HE decision by the Patriotic Front (PF) to adopt President Edgar Lungu as its Presidential candidate is legally and morally correct, says lawyer, Makebi Zulu. Mr Zulu, who is Eastern Province Minister, said contrary to sentiments from PF critics, the decision made to adopt President Lungu was correct because the eligibility debate holds no water.

The Malambo lawmaker stated in an interview that the party has not risked anything because President Lungu’s eligibility had been cleared by the Constitutional Court when it ruled in his favour. “But as far as we are concerned, we are legally correct, we are morally correct and in every way, as a party, we have made our decision and our decision is the correct decision,” he said. Mr Zulu dismissed political activist Brebner Changala's statement that the PF has taken a huge risk to adopt Presi-
dent Lungu as its candidate. He advised Mr Changala to keep quiet on the eligibility matter because he had no legal background to understand what exactly was on the table. Mr Zulu said the ruling party would not labour on Mr. Changala because he had clearly shown that he desired nothing good to happen in PF. “Mr Changala has always been at PF, It’s not that he desires any good to happen in PF, So if he thinks we have made a mistake, it is for his own good,” he said.

Chief Liteta (Charles Mulando) wants the court to nullify the appointment of Chief Chitanda (Phanwell Chikalakasa) as Senior Chief Mukuni Ng’ombe of the Lenje people of Central Province. Chief Liteta also seeks an interim injunction restrain-
ing Chief Chamuka (Morgan Ngulube) from installing Chief Chitanda to the throne of Senior Chief Mukuni Ng’ombe until the determination of the court case. He also wants a permanent injunction restraining Chief Chitanda from holding himself out as Senior Chief Mukuni Ng’ombe. Chief Liteta wants an order recognising him as Senior Chief Mukuni Ng’ombe being the longest serving junior chief hereof. According to a statement of claim, Chief Liteta stated that on March 26 this year, following the death of the then Senior Chief Mukuni Ng’ombe (Chief Chipepo) the

Chinsali Senior Resident Magistrate, Julius Malata, has however, suspended the sentence for two years during which Kang’ombe should not commit a similar offence. The magistrate has also ordered that the K300 which was paid to the two police officers for transport by the convict be forfeited to the state. This is in line with article 355 of the criminal procedure code chapter 88 of the Laws of Zambia. ECZ Chief Electoral Officer Patrick Shindano, said political parties especially, those that keep accusing it of wrong doing, should ensure they fully invest in their polling agents to avoid mistrust. Mr. Nshindano said this when he featured on ZNBC’s Sunday Interview. He emphasised the need for political parties to have enough polling agents because the electoral process was as transparent as the ballot box. “Invest in your polling agents, this is very very im-
portant because the process is extremely transparent, you are working with a transparent ballot box, you will be seeing it filling and at the end of the day you will count together, we will close the poll together,” he said. Meanwhile, Mr Nshindano said the ECZ has converted all streams into polling stations in a bid to enhance result management system. He said the change might seem simple but was very significant in the tabulation of results because that has been one aspect of the electoral process which was the most contentious among political parties. Mr. Nshindano said collecting election results from streams to polling stations brought a lot of confusion among political parties as they feared that
the votes would be manipulated during the exercise. He explained that each stream now called polling station would have its presiding officer so that once the voting exercise was concluded, it would close and the result announcement form would be signed. "What it implies is that the voting would start and end at the polling station awaiting transmission of the results to the totaling centre and all political parties would be able to know the final results from the particular polling station, Mr. Nshindano said. Mr. Nshindano added that the conversion of streams to polling stations would also quicken the voting process and this would translate into the quicker announcement of the final election results.

