PUBLIC TRUST AMIDST the Honeybee Pharmaceutical scam, it is imperative that authorities quickly step in to restore public trust in health preventive measures that include Covid-19 vaccines. This is the more reason we commend the assurance provided by the Ministry of Health director for infectious diseases, Professor Lloyd Mulenga. Prof Mulenga on Monday assured the nation that there was no need to be skeptical over the Covid-19 vaccines that will be administered in the country because they are safe. Prof Mulenga’s assurance should also serve to dismiss the claims made recently by Movement for Multi-party Democrary president Dr Nevers Mumba that the country should be wary of the Covid-19 vaccine. The MMD president had warned that Zambia should not rush to receive and administer the Covid-19 vaccine before knowing its long term side effects. In his New Year message, Dr Mumba said government should not take the Covid-19 vaccine until local labs and researchers certify that they were fit for Zambians, that they could be a death trap. Dr Mumba’s statement was also received with a pinch of salt because he appeared to have been reacting to President Edgar Lungu’s announcement about the procurement of the Covid-19 vaccine. These claims were however quickly repudiated by Ministry of Health spokesperson Dr Abel Kabalo who advised Dr Mumba not to cause unnecessary panic among Zambians over the Covid-19 vaccines. With the first batch of the vaccines expected to be received next month, Prof Mulenga also assured that despite the vaccines having some side effects, they were safe for use in Zambia. “Every drug has a side effect, but looking at the evidence which is there, these vaccines are safe for administration in Zambia,” said Prof Mulenga. Yes, the Honeybee Pharmaceutical scam has jolted Zambians, that the company allegedly procured defective condoms and gloves which were eventually released to the public through the Ministry of Health. The HoneyBee issue has already claimed one casualty, in Minister of Health, Dr Chitalu Chilufya who was dismissed on Sunday by President Lungu. And now the company scuttling the evidence saying the condoms reportedly tested by the Zambia Bureau of Standards were not theirs. This is because ZABS did not follow the protocol in conducting the tests by involving the supplier. This will no doubt bring more confusion to the issue. Zambians must still have confidence in the Ministry of Health that it is on the right trajectory in combating the second wave of the Covid-19 pandemic. People should therefore not feel apprehensive that their lives were in danger. Prof Mulenga said the first batch would cater for about 20 percent of the population including health care workers. Prof Mulenga however said there were still avenues of acquiring more vaccines which would cater for the rest of the population. Our advice is that the public must learn to dismiss cynical talk from those who want to play politics over serious health issues. They should instead have faith in the medical experts, and realise that no government would deliberately place the lives of its citizens in danger. Moreover, this being an election year, there won’t be a shortage of characters casting doubt on preventive health measures put in place by the government by planting fear in the minds of some gullible citizens. They will just be playing politics.

Mr Zulu is also worried about lack of proper supervision by those responsible for the projects. The minister expressed displeasure at the sub-standard works done on some bridges, which were being washed away. He attributed the high num-

ber of bridges being washed away to poor workmanship and lack of supervision. Mr Zulu cited the Mkhangazi Bridge in Katete which was washed away recently due to shoddy works. "Today, we visited Mkhangazi Bridge in Katete that connects Msoro and Katete with RDA, ZNS and the Local Government to assess and consider an appropriate remedial action in the short, medium and long term. "It is however purely a case of poor workmanship and lack of supervision," Mr Zulu said. He said there was need for the contractors to be supervised to prevent shoddy works. The minister also assured the people in the surrounding areas that Government would immediately restore connectivity at the two crossing points.

By PETER SICHALI GOVERNMENT should quickly place spies in mines to curb the growing looting of mineral resources through under declaration of production, former Transport and Communications deputy minister Alfred Ndhlovu has said. Mr Ndlovu said placement of spies in mines would help the country to fully benefit from the sector. He said the country has continued to lose millions of dollars through under declaration of proceeds by some mining firms. Mr Ndlovu said calls to have experts strategically positioned in mines will reduce repatriation of proceeds to other countries by dishonest investors. He said the country was not fully benefitting from the mining sector because there was too much cheating. “Some mining companies under declare their productions thereby costing Government millions of Kwacha,” Mr Ndhlovu said. Mr Ndhlovu said spies would inadvertently provide Government with valuable information on the performance of the mines. Honey Bee, in a statement distributed by their lawyer, Mr Tutwa Ngulube wondered why the purported tests on the condoms and gloves by the Zambia Bureau of Standards were done in their absence and without notice to them as stipulated in the contract. “Therefore, no one can say with certainty that the kits in question were ours and that the purported results are in fact what was alleged at the PAC meeting last week,” the statement reads in part. Honey Bee also indicated that the contract for the supply of various health kits had a clause that relates to disputes and the said clause required that when a party has a dispute or there was some disagreement regarding the quality of the product, same must be verified in the presence of both the supplier and the contracting party. Honey Bee believes its competitors are using the media to dislodge their business. “It is very clear that this is a competitors’ fight aimed at eliminating the other competitor. In this case we are victims of a politically-motivated fight aimed at former Minister of Health Dr Chitalu Chilufya by his enemies within and outside government,” the company stated. And Honey Bee said contrary to speculation, the ZAMRA license was issued to the company before the re-inspection was done and that all procedures and the required statutory fees were paid.

