INISTRY of Labour officers yesterday bounced when they went to look for the Chinese national and his employee, who was spotted in Lusaka being wheeled on a goods trolley at Carousel Shops by the Zambian worker. The officers found the shop closed. Government officers have been looking for Lao Yan to ascertain what really transpired since Saturday. Inside sources said the employee, John Zulu switched off his phone after ministry officials contacted him to get his address and that of his boss, Mr Yan. The source said the labour officers were now looking for their residences. “We need to review his contracts, see terms and conditions etc... the employee cannot advise us to leave his boss alone,” the source said. that the bank did not report any suspicious transactions on the account from 2012. He said no payment of K590, 000 was made in Chimese’s account by ZAF and that the account was credited with K421, 344 by ZAF as a gratuity payment because his contract had ended but the Drug Enforcement Commission (DEC) seized it. Mr. Chikontwe said the

gratuity payment was not a suspicious transaction or a crime. He said it was not dubious to receive gratuity because a customer had worked for it and that it was an entitlement. He said it was not the kind of transaction that the bank would report about. Mr. Chikontwe denied being aware about Chimese’s appointment as a diplomat in Zimbabwe and that he was paid by government in foreign currency. He said he was not aware of the money which Chimese was given when he was recalled in 2011 therefore the said payment could not reflect on the documents he submitted before court.

State closes Kambwili dog libel case By CHARLES MUSONDA THE State has closed its case in which National Democratic Congress (NDC) leader Chishimba Kambwili is charged with defamation of the President for allegedly referring to President Lungu as a dog from Chawama compound. Testifying as last prosecution witness yesterday, arresting officer Stephen Nkowani said a person who recorded the video in which Kambwili made the remarks in August 2019 is not known and that the gadget used to record it was not examined. In cross examination by defence lawyer Keith Mweemba, Mr. Nkowani said Kambwili uttered the words in Bemba and that a translator translated them into English.

He said President Lungu is not mentioned in the indictment and that the price of mealie meal was not K150 per 25 kilogram bag at the time Kambwili uttered the words. Mr. Nkowani said he did not have anything to show that Agriculture minister Michael Katambo did not say that the price of mealie meal had doubled to K150 in August 2019 from K75 at the start of the year. This was after Mr. Mweemba showed him an online publication in which Mr. Katambo was quoted. The witness disputed that the mealie meal price had increased to K150 and that he did not know satire and a satirical expression, which he said he did not bother to investigate because he did not see the need to investigate the angle of figurative speech. The case comes up on April 6, 2021 for ruling on whether or not Kambwili has a case to answer.

Mopani workers get legal support

GOVERNMENT has secured legal services for over 2,500 Mopani Copper Mines employees who had sued Stanbic Bank for unilaterally increasing interest rates on their personal loans. Mines Minister Richard Musukwa says government through ZCCM- IH has hired a legal Counsel to represent the aggrieved Mopani Copper Miners in order to assert their rights against Stanbic Bank. Mr. Musukwa said government has received numerous complaints from the Mine workers whose initial case was dismissed by the Kitwe High Court after they failed to raise funds to pay the Lawyer. He said government has secured legal services for the Mopani Miners in order to understand the problem and protect their interests. Mr. Musukwa said that government has a duty to ensure workers at Mopani Copper Mine are not short-changed in any transaction they venture in. And Mine Workers Union of Zambia President Joseph Chewe said the gesture by government is a relief to the miners who have been paying Stanbic Bank over the last seven years. Mr. Chewe said Mopani workers will be assured of more money in their pockets once the loans are scrapped off their pay slips. Mopani workers have been challenging Stanbic Bank for increasing their interest rates from 15 to 40 percent.- ZNBC

State assures jobless doctors By NATION REPORTER GOVERNMENT has assured over 400 “protesting” doctors who are seeking employment that they will all be employed when funds are made available. Ministry of Health Permanent Secretary – Technical Services, Kennedy Malama told the doctors that Treasury authority had been given to recruit 395 health workers, including doctors. Dr Malama said in as much as the number was not enough to accommodate all the doctors seeking employment, recruitment was done in phases depending on the availability

