PUPILS OR MURDERERS? THE nation has over the past week been in a state of shock following the brutal and tragic death of a Grade 12 pupil allegedly killed by pupils from another school in Lusaka. The unfortunate victim, Ryan Phiri, who was aged 17 and was a pupil at Kabulonga Boys’ Secondary School died at the University Teaching Hospital after he was attacked by pupils from Twin Palm Secondary School. Even as we mourn his unfortunate death, and imagine what his distraught family is going through, questions abound as to what compelled the attack. One of the questions that ought to be answered is what kind of people are schools churning out, who do not value human life? According to Zambia Police spokesperson Esther Katongo, Ryan was with three of his schoolmates when they were attacked. The other three escaped but Ryan was not so lucky. Ms Katongo said the assailants used golf sticks to batter their hapless victim in an attack that happened around mid morning between Malata and Twin Palm areas. Although Ms Katongo has assured the nation that the matter is being investigated, we implore the police not to leave any stone unturned as they hunt for the assailants. They must be hunted down and made to pay for the heinous crime they have committed. Parents expect their children to be in a safe zone when they are at school – or even in their uniforms. No parent expects to be told that their child has been killed in a manner that is difficult to understand. Although we understand there could be rivalry between the two schools, this should be restricted to academic performance or even sports. There has always been a rivalry of some sorts between schools through the ages either because of academic results, or in some cases relating to sports activities. This rivalry never ended up in physical attacks amongst pupils. If anything, pupils were able to make friends through competing in sports activities for example. We thus challenge school administrations to take it upon themselves and instill a sense of oneness among pupils from the different schools. As a nation, we cannot claim to be a Christian nation when children can resort to murderous rage just because someone is from another school. Ryan’s life has been snuffed out prematurely at 17, and somewhere, those responsible are going about their lives as though nothing has happened. We hope parents with children at Twin Palm Secondary School will seriously question them if they had anything to do with the assault and act responsibly – even if it means handing their children to the police. They owe it not only to Ryan but their children too.

HE Patriotic Front has warned the UPND to stop alarming the nation with fabricated lies which cannot be substantiated. PF Deputy Secretary-General Mumbi Phiri said yesterday the UPND were so desperate that they have increased their alarmist behaviour by fabricating lies and the Zambian people cannot afford to trust such characters. Ms Mumbi has warned the opposition party not to drag the PF into their propaganda. Ms Mumbi said it was unfortunate that UPND has continued to fabricate lies to tarnish other people's names for them to get to State House.
"UPND are well known liars. Zambians have stopped taking them seriously because they have come to realise that the party is so desperate to get power and will do anything to achieve this,” Ms Phiri said. Ms Phiri was reacting to claims by UPND Secretary-General Stephen Katuka that PF was ferrying Congolese to register as voters, which she described as a sign of desperation. She said it was unfortunate that UPND has continued to lie despite their lies costing lives, even innocent youths such as Chipenzi. She said the UPND have continued to peddle lies without caring for the welfare of people all for political mileage. Ms Phiri said it is disappointing that UPND no longer cared about the consequences of their lies.
"The UPND can say anything even if it doesn't make sense just for them to get to State House," Ms Phiri said. Ms Phiri said UPND should sober up and stop peddling lies that have potential to disrupt peace. "What the UPND is saying that PF is ferrying Congelese to register as usual it is a desperate attempt to make people rise against the government but it won’t work because people know the truth," Ms Phiri said. Ms Phiri said lies have been part of UPND’s DNA and that they should not be trusted. She said she did not know the source of the forged copy of certificate of title that purported to show that Chimese is owner of the land and properties. “The copy showed to me by DEC (Drug Enforcement Commission) officers was forged and it is a forged document. The DEC officers didn’t intimate where they got it from,” Ms. Tembo said.

Dad who killed his two-year-old daughter convicted By GRACE CHAILE-LESOETSA THE Lusaka High Court has convicted a man of Kanyama Township for causing the death of his two-year-old daughter. Luckson Manda, 32, was yesterday convicted by Judge William Mweemba after he pleaded guilty to a charge of manslaughter. Facts of the offence are that on July 10, this year, around 12:00 hours, Manda was at home with his two-yearold daughter Gift. The victim started crying continuously and this irritatedd Manda who started beating the child to stop her crying. After beating her, Manda negligently lifted her from where she was and the child fell down hitting her head on the ground. She started bleeding from the noise and mouth and was taken to hospital where she was pronounced dead. A postmortem said the cause of death was brain haemorrhage due to fatal blunt force that caused the head injury. In mitigation, Manda, through his lawyer, Legal Aid, Jonas Matende said he was very remorseful for having caused the death of his daughter and it is a burden he will have to carry throughout his life especially that Gift was his only child. He said since his arrest on July 13, 2020, he has come to a realisation that prison is not a good place and vowed to walk a straight path before the law. Manda said he has since started going to church to help him manage his temper. Mr Justice Mweemba adjourned the matter to December 14, this year for sentencing.

