CELEBRATE ZAMBIA SAFE RANKING
LET it sink in that Zambia has been recognized and ranked as one of the safest countries in the world. Fourth safest in the world and the only one in Africa. That is no mean achievement by any standards and only those who are perpetually jealous of their own country would not take pride in this development. This is a commendable achievement for which government through the Ministries of Health and Toursim, should be praised. It is a clear indication that we are doing something right in the fight against the coronavirus. Many countries are struggling to overcome the negative impact of the Coronavirus which has wrecked economies the world over. Big or small, all economies are having trouble finding a firm footing because of the many negatives brought by the covid19. However, in the midst of all this and despite fears of a second wave, Zambia against all odds, has emerged as one of only six (6) countries in the world that are considered safe according to international standards by the WHO and UWTO. Zambia has been named the fourth safest country in the covid era. In other words, these six countries, which includeing Zambia, are the only countries where someone can feel safe going despite the covid19 which is still ravaging the whole world. After forced lock downs and implementation of health safety guidelines, many countries endured near break down of social services as hospitals struggled to save lives. The Italian president cried openly after admitting his country had been overwhelmed by the covid19 as thousands succumbed daily to the disease. Yet Zambia, with its limited resources but with a lot of hearty and dedication from health personnel, managed to stem the covid19 and to reduce it to manageable levels. Indeed the ride was rough and seemed insurmountable at times as the closed sectors cried for relief. However, last week, Zambia recorded a milestone by any standards by named one the six (6) safest countries on earth in as far as covid19 is concerned. ZAMBIA has been ranked fourth safest in the world in the light of the COVID-19 pandemic and the only one in Africa according to an article published on the Wego travel blog website, entitled “Safe Places to travel During Covid-19 Pandemic. According to Wego, the Kingdom Saudi Arabia ranked sixth among the countries in the world with a classification based on the standards of the European Union countries to coordinate travel restrictions. Of the 70 countries with sufficient data and testing, only six were ranked as safe for travel. The classification was based on epidemiological criteria, regarding the ability of countries to contain the pandemic, achieve stability over a long period of time, and the efficiency of the health system, particularly, the clinical capacity for intensive care rooms and efficiency medical staff. Australia ranked first in the global safe destinations for travel during the corona pandemic, followed by New Zealand, Singapore, Zambia, Cuba and Saudi Arabia. But for some unpatriotic Zambians, this news seems to have rubbed them up the wrong way and are going out of their way to prove that the contrary. Evangelical Youth Alliance (EYA) President, Moses Lungu has complained that people, especially politicians, are making political mileage by talking ill of the country’s economy. Some people are all too quick to celebrate any calamity that befalls the country and the recent default on Eurobonds gave them an opportunity to do just that. The fact that the country has recorded positive news with this recognition matters less to unpatriotic people bent on denting the image of the country. Rev Lungu has wondered if at all such people have any good intentions about the country. True leadership is about showing the correct way of doing things and not about gloating or going out of your way to create negative propaganda about one’s own country. Patriotism is preached in many developed countries and yet here, people what to make unpatriotic actions seem as correct behavior.

THE Court of Appeal has upheld a life sentence slapped on a Lusaka accountant for sodmising his five-year-old nephew. Victor Mulungwe, 42, was sentenced to life imprisonment with hard labour for a charge of unnatural offences last year by the Lusaka High court judge, Elita Mwikisa. Facts are that Mulungwe on November 27, 2014, sexually abused his nephew against the order of nature. He pleaded not guilty to the charge. He however, appealed against both his conviction and the sentence imposed on him. Mulungwe’s grounds of appeal was that the charge he was facing, was not proved be-
yond reasonable doubt. And that the sentencing judge failed to give him credit for being a first offender, when she imposed the maximum sentence. His lawyer argued that the finding of the boy in his house was nothing unusual and could not have amounted to ‘something more’ as the convict was the uncle. The defence team therefore stated that it should not, in the circumstances, have been considered to be supporting evidence. But the State advocate Bob Mwewa argued that on the material day, the victim was found standing in between Mulungwe’s legs while he was seated on a bed. Mr Mwewa further stated that the boy looked distressed and became withdrawn and the following day when the
child was checked after complaining , he was found to have been sexually abused, and a medical report confirmed so. In its judgement , the Court of Appeal said instead of Mulungwe being protective as an uncle, he abused the boy. Court of Appeal deputy judge president Chalwe Mchenga, sitting with justice Betty Majula and judge Mwiinde Siavwapa said the sentence of life imprisonment did not come to them with a sense of shock , as being excessive. The Court therefore found no merit in the appeal against sentence and dismissed it. “Both the appeal against sentence and conviction having been unsuccessful, this appeal fails and it is dismissed. The appellant’s (Mulungwe) conviction and sentence are upheld,” read the judgement.