GRIZZLY Mining Limited has paid more than K400 million in taxes to Government from 2015 to date while maintaining the full workforce with strict adherence to Covid-19 guidelines. The emerald producing firm has maintained 805 workers at the emerald site in Lufwanyama, 45 kilometres from Kitwe, with strict adherence to Covid-19 safety guidelines. Grizzly Vice-Chairman, Abdoul Ba, said in an interview that all the workers were on full salary and were operating in phases to avoid overcrowding and were being checked regularly by a team of health workers at the company clinic within the mining area. He said operations would continue because workers needed income while the firm was determined to keep operations afloat. He said the chairman, Mr Abdoulaye Ndiaye, popularly known as Gounasse, has given strict instructions to ensure that there is strict adherence to Covid-19 guidelines and was desirous to keep generating revenue and contributing to Government coffers in terms of taxes. Mr Ba explained that the firm did not perform very well in 2015 and 2016, when it paid taxes in form of mineral royalties, export duty and Pay As You Earn, amounting to K10, 784, 525 and K20, 180, 390 respectively. Eventually, some of them came through. I had to make such effort to ensure that we keep running and paying the workers and eventually taxes to Government,” he said. Mr Ba said the partnership under Gemcanton could not hold as differences deepened and production went down, hence his team reverted to Grizzly to redeem operations.

According to a memorandum note of appeal filed in Court on March 5, 2021 ,The Attorney General argued that Ms Justice Mwikisa erred in law and fact when she quashed the decision of the minister and that the judge also erred in law and fact when she held that the manner the minister declared the CEC transmission and distribution lines as common carriers did not comply with law. He further argued that the Judge also erred in law and fact when she declared that the manner in which Statutory Instrument S.I 57 was drafted did not leave room for CEC to negotiate new terms or conditions.

Ms Justice Meikisa on February 26 this year quashed the minister's decision . But on March 4, 2021 , Mr Kalaluka filed a notice of appeal in a matter involving the attorney general , ERB vs the people informing the court that he would be appealing against its decision. Ms Justice Mwikisa on March 5, this year granted the Attorney General leave to appeal against her decision. And in an affidavit in support of the notice for application for leave to appeal, the State said that it should be granted leave it was seeking because the appeal had high prospects of succeeding at appeal. CEC which has cited the Attorney General and the Energy Regulation Board (ERB) as respondents, was seeking a declaration that Mr Nkhuwa’s decision to declare its transmission and distribution lines as common carrier is unlawful.

IT is the duty of the police to protect the vulnerable in society from being bullied by the “mighty” in society. This is why police must explain what is happening to the Hatembos of Kalomo – Milton and his sister, Pheluna. Police must tell us where the siblings are. They just cannot vanish into thin air without trace. Police owe it to not only the Hatembo family but to the nation as well to thoroughly investigate what is going on in their lives. The siblings are unable to lead a normal life because stronger forces have taken over their lives, which police must end. Police have not handled the Hatembo saga from the time when the family was attacked at their homestead in Kalomo. This was after they lost a case in which they had sued UPND president Hakainde Hichilema for illegally occupying their 2, 000-hectare farm in Kalomo, farm number 1924. First, the family was attacked, apparently to instill fear into them so that they do not appeal against the court ruling. Milton Hatembo disappeared for some days, only to reappear under the protection of some dubious non governmental organisation-orchestrated press conference. But he has not been heard from since that press conference last month. And yesterday in Lusaka, Milton’s brothers, Cosmas and Emmerson were at the Lusaka Central police station to officially report that their relatives were missing. Cosmas said Pheluna and Milton were abducted after the family sat and agreed to appeal against the High Court ruling to the Supreme Court over a case of Kalomo Farm 1924. He explained that they decided to come from Kalomo to report the matter in Lusaka because they believed that the duo were abducted from Lusaka. “We are here in Lusaka from Kalomo seeking help from the police. This is why they are even prepared to hold a funeral gathering for them, that they could be dead. As Cosmas explained, there was no way that Pheluna could leave one of her children who is differently-abled and depends on her for needs, for days on end. No mother can do that. THE Constitutional Court has dismissed a petition by losing independent Lundazi Central constituency candidate Bizwayo Nkunika in which he was asking it to declare the seat vacant alleging that the incumbent Member of Parliament Lawrence Nyirenda does not hold a full Grade 12 certificate. In its judgement, the court stated that Mr Nyirenda did not contravene Article 70 (1) (d) or the Constitution as such he remains MP for the constituency . But ConCourt president Hilda Chibomba and Judge Palan Mulonda in their separate dissenting judgements declared the seat vacant arguing that he had no academic qualifications equivalent to a school certificate. This is in a matter where Colonel Nkunika, the former

