S the 90-day notice to suspend operations comes to an end this month at Mopani Copper Mines, stakeholders in the mining industry have described as worrying the silence over the future of the mining firm. Stakeholders said they are not comfortable with the lack of information on matters surrounding the future of the mining firm. The Glencore-owned copper mine in April this year placed Mufulira and Nkana units on care and maintenance citing economic challenges and the outbreak of the Covid-19. However, the firm back pedalled after Government intervened, but tendered a 90-day notice to place the assets on care and maintenance again. Association of Mine Suppliers and Contractors president, Augustine Mubanga, told the Daily Nation in Kitwe

that there was urgent need for Government and Mopani to advise the way forward. "We need to know so that we can all have the knowledge on the way forward. Let the government quickly make available the decision it has made so that stakeholders are aware of what is going on regarding this matter," he said. Mr Mubanga observed that the silence only brought uncertainties among stakeholders as far as the current position was concerned.

In a separate interview, Mineworkers Union of Zambia (MUZ) president, Joseph Chewe, said that Mopani and Government's silence was creating anxiety among workers and other interested parties. "It is time that Government said something on the matter before a bad message is sent to some individuals and organisations dealing with the mines," Mr Chewe said in Kitwe yesterday. Mr Lungu called for patience among stakeholders owed money as the debt would be settled in full once the liquidation process was over. “I also would like to advise our stakeholders that KCM management is indeed focused on ensuring continued production in order to maintain the company as a going concern and meet its immediate obligations as the government continues with the process of seeking a new strategic equity partner for Konkola Copper Mines,” Mr Lungu said.

Modern Maina Soko Hospital nears completion By SIMON MUNTEMBA THE construction of the modern specialised Maina Soko Military Hospital in Lusaka is nearing completion. And Government has expressed happiness with the works done on the multimillion health facilities so far by an Israeli contractor, Ashtrom. Speaking when special assistant to the president for project implementation and monitoring Andrew Chellah inspected the project yesterday, Ashtrom Zambia managing director, Guys Gross said the project had reached 95 percent completion. Mr Gross said all the constructing works were done on the modern 250-bed capacity hospital and only installation of equipment were being done. He promised Mr Chellah, who was accompanied by Ministry of Defence Permanent Secretary Felix Phiri that the project would be

handed over to government next month. Meanwhile, Mr Chellah said he was impressed with the works. Mr Chellah said the multi-million health facilities would go a long way in the provision of specialised health services to Zambians and reduce expenses of sending patients abroad for specialist treatment. Mr Chellah also urged the Zambian contractors to acquire skills and knowledgeable transfer from the foreign contractors as a way of enhancing their capacity in the industry. By BUUMBA CHIMBULU OVER K25.7 million has so far been collected from mobile tax payment solutions in the last three years by the Zambia Revenue Authority (ZRA), as the organisation launches Tax on WhatsApp Payments. By the end of last month, over 52, 000 transactions had been made through the mobile tax payment system, translating into revenue collection of more than K25.7m since 2017. ZRA Commissioner General, Kingsley Chanda, said they first implemented the mobile tax payment solutions in April 2017. Mr Chanda was speaking in a speech read for him by ZRA Commissioner Customs, Sydney Chibbabbuka, yesterdayin Lusaka during the launch of the tax on WhatsApp Payments. At the same function, ZRA signed a Memorandum of Understanding with 534 Konse Konse and Investrust Bank for the implementation of the online tax payment solutions. "Currently, over 90 percent of our payments are online and we hope this product we are launching today will push to a 100 percent online payments," Mr Chanda said. He said taxpayers would be able to pay their taxes directly from their phones using the Tax on WhatsApp which automatically linked to either mobile money account of bank account. Mr Chanda explained that the innovations was aimed at supporting already existing payment platforms. The platform, he said, was part of the agenda to make tax payments easy for taxpayers. Investrust Managing Director, Simangolwa Shakalima, said the partnership with ZRA would enable customers make domestic tax payment through their mobile phone using WhatsApp amid the Covid-19 crisis. “This innovation we are bringing in is convenient to our customers and it could have come at a better time in the Covid-19 environment and as Investrust we are really proud of this partnership in the sense that some investment we have done in improving our digital channel is now bearing fruits,” Mr Shakalima said. And cGrate Zambia (543 Konse Konse) Managing Director, Kelvin Chikomo, said the partnership with ZRA was significant as there were no more excuses that the tax payment process was cumbersome and laborious.

