President Lungu has appointed nominated Member of Parliament, Raphael Nakacinda as minister Water and Sanitation minister. He has since wished Dr Chilufya well in his future endeavors. This is according to a statement issued by special assistant to the President for press and public relations, Isaac Chipampe. In February 2015 Dr Chilufya was appointed Deputy Minister of Health. After retaining his seat in the 2016 general elections, he was promoted to Minister of Health. Dr Chilufya’s sacking follows the revelation by the Parliamentary Accounts Committee (PAC) that the ministry allowed the distribution of substandard medical supplies by Honeybee which was awarded a US$17 million contract to supply medical kits. This was revealed at the PAC hearing where Ministry of Health Permanent Secretary for Administration Kakulubelwa Mulalelo, and director for procurement Wilson Banda, ZAMRA Medical Stores Limited (MSL), and the Zambia Bureau of Standards (ZABS) were summoned. And ZABS executive director Manuel Mutale confirmed that according to tests the latex condoms and gloves supplied by Honey Bee, were substandard and the results were submitted to ZAMRA and Medical Stores for a decision to be made. And ZAMRA admitted that there has been an oversight

by the institution to not recall the products from the market because the authority has been waiting for other test confirmations from Zimbabwe. MSL distributed condoms and gloves to the public that did not meet the required standards set by the Zambia Bureau of Standards in September, 2020. But the Committee heard that unfortunately the fake condoms, gloves and paracetamol was authorized for distribution more than three months ago by the office of the Permanent Secretary at the Ministry of Health despite the items being substandard. The Ministry of Health Permanent Secretary for Administration, ZAMRA and Medical Stores all struggled to give satisfactory answers on why fake condoms and gloves have been distributed to the public and no recall of the products has been done three months after the distribution, thereby putting the lives of many people across the Country in danger. Meanwhile, Honey Bee Pharmacy through one of its directors Zakir Motala failed to provide the addresses of the company as documents availed did not have such information including letter heads and has been ordered to provide the information in a few days. And as more irregularities were revealed in the multimillion dollar contract, it was discovered that ZAMRA in 2019 did reject awarding Honey Bee a certificate due to 17 inadequacies, but after the release of the Auditor General’s Report in 2020, meeting without minutes was held by ZAMRA on a weekend and certification was done.

Covid claims 5 more lives as 1,161 cases recorded By NATION REPORTER FIVE Covid-19 patients have died in the last 24 hour, Health minister Chitalu Chilufya has said. And Dr Chilufya said 1,161 new Ccovid-19 cases had been recorded out of 11,700 tests done in the last 24 hours bringing cumulative COVID-19 cases nationally to 27,728. He said all the deaths recorded in the last 24 hours were facility deaths and included two patients in Levy Isolation Center; a woman in Livingstone Central Hospital; a young man in Solwezi General Hospital; and an elderly man in Lewanika General Hospital. Dr Chilufya said the cumulative deaths was now 469 with 164 being due to Covid-19, while 291 were Covid-19 associated deaths and 14 were yet to be classified. Meanwhile, Dr Chilufya said the new cases were detected in 47 districts with the highest five being Lusaka (365); Ndola (140); Kabwe (137); Rufunsa (74); Chipata (52). He said the number of patients admitted to health facilities was 191 cases with 112 on oxygen therapy. “We have discharged 86 people bringing the cumulative recoveries to 20,598. Unfortunately we lost 5 patients in our health facilities,” Dr Chilufya said in a statement. Dr Chilufya said poor adherence to prescribed public health measures coupled with the vicious nature of the new strain in many circumstances being the exacerbating factor of the increased number of cases. He urged the public to mask up, maintain physical distance, wash hands frequently or use hand sanitizer; avoid crowded places and stay at home and seek medical attention early if symptomatic.

Chongwe water contractor complains of delayed payment By JOHN KOMBE THE contractor that worked on the Chongwe water improvement project has complained that Government is delaying to settle outstanding payments after the successful completion of the upgrade. Zambezi Drilling Limited, Company Engineer, Ramaprassad Ilindra said Government had a balance of about K4.2 million of the K17.2 million project sum. He explained that Government had however paid K3 million of the K5.4million penalty for delayed payments. Mr Ilindra said Government owed about K5.4 million in total and that owing to the prolonged implementation period of the project, the company had incurred unexpected costs and as such any further delay in payments was not in the best interest of business. In his view, the delayed implementation of the project which commenced in 2014 cannot be blamed on the company. He said that Lusaka Water Supply and

Sanitation Company (LWSSC) was to blame for changing a number of designs on the project coupled with delayed payments. Mr Ilindra said that the company had completed the works after a lot of pressure from Government. He said that it was regrettable that the same Government that insisted that it was committed to seeing the project completed had gone mute on outstanding payments. The company engineer charged that the relevant departments were not picking his calls after his firm successfully completed the project. LWSSC projects manager, Wycliffe Kunda, refuted claims of any outstanding payments to the contractor, insisting that the firm was paid in full. Mr Kunda however promised to verify if the contractor had made any claims on extra works done. According to him, the contract sum included contingency and could not be paid without justified reasons. Mr Kunda said that the project would be officially commissioned any time soon as it had passed the initial testing phase.

Where is promised development, M’membe asked By NATION REPORTER A BEMBA sub-chief who allegedly agreed to give Fred M’membe a huge tract of land in exchange for a palace, clinic and school, got nothing. And now Chief Mukwikile of Shiwang’andu says the former Post Newspaper proprietor, Mr M’membe had not yet delivered the development promised to his sub-chief, Chama Nkulungwe. Chief Mukwikile told the Daily Nation in an interview that Mr M’membe has since 2016 not honored his promise to construct a school, a clinic and build a house for sub-chief Chama Nkulungwe in exchange for the land. The traditional leader said Mr. M’membe has never shown commitment towards his proposal of giving the people of Mwika village a clinic and school and build a house for the sub-chief as agreed. Mr M’membe who is Socialist party leader is alleged to have built a mansion on the piece of land acquired using by allegedly deceiving the chief, off the shores of the Chambishi River. Mr M’membe was personally taken by Shiwang’andu Member of Parliament (MP) Stephen Kampyongo who was an aspiring candidate at the time who revealed that he was present at the time he “Mr. M’membe” made promises to the chief when acquiring the land. And Evangelical Youth Alliance President, Reverend Moses Lungu said it was sad that a person aspiring to lead the country could use such deceptive ways to get what he wanted. Rev. Lungu described the act by Mr. M’membe as selfish and urged the chiefs in the district to denounce him and alert their subjects of such people who use the distress of people to their advantage. “That is how selfish M’membe can be, he does not mean well and such a character is not to be trust, he had the Post Newspaper closed for non tax compliance,” he said.