Zambian High Commissioner to London petitioned the election of Mr Nyirenda for allegedly not holding a full Grade 12 certificate. He claimed that Mr Nyirenda was not supposed to take part in the parliamentary elections because he allegedly does not have a Grade 12 full certificate or an equivalent as required by law. Col Nkunika cited Mr Nyirenda as the first respondent and cited the Electoral Commission of Zambia But Mr Nyirenda and the ECZ urged the court not to entertain the petition contending that apart from it being statute barred, the current MP qualified to contest the seat and hold the position as he had academic qualifications equivalent to a Grade 12 school certificate Mr Nyirneda’s documents presented during filing in of nominations included a GCE certificate with one pass, a ZNS certificate, a certificate in computers and certificate in theology training by extension. Delivering the majority judgement by judges Ann Sitali, Mungeni Mulenga and Martin Musaluke, yesterday, the court said that Mr Nyirenda will continue to serve as MP as he did not breach the law and had academic qualification that made him eligible to contest the seat.

Health NGO aids women By CHARLES MUSONDA HOLOGIC Inc., a global leader in women’s health, has partnered with leading analytics and consulting firm Gallup, Inc. on the creation of the Hologic global women’s health index, the largest and most comprehensive assessment of women’s health in the world. The multi-year initiative is the first survey to track critical markers of women’s health and safety by country over time. According to a statement issued in Lusaka yesterday, the partnership will include individual responses from more than 120, 000 people across 116 countries and in 40 languages. Through a series of targeted questions, the Hologic global women’s health index will provide unique insight on reproductive health, domestic violence, preventive care, access to care and early disease detection. Hologic conducted the survey as part of Gallup’s world poll, the most comprehensive and farthestreaching survey of the world. The survey connects with more than 90 percent of the world’s adult population through annual nationally representative surveys with comparable metrics across countries.

“In our ongoing work to support women’s health around the world, we’ve struggled to find comprehensive data that measures progress on key issues like access and quality of care on a global scale,” said Steve MacMillan, Hologic’s chairman, president and chief executive officer. “Beginning in 2019, we started working with Gallup to develop the global women’s health index to fill this critical need for a datadriven approach to women’s health. Particularly now, as longstanding disparities in healthcare are exacerbated by the Covid-19 pandemic, we hope that the upcoming findings will shine a spotlight on the need to redefine policies and put women at the center of post-pandemic responses and health systems moving forward,” Mr. MacMillan said. Hologic and Gallup developed survey questions for the Global women’s health index under the guidance of global women’s health experts and thought leaders from leading institutions such as Johns Hopkins University, George Washington University, RAD-AID, and Popper and Company among others. LUANO’S Kampoko Bridge has collapsed due to heavy rains experienced in the area, says Senior Chief Mboroma. The traditional leader said the damaged bridge was negatively affecting the movement of people in Ching’ombe and Mboshya areas in accessing services. “This sad development is affecting the movement of people, goods, and services such as health and education,” he said. Senior Chief Mboroma said the bridge was recently renovated by the Road Development Agency (RDA) but collapsed, hence the need to find a lasting solution to the problem. The traditional leader was speaking when Luano District Commissioner Christopher Chibuye paid a courtesy call on him. And Mr Chibuye, who is also chairperson of the District Disaster Management and Mitigation Unit, visited the site to see the extent of the damage. He called for calm among residents, saying Government was working on modalities to ensure the situation was addressed. “We will find an alternative for people within the shortest period,” he said. MANUFACTURERS DECRY UNFAVOURABLE TENDER OUTLAY

