CABINET APPROVES CYBER SECURITY, CYBER CRIMES BILL CABINET has approved, for publication and introduction in Parliament, The Cyber Security and Cyber Crimes Bill, 2021. This follows the approval of the National Cyber Security Policy at the last Cabinet Meeting held on January 11, 2021, Cabinet raised concern at the lack of a comprehensive legislation that provides for cyber security in the country that offers protection to persons against cybercrime or that provides child online protection. In a statement issued by Chief Government Spokesperson Dora Siliya, Cabinet further, in line with the approved Policy, intends to promote the responsible use of social media platforms. And Ms. Siliya said Cabinet approved for publication and introduction in Parliament of a number of Bills aimed at revising the composition of the Boards. This is by providing for removal of some senior Government officials on Boards and some Committees in order to enhance the principle of good governance. She named the Bills as The Zambia Institute of Diplomacy and International Studies (Amendment) Bill, 2021, the Zambia Revenue Authority (Amendment) Bill, 2021, the Public-Private Partnership (Amendment) Bill, 2021 and the Public Service Pensions (Amendment) Bill, 2021. Others include the Compensation Fund (Amendment) Bill, 2021; the National Institute of Public Administration (Amendment) Bill, 2021 and the Service Commissions (Amendment)

Bill, 2021. This is in addition to the Zambia Institute of Advanced Legal Education (Amendment) Bill, 2021, the Zambia Law Development Commission (Amendment) Bill, 2021, the Citizens Economic Empowerment (Amendment) Bill, 2021, the Control of Goods (Amendment) Bill, 2021 and the Petroleum (Exploration and Production) (Amendment) Bill, 2021 among others. And Ms. Siliya disclosed that during the Meeting, Cabinet also approved a seven- member Board of the Zambia National Building Society -ZNBS- charged with the responsibility of overseeing the operation of the institution and providing governance oversight in line with the Building Societies Act No. 412 of 1968. The tenure for the previous ZNBS Board expired on 30th June, 2020. She said Cabinet also approved for publication and introduction in Parliament of the Bill entitled “The Legal Aid Bill, 2021. Ms. Siliya said the Bill will create the foundation for the establishment of a comprehensive legal aid system in Zambia that is accessible, effective, credible and sustainable to persons whose means are insufficient in civil or criminal matters. She added that Cabinet also approved The National Postal Policy and its Implementation Plan. And in winding up business for the day, Cabinet approved in principle, the introduction of a Bill in Parliament in order to amend the Zambia Wildlife Act No. 14 of 2015.

UPND president Hakainde Hichilema’s spokesperson Anthony Bwalya and assistant for special duties, Mubita Nawa have been arrested for alleged theft and forgery. They are expected to be charged with theft and fraud charges related to NRCs. Police spokeperson, Esther Katongo confirmed the development in a statement. Ms Katongo said the two were currently detained in police custody yet to be charged with the subject offences. She however said detailed information would be given at an appropriate time. In October 2020, Police issued a “warn and caution” on theft and fraud charges against the duo. In October 2020, the two appeared on Muvi TV Assignments programme and produced a large stack of National Registration Cards that they claimed were irregularly issued. Police began investigating the matter and summoned the two to establish how the duo came into possession of secure national documents only issued to individual citizens. Mr Hichilema shortly after the incident employed the two in his office as political aides.

Mr Chanda said Mr Mmembe should explain the Zambia Airways privatization and the loan of US$5.5 million which was procured from Development Bank of Zambia and the Intermarket Bank. He said Mr Mmembe had not yet explained the tax evasion scandal but was busy pretending to be a saint. “Socialist Party (SP) president Fred M’membe should stop deceiving Zambians that he is a saviour with interest of serving the nation at heart,” Mr Chanda said in an interview. He said as opposed to the picture Mr. M’membe was trying to portray of himself to Zambians, the former proprietor of the defunct Post Newspapers Limited ruined many people’s lives and careers using his newspaper. Mr. Chanda said Mr. M’membe spent a lot of time on attacking and scandalising people, especially late President Frederick Chiluba whom he fought relentlessly even in

his death. He said Mr. M’membe’s decision to join politics was purely out of business interest and not service to the nation. He said the SP leader contributed to the downfall of his Post Newspapers Limited because he decided not to pay tax for a number of years, saying the resources he failed to pay could have contributed to national development. Mr. Chanda also challenged Mr. M’membe to come out clear on the statement by Rainbow Party president Wynter Kabimba that he could not agree with SP leaders on their proposed financiers because of the latter’s sexual orientation. Recently, the Lusaka High Court dismissed a case in which Mr. M’membe sued Mr. Kabimba, the Daily Nation, and Millennium Radio over the statement. Mr. M’membe was yesterday quoted in the Mast newspaper saying that enemies of late President Michael Sata do not like him because they think that he was the one who made Mr. Sata President.

DIssolve all structures, MMD urged By PETER SICHALI THE Movement for Multiparty Democracy (MMD) should dissolve all structures and call for a national convention, Operation Save MMD chairperson Raphael Nakachinda has said. And Mr Nakachinda has appealed to the court to expedite the process of guiding the former ruling party. He said in an interview that there was need for the former ruling party leaders to put their personal interests aside and focus on uniting the party. “It is for those in MMD leadership to serve the interests of the party and not a single individual,” Mr Nakachinda said. Mr Nakachinda said the party should dissolve all structures

to pave way for a national convention ahead of the August 12 polls. “We appeal to the courts to expedite the matters involving MMD for the party to move forward because our interest is to be a more united party that can positively contribute to the national discourse,” Mr Nakachinda said. Mr Nakachinda said there was need to have a more united MMD as the country goes for the August 12 polls. Meanwhile, New Hope MMD national secretary Elizabeth Chitika said preparation for the national convention are underway and that the national executive committee will announce the dates 30 days before the convention. Ms Chitika however said only members who are in good

standing with the party will participate in the convention. Ms Chitika said the party extended an amnesty to members that were not in good standing before the court judgement and that some members had responded by rejoining the party. “MMD will hold the convention with or without Covid-19, so that our members can enjoy their democratic right of choosing their leaders,” Ms Chitika said. She said an amnesty has remained open for MMD members who were found on the wrong side after the court judgement. “The national executive committee issued an amnesty to those that were on the wrong side before the court judgement and its open to those who are willing are free to come back,” Ms Chitika said.