THE DIE IS CAST NOW that political parties are concluding their intra-party polls, the stage is almost set for the August 12 general election campaigns. The New Hope MMD, UPND, PF and UNIP have had their internal elections from lower organs to the national level while Chishimba Kambwili’s National Democratic Congress is set for the general conference this week. It is hoped that other parties, including the Forum for Democracy and Development, Felix Mutati’s Movement for Democratic Congress and others would be concluding their respective internal electoral process this month in readiness for campaigns which will start mid next month. All serious parties must fulfil this mandate as required by the Republican Constitution or else they will remain spectator parties. According to the Constitution of Zambia (Amendment) number 2 of 2016 article 60 1(C) (c) a political party has the right to conduct primary elections for the selection of candidates. Further article 60 (2) (a,b,c) states that a political party shall promote the values and principles specified in the Constitution and have a national character; promote and uphold national unity. An outstanding provision is the subsequent one under (d) which states that a political party shall promote and practice democracy through regular, free and fair elections within the party. This is what the parties that have so far conducted internal elections have done and it is now up to the rest of political organisations to do the same so that they prove their worth in following the law. It is not enough for political parties to remain on paper and issuing media statements without conducting internal elections as required by the Republican Constitution. Therefore, participating political parties must now prepare themselves for campaigns and desist from petty and unsubstantiated complaints. The laws of the land provide for a defined complaints procedure pertaining to campaigns and electoral activities. It is also important for those vying to stand as councillors and Members of Parliament to remain truthful to the people; they should not resort to false promises. MPs have a clear mandate which has specifically been provided for in the Republican Constitution under the functions of Parliament and National Assembly. Thus MPs are representatives of their people in their constituencies. Under article 63 of the Republican Constitution, the functions include enacting legislation through Bills passed and assented to the President for assent and overseeing the performance of the Executive arm of Government. This is done through ensuring equity in the distribution of national resources among Zambians and appropriating funds for expenditure by State organs, State institutions, provincial administration, local authorities and other bodies. The MPs also scrutinise public expenditure, including defence, constitutional and special expenditure and also have the obligation to approve public debt before it is contracted; and approving international agreements and treaties before these are acceded to or ratified. It is important, therefore, for aspiring MPs to state their ambitions within the provisions of the law and not to expound issues which are outside the ambit of Parliament. This is an election year and politicians ought to be truthful in their conduct to inspire the electorate because deceit, lies and misconduct can breed apathy.