Complacency is dangerous!

THE soaring numbers of covid-19 infections and the low compliance levels among citizens must not only worry Government but also all Zambians across the country. Even with enhanced awareness programmes, people are still merry-making in highly congested bars and night clubs without masks. Social media is awash with images of hundreds of patrons being flogged mercilessly in beer outlets in the night, many of them dead-drunk and screaming their lungs out. Reports surprisingly suggest that after being smoked out, some of them drove to other night clubs and hideouts, which they thought were safe, but they ended up enduring yet another corporal punishment at the hands of uncompromising law enforcement officers. A person can never be more embarrassed than being flogged in public with their images splashed all over even for the children and dependents to watch. One then wonders the reasons for such downright defiance! Yes, the decision to prosecute bar and night club operators via fast-track court is an appropriate action which will curb illegality. However, revellers too require to be arraigned! Perhaps the night patrols conducted in Lusaka at the weekend should be replicated to all parts of the country. This initiative will send a strong signal but should also be done during the day in markets, bus stations and other public places. Citizens will only respond positively once they notice men and women in uniform patrolling public places and pouncing on defiant persons. It is difficult to explain the laxity among the residents in the face of the deadly and fast-spreading second wave of the pandemic. Even with information that the daily infection level has breached the 1,000 mark, people are still complacent. On Saturday, there were 108 patients on oxygen while 23 people died. The cumulative total on Saturday stood at 26,567 cases, 464 deaths and 20,512 recoveries and this calls for extra caution. It will be prudent to enhance awareness programmes in Churches, learning institutions and work places. Evidently, the virus thrives in cold temperatures as the numbers shoot up significantly and drop drastically in the hot weather. As Health Minister, Chitalu Chilufya, has repeatedly emphasized, citizens ought to demonstrate responsibility by masking up while in public and should also observe physical distance. Residents must avoid unnecessary movements and also wash their hands regularly to ensure that this pandemic is brought down. European countries, with modern and advanced medical facilities, are overwhelmed with covid-19 patients and Zambia just needs to take pragmatic action now. The United Kingdom on Saturday recorded close to 70,000 cases with more than 1,000 deaths while hospitals were overwhelmed with critical cases. It follows, therefore, that the disease has no boundaries as it can attack the low-income populations as well as the affluent. In Zambia, high-profile personalities including ministers have been infected by the pandemic. For once, Zambians must take responsibility and follow the health guidelines so that the numbers can recede. Schools are opening on January 18 and hence the need to fight his disease vigorously and ensure the school calendar is not negatively affected. Complacency is dangerous!

SOME traditional leaders are preventing miners from accessing areas given to them by Ministry of Mines and Mineral Development, Small Scale Miners Association of Zambia has complained. As a result, this is affecting progress in developing the small-scale mines. Association president Kunda Chani said the situation was devastating because a number of mining projects had stalled. Mr Chani said in some areas chiefs and headmen were stopping legal owners of mining areas to operate, thereby encouraging illegal activities.

He said in an interview yesterday that some mining areas had been invaded by illegal miners with the support of the traditional leaders. Mr Chani said such development was unacceptable and called urgent intervention from the Ministry of Mines and Mineral Development. "These are the things which are mainly affecting the growth of the sector because no development is being done by miners as required by the law. When Ministry of Mines and Mineral Development issues a mining right to miners they expect them to start operations according to the law. When nothing is done

in the mining area then they have right to revoke the licence. Mr Chani said Government explaine to traditional leaders that their role in mining sector was only to give consent and they were not supposed to stop miners to operate. “With this kind behaviour from our traditional leaders which we respect, how can development take place in this mining area? I am calling on the Ministry to ensure that they take keen interest in such matters because they affect the economy," he said. He added: "The sector can only develop significantly when the miners have support from Government as well as traditional leaders.”

Chief Chitimukulu counsels on voting PARAMOUNT Chief Chitimukulu of the Bemba has urged Zambians to exercise their democratic right, by turning up in large numbers to vote in the 2021 general election. The traditional leader was speaking when he crowned 21 traditional leaders, drawn from North-Western province, as ambassadors of peace, under the Movement for Voter Sensitisation. The Chitimukulu, who is Patron of the Movement for Voter Sensitisation, says the organisation will soon have a footprint in all the provinces. And North-Western Province Minister, Nathaniel Mubukwanu has urged the organisation to encourage people to vote, a gesture, which must be supported by all Zambians. Meanwhile, traditional leaders from the North-Western province have welcomed efforts by Movement for Voter Sensitisation to educate people on the importance of voting in the province.