ZAMBIA Association of Manufacturer (ZAM) is concerned that local producers are still struggling to account for a lion’s share in Government and mining industry procurements due to unfavourable tender financing arrangements. This is due to, among other things, unfavourable tender financing arrangements and preference for imported products among procurement departments, ZAM vice president-South, Chipego Chileshe, said. In order to address the concerns of manufacturers, Zambia Public Procurement Authority (ZPPA) indicated that Parliament has amended the Public Procurement Act of 2008 to make it more responsive to the needs of the industry. Furthermore, ZPPA stated that the Public Procurement Statutory Instrument (SI) number 63 of 2011 is being revised to align it to the 2020 Amended Act. ZPPA was responding to the concerns of the manufacturers during the Local Content and Proudly Zambia Mini- Expo conference held on March 3, this year.

The Memorandum of Understanding (MoU) seeks to strengthen collaboration between the two institutions in promoting the growth of the local companies.

Kafue Council denies tampering with Lafarge’s land

Commissioner of Lands and Kafue Town Council provide details of all subdivisions created on its land number 16326/M and that the same be cancelled immediately. Lafarge is also seeking an order that Zambia Police Thrift and Credit Corporative Society Limited removes its fence erected on its land. The plaintiff seeks an order of interim injunction restraining the three defendants from any further transactions until final determination of the matter. In a claim, Lafarge Zambia stated in June 2004, the Ministry of Lands issued a certificate of title for a piece of land situated in Shimabala

LUSAKA High Court Judge Sharon Newa has sentenced a 36-year old man of Kafue Estates to four years imprisonment with hard labour for killing his wife after she questioned his drinking habits. Thomas Banda, who appeared remorseful, pleaded guilty to a charge of manslaughter. Facts were that Banda on November 6, last year in Kafue Estates killed his wife, Prudence Hamoonga. On the fateful day, Banda came home at midnight and found his wife sleeping. He picked up a quarrel with Ms Hamoonga who queried over his

drinking habits. It was during the scuffle that Banda pushed her and she fell to the ground. When he notice that she was not moving, he called the neighbours who assisted him take her to Kafue District hospital where she was pronounced dead. According to the post mortem, the cause death was blunt impact trauma to the head due to an assault. In mitigation, Banda pleaded with the court to exercise maximum leniency as he was now a widower with two children aged four and seven years. He added that his children still needed his guidance. He said he was deeply traumatised

for having caused the death of his dear wife, a fact that would haunt him throughout his life, which was punishment on his own. Banda said he has reformed and joined a Catholic group and upon his release, he would want to be an ambassador for Gender Based Violence. Judge Newa said she considered Banda’s mitigation and noted that he had readily pleaded guilty, therefore had not wasted the court’s time and resources. “I have noted that you have room to reform. I sentence you to four years imprisonment with hard labour effective November 10, 2020, the day of your arrest,” she added.

ECL’s candidature is in tandem with the ConCourt ruling, not treasonous Dear Editor, INITIALLY, we had abandoned the debate pertaining the eligibility of President Edgar Lungu as it was without any doubt coined to divert from serious issues. We did our level best to belabour to engage the opponents of President Lungu’s candidature but the issue is void and we cannot substitute our energy for productive debate. As far as we are concerned, ECL is eligible and his eligibility is no longer a legal but a political debate. We will therefore treat the statement by a named senior lawyer as political discourse just like any other person opposed to his candidature. We will not discuss legal issues pertaining ECL’s eligibility because with all due respect, the learned counsel was merely politicking. As far as we are concerned, ECL is eligible and those opposed to his candidate can do what is within the law but above all, they should respect the decision of the ConCourt. We know the proceedings that are premised on Article 52 are novel in our legal history and our friends on the left are ever zealous with futile academic court processes meant to hold the institutions of Government hostile. We recall on how in the aftermath of the 2016 elections pursued the proceedings in the High Court over what they termed as the “right to be