Pastor Chanda said it was prudent that the ACC became professional in its operations. Pastor Chanda said President Edgar Lungu was correct that the fight against corruption was selective and targeted at government officials with intention of compromising government under his leadership. He said both the ACC and DEC are compromised because they are just targeting certain individuals who have not even indulged in corrupt activities, leaving some opposition leaders who had put the economy in a mess

during privatisation through the dubious sales of national assets. Pastor Chanda claimed the two institutions were prosecuting innocent people who had acquired property genuinely. He said in serious cases like the mysterious 48 houses and the sale of Intercontinental Hotel, the two institutions had failed to investigate or prosecute those who were involved. Pastor Chanda said there was evidence on these two cases but the only thing they were focusing on was to scandalise those in the ruling party. He said the behaviour exhibited by the two institutions showed that they were becoming irrelevant to the Zambian people. And former Vice President Enoch Kavindele said it was shocking that the ACC has left

Meanwhile, Zambia Republican Party president Wright Musoma has charged that it is hypocritical for UPND to comment on sale of any property in Zambia when they have failed to explain how some of their leaders enriched themselves from the privatisation of state assets. Mr Musoma said it is hypocritical for UPND to suggest that it would be too expensive for NAPSA to buy Chrismar Hotel. "It is a viable business because it's not like how a known opposition leader sold Intercontinental Hotel at $5m when there were higher bidders just because he also wanted the hotel," Mr Musoma said. He said in as much as there was no deal yet for the sale of

Chrismar Hotel, it would be a move in the right direction for NAPSA to buy the hotel because it was a viable business. Mr Musoma said it defies logic for the UPND to comment on the sale of any property because the country still awaits answers on how state property including Intercontinental Hotel in Livingstone were sold at giveaway prices. He said the UPND, which always want to politicise everything including straight forward issues, should first of all explain to the nation how their leaders suddenly became rich. "UPND has once again shown their ignorance and hypocrisy by trying to comment on issues that some of their own leaders have failed to explain," Mr Musoma said.

ECZ stands ground on voter registration By GRACE CHAILE-LESOETSA THE Electoral Commission of Zambia (ECZ) says restricting voter registration for the 2021 elections to 30 days is not a breach of the constitution. Chief electoral officer, Kryticous Nshindano, said that the registration of voters and prescription of the cut off dates in respect to the registration of voters and the compilation of the register of voters was prescribed under the Electoral Process Act number 35 of 2016. This is in response to the petition filed by Chapter One Foundation, which was asking the Constitutional Court to make an order mandating the state to implement the mobile issuance of National Registration Card (NRC) throughout the country as well as an order for the ECZ to carry out continuous voter registration between elections. Chapter One Foundation argued that Government violated the Constitution by implementing the issuance of NRC in a manner that contravenes the Constitution.

THE Lusaka City Council has called for a meeting with aggrieved residents of PHI opposed to the development of a shopping mall. It is being constructed by a Chinese firm on land under the Zesco pole lines near the Praise Worship Centre in Lusaka. The land belongs to the Chainama Hospital on which the Presidential Housing Initiative was allowed to build structures following extensive invasion by squatters. A senior PHI official told the Daily Nation that strict instructions were given by Zesco to distance the housing development from the pole lines and a fence was subsequently constructed to stop any development.

In an invitation letter addressed to the PHI Neighbourhood Watch Committee, Lusaka Town Clerk, Alex Mwansa said the meeting was called to hear concerns of both the residents and the developer. Mr Mwansa said the meeting will be held today in the Council Chamber at 14 hours. “Following media reports that the residents of PHI residential area opposed the development of a shopping mall on the land reserved for other services, Council has decided to invite you and the developer to a meeting to hear the concerns of both parties,” the letter reads in part. Residents recently blocked the Chinese developer from constructing a shopping mall on land dubiously allocated by the Lusaka City Council. The residents have mounted security

to ensure that the developer did not have access to the land. Lusaka City Council Public Relations Manager, George Sichimba, confirmed that the Chinese developer had rights to the land because he had title deeds from the Ministry of Lands. But Ms Jacqueline Chishimba, a member of the PHI neighbourhood watch said the council refused to sell the land in question to residents to set up a youth centre. The council, she said, advised that the area was not safe because it was under Zesco pole lines but surprisingly the local authority sold the same plot to a Chinese firm to construct a mall. Lands Minister Jean Kapata also said the ministry would investigate the sale.

