LET’S MOVE ON MARIJUANA FOR a country that desperately needs to raise foreign exchange to help revamp its economy, it is surprising that Zambia has been dragging its feet over the growing and export of marijuana for medicinal purposes. This is a billion-dollar global trade that has seen African countries approve the cultivation of marijuana for medical purposes. There is a ready market in Europe, said to be the largest, and the United States. Zambia has an ideal climate for a thriving marijuana growing industry and it is surprising that inertia by Government is preventing this money-spinning venture from taking off. It is in this vein that we join the Zambia Hemp Growers and Industries Association (ZHGIA) in calling on Government to speed up the actualisation for the growing of marijuana. ZHGIA president and chief executive officer, Peter Sinkamba, said the legislation process must be expedited so that the country could begin to benefit from the potential “money spinner.” It is almost a year since Government approved a proposal to legalise the production of Marijuana, but is yet to come up with guidelines on how this could be actualised. It is this inertia that is worrying. Mr. Sinkamba, who is Green Party president has been propagating for the legalisation of marijuana as a business venture and earn foreign exchange for the country. Only Mr Sinkamba appears to be interested in seeing this come to fruition which led to the formation of the Zambian Hemp Growers & Industries Association (ZHGIA) with PACRA, with the principal business activity to promote the cultivation, production, manufacturing, distribution, and coordination of hemp business in Zambia as well as protecting and upholding rights and interests of its members. Rwanda has already approved the cultivation of marijuana for export, so has Lesotho. South Africa even allows private use of marijuana in private. What is likely to happen is that countries that have just legalised marijuana production for export will dominate the market while Zambia is dragging her feet. As Mr Sinkamba noted, Cabinet had already approved in principle the cultivation and export of cannabis for medicinal, industrial and economic purposes but bemoaned the slow pace at which the implementation of the review of the legislation was going. According to him, Government had even taken the matter to parliament and yet nothing tangible had come up so far. According to research from The African Cannabis Report, the first detailed report on the legal cannabis industry in Africa, the continent’s legal cannabis industry could be worth more than $7.1 billion annually by 2023 if legislation is introduced in some of the continent’s major markets. This is the core reason why there is concern from interest groups that the legislation process must be speeded up so that the country could have a chunk of this huge market. With Zambia facing a huge foreign debt, survival lies in exploiting new potential foreign exchange earners such as agricultural, in form of marijuana, as well as mining of high value minerals like gold. Government must therefore stop dragging its feet and provide a roadmap that organisations like ZHGIA could follow and get their ideas into reality.

Over 30 families were displaced after a Mr Chitambala obtained a court order for the demolition of the occupied houses last Saturday around 02:00 hours. Bupalo ward counclilor Nelius Mumba complained to the Daily Nation yesterday that the victims had been sleeping outside with their children. “We are very saddened by this situation. THE voter registration exercise is still a shame despite the Electoral Commission of Zambia (ECZ) claiming to have deployed more electoral officers, UPND spokesperson Charles Kakoma has said. A check by the Daily Nation found that most of the registration centres still had one or two ECZ officers working. Only one officer was found working at Matero Secondary School Registration Centre with scores of residents on the queue. Mr Kakoma said at the pace ECZ was handling the voter registration process, the nine million target was not going to be attained.

