… Prices still exorbitant despite directive to reduce By NOEL IYOMBWA CEMENT prices have remained high despite the Competition and Consumer Protection Commission (CCPC) ordering that firms revert to pre-cartel prices by May 7 this year. And the CCPC says it has embarked on a countrywide survey to check and confirm on whether cement companies have reverted to the prescribed prices. CCPC ordered that the cement prices be slashed from the current average prices of K140 per 50kg bag of cement to between US$4.5 to US$5 which translates to K110 per at the

current exchange rate of K22 per 1 US dollar. Three cement producer companies that were investigated for restrictive business were found wanting and CCPC fined the firms. The companies are Lafarge Zambia Plc and Mpande Limestone Limited which were found wanting for price fixing, while Dangote was forgiven after complying during the probe. The two cement manufacturing entities were ordered to each pay 20 percent of their 2019 and 2020 turnovers. Despite CCPC announcing the directive takes effect on May 7, this year which is 30 days after the parties receive

NAREP wrangles in new twist …NAREP’s Steven Nyirenda’s candidacy hangs in balance By AARON CHIYANZO NAREP officials have petitioned the Electoral Commission of Zambia (ECZ) not to entertain the nomination of ousted party president, Steven Nyirenda who has already paid K95, 000 nomination fees for the Presidential race on the party ticket. The party officials told ECZ that the matter involving the NAREP presidency was still in court pending determination of who the rightful holder of the political office was. This is contained in a letter dated April 29, 2021 addressed to ECZ Chief Electoral Officer, Patrick Nshindano. Lawyers representing, Mr Charles Maboshe, who was appointed president of NAREP to replace Mr Nyirenda, said the status of acclaimed office bearers for the party raises highly contentious issues. The lawyers, CL Mundia and Company, stated that the legitimacy of Mr Nyirenda’s presidency was still in question. “Our clients categorically reject the proposition that the 1st and 2nd plantiffs are legitimately in office as secretary general and president respectively and this position has firmly been brought to the attention of the court through a robust defence and opposition to the injuction at hand is yet to be heard on an inter parte basis,” the latter reads in part. The lawyers indicated that the party was embroiled in serious litigation involving the current office bearers. They also stated that one of the issues to be determined by the court was which party constitution was currently in effect

The lawyers urged ECZ not to allow any of the parties to the action to impose or nominate any candidates at all levels in the forthcoming elections until the matter was resolved by the High Court. “You will appreciate that permitting any of the parties to this action to sponsor candidates would represent a clear interference in the due administration of justice before the High court has an opportunity to determine this matter to its logical conclusion,” they wrote. In response, Mr Nshindono in a letter dated May 4, 2021 requested for supporting court documents to “enable us proceed as intimated in your letter under reply.” The court documents were submitted to the ECZ on Monday, May 10, 2021. Mr Nyirenda was ousted last year over alleged failure to follow procedure and causing divisions in the party, among other reasons. He challenged his expulsion in court on grounds that it was unconstitutional and wants a declaration that he is the duly-elected NAREP president.

Lawyer Mosho filed motion on whether the ConCourt has jurisdiction to hear and determine Mr Sangwa’s petition which he said lacks disclosure of constitutional issue. In this matter, Mr Sangwa has petitioned the ConCourt to compel the Electoral Commission of Zambia (ECZ) to amend the affidavit for Presidential candidate/Running mate by including a paragraph saying “ I have not held office twice” to comply with article 106(3) of the constitution. ECZ and the Attorney General are respondents while Mr

In his affidavit in opposition to Mr Mosho’s motion, Mr Sangwa contended that the notice of motion to raise preliminary issue pursuant to article 128 of the Constitution of Zambia (amendment) Act 2016, Article 128 of the Constitution does not deal with the matters of practice and procedure but the substantive jurisdiction of the court. He said that Mr Mosho in his arguments has not referred to the portion of Article 128, which supports the motion. “Although Mr Mosho was added to these proceedings as an interested party, he has no authority to file the motion in issue. “In the proceedings; his stake in the success or failure of the litigation; or his legal duty to participate in the pro-

ceedings. The joinder doesn't empower him to pursue his own issues in this matter,” Mr Sangwa argued. Mr Sangwa said Mr Mosho could only pursue the motion if made a respondent. He insisted that the petition was not against the provisions of the statutory instrument but the affidavit attached to the regulations as a schedule. “My contention is that the affidavit doesn't satisfy article 52 (1} of the Constitution because it does not address the ground for disqualification contained in article 106(3) of the constitution. Therefore, there is no basis for the contention that the petition discloses no constitutional issue or alleged breach of the Constitution,” he stated. Mr Sangwa urged the court to dismiss Mr Mosho’s motion for lack of merit.