ACC slammed for laissez faire attitude By PETER SICHALI THE Anti-Corruption Commission (ACC) failure to investigate cases of public interest such as the privatisation saga of 1990s and the involvement of counclilors in illegal land deals, is an indictment on its ineptitude and why it should be disbanded, Zambia Jubilee Coalition (ZJC) SecretaryGeneral Kwaela Mwanza has said Mr Mwanza said the ACC’s dwindled public confidence calls for a serious review of its operations. Mr Mwanza said the public have lost trust in the ACC due to failure to carry out its mandate professionally. He said ACC as a body mandated to fight corruption has failed to produce desired results on a number of issues of public interest. Mr Mwanza said ACC should be cleaned up and rebranded to rebuild the lost public confidence. Mr Mwanza said public confidence has degenerated due to lack of effectiveness and failure to deal with corruption related matters as captured in the Auditor General Report. He said the manner the ACC has dealt

with corruption allegations to which public interest is involved has also contributed to its degenerated public confidence. And Mr Mwanza has urged the ACC to take interest in the Auditor General’s report and investigate all corruption-related matters including cases of the councillors from Kitwe and Lusaka City councils alleged to be involved in illegal land dealings. Mr Mwanza said it was unfortunate that the ACC has not taken interest to investigate corruption. “It is disappointing that the ACC as an institution mandated to investigate corruption has not taken up issues related to corruption cited in the auditor general’s report,” he said. He said the ACC was expected to be proactive and investigate all corruption-related matters. Mr Mwanza said it was unfortunate that ACC as an institution with a mandate to investigate corruption has not shown an interest to probe the privatisation process of 1990s. Mr Mwanza said Zambians have been demanding for answers on how privatisation was conducted and ACC has never made any attempts to get answers including on how an opposition leader suddenly became rich.

Dr Tasila Tembo’s suspected killer denies murder charge By GRACE CHAILE-LESOETSA DR Tasila Tembo’s alleged killer, Zambia Army officer, Lieutenant Nigel Mwaba has pleaded not guilty to a charge of murder. And Lusaka High Court Judge Wilfred Muma granted an application by the defence lawyers that Mwaba be taken to Chainama Hospital for assessment of his mental condition. This was after the accused took a plea of not guilty before Mr Justice Muma yesterday. Facts of the offence are that between October 24 and 26, last year in Lusaka, Mwaba, 33, did murder Dr Tembo, alleged to be his lover. The defence lawyers from Legal Aid Board led by Ms M. Marebesa asked the court that Mwaba under goes a mental test at Chainama Hospital. “The accused person be taken to Chainama Hospital for assessment for a condition or conditions of disruptive, impulse-control and conduct disorder,” she stated. The named condition is a disorder that can cause a person to behave angrily or aggressively toward people or property. The State did not object to the application. Mr Justice Muma granted the application and adjourned the matter to February 15, this year.

HE Bank of Zambia (BOZ) has instituted investigations into the case where scores of civil servants in Kapiri Mposhi have been swindled out of their salaries and life savings by fraudsters purporting to be Zanaco employees through a phone scam. Scores of civil servants are in a quandary as their life savings and salaries from the Zambia National Commercial Bank (ZANACO) have vanished in a phone scam. BOZ assistant director of communications, Bersnart Mwanza said investigations into the matter had been instituted through the security department. "The security department will institute investigations into the matter," she said. The fraudster claiming to be a Zanaco employee called clients with XAPIT accounts informing

viewed five of the victims who include three female nurses at Kapiri Mposhi Urban Clinic who were swindled on Tuesday and Wednesday last week respectively by an unidentified male who called them using the same Airtel line. One of the victims who is a nurse explained that she was swindled money amounting to 3, 850 on Tuesday by the trickster who told her to change the secret code while her workmate lost K10,000. An old man was found crying in the bank after losing his K600 saings. Other workers were too embarrassed to disclose the details. She explained that when queried why such important changes involving one's account secret code were being made through a phone call, the conmen explained that it was in order to avoid overcrowding in the bank to prevent the spread of COVID-19.

UPND cadre nabbed in suspected murder of PF youth By KALOBWE BWALYA ONE of the UPND cadres suspected to have killed a Patriotic Front (PF) youth, Terrence Mutale in Lusaka’s Kanyama Compound on Thursday has been arrested. Mr Angelos Musonda, PF Lusaka Central constituency chairman at the weekend confirmed in a statement and condemned the killing of the youth by people suspected to be members of the UPND. And the police have confirmed the arrest of one person involved in the incident. Police spokesperson Esther Katongo said police had arrested one suspect and were looking for other suspects believed to be on

the run. “This is in connection with the murder of Terence Mutale and assault of one other person in an incident which occurred on January 28, 2021 at around 15:00 hours in Kanyama Compound.,” Ms Katongo said. The incident happened when two groups clashed along first road off Mumbwa Road during a funeral procession. Ms Katongo said initially the report was recorded as unlawful wounding and the two victims were taken to Kanyama Level One Hospital for treatment. She however said, Terence Mutale who had sustained multiple head and body injuries was referred to University Teaching Hospital where he later died on

