HE surviving 130 of 236 Saturnia Fund pensioners, from BP are back in court next month, 18 years after their claim was commenced. Over the years the argument has been the court

award of K26 million which Saturnia has disputed claiming that the pensioners are only entitled to K1.2 million. MY office will not sanction any acts that will usurp the powers of the Electoral Commission of Zambia as it is independent and autonomous, President Edgar Lungu has said. President Lungu has reaffirmed his commitment to ensuring the independence of the ECZ or any other constitutional body. The President noted with concern insinuations from some quarters of society that he had directed the ECZ to abandon the current voters' register and to introduce electronic voting in an effort to disadvantage the opposition in the 2021 elections. President Lungu said under his leadership, he had allowed and would continue to allow constitutional bodies like the ECZ to operate autonomously

and independently. He said he would not sanction any acts that would usurp the powers of the ECZ President Lungu said he found it absurd that some citizens continue to claim that he was directing ECZ to change voter registration methods to his and the ruling party's advantage. The President in a statement issued by his special aide for press and public relations, Isaac Chipampe, said that even he and the ruling party were uncomfortable with some of the newly introduced methods but he was restrained to comment because his words maybe seen as interference in the operations of the ECZ. He said he does not want the electoral process to be marred in controversy and prays that the polls would be free and fair before, during, and after voting.

DANGEROUS TALK ZAMBIANS must learn to appreciate the peace obtaining in the country and not take it for granted. They must realise that the onus is on them to preserve and guard what they hold dear before it is too late. It is not only through political violence that the country can be thrown into turmoil but other seemingly dangerous insinuations. It is in this vein that we call on the nation to heed the warning from Chief Chikwanda of the Bemba to guard against what warns is careless talk regarding Bemba domination. Chief Chikwanda said the careless tribal talk has potential to disrupt the country’s peace and should be avoided by all means. He said careless tribal discourse including claims that Government was dominated by the Bemba was a recipe for chaos in the country. Zambians ought to realise that there are 73 tribes that make up the nation and none of them is more important than the other. If anything, it is the unity among the 73 tribes that has made the country unique. That a person originating in Mbala can go and settle in Sinazongwe and be accepted is something that must be hailed. After all during the independence struggle, it was the unity of purpose that made it easy for the nationalists to defeat the colonialists that led to Zambia’s independence. That spirit from the independence struggle is what must be maintained. Our independence stalwarts came from all parts of the country and fought for the creation of an independent and united country. Why then should Zambians allow anyone to mislead them and divide them on account of one’s tribe? As Chief Chikwanda said, there should be no mention of tribe in governance and political dispensation of the country. Tribal politics, it must be noted, has destroyed a lot of African countries and most are yet to recover from the upheaval. The Rwanda genocide of the mid-1990s was a product of one tribe blaming its shortcomings on the other. The ethnic mix of Rwanda is the same as in Burundi and as everyone knows, they are still trying to resolve that complicated tribal rift – Hutus and Tutsis. And for Zambians, Chief Chikwanda’s warning is appropriate as the country edges closer to the Presidential and general elections next year. The traditional leader said the country was heading for general elections next year and tribes should not be part of the political discourse. “It is ‘One Zambia One Nation’ and tribal talks including claims that Government is dominated by Bembas should be condemned by all Zambians,” Chief Chikwanda said. Anyone who tries to promote such divisive talk must be flushed out and made to undergo mental rehabilitation so that they could be aware of the country’s values. The country’s constitution gives every Zambian equal rights in all aspects of the nation’s life and no one should discriminate against another on account of tribe. Next year’s elections are not about endorsing tribal chiefs but national leaders who will who will offer themselves to serve the Zambian nation. It would be folly for any politician to believe that they could win elective office through the tribal vote. That as Chief Chikwanda noted must not be accepted. Zambians must continue to look up to the founding fathers for inspiration and pray that tribal politics continue to be sidelined. What will drive and build the nation is to work as equals and realise that unity will see the country through any difficulties.