heard” with the apparent hope of holding the ConCourt culpable over the interpretation of 14 days. It is in public domain on how they persistently fished in the dark and they have not succeeded in their academic legal proceedings. It is ostensibly clear President Lungu is a popular candidate who is in good standing with the electorates and this is calculated to avoid facing him on the ballot. It is also surprising that the named State Counsel has elected to suggest that it’s treasonable for President Lungu to contest as Presidential candidate. As far as we are concerned, the court pronounced itself on the period less than three years as not constituting a full time. All we can say is that obeying the judgement of the ConCourt is not treasonable at all, it is instead ECL’s patriotic duty to offer himself for service. It is not correct in an event that ECL has filed his nomination, he can be accused of seizing state power by what his opponents are calling as unlawful means. We therefore urge all Zambians and all those interested in public affairs, to ensure they properly acquaint themselves with the judgement of the ConCourt and all relevant literature so that they do not fall prey to hoaxes of deception. It has become a matter of public concern that most Zambians have opted for the “copy and paste” kind of thinking. The copy and paste kind of thinking process is the one that adopt the thought of others as gospel truth without interrogating the substance of the thoughts. It is this same “copy and paste” kind of thinking which has made some Zambians not to have the courage to interrogate the barrage of misleading comments regarding the eligibility debate. should be in the fore-front championing the wearing of face masks. It is regrettable that the operators are the ones frustrating Government’s efforts in this fight," he said.

Mr Kamuti said observed that it was difficult for bus operators to advise their passengers to adhere to the health guidelnes if they were not leading by example.

He noted that this was a danger in the sense that no passenger would accept to do what the bus owners were practicing. Mr Kamuti explained that in as much as people wanted to make money at the time the economy was limping, it was important that they also took

health matters into serious consideration. He said this would help reduce the number of new Covid-19 cases being recorded and save many lives. Mr Kamuti reminded citizens to always take precautionary measures, stating that the pandemic was a serious one.

THE ELIGIBILITY DEBATE: THE SILLY SEASON IS FINALLY UPON US

HE SILLY SEASON is once again upon us.

The debate on President Edgar Lungu’s eligibility which is being fuelled by the opposition and their media surrogates and outfits is a perfect indication that the SILLY SEASON is yet again upon us. Before I am accused of insults or and unpalatable language by the ignorant arrogants who comment before reading, let me first begin by explaining what the phrase SILLY SEASON means. A Silly Season is a period when the mass media often focus on trivial or frivolous matters for lack of major news stories; a period marked by frivolous, outlandish, or illogical activity or behaviour. 1. The issue of President Edgar Lungu’s eligibility is a DEAD ISSUE; the Constitutional Court already RULED upon it. 2. The judgment of the Constitutional Court is FINAL, it cannot be challenged by any other court in the country. 3. The question of what it means to HOLD OFFICE TWICE was conclusively dealt with by the court in determining whether President Lungu is eligible or not. 4. Any other issue on this matter is merely academic and an exercise

in futility. However, some lawyers will use this debate to make money and some politicians will use it to try to mislead the public. Here is a summary of the CONSTITUTIONAL COURT JUDGMENT ON THE ELIGIBILITY OF PRESIDENT LUNGU: SELECTED JUDGMENT NO. 6J OF 2018 (2224) IN THE CONSTITUTIONAL COURT OF ZAMBIA

2017/CCZ/004 1. TENURE OF OFFICE OF MR EDGAR CHAGWA LUNGU PRESIDENT OF THE REPUBLIC OF ZAMBIA 2. THE ELIGIBILITY OF MR EDGAR CHAGWA LUNGU, PRESIDENTIAL CANDIDATE IN THE PRESIDENTIAL ELECTION TO BE HELD IN 2021 We have considered the submissions by the parties and we have also reviewed the authorities cited. To ably answer the question whether the presidential term of office that straddled two constitutional regimes can or should be considered a full term in terms of Article 106 (3), and (6) of the Constitution, it is imperative to first determine what would be considered as ‘HOLDING OFFICE’ under Article 106. In particular, Article 106 (2),