January30, 2021 around 11:00 hours. Ms Katongo said an investigation into the matter led to the arrest of a woman aged 52 whose identity has been withheld, but of Old Kanyama compound and a manhunt for other suspects has continued. Meanwhile, a girl identified as Margaret Mudenda as was found dead in her boyfriend’s house in Lusaka’s Chainda compound on Saturday between 13:30 hours and Sunday 16:30 hours. Ms Katongo said, police received a report of suspected murder which occurred between January 30 and 31 at around 16:30 at an unmarked residence in Chainda compound. Ms Katongo disclosed that the

body was discovered by the landlady and neighbors after the father of the victim aged 67 begun inquiring on the whereabouts of his daughter on Sunday. Ms Katongo explained that, according to some neighbours, Margaret Mudenda was last seen on Saturday at about 16:30 hours. Ms Katongo said, the landlady of Margaret's boyfriend and neighbours decided to force open the door to the house as it was found locked. She however disclosed the girl was discovered dead on the bed and the matter was reported to the police. "It is suspected that the victim was locked inside the house as the key to the door was not found.,” said Ms Katongo.

Mr Lungu however argued that the reorganisation and restructuring of KCM is within the mandatory power as provisional liquidator of the mine. He stated that no order of court is required for him to carry out functions that are incidental to the powers given to him by the court. Mr Lungu stated that KCM Smelter Company Limited and Konkola Mineral Resources are subsidiary companies owned by the State therefore it is not true that the reorganisation is intended to remove the assets of the mine (KCM) from the supervision of the court. Ms Justice Dr. Mwenda in her ruling yesterday, said a wrong

process was used by the plaintiffs to apply for leave to commence proceedings against Mr Lungu, a company in provisional liquidation. “This is the basis for my stating earlier on in this ruling that the plaintiffs’ notice of motion has no leg to stand on. I accordingly, dismiss it. I set aside the ex parte order granting leave to the plaintiffs to commence an action against the first defendant and dismiss the matter before this court. The ex parte order of injunction dated 18th January, 2021, is accordingly, discharged forthwith. Leave to appeal is denied,” Justice Dr. Mwenda ruled.

Vedanta lose suit against KCM liquidator By GRACE CHAILELESOETSA THE Lusaka High Court has dismissed a matter in which Vedanta Resources Holdings Limited and two others sued Konkola Copper Mine (KCM) provisional liquidator, Milingo Lungu, challenging the reorganisation of the mining firm. High Court Judge Dr. Winnie Mwenda said the application for leave was improperly before the court and it had no jurisdiction to entertain it. But Vedanta says it is disappointed at the judgement and continues to believe that the provisional liquidator is currently contravening the limitations of its office and will be consulting its legal team as to its next steps. Last December 28, Mr Lungu issued a management brief to KCM employees, announcing the reorganisation of the giant mining firm.

Under the reorganisation, Mr Milingo proposed to restructure KCM into two subsidiary companies effective February 1, this year. But the three, Vedanta Resources Holdings Limited, Vedanta Resources (Jersey II) Limited and Vedanta Resources Limited challenged the splitting of the firm in the Lusaka High Court. They argued that Mr Lungu did not have the power to carry out the reorganisation of KCM business, assets and affairs in the manner he announced on December 28. Vedanta Resources Holdings and others also wanted an order of injunction restraining Mr Lungu from undertaking any reorganisation of KCM or transferring, disposing of, selling or dissipating the assets until the determination of the proceedings. The three stated that by the proposed actions of Mr Lungu and KCM they would continue to suffer loss and damage.

Gold mining halted

From Page 1 Mr Banda disclosed that a group of artisanal miners who obtained an artisans’ mining right did not follow the required procedure before undertaking the mining activities in Chongwe. He said that the miners were reported to have illegally commenced operations in Chitentabunga and Kangombe villages in Chongwe without consent. Mr Banda acknowledged that the miners had mining rights from the ministry, but pointed out that there were other legal issues that needed to be followed before such an undertaking. He said that artisans were required to get consent from the relevant authorities who was in this case her royal highness Chieftainess Nkhomeshya Mukamambo II. Mr Banda said that an environmental impact assessment also needs to be conducted by the Zambia Environmental Management Authority (ZEMA) before any mining activities were commenced. And Headman Nkomeshya who is Zone chairman in the area where the illegal mining is said to have been taking place described the act as unwarranted. He disclosed that the miners through a Charles Bwalya of Kabwe did earlier write to the BRE seeking authority to mine. The headman said that the miners however started mining when the royal establishment was still pondering on the application. Meanwile, the Ministry of Mines has expressed concern

over the increase in illegal mining activities in Eastern Province. Provincial Mines Officer Brian Nyambe said the number of illegal miners was growing because people now know the value of some of the minerals such as Gold. Mr. Nyambe said the ministry had been emphasising to the people the need to formalize their mining activities. He was speaking in an interview with ZNBC News on the sidelines of training for small-scale miners organised by the United Nations Development Programme in conjunction with African Caribbean Pacific and European Union. And the Policy Monitoring and Research Centre (PMRC) says Government needs to amend the Mines and Minerals Development Act No. 11 of 2015 to ensure that Zambians benefit from the mining sector. PMRC Executive Director Bernadette Zulu said this would help Government to maximise from the 100 percent acquisition of Mopani Copper Mines. Ms. Zulu said in a statement that the amendment of the Act would ensure proper coordination and an adequate legal framework governing the mines. She said poor corporate governance has led to the fall of many private and stateowned enterprises around the world. Ms Zulu said PMRC strongly recommended that principles of corporate governance be embedded in the running of Mopani Copper Mines.