By GRACE CHAILE LESOETSA UPND president Hakainde Hichilema has sued the State claiming damages for malicious prosecution in a case where he was acquitted of treason charges in 2017. Mr Hichilema who has cited Attorney General Likando Kalaluka as the defendant his seeking an order that all known police officers that conducted themselves in an unprofessional manner during the operation to arrest him and subsquently during his arrest and prosecution be surcharged. He wants the Lusaka High Court to order the State to pay him damages for malicious, including aggravated and exemplary damages, in respect of the charge of use of insulting language for which he was prosecuted. He also wants any amount found due to him. In a statement of claim filed yesterday, Mr Hichilema states that on April 10, 2017 at around 20:00 and 21:30 hours several Zambia Police officers wrongfully and forcefully gained entry of his home without consent, warrant, reasonable and probable cause in an operation to arrest him which lasted until the next day. He has named some of the officers who entered his home as Martin Musambachime, Arthur Shonga, Mpazi Mubita and Aubrey Hamwene. Mr Hichilema stated that the unlawful raid conducted as his home during the operation and the brutal and spiteful conduct of the police officers including their acts of looting, damaging of his property was malicious.

PUT ZAMBIA FIRST NOW that the political campaigns for the August 12 tripartite elections have started in earnest, Zambians must agree amongst themselves that the country must come first. They should all agree that no one will raise a finger or any offensive weapon against another in the mistaken belief that they are promoting their political party. They must all understand that democracy demands that one must be prepared to listen to opposing ideas that one does not support. Each person must be allowed space in which to freely express one’s views without fear of being physically attacked. The nation must therefore heed the tone set by President Edgar Lungu that “we should never put the country on fire regardless of the outcome of the August 12 general election. This is a clarion call that Zambians must embrace peace even as they go about campaigning for their political parties. President Lungu has urged Zambians not to be driven into violence by people who do not mean well, especially now that campaigns had commenced. The President took advantage to call for peaceful campaigns in Lusaka yesterday when he commissioned the newly constructed multimillion Kwacha Kanyama Police Station. “There is no need to be violent when your leaders are not violent. We should never put this great country on fire regardless of the outcome of the results on 12th August,” Mr Lungu said. The nation must be reminded that this is not the first time that President Lungu has stressed the need for Zambia to hold peaceful general elections. He has pledged that his administration is committed to ensure that there is peace before, during and after the August 12 elections to ensure that the will of the people prevails. This is the more reason why Government has made an open invitation to the European Union and other international observers to come and monitor the elections. Foreign observers must come and see for themselves at first hand how the elections are being conducted and observe the election contenders canvass for votes. It would enable the monitors observe for example whether there has been a breakdown of law and order for the nation to hold free and fair elections. This is important for there has been a lot of misinformation from some local politicians to the outside world that Zambia was not capable of holding elections as people were not free. We note that even the Zambia Police have promised to ensure that law and order prevails during the campaign period and even after the elections. Inspector General of Police Kakoma Kanganja has said they are ready to deal with political parties and other people who will attempt to destabilise the country’s peace before, during and after the elections. Mr Kanganja said in an interview that his officers were ready to counter anything that would come their way and ensure that peace, law and order prevailed during the election period. Our appeal to all the political players is not to treat the men and women in uniform as their enemy. They must emphasise to their officials that the success of the August 12 elections depends on team work among all the political players with the security enforcement agencies. They must not brand police with any party but as a neutral force in the political arena. Police officers will always be there whatever the outcome of August 12 protecting all and sundry.

NEW Congress Party (NCP) president, Peter Chanda has withdrawn his candidature for the August 12 presidential race and pledged to support President Edgar Lungu. This is two days after paying the K95, 000 Presidential nomination fees to the Electoral Commission of Zambia. Mr Chanda said he decided to withdraw because he could not garner enough votes without holding public rallies as discouraged by the ECZ.

