O mining activities will be allowed in Lower Zambezi as this would have a negative impact on the eco-system, Minister of Lands and Natural Resources Jean Kapata has said. The minister said

Government would not listen to any calls for mining activities to actualise in the area because it was aware of the negative impact such activities had. Ms Kapata in an interview yesterday, said Zambia Environmental Management Agency (ZEMA) rejected the proposal after undertaking environmental assessment and that was final. She said Government would not allow the eco-system to be under threat because of selfish interests. “ZEMA did its environmental assessment after an investor showed interest to undertake mining activities in the area. After its assessment it found out that if mining was allowed then it would

have negative impact on the eco-system. So as Government, we shall go with what ZEMA had indicated. So what I can say is that ZEMA rejected the mining activities and no investor will be allowed in the area. “As people we need to consider the eco-system in whatever we want to do, we can not just do it for the sake of doing it, no. So this matter is over and we shall not allow anyone there,” she said. Recently, chief Mphuka of Luangwa appealed to Government to allow a mine to be established in the Lower Zambezi. Chief Mphuka said Luangwa was underdeveloped and lacks economic activities hence the need for the

mine to be set up quickly. A debate erupted after the Lusaka High Court gave a go ahead to a mining operation in the Lower Zambezi National Park with several people calling for the revocation of the license. But Chief Mphuka said those calling for the revocation of the mining permit had no understanding of the area. “I condemn certain chiefs who are saying this mine should not go ahead. It’s not in their chiefdom, the mine is in Senior Chief Mburuma’s chiefdom. These are the people that need to be asked first in Luangwa district,” Chief Mphuka said. He added that the recent media reports on the wildlife at the mining site were false.

‘Killer’ soldier sent to High Court By CHARLES MUSONDA A ZAMBIA Army officer accused of killing a medical doctor in a gruesome murder believed to be a crime of passion has been committed to the High Court for trial. Lieutenant Nigel Musonda Mwaba, 33, of 392/A Barlastone in Lusaka, was committed yesterday when he appeared in the Lusaka Magistrates’ Court following his arrest on November 28, 2020 after being on the run for about a month. Particulars of offence are that Mwaba, between October 24 and 26, 2020, murdered 47-year-old Dr. Tasila Tembo Peters who was his lover. A chained and handcuffed Mwaba was driven to the court premises around 08:30 hours by the anti-robbery officers after which he appeared before Principal Resident Magistrate Mwaka Mikalile who allocated the case to Magistrate Chinunda Chiwaula. Dr. Tembo, who was reportedly murdered in cold blood, went missing from home and a few days later her decomposed body was found near Mikango Barracks with the head severed from the body. Mwaba was apprehended about three weeks ago after he was cornered at the

late Dr. Tembo’s grave at Leopards Hill Memorial Park. Clad in a light grey top track and charcoal grey bottom track, a gloomy looking Mwaba told Magistrate Chiwaula that he understood the murder charge after it was read out to him. Mr. Chiwaula later told him that the case he is facing is only tried by the High Court. Public prosecutor Hermit Maloza then informed the court that the Director of Public Prosecutions has issued instructions committing the accused person to the High Court for trial and Mr. Chiwaula accordingly committed him. After his committal, Mwaba applied to the court to grant him an opportunity to be taken to hospital for ear treatment. He said his experience in detention caused injury and damage to his ears, which keep on discharging pus and blood and that he has lost hearing on one side because of the damage. Mwaba also said he was taken to Sikanze police camp where he was seen by a nurse who discovered that he had an infection in his ears. He said when his family asked for a copy of a medical report they could not be given and that it was later torn. Mr. Chiwaula then instructed the State to ensure Mwaba undergoes necessary medical attention because it is within his right that he is treated. He was later driven away from the court premises while lying down in a police van.

Replaced paracetamol not expired By OLIVER SAMBOKO THE Southern Africa Students and Youth Development Association (SASYDA) has clarified that the paracetamol that was recalled by ZAMRA was not expired but the drugs were only recalled because some batches failed the appearance test. Association President, Ibrahim Kabwe Mwamba, said following various reports on the issue, SASYDA took upon itself to check the facts where it was discovered that the paracetamol was recalled because of discolouring and not being expired. “SASYDA would like to clarify that the paracetamol that was recalled by ZAMRA was not expired. After checking the facts, it has been established that actually the reason the paracetamol was recalled was because some batches failed the appearance test hence some tablets were discolouring,” he said. He said the occurrence was not extraordinary because in the last one year, ZAMRA had confirmed that it recalled 4000 different products from