Clergy backs Sumaili in condemning posting of indecent photos By JOHN KOMBE EVANGELICAL Youth Alliance (EYA) president, Moses Lungu has backed Minister of Religious Affairs, Godfridah Sumaili in condemning individuals in the habit of posting indecent photos on social media platforms. Ms. Sumaili recently advised those who were in the habit of exposing themselves to stop or face the wrath of the law. She disclosed that her office had received several complaints from the public who appealed to her office to curtail the wicked habit. Rev. Lungu said that Ms. Sumaili was in order and must be supported by all Zambians who treasure the culture of the land. He said that the condemnation must be embraced by all Zambians because it hinges on national values and principles. He said morality and ethics were the bedrock of the country’s culture and as such must not be abrogated for any reason whatsoever. In his view, the condemnation must not be seen as an attack on any individual because the minister was speaking from her position as a government official. He insisted that the minister being a government official had the mandate to ensure that the laws of the land
were respected. Zambia, he said, was a sovereign state that had established for itself guidelines for public conduct. He said that these guidelines were based on the long standing cultural values of the land and must be upheld if Zambia was live up to the Christian nation declaration. And Winning Life Ministries International presiding apostle Anthony Mubanga of Lusaka also supported the condemnation. He however noted that the condemnation of such acts must not be targeted at individuals and insisted that the minister was being selective in her condemnation of immorality and advised her to be balanced. Rev. Mubanga said that in as much as exposure of bodies by both men and women is immoral, it must be addressed in a more balanced manner. He pointed out that the country was faced with many immoral conducts which needed equal condemnation. He was of the view that the ministry of Religious Affairs must provide standardised leadership that condemns all acts of immorality without creating a situation where individuals feel that they were being singled out. He said that all citizens must be respected and advised in a manner that upholds human dignity.
Chanda has disclosed the UPND has launched a vicious propaganda campaign parading young children obtaining NRCs and voter cards and alleging that it is happening in the PF strongholds. And Mr Chanda has charged that the allegation by Mr Katuka that the PF is ferrying Congolese to come and register as voters is baseless and a sign of desperation. Speaking in an interview Mr Chanda said that the challenge and fear of the UPND is that the voter turnout in PF strongholds has been good hence their parading under age children and alleging that they were being registered as voters and obtaining NRCs in PF strongholds. Mr Chanda described the move as an admission by the opposition party that it stand no chance to win in 2021.
Lawyer’s risky sex case dismissed By CHARLES MUSONDA THE Lusaka Magistrates’ Court has dismissed a case in which a lawyer complained against her lover for allegedly exposing her to a health risk through sex. In this case, Ms Naomi Sithole complained against Kelvin Milambo that he knowingly and negligently exposed her to an infection dangerous to her health. Particulars of offence were that between March 26, 2020 and June 21, 2020 in Lusaka, Milambo unlawfully and negligently did acts which, and which he knew or had reason to believe to be, likely to spread the infection of any disease dangerous to Ms. Sithole’s life, contrary to Section 183 of the Penal Code, Chapter 87 of the Laws of Zambia. Lusaka Magistrate Felix Kaoma dismissed the case yesterday and discharged Milambo for want of prosecution after Ms. Sithole failed to show up in court to prosecute her matter. When public prosecutor Jordan Busiku called the case, Ms. Sithole was absent, prompting defence lawyer Osborne Ngoma to apply for dismissal of the case. Mr. Ngoma said the matter was started in terms of Sections 90 and 92 of the Criminal Procedure Code and that it was the complainant’s duty to prosecute the matter as the accused person was before court at her instance. He said as the record showed, yesterday was the second time Ms. Sithole failed to turn up to prosecute the matter and reasons of her absence were not known as there was no notice of adjournment. “Therefore our prayer is that this matter be dismissed for want of prosecution as it appears that the complainant is no longer interested in this matter and the court can’t be held to ransom…. justice should not only be done but be seen to be done,” Mr. Ngoma said.