Honeybee also wants an order of interim injunction to restrain ZAMRA by itself, agents or whomsoever from revoking the plaintiff’s pharmaceutical licence and publish any information on social media and other platforms calculated at injuring its reputation and any other reliefs deemed fit. In a statement of claim filed by its lawyer Tutwa Ngulube, Honeybee stated that on or about November 2019, it bid and won a tender for the supply of 22,500 health centre kits with the Ministry of Health, and a contract was executed to that effect. It stated that by special condition 9.1 copyright of the said contract, the goods contracted to be sold were to be subjected to testing and confirmation procedure as a condition precedent for awarding a certificate of acceptance as to the fitness of the goods supplied. “Pursuant to the said contract, the plaintiff delivered part of the consignment contracted for and the same was subjected to a testing and confirmation procedure and a certificate of fitness and acceptance of the goods supplied was issued by the procuring entity,” it stated. Honeybee claim that on or about September 17 last year and

other subsequent days , ZAMRA began issuing threats , unverified and disparaging remarks to the plaintiff as having supplied defective products disregarding the certificate of fitness earlier issued to it. It stated that on several occasions engaged ZAMRA to settle the issues in contention but proved futile as the defendant went on rampage issuing threats against its good reputation. “The defendant has further threatened to revoke the pharmaceutical licence of the plaintiff in a malicious and arbitrary manner without regard to the provisions of the contract aforesaid when in fact a number of other pharmaceutical companies such as International Drug Corporation limited and Shalina Pharmaceutical company limited has had their products recalled but without any threats or negative publicity,” its stated. Honeybee stated that the purported laboratory results that ZAMRA is relying on were obtained from a laboratory that is not accredited with the World Health Organisation, contrary to the provisions of the contract. It will show that the allegations are all false and untrue and that at no time did it supply defective goods to ZAMRA.

MAKE SCHOOLS SAFE HAVENS SCHOOLS re-opened throughout the country yesterday against a backdrop of a more deadly second wave of Covid-19. With their re-opening, the catchword now must be cleanliness in all schools. The schools were initially scheduled to re-open for the 2021 school calendar last month but the government decided otherwise. This was to allow the school managements prepare adequately and ensure that health guidelines were put in place. From a survey carried out in Lusaka yesterday, it is evident that the health preventive measures being spearheaded by the government are bearing fruit. What was evident was that all the learners were putting on face masks, hand sanitisers were in place and social distancing was being observed by not having overcrowded classrooms. St. Maurice Primary and Secondary school head teacher, Sr Maria Mwanza said the school, in Garden House area, would not allow any pupil entering the premises without a face mask as guided by the Ministry of Health. Sr Mwanza also said, the school had engaged officials from the Ministry of Health, who had time to sensitise teachers on the dangers of Covid-19 and how to handle the learners in school. She also said the school would be fumigating classrooms weekly and pupils were now sitting two on each desk and the teacher-pupil ratio has also been reduced to 45 per class indoors to keep social distance. Although the survey was restricted to a few schools in Lusaka, we are confident that schools throughout the country are taking seriously the warning by the government to ensure that health precautions are followed to the letter. There have been calls from across the nation that the second wave of the Covid-19 pandemic would put the lives of the learners at risk. We are glad though that Government has decided to take decisive action by ensuring that learners return to classes with strict instructions that school authorities adhere to the health guidelines. Cleanliness in schools which in the past was not considered a priority is now a must. Cleaners must now be under strict supervision to ensure that school surroundings, especially ablution blocks are clean. If anything, officials from the Ministry of General Education, working with their counterparts from the Health Ministry must make regular inspection tours of schools to check on their compliance levels. We must ensure that schools do not become super spreaders of the pandemic but should be a safe haven for not only the learners but the staff as well. With total compliance of the health guidelines, we do not see why schools should not operate normally so that children do not miss out on lessons. It must be noted that disruptions in the school calendar could have disastrous consequences for the more vulnerable in society whose parents and guardians cannot afford private tuitions, not forgetting the inability to revert to e-learning. But adherence to cleanliness will ensure that all have access to quality education.

HE acquisition of majority shares in Mopani Copper Mines is a well negotiated deal, says Permanent Secretary in the Ministry of Mines, Barnaby Mulenga. Mr. Mulenga was responding to concerns from some stakeholders that the company may have been undervalued. He clarified that there was no valuation of the assets in the acquisition process because the

negotiations were centred on reducing the US$4.8 billion loan Mopani owed to its shareholders. MOST pupils that reported for school yesterday had their masks on, with hand sanitisers as well as observing social distance. A check by the Daily Nation in Lusaka found that in most schools pupils had face masks and school management were not allowing anyone to enter the premises without a mask on. Pupils from St. Maurice in Lusaka’s Garden House were found having class lessons wearing their masks St. Maurice Primary and Secondary school head teacher, Sr Maria Mwanza said the school would not allow any pupil entering the premises without a face mask as guided by the Ministry of Health. Sr Mwanza explained that, before the schools reopened, the school management had put everything in place by providing enough space for learners, including hand washing dishes and

hand sanitisers for teachers. Sr Mwanza also said, the school had engaged officials from the Ministry of Health, who had time to sensitise teachers on the dangers of Covid-19 and how to handle the learners in school. She also said the school would be fumigating classrooms weekly and pupils were now sitting two on each desk and the teacherpupil ratio has also been reduced to 45 per class indoors to keep social distance. She said no parent or guardian would be allowed to enter the school premises without a mask and with no concrete reason. Ms. Katongo said the victim was a Grade 12 pupil. She said the deceased is reported to have been in the company of three colleagues who ran away after being attacked. ESWATINI REVAMPS TAX SYSTEM, CUTS DEBT ARREARS AMID VIRUS CRISIS