different suppliers. “The good news is that the supplier honeybee has adhered to the rules and regulations of the regulator and replaced the entire consignment of paracetamol, “he said. This week, Honeybee Pharmacy replaced 19, 900 of 500mg tablets of paracetamol that it supplied to Government worth $700, 000, after it was awarded a $17 million contract to supply Health Centre medical kits to the Ministry of Health. According to a delivery note dated December 15, 2020, Honeybee Pharmacy delivered 19,900 of 500mg tablets of Panadol to Medical stores as replacement for the tablets BP 500mg batch numbers PPYP03 and PPYP-04 manufactured by Prashi Pahrma Pvt Limited of India. Speaking at a press briefing at Democracy House in Lusaka yesterday, Dr Mumba said he was arrested on December 10, 2020 and driven to Lubumbashi in the night where he was on December 11 interviewed for five hours on several allegations bordering on treason. Dr Mumba said he was placed under house arrest (I was placed under restriction) at a hotel. He said none of the allegations raised by the Congolese investigative wings contained any truth. “I was apprehended at a lodge in Kolwezi by a huge delegation of contingent of soldiers who surrounded the lodge and drove me through the night to Lubumbashi where I was placed under restriction in a hotel room,”Dr Mumba said. Dr Mumba said his response to the allegations were forwarded to Kinshasa. He said the allegations levelled against him were fed to DRC security by powerful people who planned that he

should be charged with treason in that Country. Dr Mumba said he went on a hunger strike to push for government intervention. He said his party is determined to ensure that people responsible for lying to the DRC government are tracked down. “It is clear that some powerful evil men and women lied to DRC security so that I can be arrested and charged with treason and probably sentenced to death but we are determined to ensure that these people are tracked down and this process has begun,” Dr Mumba said. The MMD leader said he could not give details of what he went through because he did not want to scare the nation. And Dr Mumba has thanked government for the strategic role it played in securing his release. Dr Mumba has also thanked two Presidents one from SADC region and the other one from east Africa and the International human rights bodies for securing his release.

OVERNMENT must deploy Zambia National Service and Zambia Army to tighten security at Kasenseli to stop illegal mining activities, the Small-Scale Miners Association of Zambia has said. Association president Kunda Chani said it was prudent that the security was beefed up at the gold mining area in order to completely eradicate the illegal activities. Mr Chani was concerned with the recent invasion of some villagers in the rich gold area, saying that such activities continued then the country would not benefit from the resource. He said in an interview

yesterday, gold had been identified as a strategic resource which can help revive the economy, therefore, there was need for stringent measures to protect it. Early this month over 500 illegal miners had broken into the perimeter wire fence at Kasenseli and forced their way into the mining area at Kasenseli gold mine in Mwinilunga looting undisclosed quantities of alluvial gold. The illegal miners were reported to have come from a camp in the nearby camp called Kabanda B Township in Mwinilunga district. District commissioner Arnot Mapulanga confirmed that the illegal miners found it easy to gain entry into the mine area by simply un-

screwing the joints in the wire fence. But Mr Chani suggested for this not to occur in the near future, there was need to tighten the security at the gold area. He said that ZNS and the army had proved their capability of enforcing security whenever they were directed to, therefore, it would be prudent that they were deployed in order to beef the security with police officers who were earlier deployed. “What is happening there is not good for the country. If illegal activities continue like that then there is nothing we shall benefit as a country. For me I think deploying ZNS and army because there is already police officers there it will mean that there will