Mr Kambwili said the constitutional court was the final jurisdiction on matters of the constitution and therefore the Ministers who drew allowance and salaries from Government when Parliament dissolved, including himself should pay back as instructed by the court. Mr Kambwili said although he did not agree with the Concourt judgement, he has no other option but to respect its decision because the ruling by the constitution court was final and whether he liked it or not the decision has already been made. He also said the decision of the court has created a constitutional crisis because under the constitution President Edgar Lungu acted within his powers to allow the Minister to continue in office after the dissolution of Parliament. Mr Kambwili said under the constitution, the President cannot be taken to court for any decision he or she makes while in office and wondered why the court made that decision when the Ministers were asked to remain in office by the President himself. He said article 106, was very instructive that Minister shall remain in office until another Government is formed, how-
ever was quick to mention that the same constitution contradicted itself when it states parliament should dissolve three months before the general election. “How can you follow up the formers Ministers to pay the allowances and salaries when it was the President using his power who instructed them to remain in office," he questioned. Mr Kambwili said the country should draw lessons from the issue and consider setting up another court lower or higher than the constitution court which would act as ladder when the constitution court makes a wrong decision. "Currently, the constitution provides that the constitution court is the final jurisdiction on constitution matter meaning whatever decision it makes cannot be challenged in another court," he said. And Mr Monde said President Edgar Lungu was not to blame for the continued stay of Cabinet Ministers in office after dissolution. He said unlike UPND, PF is a law abiding party and will comply with the decision of the court. Mr Monde said those that remained in office are capable of making their own decision therefore no one should lay a blame on President Edgar Lungu. NITED Party for National Development (UPND) Monze Central Member of Parliament Jack Mwiimbu has accused the government of conducting the Mobile National Registration Card issuance exercise in Luapula, Northern, Eastern and Muchinga Provinces. Mr Mwiimbu who is also Opposition Chief Whip said that he was
aware of what was transpiring in the four provinces. He told Parliament yesterday, the mobile exercise had continued in the provinces despite it coming to an end by November 4, 2020. But Vice President Inonge Wina and Home Affairs Minister Stephen Kampyongo remained mute over the allegations. Mr Mwiimbu said what was happening was not right because people in some areas were being disfranchised.
“People like in Western Province Mr Speaker have been disfranchised, the mobile exercise was conducted in a manner everyone expected and even after extending for five days there was many challenges and people who were eligible could not obtain the NRCs. But what is happening is that the same mobile exercise which came to an end in November has continued in Luapula, Northern, Eastern and Muchinga and people are obtaining the NRCs

THE Engineering Institute of Zambia (EIZ) has been invaded by people who are not trained and we have cadres who have joined the business, says its President, Able Ng'andu. And Mr. Ng'andu conceded that EIZ has not been proactive and this has led to the profession being eroded. He stated that a few bad elements such as cadres and fake engineers have tarnished the image of the profession and as EIZ they would not allow such unprofessionalism but step up and restore sanity.
Mr Ng'andu however explained that there was nothing wrong for the public who include political party cadres to join the business of construction but should ensure that they employ qualified engineers as provided for by the law. "EIZ has been invaded by other members of society who have taken part in construction who are not trained. We have got cadres who have joined as businessmen and there is nothing wrong in them joining the profession, but if you are not a professional engineer you should employ one because under the law of Zambia anyone can set
up any company," he said. Speaking on ZNBC Sunday interview, Mr. Ng'andu said the EIZ Act would be enforced to ensure that construction work is only done by professional engineers and at the same time punish all the erring engineers. He also admitted that things have gone wrong in the profession and this has led to some engineers compromising on quality and abandoning projects. Mr. Ng'andu said EIZ would work on correcting the wrongs which are being done in the profession by being proactive and to restore professionalism in the construction sector.

And Chief Chipepo, who is also chairman general of the FATA Zambia Chapter, said the forum is determined to fight poverty in rural areas by ensuring that indigenous people benefit from various economic activities taking place in their respective areas.
He said this is because most economic activities like mining, agriculture, and tourism in African countries take place in rural areas where many people are still living in poverty. He said the FATA is implementing a number of policies that are aimed at ensuring that people in rural areas are protected from exploitation by external players like foreign
investors. Chief Chipepo said one of such policies is the one focusing on ensuring that no investor is given a title deed for traditional land but a certificate of land lease for a specific period and not on permanent basis. He said the FATA will ensure that in all such ventures local communities hold about 10 percent shares through trusts and foundations. He

said the forum is also working at ensuring that there is an end to infighting among traditional rulers over succession disputes and boundary arguments. Chief Chipepo said the FATA is not only for chiefs but also headmen and all descendants of royal families regardless of their status and location. K66 million released for road repairs By KETRA KALUNGA
THE government has released about K66 million towards roads repair works across the country to prevent the disruption to supply, delivery, and movement of goods and services during the rainy season. Road Development Agency acting director of Communications and Corporate Affairs, Anthony Mulowa said the agency was carrying out repair works with the focus on the more vulnerable sections and structures of the road network. Mr. Mulowa said in an interview that currently, RDA is carrying out several emergency works to mitigate against any potential damage to infrastructure that would likely cause disruption to supply, delivery, and movement of goods and services this rainy season.

