A WITNESS has testified that Ultimate Insurance Company Limited paid Nchito and Nchito Advocates US$63,985.99 (over K1.2 million) for undisclosed legal fees. The witness Mibanga Mwiinga said yesterday that there was no invoice that was submitted to ABSA Bank Zambia Plc and that she could not tell the type of legal fees for which Ultimate Insurance paid the law firm.

And Home Affairs minister Stephen Kampyongo says it is not true that Larry Mweetwa was deported from Zambia because he never signed his deportation order. Mr Mweetwa, who is a British national of Zambian origin, lives in Botswana and was attempting to enter Zambia when officers flagged his passport. He however, managed to enter because the passport had already been stamped.

IF it is not the lawyers, then it will be the politicians who will run this country into crisis. It has now become a practice that normal, ordinary and self-evident situations are twisted into contorted and grotesque absurdities, that defy any form of logic. Polarisation and emotionally charged disputes have become the norm rather than the exception. So bad is the situation that even the interpretation of ordinary constitutional language is perverted to convey, a divination intended to reinforce an imaginary order of things which the ordinary Zambian is not expected to understand because of convoluted but meaningless delivery. For example, the country has been gripped by two topics, eligibility of the President and repayment of emoluments for the “illegal” occupation of offices by ministers. UPND president Hakainde Hichilema has gone further to suggest a surcharge once he assumes office after the 2021 elections. For once, we would have expected Mr Hichilema to support his nemesis President Edgar Lungu over the constitutional powers of the President. He should know that ministers take an oath of allegiance. They swear to be loyal in their execution of duty as assigned by the President to whom they are answerable and through him to the people. It follows therefore that ministers must follow instructions given by the President. In turn the Presidency is a creation of statute, realised of course through periodic elections. The office has wide discretionary powers protected by immunity, in the realisation that misadventures are inevitable. The office holder need not be overly circumscribed in the execution of the office. Even Mr. Chishimba Kambili understood this principle, but in deference to a court ruling obliged to pay. He understood that the President had executive power to act in the manner he did. Now UPND Lusaka Province chairperson Obvious Mwaliteta has joined the fray stating that the party will petition the nomination of President Lungu for disregarding the August 8, 2016 ConCourt order for 63 former and current ministers to pay back the salaries and allowances they illegally accrued when they remained in office after Parliament was dissolved. It is not clear where the petition will be directed. Our biggest problem as a country is the failure by our politicians and our more politically charged lawyers to appreciate the difference between liberty and licence. There is a very big difference between the two. Liberty connotes a moral value demanding an adherence to morality, as in truth and objectivity whereas licence is the abuse of freedom. Liberty is enlightening whereas licence is oppressive and objectionable often characterised by crude language. Our lawyers in and out of courts are using “divination” than applying the letter and spirit of the constitution to determine issues that are self-evident. Add to this the patent abuse of freedom of expression which is in reality character assassination; the result is a potent and charged atmosphere based on misinformation and half-truths. Our lawyers are making no effort to correct the situation. As a result our discourse is replete with licence, measured by the tenor and tone of dialogue. A culture of excessive freedom has dulled senses to extremes of abuse, which preys on gullible minds that lack the ability to distinguish between the two. This cacophony of negativity is not particularly helped by conflicting judicial decisions which defy the constitution.

Mr Malanji said Government will not waste time to investigate Dr Mumba, who was detained for some days on alleged treason cases in DRC . Mr Malanji said in an interview yesterday that Government did its part in ensuring that Dr Mumba was released but will not start investigating what led to his arrest. The Minister indicated that it was prudent for Government not to indulge in what Dr Mumba was detained for in that country. “We cannot reach that level to investigate what happened in DRC, we do not want to start

UPND chairperson for mines, Percy Chanda, said Zambia had no capacity whatsoever and that this was evident in the country’s failure to pay off its debt. CHIEF justice Irene Mambilima has described the late Constitutional Court judge Enoch Mulembe an unpretentious, hard-working and meticulous judge who stood for justice and human rights. Ms Justice Mambilima said Justice Mulembe dedicated 27 years of his life fighting for human rights. Justice Mulembe 52, died last Thursday at the University Teaching Hospital (UTH) after an illness. She was speaking during the special valedictory session for the late Mr justice Mulembe held at the Supreme Court in Lusaka yesterday. Ms Justice Mambilima said that the sudden death of the judge which came barely a month after celebrating his 52nd birthday, was received by all on the bench with a deep sense of shock. “That the late honourable Mr justice Mulembe came to the bench only four years ago, 11th March 2016, having been appointed judge of the Constitutional Court of Zambia. “For us who worked closely with him, we remember him as an unassuming yet unpretentious, hardworking and meticulous judge who stood for justice and human rights,” she said. She said he would be remembered for his knowledge and uncompromising views on human rights, constitution and international law, which were reflected in his judgements. Attorney General, Likando Kalaluka, said judge Mulembe was an exemplary champion of human