Financial fraudsters ‘clipped’

FINANCIAL sector regulators have launched a campaign aimed at protecting the public from fraudulent financial products such as pyramid schemes in the different ways they are offered. Pensioners, farmers, workers and entrepreneurs have been targeted in different ways, with some losing their money, including life savings, such as pensions to unlicensed entities on the promise of high returns. The Bank of Zambia, Pensions and Insurance Authority, and Securities and Exchange Commission launched the Financial Sector Joint Messaging Communication Campaign yesterday in Lusaka. The campaign, which will run for 12 months on various media platforms including social

media, will cover topics such as digital financial services, network marketing, insurance services products, pyramid schemes and cryptocurrency, among others. In a joint statement, the regulators expressed concern that the public fell prey to fraudulent financial products and misleading investment adverts offered by entities operating outside the ambit and supervision of the three financial regulators. The regulators believed that fraudulent financial activities perpetrated by unlicensed entities could not thrive in an environment where members of the public were well informed about various financial products and services. “It is, therefore, our hope that this Campaign will equip our citizens with the information needed to make informed and

The regulators encouraged the public to take an interest in this campaign to learn more about how they could secure their money, and to only deal with registered financial service providers. “This is consistent with the National Strategy on Financial Education in Zambia, which seeks to empower citizens with sufficient knowledge, understanding, skills, and confidence to make prudent financial decisions for themselves and their families,” the regulators said.

THE disclosure by Agriculture Minister Michael Katambo that some millers are lying low instead of being in the market place stocking up on maize for their milling plans makes sad reading. It makes sad reading because they are doing so as they want to reap where they did not sow – all this is due to greed. And we feel it is this spirit of greediness that must be exorcised from their mentality – even if it means running them out of business. According to Mr Katambo, some millers are reluctant to buy maize because they think the Food Reserve Agency (FRA) will come to their rescue when they run out of maize. Mr Katambo said Government had noticed that some millers were reluctant to go on the market to buy maize. "In view of this situation, Government wishes to strongly advise the millers that are reluctant to buy to start buying and stop thinking that the Food Reserve Agency will come to their rescue," Mr Katambo said. Mr Katambo cautioned all millers that were seeking to access maize from the FRA that they would not receive any support at the expense of the millers and grain traders that had invested their own money and buying maize from farmers. It certainly would be unfair to those millers who are buying maize on the open market and incurring costs to compete with their colleagues banking on obtaining subsidised maize. Mr Katambo pointed out that Government will not entertain any opportunistic behaviour from millers as they will result in market distortion which will affect the investment that has been made by genuine players in the industry. Millers who are not buying maize on the open market should in fact be warned that this time round, they will not be in a position to play tricks with the government. We believe that before the end of the year, the milling plants set up under the Zambia National Service will be in full production – and we all know that the institution is capable of growing its own maize. And if anything, we would rather the FRA releases maize to ZNS-run milling plants knowing full well that the end consumers will not pay through the nose. Private milling firms ought to be reminded that much as the government has set up an enabling environment for them to operate that will not entail giving them “free” maize. We would have thought that every serious miller would by now have people in the market place buying maize for their milling firms, and ensure they have enough stock until the next season. But nay. They are playing tricks with the government knowing very well that when there is no maize to buy on the market and the price of mealie meal shoots up, the State will intervene. They have been there before and they know how to manipulate the system. After all, that is what happened last year. When the price of mealie meal shot up to abnormal levels, threatening social upheaval in the nation, Government was forced to step in and release maize from the strategic reserves held by the FRA at subsidised prices. We are happy that the minister has stated in no uncertain terms that the millers must stop thinking that the FRA would come to their rescue for their failure to buy maize during this marketing season. As the minister noted, the maize the FRA holds can only be released when there was a shortfall in the country. We do not think this will suffice having had a bumper maize crop this season though - definitely not because of being greedy. That will be living off the poor farmers who sweat to produce the maize. Simply put, they must not expect to reap where they did not sow. Government should in fact blacklist such millers and only allow genuine ones to access maize from FRA should the need arise. All milling firms should be buying maize on the open market as a liberalised economy entails. That will ensure fair competition among the milling firms and even help separate the men from the boys in the business.

IT is wishful thinking for the opposition to predict that the PF will be out of Government in 2021, Patriotic Front (PF) vice chairperson for mobilisation Geoffrey Bwalya Mwamba has said. He said UPND would be defeated in the 2021 general elections because it had leaders who were political nonentities. Mr Mwamba said the ruling party national mobilisation team had gone flat out to dismantle all the UPND structures across the country. He said in an interview yesterday that many UPND members, including influential individuals, had decided to join the ruling PF because the opposition parties had leaders who had no direction. Mr Mwamba said it was therefore

Zambia has not recorded any deaths in the last 24 hours, but posted 142 new cases of COVID-19 out of 794 tests done. This brings the cumulative number of COVID-19 cases in the country to 9,981. No death was recorded while 20 recoveries were recorded bringing the total number of recoveries to 8, 776. Health Minister, Chitalu Chilufya, said during the daily update on the pandemic that the ministry would continue sensitizing members of the public on the health guidelines. Dr Chilufya emphasised the need for people to avoid public places and to always observe social distancing amongst other preventive measures to save many lives. “It is however sad that we have continued to record positive cases among health workers countrywide. But we will continue to fight as a ministry to ensure that the