ECZ says voter registration will continue in prisons By PETER SICHALI THE Electoral Commission of Zambia (ECZ) will not stop voter registration for inmates as being demanded by UPND because it is implementing a Constitutional Court ruling on prison vote. ECZ acting Public Relations Manager Sylvia Bwalya said prison vote is not the making of the electoral body and that its task was to effect the judgement and inform stakeholders. “This was a Constitutional Court ruling and not the making of the ECZ.” Ms Bwalya said it was the ECZ’s mandate of implementing the judgement. “The task of the ECZ is to make sure that it effects the judgement and share with the stakeholders how the process is going to be undertaken which we have been doing from the onset,” she said. And Ms Bwalya said the ECZ in cooperation with the Zambia Law Development Association has been engaging various stakeholders on prison voting. Ms Bwalya said contrary to claims by UPND, the ECZ has been engaging stakeholders on prison votes “These include political parties, civil society, the church, the Law Association of Zambia, the Judiciary, security agencies and the public,” Ms Bwalya said.
Government condemns brutal killing of Grade 12 pupil GOVERNMENT has condemned the killing of a Grade 12 pupil of Lusaka’s Kabulonga Boys Secondary School by suspected pupils from another school. National Guidance and Religious Affairs Minister, Godfridah Sumaili laments that what transpired in the incident involving Kabulonga Boys Secondary pupil is unacceptable and should not be tolerated. Reverend Sumaili was speaking when she paid a courtesy call on Northern Province Minister, Bwalya Chungu, in Kasama yesterday.
“We are deeply saddened that the life of a young boy was lost in such a manner, we are appealing to the parents to ensure their children are brought up in a peaceful environment for them to be responsible citizens,” she stated. Firefighters mourns Chabwera THE Firefighting and Safety Suppliers Association of Zambia (FFESSAZ) , has received the death of former Chairman of the Association, Gerry Chabwera, with sadness and shock. FFESSAZ President Daliso Mwale , says Mr Chabwera, who died on Saturday, December 5, 2020, will be remembered for his immense knowledge and contribution when he saved in various portfolios. “Dr Chabwera, worked at NAMBOARD as Chief executive officer and at ZACCI as chairman and also served on many boards,” Mr Mwale said. THE Immigration Department has allegedly refused to return documents to a man of Somali origin who was released from illegal detention over allegations of terrorism. In this matter, Mr Hassan Sangab, who is of Tanzanian nationality, was last year detained for over 50 days on allegations that he was involved in terrorism and later the Minister of Home Affairs issued a deportation order against him. Several properties, including his residence documents in Zambia, were seized from his house in Lusaka’s Emmasdale area while he was in detention but his lawyers from PnP Advocates challenged his detention and subsequent deportation by way of an application for judicial review. On October 22, 2020, Lusaka High Court Judge Wilfred Muma ruled in Mr. Sangab’s favour and granted him judicial review of the Minister’s decision to deport him on October 18, 2019; and detain him from NAKONDE residents have urged Zambians to give the Patriotic Front (PF) Government and President Edgar Lungu another five year term to enable him finish the programmes the government has embarked on country wide. They say a lot of projects have taken shape throughout the country and that it is just important that the PF government is given another chance to execute all the programmes before exiting office. And Nakonde Constituency aspiring candidate Musingwa Siame has urged residents to turn up in numbers and register as voters in the 2021 general elections. Mr Siame says all Nakonde eligible citizens must register so that they can exercise their constitutional right to vote in next year’s elections. Mr Siame said this in a telephone interview in Lusaka yesterday, adding that the PF government under the leadership of President Edgar Lungu has initiated several developmental projects in

He said this was in line with what was
determined in the Amnesty International case and that he had the right to a fair hearing. Following the court ruling, Mr. Sangab recently attempted to get back his documents from the Immigration Department, which however, allegedly refused to release them for unknown reasons despite preparing a handover certificate dated November 30, 2020. According to the handover certificate prepared by a Mr. Frank Michelo and seen by the Daily Nation, the items being handed over were an alien national registration card number 996637/11/2 and residence permit number 000320 under the name Hassan Sangab. Mr. Sangab even signed on the certificate on the same date and this was witnessed by another Immigration officer a Ms. E. S Kapanda but the documents could not be released despite his lawyers having written letters to the court, the Minister of Home Affairs, Immigration Department and the Anti-Corruption Commission over the same issue.

Western PS challenges agriculture staff to find ways of harvesting water WESTERN Province Permanent Secretary, Danny Bukali has challenged agricultural experts in the province to provide technical advise on how Government can harvest abundant water from the Baroste plains. Mr. Bukali noted that Western Province receives huge volumes of water every year which was not being adequately utilized for agricultural purposes. A Y- A s -Yo u E a r n (PAYE) can only be refunded if there is a genuine mistake in the tax computation by the employer resulting in the employee being overtaxed, says the Zambia Revenue Authority (ZRA). ZRA Corporate Communications Manager, Topsy Sikalinda, said a refund could be made when an employee did not exhaust the tax credit for that particular charge year. Mr Sikalinda said a refund could also be made when getting a refund of tax deducted on tithe from an approved public benefit organisation with a valid certificate. He said in an interview that this was so even on all other
tax types. “In order for one to be refunded the over payment, their employer must have been remitting the Pay as You Earn Tax to the ZRA and the submission for a refund can only be done after the end of that particular charge year. “The claim is only done on income accrued in the final year of employment,” Mr Sikalinda said. He however regretted that ZRA offices were confronted with numerous cases of the PAYE Refund with most people thinking it was guaranteed income or refund after separating with their employers. Mr Sikalinda explained that what was refundable was not the tax paid during employment but the overpayment on the PAYE that could have resulted from pay roll errors or unwarranted deductions in