He said the logo which was designed by his predecessor Cosmas Mwale was not corresponding with his message and vision. “I want to state that we have resolved not to participate as a party at Presidential level. We are only participating at parliamentary and local government levels. “As a party that is participating in these elections for the first time, it will not be possible to win without public rallies to meet the people,” Mr Chanda said. He said the party was in an alliance with the ruling Patriotic Front, and would support the candidature of President Lungu.

Ministry of Health spokesperson, Dr Abel Kabalo, said in an interview that normal operations in all the renal units had resumed following the arrival of the consumables. Dr Kabalo urged renal

patients not to panic and ensured that every Zambian would be given equal access to quality health services. “The consumables arrived in the country just as we had assured and normal operations have resumed. So patients should not panic as we will ensure that they are cared for,” he said. Dr Kabalo said the disruption in the supply chain was caused by the outbreak of the Covid-19 pandemic which led to a shortage of

the dialysis consumables in the country. He said the pandemic had affected the rate at which the renal supplies were being produced as a number of companies had closed down. Health Minister, Dr Jonas Chanda, gave a stern directive to have consumables and equipment for renal dialysis available following a big mortality rate of patients as a result of the shortage.

Dr Chanda said the World Health Organisation recently approved the Sinopharm vaccine for emergency use in Covid-19. He said the Chinese vaccine was safe, efficacious and being was used in over 100 countries. He said the Covid-19 vac-

cination programme had made tremendous headway since it was launched 28 days ago. Dr Chanda said in the last 24 hours, 5, 058 doses of the AstraZeneca vaccine were administered, bringing the cumulative number of vaccinated persons to 90, 916. Dr Chanda said from the figures, it was clear that Zambians had accepted the Covid-19 vaccination programme and discarded the various myths, misinformation and conspiracy theo-

ries. Meanwhile, Dr Chanda earlier told parliament that the development indicated that there had been continued community transmission. He said in the last 48 hours Zambia recorded 59 new confirmed Covid-19 cases out of the 4, 800 tests conducted in 24 districts. Dr Chanda said the districts included Kabwe, Chienge, Nchelenge, Chibombo, Chipangali and Kasempa.

Ms Chalikosa has not been adopted to recontest the Mpika parliamentary seat by the Patriotic Front. She said she was not in any talks with UPND and that her loyalty was to the Patriotic Front and President Edgar Lungu. “I have learnt of the ongoing media statement claiming I am in talks with the UPND for adoption. Mr Mweetwa was responding to concerns of regional voting in constituencies such as Dundumwezi. He said production was the secret of the hard-working people of Southern Province and not the much talked about tribalism. “I can rest assure you and this is free advice to PF, if they gave the people of Dundumwezi seed and fertiliser, they will harvest votes there while the people will harvest maize, “If you take 500 bicycles as they have done, they will not get any votes because the people of Dundumwezi already have an economic base to buy bicycles for themselves,” he said. Mr Mweetwa urged the PF to address the

challenges that the people in the region were facing among a lack of value for maize and meat produced in the region. He said that once maize and meat production in the province were valued as economic commodities, the ruling party would get votes from the people in the area. Mr Mweetwa said UPND president Hakainde Hichilema was just a politician who wanted to be voted the same way the PF would want to be voted except that he has identified himself with the people in the region. OVERNMENT has intensified the fight against smuggling at Mokambo border in Mufulira district, District Commissioner Mike Manda has said. Mr Manda said intensified patrols and community sensitisation in the area had continued in order to discourage the vice. He observed that the issue was becoming a huge challenge as some people were now trying to start smuggling flour, which was not previously peddled across the border. Mr Manda was speaking in Mufulira yesterday. "We need to join hands and fight together if this vice is to be curbed because continuing with it will do nothing but take the country backwards in terms of development as most smugglers are running away from ZRA taxes. Mr Manda warned that those who would be found wanting risked being imprisoned with hard labour. He said it was important that citizens committed themselves to doing what was noble if the desired development was to be achieved across the country. Kitwe lawyer sued over child support By SILUMESI MALUMO A LUSAKA resident Aneshi Chipungu has sued Kitwe based lawyer of Nyorongo and Company Kondwani Musukwa for failure to provide child support. She is being represented by Simeza and Sangwa Associates in this matter before the Lusaka High Court. Ms Chipungu said Mr Musukwa has failed to render support to their 10-year-old child for the past six years now, when he had capacity to do so. It is believed that after the child was born in 2010, Mr Musukwa had not provided any financial support. She wants the Lusaka High Court to order Mr Musukwa to start providing support to the child with school fees and monthly maintenance. Ms Chipungu also wants Mr Musukwa to be providing K16,000 for school fees and K5,000 for monthly maintenance. “Our client instructs that you and our client had a child together namely, Kondwani Musukwa Junior who was born in 2010 and now aged 10 years old. UPND ALLIANCE PLAGIARISED ‘THE ZAMBIA WE WANT’ SLOGAN Dear Editor,