And speaking during the same update, Home Affairs Minister Stephen Kampyongo said it was unfortunate that people had to wait for punitive measures for them to protect their own health. 14 Chingola churches shut By SIMON MUNTEMBA CHINGOLA Municipal Council (CMC) revoked gathering permits in 14 churches and closed down two bars at the weekend Council Assistant Public Relations Manager, Donna Mbalwe, said the exercise was conducted to monitor adherence to permits for public gatherings. He said the council was also mandated to check if bars were operating illegally amid the ban during the Covid-19 pandemic outbreak “The activities that took place on 14th August, 2020 by the health inspectors targeted the bars and on Saturday and Sunday the activities which were targeted were weddings, chilanga mulilo, marriage blessings and church gatherings,” he said. The premises were inspected and monitored for compliance to Covid-19 guidelines. He said the inspectors found children below the age of 12 years not observing social distancing Mr Mbalwe said the church gathering permits were revoked because some services exceeded one hour and there was no hand washing facilities at the entrances. “Churches were charged a penalty of 750 and out of 14 which were charged, six had paid and eight were yet to pay to the council, while one bar has paid 1, 000 for operating illegally and one is yet to pay,” he said.

Maintain 9.25 p.c. monetary rate, BoZ urged By BUUMBA CHIMBULU THE Centre for Trade Policy and Development (CTPD) expects the Monetary Policy Committee to either maintain the benchmark for lending money in the financial market at 9.25 percent or reduce it to supplement efforts in curbing the effects of Covid-19 on the economy. The MPC will today announce its monetary policy rate, a benchmark which will give a direction on interest rates in the financial market. CTPD Researcher - Public Finance, Mataa Wakumelo, said the negative economic outlook on which basis, the committee lowered the policy rate in its last sitting had not registered any improvement in the period under review. Mr Wakumelo recommended that

He indicated that disruptions in business operations due to the pandemic had continued to negatively impact on productivity and ultimately weigh on economic activity.

Mr Wakumelo explained that this was exacerbated by the persistent effects of load shedding, albeit rising production costs stemming from, among other factors, high energy prices and the sustained depreciation of the Kwacha per dollar exchange rate.He also said the significant part of the prevailing inflation was more premised on supply constraints than it was driven by demand pressures. Mr Wakumelo attributed this to private sector activity which had continued to be stifled by liquidity constraints associated with higher debt service payments necessitated by the depreciation of the exchange rate over the review period. “It is therefore CTPD’s expectation that the committee relaxes its stance by either maintaining or reducing the policy rate,” Mr Wakumelo said.

HOME affairs minister Steven Kampyongo exercised leadership by condemning the transfer of a traffic officer who was captured in a video circulating on social media, PF Chief Media Administrator for social media Erasmus Mukondo has said. A video went viral on social media involving a traffic officer in an altercation with a suspected PF cadre. Deputy Inspector-General of police, Bonny Kapeso, is reported to have transferred the woman. Mr Mukondo said that Mr Kampyongo reacted in a fatherly manner by condemning the transfer of the officer in question by Mr Kapeso without investigating the matter. Meanwhile, Mr Mukondo has implored civil servants to avoid passing political opinions. He said that civil servants must be non-partisan and avoid any altercations with political cadres as they risked being labelled as cadres or belonging to a certain party. Mr Mukondo however condemned the suspected cadre for dragging the name of the President in a personal misunderstanding. He said that the PF not support any violent act by its members adding that any misunderstanding at individual level should have nothing to do with the party. “It is very embarrassing, altercation was at individual level so it had nothing to do with the party, and the name of President should not be dragged in personal matters. “On the other hand the alleged cadre should not have uploaded the video on social media, since he had evidence he would have handled it professional. OLICE Inspector General Kakoma Kanganja has directed the suspension of the K750 fine and arresting of people disregarding Covid 19 preventive measures such as wearing of masks. Speaking in an interview after the launch of the point of sale machines by Zambia Police Service in partnership with Zanaco bank at Lilayi Police Training College Mr Kanganja said it has come to his attention that some officers who were deployed on the streets to enforce Covid-19 rules have been abusing this provision. Mr Kanganja said the suspension of the fine does not mean people should throw away their masks but to continue with all covid-19 health guidelines. PRESIDENT Edgar Lungu will easily retain power next year as the country goes to the polls because his works are visible and appreciated by many Zambians, says a top Patriotic Front (PF) official. PF Lusaka Province secretary Kennedy Kamba said the campaign for change of government being propagated by the UPND was a mere exercise in hallucination because they realise President Lungu and the PF were popular and loved by the general citizenry on the ground. Mr Kamba was reacting to sentiments by the UPND president, Mr Hakainde Hichilema who was quoted in some sections of the media as claiming that there was gloom and doom in the country because the PF does not know its purpose and UPND was the only alternative party to revive the country. Drowning in debt, seeking multiple jobs