He said ECZ needed to register thousands of people in one day to reach the target. Mr Kakoma said in an interview that there was need for more to be done for ECZ to attain its target ahead of the 2021 general elections. He said after visiting some registration centres, he discovered that there were no additional electoral officers which the ECZ promised to deploy. He said claims of additional electoral officers were rhetoric because what was on the ground was different. Kalunga told Lusaka magistrate, Alice Walusiku during continued trial yesterday that Ultimate paid the money between 2019 and January 2020 through his bank. Three Marshlands Consortium Limited directors, Nachi Musonda, Tobias Hanyimbo Milambo and Richard Lubemba are in court facing 15 counts of forgery, obtaining money by false pretenses and uttering false documents, among them Ultimate Insurance Company Limited shareholder resolutions. Milambo, 48, a chartered insurer of Woodlands, Musonda, 33, of Chongwe and Lubemba, 31 of Chalala are alleged to have forged documents purporting to show that they had been appointed as directors at Ultimate. It is alleged that between January 1, 2018 and December 31, last year, Milambo, Musonda and Lubemba, with intent to defraud, forged a Bitrust Rear Estate Innovative Solution Valuation Report dated January 6, 2018 for stand 9192/35 Manunga Road, Ndola. The trio, all insurers, allegedly forged the document by purporting to show that it was genuinely issued and signed by authorised by Bitrust Real Estate Innovation Solution for Investors, when it was not the case. It is further alleged that between the same dates, Milambo, Musonda, Lubemba, Marshlands Consortium Limited are accused of obtaining goods by false pretenses and stealing over US$41, 000 belonging to Ultimate insurance. The three directors were initially represented by Nchito and Nchito Advocates in the matter but are now represented by Lusaka lawyer Osbourne Ngoma and others. When the matter came up for

continued trial yesterday, Mr Kalunga said that on August 26 , 2020 he was asked by his superiors to reprint a bank statement for account no 0011028454 for Ultimate from ABSA Bank Zambia Limited which was held in United States dollars. He said that after the instructions by his superiors he reprinted the bank statement with transaction details. Mr Kalunga explained to the court that he re printed the statement using the computer system of the bank which was secured by means of password and data inscription and he had been in custody of the document. He submitted the print out of the bank statement as part of his evidence but one of the defence lawyers objected to the production of the document on grounds that the witness did not satisfied the provisions of the law in producing the statement. But Ms Walusiku in her ruling allowed Mr Kalunga to produce the statement saying it he met all the necessary conditions as a witness who is an official of ABSA bank. In a related matter the Registrar of Pension Insuranve Authority (PIA), Christopher Mapani, his Deputy Registrar in charge of Insurance, Titus Nkwale, and Manager insurance, Nicholas Mbuya are facing charges of abuse of authority also appeared before Lusaka Magistrate Felix Kaoma for commencement of trial. No money, no exams for UNZA students By AARON CHIYANZO STUDENTS who are completely unable to pay academic fees should withdraw and register when they are ready because they will not be allowed to write examinations, University of Zambia (UNZA) Vice Chancellor Professor Luke Mumba has said. Prof Mumba said all students who had outstanding obligations would not be allowed to write examinations. The examinations commenced yesterday. He said some students never come back to clear their dues when they were allowed to write examinations. “We will not take that route this time around, students just have to clear their dues. For those who really do not have

money, let them withdraw for this academic year and we will allow them back to when they find money,” Prof Mumba said in an interview. He said it had become a criminal offence under the Public Finance Management Act No. 1 of 2018 to fail to collect public revenue which included fees from students. “Our hands as management are tied,” Prof Mumba added. Prof Mumba said every year the Office of Auditor General had been querying UNZA for failure to collect fees from students and allowing students to write exams without paying fees. Prof Mumba explained that students had been provided a payment plan to meet their obligations in four instalments per academic year.

COPPER prices yesterday hit a 29-month high of US$7, 179 a tonne, the strongest since June 14, 2018. Three-month copper on the London Metal Exchange jumped as much as 2.8 percent to US$7, 179 a tonne, the strongest since June 14, 2018. This is according to the Absa Bank Zambia Daily Market report. “Industrial metals rose yesterday, with copper prices hitting 29-month highs and Shanghai aluminium scaling a three-year peak, on optimism around demand in top metals consumer China,” Absa said. Oil prices also climbed, recouping some losses from the previous session as hopes that Organisation of the Petroleum Exporting Countries (OPEC) will hold current output curbs offset concerns about weaker fuel demand due to rising Covid-19 cases and higher production from Libya. Brent crude futures for January rose 44 cents, or one percent, to US$43.22 a barrel, while U.S. West Texas Intermediate crude for December was at US$40.67 a barrel, up 54 cents, or 1.4 percent. Meanwhile, the Kwacha is this week expected to pick up slightly depending on dollar inflows the market will receive from corporates converting for upcoming payroll obligations amidst increasing corporate greenback demand. The past week saw the Kwacha trade between K20.80/ K20.85, with market activity still remaining largely unchanged and the main players being energy and agriculture entities. Absa Bank said the Zambian Kwacha was unchanged on Friday in a relatively quiet trading session as importers continued to seek the greenback in a market still caught short of dollars. Opening the trade day at K20.88/20.93 per dollar, Absa bank said, the local unit traded firm throughout until close of business. The Kwacha closed Friday's trading session against the U.S dollar at K20.88/ K20.93.