THE continued attacks on the Electoral Commission of Zambia (ECZ) by the opposition political parties is a clear sign that they are already defeated way ahead of the 2021 general elections, Patriotic Front (PF) in Lusaka has said. PF Lusaka Province Secretary Kennedy Kamba said “Instead of encouraging their members, the church and civil society organisations to combine efforts in calling on people to register as voters in large numbers, they have re-

Mr Kakoma said the Commission cannot go ahead to register inmates without consulting all political parties. State defends declaration of CEC’s transmission lines as common carriers By GRACE CHAILELESOETSA
THE State has told the Lusaka High Court that there is nothing illegal with the decision by Minister of Energy Mathew Nkhuwa declaring CEC’s transmission and distribution lines as common carriers. This is in a matter where Copperbelt Energy Corporation (CEC) Plc is seeking judicial review challenging Mr Nkhuwa’s decision to declare its lines as common carriers saying it is unlawful. It has cited the Attorney General and the Energy Regulation Board (ERB) as respondents in the matter. CEC wants the court ‘s declaration that that the decision of of Mr Nkhuwa to direct CEC to provide a wheeling path for Zesco limited to supply power to Konkola Copper Mines plc on terms dictated by the ERB is illegal and therefore null and void. It further wants a declaration that the decision by the director general of the Energy Regulation Board that CEC shall charge wheeling tariff of US$5.84/kw/month is illegal and therefore null and void. It is seeking an order of certirarii to remove into the High Court for the purposes of quashing the decisions as well as an order of prohibition prohibiting the Minister from implementing or enforcing SI no 57 of 2020. In skeleton arguments , the Attorney General Likando Kalaluka submitted that section 15 of the Electricity act no. 11of 2019 empowers the minister by SI to make regulations declaring a transmission and distribution line as a common carrier. The State also submitted that the minister’s decision was done for the purposes achieving that which the Electricity act was enacted. Mr Kalaluka stated the parties/enterprises are at liberty to still negotiate a mutually acceptable agreement as such right has not been taken away or lost as contended by CEC.

Dr Kunda said in an interview that some mining companies, have resisted to pay the increased tariff of 9.3 US cents/kWh. He said the defiant mining companies have since 2017 been paying tariffs between 6.8 cents/ kWh and 8.5/kWh while others have willingly progressed to the agreed tariff. In response to a query, Dr Kunda stated that Zesco buys power from the various Independent Power Producers (IPPs) between eight and 13 US cents/kWh for supply to all consumers including the mines, representing a subsidy by Zesco of up to 6.7 US cents/kWh on every unit sold to some mining companies. “Currently, the total cost to Zesco is over 13 US cents/kWh, the cost of transmission, distribution, and supply is over 6.5 cents/kWh and that is excluding the cost of generating or electricity purchases. “Zesco sells the same power to domestic customers at about 4.3 US cents/kWh and vulnerable to foreign exchange rates, the
tariff mismatch represents a subsidy of up to 5.6 US cents/kWh,” he said. Dr Kunda said the only sustainable solution was for the entire Electricity Supply Industry (ESI) and all the mines and retail customers to quickly move to the costeffective tariff. And mine expert, Edward Simukonda called on mines to be patriotic and pay the 9.3 US cents tariff to Zesco because they are ripping off the power utility. Mr. Simukonda said in an interview that the mines should adhere to the effective tariff proposed by the government so that Zesco could also benefit from the deal because as things stand, the power utility firm is supplying the mines at a loss. He said Zesco should sell power to the mines at a price not less than 10 US cents/kWh for them to make a profit. “In this case, Zesco is losing and the mines are gaining, so the mines should pull up their socks and start paying the standard tariff rates so that Zesco can also benefit because power production is very expensive,” Mr Simukonda said.

But Mr Simwinga said no institution, that serves the public should expect to be free from the scrutiny of stakeholders. He was speaking in an interview yesterday. “My take is that there is no doubt that criticism is good for people and institutions that are part of public service or life. No institution that serves the public including football coaches should expect to be free from the scrutiny of those it serves. “Personally I have learnt from my humble public service that criticism is like chroloquine or quinine. We should take it not because of its taste but because of its effect and get cured from malaria,’’ said Mr Simwinga said, who is former Kitwe Town Clerk. ENERGY Regulation Board will see whether it is alright to increase the pump price seeing that price for crude oil has increased on the international market, Minister of Energy Mathew Nkhuwa has said. Ex-ramcoz miners in k10m windfall

STAR Tanganyika Investments, the new mine investor in Luanshya, has handed over K10 million to pay off principal outstanding dues to former Roan Antelope Mining Corporation of Zambia (RAMCOZ) miners. Over 6000 miners are supposed to benefit from the amount. Hundreds of Luanshya residents turned up at Mpatamato Stadium to witness the handover ceremony which finally brought to close a 20year battle for their money. The mine was initially ZCCM Luanshya division before privatization, but was
sold to the Binani Group of Companies in 1997 for a consideration of US$35 million and payment was made in full through their lawyers, Rothschild & Sons. Star Tanganyika investments representative, Darius Ghesmati, hailed Government for ensuring that the project was successful. The firm is taking over the three tailings dams in Luanshya. “We also thank Luanshya Mayor for the hard work and support to ensure the realisation of this project which will bring great opportunities to Luanshya town. “The next phase of this project brings with it economic
and social benefits. It will create new jobs and help support investments into local secondary industries around this project,” Mr Ghesmati said. The symbolic K10 million cheque was received by Luanshya Mayor Nathan Chanda and the Ex-Miners Executive Committee. The mayor thanked the Ex Ramcoz Miners and the Executive committee for the patience as the money had been long outstanding. “It is heartbreaking that some of our parents have died whilst pushing for this money. I am aware that there are outstanding payment relating to 2000, 2001, 2002,
2003 and January 2004 Napsa payments,” Mr Chanda said. Mr Chanda further warned those who wanted to frustrate the important process which he said would benefit the community of Luanshya to stop and allow the people of Roan who had suffered for a long time to live in peace. RAMCOZ started facing operational problems soon a few years after taking over the assets, prompting Zanaco, which had given a loan to the mine, to place it under receivership with Christopher Mulenga of Grant Thornton being receiver manager until 2006 when the Government Administrator General took over.