WAS greeted with a rude shock as different colleagues within the Patriotic Front made consistent inquiries regarding the slogan of “the Zambia we want” slogan. They wanted to find out the circumstances under which the slogan was being used by the opposition yet it was an initiative of the PF members following the events after holding of the peaceful convention. The background of the slogan is traceable from April 10, 2021 when the PF and Republican President Mr Edgar Lungu had opened the two-day elective conference. The convention was held in a peaceful manner with attendance from different political parties and other stakeholders. Among the political party presidents who attended included then National Democratic Congress’s Chishimba Kambwili, Forum for Democracy and Development’s Edith Nawakwi, Economic and Equity Party’s Chilufya Tayali among others. The event was unprecedented as never in the history of Zambia has the political party held a convention with its competitors in attendance. It was after the said development that after consulta-

The rapid rise of identity politics in Zambia is what we should worry about, not the so-called fragmentation of the opposition. In a multitude of opposition political parties, the Patriotic Front won, as a single party, the elections of 2011. It should worry us that political parties have been established on personalities and their capacity to draw regional or ethnic support. We need to sincerely rebuild the One Zambia, One Nation our forefathers envisaged. So the hasty patchwork formations that we continue to see, are intended to draw personalities that may draw support from the ethnic regions they come from to these formations. This is an exercise in futility for in many cases, such personalities have no capacity or following to herd a people to their perceived new political destinations. Instead of bridging gaps, these alliances end up promoting and confirming tribal and regional politics. Instead of healing the major rifts beginning to emerge, they exclude and divide us further. Infact, these alliances are mere job-seeking ven-

tures for those involved than any semblance or commitment to resolve, collectively, the challenges facing our country. If the foundation is not based on ideas, collective resolve to build this country, if it is instead based on power and position sharing, it's a “tower of babel” headed for an inevitable downfall.

Mr Chanda The emeralds are competing on the international market, meaning that the country is getting the revenue it needs from this kind of business. People came from across the world to buy our emeralds; which means that more revenue is coming to government. Zambians want a leadership keen to provide solutions to issues that face this country such as corruption, political violence, the economy and our debt, youth unemployment among others and not leaders engaged in political gambling through these endless selfish formations. The exercise comes out as a power-grab scheme than a people-driven movement or resolve. Zambians want our leaders to work for this country, govern based on a sense of patriotism and dedication, run an all-inclusive government and resolve the challenges that face us in a consensus, fair, inclusive and transparent manner. The Daily Nation edition of April 12, 2021 at page 8 of the reader’s forum at the bottom right an article was published entitled, "THE ZAMBIA WE WANT.” In that article, “the Zambia we want” was attributed to President Lungu’s initiatives towards peace building. “The Zambia we want” originally was meant at encouraging President Edgar Lungu to continue with the same all-inclusive approach which knows no political affiliation.

I’m very shocked that without attributing originality, my slogan could without consent be copied and pasted with the view to championing the agenda meant at discrediting President Lungu when that was not my intention when conceiving it. I challenge the UPND president, Mr Hakainde Hichilema and his cohorts to adduce any documentary evidence that they had not copied my slogan. It is shocking that even before the accusation of plagiarising the manifesto from a

certain country could settle, the UPND has now been implicated in plagiarising from a private citizen. This raises the question of integrity of their promises and Zambians should take this as a wake-up call not to be swayed by plagiarised promises. I urge the UPND alliance to withdraw my slogan or else I will look at other options available including seeking legal redress to defend the integrity of “the Zambia we want” slogan. EDUCATION in Zambia needs to develop strongly on science and technology to improve the local economy into a manufacturing base. My best topic in secondary school was preparation of gases generally from the scientific point of view and I loved preparation of both Oxygen and Carbon Dioxide from a scientific sense. After so many years of about 15+ years today and this morning, I stood up to teach Grade 11 pupils about preparation of oxygen where I have remembered a couple of stuffs such as potassium permanganate, potassium chlorite, hydrogen peroxide and manganese (vi) ox-