‘FOREIGN TRANSPORTERS EXTERNALISING FUNDS’ Z

AMBIA is spending over $2 billion on transport per year, hence the need for the country to domesticise the sector to avoid externalisation of funds, Petroleum Transporters Association of Zambia president Benson Tembo has said. “Generally, externalisation of funds in the transport sector has not been addressed. We have however seen progress in the

petroleum transport sector because Government has given import waivers for the local oil marketing companies and meaning that all the business is confined locally,” Mr Tembo said. Mr Tembo said, however, that Government should remove foreigners from participating as main contractors and only participate as sub-contractors. “Removing foreign transporters will help domestic the revenue and externalisation will be a thing of the past and the only revenue that will go out is payment to a few

sub contracted foreigners transporters,” he said. Mr Tembo said the fuel transport sector had grown and did not require the participation of foreign transporters. He said transportation of minerals had remained the biggest loophole for externalisation of funds as there was no participation of Zambians in the mineral transport sector. “There is urgent need to domesticise the transportation of minerals so that the economy can benefit,” Mr Tembo said.

He mentioned that stopping such key projects that have already reached an advanced stage would not make sense because it would be a waste of resources. “As a result of ongoing discussions that we are taking with the various creditors, we have been requested as part of the debt suspension to indicate which projects we consider to be priority projects to exclude them from the process,” he said.

THE Electoral Commission of Zambia (ECZ) has been accused of manipulating the voter registration exercise by favouring the opposition but it has denied the claims. A consortium of civil society organisations said ECZ seems not to be doing very well with registering voters in a manner that was free from manipulation and fairness. The civil society organisations are Young African Leaders Initiative and Advocates for National Development and Democracy. “We want to note that in most areas which appear to be strongholds of UPND, the registration process of voters is taking less than six minutes for one voter to register while in PF stringholds it is taking 10 to 15 minutes to register,” the consortium claimed. ECZ chief executive officer, Kryticous Shindano however said the commission was an autonomous electoral management body. Respect the law, alcohol dealers urged By KALOBWE BWALYA BAR owners, retailers and distributors of alcohol have been reminded of their legal obligations as Zambian Breweries partnered with Lusaka City Council and Ndola City Councils in a workshop of compliance. Zambian Breweries Legal Counsel Deborah Bwalya said the aim was to educate those in the alcohol trade on the legal framework governing the sector to help them compete vigorously while respecting the law. Ms Bwalya said the brewing company together with the two councils seek to educate bar owners, retailers and distributors on issues pertaining to compliance, prevention and detecting violations of rules, which protect their businesses from fines and lawsuits, and practical advice on running their businesses. Ms Bwalya said the partnership would also focus on customer care and sustainability, including alcohol responsibility, sensitizing customers on avoiding underage drinking, drinking and driving, gender based violence and alcohol abuse. ZAS chairperson, Sylvia Kagulura, said it was important to live a day at a time but in the best way for the Lord. She was speaking during the annual general assembly for ZAS. Police probe Charmaine attack By KALOBWE BWALYA POLICE have instituted investigations in the matter where UPND official, Charmaine Musonda and three other people were attacked. SENIOR Chieftainess Chungu of Lupososhi has expressed her displeasure following the recent collapse of the Constitution amendment Bill 10 of 2019 in Parliament. She learnt with sadness the failure to pass Bill 10, which had progressive clauses such as the representation of youths, women and disabled. The traditional leader said that the failure of Bill 10 was a sign of selfishness among opposition political party Members of Parliament (MPs). She however assured Government that the traditional leadership would continue to support Government, stating that Bill-10 would succeed in the near future. Encroachment on road reserves reduce - RDA By KETRA KALUNGA THE number of illegal structures in the road reserves has reduced, the Road Development Agency (RDA). RDA director of communications and corporate affairs, Masuzyo Ndhlovu, said in an interview that there had been a reduction in the number of structures being built on the road serve. Mr Ndhlovu however said the RDA had continued sensitising the public on the need to stop illegal constructions in the road reserve. “There has been a reduction in the number of structures being built in the road reserve however as RDA, we have continued with sensitising the public on why they should avoid building in the road reserve,” he said. It was discovered that private developers were constructing illegal structures on road reserves, the situation which saddened the RDA. RDA feared that if the infringements in the road reserve were not halted, the country would find it difficult to carry out future developments and expansion of roads. Open letter to musician Lota Mandevu aka DRIMZ Dear Editor, I AM quite impressed with your appeal for peace and condemnation of tribalism. Your appeal to the head of State, the President of the Republic of Zambia to fight tribalism and political violence is laudable. But I am challenging you to also play your part by being a responsible artist, a bridge builder and peace maker. You have also been fanning the flames of politically motivated hate and violence through your music. For example, your song “ba Mwankole” does not promote or preach peace but fans political violence. It is not only provocative but also disrespectful. You can’t hide behind the claim of satire or metaphor. Clearly, the song was aimed at provoking public hate and contempt towards a particular group of citizens. That is why it played a very divisive and destructive role in the recent parliamentary and