PRESIDENT Edgar Lungu should intervene and ensure that ex-United Bus of Zambia (UBZ) employees are paid their terminal benefits, UBZ representative John Nyirongo has said. Pastor Nyirongo said 475 former UBZ employees out of 1,200 have died without getting their terminal benefits. He said the former employees have on several occasions written to Secretary to the Cabinet and petitioned President Edgar Lungu to no vail. “Over 475 of our colleagues have died without getting their terminal benefits and more people will die if we are not paid, we therefore appeal to the Head of State to intervene and ensure that former UBZ employees are paid,” Pastor Nyirongo said. Properties belonging to the United Bus Company of Zambia (UBZ) worth about US$5.5 billion have vanished after liquidators handed them back to Government in 2001. The properties were supposed to be sold off to pay ex-workers’ terminal benefits following the liquidation of the

company. According to the appeal petition by ex UBZ employees, addressed to the President and dated October 8th, 2017 by the Committee of Inspection for UBZ (in liquidation), the liquidators who were engaged managed to dispose of some properties and proceeds were used to clear off dividends for majority of the creditors. The initial letter indicates that the first liquidator, R. M Sombe in his final report indicated that the terminal benefits of former employees were agreed to be treated outside the liquidation law. It states that the joint liquidation team comprising C. Lumpa, A. I. Kalaluka and C. Mabutwe who were later engaged by Government found almost all movable assets and few properties had been sold leaving residential properties as the bulk of the remaining assets. “To our surprise on October 9th to 13th, 2006, the fourth Dividend payment was conducted leaving out former workers who were unsecured creditors,” the latter reads in part,” the petition reads in part. In 2001, upon expiry of

agreements and payment of outstanding charges, the liquidators handed over all the remaining 82 properties worth about US$5.5 billion to Government through the Ministry of Finance. The properties were handed back on agreement that the houses be sold to ex-employees by deducting the price from their terminal benefits or they be sold to clear the dues. To the surprise of the committee and ex-workers, the Secretary to Cabinet’s office referred the former employees back to the liquidators for payment of terminal benefits when the agreements had expired and properties handed to the State. The State made it clear that it did not have anything to do with the terminal benefits for UBZ workers. Mr. Chanda said this in response to reports in some sections of the media that President Edgar Lungu had a failed rally at Mufulira’s Shinde stadium. He explained in an interview that the Shinde stadium was just a temporal place that was designated as a landing bay for the presidential chopper en route to Sunset motel where the Head of State addressed PF party officials. The Luanshya mayor said contrary to lies peddled by the opposition, the PF party has gained ground in the province and has penetrated the rural areas which were once the opposition stronghold. “We will not labor to explain the opposition propaganda and contrary to lies by the oppositions and some sections of the media, PF has penetrated the rural areas of the province which were once a preserve of the opposition,” he said. Mr. Chanda said the ruling party would not allow the opposition to distract them from their main focus of providing leadership to people in the country. And Mr. Chanda said as the party in the province they are excited that the certainty surrounding the jobs at Mopani Copper mine has been cleared by the President’s visit to the province. He said in a statement that President Lungu’s visit to Mopani and KCM has demonstrated the Head of State’s resolve to protect the interests of the Zambian miners. Mr. Chanda stated that the President’s assurance that no mine would be closed in Zambia was a sign that the PF led-government would continue to protect jobs on the Copperbelt. On his three days tour on the Copperbelt, President Edgar Lungu toured Lubambe Copper Mine in Chililabombwe, visited Konkola Copper Mines, Mopani Copper Mines, and met with Mine Unions as well as Copperbelt University students.

EXPRESSION OF INTEREST ZDA/MSME/001/2021: REQUEST FOR EXPRESSION OF INTEREST FOR THE DEVELOPMENT OF THE GOVERNANCE CHARTER FOR THE PROPOSED TRADE AND INDUSTRIAL DEVELOPMENT FUND 1.0 BACKGROUND The Zambia Development Agency (ZDA) is a Statutory Body under the Ministry of Commerce Trade and Industry (MCTI) charged with the mandate to promote trade and investment and facilitate enterprise development to enhance business competitiveness. The ZDA with support from the Government of Finland through the Accelerated Growth for SMEs (AGS) Programme being implemented through the Ministry of Commerce, Trade and Industry (MCTI) seeks the services of a consultant to undertake the task of development of a governance charter for the proposed Trade and Industrial Development Fund (TIDF). The imperative to operationalise the TIDF is premised on Government’s recognition that, while the economy has performed strongly over the last 10 years (with annual growth in GDP averaging 6%). The contribution of local business enterprises particularly Micro, Small and Medium Enterprises (MSMEs), smallholder farmers and cooperatives to economic growth has remained low. One major constraint towards higher performance of local business enterprises has been limited access to affordable medium- and long-term business financing. It is estimated that less than 25% of MSMEs, smallholder farmers and cooperatives are able to access business finance from commercial banks and other non-banking financial institutions. Equally Micro Financing Institutions are too expensive with interest rates normally averaging 30% per month. There are few Development Finance Institutions in Zambia with a specific mandate to support Growth Oriented Enterprises with adequate portfolios to meet the huge demand for affordable medium and long term business finance. Additionally a significant number of local enterprises have a weak asset base to use as collateral to secure business financing. Further, the preconditions placed by development finance institutions to borrowers have proved to be an impediment to most of the local business enterprises. Driven by its mandate to accelerate industrialization and diversification of the economy, the ZDA has extensively consulted with public and private investors with a view to attract investment to operationalize the TIDF. The consultative process has triggered traction to develop a Governance Charter that will be employed to operationalize the TIDF. 2.0 PRE - QUALIFICATION The Agency is therefore inviting firms to express interest to develop a Governance Charter for the proposed Trade and Industrial Development Fund. 3.0 GOAL The goal of the governance charter is to operationalize