ide or dioxide. I loved chemical sciences unfortunately I never pursued anything in chemical sense at professional level but I do appreciate colours in paints mostly made out of these chemicals. The nation needs to develop a strong passion towards science and technology to improve the economic landscape. Having made the right decision for yourself and the society, you fill in the form for the vaccination and hand it over. It’s checked and you proceed to the next table to get your jab. You (with a broad smile as you roll up your right sleeve): Sister, I want the Johnson and Johnson vaccine! Nurse: Sorry, madam. Only the AstraZeneca vaccine is available in Zambia. And madam, we recommend that you get the jab in your left arm. You (with a mischievous expression): Aahhh. The story of us left-handers! You have concluded that I am righthanded, right? Nurse (blushing, but difficult to tell because of her skin colour): Sorry, madam. We shall use the right arm then. You (as you present the right upper arm): I am a 43-year-old female and I am told that the Johnson, Moderna, or Pfizer vaccines are the best for us. Nurse: I think the doctor can answer that. Doctor (goes over to table): Madam, the best vaccine for you is the one you are able to get. In Zambia, for a variety of reasons, we only have the AstraZeneca vaccine. You (combatively, as you withdraw your arm slightly): Shouldn’t I wait for the others then? Doctor: No. The protection that all vaccines offer is very, very similar. From the science, it seems unlikely that the vaccine can affect the baby. If the woman is likely to be exposed to the Covid-19 virus, then she should get vaccinated. People with other illnesses like diabetes, hypertension, HIV/AIDS, and even obesity should get the vaccine. These are people with what we call co-morbidities, that is, they get Covid but have other underlying medical problems. These are more likely to be hospitalized and more likely to succumb to Covid-19 if they contract it. You: That must be half of all Zambians! Doctor (laughing): You are a pessimist, madam! The odds of you getting Covid and getting seriously sick or dying outweigh by far the odds of you getting seriously sick from the vaccine. You: I see Doctor: Now, if someone has an acute infection, like say malaria or tonsillitis, it is better to wait until the illness has cleared before getting the vaccine. You: My father is diabetic, but he has survived this curse! He was in Levy Hospital but is now recovering at home. He got sick three weeks ago. Can he get the vaccine? Doctor: Not yet. Those with an active Covid-19 infection should wait until they have fully recovered. The recommendation is that they should be vaccinated after about 90 days. Those who need to get any other vaccine should wait until two weeks after their Covid-19 vaccine. You: Thanks, doc. Why is all this information not availed to us? We are getting all the information from social media! Lots of negative info at that! Doctor: They are trying, but I think the government has been overwhelmed. You: Or are being distracted by the coming general elections! Doctor: No comment. I’m a government employee! You: So am I! One last question, doc: What of the clots everyone has been talking about? What are the chances that I may get them? Doctor (smiling): Now you ask me! Those are extremely rare, perhaps occurring in 1 in 250, 000 vaccinations. They have been found in younger people more than in your age group. Looked at differently, it is also important to know that the chance of developing clots is much, much higher in a person not vaccinated for Covid-19 who goes on to get the disease. More than two million people have died from Covid-19, and those who have died from complications of the vaccines is in single digit thousands. I would say you have more chances of winning the lottery than getting a fatal complication! You: Ok. Then I’m off to buy my lottery ticket. Sister, can I have my vax certificate, please? FAZ sources FIFA funding for Solwezi stadium By JACKSON MAPAPAYI THE Football Association of Zambia (FAZ) has secured about US$300, 000 from the world football governing body (FIFA) for the rehabilitation of the Solwezi Independence Stadium. The funds to rehabilitate the facility which was built in the 70s are under the FIFA forward funding. This came to light during the crowning of Quatro Kalumbila as champions of the 2019/2020 FAZ provincial cup in Solwezi who walked away with a K26, 000 cash prize and a trophy after beating Bresmar United 4-0 in the final match. North-Western Province Minister Nathaniel Mubukwanu who graced the event stated that the amount will go a long way in supporting football development not just in the region but the country as a whole.