local government by-elections. People were quick to interpret who the “mwankoles” are in the song. The people you called “Ba Mwankole” are reasonable human beings with feelings and emotions. They still feel hurt, angry and bitter because of the ridicule your song occasioned on them and their social group. If you are not alive to this reality then you are still a toddler in the creative arts. You need to find a way of making amends with the people you disrespectfully called “Ba Mwankole” and “ba Mushanina bwali.” Failure or refusal to do so may adversely affect your career and your personal safety. The ideal is that those who feel injured should exercise tolerance and swallow the shame of being ridiculed as “ba Mwankole ba Mushanina bwali” because Zambia is a democracy where every citizen should express themselves freely. Yes, that is the ideal. But we are not living in the ideal world sir. We are living in the real world. Realism supersedes idealism. In politics the real world exists. WHY AND HOW PRESIDENT LUNGU CANNOT BE PETITIONED VIA ARTICLE 52 Dear Editor,

RESIDENT Edgar Lungu’s eligibility to contest the 2021 polls debate has been revived after the Constitutional Court (ConCourt) poured water on the then ill-conceived “Third – Term” debate. But this time around the debate is orchestrated to instil fear in the head of State and the governing PF by threatening to petition the incumbent via Article 52 (4): “A person may challenge, before a court or tribunal, as prescribed, the nomination of a candidate within seven days of the close of nomination and the court shall hear the case within twenty- one days of its lodgement.” However, President Lungu will successfully file his nomination papers as PF’s 2021 Presidential candidate whilst serving as a Republican President in line with Article 52: (1) “A candidate shall file that candidate’s nomination paper to a returning officer, supported by an affidavit stating that the candidate is qualified for nomination as President, Member of Parliament or councillor, in the manner, on the day, and at the time and place set by the Electoral Commission by regulation. (2) A returning officer shall, immediately on the filing of a nomination paper, in accordance with clause (1), duly reject the nomination paper if the candidate does not meet the qualifications or procedural requirements specified for election to that office.” In short, both a Republican President and PF’s 2021 Presidential candidate will be in the person of Edgar Chagwa Lungu. An election petition initiated via Article 52 exempts the Republican President who is