JOHANNESBURG - South African employees are taking second jobs and using expensive short-term loans just to make it through the month, a new survey reveals. The research was released on Monday by PayCurve, a financial technology platform which allows employees early access to a portion of their earned income ahead of payday. It points to “a nation struggling to stay afloat,” with most employees surveyed unable to make their income last even until month-end, according to Tamir Sacks, CEO of PayCurve. Sacks said a “representative sample” of 500 South Africans aged from 16 to 65 and earning a salary each month, was surveyed, and the results reflected how severely financially stretched

The survey found that emergency expenses, such as car repairs and unforeseen medical bills, accounted for 31 percent of respondents’ additional funding needs, while eight percent of respondents said the extra funds would be used for educational expenses. Most of the respondents who needed financial help in meeting these costs were aged between 36 and 45. Almost half of those surveyed said they were being forced to take a second job - if they were lucky enough to find one - to make it through to the end of the month. Nigeria's $1.5bn World Bank loan delayed over reforms, say sources ABUJA/LAGOS - The World Bank is unlikely to approve a much-needed $1.5 billion for Nigeria this month as planned due to concerns over desired reforms, three sources familiar with the talks have said. A delay in financing from multilateral lenders could leave Africa’s biggest economy and top oil producer, battered by low crude prices, unable to fully finance a record 10.8 trillion naira ($28.35 billion) budget. The central bank has said Nigeria’s balance of payments gap this year will be $14 billion. The World Bank, which has said Nigeria could be heading toward its greatest fiscal crisis in 40 years, had aimed to bring the loan to its board for approval this month, but the sources said negotiations over what Nigeria will do to secure it were incomplete. “They are not convinced about the reforms,” a source close to the government said. All three sources declined to be named due to the sensitivity of the negotiations. The source added that the currency was the core issue. World Bank loans are often contingent upon reforms. It has not outlined any demands,

but said previously that it was “recommending” a more unified, flexible exchange rate. Fuel subsidies and electricity tariffs are also being discussed. Another banking source said the loan could now not be approved until October. Nigeria’s finance ministry directed queries to the World Bank. The greatest mistake you can make in leading a nation is to think that managing a nation is about a better economy where people have money and eat well and all. While that is important, the truth is leading a nation requires more competencies than just money. This is why HH is not anywhere fit to lead a nation, let me highlight a few key competencies of leadership at national level. (A) FORGIVENESS It may sound awkward but for a nation to move foward and well requires that the president can and is able to forgive and HH has clearly demonstrated lack of a forgiving heart and is bent to pay evil for evil while President Lungu has demonstrated extreme tolerance and forgiveness towards humanity like forgiving and promoting Miles Sampa and GBM, great leadership to admire. (B) HUMILITY They say great leaders behave like they don’t have authority even when they have it and that is exactly who President Lungu is, many of you think he is weak and fails to use his power and

In the management of public finance, the funds are managed by public officers and not politicians, yet only PF politicians have been pursued. Little do we hear the names of erring technocrats pronounced louder than the trumpets blown on politicians. There a numerous technocrats who have been found wanting, a vindication that technocrats control the expenditure programmes in the operations of Government therefore can know better than politicians. A very good example can be deduced from facts such as the Henry Kapoko case as well as the former Ministry of Finance employee who has been caught in a web of ownership of the controversial 51 houses. Even the allegations of improper land allocation, it is inconceivable to assume that everything can take place without the involvement of Directors at various local authorities. However, only politicians were suspended yet no known administrative action taken against Town Clerks and their Directors. As Head of State and Commander in Chief of the Armed Forces, President Edgar

Lungu is bestowed with the responsibility to exercise parental jurisdiction and maintain an oversight role over public institutions. Where necessary, he can express discontent. It is in the exercise of this noble and constitutional responsibility that President Lungu in his unique wisdom deemed it fit to express his concern in a manner the Anti-Corruption Commission was handling politically-charged complaints. The ACC has earned its reputation as the Anti-Politician Commission. On a number of times, there has been a number of nonpolitical actors that has fallen in the realm of public concern. We have observed that there has been immense dedication to proactively pursue the perceived inner circle and allies of the Presidency. Unless there was adherence to the timely and well researched parental guidance, the public confidence in the institution is likely to be eroded. Like we have noted, other oversight institutions such as Public Accounts Committee, the Auditor General and Financial Intelligence Centre among others cited financial malpractices by nonpolitical actors. To the best of our recollection, ACC has been reluctant to give the cases the same publicity they give to politically-charged complaints. Just like any other institution, we do not take pride to see its impartiality being brought into ridicule.