OAD Development Agency (RDA) has awarded a contract to Shachitari Contractors Limited to construct Lundazi and Msuzi bridges at a cost of K98, 333, 438.91. RDA Senior Manager Corporate Affairs, Anthony Mulowa said the cost for Lundazi bridge was K70, 811,506.18 and K27, 521, 932.73 for Msuzi bridge. Mr Mulowa said the works on the Lundazi bridge would start after the rainy season between April and May 2021. He said in an interview yesterday, “It is expected that no significant amount of works will be executed during this rainy period as most of the preparatory works involve earthworks, which cannot

date for the whole contract is October 5, 2021, he said. provide adequate signage for the project and maintenance of detours on a regular basis, starting in November 2020. to bring in huge investment to expand operations as well as willing to pay off the workers their dues. “Workers want to be treated like the way the workers at KCM have been treated by the liquidator. This is their wish,” he said. Meanwhile, Mr Chansa said once all the issues at Mopani as well as KCM were addressed the country would be the biggest producer of copper in Africa. He said the two mining firms were one of the biggest in the country, therefore, if they start producing copper as required the country would be able to export more. “We have copper coming from NorthWestern and if Mopani and KCM start producing more, this means the country will be the biggest producer and will be able to export in large quantity,” Mr Chansa said.

He said in an interview yesterday, his party had not at any time engaged any foreign company to be PR strategists. What is being reported, Mr Mucheleka said, were falsehoods which need to be ignored by all Zambians. “That is nonsense, which party can engage in such things which does not even add any value. THE judiciary must be distanced from political activities as the country heads towards the August 12 general elections, Kitwe High Court Judge Abba Patel has said. Justice Patel said the Judiciary was a non-partisan institution and should be distanced from political activities. She was speaking at the ceremonial opening of the criminal sessions at the Kitwe High Court on Monday. “The judiciary is a nonpartisan institution which is independent of Government and is only subject to the Constitution of the country,” she said. Justice Patel said that as the country heads towards campaigns, there would be need to promote a culture of respect for each other’s opinions in line with good governance tenets. And Justice Patel is concerned with the apparent increase in domestic cases including Gender Based Violence (GBV) against women and girls. She said while there is a general reduction in the number of both civil and criminal cases before the courts, domestic disputes and GBV cases such as defilement

and rape were on the rise. “The rising cases of crime against women and young girls is a source of concern in a Christian nation. We need to protect the girl-child from her brother, father, uncle and even grandfather,” Justice Patel said. She said community leaders, church elders and local leaders must all join hands in helping to overcome the rising cases of crimes against women. She said fighting crime should not be left to the judiciary and the police alone. Justice Patel said there was a need for timely law reforms to give judges and magistrates discretionary sentencing powers other than depending on mandatory minimum sentences only. She said in view of the current Covid-19 situation, appropriate reforms were needed in the law so that judges could mete out appropriate sentences for particular cases to avoid overcrowding correctional facilities. And Kitwe High Court judge-in-charge Charles Chanda said judiciary workers are front-liners in the Covid-19 because justice has to be served regardless of the circumstances. He said well-wishers and local leaders in Kitwe should therefore consider the judiciary whenever they are giving out chemicals and protective equipment necessary for preventing the spread of Covid-19.