seeking re-election: He enjoys full executive powers and immunity from legal suits or criminal prosecution under Article 98 (1) “A person shall not institute or continue civil proceedings against the President or a person performing executive functions, as provided in Article 109, in respect of anything done or omitted to be done by the President or that person in their private capacity during the tenure of office as President.” The constitution framers were alive to a Republican President’s immunity from legal suits or prosecution. So, if the learned State Counsel, John Sangwa and his counterpart Choma Central Member of Parliament Cornelius Mweetwa petitioned President Lungu’s eligibility to contest 2021 polls, then the Constitutional Court (ConCourt) will have only two options: Either dismiss the case with costs or entertain the matter for experimental or academic purposes. First and foremost, the ConCourt cannot revisit its earlier judicial decision as that would cast serious aspersions on its judicative function. Secondly, petitioners will grapple with this challenge: How do they separate the PF’s Presidential candidate from a Republican President in one person of Edgar Chagwa Lungu for them to serve Court summons? However, the ConCourt can only entertain the case for experimental or academic purposes as Article 52 exempts the Republican President who is seeking re-election. Moreover, under the most misinterpreted Article 106 (3) President Lungu is eligible to contest 2021 polls: “A person who has twice held office as President is not eligible for election as President.” The “twice held office as

President” refers or captures the scenario effective January 5, 2016 when President Lungu appended his signature on the amended constitution. And amended law does not look back! Then, begs the question: How many times has President Lungu held office since January 5, 2016? The answer is once! First and foremost, the President‘s full term of office is five years. What about Mr Lungu’s election as President in 2015? Many President Lungu’s eligibility to contest 2021 polls critics get confused with this question. Since 2015 elections took place before the amended constitution, we need a transition law to interpret the event. Unfortunately, the transition law or bridge to help us transport a past event in the current constitution does not exist. So, what do we do? Either ignore the past event as the amended constitution does recognise it, or borrow a law in the current constitution to help interpret the past scenario. The Article 6 (6) defines the 2015 election scenario: “If the Vice-President assumes the office of President, in accordance with clause (5)(a), or a person is elected to the office of President as a result of an election held in accordance with clause 5(b), the Vice-President or the Presidentelect shall serve for the unexpired term of office and be deemed, for the purposes of clause (3) (a) to have served a full term as President if, at the date on which the President assumed office, at least three years remain before the date of the next general election; or (b) not to have served a term of office as President if, at the date on which the President assumed

office, less than three years remain before the date of the next general election.” President Lungu served for only 20 months from September 20, 2015 to September 13, 2016 technically, President Lungu did not serve the full term of office. Therefore, he is eligible to contest the 2021 polls! The issue of public interest: The State Counsel Likando Kalaluka‘s voice, who is also AttorneyGeneral, would have offered legal guidance to the nation. Equally, PF legal committee chairperson Brian Mundubuile, who is also Parliamentary Chief Whip, should have provided legal counsel than leave the nation speculating. The raging debate on President Lungu’s eligibility to contest 2021 polls: Calculated to throw dust in the Zambians‘eyes and influence their perception. As for Mr Sangwa, he lamentably failed to interpret the Article 52, read together with Article 98. Contrary to assertions that many Zambians will petition President Lungu’s eligibility to contest 2021 polls by the Choma Central lawmaker, many Zambians who are exasperated with Mr Hakainde Hichilema’s five consecutive loss of elections since he took over the mantle from UPND’s founding leader late Anderson Mazoka will petition his eligibility to contest the sixth time as no Convention has been held to indorse his candidature. The UPND has never held a convention ever since the 2006 controversial convention that ushered in Mr Hichilema as its leader, a situation which contravenes Article 60 sub -section 2(d) of the current constitution which requires a political party to hold periodic primary elections. As a matter of fact, Mr

Hichilema’s opponents may use Article 52 to cripple his campaigns. Mr Sangwa and Mr Mweetwa should begin to prepare how to defend Mr Hichilema should Zambians petition his eligibility than influence public perception on President Lungu’s eligibility case that is already settled by the Court of law. Interpreting the Constitution in this country has been the “spoiled child” of the so-called legal experts. It’s for this reason we need law interpreters and not legal experts. And it’s for the s a m e reason Article 2 of the current constitution gives every Zambian c i t i z e n the right to defend the constitution: “Every person has the right and duty to - (a) defend this Constitution; and (b) resist or prevent a person from overthrowing, suspending or illegally abrogating this