January's PMI – a measure of economic activity in the manufacturing sector – released on Monday, edged up slightly to 50.9 index points, from 50.3 points reported in December. However, the reading is still below the average recorded for the final quarter of 2020. Values above 50 indicate increased activity and values below 50 indicate decreased activity. "The bout of load shedding mid-month may have weighed on production in January. In addition, the adjusted Level 3 lockdown regulations would have negatively affected production in the liquor- and hospitality-related industries in particular," the index report read. In addition, the business activity sub-index declined for a fourth consecutive month – to 43.5 points from 44.9 points recorded in December. This reflects a further loss in the recovery momentum. The new sales orders sub-index rose slightly to 47.2 points in January from 45.2 points recorded the previous

month. "This was despite a further deterioration in export sales, which suggests it was supported by a reduction in the rate of decline in domestic demand instead," the report read. It is still below 50 and reflects "constrained demand conditions". The pace of job shedding in the sector also seemed to have slowed, with the employment sub-index rising from 43.8 points to 48.6 points. The supplier deliveries subindex also increased – to 68.9 points from 64 points reported in December - which indicates supplies are less readily available, possibly due to supply chain disruptions during the month. "This is likely not only due to local restrictions, but also tight(er) lockdown regulations in the rest of the world," the report read. According to the report, purchasing managers are optimistic about the future operating environment – possibly linked to the prospects of an improved global economy during the second half of the year. This should boost exports, the report read. The landlocked nation intends introducing new levies to increase its tax take and bring more individuals and entities into the net, Finance Minister Neal Rijkenberg said in an interview. The government estimates that the so-called “shadow economy” of illicit and informal activity, accounts for about 40% of output and isn’t factored into the national accounts. That meant gross domestic product of 68 billion emalangeni ($4.5 billion) was probably understated by about 27 billion emalangeni in 2019. Consumption taxes, which limit the scope for evasion, are on the cards. Maximise presidential votes in opposition dominated constituencies Dear editor, I have noticed with great concern that we seem to be relaxed as a Party PF in terms of assisting our Party structures or functionaries in opposition dominated CONSTITUENCIES which is making it difficult to maximize on Presidential Votes ahead of August General Elections. PF structures in opposition strongholds seem to be operating like POLITICAL ORPHANS with little or next to nothing at all in terms of support that can make it easy for them to mobilize the Party PF. What is more shocking is that we have leaders in strategic party positions of authority who are failing to take advantage of efforts made by Party structures and functionaries to maximize on PRESIDENTIAL VOTE ahead of

August General Elections by getting fully involved, furthermore offering maximum support. It has now become a common trend for some leaders to act or execute their duties with their areas of jurisdiction only when President Edgar Chagwa Lungu speaks or register his concerns. It's shocking and highly disrespectful to note that some leaders prefer taking lies to State House at lightning speed just to shield their gross incompetence and protect their positions when the reality on the ground is different. It's for this reason that I have felt it prudent to make my honest and humble submission to our distinguished leader President Edgar Chagwa Lungu on the need for him to take keen interest and fully support efforts being made by the party structures and

Malpractices in the run up to the UPND convention

Dear editor, After protracted persuasion and demand for intra party democratic elections, the 23 year old opposition United Party for National Development (UPND) has succumbed to public outcry in the apparent submission. They have hurriedly organized the purported elective convention to be held on 14th February, 2021 in which they will subject themselves for election. In the interest of the nation, we wish to conduct an appraisal of some of the salient issues underpinning the imminent elective virtual conference. We carefully scrutinized the nomination of selected candidates last Friday and we do not think there is level playing field. While it is the democratic right of Mr Hakahinde Hichilema to seek the services of any UPND member to defend his bid to be the flag bearer, it was inappropriate for him to parade the Chairpersons in the vicinity to open-

ly endorse him as an aspiring UPND Presidential candidate. While it may be argued that the National Management Committee has been dissolved, the provincial and lower structures have not been dissolved. By implication, this means the provincial chairmen can still exercise undue influence over their lower structures under their jurisdiction. Any member of lower structure who will resist their provincial chairmen is likely to be disciplined. This on its own constitutes electoral malpractice. We also noted that, the provincial chairmen endorsed UPND aspiring President Hakahinde Hichilema just right in the nomination centre. In other words, the nomination was turned into the campaign centre and this is was undue prejudice to the outcome of the UPND Presidential elections. It is unheard of even in the mainstream politics for candidates who have validly filed their nomination papers to cam-

paign. We wish to remind the UPND and supporters aligned t HH that the constitution of Zambia adds emphasis on adherence to the democratic principles and this conduct falls short of the demands for upholding democratic principles. We wonder what will happen if the HH lost UPND presidential elections and how that would bear on party internal democracy. We also observed that the Director of Ceremony Mr Sibote and Honourable Douglas Siakalima are member of the HH campaign team. This is clear inappropriate conduct on their part and if the process was genuine should have stepped aside and allow impartial and disinterested persons preside over the event. The other observation is that the so called Electoral Commission mostly drawn from UPND user friendly civil society were all handpicked by Mazabuka