OVERNMENT should reverse its decision where mineral royalty payments are no longer treated as a deductible expense for the purposes of calculating corporate income tax, the Zambia Chamber of Mines (ZCM) has said. According to the ZCM, the provision substantially increased the effective tax rate, handing over almost all the proceeds of mining to Government. "Since 2019, mineral royalty payments are no longer treated as a deductible expense for the purposes of calculating corporate income tax. "The effect of this is that

mining companies end up being taxed on income that has already been paid over as a royalty – a situation referred to as double taxation," ZCM said in a statement yesterday. ZCM complained that the failure to remove the provision to protect revenue far smaller than the investment sums in the offing would not be lost on the Eurobond holders. The bondholders, ZCM explained, would have been looking to the renewed growth that should have followed to mitigate their income loss during the proposed moratorium on coupon payments. "The removal of non-deductibility is a key condition for investment into other minerals such as gemstones, nickel, manganese, and gold, if we

are to diversify our minerals offering in a formalised manner. "Withdrawing this one provision would have been and still could be the ‘green light’ signal to investors that Zambia is once again open for business," ZCM said. ZCM said the US$1 billion Kansanshi Mine sulphide expansion and life of mine extension project, the US$1 billion Lubambe Mine expansion, and the underground equipment fleet expansion at the NFCA Chambishi South East Ore body were three major mining sector investments that were tangible and achievable. ZCM therefore concluded that the 2021 national budget announced last Friday again missed an opportunity to stimulate growth in the sector.

Locusts spraying temporarily halted by animal movements By KALOBWE BWALYA in Mwandi THE aerial spraying of African migratory locusts in Mwandi, will not commence today because animals have to be moved to safer places in order for the exercise to take place, says an International Red Locust Control Organisation Scientist, Ayoub Nchimbi. This follows the infestation of the African migratory locust in some parts of Mwandi and Sesheke. And Zambia Airforce (ZAF) Chief of Operations Brigadier-General William Lungu said ZAF is mandated to cooperate with and assist civil authorities in emergencies, relief and disaster management operations. Brig-Gen Lungu explained that ZAF can therefore not leave the eradication of the locusts to the International organisation alone, but would ensure that the operations were carried out perfectly. Brig-Gen Lungu said this when he paid a courtesy call on Mwandi Commissioner Prescious Myenga yesterday. Meanwhile, Ms Myenga said if the locusts were not eradicated early , there would be hunger in the district. And the International Red Locusts control Organisation has assured the affected villagers that the chemicals being used to spray would not affect the environment because they are not toxic. Meanwhile, ZAF is ready to support Government endeavors in both military and peace times. ZAF deputy commander Major General, Benedict Kalinda, said when he paid a courtesy call on Central Province Minister, Sydney Mushanga, before his annual visit to the area to check on the operational readiness and welfare of the personnel in all the formations.

Covid-19 testing rises to 5 000 per day By SANFROSSA MANYINDA

GOVERNMENT has expanded the number of Covid-19 testing to 5 000 per day. And government has invested in new equipment that will increase the testing capacity and quick delivery of the results which will also be done via SMSs. Minister of Health Chitalu Chilufya said government through his ministry would continue striving to ensure that testing was made easy. Dr Chilufya was speaking when he gave the latest update on the Covid-19 situation in

the country. "We will ensure that we improve the capacity of screening and testing and ensure that the system is more efficient," he said. Dr Chilufya further said that the ministry would in the next few weeks carry out a country wide serial survey to ascertain the extent of the pandemic. And Zambia National Public Health Insurance (ZNPHI) Director General Prof Victor Mukonka said with many neighbours lifting the ban on international travel, it was anticipated that more cases of Covid-19 would be imported into the country.

Saturnia pension survivors back in court From Page 1

He ordered that pension contributions from both the employee and employer should be rendered to each employee and that the value realized should bear a penal interest based on the current average bank lending rate. He also ordered that compound interest was due to them and awarded the cost to the employees. Saturnia appealed to the Supreme Court. Saturnia is run by companies owned by among others UPND president Hakainde Hichilema and former Zambia Privatisation agency Valentine Chitalu. The Supreme Court of Zambia upheld the judgment in February 2014 and the matter went to assessment in 2015 during which the Pension Fund Administrators, Benefits Consulting Services Limited joined the defence on behalf of the company and testified that the plaintiffs were only entitled to K1.2 million but the court ruled that the former employees were entitled to K26.0 million.