Pragmatic approach a must WITHOUT delay, Zambia’s economic turbulence requires pragmatic approach to avoid falling into a deep national crisis. Currently, all macro-economic fundamentals have drifted into a negative status, signaling low production in critical sectors of the economy. Inflation rose to 17.4 per cent in November from 16 per cent in October this year while the exchange rate is hovering around K21.30 to a United States dollar. This year the economy is projected to contract, after a similar economic nose-dive in 1998, and certainly, this calls for practical interventions. It is for this reason that Government has crafted the Economic Recovery Programme (ERP), which builds on the Economic Stabilisation and Growth Programme (ESGP). As articulated in the document launched a few days ago, Government has laid out choices to be implemented over the next four years, providing a road map of strategic policy actions required to revive the economy. This is no small assignment though! The Government will need to engage the private sector and thrash out all encumbrances, particularly in the mining sectors, which is mainly driven by foreign entities. On one hand, Government and some other interest groups believe that mining firms need to give more in terms of taxes, considering that they are exploiting rich natural resources. Rightly so, copper is now fetching US$7,988 a tonne on the international market, an attractive price for mining firms to make reasonable profits. But on the other hand, the Zambia Chamber of Mines, an umbrella organisation of mining firms in the country, has been complaining about an unstable tax regime, which they insist results in double taxation. The chamber has proposed that Zambia should treat mineral royalty payments as a deductible expense in order to avoid double taxation and attract more investment. According to the chamber, the mining companies end up being taxed on income that has already been paid over as a royalty – a situation referred to as double taxation. Matters of this nature need to be resolved as the Government implements the recovery programme or else it will just be an academic exercise. Yes, the programme is anchored on restoring macroeconomic stability, attaining fiscal and debt sustainability and dismantling the backlog of domestic arrears. The Government is also aiming at restoring growth, diversifying the economy and safeguarding social protection programmes. But all the five strategic areas can only be explored effectively if all sticky issue are ironed out not only in the mining sector, but also in other critical industries such as tourism, which as too many payments for tourists compared to other countries such as Zimbabwe. Foreign tourists would rather tour the Victoria Falls from the Zimbabwean side while lodging in South Africa. This imbalance has been talked about years on end! Quite alright, Government invited input from Zambia Association of Manufacturers, Zambia Revenue Authority, Indaba Agricultural Policy Research Institute, Zambia Association of Manufacturers and the Zambia Chamber of Commerce and Industry. But the state must equally involve the same strategic partners in the implementation, monitoring and review of the economic recovery programme. The Zambia Chamber of Mines must be involved too! Many a time, the Government and captains of industry have differed over taxation and other policy matters because the private sector is not carried along in implementation and monitoring phases. Carrying them in all the phases will be helpful!

RUFUNSA gold mining cooperatives and ZCCM-IH have signed an agreement after a long disagreement on operational terms. In an interview, Chimwetu Gold Mining Cooperative chairman, Emmanuel Tembo disclosed that the four cooperatives finally agreed to the terms after a series of discussions with ZCCM-IH. The four cooperatives are Pokela, Chimwetu, Kamandu and Chipeketi. He expressed happiness at the development and hoped that this would help both parties to engage in business and

He disclosed that the signing ceremony took place yesterday at Jesper Lodge in Rufunsa and that ZCCM-IH was represented at the signing ceremony. THE African Continental Free Trade Area (ACFTA) agreement has huge potential to promote value addition in Zambia. It is posed to resolve the challenge of overlapping, increase market access, stimulate foreign investment and competitiveness. ACFTA could encourage diversification. NHIMA forks our K436,000 for Solwezi hospital facelift SOLWEZI General Hospital has received an advance payment of about K436,000 from the National Health Insurance Management Authority (NHIMA) to improve quality of care for the members. NHIMA Quality Assurance and Accreditation Director, Mpuma Kamanga said this is out of the approved sum of about K655 thousand. Dr Kamanga said in an interview in Solwezi that, this is part of the process to improve quality of care for its members accessing services from the health facility. He said the facility is expected to work on the outpatient department so as to fast track services for NHIMA members, renovate the specific wards identified for NHIMA members as well as buy equipment and drugs. “Solwezi general hospital as one of the 132 NHIMA accredited facilities has received

K436, 000 so far out of the approved K655,268.42. With this advance, we agreed that they work on the OPD so as to fast track services for our members, renovate specific wards, buy equipment and drugs as well as change the general outlook of the facility,” Dr Kamanga said. Dr Kamanga said the facility has also received K240,000 in claims for treating NHIMA members who seek treatment at the hospital. Meanwhile, Dr Kamanga said the institution has so far disbursed K40 million out of the budgeted K65 million advance payment to the 132 NHIMA accredited health facilities countrywide. And a check at the health facility revealed that works to renovate the outpatient department and the identified wards is underway while the painting of the outside structures is also on course. - ZANIS

Extension of reopening of schools welcome Dear editor, GOVERNMENT through the Ministry of General Education last Tuesday announced the extension of reopening date of schools from January 4, 2021 to January 18, 2021. The extension was announced by the Ministry of General Education Permanent Secretary, Dr. Jobbicks Kalumba. The decision of changing the reopening date of schools is a welcome move in that it will give parents time to raise money for school fees for their children. This year’s school calendar was affected by the outbreak of coronavirus which led to the premature closure of schools in March this year. We are in the festive season where people will be celebrating Christmas and New Year. Some people tend to be too extravagant to spend money on luxury things during the festive season.