the Trade and industrial Development Fund for the Zambia Development Agency. 4.0 OBJECTIVE OF THE ASSIGNMENT The specific objectives of the Assignment are as follows: • Documentation of local and international best practices in fund management; • Develop a Development Fund Governance Charter, including financial products (debt, equity and mezzanine finance); provide a financial model for the fund and sustainability strategy – including exits from equity positions; • Develop a fund capitalization strategy and model; • Identify staffing, technical and system requirements for ZDA to effectively manage the fund – or a suitable implementing partner to manage the fund on behalf of ZDA; • Craft an operational manual that will be employed to drive the Development Fund; and • Train the Board and Management of the Development Fund on how to use the operational manual. 5.0 SCOPE OF WORK The scope of work is as follows: • Draft a Governance Charter that will be employed to operationalize the Development Fund; • Draft a Standard Operational Manual (SOP) for operationalization of the Development Fund; and • Draft a Fund Capitalization Model. 6.0 DURATION OF ASSIGNMENT Eight (8) Weeks 7.0 QUALIFICATIONS/EXPERIENCE The following are the minimum qualifications and experience requirements: Corporate Competencies • Registered legal entity with Patent and Company Registration Agency (PACRA); • Minimum 10 years of experience in carrying out similar assignments at Institutions in Zambia and/or other African countries; and • Previous undertaking for similar assignments for reputable institutions. HE Bank of Zambia (BoZ) has called on members of the public to familiarise themselves with the features of genuine banknotes and report any counterfeits to relevant authorities. BoZ Manager Currency Front Office Operations, Patrick Phiri, advised the public to scrutinise a number of security features to identify genuine banknotes. Mr Phiri explained in the BoZ Zambanker Magazine that the easiest way to check and spot counterfeit banknotes was to use the feel, look and tilt-method. “Bank notes have many security features and it is not

expected that members of the public will remember all of them. However, you can pick two or three features that you are comfortable with to use regularly,” he said. Mr Phiri stressed the need to check more security features if first checks raised suspicions. He emphasised that the main principle was to compare the suspected note to an already identified genuine note. The security features to look out for include tactility where genuine banknotes have a feel of roughness when one runs a finger over the note. Genuine notes have a gold iridescent stripe, peak pixel, watermark value numeral, hologram, security thread and

a serial number. Meanwhile, Mr Phiri called for heightened collaboration between members of public and the police in combatting currency counterfeiting, as it is a problem that cannot be dealt with by law enforcement agencies alone. He urged members of the

public not to be afraid of the police but instead work with them in fighting the scourge. Mr Phiri and BoZ Manager Government Securities, Chiputa Chikatu, said there was enhanced engagement between the Central Bank and the Zambia Police on the amicable handling of counterfeits.

THE Word Bank has called for the strengthening of macroeconomic policy frameworks to deal with the financial crises currently being experienced by countries due to Covid-19. The multilateral institution indicated that the pandemic had shown once again how financial crises or deep recessions could set back years of per capita income gains. This is contained in the World Bank’s January 2021 Global Economic Prospects report According to the report, policies to moderate business and financial cycles remained one of the key components of a growth-enhancing policy agenda. To be effective, the World Bank said, such policies should be conducted within robust and credible frameworks. “Resilient monetary policy frameworks allow policy makers more room for proactive monetary policy. “Exchange rate passthrough from depreciation to inflation tends to be smaller in countries with more credible, transparent, and independent central banks; inflation-targeting monetary policy regimes; and better-anchored inflation expectations,” the World Bank said.

The World Bank stressed that establishing and maintaining resilient monetary policy frameworks was especially important against the backdrop of the recent launch of unconventional monetary policy tools. It indicated that fiscal rules could help prevent fiscal slippages and ensuring that revenue windfalls during times of strong growth were prudently managed. “Strong fiscal frameworks have also been associated with lower inflation and inflation volatility, suggesting that they tend to support the central bank in delivering its mandate,” the World Bank said. At the country level, the Bank said, some of the most pressing reforms were long overdue while other long-standing reform needed have been cast into a new, more urgent light by the pandemic. The World Bank said where fiscal positions were stretched, the most urgent and most cost-effective reforms need to be prioritised. It indicated that areas that needed to be shielded from fiscal consolidation to ensure future growth need to be identified. “In countries with long-standing challenges in raising government revenues, domestic resource mobilisation could be prioritised,” the World Bank said.

Can PRINCE2® be applied to all projects including personal life projects? What are the characteristics of a project methodology? A methodology is like a recipe, a recipe is normally prescriptive in terms of what to do in every step of cooking a dish. The same can be seen of PRINCE2® methodology. Many people confuse a framework to a methodology. They are not one and the same thing. A framework is loosely coupled and rather more generic. Framework and methodology are arguably the most terms used interchangeably. PRINCE2® is a methodology and stands for Project in Controlled Environments the 2 you see the end means that was the major syllabus revision was in 2009 hence revision 2, and several revisions has taken place

Final thoughts: Whenever and wherever there is work? Work needs to be managed hence the need for a project manager. A recognized project management methodology provides an extra assurance to sponsors and all affected project stakeholders that the project’s envisaged deliverables and benefits will be delivered to closely meet their expectations. Informal sector swallows bitter pill HARARE - The informal business sector has welcomed the Government’s decision to scale up lockdown measures in the face of increased Covid-19 infections and deaths, but is appealing for concessions, where possible to allow their members to conduct business. Last Saturday, the Government scaled up lockdown measures which only allow those in essential services to continue operating, albeit under strict supervision. However, the informal sector doesn’t benefit from these waivers largely due to the difficulties that come with supervising the sector. This is despite the fact that some of the informal

businesses provide essential services while majority of the citizens survive through informal activities such as manufacturing, trading and agriculture. Zimbabwe is currently grappling with a surge in Covid-19 infections and the latest round of tough lockdown restrictions are aimed at limiting the spread of the virus. In a statement, the Zimbabwe Chamber of Informal Economy Associations (ZCIEA) appealed to the Government to consider its members who provide essential services. It appealed for the provision of safety nets for its members, most of whom survive from hand -to-mouth and need to work in the lockdown. Given the size of the informal sector in Africa, the Africa Union said the governments should immediately take measures to support people making a living out of it. – THE HERALD, Zimbabwe.