RCEP: Asia-Pacific countries form world’s largest trading bloc

LONDON - Fifteen countries have formed the world's largest trading bloc, covering nearly a third of the global economy. The Regional Comprehensive Economic Partnership (RCEP) is made up of 10 Southeast Asian countries, as well as South Korea, China, Japan, Australia and New Zealand. The pact is seen as an extension of China's influence in the region. The deal excludes the US, which withdrew from a rival AsiaPacific trade pact in 2017. President Donald Trump pulled his country out of the TransPacific Partnership (TPP) shortly after taking office.

Negotiations over the new RCEP deal began in 2012 and it was finally signed on Sunday on the sidelines of a meeting of the Association of Southeast Asian Nations (Asean). The RCEP isn't as comprehensive and doesn't cut tariffs as deeply as the TPP's successor. But many analysts think RCEP's sheer size makes it more significant. Members of the RCEP make up nearly a third of the world's population and account for 29 percent of global gross domestic product. South Africa's economy was already in recession before the Covid-19 pandemic led to a nationwide lockdown in late March. Voter registration improves in L/stone By ANDREW MUKOMA THERE has been an improvement in the voter registration process in Livingstone, the Foundation for Democratic Process (FODEP) has observed. FODEP noted yesterday that the improvements the Electoral Commission of Zambia (ECZ) has made in addressing challenges. This is in contrast with the situation last week when people spent many hours on the queues in registration centres. FODEP says that the commencement of voter registration exercise on November 9, 2020 had been faced with various challenges ranging from slow pace of registration, breakdown of registration kits and inadequate staff to attend to the generally huge turnout of people seeking voter registration.

District Chairman Nyambe Mutete said six people were now being registered in one hour against previous situation where two to three persons could be registered in one hour in certain circumstances. He said that in areas where turnout was very high, ECZ had deployed extra staff and registration Kits. Mr Mutete said in a statement released to the Daily Nation yesterday that this move had enhanced the number of people being captured in a day. He added that the beefing up of registration kits had resulted in improved speed in the centres. Mr Mutete urged citizens who were busy during the week to take advantage of weekends to register as voters. “FODEP wish to reiterate it’s earlier call to ECZ to enhance publicity in all the wards so that people are made aware of the process with respect to the ECZ deployment schedule and importance of registering as voters.

LAST week I talked about the ugly scourge of extremists and fundamentalists. Today I ask, if you are an extremist or a fundamentalist, what extent can you have space for cooperation, love and national unity. The critical question among many is: so what next? I pity those individuals and societies which have embraced extremism and are into fundamentalist and dogmatic routines. The tricky part is that these are fellow Zambians and treating them as enemies, is not a viable option. Instead, we have a duty to realign them away from dogmatic ways! How? Through intensive civic education! UNITY IN DIVERSION We are wasting a lot of time and energy on unproductive debates and schemes. Take a single stick and break it, it will very easily give in. But take a bunch of sticks aligned/bound together and try to break the same; it will be very difficult, if at all. That is all the people of Zambia. Together, we can achieve more and defeat MONOPOLY CAPITAL! I hope people have taken time to understand and appreciate the discussions that informed key decisions of the very first census conducted in Zambia. In short the exercise was important but to maximise on efficiency; it was important and intellectually honest to group 73 languages and dialectics, for easy counting. The rest is a detail and should be available at the National Archives or the Statistics Agency. Take time and look at the decision by the Supreme Court, where political forces, questioned the parentage of former President Frederick Chiluba. The main issue here is that the Supreme Court, which is the highest court of law in Zambia ruled that those who were in Zambia on October 24, and consented, automatically became Zambian citizens. Zambia, is all the 10 provinces resting on a landmass of 752, 000 sq km. It is Zambia for Zambians but accommodative of other nationalities of the global village. COMMON GROUND We have absolutely no choice but to work together in developing Zambia. A Zambia that benefits from all its citizens, notwithstanding any subjective trappings, will achieve more and better. What this means as I have advocated before is that we must DOMESTICATE the concept of “democracy” in our governance process, so that it is both meaningful and useful to the country. We should understand democracy as a PROCESS and SYSTEM, which simply