Kabanshi ruling waits

FORMER Community Development Minister Emmerine Kabanshi will next Wednesday know her fate when the court delivers ruling on whether or not she has a case to answer. Kabanshi is facing two counts of wilful failure to comply with the law and applicable procedure or guidelines relating to procurement in the social cash transfer programmme. In count one, particulars of offence are that between August 21, 2017 and April 24, 2018 Kabanshi willfully failed to comply with the law, applicable procedure and guidelines relating to procurement by extending the scope of coverage of the contract between Zampost and the ministry to include three provinces and two districts under the social cash transfer programme. In the second count, particulars of offence are that between the same period; Kabanshi wilfully failed to comply with the law, applicable procedure and guidelines relating to procurement when re-engaging Zampost as payment service provider for the social cash transfer following termination of the said contract. Lusaka Chief Resident Magistrate Lameck Mwale had set yesterday as the date for ruling but when the case was called Kabanshi was not in

Ruling in contractor’s fraud case deferred again By CHARLES MUSONDA THE Lusaka Magistrates’ Court has for the third time adjourned ruling in a case a local contractor has been accused of using alleged forged documents to get a subcontract from China Henan on the Mansa-Luwingu road project. In this case, G&G Nationwide (Zambia) Limited director Christopher Banda has been accused of forging a Road Development Agency (RDA) contract and a National Council for Construction (NCC) certificate of contract used to obtain the said subcontract worth U$1, 168, and 052.00. The ruling was initially set for November 27, 2020 but when the matter came up Lusaka Chief Resident Magistrate Lameck Mwale observed that he had just received the State’s submissions on that day and adjourned the case to December 14, 2020. But on December 14, 2020 Mr. Mwale said the ruling was not ready and again adjourned the matter to January 12, 2021 but yesterday he again said the ruling was not ready and adjourned it to next Friday. On November 27, 2020 defence lawyer Charles Changano told Mr. Mwale to dismiss the State’s late submissions in line with standard law practice and the court agreed in the affirmative. In his oral submissions, Mr. Changano, of D. Findlay and Associates, argued that the prosecution has failed to establish a prima facie case against Banda as the evidence presented by the prosecution witnesses is untruthful, disjointed, manipulated and incoherent.

For Immediate Release Lusaka, (12 January, 2021)— Honey Bee Pharmacy Limited (HBPL) has followed the debate and happenings regarding our medical kits supply contract with the Ministry of Health (MoH) and we wish to deny in the strongest terms that we have supplied any defective drugs and other accessories contrary to the contractual terms and therefore defrauding the Zambian people. The 5000 medical kits we have supplied so far, worth $3.9 million are of high quality meeting WHO standards and were sourced from reputable manufacturers from India. We have not been paid any penny this far. We have not been paid amount whatsoever so we find it strange that some people are fabricating an imaginary $17 million payment to us. This is false. Other than a batch of paracetamol that was discoloring, which we promptly replaced at our cost of more than $600,000, we are not we have not been informed of any other irregularities with the other consignment. We have listened carefully and have not said anything in so far as the same is concerned. We have noticed with concern all those statements that constitute misleading information as well as incorrect information pointing at ourselves. We now wish to give our comprehensive position on this matter.

It must first be noted that the contract in issue was entered into on the 22 November 2019 for the supply of 22,500 kits and so far we have supplied 5000 kits for which the MoH owes us USD3,990,700 and no single penny has been paid towards this amount. This is contrary to what is being carried in the media to the effect that Honey Bee has been paid millions of dollars. It must be noted that there are various reports that have come to our attention through the media and various other sources but not directly from the recipient of the product we supplied. We want to point out from inception that this is an attempt to assassinate our individual and corporate reputations by hostile business competitors. The Ministry of Health award various contracts relating to the supply of health kits within the same emergency supply contract involving two other entities, Pharmanova and Artemis. These two entities have never supplied what they were awarded leading to MOH cancelling the two contracts. Pharmanova’s contract is worth $3,554,100 Whilst Artemis is $14,139,450 And there has been no delivered at all. Why is the entity that has started to deliver being maligned? Surprisingly, there is nothing in the Auditor Generals report that points to the fact that the two entities have never supplied what they was awarded to them. One would ask, why is this so? It is very clear that this is a competitors’ fight aimed at eliminating the other competitor. In this case we are victims of a politically-motivated fight aimed at former Minister of Health Dr Chitalu Chilufya by his enemies within and outside government. It has also come to our attention that a lot of things were doing in an irregular manner.