KENYA DEBT CRISIS BLAMED ON FANCY PROJECTS

AIROBI - A senior member of the Jubilee Party has blamed Kenya’s current debt burden on what he calls Jubilee administration’s populist projects started between 2013 and 2017. National Assembly Majority Leader Amos Kimunya said the projects are undertaken by the government in President Uhuru Kenyatta’s first term, and which were financed by debt, are costing the country. Between 2013 and 2017, he said, the commitments made to electrify the country or extend railway lines did not factor in the cost. “There were a lot of populist issues that were brought in that are costing us and have

increased the country’s debt burden,” he said on Citizen TV. Pointing out the expansion of Standard Gauge Railway to Naivasha, and the Last Mile Connectivity Programme, which was aimed at expanding electricity connections, Kimunya said the costs of the projects were not considered and the country would have done without them. “There isn’t any economic activity to guarantee a return on investment on the railway in the foreseeable future,” Kimunya said, adding that the Sh160 billion used to build the SGR could have been spent on other “meaningful” projects. The Kipipiri MP, who served as Finance minister between 2006 and 2008, was elected back to Parliament in 2017 after losing in 2013. He

said he would have advised against the projects if he were in office. The government has proposed to raise the debt-ceiling from Sh9 trillion to Sh12 trillion, a move Kimunya said he would support on condition that the money is used to revamp the economy. “There should be rationale for what we are raising the money for. For instance, if Kenya needs another Sh1 trillion to revamp the economy, I would support it,” he said, insisting he would not back a debt ceiling increase if the money would be used for recurrent expenditures. He said Kenya’s increasing debt was being used as political capital by supporters of Deputy President William Ruto’s expected

Zim Garlic farmers urged to increase exports

IMF board, citing increased credit exposure risks, raises reserve target WASHINGTON The Executive Board of the International Monetary Fund has agreed to raise the medium-term target for the fund’s precautionary reserves given a sharp increase in financial risks since 2018, the IMF has said. The fund’s 24 executive directors increased the target to Special Drawing Rights 25 billion, or around $36 billion, from SDR 20 billion, or $29 billion, after a regular biannual review conducted at the end of October, the IMF said in a statement. SDRs are the IMF’s own unit of currency. The review, delayed by a few months to permit an assessment of the impact of the Covid-19 pandemic, showed a significant increase in the

fund’s credit exposure and related risk since the last review in 2018, compounded by the pandemic. “Credit outstanding has nearly doubled, including a surge in emergency financing without conditionality, and commitments under precautionary arrangements are higher than at the last review,” the IMF said in its statement. It said credit had become more concentrated and scheduled repurchases were larger and more bunched. The current target for precautionary balances of SDR 20 billion was also likely to drop below the indicative range this fiscal year and next. Given these developments, directors agreed to keep the minimum floor for precautionary balances - which include general and special reserves and a special contingent account - at SDR 15 billion and raise the medium-term target to SDR 25 billion, while continuing to monitor the situation carefully. – REUTERS.

HARARE – Local garlic farmers have been urged to increase exports riding on the growth of the global market which has expanded to US$2.48 billion in the past two decades, from US$500 million, according to ZimTrade. The national trade development and promotion organisation said the number of local smallholder farmers with potential to export has been growing exponentially over the past few years. “Currently, the interest generated by smallholder farmers, regardless of land size, is an indication that they have potential to contribute more

to national exports. “What is now crucial is identifying crops that are relatively high-value and can be produced by smallholder farmers on a commercial scale. Garlic is one of those crops,” said ZimTrade in a statement. Garlic is easy to grow and can be produced in most parts of the country. It is less complicated in terms on crop management compared to other high-value crops, ZimTrade advised. Capacity development will need to be considered, as the horticulture sector is one of the priority areas identified by the National Export Strategy,

ArcelorMittal restarts Africa’s largest steel plant ahead of schedule on higher demand JOHANNESBURG ArcelorMittal South Africa’s Vanderbijlpark plant has returned to full production, weeks ahead of a planned restart due to a pick up in steel demand, says the company.. The firm which is Africa’s largest steelmaker had said in September it would resume production at its

Vanderbijlpark plant in January 2021 after it cut back output due to a drop in demand following the Covid-19 lockdown. However, an improvement in local demand saw the restart of the second blast furnace at the company’s Vanderbijlpark Works on December 20. “The company accelerated

The church must be the uncompressing mediator to politicians Dear editor, AS a Christian nation, the church is another critical stakeholder that the politicians both from the left and right should look up to as the voice of reason and hope. There are times when the relationship between politicians from left and right can have a severely strained relationship and that the parties can only communicate through a third party. Without any taint of doubt, the church is that third party that can present a more voice of reason to foster harmony among the political stakeholders. We find it strange that the Zambia Council of Catholic Bishops (ZCCB) can pen a highly subjective statement that promotes seeds of discord in a highly hostile and politically charged environment. We all do not take pleasure in seeing cold blood being spilt for whatever reasons. We all condemned in the strongest possible terms the protest leading to the abrupt but avoidable termination of life of two citizens Mr Nsama Nsama the state prosecutor and Joseph Kaunda a UPND cadre who were killed in circumstance that are yet to be established. President Edgar Chagwa Lungu has issued a strong worded statement to this effect and directed the police to furnish him with a comprehensive report on the regrettable incident. In his own words, the Republican President has termed this as “senseless and avoidable killing.” We therefore find it improper for any stakeholder to issue partisan comments that are meant to undermine the credibility of the ongoing investigations. The statement by the Catholic Bishops is with all due respect not in good taste as it has partisan considerations. We wonder why the Catholic bishops in

their wisdom find it convenient to condemn in a subjective manner yet they do not see anything wrong in the provocative stance by HH and the UPND leaders who ferried cadres with the view to stage manage the popularity. We expect the church to counsel all political leaders to respect the institutions of Governance including the police which was within its Constitutional and statutory mandate of ensuring that any person suspected of having committed an offence is made to account. We wonder why the Catholic bishops did not condemn the disrespectful public statement and daring of the police by the UPND leadership which is tantamount to anarchy. The statement has a lot of partisan lenses and short of what a neutral arbiter is expected especially in this environment building up to elections. We are desirous to know how the church arrived at the conclusion that it is the police that shot the slain citizen. We do not agree that the Council of Bishops has any capacity to carry out a thorough and impartial investigations at the speed of light and hurriedly issue a statement. We are of the view that their comment is based on speculations and they do not have facts to establish a connecting link between their accusations and the police. Further, the Council of Bishops does not have the legal mandate to do so or make any premature conclusion. While we agree that the Government institutions should be accountable to the people, we do not hold the view that that should be the basis of making them a source of despondency. We hope the Council should in future have courtesy to engage every concern in a manner that do not undermine the integrity of Government institutions. We least expect them to be entrapped to the gallery. In sum, we wish to condemn the partisan approach the Council of Catholic Bishop has taken on matters of public interest. OVERNMENT through the ministry of Agriculture has dispatched 7 thousand litres of Fall Army Worm chemicals to fight against the deadly pest from ravaging field crops in Southern Province. Southern Province Agricultural Coordinator, Max Choombe said the chemicals