K26 MILLION The Supreme Court of Zambia upheld the judgment in February 2014 and the matter went to assessment in 2015 during which the Pension Fund Administrators, Benefits Consulting Services Limited joined the defence on behalf of the company and testified that the plaintiffs were only entitled to K1.2 million but the court ruled that the former employees were entitled to K26.0 million.

The company once again appealed against the assessment judgment in April 2016 and the Supreme Court of Zambia in its second ruling on the matter on December 18, 2018 ordered that it goes back to a second assessment under a qualified Actuary as a referee. The second assessment hearing commenced in June 2019 but was truncated in unclear circumstances without any notice to the litigants in June this year (2020). However a notice has now been issued indicating , the matter has been set for hearing before Judge A.M.Chulu on October 15, 2020. Judge Phiri ruled in 2010, “In particular I find that each of the plaintiffs was entitled to be paid under rule 11(ii) after the transfer of their contribution from ZSIC : I enter judgement in the plaintiff’s favour and order the whole matter be treated on the basis of the rules that applied to each one of them at the time of separation. I further order that any redundancy packages refunded to the defendant must be paid back

to those of the plaintiffs affected with penal interest as awarded herein,” Judge Phiri ruled. He also said, “ Further still, although oral evidence was given by both parties, failed to show the history of benefits in BP (Z) Ltd., documents evidenced in the bundles of documents indicate that the defendnant’s pension trust existed even prior to 1993 and there was migration or transfer of the same from Madison to Zambia State Insurance Corporation and later to Saturnia Regna Pension Trust Fund. At the time, it would appear that BP Zambia PLC itself retained its own benefit rules administered by itself.” “I agree with the plaintiff’s counsel that each of the plaintiffs were simply cashed off by BP(Z) Ltd.; and this suited the Fund managers, Saturnia Regna Pension Trust Fund who conveniently paid into court what the BP (Z) Ltd instructed them to pay. Under normal circumstances it would have been expected that BP(Z) Ltd should have completed an withdrawal report on each of its retrenches and forward them to the Pension managers which in turn should have processed and acted on them in accordance with the pension rules in each particular circumstances of each case.,” Judge Phiri said. The dispute in the BP Zambia Staff Final Salary pension scheme arose when the company transferred the management of the fund from Zambia State Insurance Corporation in January 1995 to the Saturnia Regna Pension Trust Fund which was at the time managed by Anglo American (Central Africa) Limited Financial Services Division. At the time of transfer, the employees were promised better benefits with those who had clocked ten years and above allowed to collect both employee and employer contributions even if they left the company before the legal retirement age. However in 1999, employees that were retrenched were forced to collect their own contributions regardless of the period of service which ranged from five to 31 years. Those that refused to collect their own contributions were told that they would lose their retrenchment packages. In July 1999, Saturnia Regna Pension Trust Fund refunded the employee contributions with a promise to pay the employer contributions at age 55 or earlier death. Then a month later, in August 1999, the same Saturnia Regna Pension Trust Fund wrote another letter informing the retrenched employees that they had no further claim left in the pension scheme. This led to the dispute which resulted in the present litigation.

MORE DEMAND NCHITO PROSECUTION OVER FORGERY By NATION REPORTER

HE police should come clean on why they have failed to take action against the Nchitos in a clear case of forgery, Citizen Democratic Party (CDP) has said. Lusaka Magistrate Alice Walusiku, in the case where three Marshlands Directors are charged with forgery and fraud, ruled that their defense lawyers led by Mr. Nchima Nchito SC tendered false medical records in the Lusaka Magistrate Court to justify the absence of one of the accused persons, Nachi Musonda. CDP president, Robert Mwanza, said this was a clear case of forgery, saying that if an ordinary citizen was involved in the matter, police

would not have taken long to take action. Mr Mwanza said the police needed to apply the law fairly regardless of the person involved. He said in an interview yesterday, that it was prudent that the police moved quickly and stop shielding some people because of their status in society. "There should be no sacred cows when it comes to the application of the law. If the police have interests to protect in this particular case, let them come out in the open," said Mr Mwanza. And a PF official Lemmy Bwalya urged the police to be professional and apply the law fairly. Mr Bwalya warned that

He said all citizens were equal before the law and the law should not be seen to favour only one section of society. “If a poor person is prosecuted over a particular crime, then so should a rich man if they are accused of committing the same crime. The forgery came to light when the court summoned medical experts from CIDRZ Laboratories and Levy Mwanawasa Hospital to court to establish and confirm on the authenticity of the medical record. In his submission to court to argue about the absence of Musonda, defence lawyer, Nchima Nchito stated that the medical records submitted in court were authentic as he has been at the bar for 30 years and could not tender forged records into court for the sake of an adjournment. However, the experts from both CIDRZ Laboratories and Levy Mwanawasa Hospital established that the medical records submitted into court were forgeries.