It will be noted that the contract was awarded to Honey Bee Pharmacy, a sole Proprietor in 2019. The documents for the application/ tender all reflect this sole proprietorship. It was then the decision of the Ministry to award a contract to Honey Bee Pharmacy but it was later noticed that the ministry made a typographical error on the final contract to indicate the word limited. This was brought to their attention and instead of beginning the process again, Honey Bee decided to incorporate itself into a limited company and the legal guidance given was that the contract could then be novated and a novation agreement was put in place. It is therefore not true that the contract was awarded to a company that was none existent. This sustained media campaign by paid journalists will no longer be al-

When Honey Bee Pharmacy was incorporated, it must be noted that at that time it had been in business from as far back as 2016 and now a decision was

made to grow the business into a wholesale operation as well. Applications were made to ZAMRA, and the official fee paid for this purpose and inspections were done for purposes of approving the license. At the first visit, minor discrepancies were found and there was an instruction to correct the same. The discrepancies were immediately corrected . After this was done, the re-inspection fee was paid for the purpose of making sure that the inspection was done again as per procedural requirements. We can confirm that the license was given to us two weeks after the re-inspection was done and this can be verified from the records at ZAMRA to show when the license was issued to us. It is therefore not correct that the license was issued to ourselves before the re-inspection was done. We clearly do not have control over dates on documents at ZAMRA. All we can say is that we followed ALL procedures and the required statutory fees were paid. When a license is issued, the client signs in the book when collecting the license and this evidence is there at Arbaccus House with ZAMRA. It would therefore be misleading to assume that procedure was not followed and our license was issued in an irregular manner. The purported tests on our condoms and gloves By ZABS were done in our absence and WITHOUT notice to us as stipulated in the contract. Therefore,no one can say with certainty that the kits in question were ours and that the purported results are in fact what was alleged at the PAC meeting last week. Our manufacturers have since subjected the condoms and gloves to a global testing laboratory and the results are positive that the items are safe for use.

Clause 9 of the contract provides as follows: “9.1: the procuring entity or its representative shall have the right to inspect and or test the Goods to confirm their conformity to the Contract specifications. The SCC and the Technical Specifications shall specify what we did not receive any query on the products we supplied; we did not receive any request to test the product and there was no demand to replace the product. The persons now complaining did not avail any name of the laboratory that was used to carry out the purported tests and they did not agree with ourselves on any laboratory to carry out the test. The complaining parties have not even given the results as required. All we have seen are allegations in the media and sadly with the Auditor General’s report being at the center of things. It is

Kenya puts on hold debt repayment for six months NAIROBI - Kenya has been granted a six-month debt repayment relief by developed economies also known as the Paris Club following a successful application for the Debt Service Suspension Initiative (DSSI). The new development will enable the country to devote resources freed to increase spending to mitigate the health, economic and social impact of the Covid-19 crisis “The Paris Club has accepted Kenya’s application for debt service suspension, which now means that Sh32.9 billion of Kenya’s foreign debt owed to 10 bilateral partners under the Paris Club, falling due from 1st January 2021 to June 30, 2021,” he noted. The country has already signed a Memorandum of Understanding (MoU) with the Paris Club, to be followed by individual MoUs which each country under the Club, covering the terms of payment post-June 30, 2021. “In effect, the initiative apart from suspending the payments will give us a total of five years to repay the loans, with a grace period of one year. This is not only timely, but a sign of confidence in the country and will give us the fiscal space to make the much-needed spending on the Covid-19

‘UK economy will get worse before it gets better’ LONDON - The UK economy will “get worse before it gets better” as the country battles the pandemic, Chancellor Rishi Sunak has warned. The chancellor told MPs the new national restrictions were necessary to control the spread of coronavirus. The country will not seek debt service suspension from both its multilateral and commercial creditors, to safeguard its sovereign rating and its future access to international financial markets. Meanwhile, the Parliamentary Budget Office (PBO) says that fiscal indiscipline at the National Treasury is the reason the country’s public debt has grown exponentially in recent past. But even as the public debt continues to expand, PBO says Kenya has no option but to borrow more externally to finance the 2021/22 budget as the country experiences revenue constraints that existed even before Covid-19 made an unwelcome appearance. However, to borrow more, the National Treasury has to get Parliament to amend the Public Finance Management Act (National Government) Regulations of 2015 to increase the debt ceiling from the current Sh9 trillion. “There are serious credibility concerns on the National Treasury in fiscal management,” the report by the PBO says. – STANDARD/ DAILY NATION, Kenya.