which we have already quoted above. states that a President shall hold office from the date the President-elect is sworn into office and ending oh the date the next president-elect is sworn into office. From the above, it is clear that once a President takes up office, he/she shall hold office until the next president-elect takes up office. The question therefore, is: For how long can a president hold office? In order to answer the above question, we have to/ consider the tenure of office of the office of president. In this regard, article 106 (1) which we have quoted above provides that the term of office for a President is five years which shall run concurrently. The Applicants have posed two questions and we shall address them in the order in which they are presented. We begin with the first question. Going by the parties’ respective submissions, the main question/issue is whether President Edgar Chagwa Lungu will have served two full terms for purposes of Article 106 (3) as read with Article 106 (6) of the Constitution of Zambia at the expiry of his current term. Previously, the limitation in eligibility for election to the office of President, as provided in the repealed Article 35 (2), was premised on the

fact that a person had been elected twice as President regardless of the period the person served as President, even when the person was required only to serve the remainder of the term of office of his or her predecessor. Under the current Constitutional regime, however, the holding of office as President is attached to the term of office as defined in Article 106 (1) and (6) read together. While Article 106 (1) provides that the Presidential term of office is 5 years, Article 106 (6/) defines what constitutes a full term. Any period of 3 years and above is a full term. A period less than 3 years is not a full term. Article 106 (6) thus presents a novel situation, providing that a person will be deemed not to have served a full term of office as President if at the time he or she assumes office, less than 3 years remain before the date of the next general elections. The intention of the Legislature as shown from the import of Article 106 is that a person can serve two five year terms amounting to 10 years. However, with the enactment of Article 106 (6) two other scenarios now obtain. Under Article 106 (6) (a), it is possible that a person can serve for a period of less than 10 years, being! one term of at least 3 years and another term of 5 years and these will count as two full

terms. The converse is also true under Article 106 (6) (b) it is now possible for one to occupy the office of President for a period which is less than a full term in addition to two full terms of office meaning that a President can be in the office for a total of almost 13 years. We have decided to add this for clarity. Therefore, it is clear from the above provisions that when the Constitution is read holistically, we believe, the intention of the Legislature was that when a person takes over the unexpired term of a previous president, that person should be able to serve a substantial part of the unexpired term in order for such a term to be considered a full term. We are of the considered view that the provision regarding the full term must be applied to defining what is meant by twice held office under Article 106 (3) in interpreting the provisions of that Article. It therefore, follows that in the current case, the term served which sits astride the pre and post 2016 constitutional amendments and having looked at

the intention of the Legislature as we have done, and the holistic approach we have taken in interpreting Article 106 of the Constitution in its entirety, our answer to the question that we have rephrased is that the Presidential term of office that ran from January 25, 2015 to September 13, 2016 and straddled two constitutional regimes cannot be considered as a full term. *The author is PF Deputy Media Director..

Introduction

The United Nations Development Progamme (UNDP) in Zambia hereby invites Civil Society Organizations (i.e. Non-Govenrmental, Community-based and Faith-based organizations) to a Virtual Meeting to be held on Thursday 11 March 2021 at 10h00. The meeting will seek to introduce CSOs to the mechanism and procedures to participate in UNDP processes of grant-making to CSOs especially in the context of the Democracy Strengthening in Zambia (DSZ) Project which seeks to promote transparency, inclusion, accountability, integrity and peace during elections; also promoting institutional strengthening of key institutions of democracy including the Electoral Commission of Zambia, National Assembly, Judiciary, Zambia Police Service, the media, civil society and political parties. Objectives