CCORDING to the 2020 Global Innovations Index (GII), Zambia is ranked 122 out of 131 countries. The ranking is based on the number of intellectual rights registered within the country. The observed trend is that there are very few innovation registrations made by locals in Zambia, with out of 2000 trademarks recorded by PACRA, only 30% are local. In addition, only 20 patents on average are registered annually in Zambia and only 2 to 3 of these are local. This information was revealed by the discussant from PACRA at the recently held Innovative Manufacturers Conference. If tables have to change to see Zambia ranked more highly in the GII, the manufacturing sector has to play a leading role and ensure that products, processes and all innovations are registered in Zambia. The manufacturing sector plays an important role in fostering structural transformation. This is because the sector has unique qualities and possesses potential for strong backward and forward linkages in the economy. The manufacturing sector also plays an important role in supporting the development
Innovation in manufacturing and commercialization of innovations. Both radical and incremental innovation are promoted strategically by the manufacturing sector. Innovation refers to creating value from knowledge through the provision of a new product to the market or a new way of producing a good or providing a service. Innovation also entails organising production processes better. Innovation is risky and sometimes requires huge sunk costs. These aspects of innovation are likely to discourage many players in the economy to invest in and support innovation. Therefore, entrepreneurs in manufacturing take risks to change things and drive innovation. Innovation has many benefits. Studies have recognised innovation as the
engine of economic growth and provide evidence to show that in developing countries, like Zambia, innovation plays a pivotal role in fostering socioeconomic transformation and sustainable development. Innovation reduces the cost of production and at the same time fosters production of better and more competitive products. Innovation gives companies an upper hand in markets. Innovation also enables firms to penetrate export markets, which they may not otherwise penetrate. All these advantages tend to culminate in job creation and supporting economic development. Recognizing the importance of innovation in economic development and the strategic role manufacturing plays in supporting innovation, this year’s Annual Manufacturer’s Week was centered on encouraging collaborative

Moreover, local perceptions that categorise local products as inferior compared to imports, make local innovations very uncompetitive compared to imports. Thereby, demotivating local innovators and possible funders to actualise local innovations. Therefore, given the important role the manufacturing sector plays in innovation it will be important to strengthen the linkages between the manufacturing
sector and the education sector to promote the adoption of innovative approaches. Additionally, it will be necessary to accelerate policy reforms such as the revision of national curricular at general and higher education to respond to changing and unpredictable economic environment and develop relevant skills set to spur growth. ZAM will play its part to enhance sensitization and make manufacturers aware of the e-platforms introduced by the Government of the Republic of Zambia which have been developed to enhance access to information and can accelerate the pace of innovation such as the e-registry and Notice and Comment Web Portals, the Zambia Trade and Information Portal and electronic rules of origin among others.

ICT Ministry crafts 5-year strategic plan HARARE - The Ministry of Information Communication Technologies, Postal and Courier services has completed the development of its five-year strategic plan, which will dovetail with the National Development Strategy 1 (NDS1) and the Smart Zimbabwe 2030 Masterplan. Government anticipates that the ICT sector will drive the Zimbabwean economy going forward. The Covid-19 pandemic has highlighted the undeniable growing significance of the digital economy. Said ICT Minister Jenfan Muswere: “In pursuit of the National Development Strategy (2021-2025), the National Vision 2030 and the Smart Zimbabwe 2030 Master Plan, my Ministry has crafted its Strategic Plan for the period 2021 to 2023, which is hinged on four core values namely, transparency,

According to Muswere, SDGs are a critical component of the Government’s Vision 2030 to be an upper-middle income by 2030. Paris Airshow cancelled in blow to aerospace recovery PARIS - The Paris Airshow has been cancelled for the first time since World War Two, raising questions about the speed of the aerospace industry’s recovery from the Covid-19 crisis. Organisers said Europe’s largest industrial showcase, which attracts over 300, 000 people every other June in alternation with Britain’s Farnborough Airshow, would not go ahead next year because of the pandemic’s “unprecedented impact” on aerospace. Aviation experts said the early cancellation reflected the high advance costs of the event, estimated to generate total spending by exhibitors and attendees of $1 billion, including $400 million on building, temporary hires and security alone. Scrapping the 2021 show also deprives the industry of a deadline to stimulate deals and focus attention on new products. “The Paris Airshow could and should have been a catalyst for recovery. The organisers have clearly listened to the big exhibitors and decided it was
not worth the risk,” said veteran analyst Howard Wheeldon, who has attended dozens of air shows. “The bigger worry is that this is saying that confidence won’t be returning soon, not only in aviation but also in the wider post-Covid world,” he added. US$186M SHORT …KRA misses tax revenue target by US$186.3 milllion