Dr Choombe said quantities of chemicals being distributed per district are dependent on reports received from District

Dr Choombe emphasised that the chemicals distributed from the Provincial Office to District Agricultural Coordinators in the province and subsequently to farmers should be strictly for free and not for sale. He also observed that farmers should realise that the chemicals are an emergency measure and they are also expected to buy their own chemicals to assist in controlling and containing the pest. Dr Choombe told the National Agricultural Information Services that his office has received reports of Fall Army Worm attaches on field crops from most districts in Southern Province adding that infestation is at the small level. He further pointed out that so far the crop stand in the province is very good for the 2020/2021 season noting that if there will be no floods the province anticipates a bumper harvest. Dr Choombe said most of the maize in the field is green and not yellow as it has received fertilizer. He named the districts to be recipients of the Fall Army Worm chemicals as Kazungula, Livingstone, Zimba, Kalomo, Choma, and Sinazongwe. ECONOMIC NUTRITION INITIATIVE By LAWRENCE KABUTU THE Zambia Economic Nutrition Initiative Through All has started up a stock feed plant aimed at increasing and developing the nutrition levels and economic capabilities of farmers in Southern Province. Intermediary Aggregator Gilbert Vlahakis says the plant has been constructed and equipped with specialised stock feed machinary at an initial cost of US $200,000 United States Dollars from Musika Zambia and himself contributing equal amounts. Mr Vlahakis noted that the stock feed plant will assist farmers to access feed that is affordable and available as it is localised at his farm in Monze. He clarified that within this year his company will take up Maize, Sunflower, Cowpeas, and Soya beans from farmers in Southern Province to commence production of starter, growers, and finisher stock feeds for local chickens and other livestock. Mr Vlahakis was speaking in an exclusive interview with the National Agricultural Information Services in Monze. He disclosed that the total capacity of the plant per hour is two tonnes to get about 10 to 16 tonnes of stock feed per day. -NAIS

recalled immediately. Mr Kangwa also called on the Zambia Medicine Regulatory Authority (ZAMRA) and Medical stores limited (MLS) to take their work serious and stop taking Zambian for granted. He also urged all those people who used the substandard condoms and gloves to go for VCT and hepatitis B testing to guarantee their safety. OVERNMENT has directed all civil servants in the North-western province to undergo the Covid-19 tests. North-western province Minister, Nathaniel Mubukwanu, said all Government workers in the 11 districts of the province must undergo the covid-19 test The minister said the move was aimed at curbing the spread of the pandemic. Mr Mubukwanu said that the tests would be done without exception revealing that so far, 933 civil servants had already undergone tests since the commencement of the exercise. He was speaking when he made snap check on the testing center for civil servants at the Livestock and Fisheries department in Solwezi.

"Once you test, we expect you to observe the public health guidelines, it is for your own benefit because you have only one life," he said. Gwembe DC happy with FISP uptake By JOHN KOMBE THE uptake of the Farmer Input Supply Programme (FISP) in Gwembe is impressing with 4, 300 of the 4, 400 beneficiary farmers redeeming their inputs, says District Commissioner, Timothy Siakaziba. In an interview, Mr. Siakaziba described the FISP exercise for the 2020/2021 farming season as a success. He was happy that 95 percent of the farmers on the programme had so far redeemed their inputs. He pointed out that the government had also deposited about 90 percent of its top up towards the farmer contributions. He stressed that the government was committed to ensuring that the agriculture sector thrives. Mr. Siakaziba said that the emphasis on diversification to agriculture was not just

He said that the agro dealers were selected based on past performance. He was therefore pleased that the six agro dealers had not disappointed and had performed beyond expectation. Mr. Siakaziba also disclosed that the agro dealers were very transparent and did not fully swipe the money from farmers who had only partially redeemed their inputs. He said this was a positive development as farmers who only redeemed part of the inputs were being duped in the last two seasons. Mr. Siakaziba also noted that the district had received good rainfall so far and hoped that this would continue. He said that the good rains coupled with the early distribution of inputs would assure greater yields.

He explained that it was lawful to restrict public gatherings as it was part of the

standard for human rights on the promotion of public safety. "You can't promote law and order if you don't apply the public order Act in the country. We shall keep on engaging stakeholders on the public order act. The stakeholders must follow the public order act so that the police do not take advantage of the situation. Civil disobedience is not in the best interest of anyone. So political parties must follow the law," he said. Mr Muleya said this act is still a source of concern as the implementation of the act has led to the loss of life.

PROCUREMENT specialist has described as unnecessary calls for dismissal of Health Minister Chitalu Chilufya and his team over the honeybee pharmacy saga. Former Zambia Institute of Purchasing and Supply Secretary General Mollen Mwituma said in Kitwe that such demands were uncouth and that they ought to be discarded by all well-meaning Zambians that truly understood the consequences of relying on Importing. He explained that in procurement, one of the most critical stages of the tender procedure was the drawing of specifications drawn by the internal customers.