The Virtual Briefing on UNDP Grant Making Mechanism and Procedures is intended to increase the targeted stakeholders’ response to the Call for Proposals and ultimate participation of non-state actors in the implementation of the project activities, particularly the promotion of voter education and stakeholder engagement targeting Women, Youth, People with Disabilities (PWDs), Persons in Lawful Custody, and rural voters in the 2021 elections. Specific objectives: a)

b) The DSZ Project was born out of the key recommendations of the United Nations Needs Assessment Mission (NAM) in 2018 which outlined the need for UNDP to work closely with both state and non-state actors (i.e. civil society organisations, community and faith-based organizations) to achieve the aforesaid project objectives. DSZ seeks to promote collaboration and synergy with non-state actors in areas such as voter education and public outreach, and supporting dialogue for electoral transparency, inclusion, integrity, and accountability. In this context, DSZ recently invited non-state actors to submit proposals to partner with the project to promote specific activities including voter education and stakeholder engagement to increase the participation of Women, Youth and People with Disabilities (PWDs) in the upcoming elections across all Zambia’s 10 provinces. The Call for Proposals presents an opportunity for UNDP to interact with non-state actors who will receive grants to implement activities aimed at increasing electoral participation of women, youth and PWDs, Persons in Lawful Custody (PLCs), first time voters and rural or hard-to-reach voters in the context of the 2021 General Election and beyond. The grants ,which will not exceed USD 50,000, will be in the form of four streams or categories to which individual applicants must direct their bids, namely:  Improving Women and Youth Participation in the Electoral Process.  Improving Persons with Disabilities (PWDs) participation in the Electoral Process.  Improving Persons in Lawful Custody Participation (PLC) in the Electoral Process.  Improving First Time Voters including students’ Participation in the Electoral Process.  Strengthening the capacity of community-based and/or faith-based organizations to promote civic

Supreme Court throws out last of Trump’s bids to challenge results

WASHINGTON - The US Supreme Court on Monday disposed of the last of three cases brought to the justices by former President Donald Trump challenging his election loss, bringing a muted end to his quixotic quest in the courts that had been aimed at holding onto power. The court without comment rejected Trump’s appeal challenging thousands of absentee ballots filed in Wisconsin, an election battleground that the Republican businessman-turned-politician lost to Democrat Joe Biden by more than 20, 000 votes. Biden became President on January 20.

It was the last of three petitions filed at the Supreme Court near the end of Trump’s presidency that the justices declined to take up. The court on February 22 turned away Trump’s other two appeals - a second Wisconsin challenge and one relating to voting in Pennsylvania, another pivotal state Trump lost. Lower courts previously had ruled against Trump in those three cases. It already was clear that the high court, which includes three justices appointed by Trump, had no intention to intervene in the cases and others filed by his allies because it did not act before Congress on January 6 certified Biden’s victory. BARELY four days before the 2021 Total Under-17 Africa Cup of Nations was scheduled to kick off in Morocco, the Confederation of African football (CAF) has cancelled the Youth AFCON due to ongoing concerns about the coronavirus pandemic in the host country. Zambia, Nigeria, South Africa, Uganda, Tanzania and Cameroon are among some of the sides set to miss out on the prestigious tournament for Africa’s brightest young talent following the decision to cancel the event. CAF Communications Director Alexandre Siewe, confirmed that the CAF Emergency Committee decided to cancel the tournament after a meeting held on Monday in Rabat. Siewe stated that the committee noted the resurgence of the Covid-19 pandemic, increased restrictions on international travel and about the evolution of the situation. “The committee was made aware of the constraints faced by some of the participating member associations as well as the host country, including the fact that the coronavirus pandemic continues to present significant challenges for the organisation of international sporting events,” read a Caf statement from Siewe. Caf who are set to elect a new president on Friday also noted that Fifa’s decision to cancel the U-17 World Cup in December was also deemed as a contributing factor which led to the cancellation of the youth AFCON. However, the news has not been received well by Zambia Under-17 coach George Chilufya who is leading a team which is among five out of 12 participating countries that already set up base in Morocco to prepare for the tournament which was due to run from March 13 to March 31. Others are Ivory Coast, Senegal, Tanzania and Uganda. Chilufya said the disappointing news was not good for the development of his young charges who were looking forward to showcase their talents. “This is not good for African football. The boys and all of us had put in a lot and the association invested a lot but again we are living in a world full of surprises and the Covid-19 has turned the world upside down,” Chilufya said. The Young Chipolopolo had been pitted into Group A that consisted of hosts Morocco, Ivory Coast and Uganda while Nigeria, Tanzania, Algeria and Congo-Brazzaville were set to meet in Group B.