AIROBI - The Kenya Revenue Authority (KRA) missed its tax collection target by ShUS$186.3 million since March when the country reported its first case of Coronavirus. Commissioner General for KRA Githii Mburu said the taxman collected Sh1.09 trillion against a target of Sh1.28 trillion in the eight months to November. Besides, a tough business environment occasioned by the adverse effects of Covid-19, the poor tax collection was also due to the decision by the government to offer tax reliefs to citizens, which saw KRA forego Sh65 billion.
"It is important to note that, during the 48th East African Revenue Authorities Commissioner General's meeting held on November 11, 2020, it was established that, within the greater East African region, it is only Kenya that took the bold step of cushioning its citizens from the debilitating negative impact of Covid-19 by temporarily reducing tax rates," said Mbithi in an advertisement. However, with the government keen on stimulating the economy through its Sh930 billion post covid-19 economic recovery strategy, President Uhuru Kenyatta's administration has decided to end these tax reliefs. As a result, resident
corporate tax paid by big businesses will revert to 30 percent from 25 percent, the same will be the case for Pay-As-You-Eearn (PAYE). But those earning Sh24, 000 and below will continue enjoying a 100 per cent waiver. Turnover tax, which is deducted from monthly sales for small businesses will also be retained at one percent in what is aimed at supporting micro, small and medium enterprises. CBK walks tight rope on mobile transaction fees waiver NAIROBI - Kenya’s financial sector regulator, the Central Bank of Kenya, (CBK) is under the spotlight as the industry eagerly awaits a decision on whether mobile transactions will remain exempted from charges next year. The regulator is caught between a rock and a hard place, as it weighs the decision to scrap the waiver at the behest of lobbying from the financial sector or maintain the same in its mandate of broadening financial inclusion.
CBK Governor Patrick Njoroge has been non-committal, indicating the regulator could very well make the waiver permanent, as a balancing act between the financial incision and commission profits. “We are thinking about all the options,” said Njoroge when asked whether the regulator would extend the transaction fees waiver past the end-year deadline. “At this moment, we cannot announce that we will or won’t, the best thing is to be
a bit more patience and, we’ll say something in due course.” The CBK boss last week said the policy, introduced at the onset of the pandemic to reduce the risk of handling cash, has been successful in expanding digital payments among low-income earners. “In terms of mobile numbers, the use of digital platforms has increased,” said Njoroge during a press briefing last week. “From March to October, there has been growth in the low-value transaction (less than Sh100)
in the order of 15 per cent,” he said. “Some 2.7 million new or previously dormant accounts, have been brought on stream and this has increased the number of active mobile wallets by 10 per cent,” said Njoroge. Brexit: Toyota says no-deal outcome will be 'very negative' LONDON - The boss of Toyota's European business has warned that a nodeal Brexit could make its UK plants uncompetitive. Dr Johan van Zyl said such an outcome would create a "very negative investment environment" in Britain and be "very, very negative" for his business. He told the BBC the combination of Brexit and the Covid crisis was a "double whammy" for the carmaker. Toyota has two plants in the UK, which employ about 3, 000 people in total. But van Zyl said no decisions on the future of its UK plants - a car factory at Burnaston in Derbyshire and an engine facility at
Deeside in North Wales - could be taken until the outcome of trade talks was known. Like other manufacturers, Toyota has been badly affected by the Covid outbreak. Both its UK plants were forced to suspend production during the spring lockdown, while showrooms were also forced to close. Now the company is forecasting a strong recovery for its European business. But according to Dr van Zyl, its UK recovery could be made more difficult by Brexit. "We have Brexit, and we have Covid, and this is a double whammy which is happening to us," he said during an online media event.
"When it comes to the recovery… it's going to be more difficult if Brexit of course is negative, or a hard Brexit." The company has, he said, already taken steps to mitigate the impact of a no-deal scenario - but there is a limit to what it can do. "What we could put in place,

of lawyers. His dearly but fearless persona made him part of the legal team whose services were hired to defend former President Dr Frederick Chiluba until his subsequent vindication from any wrongdoing after the conclusion of the criminal trial. It was a protracted sixyear legal battle whose delay was attributed to the procedural technicalities. This made him rise to prominence and identified himself as a liberating figure and bring to a halt the immense selec-
tive justice, persecution, abuse of the criminal justice system and politically-motivated charges under a known administration led by a known former President. He was always defence counsel for a number of high profile individuals who were paraded before the defunct Taskforce on Corruption which was chaired by late Maxwell Nkole. He was a familiar face that needed little or no introduction even for those who did not have an opportunity to meet him. I firstly met him at Lusaka Magistrates Court in 2014 when I was on attachment. Later we had regular meet ups from his chambers and random meetings at the court house and a number of police stations in Lusaka. He always lent me his attentive ears whenever I was in need of his parental guidance. The greatest virtue I learnt from him was courtesy and have regard for others irrespective of their station in life. Although his law practice was full of hurdles occasioned by regular bans, his passion for the profession is unmatched. Even when his health was failing, he continued to render his services and defended numerous litigants. A number of former clients had testified the helpful persona that was imbued in him. A Grade 12 pupil of Lusaka's Kabulonga Boys Secondary School has allegedly been murdered by a group of pupils from Twin Palm Secondary School. Ryan Phiri, aged 17 of Lusaka's Barlastone area, was allegedly attacked on Friday and died at the University Teaching Hospital (UTH). Police spokesperson Esther Katongo has confirmed that investigations have been launched. Ms Katongo told ZNBC news that Ryan is reported to have been in the company of three colleagues, who escaped the attack. She said golf sticks are alleged to have been used in the attack which happened around mid morning between Malata and Twin Palm areas. In a related incident, a pupil of Lusaka High School is admitted to UTH after allegedly being assaulted by fellow pupils. Ms Katongo has confirmed the incident, adding that investigation have been instituted into the alleged assault of Jeff Mibenge, aged 18, of John Laing compound. She said his father, Mr Jordan Mibenge, filed in a complaint on behalf of his son, who is nursing injuries in hospital. Ms Katongo has warned pupils writing their exams to desist from engaging in criminal activities or risk being arrested and prosecuted.