A SNIPPET OF THE NEW FRA ACT NO. 6 OF 2020 By JOHN CHIPANDWE
T
he Ministry of Agriculture and the Food Reserve Agency (FRA) began the process of reviewing the Food Reserve Act Cap 225 of the Laws of Zambia in or around the year 2016. This was after it was widely agreed by the Agency (FRA) and stakeholders that the Food Reserve Act CAP 225 of the laws of Zambia needed to be amended. This process led to the enactment of the new Food Reserve Act No. 6 of 2020 that was assented to by the President of the Republic of Zambia, His Excellency Dr. Edgar Chagwa Lungu on 23rd October 2020. The initial process was subjected to a wider consultative process involving various key stakeholders in order to ensure transparency in the formulation of the new Act. The consultative processes were held at provincial and national level with a national consultative workshop as a concluding exercise in terms of engaging and collecting views from stakeholders being held at Mulungushi International Conference Centre in Lusaka. The new Act has introduced some new and progressive clauses aimed at enhancing efficiency in the management of National Strategic Food Reserves. A notable change amongst others, is the prescription and definition of the exact powers and duties the Minister of Agriculture holds in the administration of National Strategic Food Reserves. Section 20 of the new Act states that:
“20. (1) The Minister shall, for the purposes of this Act— (a) approve the quantity and type of a designated agricultural commodity to be maintained in, sold, traded or issued from, the National Strategic Food Reserve; (b) cause the collection of data for the purposes of national food security; (c) cause the inspection and verification of stock levels of designated agricultural commodities; and (d) cause the preparation of the National Food Balance Sheet. (2) The Minister may appoint inspectors to perform the functions under subsection (1) (b) and (c). (3) A person shall not obstruct or refuse to provide information to an inspector in the performance of the inspector’s function under subsection (2). (4) A person who contravenes subsection (3) commits an offence and is liable, on conviction, to a fine not exceeding five hundred thousand penalty units or to imprisonment for a term not exceeding five years, or to both.” Implications of the new changes From the above, the role of the Minister of Agriculture in the
management of the National Strategic Food Reserves is to: (i) Approve the quantity and type of a designated agricultural commodity to bea. maintained in the reserves, b. sold from the reserves, c. traded from the reserves, and d. to be issued from the reserves.
(ii) Cause thea. collection of data for the purposes of national food security, b. b. inspection and verification of stock levels of designated agricultural commodities; and c. c. preparation of the National Food Balance Sheet. In the execution of his powers under section 20, the Minister
will exercise discretion to appoint inspectors that will be given powers and authority to inspect, verify and collect data on the stock levels of the designated agricultural commodities within the country for purposes of assessing the food security of the Nation. Obstructing or refusing to provide information to the inspectors is a criminal offence which attracts a maximum penalty of a five
year jail term or being made to pay a fine of an amount of K150, 000.00 with a possibility of being made to pay the K150, 000.00 and be sent to prison1.
Conclusion The new Food Reserve Act aims to enhance the management of the National Strategic Food Reserves. It is expected that all stakeholders should acquaint themselves with the new provisions and operate within
the new mandate. Covid-19 weighs down RioZim output HARARE - Diversified mining group, RioZim has announced a 27 percent decline in gold production as some constraints at its linchpin Cam & Motor Mine affected 2020 output. The group’s gold production declined from 1.66 tonnes achieved in the prior year to 1.21 tonnes. Of RioZim’s three gold mines, only Renco posted positive production numbers in FY2020. “Throughout the current year, the group’s flagship operation Cam & Motor Mine carried out mining activities from the nearby One Step Mine hauling low grade ore to the Cam & Motor plant for processing. “This resulted in a drastic fall in gold production compared to the prior year when the mine processed higher grade ore from its Cam pits,” said RioZim chairman Rashid Beebeejaun. Production at Cam & Motor Mine for the period under review closed at 427kg, a sharp 42 percent decline compared to 738kg in the prior comparable period. Management said the depletion of oxide ore
resources at the mine necessitated the migration of mining operations to the group’s nearby One Step Mine. RioZim is currently hauling ore from One Step Mine to the Cam & Motor processing plant. “The ore resources at One Step Mine have significantly lower grades than those at the Cam & Motor pits and this negatively affected production output,” said the chairman. “The mine is, however, focused on completion of its BIOX plant project which will enable the resumption of mining and processing of high grade refractory sulphide ores from the Cam pits.” The gold price maintained a growth trend throughout the year recording a 27 percent growth from the prior year’s average price of US$1 395/oz, to an average price of US$1 765/oz in the current year which counteracted the impact of lower production volumes. The 18.2 billion yuan penalty is triple the previous high of almost $1 billion that US chipmaker Qualcomm had to pay in 2015, and was based on four percent of Alibaba's 2019 domestic revenue, according to China's antitrust watchdog. Secretary General of the African Continental Free Trade Area (AfCFTA) agreement, Wamkele Mene, said, "moving towards a common currency in the African continent is the objective," outlined in the Abuja Treaty Establishing the African Economic Community of 1991. "We know there are a number of challenges that are related to that," he told a webinar hosted by the ANC's Progressive Business Forum. "You have to deal with macro-economic convergence and so on, but in the interim what do we do to overcome the fact that there are 42 currencies on the continent?" He said the pan-African payments and settlements platform that was being developed in partnership with Afreximbank would go a long way toward addressing this issue and towards making trade on the African continent less
costly and more efficient. He said: "I don't know how long it will take for Africa to have a common currency. It may not happen in our lifetime, but we have got to start somewhere to address the multiplicity of currencies as a constraint for intra-Africa trade." Mene said the AfCTA was one of the "first steps" towards a common currency, as initially, all 55 African Union member states would apply the same rules for the ease of doing business. "We are also considering how digital platforms can contribute to more efficient trade on the African continent," he said. Currently, the absence of a common currency was mak-
ing trade complicated and costly. "If you are in Ghana and you want to trade with somebody in South Africa, first you have to convert the Ghanaian cedi into the dollar. The recipient will then have to convert the dollar into the rand. That is costly. It actually contributes also to inefficient trade patterns on the African continent." He said it would take time, "but in the absence of that, this (technology) is the best tool that we have that we can offer businesses, (and) that we can offer investors. President Lungu Dear Editor, WHILST closing the historical Patriotic Front elective convention which renewed President Edgar Lungu’s second term mandate as party President, the party boss did not leave anything to chance but sent a strong message to the Zambian voters. President Lungu warned the opposition leaders whose hands are direly itching with begging bowls to the foreign funders in the run up to the elections. As much as the political stakeholders have the right to engage in alliances with foreign interests, the same should not substitute their duty to be patriotic to Zambia. The parental guidance by President Lungu whose primary duty is to protect the constitution and the sovereignty of Zambia is timely and a wake-up call to Zambians that selling the country’s sovereignty cannot be disguised as regime change. The perceived foreign interests have made relentless and desperate efforts to destabilise Zambia and we wonder their containment and obsession with Zambia’s electoral democratic processes. While the foreign interests are stakeholders, the same cannot be said when they attempt to use proxies who in turn weaken Zambia’s institutions and “put Zambia under outside control.”
Zambia and Zambians at large have shown their ability to handle even the complex conflictual points of view. A very notable illustration is the just ended PF convention which did not only usher in a democratically elected party leadership but went beyond its mandate to bring the opposition political parties together to intimate what has been seen as the journey which will inculcate into national healing. One opposition figure has shown his true colours as he has a demonstrable and traceable trend to even blatantly lie about Zambia’s high cherished profile and even dent Zambia’s image. He has given Zambians a clear signal that his allegiance is not to Zambia but to the sponsors. For instance, he disputed the decision by the government’s protectionist approach to redeem Konkola Copper Mines and Mopani Copper Mines and he openly sided with foreigners. The Zambian people must therefore take the advice from President Lungu seriously. The decision on August 12, 2021 is the vivid opportunity that will redefine Zambia’s ability to reclaim control over its domestic affairs. Be wary about fraudsters during the police recuruiment exercise Dear Editor, SOME fraudsters have taken advantage of the ongoing police recruitment exercise across the country by swindling some people. Many who have applied for vacancies in the police service as police constables have fallen prey to the scam. The Zambia Police Service last month advertised for the positions of police constables. The criterion for recruitment was that people who met the requirements for recruitment should apply in their respective provinces without travelling to Lusaka. However, some fraudsters purporting to be senior police officers or to have connections in the Zambia Police Service are swindling the applicants of huge sums of money. The amount being demanded ranges from K5, 000 to K10, 000 per individual applicant. The fraudsters send messages to the unsuspecting people to send money to a particular mobile number so that the latter can be considered for employment in the
police service. Not too long ago, two former Zambia National Service (ZNS) officers were last month nabbed in Kabwe for swindling more than 100 youths on the pretext that the latter would be employed in ZNS. The culprits are appearing in the courts of law for the committed offence. It is true to mention here that Zambia is grappling with the problem of unemployment. The youth are mostly affected regardless of their professional qualifications. This is because Zambia's population is mostly made up of the youth. This is the main reason why they are easily duped when it comes to issues of employment. To crown it all, I earnestly appeal to youths to be wary about the fraudsters. Ndola’s Kapalala market project progresses By SANFROSSA MANYINDA THE trader's shelter at Kapalala market in Ndola's Masala Township is set to be launched next month as the first phase is almost done. The re-construction of the market that commenced in October last year involves the initial stage of constructing one market shelter at a cost of about K2.7 million. According to the plan, the market would be able to accommodate over 4,000 traders. In August 2017, thousands of traders were left in awe after the market was burnt and reduced to ashes. Ndola City Council Public Relations Manager, Rebecca Mushota, told the Daily Nation yesterday that the shelter would be ready for the launch this month or early next
month. She said the second phase of the market construction would commence immediately the first phase is completed. The funds for the reconstruction of the market were raised from a donation that came through the Copperbelt Provincial Office as well as part of the equalization fund. Early this year, the Government also released K14 million for the project. Kabushi Member of Parliament, Bowman Lusambo, said the new market would be the largest in the country once completed. Mr Lusambo appealed to the residents and traders to remain patient as the Government through the contractor, Zambia National Service (ZNS) would be working on the rest of the project.