affords citizens an opportunity to participate. IT IS ALL ABOUT PARTICIPATION. In this process, what is expected are serious differences! But, the democratic process has its own rules. One thing which has worked in favour of most democracies, is working towards a common ground on many issues. Anarchy or violence is the antithesis of civility - and it is precisely the existence of hooligans in some democracies that continues to complicate analysis. How can one defend extremists such as the Ku Klux Klan? Emphasis is more on what is good for the country as opposed to what is good for a group of individuals. If you came to Zambia, you will find no dispute where Cairo Road is. Same with where State House is situated. The same with the Supreme Court siting and is the case with Parliament. As any public office, now and before, the portrait of the Head of State is displayed prominently. The significance is the civilised manner of demonstrating UNITY and Coherence of action. Somebody is employed to specifically ensure that the Head of State’s portrait is in every relevant and necessary public office or place, depending on circumstances. Building consensus is not the same thing as securing agreement on everything. When consensus is built, you coalesce. Meaning you bond and see things as a common project. Clearly you then are ready to move on. When you refuse to reach consensus you agree to create an impasse; accompanied by a heap of problems, that society must navigate through. (This is what happened in the Zambian Parliament a few weeks ago!

Do you remember how the Referendum was defeated in the 2016 Elections? The common thread was that “if you vote for the referendum, it means you are voting for the Patriotic Front”. The icing that reaped massively from ignorance was: Did you see Mr or Mrs Referendum come to campaign? Be careful with this person called “Referendum”. With that kind of politics and politicking, what do you expect? So what? All the dirty and nasty things may be heaped on helpless Zambians. I ask, SO WHAT? We have seen the worst of things and this is in no way justifying wrong-doing. It is just acknowledgement the fact that it happens and has happed before. My take is to ask a question: Who shall develop Zambia, if Zambians shun away from the noble duty of participation? Let me quickly say that I do not think it is correct to lump the concern of lack of patriotism on all Zambians. It is a concern that may be heaped on selected Zambians who have shown their insatiable campaign to get political power, at all costs. Foreign control The good news is that, the will of the people shall prevail as in the past. I see the 2021 election as a validation of the fact that Zambians do not and will not accept tacit foreign control. In other words the 2021 election is not about poverty or about Zambia’s debt and its consequences. It is Monopoly Capital and the

entire Babylon System Versus the Zambian people. It is about wrestling political power from a Patriotic Front government which has committed to Zambia and Zambians. OHANNESBURG - Malawi's President Lazarus Chakwera and his wife Monica were not allowed to leave South Africa as planned on Friday night as more details emerged of self-proclaimed prophet Shepherd Bushiri's escape from South Africa. Bushiri and his wife Mary were out on R200, 000 bail when it was discovered that they had not checked in with the police on Friday as required in terms of their bail conditions. A warrant for the arrest of Bushiri, and his wife has since been issued, according to South African government spokesperson Phumla Williams. In a surprise development, Bushiri appeared in a live video broadcast that was streamed online on Saturday in which he said he had chosen to leave South Africa in violation of his bail conditions because he feared for his safety and was concerned he would not get a fair trial. His departure took place in the same week that Chakwera visited South Africa for talks with President Cyril Ramaphosa. The overlap in Bushiri's escape and Chakwera's trip to Pretoria raised speculation that Malawi's leader - or at least his delegation - helped the self-proclaimed prophet and his wife flee.