Grow foreign reserves in levels By BUUMBA CHIMBULU

OVERNMENT should start targeting to grow gross international reserves at a particular level to determine whether or not there is an improvement, instead of indicating ratios in the national budget, says the Economics Association of Zambia (EAZ). Finance Minister, Bwalya Ng'andu, last Friday indicated during the 2021 national budget presentation that Government was targeting an import cover of 2-5 months. EAZ national secretary, Mutisunge Zulu, however said the best way to ensure sustainability and easy tracking of reserves would be to target a particular level.

Mr Zulu explained yesterday in Lusaka during the PwC post 2021 national budget that targeting ratios could be misleading. "I just want to talk about the import cover. I know that we always target a ratio of 2.5 months of import cover but a ratio itself will not have meaning if we do not look at the numbers that are involved. "I talked about this because you can have an import cover that is increasing while your reserves are constant and your import cover is shrinking and that will manifest into growth in terms of ratio when the reserves are actually not growing," he said. Mr Zulu said: "so may be this is where some of the intervention measures such as gold, mining and small-scale miners

can come in." Ministry of Finance Permanent Secretary for budget, Emmanuel Pamu, said Government had put in place measures meant to stimulate the economy. Dr Pamu explained that the national budget was among others, meant for economic recovery. Meanwhile, PwC Partner from South Africa, Jyoti Mistry, said increasing the tax rate on betting to 25.0 per ent from 10.0 percent was expected to generate additional revenue to the fuscus of K59.3 million. Ms Mistry said the measure seeks to harmonise the tax rate of betting with that of similar games. "Currently, betting games are charged a presumptive tax at the rate of 10.0 percent on gross takings," she said.

words. He also wants an order of injunction to restrain Ms Nawakwi, her agents, servants and whomsoever from further defaming him or publishing similar defamatory words of him. Mr Hichilema is also claiming reimbursement of the sums expended by him in mitigating the effect of Ms Nawakwi's conduct towards him and arising from the publication of the defamatory words. But Ms Nawakwi through her lawyer, State Counsel Chifumu Banda, argued that Mr Hichilema's statement of claim against her, lacks sufficient particulars to enable her to settle a meaningful defence. THE Norwegian government and Yara International have donated 2, 000 tonnes of fertiliser to selected smallscale farmers as part of the Covid-19 response. Yara International Commercial Director, Gabriel Peens, said the company was launching Action Africa Initiative with the goal to mobilise support for 250,000 farmers in seven African countries. He said Yara, through the Action Africa Initiative, was committing $25 million to provide food for more than one million people in Southern and Eastern Africa. And Conservation Farming Unit (CFU) Executive Director, Collins Nkatiko, said the organisation had already identified 20, 000 farmers to benefit from the donated farming inputs. Agriculture Minister, Michael Katambo, said the farming inputs were meant to alleviate food insecurity among the poor small-scale farmers. Speaking during the do-

He said farmers were not able to easily take their produce to markets of their choice or purchase inputs from outlets of their preference due to the imposed restrictions. Red locusts destroy 500 hectares Namibian grazing land, minister says WINDHOEK - Namibia is struggling to contain the second outbreak this year of the African migratory red locust, which has destroyed 500 hectares of grazing land in the north-east of the country, the country’s agriculture minister has said. At least 19 areas in the fertile Zambezi region, which borders Zambia, Zimbabwe Angola and Botswana, have been hit by a red locust outbreak since August 12, Agriculture minister Calle Schlettwein said in a statement. In total, 4,002 square kilometres have been invaded and 500 hectares of livestock grazing land destroyed, he said. The country needs around 30 million Nambian dollars

($1.77 million) for additional resources to contain the spread and enable aerial spraying, the minister added. Some neighbouring countries, also affected, are already spraying from the air, which Schlettwein said was driving the locusts to countries, such as Namibia, that have yet to do so. The outbreak follows another in February of the large, red-winged grasshopper species, which is common to sub-Saharan Africa. It breeds prolifically in conditions of drought followed by rain and rapid vegetation growth. Sophia Kasheeta, deputy executive director of the agriculture ministry, told Reuters the money needed could be sourced from the private sector, government “or anyone who can come on board.” So far the Food and Agriculture Organisation is among international bodies providing technical help and materials. – REUTERS.