MP Honourable Garry Nkombo who is also the candidate for a position he is yet to announce (we restrain ourselves from confirming the position as we do not want to pre-empt the awaited announcement). Where on earth has the prospective candidate single handily appointed the members of the body organizing elections? We are also concerned on the absence of independent observers such as Young African Leaders Initiative (YALI), among others. We also note that even the CSOs which are observing the UPND elections were selected and accredited in a very secretive manner. We therefore urge the UPND to be sincere in their so called intra party elections. We can only wish they conduct free and fair intra-party elections as opposed to stage managing democracy. ZRA engages councils on taxing the informal sector By BUUMBA CHIMBULU AN agreement to boost tax revenue collection under the informal sector has been signed between the Zambia Revenue Authority (ZRA) and 33 Local Authorities from across the country. Under this agreement which is aimed at broadening the tax base, the local authorities will be tax agents for rental income, base tax and turnover tax in markets and bus stations. This is part of the initiatives put in place by ZRA to achieve its K59.3 billion revenue collection target for this year. The councils, who have been identified as key strategic partners to broaden the tax base for the informal sector, will receive 10 percent commission under this agreement, says ZRA Commissioner General, Kingsley Chanda. Mr Chanda said yesterday in Lusaka during the signing ceremony that taxpayers would be using various ZRA payment platforms to remit this tax. “The engagement of the local authorities has been done in a phased way. The contracts of the 33 councils we are signing today is phase one and the rest of the councils will be contracted in phase two, which should be done in the second quarter of this year,” he said. Mr Chanda said while ZRA would offer necessary support to ensure the success of the engagements, the authority would sensitise the public and tax paying community about the partnership. He said ZRA would also register all taxpayers submitted to the authority by local authorities and carry out tax awareness. In return, he said, ZRA expected the councils to develop and maintain a credible database of taxpayers eligible to pay the respective taxes.

Senior Chieftainess Chungu of the Bena Mukulu people said there could be development in the country once there is peace and unity among people. OV E RN ME N T has not abandoned the 48.5 kms Chongwe hospital/ Katoba road project which was started in 2014, says Chongwe Member of Parliament Japhen Mwakalombe. Mr. Mwakalombe was responding to some residents over the delayed implementation of the project which they described as abandoned. He said that the upgrading to bituminous standard of RD 149 and D151 from Great East Road at Chongwe district hospital to Katoba primary school in Katoba ward was still on government’s agenda. He said that nothing had changed and as such the government was doing everything possible to ensure that the project is completed. He disclosed that the government had to terminate the contract which was originally awarded to Zhogmei Engineering Group on April 5, 2013 for technical reasons which he did not disclose. Mr. Mwakalombe who is also Copperbelt Province minister stressed that the government was aware of the poor state of the road which leads to the main agriculture area and that it was for this reason that the government was not ready to abandon such an economically viable road. Meanwhile residents along the Chongwe hospital/ Katoba road expressed concern at the poor state of the road. They complained that the road had become impassable in areas where it was not tarred. Mr David Phiri of Kampekete village in Manyika ward thanked the government for the project. He however appealed to the government to expedite the project which he said had prolonged for far too long and that the people were tired of waiting for the completion of the road. Another resident of Ntanisya village in Lwimba ward described the poor state of the road connecting the area to Chongwe central as a hindrance to development and observed that the heavy rains being experienced had even worsened the poor state of the road.

Some members of the party shared information that confusion had rocked the party at district level in Chililabombwe when former mayor Paul Kabuswe joined the opposition party and made his interest of contesting the seat known.. Mr Kabuswe is a well-known figure in the border town who most of the people as well as aspiring candidates saw as a threat. Most of the members complained that Mr Kabuswe had already been favoured by the party to be adopted as its parliamentary candidate. But UPND Copperbelt Information and Publicity Secretary Lawrence Mwanza said that the party only had a minor misunderstanding that the party was currently taking care of at district level. The empowerment has come at a time when the constituency is earmarked to benefit from the construction of Kapalala market which was gutted three years ago. Kabushi Members of Parliament Bowman Lusambo said the government cared about the welfare of marketeers across the country, hence its commitment to promote socio-economic equality among the informal sectors such as marketeers and taxi drivers. NO CONFUSION HAS ROCKED THE PARTY IN CHILILABOMBWE - UPND within the party to discredit new members that showed interest to be adopted for certain seats. Mr Mwanza was speaking in an interview in Kitwe yesterday.

“ We have discovered that we have people that are paying others among ourselves to say bad things about those that wish to aspire for certain positions under the UPND

ticket. “ But I would want to make it clear that being a member of the party for so long did not guarantee people to be adopted even when they have

no following or ground in their areas,” he said. Mr Mwanza however mentioned that the party provincial leadership would soon sit the members down

and allow people air their views. He also warned that the party would not allow a few individuals to go against the principles and values of the party.

The Independent Schools Association of Zambia is an independent, non-profit organization that serves the interests of member schools. It was founded in 1995, as leaders of independent schools grappled with how best the private school sector in Zambia could work together to promote their common interests. The association has grown in number, and now represents the interests of 49 schools who provide education to approximately 23 000 pupils. The growth of ISAZ and the increasing complexity of the education sector have necessitated the employment of an Executive Director.

OLWEZI East Patriotic Front parliamentary aspiring candidate Athanase Kaleleka has urged the Church to continue praying for the peace and unity of Zambia as the Country heads towards this year’s general elections. Addressing congregants during a fundraising concert held at Kasapa Union Baptist Church at St Dorothy, Mr Kaleleka said as the country draws nearer to the general elections, the political environment will start becoming hostile. He said it is during such moments that the church can play a bigger role of ensuring that the country remains at peace.

“It is for this reason that I am making a passionate appeal to the Church to continue praying for peace and unity of our country as we head to the polls,”

ICC bribery accused provisionally freed in Kenya NAIROBI - A Kenyan lawyer accused of bribing witnesses in the failed International Criminal Court case against Deputy President William Ruto was released yesterday under strict conditions, the ICC said. Paul Gicheru handed himself over to Dutch authorities in early November and was transferred to the Haguebased court where he appeared for the first time just a few days later. He was freed in Kenya "with specific conditions restricting liberty during the confirmation of charges proceedings against him," the ICC said.