The death of late senior and veteran lawyer Nicholas Chanda has taken many with utmost disbelief. He attended University of Zambia Law School class of 1995 and consequently was admitted to the Zambian bar as an Advocate of the High Court of Zambia in 1996. Mr Nicholas Mumbi Chanda was a persuasive and tough talking legal gun for hire. He was equal to the task whenever his attendance and services were required. I may not have all sufficient detail on his trail of legal achievements but based on my personal interactions with him, I put to pen what appear to be my tribute to him. Mr Chanda distinguished himself as a spring of knowledge emerging and aspiring professionals learnt from. His eloquence, art of written and oral persuasion was exceptional. The cogency thoughts he had were based on a resourceful and prepared intellectual. In the journey of criminal trial advocacy, a path he immensely dedicated his life to, he distinguished himself among his colleagues at the bar, the legal gladiator, the litigants and the public as a reservoir of average intellect with admirable proficiency of the Criminal Procedure Code. There were times, I was in the court auditorium when he exercised his calling as a fierce defence counsel and there was at times a dead end with fellow advocate especially with the rival prosecution side in the quest to determine disputed points of law. ECZ SHOULD PUT ITS FOOT DOWN Dear Editor, I WISH to appeal to the Electoral Commission of Zambia to put its foot down and be heard on the political front as things seem to have gone weird now. ECZ should raise its voice and be heard when people are complaining about one situation and another to give confidence to all stakeholders as we head towards the general elections in 2021. For instance, how does ECZ qualify vote buying in their electoral code of conduct? And when is the vote buying seen to be an electoral crime and what are the punitive measures it has put in place to curtail such? As a country we are witnessing a lot of huge financial and material donations to mainly churches, chiefs and political gatherings currently while most Zambians are grappling with high cost of commodities, hunger, debts, etc. Unfortunately, these donations are coming from our leaders, not just ordinary members, meaning, these are not just donations as may be argued by some. While all this is happening before the campaign window period, ECZ is silent over it while other political players are actually accusing ECZ to be playing along or double standards. It is for this reason that I appeal to ECZ to sound its siren and spell out what voter buying is before it gets worse and out of hand, where we are now even told that some voters are even being instructed on which polling station to vote from, which is unacceptable. NATIONAL Democratic Congress (NDC) Kitwe district vice youth chairman Shadrick Mutale has with immediate effect resigned from the NDC party and joined the Patriotic party citing lack of leadership as the reason for his decision. Mr Mutale cited lack of leadership in the party and that the leadership had not created room for the young people. “I have decided to join the PF because its leader who is also Republican President Edgar Lungu, has the heart for the young people as evidenced by a number of young people that he has appointed in his Government,” he said. Mr Mutale was welcomed by PF Copperbelt provincial chairman Nathan Chanda, Kitwe district chairman Evaristo Chilufya, Kitwe district secretary Lungo Kawaya among others. Mr Chanda urged all those who were still undecided to join the PF which he said was the party of choice. A RESIDENT of Luanshya Jerome Kanyika has reported the Luanshya Municipal Council to the AntiCorruption Commission (ACC) for allegedly failing to follow the right procedure in the awarding of land to Star Tanganyika investment, a new British investor taking over the tailing dams in the district. Mr Kanyika said Star Tanganyika was not among the companies that took part in bidding for the tailings and wondered why it was given the facilities.
Mr Kanyika was speaking in Kitwe yesterday. “We are challenging the council to explain to us, the residents of Luanshya and give us the minutes of the meeting they had when making a decision to give land to the firm. We also want to know which councillors attended the meeting and who the chairperson for the meeting was,” he said. Mr Kanyika has also challenged the council to explain why the government through the Ministry of Mines was not represented at the ceremony where the firm pledged to pay the benefit of
K10 million to ex-Ramcoz miners. On Saturday, Star Tanganyika handed over K10 million to pay off principal outstanding dues to former Roan Antelope Mining Corporation miners. “ The amount itself is also questionable and an insult to the would-be beneficiaries. The money is not enough for the over 5000 ex miners as most of them are owed in benefits amounting to K50, 000. “ This amount will only see the ex miners sharing not more than 2,000 each which we will not allow to happen,” he said.