Kenya mulls value addition on fresh produce NAIROBI - Kenya planned to enhance value addition on fresh produce like avocado and vegetables alongside tea to boost their competitiveness in the overseas market, a government official said at the weekend. Betty Maina, cabinet secretary in the Ministry of Industrialisation, Trade and Enterprise Development, said that actors in the horticultural value chains have been encouraged to set up infrastructure to boost value addition. “We really expect our manufacturing output to grow with greater focus being on value addition, I can confirm that we have exported frozen avocado to China in the last two months,” Maina said during a virtual briefing in Nairobi. “We believe that trade is the driver of our economy, consumers prefer pre-cooked products and value addition is the way to go,” she added. She said the market for frozen avocados originating from Kenya has been expanding in Europe and Africa. “We have a great opportunity to expand our market, we expect our output of manufacturing to grow every year,” said Maina. “One of the things that kept us going is our export that managed to revive itself

quickly. I know it is expensive to start it up but it is something that can be done by joint use of facilities and use it at a fee,” she added. Maina who was speaking during a webinar on the country’s export agenda 2020-2021 and how to build resilience for the export sector amid Covid-19 pandemic said that Kenya was working on a financing model to boost its exports portfolio. Too many taxes in Zambia overburdens people Dear Editor, THE Zambia Revenue Authority (ZRA) is a quasi government institution mandated to collect taxes from taxpayers every month. It is one thing to collect taxes from taxpayers and is another to overburden them as the case is at the moment. Our country has so many taxes imposed on taxpayers. Many entrepreneurs are facing some challenges to make profit owing to high competition on the market for instance. Worse yet, they have to pay different forms of

taxes. These taxes include turnover tax, value added tax (VAT), pay as you earn (PAYE), withholding tax among other forms of taxes. I recall vividly that fifth and late president Michael Chilufya Sata bemoaned high taxes in the country which impact negatively on people’s lives. His campaign was premised on lower taxes and more money in people’s pockets. This is no longer the case under the current regime. May his soul rest in peace. The government through ZRA had just introduced underground water and borehole tax whose motive is still unclear. As if this was not good enough, the government is in the process of taxing people in the informal sector preferably the marketeers. This doesn’t augur well as a matter of fact. Masala market reconstruction to start soon

THE construction of the Kapalala Market in Masala Township in Ndola will start in two weeks, the Ndola City Council (NCC) has confirmed. According to the council, this will involve the initial stage of constructing one market shelter at a cost of about K2.7 million which will take about two months. In August 2017, thousands of traders were left in shock after the vast market in the sprawling Masala Township caught fire and burnt everything to ashes. Council Public Relations Manager, Rebecca Mushota, told the Daily Nation that traders would move in as soon as the shelter was completed. “The Zambia Army has been contracted

and the funds have been raised from Constituency Development Fund for Kabushi constituency, part of the equalisation fund and a contribution from the Copperbelt Provincial Office,” she said. Ms Mushota explained that some of the material weere already on site ready for commencement of the project. She further appealed to the residents and traders to remain patient as the council was embarking on the reconstruction of the market. The Public Relations Manager advised traders to desist from using braziers in the market and leaving them unattended to. The residents have criticised the three leaders for alleged failure to honour their 2016 campaign promises. They said their leaders had never gone back to thank the people who voted for them or listen to their challenges. Speaking during a PF mobilisation meeting, Akafumba branch chairman Lloyd Muwowo said people were suffering as though they did not have leaders to speak for them. Mr Muwowo said the last time he heard Livingstone Member of Parliament Methews Jere speak in parliament, he was talking about rhinos in the Mosi-oa-tunya National Park forgetting about the people.