This typically tyrannical and arbitrary powers of the UPND Presidency on the choice of the Vice President, Mayors and Members of Parliaments does not give us any promise that Mr Hakainde Hichilema’s reign will be characterised with repression. A Vice President with MPs that are handpicked by a party President will be captured and lack the requisite independence. By comparison, President Edgar Lungu has allowed all aspiring candidates to have access to the PF structures while HH has not given any authority to aspirants to challenge the incumbent MPs. The decision by President Lungu is meant at giving the people as a repository of power to decide on who represent the

party at the elective electoral processes. In a democracy, the UPND should not have preference based on ethnicity but by consulting the members of the party. Moreover, Mr Hichilema’s association with Bemba-speaking politicians has never been based on principle. It has been done with the expectation that he dilute his tribal tag which brought about his stay at the helm of the 23-year-old opposition political party. THE mushrooming of shopping malls developed by both private individuals and the public sector across the country is a welcome development. This is because the general public can buy various goods and services in a conducive environment. These shopping malls add beauty to the areas in which they are located. Other cities within Zambia have some shopping malls as well such as Edgar Chagwa Lungu Mall in Kitwe for instance. Besides customers accessing the various goods and services at these shopping malls, this doesn’t augur well with tenants at these malls. This is because rentals are astronomical or rather high.

As if this is not bad enough, some landlords of the shopping malls charge rentals in foreign currencies such as the dollar for instance. We appreciate the state of the art of these shopping malls quite allright but, the landlords should charge reasonable rentals to tenants so as to give them breathing space. My appeal to the shopping mall owners including the government is to stop charging rentals in dollars and possibly reduce the monthly rentals to a bearable minimum. FISH MONGERS APPEAL FOR RELIEF PACKAGE

AN association of fish mongers in Mombova area in Sekute Chiefdom of Kazungula has appealed to Government to consider empowering members with start-up grants during the fish ban period. This is for them to venture into other businesses as they entirely depend on fishing as a source of their livelihood. In an interview in Livingstone, the Association chairperson, Ms Judith

Mainga, said the advent of the Covid-19 pandemic and the effect of the fish ban has had a negative impact on their business. Government imposes a fish ban from December 1 to March 1 of the following year to allow breeding and preserving species. She said once members were given start-up grants, there would be no reason for any fish monger to engage in illegal fishing during the ban. Ms Mainga said that fish mongers had been left with no means of survival as

they were only dependent on fishing and fish trading. She added that empowering them with some start up grants would help alleviate the pressure that has come with Covid-19 and fish ban. Ms Mainga said that most her members are willing to be entrepreneurs but lack financial support. She said that if members of the association are empowered, it will help reduce poverty in their families and communities.

FINANCING SKILL TRAINING FOR EMPLOYER BASED IN-SERVICE TRAINING Background The Skills Development Levy was established in 2016 under the Skills Development Levy Act No. 46 of 2016. The main objective of the levy is to provide financial resource for the TEVET sector for skills development in collaboration with the Technical Education, Vocational, and Entrepreneurship Training Authority (TEVETA), which was established under the Technical Education, Vocational and Entrepreneurship Training Act of No. 13 of 1998 and the amendment Act No. 11 of 2005. Among the responsibilities of TEVETA, is the management of the Technical Education, Vocational and Entrepreneurship Training (TEVET) Fund. The Skills Development Fund (SDF) plays an important role in assisting the Government of the Republic of Zambia (GRZ) to develop a high quality, sustainable, demand-driven, and equitable TEVET system, and one of the mechanisms used in achieving this objective is the TEVET Fund. The TEVET Fund establishes a financing platform that purchases training services from public providers, on a competitive basis, for skills development in both the formal and informal sectors of the economy, at an arm’s length transaction. It plays a critical role in the reform of the TEVET system by separating the provision of training from its financing. It also shifts the focus from quantity to quality. As a financier of training being procured from TEVET providers, the TEVET Fund is able to introduce standards and accountability to the system for the desired outcomes. The Fund also introduces performance incentives for training providers and, through its stakeholders, establishes rules for spending on training services that promote national development objectives, including equitable access. Invitation to Employers and Training Providers The Government of the Republic of Zambia, using proceeds from the SDF, has set aside funds towards the implementation of the Employer Based Training (EBT) activities through the TEVET Fund. The TEVET Fund is hereby inviting Employers in collaboration with Training Institutions registered with TEVETA, under the