ZAMRA counsels society on drugs safety By ANDREW MUKOMA THE Zambia Medicines Regulatory Authority (ZAMRA) says that for pharmacovigilance system to function effectively, it requires the active participation of all stakeholders. Pharmacovigilance (PV or PhV), also known as drug safety, is the pharmacological science relating to the collection, detection, assessment, monitoring, and prevention of adverse effects with pharmaceutical products. ZAMRA Director-General Bernice Mwale has said that, it is imperative for stakeholders such as the media, members of the public, academia scientists, hospitals, public health programs, cooperating partners and health healthcare providers to take part. She said this during the ongoing Southern Province Pharmacovigilance advocacy training workshop for healthcare providers in Livingstone yesterday. Ms Mwale said that healthcare providers are at the heart of any Pharmacovigilance system and play a pivotal role Ms Mwale in ensuring that safety information, including, adverse drug reaction, product quality problems and medicine errors are promptly reported to the authority. She said that this is in order for causality assessment and decision making to be at play. “I therefore call upon healthcare providers to engage, and collaborate with the authority in the implementation of Pharmacovigilance activities so as to ensure safe and rational use of medicine,” Ms Mwale said. Meanwhile, Ms Mwale informed participants that ZAMRA has revised the Pharmacovigilance trainers manual, Pharmacovigilance reference and Pharmacovigilance handbook, in partnership with Global Fund, Ministry of Health and Churches Health Association of Zambia.

TEACHERS at Kelongwa primary school in Kasempa are forced to squat in nearby villages due to inadequate staff accommodation. Currently,the school which runs from grades one to nine only has one staff house which is occupied by the school head teacher. And a resident, Mr Abel Kalepa has appealed to government through the district administration to consider putting up more staff houses for the teachers. He said it is not safe for teachers to be squatting in nearby villages because anything can happen to them. “On behalf of Kelongwa community, I want to make an earnest appeal to government to quickly consider putting up staff houses for our teachers. It is not safe for them to be squatting in nearby villages,” he said.

Only five (5) senior officials of any participating political party with Electoral Commission of Zambia accreditation will be allowed to accompany aspiring candidates into the Nomination Centre during the filing of nominations. CCRA - Votes are being counted in Ghana after presidential and parliamentary elections. Initial results suggest the incumbent Nana AkufoAddo is ahead of his rival, the former president, John Mahama. The ruling National Patriotic Party (NPP) is also reported to be leading in the parliamentary polls but Mahama’s National Democratic Congress (NDC) disputes this. The election on Monday passed off largely peacefully, but local media in the central region say a group opened fire at one polling station, injuring two people. In Uganda, presidential
candidate and musician, Robert Kyagulanyi, popularly known as Bobi Wine, has told CNN that he survived what he called assassination attempts in the last two weeks ahead of next month’s elections. The politician last week briefly suspended his campaigns after members of his campaign team were injured and his car damaged. He told CNN’s Christiane Amanpour that there was no level playing field for presidential candidates and the “military had taken over (policing) the campaign process.” “I have to put on a bullet proof [vest] for me to able to campaign. I’ve survived two assassination attempts in the last two weeks where bullets have been shot in my car and
on the tires and the windscreens,” he said. Uganda will hold its election in January 2021. Bobi Wine is looking to unseat President Yoweri Museveni, who has governed the country for 34 years. Meanwhile, Liberians are voting in a referendum about shortening presidential terms from six to five years and allowing citizens to have dual nationality. Some of President George Weah’s critics are concerned that he could use the constitutional change to extend the number of terms that he serves. BUSHIRI FRAUD CASE: Accused 1’s bail application postponed as State witness unavailable JOHANNESBURG - The formal bail application of Willah Mudolo - accused one in the Bushiri fraud case - has been delayed after it was postponed yesterday in the Pretoria Central Magistrate’s Court. The formal bail application of the Zambian was provisionally set to proceed yesterday, however, the State requested a postponement after it was revealed to the court that a State witness was unavailable. Mudolo’s formal bail application began on November 6, two days after his co-accused were granted bail. Ethiopia must restore the rule of law in Tigray, says UN UNITED NATIONS - “It is essential to quickly restore the rule of law, in full respect for human rights” in Ethiopia’s northern Tigray region, UN Secretary General António Guterres has said. In a brief statement he added that he was “very concerned about the current situation” in the region after four weeks
of fighting between federal troops and the forces of the Tigray People’s Liberation Front (TPLF). More than 40, 000 people have fled across the border to Sudan and many others may have been forced from their homes. Within Tigray itself it is thought that there are many