But Mr Mwitumwa believed that the procurement team at the Ministry of Health did its best and that the best bidder was Honey Bee Pharmacy at that time. “The procurement team will only award the tender to the bidder that responds to the ITT (Invitation to Tender) in conformity to the drawn specifications with respect to the Government’s proposed payment terms drawn by the buying entity and of which at the time of awarding the contract. “ We must however bear in mind that for the drawn specifications to be met, as the procuring entity, you need to have

the financial capacity to meet the supplier’s financial conditions at the time of supply and this is where we missed it,” he said. Mr Mwitumwa said that according to the reports produced by the Ministry of Health, Honey Bee had not been paid any money over the supplied consignment. He said that the payment terms were that Government gets a six months credit facility which would be due in March, 2021. He explained that this was because the Government had been struggling with finances in the recent past as observed from a lot of projects which had been halted. Mr Mwitumwa further wondered how Honey Bee Pharmacy and the Ministry of Health were expected to meet their specifications if the money was paid in full. He said Government had been struggling with finances of late stating that Dr Chilufya with his team at the Ministry could not take the blame.

Opposition slams PF for ignoring covid-19 rules By SANFROSSA MANYINDA THE United Party for National Development (UPND) has challenged Government and the ruling party to respect Covid-19 guidelines amidst the second wave of the virus. UPND Copperbelt Information and Publicity Secretary, Lawrence Mwanza, told the Daily Nation in Kitwe that the PF members had been gathering in large numbers without observing the health guidelines such as wearing masks and observing physical distance. He observed that there were crowds of cadres who gathered to welcome President Lungu while others attended his programmes during his three day working

visit on the Copperbelt. Mr Mwanza said that almost all of the people that gathered to attend the programmes were spotted without face masks and that they were not observing social distancing. “This is very risky and a big danger especially that we are in the second wave of the Covid-19. We failed as a country to contain the first wave of the virus, do you think we will manage the second one which is claiming so many lives with this kind of behaviour?” he wondered. Mr Mwanza said that in as much as the ruling party would want to campaign and drag numbers in certain regions, it was also important that it considered the health of the people. He said the ruling party was showing the public that people could ignore the Covid-19 guidelines and go back to their normal ways of living. He said it would be difficult for ordinary Zambians to believe that Covid-19 was real if leaders were in the fore-front ignoring the health guidelines. Mr Mwanza said that the earlier the situation was controlled by the leaders the better for the country.

UPND dismisses Luanshya defections By ROGERS KALERO THE Patriotic Front (PF) must stop playing fake defections because this will not help to redeem the ruling party’s lost popularity, the UPND in Luanshya has said. UPND Luanshya Central Chairperson, Muntanga Sinkala, said it was misleading for the PF to claim that UPND ward officials in Buntungwa ward had defected to PF. Mr Sinkala said no leaders or members from Buntungwa ward had resigned from UPND to join the ruling party. "We would like to categorically dispute the purported defections of the UPND ward officials in Butungwa ward of Luanshya Central Constituency. PF are trying to hoodwink and deceive themselves by faking defections," Mr Sinkala said. He said PF's fast dwindling popularity on the Copperbelt was frustrating leaders in the ruling party and had now resorted to faking defections. Mr Sinkala said PF leaders must not pride themselves in fake defections which would not help redeem them from the impending election defeat at the hands of the UPND on August 12, this year. "The PF should accept the fact that their fortunes in the province are gone as Copperbelt is no longer their stronghold," he said. Mr Sinkala said only one official who was enticed by money had left, the rest were not in the rank and file of the UPND ward structure in the constituency. “Let it be known that PF using its corrupt schemes paid all the people who were paraded as defectors. This is a very shameful act by the ruling party who seem not to learn from past leaders like Rupiah Banda of the MMD who used the same schemes but ended in an embarrassing defeat. “This desperation won't salvage the PF lost glory in Luanshya in particular and Copperbelt province in general. The UPND in Luanshya is as solid as a rock as it is fast gaining popularity on the ground, he said. The UPND in Luanshya, he said, was ready to deliver the much- needed change come August 12, this year.

At the end of this lesson, learners should be to: · Describe family and marriage · Explain the elements of family law · Identify types of marriage in Zambia FAMILY LAW Family and marriage a) A Family is the smallest unit in a society which comprises of persons related by blood or marriage. There are four (4) types of families in Zambia. i. A nuclear family: A group of persons consisting of a man, his wife or wives in case of polygamous marriage and their children. ii. An extended family: that consists of not only a man, his wife or wives and their children but also grandparents, uncles, aunties, nieces, nephews, cousins, in-laws and grandchildren. iii. A single headed family: that consists of a single parent and children. This can be as a result of divorce or being widowed. iv. Child headed family: is a new type of a family that has emerged in Zambia mainly as a result of the HIV/AIDS pandemic that has claimed lives of many adults leaving children to bring themselves up (as double orphans). b) Marriage is a legal union of a man and woman as husband and wife. This contract is based on the following:i. Rights: Entitlements a wife or husband enjoys in the union. ii. Obligations: These are duties that a wife or husband performs in the union. For example each of the spouses has a duty to take care of and protect the other spouse. iii. Capacities: These are abilities or capabilities that each spouse brings to the union. For example, a wife has the ability to conceive and bear children for the union. iv. Incapacities: These are inabilities or incapacities that each spouse brings to the union. For example a wife who is not educated and not skilled in anything may bring to the union the inability to provide for the union. The elements of family law i. Marriage: a legal union of a man and woman as husband and wife. ii. Divorce: Is the dissolution of marriage which is done when the court handling the case satisfies itself that a marriage had actually existed. iii. Property settlement (Sharing): *After a divorce in a customary marriage the woman usually gets some form of compensation to allow her start life afresh. *In a civil marriage the property is shared by the Deputy Registrar’s court in the situation where one contributed in the earning of the union, he or she will be entitled to a third (1/3) of the total wealth of the couple. *If both spouses contributed to the earnings of the couple the property will be shared at 50-50 basis. iv. Maintenance of spouse and children