I’ll quit if I lose polls - Sinkamba …to focus on marijuana export By KETRA KALUNGA I will step down as Green Party President if i don’t win the 2021 general elections and concentrate on cannabis growing, says Peter Sinkamba. Mr Sinkamba said in an interview that the three times that he had contested as Green Party Presidential candidate were enough so he would step aside should he fail in next year’s elections. He however said his party would emerge victorious in the 2021 elections because it was the only party with solutions to the economic problems in the country. Mr Sinkamba noted that other parties were just talking about recycled ideas which were not helping out. “As the leader of the party, this will be the last time i will be contesting if i lose the 2021 elections, i think three times contesting is good enough to give others an opportunity to also contest,” he said. Mr Sinkamba however urged all political parties to reconcile and put the interest of the nation first in order to have violent free elections. The opposition party leader said it was only when political parties co-existed that a peaceful political atmosphere would prevail. Mr Sinkamba said if political parties do not embrace the spirit of reconciliation now, the coming elections would be be marred with violence and apathy. “The prevailing political atmosphere is tense and the only way out is for political parties to reconcile and put the interest of the nation first then we are going to have peaceful elections,” he said.

ZAMAST Muchinga Province Coordinator, Josephat Chitimbwa, said middlemen and agents were the cause of high fuel prices therefore should be cut off. Mr Chitimbwa said Government should instead start trading directly with suppliers to avoid unnecessary expenses. …CBK bid to shield shilling yields dirty dollar deals NAIROBI - Efforts to shield the shilling from weakening on the official exchange rate has created a dollar black market where banks display one price on their boards but sell at a higher price. Bank treasuries show that lenders are selling dollars at between Sh113 and Sh116 apiece while Central Bank of Kenya (CBK) places it at an average of Sh111.1 A spot check by the Saturday Nation showed that lenders were showing lower prices giving an impression that they were trading at a loss. An analysis by Standard Bank’s Head of Africa Research Jibran Qureishi said the market was quoting different exchange rates because of fear of reprisal from CBK and warned of a risk of development of a dollar black market. He explained why confusion has hit banks over the shilling’s exchange rate against the dollar, with lenders now buying and selling well above the printed official rate when buying hard currency from one another. Later Stanbic Bank disowned the analysis. “The contents of that report do not reflect the position of Stanbic Bank Kenya limited. The note was authored by Jibran Qureshi of the Standard Bank Africa Research unit, which is the independent arm of Standard bank Group of South Africa,” Stanbic Bank boss Charles Mudiwa said in a
statement. HE government borrowed an average of $23.4 million daily within four months this year as its appetite for loans to finance ambitious capital projects amid the Covid-19 pandemic continues. The borrowing comes despite warnings from the Bretton Woods institutions — the International Monetary Fund (IMF) and the World Bank — that the continued pile up of public debt may prove a challenge to pay back. A document from the National Treasury tabled in the National Assembly yesterday shows that Sh322,178,194,040 in 15 new loans was procured between May 1 and August 31 from various commercial and multilateral lenders. This means that the government procured Sh887,308 an hour to finance the various projects, according to the National Treasury document. Of the 15 new loans, 12 are from multilateral lenders and three from bilateral lenders. The latest details come as the country’s public debt cruised to Sh7.12 trillion, about 71.2 percent of the Gross Domestic Product (GDP) against a ceiling of Sh9 trillion. RESIDENT Edgar Chagwa Lungu's first term of office was essentially setting a platform for the next generation of inclusivity. His next Government after his re-election is certainly to be an all inclusive Government which has regard to the diversity of the Zambian society. Even under difficult circumstances, his first term had majority of youthful characters in Government holding sensitive positions, his choice of officials was responsive to gender balancing. It is the Youth oriented approach which has made young people to have the sense of ownership of the Government and PF ruling party. Ideologically he was receptive to political diversity (that's why he was accused of allegedly appointing new comers) among other attributes of inclusiveness. In the past, youths and women had the sense of suspicion of their explosive exclusion from the corridors of power but not anymore. Against all odds, national interest came first and he utilized every talent irrespective of the political parties they originated from. This decision had injured greedy politicians who thought they had a monopoly when it comes to service to the nation. Western and Western provinces as well as Southern province. As things stand, PF will increase the margin in those provinces which also give us assurance that the party will consequently produce MPs who will be considered to serve in the next ECL Government. This will give every region a fair chance to be considered for appointment. On the participation of young people, President Lungu has broken the norm and provided an enabling environment and a platform for youths to be heard. He has also allowed youth led businesses to be empowered, sustain and grow their businesses. It is only that he is let down when social media is used as a battering rode to communicate unpalatable language as opposed to progressive ideas which would enhance quality delivery of service. Further, a progressive step to take a corrective action by affirming this commitment through constitutional reforms. Among the steps taken was entrenching the guarantee of youths having their safe seats. However, greedy politicians sabotaged this effort of promoting inclusive government. It is therefore ostensibly clear that President Lungu is determined to promote inclusive governance. Once re-elected, inclusivity will be the hallmark of the next generation of his government. SOCIAL media has been awash with messages of condolences following the death of Ryan Phiri aged 17 of