Technical Education, Vocational and Entrepreneurship Training Act No. 13 of 1998 and the amendment Act No. 11 of 2005, to present proposals for support through the TEVET Fund towards skills development for EBT. This financing is available to Employers and TEVET providers whose request for financing will be considered responsive to the disbursement criteria. Focus is on provision of training that meets the current market demands. Submission of Proposals Training Providers will be required to submit five (5) copies of each of the proposals in a sealed envelope. Businessman constructs footbridge for community A BUSINESSMAN in Mwinilunga has constructed a foot bridge across the Mudanyama River for the community. Mr Abel Lukanganyama says he has been prompted to construct the bridge following reports of people and goods falling in the river while crossing it using logs laid across it. “People that have been using the previous bridge had a lot of challenges. A lot of people have fallen in this river and a lot of property and some of it has not been recovered, this is what prompted me to put up this bridge”, he said. Mr Lukanganyama said this during the handover of the foot bridge to the community. Schools must open on January 18’ By ANDREW MUKOMA A CIVIL Society Organisation has objected to some sections of society that are proposing the postponement of the opening of schools in view of the escalating number of Covid-19 cases. GEARS Executive Director, MacDonald Chipenzi, said schools should just reopen on January 18, as planned but cautioned that there must be strict adherence to Covid-19 regulations. He observed that the pandemic would not “go away” anytime soon, hence rescheduling the opening date would be like closing indefinitely. Mr Chipenzi noted that last year, the school calendar was disrupted and therefore, doing so again would only disadvantage the learners. ‘NO ONE ESCAPED FROM CHONGWE ISOLATION CENTRE’ 11

REPORTS that a trader in Chongwe bolted after testing positive are false, Chongwe central ward councillor, Juvenalis Mulimbika has said. He dispelled rumours of a welder from the main market escaped from isolation at Chongwe District Hospital after an alleged positive Covid-19 test. Mr Mulimbika made the clarification when journalists visited him at his shop at Chongwe main market to verify the report. He stated that he carried out investigations and established that the trader had indeed gone to the hospital to seek treatment.

He said that rumour-mongering in the wake of the pandemic had a potential to cause unnecessary panic among members

Mr Mulimbika insisted that the local authority and the market committee were alert and would not allow any trader to continue operating if they were supposed to be isolating or in quarantine. Chongwe district health environmental health technologist, Kelvin Mwakapushi, told the Daily Nation that the district health office did not receive such a report. He however stated that it was important for people who were still waiting for their results to isolate until the results were confirmed. Mr Mwakapushi said that this procedure must not be flouted as it was not safe for both those recommended for isolation and the public.

Zambia records highest number of inmates as voters By SANFROSSA MANYINDA ZAMBIA has become the first country to record the highest number of inmates to register as voters, the Prisons Care and Counselling Association (PRISCCA) has said. PRISCCA president Godfrey Malembeka said close to15, 000 of the 18, 000 inmates who are eligible voters, registered for the 2021 general elections. Mr Malembeka said this had never happened in any country that had been allowing the incarcerated people to vote. He was speaking to the Daily Nation in Kitwe yesterday. “Zambia becomes a shining example because after the elections, governments from other countries will be coming to learn from us. “The high number recorded shows that the inmates understood very well that their voices were in their votes and ae an organisation, we will continue sensitizing then to understand how important voting is,” he said. Mr Malembeka assured the nation that there would be no voter apathy on the part of the inmates. He said that the number of inmates who registered as voters was a clear demonstration that they knew what they wanted. Mr Malembeka however called on the inmates that registered as voters and were pardoned during the festive period to take advantage of the verification period to ask the ECZ any questions they had concerning how the voting would be done.

Zamtel Chief Commercial Officer, Chibeza Ngoma, said the Back2School promotion is meant to ease the financial burden that customers face when financing education. OHANNESBURG The judicial commission of inquiry into state capture has warned former President Jacob Zuma that he must appear before it next week, regardless of whether the Constitutional Court has ruled on its urgent bid to compel him to answer questions about his nine years in office. “The commission wishes to make it clear to you that, even if the court has not handed down its judgment by January 18, 2021, you are obliged to comply with the summons and appear before it because the summons remains valid and binding

on you since it has not been withdrawn, set aside or suspended,” the commission’s secretary, Itumeleng Mosala, wrote to Zuma on Monday. Mosala wrote: Therefore, the commission wishes to make it clear to you that any failure on your part, without sufficient cause, to appear before it (from) January 18 to 22, 2021 will constitute a criminal offence. Zuma’s lawyers have yet to comment on the commission’s letter. It is also unclear, given that the Constitutional Court was asked to rule on the former president’s right to silence, if and how the hearing can proceed without it having

While the commission of inquiry had asked the Constitutional Court to deliver its decision by January 10, it has since indicated that it could still secure two weeks of Zuma’s evidence if that ruling taken personal blame for being among those responsible for the recent rise in Covid-19 cases in the country.