We will try to answer these questions: What is Project Governance? What is an underlap and overlap of responsibility in project management? When does and an underlap or overlap happen in a project? How do you avoid underlaps or overlaps of responsibility in your projects? Project governance framework is based around a number of core principles in order to ensure effectiveness. Project governance is the management framework within which project decisions are made to ensure project success. I am sure that you

will agree with me that many projects fail not because of technical abilities or reasons but rather poor project governance. Failure of project governance in a project is a recipe for an overall project failure. Definitely this can form an attractive research project for post graduate students in project management. Project governance is a critical element of any project, since the accountabilities and responsibilities associated with every project are different and depends on environment and context. Organization’s business as usual activities are laid down in their organizational governance arrangements; rarely does an equivalent governance framework exist to govern the development of its capital investments (projects). Organizational governance is most organizations is achieved by having in place organization governance structures that guide their management functions in order to ensure smooth organizational direction and control through policies and processes to meet strategic and operational objectives. A key role in project governance is that of the project sponsor or project executive. The project sponsor has three main areas of responsi-

bility which are to the project steering committee or project board, the project manager and the project stakeholders Ownership and responsibility in projects: It is a vital principle in project management best practice that every part of the project should be owned, so that responsibility, delegated authority and accountability can be assigned to the owner. It is important to establish who is responsible for what in order to avoid overlaps and underlaps of responsibilities. An underlap means that no one project manager is deemed to be responsible which leads to the confusion and chaos and decision not being made until they become critical. Conversely an overlap means two or more managers could feel they are personally responsible which leads to confusion, contradictory orders, duplication of effort and even conflict. This is where project organization structure is required to clearly outline ownership, authority, responsibility and accountability. You can avoid underlaps and overlaps happening in your projects by adopting best practice. For example in PRINCE2 methodology, the principle number 3. Defined roles and responsibilities and the organization theme addresses and takes care of project

governance requirements. It ensures appropriate project governance by enabling and defining distinct responsibilities for directing, managing, delivering the project and clearly defining accountability at each level. Adopting and embedding good project governance early enough in the project inception is good and advantageous in that it consequently pays off by minimizing unnecessary project team meetings discussing roles and responsibilities. Project responsibility and accountability is established by delegating authority from one management level to the next by setting tolerances against six aspects of performance for the respective level of the plan: • ● Cost -The degree of allowable overspend or underspend against an agreed budget • ● Time - The degree to which a project is allowed to deliver later or earlier than an agreed target completion date • ● Quality - How much something can vary from agreed quality criteria. For example, a project to produce a new sports watch might have a target that the watch should work under water to a depth of 50 metres, with an allowable tolerance of

plus or minus 5 metres • ● Scope - Allowable variation of the plan’s products. For example, a project might be required to deliver all of the must do, ‘mandatory’, requirements but be allowed to deliver only 50 per cent or more of it’s should do, ‘desirable’, requirements • ● Benefits - The degree to which it is allowable to under-deliver or over-deliver benefits (realized or estimated). For example, the business case for a sales improvement project might have been modelled with a plus or minus 2 per cent range of increased income generation • ● Risk - Limits on the plan’s aggregated risks. For example, a tolerance might be set that the cost of aggregated threats must remain less than 15 per cent of the budget and that the cost of any single threat must be no more than 10 per cent of the agreed budget. Final thoughts: It is also good idea to set up controls so that if those tolerances are forecast to be exceeded, they are described as being in exception and immediately escalated to the next management level for a decision on how to proceed. Putting an assurance mechanism in place so that each management level can be

confident that such controls are effective. One of the advantages of using best practice in project management is that it comprises of guided roles and responsibilities, terminology and processes that people become familiar with and so clarifies project governance and facilitates team working and cross-organization cooperation. For good project governance, it is very important that the chain of accountability from any higher level (organization, portfolio or programme) to the project level is made clear. Effective governance of project management ensures that an organization’s project portfolio is aligned with the organization’s objectives, is delivered efficiently and is sustainable to ensure success. Kitwe Bullets and Monze George FC will compete in group D with Division one representatives, Efford Chabala, Tamanga and Zanaco who will begin their campaign with a tie against Monze George. CSS Petauke, Tamanga, Siavonga Beetles and BS Stars will be on bye on match day one of the tournament which will see the first two teams of each group qualifying for the quarterfinals.