Barlastone Park and a pupil of Kabulonga Boys Secondary School. Last Friday around 10:00 hours Ryan who was in the company of three pupils of Kabulonga Boys was attacked by some pupils from Twin Palm Secondary School between Malata and Twin Palm. The motive behind the attack is not yet known and friends of the deceased managed to escape but sustained injuries. Ryan was beaten by his assailants who were using golf club sticks was taken to University Teaching Hospital (UTH) but died around 18:30 hours. Mr. Frank Phiri, father to the deceased reported the matter to me police. Pupils go to school to learn and not to involve themselves in physical or any form of violence. It is heartbreaking and unfortunate that the boy was beaten to death at the time Zambia is commemorating the 16 days of activism against gender based violence. If the above is not bad enough, Ryan future has been curtailed by some evil minded and violent pupils of Twin Palm Secondary School. The deceased was scheduled to write his final examinations this month. The police manhunt for the killers of Ryan from Twin Palm Secondary School should must be intensified so that culprits are arrested and ultimately prosecuted. Justice must prevail in this matter. The gruesome murder of
Ryan Phiri Ryan by fellow pupils sends a strong warning that our children are not safe at school. To ameliorate such a heinous crime, there is need to intensify counselling of the pupils on the dangers of alcohol and drug abuse. The assailants could have acted under the influence of alcohol and drugs. Whatever exacerbated the murder of Ryan, the killers must be brought to book. What kind of generation are we going to have? It is unaccepted for pupils to attack their colleagues. I can imagine the trauma the parents of the slain boy are going through. As a parent myself, I am personally hurt about this bizarre incident. The killing of Ryan by fellow pupils has set a bad precedent. In view of the aforementioned, the police should intensify the manhunt for the assailants of Ryan so that the former can be arrested to face the full wrath of the law. ELEMIYA PHIRI Lusaka
Be wary about fraudsters during the festive season Dear Editor, Zambia and the rest of the world will be celebrating Christmas on 25th December. Christmas is the day on which Jesus Christ, our personal saviour was born. People celebrate Christmas in different ways. Some people celebrate Christmas by going to church for prayers and worship. On the other hand, some people celebrate Christmas by drinking beer and eating sumptuous meals. There is a widely held notion that someone can only enjoy Christmas when the particular individual is financially sound or has money. Whether this notion is true or not, it is a matter of debate. However, it is during the festive season that criminal activities increase as the fraudsters of different age groups resort to using various means to swindle the unsuspecting members of the general public. The fraudsters may use social media platforms sending messages to some people on the pretext that the latter
had won the prize such as a car for instance. For the winner to redeem the prize, they will be requested to deposit a certain amount of money on the prescribed mobile number. The mobile money platform has also been abused by the fraudsters to swindle people. The fraudsters may send messages such as this one; "send the money to this number 0979188020. I no longer use this number." Still on the mobile money, the fraudsters can go to the agent and deposit fake money and later withdraw the genuine ones at another booth. It is therefore imperative that the mobile money agents should thoroughly check the notes when a client is depositing the money to ascertain whether the notes are genuine or fake. To crown it all, I advise the general public to be wary about the fraudsters who are out there to swindle some people during this festive season. HE influence of light is very important as regards livestock production. It affects, though the eyes, the pituitary gland which in turn controls the sex cycle. Hens lay better as the days grow longer, and ewes can be persuaded to take the ram out of season if illumination is drastically altered by artificial means. This is seen in animals when certain minerals lack in their diet. When it comes to dairy farming, first and foremost rule on the farm must be to ensure that the maintenance and production rations are properly balanced in the broad sense of proteins, carbohydrates and fats, undernourishment arising from a shortage of one or more of these will cause a state of sub-normal health that may lead to infertility. Beyond what has been mentioned, there are the problems of finer balances in feeding particularly with regard to mineral and vitamins. The requirements of a dairy cow in production
may outstrip the available nutrient intake, resulting in disturbed fertility, in other words, when the level of milk production is in excess of that provided for by the production ration. It may be that the cow is incapable of ingesting sufficient quality of food to satisfy production needs a circumstance which is more likely to arise under conditions of intensive grazing systems. The starch equivalent of good summer grazing is just as inadequate for highyielding cows as is its mineral content. This may lead to an increase in the number

The farmer must bear in mind especially those who venture to make or compound own rations for their animals, that if there is an excess of calcium then the availability of all these is likely to be suppressed. The result may be an induced deficiency and a consequent disturbance of the breeding mechanism. So trouble may occur as a result of excess of or a deficiency of one or more of these elements thus it is clearly important to ensure that they are all present in adequate amounts in a well-balanced ration. This is all about the effect of light, feeding and balanced ration. Farmers especially dairy farmers consider what has been highlighted in this article for the purpose of keeping production going on with as minimal problems as possible. Infertility can be more than what has been mentioned. Factors can be many. Finally, to be sure that the cows have conceived. Pregnancy diagnosis can be carried out at regular intervals, say every three months or at least as often as circumstances suggest. This however, can be left to the vet because it requires considerable experience and a detailed anatomical knowledge. Ninety days after service is ideal time for this examination. The job is worth doing.