With the recent developments which has seen President Lungu’s lieutenants fall in the web of their investigatory mandate, this is seen to be a stage-managed ploy to misuse criminal procedures to fight the people walking the corridors of power. For example, when one high ranking Government official is arrested, there are always calls by the notable and partisan adversaries of the Presidency who call for the suspension of the accused persons. Had President Lungu not stood his grounds, by now he would have lost nearly his entire cabinet on the pretext if letting the law to take its course. We will continue offering checks and balances to the state investigative agencies and resist any apparent attempt to make governance grind to a halt. We therefore wish to rally behind President Lungu and his concerns are genuine. The onus is on the concerned institutions to take this guidance seriously to redeem the trust of the public. Dr Dube said some members of staff had tested positive to the virus and hence authorities decided to fumigate the premises in Bushi Township "We have not completely closed the offices, what we are doing today is fumigating the premises so that it is safe for all of us," he said. The money was released to the traders through Member of Parliament Frank Ng’ambi at the weekend. Lake Kariba water level drops By ANDREW MUKOMA

WATER levels in Lake Kariba has continued to recede after attaining a peak level this year of 481.30 meters on June 30. The dam recorded 26.94 Billion Cubic Meters (BCM) of stored usable water, 41.57 percent live storage. Zambezi River Authority (ZRA) chief executive officer, Munyarazi Monodawafa, announced that the recorded lake level on August 13, this year was 480.87m, with 24.84 BCM of stored usable water (38.3 percent live storage). ZRA said of this 24.84 BCM usable storage, only 7.3 BCM was the available balance from the 2020 water allocation. Mr Munodawafa said the water level put the lake at 5.37 meters above the Minimum Operating

Level (MOL) of 475.50m. Last year on the same date, the lake was only 3.17m above the MOL having registered a lake level of 478.67m with 14.40 BCM of stored usable water (22.16 percent live storage). Further, the Zambezi River flow recorded at Chavuma continued to recede as per historical trend, which was seen from the last highest peak flow attained of 58258 meter cubic per second (m3/s) recorded on February 25, this year to a river flow of 201 m3/s recorded on August 13, 2020. He said that in line with its mandate, ZRA would continue to monitor the hydrological outlook of the Kariba catchment and make necessary adjustments in the reservoir operations. This is to ensure continued availability of water for power generation operations at Kariba.

GARBAGE collection in Livingstone has become a challenge following the breakdown of the only front-end loader at the local authority. As a result, the local authority had been relaying on goodwill from the Zambia National Service loader for garbage collection. The situation has seen growing heaps of garbage mostly in high-populated townships such as a Zambezi Sawmills, Dambwa Site and Service, Kashitu, Nakatindi, Linda, Ngwenya and Libuyu. Simonga Ward Councillor Peter Munyama said the situation was posing a health hazard in the community. Mr Munyama noted that residents had been cleaning but the garbage being generated was not collected. He said during a meeting at the council that residents

Fuel importation: is it properly being monitored …smuggling of the commodity reaching alarming levels By BRUCE KAEMBA

I

T is a well known fact that fuel plays a vital role in driving the development of a country. This is why many countries, if not all, have priotised the production, supply and distribution of this important commodity and have readily available facility or facilities which are solely put up to ensure that this commodity is always available at any given time. However, just like in any other sector, the energy sector in Zambia is overwhelmed with so many challenges, chief among them the influx of unscrupulous fuel dealers who are engaged in all sorts of shoddy deals which include fuel-fraud, smuggling, adulteration, under-invoicing and outright theft of petroleum products. According to available statistics, these illegal business practices in this sector costs Africa, as a whole, a whopping US$100 billion each year, apart from draining nations of the much needed tax revenues. To mitigate this problem, several pan-continental and national efforts have already been put in place. Countries like Mozambique, Tanzania and Uganda have demonstrated that a unique identification marker can enable the tracking of fuel products across the supply chain, and help identify adulteration points and contraband fuel, thereby guaranteeing tax compliance. Such fuel marking technology has led to significant increase in tax revenues from fuel products in these countries, along with a drop in the adulteration rates and an overall improvement in product quality. Their positive experience could serve as a blueprint for other countries like Zambia to emulate, formulate and implement anti-illicit fuel trade systems. In Zambia, the institution charged with the responsibility of monitoring the use and consumption of fuel and ensure that this commodity is regulated and monitored to curtail its misuse or abuse is the Energy Regulation Board (ERB), established under an Act of Parliament. The ERB was established by the Energy Regulation Act, no. 16 of 1995. This Act was amended by the Energy Regulation (amendment) Act no. 23 of 2003. Tied to this is the National Energy Policy (NEP), which is the main energy policy document in the energy sector, guiding changes and developments in the sector. The policy document contains measures for each energy sub-sector and outlines strategies for implementation and identifies the legal framework required to

implement the policy. Of equal importance in this sector is the presence of the Tazama Pipelines Limited. The pipeline is a 1, 704-kilometre facility running from the tank farm at Kigamboni in Dar-es-Salaam to the refinery at Ndola in zambia. This provides pipeline transportation of feedstock to the refinery and is a natural monopoly. Tazama is also managing the feedstock on behalf of government in an agency arrangement while Indeni Petroleum Refinery Limited is the only refinery in the country.