HE heat of Chimwemwe Independent Member of Parliament (MP) Mwila Mutale has intensified as the Church has also weighed in complaining about poor representation. ident Hive Hamududu has said. Mr Hamududu said that his party was not interested in politics of name calling and insults but in politics of policy. He observed that currently, the county requires technical politics and not the ordinary African politics. Addressing journalists in Livingstone yesterday, Mr Hamududu noted that because of poor policies, Livingstone as a tourist capital of Zambia has become a dead city compared to the way it was during the UNIP era. Maramba plunged into darkness
…as thieves steal Zesco cables By ANDREW MUKOMA THIEVES have stolen Zesco cables from a transformer which feeds Maramba's MAs Township in Livingstone with an estimate of over 400 houses being affected. Zesco spokesperson, Henry Kapata, who confirmed the theft to the Daily Nation in Livingstone said the power utility company was on the ground working to restore supply. Mr Kapata said that vandalism and theft were retrogressive on the company and to the residents of Maramba Township who were affected. “The actual vandalism is very retrogressive for us as Zesco because it means that several of our customers in Maramba will have no power in the next 24 hours because we have to mobilize some resources. But we are working very hard to ensure power is restored. I think what is important now is that vandals are uncles, vandals are nephews, and they are grandfathers….obviously for now anything is possible and so, if we live with these people, the best is to report them to the police,” he said. Mr Kapata said that the theft occurred yesterday around 02:00 hours and