Mr Zyambo said this in a speech read on his behalf by the Katete District Commissioner Joseph Makukula during the prize giving ceremony for the 2020 Keyhole Garden Competition winners in Katete, Eastern Province. One senior lead farmer and three lead farmers of Katete district were awarded for performing exceptionally well in constructing and managing their own keyhole gardens. The event was a joint activity of the Ministry of Agriculture and GIZ’s Food and Nutrition Security Enhanced Resilience (FANSER) Project. GIZ coordinator of agriculture and food security in Zambia Moritz Heldman said his organisation appreciated the relations it shared with the ministry at national and local levels. Mr Heldman also said the Key Hole Garden Competition resulted in the training of over 1,200 extension staff and farmers in Katete and Petauke districts. A keyhole garden is simply a circular raised garden bed with a built-in walkway and a centrally placed basket for watering and compost manure. It is being promoted in Katete and Petauke districts of Eastern Province because of its ability to retain moisture in dry seasons, sustain soil fertility, and allow yearround production of nutritious vegetables. - NAIS

USIKA and SHAIS Foods, a local food processing company have signed a memorandum of understanding to strengthen its processing capacity. Speaking during the signing ceremony, Musika managing director Reuben Banda said the partnership between the two organizations is of strategic importance because achieving consumption and production of a diverse range of nutritious foods remains critical. Mr Banda said that the grant agreement is critical to achieving a key milestone in improving the consumption of a diverse range of nutritious foods among poor Zambians especially women and children within smallholder farming and rural communities. He said government through its vision 2030 and the seventh national development plan hss been making efforts to reduce hunger in all its forms for the majority of Zambians. Mr Banda explained that vision 2030 and the 7NDP are aligned to the attainment of the sustainable development goals particularly SDG number two (zero hunger). He said Zambia’s high rates of malnutrition have persisted for several decades adding that according to the 2028 demographic and health survey, up to 35 per cent of children under the age of five continue to show signs of stunted growth and 12 per cent of under-fives are underweight while four per cent are acutely undernourished. Mr Chipulu said the contract will lead to producing more snacks and engage more small scale farmers in Mumbwa district. “Once commissioned it will engage more women farmers in Mumbwa district and we intend to open 10 booths in Mumbwa district and set up bulking centre for the purposes of collecting maize. “With this kind of support we can achieve beyond imagination I would like to thank Musika for the support,” he said. Musika is a Zambian nonprofit company that works to stimulate private sector investment in smallholder agricultural markets.

Delayed Chama North road repairs worry aspiring MP

By PETER SICHALI CHAMA North aspiring candidate Yotam Mtayachalo has expressed concern over delays to commence road works on the downgraded Chama-Matumbo and the Lundazi-Chama roads from bituminous to climate resilience standards. Mr Mtayachalo said it was saddening that works have not yet commenced despite assurances from the government following the rescoping of these projects this year. Mr Mtayachalo said the rain season has just started and Chama will soon be cut off from the rest of the country because the Chama-Lundazi road and part of Chama-Matumbo road are in deplorable states needing urgent intervention. “Therefore I want to again take this opportunity to request the minister of Infrastructure and Housing to shed more light as to why work on these two projects have not yet commenced,” Mr Mtayachalo said. Mr Mtayachalo said road works on other down-graded road projects are going on elsewhere but the situation in Chama is different as no explanation whatsoever has

Mr Mtayachalo said the remaining 62km of the ChamaMatumbo road especially at Mpyanakunda village is equally in a state of disrepair which will result into the district to be cut off from the rest of the country from both sides. “We are also concerned that despite the contract to construct the Kamphemba bridge on the Chama-Matumbo road was awarded a long time ago work has not started consequently I’m appealing to the government to consider erecting a temporal bridge as the same would go a long way to alleviate people’s sufferings while the government is mobilising resources to build a permanent bridge,”Mr Mtayachalo said.
WE will not accept piecemeal amendment to the NGO Act of 2009 as proposed in the amendment Bill before parliament, Zambia Council for social Development (ZCSD), Executive Director Leah Mitaba has said. She said it would be tragic if parliament went ahead to pass the amendment to the NGO act of 2009, when there was already another process of repealing and replacing the act. The ZCSD Executive Director was speaking at the NGO regional meeting held in Lusaka to share experiences on the formulation of NGO Act. Ms Mitaba said the NGOs civic space and human rights were under serious threat,

She said that the journey to have a good NGO law has been going on for some time, led by technical working group, comprising of civil society organizations, government ministries and departments.# According to Ms Mitaba, the outcome had not been favourable.
Ms Mitaba said that the journey had been expensive and energy draining which has since looked like an impossible mission. She however said ZCSD was determined to come up with a framework that would facilitate the work of NGOs in Zambia. Ms Mitaba noted a vibrant, independent and wellcoordinated CSOs could only be realized in a favourable legal framework that promoted, good governance, civic space and
adherence to both local and international laws. “ As ZCSD, we shall also share research results on the legal analysis of the NGO act No. 16 2009 under the project being implemented with support from International Centre for Non-for profit Law ( ICNL) and the findings from the study provides useful lessons in achieving a conducive legal framework for NGOs,” Ms Mitaba said.