SAMPLE In normal circumstances, the importer is required to sample the fuel for conformity to the Zambian standards prior to offloading and distributing on the market. This is necessary to guard against compromised product quality. On the other hand, Oil Marketing Companies (OMCs) who also play a vital role in this sector, are vertically integrated in the distribution and retail business of fuel while at the tail end are dealers as suppliers to retail customers. This market is final in nature as retail customers buy the petroleum products for final consumption. The market is characterised by many suppliers and many buyers, collectively creating a competitive market structure. This is potentially the flash point where smuggling of the commodity starts, as some of the OMCs, and they are many in Zambia, have a questionable background or are indeed a smoke-screen of some unscrupulous dealers involved in the business of fuel. The distribution of fuel and petroleum products is mainly done by road transportation meaning there is enough room for unscrupulous fuel dealers to moot out plans on how to move the consignment of this product fraudulently. Little wonder then that, in September 2010, the government announced the introduction of a Uniform Petroleum Pricing (UPP) mechanism in the country apparently in the hope that these measures would somehow reduce the incidences of smuggling. In the same year, the ERB implemented the UPP mechanism and announced the new countrywide prices that took effect at

midnight the same day. Though the ERB has adequate legal framework mechanism backing its operations, the energy regulator has been unable to stop the rampant smuggling of fuel in the country. Actually the trend is increasing and is having a negative effect on the government’s ability to collect revenue from this important sector. The ERB has on several occasions merely expressed concern at the rise in reported incidents of fuel being smuggled into the country and has reaffirmed its commitment to ensure that smuggled fuel is not offloaded onto the local market. Following recent media reports of smuggling of fuel, the ERB has as a matter of urgency instituted investigations to ascertain possible breaches of licence conditions by the affected parties, as well as assure strict adherence to quality specifications. In the same year 2018, ERB rolled out a fuel marking, as an intervention that would help tackle challenges regarding fuel marketing and trade by focusing on among other areas; Minimise dumping and smuggling of tax exempt and/or transit petroleum products onto the domestic market. It is a well known fact that dumping or smuggling entails tax evasion thus defrauding the government of due taxes on petroleum products. It must be emphasised that smuggling of fuel into the country not only deprives Government of the much needed revenue but also puts at risk the quality of fuel on the market. This is because the quality of smuggled fuel cannot be guaranteed as it is not subjected to checks to verify compliance to set standards. Unlike smuggled fuel, legally imported fuel is supposed to be checked for conformity by way of a certificate of quality submitted to the Zambia Bureau of Standards (ZABS) at the point of entry into Zambia but this exercise is either deliberately being overlooked or is omitted from the clearance process. In normal circumstances, the importer is required to sample the fuel for conformity to the Zambian standards prior to offloading and distributing on the market. This is necessary to guard against compromised product quality. But as it has already been established that a large amount of the fuel distributed in the energy sector is being off-loaded illegally on the market, the aspect of good quality fuel which meets all the required standards, finding its way on the market is almost nil. This could definitely be attributed to the fact that some of the players who find their way in this sector are engaged in rampant acts of smuggling of fuel and their reputation and business

profile are highly questionable. Agreed, some of the fuel dealers in the sector are doing their best and are transparent and accountable in the way they conduct their business and are genuinely declaring their profit margins to the government thus contributing to the Treasury accordingly. However, the current upsurge in the number of OMCs and filling stations in the country means a corresponding increase in the number of cases of fuel being smuggled into the country because, as earlier indicated, some of them are eager to cash in by taking advantage of the laxity or lack of seriousness on the part of the institutions responsible for monitoring the consumption of fuel in the country. Evidently the amount of fuel being consumed on the Zambian market is not commensurate with the amount of fuel which is coming into the country. This is clearly a paradox and could only be attributed to the increase in the number of unscrupulous OMCs and filling stations. This is the reason why imported fuel which is meant for consumption in the neighbouring countries of Zambia, has ended up being decanted within the country despite the importers declaring that the fuel was in transit to another country. This modus operandi by un-