They forget that schools will be reopening after the festivities. When schools reopen, there is an issue of paying school fees for the children. The Covid-19 pandemic has impacted negatively on people’s financial status. The Covid-19 led to a slump in business activities as entrepreneurs could not make enough money. On the other hand, some people lost employment and others were sent on forced and unpaid leave as a dire consequence. My humble appeal to pupils on holiday is that they should spend the holiday responsibly by desisting from vices such as alcohol abuse, drug abuse, illicit sex and crime, among others. These pupils should instead study during the holiday to catch up on some topics before the commencement of the first term. However, the pupils writing examinations should exhibit exemplary behaviour by not resorting to any form of violence. Just recently Ryan Phiri, a Grade 12 pupil of Kabulonga Boys Secondary School was beaten to death by some pupils from Twin Palm Secondary School. WHENEVER citizens of Zambia travel abroad, they carry the image of Zambia on their shoulders thus any scandal that their name is associated with is piled on the nation. The responsibility is even greater to former Government officials and opposition leaders who have a sizeable following in Zambia.

We find it extremely intolerant for a well enlightened individual like Dr. Mumba to risk the security of the nation by visiting a war tone country especially that he was implicated in threatening the existence of the Government of the sovereign state and leading to his detention. What of the allegations reported in some sections of the media regarding his “solicitation of campaign funds from one of the rival camps with the Government of the day?” We need his substantive reply to this important question. Moreover, we have always advocated for the enactment of the Political Party Bill into law as it seeks to compel disclosure of any apparent inappropriate affiliation with the foreign Governments. The Political Party Bill will guard the integrity of the electoral process and ensure that no political leader

undermine the sovereignty of another country, the very basic tenet upon which nations are built. We are glad the Zambian Government intervened to secure for his retrieval from the nation that was nearly asking for his head on a Plata. Luanshya Council pursues ‘runaway’ supplier By SANFROSSA MANYINDA A COPPERBELT-BASED supplier has failed to deliver a garbage truck to the Luanshya Municipal Council two years after receiving 75 percent up-front payment. As a result, Luanshya Municipal Council has called on Government to take action against the supplier for failing to deliver a garbage truck to the local authority. According to Luanshya Mayor, Nathan Chanda, the supplier failed to deliver the truck despite being paid 75 percent of the contract sum of over K 1.6 million. The truck was procured by the Provincial Administration in Ndola on behalf of the council. Mr Chanda has, appealed to Copperbelt Permanent Secretary, Bright Nundwe, to assist the local authority get the equipment. Meanwhile, sources have revealed that at the last sitting of the council, a resolution was passed to report the matter to the AntiCorruption Commission. CIVIC EDUCATION On today’s pupil’s forum in Civic Education, will look at a topic:Zambia’s Legal System. This topic will focus on Law, Elements of good legal system and sources of Zambian law. This topic is at grade eleven (11) level of the Zambian curriculum. At the end of this discussion, learners will be required to answer questions. Zambia’s Legal System The Law • The Law is a set of rules, which a society develops for itself to control the behaviour of its members to one another. • It also includes the meting out of punishment to members of society that do not abide by the rules and the awarding of compensation to people who have been wronged. • Without law, society as we know it would be impossible because freedom without boundaries results in anarchy, which means total confusion. From the time that human beings are born, their lives, safety, health and peace are controlled by law. Elements of a good legal system A good legal system is one that serves members of its society fairly without violating their rights. There are six core elements that should be present in a good legal system. A good legal system has to be: • Simple (Uncomplicated) A law has to be written in a language that can be easily understood by a large section of society. The form of language and the level of difficulty should suit the needs of the majority of citizens. • Comprehensive (Inclusive) It should not leave gaps but attempt to cover all possible areas of dispute, concern or debate. It should anticipate future problems and include them in the laws. It should not be constantly formulating new laws as wrongful acts take place. • Certain (Definite) Citizens ought to know clearly what is prohibited by law. A law should not be so ambiguous or vague that it is only fully understood and interpreted by a small number of people in society. It should therefore be documented so that it is possible to refer to it and that it should be clear to everyone who consults it.

b) Acts of Parliament • Acts of Parliament are laws made through bills passed by the National Assembly and assented by the President. • The process begins with the presentation of a bill in the National Assembly and passes through three Reading Stages before being sent to the President to either veto or withhold his or assent. • If he/she assents, the bill is gazetted and becomes law. • If the President does not sign, the bill is sent back to the National Assembly. • The National Assembly can either debate further or make changes or it can send back to the President in its original form. • When this happens, the President has 21 days in which to either assent or dissolve Parliament to pave way for fresh elections.