"If ZCCM-IH has any capacity, why did it ask for foreign partnership to operate a much less complicated gold mine than a copper mine? Why did it fail to

extract minerals from the black mountain but instead sold it?" he wondered. Mr Chanda said that the Zambians were not benefiting from the mineral resources because of how Government treated investors and not because of the way privatization was handled. He alleged that the Government had been ‘brutal’ with investors, instead of

engaging them in meaningful discussions. The UPND mines chairman argued that there was nothing wrong with the Mines and Minerals Development Act of 2015 that the Government was planning to amend. He said that what was wrong was the style of leadership and implementation of the Act in question. "As far as we are con-

cerned, as a country we do not know who is financing the operations at KCM and we do not know whether KCM is running profitably or not," Mr Chanda said. He however stated that the bottom line was that the asset book value was going down as there was no corresponding recapitalization. He said that during ZCCM era, miners, contractors and suppliers were

paid on time but that the asset book value was going down due to inadequate recapitalization. Mr Chanda said that those who were excited about buying shares in the mines should understand that a dividend was not paid like a monthly salary. He said that Mufulira and Nkana mines were old mines and were therefore expensive to run profitably.

PLAYERS in the Tourism sector have welcomed Government's decision to introduce tax incentives in the 2021 national budget. Industry players said the incentives would work towards revamping tourism, which had heavily been affected by the effects of Covid-19. Tourism specialist, Rose Musonda, said the incentives in the budget were timely as they would allow the sector to recover from the shocks suffered at the peak of the COVID-19 outbreak. Ramaphosa cracks whip JOHANNESBURG President Cyril Ramaphosa has cracked the whip, reprimanding Defence Minister Nosiviwe MapisaNqakula and docking three months’ salary over the ANC junket to Harare on an air force jet earlier this month. In a statement late on Saturday, the Presidency said starting from November, Mapisa-Nqakula’s salary would be paid to the Solidarity Fund for the next three months. “The president has further sanctioned the minister by imposing a salary sacrifice on the minister’s salary for three months, starting from November 1, 2020. “Her salary for the three months should be paid into the Solidarity Fund, which was established to support the country’s response to the coronavirus pandemic,” the statement noted. Ramaphosa took it a step further, indicating why he had taken tough action against the minister for her “error in judgment.” “He (Ramaphosa) found that the minister did not ‘act… in the best interest of good governance’ as required by the Executive Members

Senior election official Wilson Mahere said the allegation was meant to paint a picture that the poll would not be conducted in a free and fair atmosphere. The registrar of political parties has also written a letter to Lissu's Chadema party, saying his remarks posed a threat to national security. BOUT World Heart Day: In May 2012, world leaders committed to reducing global mortality from non-communicable diseases (NCDs) by 25 percent by 2025. Cardiovascular disease (CVD) is accountable for nearly half of all NCD deaths making it the world’s number one killer. World Heart Day is, therefore, the perfect platform for the CVD community to unite in the fight against CVD and reduce the global disease burden. Created by the World Heart Federation, World Heart Day informs people around the globe that CVD, including heart disease and stroke, is the world’s leading cause of death claiming 17.9 million lives each year, and highlights the actions that individuals can take to prevent and control CVD. It aims to drive action to educate people that by controlling risk factors such as tobacco use, unhealthy diet and physical inactivity, at least 80 percent of premature deaths from heart disease and stroke could be avoided. World Heart Day is a global campaign during which individuals, families, communities, and governments around the world participate in activities to take charge of their heart health and that of others. Through this campaign, the World Heart Federation unites people from all countries and backgrounds in the fight against the CVD burden and inspires and drives international action to encourage

U-15 soccer team back from Croatia By SPORTS REPORTER ZAMBIA’S Under-15 national team yesterday returned from Croatia after competing in the eight-team “Zlatko Markovic” Invitational Tournament. And FAZ general Secretary who met the team expressed delight that the boys were back safe and that he was looking to receiving the other two (players) plus the doctor getting back very soon as well. Zambia finished fourth but could however not play their third and fourth play-off against Qatar as two Zambian players tested positive to the coronavirus. The two players have since been isolated and remained behind with a team doctor and would only fly back once Covid-19 procedural guidelines were met. And