Prosecutors say Gicheru "corruptly influenced" their witnesses to recant testimony by allegedly paying bribes of up to one million Kenyan shillings ($9, 000) and offering up to five million more. Release conditions for Gicheru, who has denied the

allegations, included security of one million shillings, providing copies of his passport, visas and identity documents and reporting to the court at least once a week via videolink. He was also ordered to stay in Kenya at a specific address

for the length of the case when not present at the Dutchbased court. If he did not comply, the ICC said Gicheru could forfeit his financial security paid to the court and a warrant for his arrest may be issued. his is a system of coordination in animals made up of the T brain, spinal cord and nerves. The brain and the spinal cord together make up the central nervous system (CNS) while the nerves make up the peripheral nervous system (PNS). Nerves that are joined to the brain are called cranial nerves while those that are joined to the spinal cord are called spinal nerves. In the nervous system messages are transmitted in the form of electric impulses also called nerve impulses.

• An example of a slow reflex action is the pupil reflex (iris reflex). Each reflex action has a survival value which protects an animal from dangerous factors.Other examples of reflex actions are sneezing, salivating, peristalsis, vasoconstriction and vasodilation • There are two types of reflex actions, namely spinal and cranial reflexes. During a spinal reflex impulses pass through the spinal cord, whereas during a cranial reflex impulses pass through the brain.

REFLEX ARC

These are neurones that carry impulses from the central nervous system to effectors. An effector is any part of the body that carries out a response to a nervous impulse. Most effectors are glands or body organs such as muscles. Motor neurones have the following characteristics: • They carry impulses from the central nervous system to the effectors. • They have long axons and short dendrites. •Their cell bodies are terminally located (located at the end).

RELAY NEURONE These are neurones that form a link between sensory neurones and motor neurones. They are located in the central nervous system and are multipolar so as to provide many alternative paths for impulses. FIGURE 5: RELAY NEURONE

SENSORY NEURONES These are neurones that carry impulses from sense organs (receptors) to the central nervous system. A receptor is any organ that detects a stimulus and converts information about it to electrical impulses. Characteristics of sensory neurones include the following: • They carry impulses from sense organs to the central nervous system. • They have long dendrons and short axons. • Their cell bodies are not terminally located but are axillary.

SYNAPSES • A synapse is a junction between two neurones. The neurones at the synapse are not joined to each other but have gaps between them called synaptic gaps (synaptic clefts). The following passage describes how a nerve impulse moves across a synaptic gap: 1. An impulse arrives at the synapse 2. At the end plates, there are vesicles (tiny sacs) containing a chemical (neurotransmitter). 3 .The vesicles fuse with the cell membrane (presynaptic membrane) and the chemical is released into the synaptic gap. 4. The chemical diffuses across the gap and the impulse restarts at the other side. Reflex Actions • A reflex action is an automatic and stereotyped response to a stimulus. Reflex actions are often quick, but some of them are slow. Examples of quick reflex actions include: • Withdrawing of a hand from a hot object • Jumping up after sitting on a pin • Blinking when an object approaches the eye • Knee-jerk reflex • Shedding of tears when an object enters the eye.

CONDITIONED REFLEX • A conditioned reflex is a response that results from learning or training. The response given during a conditioned reflex is not related to the stimulus but the animal associates it with a related stimulus after being trained to do so. THE BRAIN The brain is the enlarged anterior end of the spinal cord. It controls automatic processes such as heart rate, breathing rate, swallowing, salivating, sneezing and coughing. • Cerebellum: This controls co-ordinated movement, helps maintain posture and also controls the sequence of activities involved in dancing, acrobatics and playing of musical instruments. • Hypothalamus: Sometimes regarded as the centre of homeostasis, this contains centres which control thirst, hunger and thermoregulation. • Pituitary Gland: This links the central nervous system and the endocrine system. (Refer to notes on the endocrine system for the hormones it secretes and their functions) • Cerebrum: This is the largest part of the brain and is the centre of intelligence, memory, language and consciousness. It has both motor and sensory areas. The motor areas control voluntary movement. IS FOOTBALL’S RACISM BATTLE BEING LOST ON SOCIAL MEDIA?

“The cavalry is on the way,” the head of the antidiscrimination body told the BBC.

WHEN it comes to online racist abuse, football appears to have had enough. Again. Last week’s series of incidents provoked a wave of condemnation from across the game and beyond. And yet, this comes almost two years after top stars took part in a campaign called ‘#Enough’, a 24-hour social media boycott in protest at a similar spate of abuse. Now the same demands for tech platforms to do more are being made. So is the battle being lost? Why is it proving so difficult to tackle this issue? And where is this crisis heading?