THERE is need for World Governments to adopt a global biodiversity framework which will provide a basis for future development plan that foster ecosystem based solutions to support lives, Water Development Minister Jonas Chanda has said. He said the adoption of the Post-2020 global biodiversity framework would outline what countries should do for the purpose of living in harmony with nature by 2050. Dr Chanda was speaking when he represent Zambia during a Virtual African Ministerial conference on environment under the theme “Enhancing environmental action for effective post-COVID recovery in Africa”. Dr Chanda noted that the Post-2020 global biodiversity framework should provide
a basis for future development planning and policy development to restore, enhance and maintain biodiversity endowment and foster ecosystem. He said Zambia had taken the challenges of climate change seriously through necessary policies and legislative framework been put in place. Dr Chanda said Africa needed to implement policies that recognized the value of natural capital, life supporting biodiversity and ecosystem services, climate change mitigation and adaptation which are vital in delivering the broadest range of crucial socioeconomic benefits. He said Zambia was already severely impacted by ecosystem degradation and noted that without transformative change, this will lead to unprecedented high levels of poverty among the communities who
depend on the environment and natural resources for survival. Dr Chanda said the Zambian Government was fully committed towards implementation of the African green stimulus programme once operationalized. He emphasized that the programme should be aligned with the regional and national development priorities so that it fosters resilience building for the environment as part of the process to green recovery. He called for mobilization of adequate resources for implementation of the stimulus program as well as ensuring that the program is implemented within the framework of national development planning processes in order to foster local practical solutions to environmental degradation and high levels of poverty.

ZRA READY FOR NEW KAZUNGULA ONE-BORDER FACILITY

HE Zambia Revenue Authority (ZRA) is ready to manage the operations of the One Border Stop Facility under the new Kazungula Bridge Project. North western province Commissioner of police, Elias Chushi, said the body was discovered on Thursday around 15:00 hours and identified the deceased as Makai Muswato aged 20. NERGY is the life blood of any country. It is virtually impossible to run a modern economy without energy. To this end, energy security is a matter of life and death for national development. This is why Energy Diplomacy across countries has been taking centre stage for centuries. Many countries including Zambia has been investing in Energy Diplomacy for a long time as epitomised by regionally integrated projects such as Tazama Pipe Line, Kariba Power Station and the Zimbabwe, Zambia, Botswana and Namibia (ZiZaBoNa) interconnector which creates a new Western Transmission Corridor in Southern Africa thereby entrenching energy security in the region Concerns regarding the prospects of our global energy security has been gaining momentum for a while. With fossil fuel; a diminishing resource, remaining number one source of energy, concerns from policy makers, opinion leaders, industry captains and Energy Diplomats remain as valid as the moon. It may be sounding like a joke but debate on the ground is that worldwide rate of major oil discoveries reached its peak in the 1960s and has since followed a steady decline. What I mean is that the rate of discovery of major oil reserves has been falling since then. This debate is usually political and is met with fierce counter debates though generally agreed that conventional fuel is a finite diminishing resource. Because oil is a political commodity, there is a sense of suspicion that data regarding specific country estimates of reserves is either overstated or understated to fit the axis of what is at stake. And according to industry consultants IHS Energy, at least 90% of all known reserves are now in production, suggesting that few major discoveries remain to be made. To put it plain, major discoveries are increasing becoming rare since 2002. In 2001, there were 8 large scale discoveries, and in 2002, there were 3 such discoveries. In 2003, there were no large scale discoveries. However, there has been some recent good discoveries to be proud of around Africa. However, given geologists’ sophiscated

Twilight in the desert as global oil reserves dwindle
understanding of the characteristics that would indicate a major oil find, it can be argued that it is highly unlikely that any area large enough to blow the mind has eluded attention. Since 1981, we have consumed oil faster than we have discovered it and the gap continues to grow. What is even more frightening is the length of lead time involved before pumping of oil commences from any discovered major oil field. The US Department of Defense once said that by 2012, surplus oil production capacity could entirely disappear unless something was done about it. In 2009, the UK industry Taskforce on Peak Oil and Energy Security said that in the following five years the world could face an oil crunch unless concerted efforts got escalated. It is no longer in dispute that discovering new oil fields has been becoming extremely hard and complicated. Just look at the recent spill from a BP oil well in the Gulf of Mexico. The well was situated more than 60km from the coast line onto sea waters and in 1.5km deep sea water. Some wells have a depth of more 8 km into the belly of the earth. Because of the difficulties of finding new ones, experts now have to scroll even in areas very environmentally unfriendly and sacrosanct. Not only is it harder to find new ones but also several major wells have already peaked meaning that they are recording declining output.