within and after marriage: Both within and after divorce a spouse has a duty to maintain his or her life partner. ï Under customary after divorce a spouse is duty bound to maintain is or her partner for a maximum of three (3) years or until he or she remarries which even happens earlier. v. Custody of children after dissolution of marriage: ï When awarding custody the ages and needs of children are taken into consideration. ï Usually the court gives custody to the mother if the children are very young. However, the father will provide maintenance. vi. Adoption of children. ï Under the Adoption of Children Act, Chapter 136 of the 1948 Edition of the laws of Zambia, the courts have been given power to grant an order to adults requesting to adopt a child. ï The Act has listed the categories of persons eligible to adopt children. ï A couple jointly wanting to adopt an infant (an infant is a child less than 7 years old) ï A mother or father of the child either along or jointly with his or her present spouse. This means that if a person has a child or children then remarries and the new partner wants to formally adopt the children from the former marriage, him or her or together can apply to adopt the children ï A person who has reached the age of 21 years old and is a relative of the infant. ï Both the infant or child and the person applying for adoption should live in Zambia. ï The infant has been looked after by the applicant continuously for at least three (3) months before the date of the application. ï The person intending to adopt notifies the Commissioner of the intention to adopt three (3) months before the application. ï In case of a couple, both or one of them should have attained the age of 25 years old and is at least 21 years older than the infant. vii. Legitimacy of children ï Based on the United Nations Convention on the Rights of the Child 1989 (UNCRC) new laws have equalized the position of children born outside marriage to those born in wedlock. viii. Succession. ï Succession when death occurs in a family is usually defined by traditional names and customs of the ethnic group that family belongs to. ï For example the Bemba‟s trace their lineage through the mother (Matrilineal), therefore, when a Bemba person, chief or headman dies, his sons are not eligible to succeed him but one of his nephews would succeed him. A complete opposite in the case of the Ngoni. ï

ix. Inheritance of property. ï In Zambia today the inheritance of

property is provided for in the Testate and Intestate succession Act of 1989. a) Testate Succession deals with inheritance of property of a dead (deceased) who left a will. ï A will is a declaration normally in writing stating how a person wants his or her property shared or distributed in the event of his or her death. ï Testator is the person who makes the will in case of a male and the Testatrix is case of a female. b) Intestate Succession: This is the Act used to distribute the property of the deceased who did not leave a will or someone who has left but that will is nullified by the courts of law. The distribution is done as follows; *20% of the estate goes to the surviving spouse. *50% of the estate will be distributed to the children both in and outside wedlock. *20% will go to the parents or guardians. *10% will go to dependants in equal proportions. The types of marriage in Zambia In Zambia there are only two types of marriages that are recognized by law. These are; Statutory and Customary marriages * Statutory Marriage which is also referred to as a civil marriage is a voluntary union of one wife and one husband for life and excluding all others. *What is considered when entering into a statutory marriage? a) Take out a notice of marriage: The notice of intention is marry made on a prescribed to the Registrar of marriages at the local council offices. b) Marriage Payment: The Marriage Act does not stipulate any payment of any kind. Unless the individual concerned just wants to observe the customary ritual of paying marriage payment. c) Age: Under the Marriage Act parties intending to marry should be 21 years of age. If any of the parties is below 21 and above 16 years he or she needs a letter of consent from his or her parents or guardians. d) Relationship: The two should not be related to each other either by blood or marriage. Their relationships which are prohibited by law to enter into marriage are known as prohibited degrees. e) Solemnisation of Marriage: This is when the actual wedding is performed following the laid down ritual such as each of the parties publicly declaring that he or she has agreed to wed the person that they are standing next to by saying this aloud and mentioning all the names of the person. f) The Marriage Certificate: This is the evidence of marriage and a copy of which is kept by the Registrar and the other by the couple. Customary Marriage: This is the marriage contracted under customary practices. This marriage may not be a union of one man one woman in the case of polygamy. ï Some requirements in a customary marriage. a) Consent: This is when the parents or ï

guardians of the woman getting married give permission for her to marry and also when the person getting married agrees to marry. b) Marriage Payment: There is always payment as recognition of the marriage. The payment is made by the bridegroom- to-be to the family of the bride-to-be. c) Spouses: The parties to the marriage should be male and female. The female should be single, divorced or widowed but the male may already have one or more wives. d) Relationship: The persons intending to get married should not be closely related by blood or through marriage. Other ‘marriages’ though not recognized under Zambian Law. a. Religious Marriage: This is the marriage solemnized or performed in church by the clergy. Note: The marriage solemnized in church should be followed up by a registration at either the Civic Centre or Council Offices under the Marriage Act or at a Local Court under the Local Court Act. b. Cohabitation: This is a marriage where the parties concerned decide to live together on their own without consent by their parents or guardians and without following any rituals performed either in a customary or civil marriage and later the society recognizes the couple as husband and wife. c. A Void Marriage: This is the kind of marriage without legal standing right from the beginning. It is null and void. Some reasons for a void marriage. - Lack of parental consent. - Non publication of vows in church. - If the man is under 21 years old. - If the female is under 21 years and above 16 years without the consent of the parents or guardians. - Prohibited degrees of marriage. d. Avoidable Marriage: is one that is initially valid which means had a legal standing until it is invalidated by the court of law. Note: Some reasons for invalidation of a marriage by the court of law. - If the child born is not the husband’s child. - If the spouse has contracted sexually transmitted disease from elsewhere not from the souse. - If the marriage is not consummated due to impotence (consummation in marriage means making complete by having sexual intercourse) - Wilful refusal to consummate the marriage by any party. - Mental disorder of any of the parties. LACK boxes of a passenger plane which crashed in the sea soon after take-off from Jakarta, Indonesia on Saturday have been located, officials say. A small flotilla of ships has been searching the site and navy divers should soon be able to retrieve the two flight recorders, they add. Aircraft parts and human remains have been found. The Sriwijaya Air Boeing 737 was carrying 62 people when it vanished from radar on its journey to Borneo. "We have located the position of the black boxes, both of them," said Soerjanto Tjahjono, head of Indonesia's transport safety committee, quoted by AFP. "Divers will start looking for them now and hopefully it won't be long before we get them." Investigators are analysing items which they believe to be