somehow managed to evade the dragnet by among other things giving false information to the clearing agents through documentation showing that the fuel was in transit but somehow ended up being consumed within the country. One interesting aspect is how easy these importers manage to easily find the market for this commodity locally despite the ZRA declaring and rating it as a high risk commodity, in which case, it is inevitably expected that the revenue collector would have in place a robust and highly pro-active mechanism to ensure that fuel on rit (removal in transit) does not find its way on the Zambian market. The question therefore remains: Does the ZRA have an effective strategy in place to monitor the fuel or indeed any other high risk goods which are transiting Zambia? History is replete with many monitoring strategies which ZRA introduced in the past to help curb the vice of smuggling fuel but all have lamentably faltered in one way or another. Now the ZRA has introduced the use of the drones to help in the fight against smuggling. We are yet to see how effective this mechanism will be. Another over-arching aspect of this increase in the cases of smug-

scrupulous OMCs and some owners of filling stations has impacted negatively not only on the clearing agents, who accordingly and unsuspectingly clear the commodity at the port of entry but, ended up being entangled in a web after the importer fraudulently decides to offload the commodity within the country, as opposed to its final declared destination. This illegal practice has also robbed the government of the much needed revenue, as these dealers evade paying tax to the Zambia Revenue Authority (ZRA). Monitoring the movement of fuel has been a thorny issue and a nightmare on the part of ZRA, as the unscrupulous importers of this commodity have always

Are their clients, who are running the many mushrooming filling stations, dotted across the country part of the rings of unscrupulous fuel dealers? These and many other questions will remain unanswered until such a time Government goes deeper and unmask who really these dealers are and deal with them accordingly, only then would we be protecting the relevance existence of Indeni and Tazama Pipeline. Truth be told, these unscrupulous fuel dealers are having a field day in that despite them buying

fuel on the black market without paying duty on it while selling it at the same price with other dealers who are paying customs duty. One can only imagine how much profit they are making. As things stand now the ZRA appears to be highly ill-equipped to undertake this gigantic task of putting an end to fuel smuggling, as their current strategy which is mainly anchored on motor vehicle patrols is inadequate. This inadequace is demonstrated by the revenue collector’s aggressive barking at the wrong tree, who happens to be the declarant also known as the clearing agent whose role is to merely facilitate the clearance of any cargo that arrives at the border. In this case, it is most unfortunate and unfair for the ZRA to hold the clearing agent responsible for any undervaluation or wrong declaration, as he simply conveys declaration given to him by the importer to customs. Therefore any queries raised by customs over the cargo cannot be answered by the clearing agent without consulting the importer. The fact that the ZRA is quick to punish the clearing agent in an event that an act of smuggling of fuel or indeed any other cargo is discovered, is an indication that the revenue collector is unable to put this vice to a stop by getting to the bottom of who really is the culprit. This therefore entails that the government, through the Ministry of Energy, needs to step in and fill this grey area in the operations of the ZRA by ensuring that all matters related to smuggling of fuel are dealt with decisively and promptly. The government also needs to seriously interrogate who the real culprits are in this cycle and what motivates them to engage in such vices. Is the government aware about the capacity of these fuel importers? Basically the government needs to go deep to the root of the problem. Perhaps the starting point to realigning the importation of fuel with the aim of restoring normalcy is to question the relevance of the two government instituions, Indeni and Tazama board of directors. What can Zambia do to curb fuel smuggling? Indeed, Zambia is overdue for concrete steps to fight the illicit fuel sector. With more than 60 percent of the fuel consumed in Zambia being smuggled, the government, the ERB, Indeni, Tazama, ZRA and other allied entities must up their game if parity is to be restored in this sector. *The author is a Lusaka-based business executive and current president of the Customs Clearing and Freight Forwarding Agents’ Association of Zambia.

NO COVID SCAM …Kenya dismisses exposé on looting of Covid-19 funds

AIROBI - Kenya’s health ministry has dismissed an exposé that alleged massive looting and disappearance of millions of dollars of donor funds and equipment meant to help the country contain the spread of coronavirus. An investigation by a local television station claimed that more than $400m (£304.5m) worth of donations could not be accounted for as Covid-19 cases continue to surge in the country. Kenyan health workers have threatened to go on strike due to a lack of personal protective equipment (PPE). The investigation alleged

that well-connected individuals, including politicians, profited from contracts to supply the PPE including medical masks and gowns. Some of the companies that were awarded multi-million dollar contracts had only been set up a few months earlier, it is claimed. Pirates said in a statement that Shonga remain suspended as he awaits the finalisation of the disciplinary proceedings against him. Meanwhile, the club has cleared Thembinkosi Lorch to return to the squad following the finalisation of the disciplinary proceedings against him. Pirates said they lifted Lorch’s suspension after he pleaded guilty to all charges that were brought against him by the club. “Lorch further apologised for his misdemeanor and has accepted the sanction imposed on him by the club. “ T h e 25-year-old has joined the squad in the BSE B u b b l e after undergoing his two Covid-19 tests as per the proto-