On the other hand, the global consumption has been on the rise. With current growth rates (before COVID-19 pandemic) in various economies including emerging markets such as Africa, the picture can be frightening.
It is argued that we have already consumed approximately half of the world’s total reserve of about 2.5 trillion barrels of conventional oil in the ground from the days of the first oil well at a rate of over 30 billion a year meaning the world is nearing its production plateau. This argument is fiercely counter opposed. It’s an endless debate in Energy Diplomacy given the sensitivities of energy security issues for national posturing. In the coming articles, I will detail some of the oldest oil wells and how they have served humanity.
Matt Simmons, long time energy analyst who studied energy for 34 years, in his book “Twilight in the Desert” has effectively confronted what he termed complacent belief that there are endless oil reserves in the world biggest producer; Saudi Arabia. He has created a compelling case that Saudi Arabia production will reach a peak, after which its production will decline and the world will be confronted with a catastrophic oil shortage unless major discoveries are found elsewhere. The factual basis of the book is over 200 technical papers
published over the last decades which individually detail problems with particular wells or particular fields, but which collectively demonstrate that the entire Saudi oil system is “old and fraying.” This postulation is also often dismissed as inaccurate in oil politics. Geologist Dr. Collin Campbell in a 1998 article in Scientific American also detailed numerous discrepancies about estimates in Middle East reserves. It is widely acknowledged and debated by the world’s leading petroleum geologists that more than 80 percent of all recoverable oil has now been found. Therefore, according to the debate, it is known within a reasonable degree of certainty the total amount of oil available to us. We also know our global consumption. Therefore, we can predict how much time we have before we start having serious energy security challenges down the road. Repositioning and recalibrating policies to be forward looking, building on past efforts with a sense of urgency and taking Energy Diplomacy to another level firmly anchored on unprecedented political will is what will guarantee energy security in the future. Trump campaigns in Georgia amid crucial Senate race US President Donald Trump has held his first rally after losing the US presidential election. The event in Georgia comes before key Senate runoff elections there in January which will decide control of the upper house. Joe Biden is the first Democratic candidate to win the state in a presidential election since 1992. Mr Trump has repeatedly refused to admit his defeat and made numerous unsubstantiated claims of voter fraud. Ahead of the rally he criticised Georgia's Republican governor on Twitter, calling on him to help overturn Joe Biden's election victory in the state. In his speech on Saturday however the president seemed to admit his loss, claiming his foreign policy measures could be reversed soon due to the incoming Democratic president-elect. Under the US constitution, Mr Biden will take office on 20 January regardless of whether Mr Trump admits defeat. Mr Biden won the presidential election with 306 votes in the electoral college - the system the US uses to elect a president - to Mr Trump’s 232. The college will meet on 14 December to formalise the outcome. Appearing in Valdosta, Georgia for his first rally
since the 3 November vote, Mr Trump again made claims of electoral fraud and attacked Governor Brian Kemp. Mr Trump has alleged throughout the election that the increase in postal ballots had led to widespread fraud, but there has been no evidence of this. In a speech nearly two hours long - nominally to support two Republican Senators campaigning for re-election - President Trump told the cheering crowd that he could still win the election. Repeating his unsubstantiated claims, he said “they cheated and rigged our presidential election but we’ll still win it”, adding that Mr Kemp should “get a lot tougher”. The crowd - many waving

Despite the euphoria of the event, some Republicans are concerned that the president’s continuing allegations of fraud will discourage his supporters from voting in the Senate races by falsely convincing them that the system is rigged. Georgia’s Secretary of State Brad Raffensperger, a Republican, said on Wednesday that no evidence of widespread fraud had been found to support Mr Trump’s claims. ONE of the key figures behind the August coup in Mali has been chosen for a top post despite concern over the military's continued influence in the country. Colonel Malick Diaw was unanimously elected to lead the interim legislative body, the National Transition Council. This is supposed to play a crucial role in the transition to civilian rule within 18 months. One of the country's main opposition groups is boycotting the body. The opposition group, known as the June 5 Movement, organised massive street protests against the man who was ousted from power, Ibrahim Boubacar Keïta. But it says it will not serve as a "stooge for a disguised military regime", reports the AFP news agency. The BBC’s Noel Ebrin Brou says Col Diaw was one of the brains behind the 18 August
coup and became deputy leader of the junta. He was the only candidate in the running to head the 121-member body. He also played a key role in negotiations with the West African region body, Ecowas, which imposed sanctions on Mali after the military takeover. The sanctions were finally lifted in October. Junta leader Col Assimi Goita is the interim vicepresident, while former Defence Minister Bah Ndaw leads the country. Mali is facing huge economic problems, while also battling an intense Islamist insurgency. Thousands of French, African and UN troops have been sent to the country to tackle the militants. The coup sparked international condemnation, but it was welcomed by many Malians. - BBC
Covid: South Korea raises alert level amid spike in cases SOUTH Korea is raising its Covid-19 alert levels, as it battles a rise in infections. Gatherings of more than 50 will be banned in the capital Seoul and surrounding areas from Tuesday, while gyms and karaoke bars be closed. On Sunday 631 new infections were reported in one day, the highest number in nine months. The country was widely praised for its virus response earlier this year, with aggressive testing and contact tracing. But the authorities have struggled in recent weeks. The number of active cases in South Korea now stands at 7,873, and there are concerns about rising numbers in hospitals.
There have now been 37,546 cases in total, and 545 deaths. Health minister Park Neunghoo said there was a risk of the virus spreading if nothing was done. “We concluded that this is a dangerous situation on the verge of expanding into a nationwide pandemic,” he told Reuters news agency. Restrictions would also be tightened in other parts of the country, Mr Park said, but at a lower level. They will last at least three weeks. On Saturday, Seoul’s municipal government introduced a curfew, with most businesses including restaurants, bars and cafes being forced to close at 9pm.- BBC
Durban professor develops first anti-Covid-19 drug treatment DURBAN - Vaccines are used as a preventative measure to prepare immune systems to fight off diseases and ideally prevent further infections but treatments are typically used when patients are already sick with a certain disease. The clinical pharmacologist, who cannot be named as yet due to contractual obligations, lectures part-time and is a research fellow at the Durban University of Technology. The professor told the Sunday Tribune the drug, known by the identification tag HIM20, was developed in May
but was not yet available to the public as it was going through a second round of testing. The professor had a team of five doctors and pharmacists who assisted with the clinical trial. They monitored compliance, side effects, adverse reactions and determining pharmacokinetic profiles of the drug. Family and marriage a) A Family is the smallest unit in a society which comprises of persons related by blood or marriage. There are four (4) types of families in Zambia. i.
A nuclear family: A group of persons consisting of a man, his wife or wives in case of polygamous marriage and their children.
ii.
An extended family: that consists of not only a man, his wife or wives and their children but also grandparents, uncles, aunties, nieces, nephews, cousins, in-laws and grandchildren. iii. A single headed family: that consists of a single parent and children. This can be as a result of divorce or being widowed.
iv. Child headed family: is a new type of a family that has emerged in Zambia mainly as a result of the HIV/AIDS pandemic that has claimed lives of many adults leaving children to bring themselves up (as double orphans). b) Marriage is a legal union of a man and woman as husband and wife. This contract is based on the following:i.
Rights: Entitlements a wife or husband enjoys in the union.
ii.
Obligations: These are duties that a wife or husband performs in the union. For example each of the spouses has a duty to take care of and protect the other spouse. iii. Capacities: These are abilities or capabilities that each spouse brings to the union. For example, a wife has the ability to conceive and bear children for the union.
iv. Incapacities: These are inabilities or incapacities that each spouse brings to the union. For example a wife who is not educated and not skilled in anything may bring to the union the inability to provide for the union. The elements of family law i.
Marriage: a legal union of a man and woman as husband and wife.
ii.
Divorce: Is the dissolution of marriage which is done when the court handling the case satisfies itself that a marriage had actually existed. Property settlement (Sharing):
*After a divorce in a customary marriage the woman usually gets some form of compensation to allow her start life afresh. *In a civil marriage the property is shared by the Deputy Registrar’s court in the situation where one contributed in the earning of the union, he or she will be entitled to a third (1/3) of the total wealth of the couple. *If both spouses contributed to the earnings of the couple the property will be shared at 50-50 basis. iv.
Maintenance of spouse and children within and after marriage:
•
Both within and after divorce a spouse has a duty to maintain his or her life partner.
•
Under customary after divorce a spouse is duty bound to maintain is or her partner for a maximum of three (3) years or until he or she remarries which even happens earlier.
v. Custody of children after dissolution of marriage: •
When awarding custody the ages and needs of children are taken into consideration.
•
Usually the court gives custody to the mother if the children are very young. However, the father will provide maintenance.
vi. Adoption of children. •
Under the Adoption of Children Act, Chapter 136 of the 1948 Edition of the laws of Zambia, the courts have been given power to grant an order to adults requesting to adopt a child.