Time to take responsibility

The pressure on the social media platforms is intensifying. The appetite for more regulation is growing. Last week the Premier League said the tech companies “need to do more”, calling for “swifter removal of offensive messages and improved identification and banning of offenders.” Manchester United, with three of their squad subject to vile messages, urged the creation of verifiable and identifiable accounts so offenders could be caught, saying they and the players were “sick of it,” making the point that no one should face such hate-filled abuse in their place of work. The Duke of Cambridge, who is also the president of the Football Association, has praised those who have spoken out and called for an end to the “despicable” abuse. Writing on Twitter, Prince William also cited the need for social media companies to raise their game. “We all have a responsibility to create an environment where such abuse is not tolerated, and those who choose to spread hate and division are held accountable for their actions. That responsibility extends to the platforms where so much of this activity now takes place,” he said. The Professional Footballers’ Association, which represents players, has asked the tech giants to prevent users from being able to send explicitly racist terms and emojis. “While racist abuse is allowed to continue on each platform, we can only conclude that this is a choice by the companies running the social networks,” it said. Putting such criticism to the platforms is no easy task. We asked for an interview with Twitter on this subject back in 2019. We are still waiting for one. Our request last week for an interview with Facebook - the owner of Instagram - was met with a short statement saying: “There is no place for racism on Instagram and we are committed to removing it when we find it. “We know there is more to do and we will continue to work closely with clubs, players and football authorities to investigate instances of discrimination and collectively tackle this issue.” Twitter too issued a statement: “Racist behaviour has no place on our service and when we identify accounts that violate any of the Twitter Rules, we take enforcement action.

“We have proactively engaged and continue to collaborate with our valued partners in football to identify ways to tackle this issue collectively and will continue to play our part in curbing this unacceptable behaviour - both online and offline.”

New legislation

The government meanwhile has vowed to press on with plans for “groundbreaking” new online harms legislation later this year to make tech companies legally responsible for the online safety of their users, and make them accountable to a regulator Ofcom - over abusive content. Racist messages would need to be removed “without delay.” The proposals include the threat of massive fines of up to 10 percent of global turnover if the companies fail to meet their obligations, and there could even be criminal sanctions for senior executives. Behind the scenes, while football authorities were encouraged by the recent meeting that Culture Secretary Oliver Dowden hosted with players to discuss online abuse, there is concern at how long it is taking to introduce new laws considered long overdue, and fears they may be watered down if the hugely powerful, US-based tech companies have their way and threaten to invest elsewhere. But according to Kick It Out chief executive Sanjay Bhandari, the

legislation - along with the promise of more regulation in the US from President Joe Biden - are grounds for optimism. “The cavalry is on the way,” the head of the anti-discrimination body told the BBC. “That’s the hope on the horizon, but that may not come quickly enough so there’s things we need social media to do right now. The behavioural, cultural problems will take longer to solve. “It’s the technology problem we can do more quickly and all of the answers sit with Twitter and Facebook. Technology has been massively unregulated for 25 years and its time we closed that loophole.”

Frustrations

Some at the Premier League - which launched a dedicated, ‘rapid-response’ reporting system for players last year - say the social media platforms have improved in recent years, but not enough. There has been success with the removal of posts but officials want more effort to assist the authorities to find perpetrators so they can be banned by clubs (if they are a fan) or even prosecuted. While there have been some successful prosecutions - an Irish teenager is due to be sentenced tomorrow for sending racist abuse to former Arsenal and England striker Ian Wright - these are few and far

between when the sheer scale of the abuse is considered. One insider said league officials felt hampered by what they called impregnable and unresponsive tech companies using privacy, freedom of speech and the sheer weight of traffic as reasons for not handing over information that would help identify offenders. The fear is that the police - without the resources to pursue every possible crime - only intervene in the most serious cases, and abusers know they face little risk of sanctions. Court orders need to be obtained to force the platform to co-operate, evidence has to be gathered, and often offenders are overseas in different jurisdictions. Another challenge is persuading players to take legal action, which can often seem a daunting prospect.

Big-tech’s defence

While admitting there is “more to do,” Facebook does point to the fact that it is working with Kick It Out on a fans’ education and reporting initiative, and has built tools designed to prevent unwanted contact on Instagram. It has also tripled the size of its safety team to 35, 000 people, claiming it proactively took action on tens of million of pieces of hate speech last year. But considering the vast wealth of these companies, many

believe more should be invested. The tech companies argue that tackling this problem is not as straightforward as many assume. They have other areas of concern that must also be monitored across their vast, unregulated platforms; from suspected terrorism and paedophilia to the spread of misinformation. Simply blocking certain discriminatory words or emojis from being used in the first place is problematic, because these can also be used in a non-offensive context, and across global platforms can have different meanings in different communities or territories. The companies can block devices for repeat offenders, but that person can then just use a different device.

Could football do more?

There are also those who believe that the time has come for football’s authorities and clubs to invest more, and take the burden of reporting away from the players. “The problem is that the systems that they’ve got in place require a player to receive and then report the abuse themselves, and by that point the damage has already been done,” according to Jonathan Hirshler, the CEO of Signify, a data science company that uses artificial intelligence to uncover the identities of abusers. – BBC.

LUSAKA Province Minister Bowman Lusambo has joined the bandwagon of those that are calling for the removal of FAZ president Andrew Kamanga following the national soccer team's disastrous performance in Cameroon. Zambia were on Sunday afternoon dumped out of the ongoing CHAN tournament in Cameroon following 3-1 bashing at the hands of defending champions Morocco. But Lusambo noted that the painful loss to Morocco was, asymptomatic of the many things that had gone wrong with football since Kamanga took over as FAZ president.

He noted that it was undeniable that football had been sinking and it had been since Kamanga took over Football House. Lusambo said that there is need for the football fraternity to find a suitable candidate to replace Kamanga so that the country could get back to the AfCON qualifiers. He said that an interim executive should be put in place to run the FAZ until the next annual general meeting to usher in a new executive. FOOTBALL Association of Zambia (FAZ) president Andrew Kamanga said it is depressing that the Chipolopolo failed to reach the semifinals at the ongoing African Nations Championship in Cameroon. Speaking after Zambia’s 3-1 defeat to Morocco in the quarter final stage, Kamanga said his executive will carry out a CHAN postmortem to ascertain what went wrong in Cameroon. Kamanga said qualifying to the semifinal of the CHAN would have been a perfect reward for the level of preparations that
