The WHO also criticised some nations for not doing enough to reduce the spread of the virus during the first wave of the pandemic. Ryan said: "We are seeing a large number of cases, we are seeing widespread disease, we are seeing very, very high positivity rates and an increasing lack of capacity to do any effective form of contact tracing." In August, the WHO said that young people were the primary spreaders of the virus. But WHO officials said on Monday that the coronavirus is starting to "leak" into older and more vulnerable populations. WHY BILL 10 IS BENEFICIAL TO ZAMBIA

URING his tours of rural Zambia President Edgar Lungu has been approached by traditional leaders to help resolve crippling succession wrangles in a number of chiefdoms, some of which have claimed lives. But the President has politely declined to intervene in the bitter disputes because the current Constitution does not give government power to recognise or gazette a chief. During one meeting with chiefs and headmen in Western Province where the Nkoyas were asking him to intervene in chiefdom conflicts, the President explained that Government would only be able to help resolve succession wrangles if Bill 10 was passed into law. The President also said during a meeting with chiefs in Senga Hill in April last year it was good that almost all traditional leaders agreed that the Constitution Amendment Bill Number 10 of 2019 would help to resolve the succession wrangles in their chiefdoms. The current situation has made it hard for chiefdoms to avoid succession wrangles because anyone could stand and claim to be a chief without fear of any authority. This is one of the benefits the nation stands to reap should Bill 10 become law. But there has been so much misinformation, disinformation and naked propaganda against the bill that some Zambians believe it is aimed at prolonging the Patriotic Front’s stay in power and giving President Lungu an imaginary third term when he has served only one and deserves a second. The purveyors of this misinformation have, however, failed to provide proof except hiding behind general assumptions and allegations of dishonesty. But the truth is that the bill is aimed at sealing the gaps, weaknesses or lacunas in the republican Constitution identified after the 2016 general elections. Once the bill becomes law the country will make a huge leap towards an inclusive society where every group is carried on board in all national governance and development processes. It will also refine the electoral process and system and reduce post-election tensions. The benefits abound.
1 After the 2016 General and Presidential Election The process to amend the Constitution of Zambia, Chapter 1 of the Laws of Zambia, began in November, 2016, when the National Assembly approved a Private Member’s motion moved by Mr Rogers Mwewa, Member of Parliament for Mwansabombwe Parliamentary Constituency, urging the Government to amend the Constitution in order to reinstate Members of Parliament on councils and address the lacunae that had arisen following the 2016 amendment to the Constitution.

Dealing with election petitions The bill also proposes to extend the period in which the Constitutional Court should hear and dispose of a petition over the results of a presidential election. After fierce opposition from opposition parties and allied civil society organisations, several changes have been made which should be debated by members of Parliament. The National Assembly of Zambia is mandated by the Constitution to pass bills into laws.

Genesis of Bill 10 Bill 10 emanated from the petition of the ConCourt by the United Party for National Development (UPND) after the August 11, 2016 general elections. The ConCourt threw out the petition for lack of prosecution after the 14 day period enshrined in the Constitution lapsed without the UPND presenting evidence to support the action. The Constitution of Zambia (Amendment) Bill, N.A.B 10 of 2019, was presented to the House for First Reading on Friday, August 2, 2019. Since it was presented in the Third Session of the Twelfth National Assembly, the Bill lapsed by reason of the prorogation of the House. Government Chief Whip Brian Mundubile told a media briefing in June that in accordance with Standing Order 126 of the National Assembly of Zambia Standing Orders, 2016, the House, on Tuesday, December 3, 2019, resolved to restore the bill to the Order Paper for consideration at the Second Reading Stage. The bill was placed on the Order Paper of Wednesday, December 4, 2019 as an Order of the Day. “However, during the debate, the Hon Minister of Justice sought leave of the House to defer the consideration of the Bill to a later date. Debate on the Bill was accordingly deferred to a later date,” Mr Mundubile said. On Tuesday, March 17, 2020, the bill was again placed on the Order Paper for resumption of debate. But debate on the question was not concluded on that day and spilled over to

Speaking during the official launch of the 2020/2021 MTN/FAZ Super Division, Mulenga said it will be gratifying to see soccer fans being allowed to watch their teams from match venues when Super Division football returns this weekend.