If citizens come into conflict with the law, they should be able to afford legal representation. Similarly, a wronged person should be able to readily access legal means of having their problem dealt with. If the legal system is not affordable, then it excludes a large number of people. • Flexible (Adaptable) Laws have to keep up with social change and therefore, they should change with time. If a type of dispute which was not there previously comes up, the law should change to take care of any new challenge. If it does not, then it is rejecting change. A good law should not reject change. • Moral Values (Ethical) The law should be based on the moral values of society. If laws do not reflect society’s core values, citizens are unlikely to respect and uphold it. Sources of Law in Zambia Sources of law are the starting point to refer to in order to find what the law says when one is faced with a legal problem. Zambia has a dual legal system and relies on the English Law and African Customary Law. i. English Law Sources • Common Law is one of the Laws that Zambia has adopted. Common Law is the Law that started from customs that were common to all parts of England. • England applied this Common Law to its colonies such as Zambia and after independence this became part of the sources of law of the Zambian legal system. ii. Legislation Legislation or statutes is the largest source of law in Zambia. These are laws enacted by parliament. All powers to make laws are vested in parliament. There are three types of laws made by legislation. a) The Constitution • The Constitution is the Supreme Law of the land. Article 1 Paragraph 3 of the 1996 Amended Zambian Constitution states out its supremacy. • It states, This Constitution is the Supreme Law of Zambia and if any other law is inconsistency of this law, that other law will be declared void. • This implies that if any law does not conform to the Constitution, then that law becomes invalid

• For example, if a case handled by the Supreme Court is recorded in the Law Reports, this decision is binding on the High Court and the Industrial Relations Court. The imaginary case below illustrates this point:

International Treaties • Zambia is signatory to a number of International Treaties. • The contents of these treaties are the sources of Law. • Note that in order for these International treaties to become Law they have to be domesticated through an Act of Parliament in order to officially become Zambian Statutes. Note: we have two types of legal systems in the world namely; Monist and Dualist. Dualist legal system which recognises International Law as law but does not apply directly on the country not until it is domesticated through an Act of Parliament while Monist Legal system considers International and domestic law as one.

ARARE - The mayor of Zimbabwe's capital Harare, Jacob Mafume, was denied bail on Thursday in a case that has triggered fresh accusations of harassment of the country's opposition. Mafume has been charged with defeating the course of justice. He was arrested on Monday for alleged witness tampering in another case involving abuse of office for which he was already out on bail. Mafume was ordered remanded in custody to January 28 by Harare Magistrate Ngoni Nduna. Mafume, elected in September, is a prominent

member of the Movement for Democratic Change (MDC), which accused the ruling ZANU-PF party of harassment. "The sabre-rattling ZANU-PF regime is arresting our councillors in order to cow them into submission," it said on Monday. Mafume had been arrested on November 25 on allegations of having allocated residential land to his sister and a colleague. It was while he was on bail on this charge, according to prosecutors, that he tried to interfere with a witness, Edgar Dzehonye, a municipal housing manager. Mafume said he had been arrested in a setup, as he had

never had any contact with Dzehonye. But prosecutors said Mafume had been communicating with Dzehonye and planned to bribe him with the equivalent of $1,500. Nduna said the state's evidence was convincing. "There were existing bail conditions for him including not to interfere with witnesses," Nduna said. "It is therefore clear that this cannot be cured by any other condition but imprisonment is the only remedy and the accused is therefore accordingly denied bail." ZANACO Futsal Club coach Wilson Katenge is confident his side will win promotion to the Premier Futsal League (PFL). Katenge said the “Young Bankers” who dominate the PFL division one league with 34-points have had an impressive run in the first round where they have been unbeaten. Katenge said ZANACO, who also compete in the Football Association of Zambia (FAZ) provincial league will win promotion despite facing stiff competition from Pioneer Avengers, DS Academy, Lilanda Bullets and BS Stars who are all in the top five bracket on the log. Katenge said after going unbeaten in the first 12 league games, the team’s target is to win promotion to the top flight futsal league to compete with elite clubs. “It was our first time to play futsal but the boys have gelled very fast and the first round has been okay though there is a lot of competition and it is helping us with our fitness levels. “When we started we just thought of competing because it was our first time but as we are progressing we have realised we can win promotion and play in the Super Division,” Katenge

said. He said ZANACO has managed to be competitive in both the PFL Division one league and the FAZ provincial league because of the availability of a lot of talented players at Young Zanaco FC. ZANACO enjoyed a 6-0 walk over win over DS Academy over the weekend to move to 34 points, three points ahead of Pioneer Avengers who defeated Veterans in their last league match.