The UN hub was gutted after fire set on the nearby office of an international charity spread to the UN facility, said a second aid worker. The offices of three other international NGOs were also burnt by the insurgents who took over the town, the second aid worker added. A military source confirmed the Saturday attack on Damasak but said militants failed to overrun the town. Some residents were reported to be fleeing from the town toward neighbouring Niger. Damasak has repeatedly been targeted by ISWAP militants who have made several failed attempts to overrun a military outpost outside the town. ISWAP, which split from the jihadist group Boko Haram in 2016, has become a dominant threat in Nigeria, attacking soldiers and bases while killing and kidnapping passengers at bogus checkpoints. On March 1, ISWAP jihadists overran a UN hub in Dikwa, killing six civilians and forcing aid workers to temporarily retreat from the town despite urgent humanitarian needs. Latest US police shooting of black man in Minneapolis sparks fresh protests MINNEAPOLIS, US - Protests broke out on Sunday night after US police fatally shot a young black man in a suburb of Minneapolis – where a former police officer is on trial for the murder of George Floyd. Hundreds of people gathered outside the police station in Brooklyn Centre, northwest of Minneapolis, with police later firing tear gas and flash bangs to disperse the crowd, according to an AFP videojournalist. By around midnight local time, the National Guard was on the scene, police had declared an illegal assembly, and the Brooklyn Centre mayor said he would "be issuing a curfew order shortly." The mother of Daunte Wright, a 20-year-old black man, told a crowd earlier on Sunday evening that he called her to say he had been pulled over by police, local media reported. Katie Wright said she heard officers tell her son to put his phone down, and then one of the officers ended the call. Soon after, her son's girlfriend told her he had been shot. The Minnesota Bureau of Criminal Apprehension

N Friday the 9th of April 2021 we looked at the hormones that control our appetite and help to stop us from continuing to eat when we are full. The following hormones , insulin, ghrelin and leptin under the control of the brain play a pivotal role in food regulation and weight control. Ghrelin makes us hungry, it makes us seek for food, Insulin helps to burn the food(glucose) we have eaten into fuel and excess stored as fat and then leptin produced by the fat cell helps to control our weight ultimately. Of the three, leptin is one directly connected with weight. When there is a lot of fat deposit, a lot of leptin is produced which tells the brain to let the body go on starvation mode and utilise the stored fat reserves it has in stock. Then when the fat cells drop, leptin levels reduce triggering the brain to go look for food. This is what should happen in an ideal situation. But we don’t live in an ideal world, actually the real world can sometimes be so sophisticated to fathom. One of my quotes can attest to this ( “at times life teaches us to pronounce words whose letters are not even in the alphabet…”DR Masuwa 2021). Look at Covid-19 itself, how much of it is really known? It still is a big puzzle with so many questions and yet so few answers .Yes vaccines are here but we are yet to see how they will really help out . Indeed so much is unknown but one thing I know is that obesity greatly reduces ones fight against Covid-19. These “lets burn it” series are to highlight the importance of maintaining a good health weight not just for Covid-19 but in general ,for a lot is at stake when one carries extra pounds, not cash of course as those extra pounds would be a great thing in these hard times. Today we going to look at what happens when one’s eating goes out of hand, when the ying yang of the

Makembo said Napsa Stars should be proud of their achievements in the CAF Confederations Cup where they reached the group stage in their maiden appearance in the continental competition. He said the heavy defeat in Cameroon should motivate the team to come back stronger as they focus on the MTN Super League games. With three defeats and one draw in Group B of the CAF Confederations Cup, Napsa remain stuck on fourth position with one point, eight points behind Coton Sport who claimed top spot in Group B with nine points from three wins and one defeat after four matches. Meanwhile, Makembo has urged the Zambian champions Nkana FC to stay focused and work hard to reach the CAF Confederations Cup quarter finals.