In case of a couple, both or one of them should have attained the age of 25 years old and is at least 21 years older than the infant. vii.

Solemnisation of Marriage: This is when the actual wedding is performed following the laid down ritual such as each of the parties publicly declaring that he or she has agreed to wed the person that they are standing next to by saying this aloud and mentioning all the names of the person.
f)
The Marriage Certificate: This is the evidence of marriage and a copy of which is kept by the Registrar and the other by the couple.
•
Customary Marriage: This is the marriage contracted under customary practices. This marriage may not be a union of one man one woman in the case of polygamy.
•
Some requirements in a customary marriage. Consent: This is when the parents or guardians of the woman getting married give permission for her to marry and also when the person getting married agrees to marry.
a)
Legitimacy of children
Based on the United Nations Convention on the Rights of the Child 1989 (UNCRC) new laws have equalized the position of children born outside marriage to those born in wedlock.
•
viii. Succession. •
Succession when death occurs in a family is usually defined by traditional names and customs of the ethnic group that family belongs to.
•
For example the Bemba‟s trace their lineage through the mother (Matrilineal), therefore, when a Bemba person, chief or headman dies, his sons are not eligible to succeed him but one of his nephews would succeed him. A complete opposite in the case of the Ngoni.
b)
Marriage Payment: There is always payment as recognition of the marriage. The payment is made by the bridegroom- to-be to the family of the bride-to-be.
c)
Spouses: The parties to the marriage should be male and female. The female should be single, divorced or widowed but the male may already have one or more wives.
d)
Relationship: The persons intending to get married should not be closely related by blood or through marriage.
Other ‘marriages’ though not recognized under Zambian Law. a.
Note: The marriage solemnized in church should be followed up by a registration at either the Civic Centre or Council Offices under the Marriage Act or at a Local Court under the Local Court Act.
ix. Inheritance of property. • In Zambia today the inheritance of property is provided for in the Testate and Intestate succession Act of 1989.
b.
Cohabitation: This is a marriage where the parties concerned decide to live together on their own without consent by their parents or guardians and without following any rituals performed either in a customary or civil marriage and later the society recognizes the couple as husband and wife.
c.
A Void Marriage: This is the kind of marriage without legal standing right from the beginning. It is null and void.
a) Testate Succession deals with inheritance of property of a dead (deceased) who left a will. A will is a declaration normally in writing stating how a person wants his or her property shared or distributed in the event of his or her death.
•
Testator is the person who makes the will in case of a male and the Testatrix is case of a female.
•
Some reasons for a void marriage.
b) Intestate Succession: This is the Act used to distribute the property of the deceased who did not leave a will or someone who has left but that will is nullified by the courts of law. The distribution is done as follows; *20% of the estate goes to the surviving spouse. *50% of the estate will be distributed to the children both in and outside wedlock.
*10% will go to dependants in equal proportions.

If the marriage is not consummated due to impotence (consummation in marriage means making complete by having sexual intercourse) - Wilful refusal to consummate the marriage by any party.