Law Association of Zambia (LAZ) president Abyudi Shonga said the legal fraternity was struggling to accept the harsh reality of the judge’s death. He said judge Mulembe who was admitted to the bar in 1993, was exceptional in both his educational and professional career. Mr Shonga said the judge was in good standing with LAZ and that his legal mind would be immortalised in the rulings rendered by the Constitutional Court. His former classmate at the University of Zambia School of law, Judge Gregory Cornhill said that the judge would be missed because he had the ability to relate with everyone around him well. Justice Mulembe was born on November 20, 1968. He graduated from UNZA in 1992 with a Bachelor of Laws Degree with a merit before and was admitted to the Zambian bar on December 30, 1993. In 1996, he obtained a Masters Degree in International Law from the Raoul Wallenberg Institute for Human Rights and Humanitarian Law, University of Lund, Sweden. He also held a Postgraduate Advanced Diploma in International Protection of Human Rights from the Institute for Human Rights, Abo Akademi University, Turku, Finland (2000) and a Certificate in University Teaching and Research in Human Rights from the International Institute of Human Rights/International Centre for University Human Rights Teaching, Strasbourg, France, (1999). Prior to his appointment as Constitutional Court Judge on March 11, 2016, was served as chief executive officer at the Zambia Institute of Advanced Legal Education. Justice Mulembe was a member of the Legal and Justice Sector Reforms Commission, the Commonwealth Magistrates’ and Judges’ association.

M’membe denounces tribal voting By SILUMESI MALUMO
SOCIALIST Party president Fred M’membe has denounced tribal voting ahead of 2021 general elections. Dr M’membe said there was no need for Zambians to promote tribal vote because this was not good for the country. He said that there was need for Zambians to vote for someone in office based on merit. Dr M’membe said what happened in the 2016 general elections which even prompted President Edgar Lungu to institute a commission of inquiry on voting pattern should not repeat itself in 2021. He said all Zambians were one, therefore, they should not vote based on tribal lines. Dr M’membe said citizens should champion oneness and vote based on the credibility of the person to govern the country. “As Zambians we come from one place which is Congo. In 1600 BC and 1700 BC all people came to settle in Zambia are from Congo and our generation today we all come from Congo so we are one people,” he said. He said it was high time Zambians rejected people who championed tribal voting which did not benefit anyone. “This issue of voting on tribal line should not exist in this country because we need to embrace each other. Let someone who should be in office be voted by majority Zambians not based by tribal lines. “We do not need to repeat what happened in 2016. This should be a thing of the past,” Dr M’membe said.

Social media has been awash with reports that Larry Mweetwa, a Zambian national living in the UK was on Friday ordered to leave within 48 Hours by the Immigration Department in unexplained circumstances. to the country’s interest. The reports indicated that Mr Mweetwa, an outspoken member of the UPND was in Zambia for his Christmas holiday and to help mobilise people to register as voters in Mbabala Constituency where he intends to contest as Member of Parliament before he was deported. Mr Mweetwa announced his deportation on his Facebook page and described the experience as sad. “It’s with a sad heart I share my ordeal. I went to Zambia to spend Christmas and also assist in mobilising voters in Mbabala constituency. When I reached the border I paid visa fees $50 and toll gate fees $50 and the immigration cleared me and stamped my passport and gave me 30 days to stay in the country because I was using a dual nationality passport,” he explained.
Zambia’s debt to fuel suppliers balloons to $727m
By SILUMESI MALUMO LANDS and Natural Resources Minister, Jean Kapata, has joined other former ministers who have paid back salaries and allowances for staying in office after Parliament was dissolved in 2016. Ms Kapata confirmed yesterday that she had paid back the money as ordered by the Constitutional Court. She said that it was her duty to honour the Constitutional Court ruling, which had directed that all the 64 ministers must pay back. “We just have to pay back the money, and I can confirm that I have paid back. It is our obligation to respect the ruling of the Constitutional Court. We have to be law abiding citizens. Ms Kapata has paid back about K58, 679.16 Last week, Tourism and Arts Minister Ronald Chitotela and Democratic Party president Harry Kalaba paid back the money for illegally staying in office and getting salaries after parliament was dissolved in 2016. Mr Chitotela had paid back the sum of K50, 811 while Mr Kalaba, who served as Foreign Affairs Minister at the time, paid back K60, 434.88. Meanwhile, Attorney General Likando Kalaluka said a number of former ministers had shown willingness to pay back the salaries they withdrawal after dissolution of Parliament. Mr Kalaluka said in a separate interview yesterday all the former ministers had been given bank details where they were supposed to deposit the money. He said that some of the ex-ministers had already deposited the money without giving information to the public. “Yes a number of them have paid back the money, what is happening is that others are paying back quietly without publishing on social media,” Mr Kalaluka said.

‘Let HH face the law’ By SIMON MUNTEMBA UPND supporters should let Hakainde Hichilema face the law because he is not a sacred cow or above the law to be considered untouchable, says Economic and Equity Party (EEP) president Chilufya Tayali. Mr Tayali yesterday accused Mr Hichilema of growing cold feet at the prospect of appearing before the police following a call out against him. Meanwhile, Inspector General of Police, Kakoma Kanganja has directed the police to keep an eye on the UPND which is planning to stage an unlawful procession ahead of Mr Hichilema’s appearance for questioning. And Mr Tayali who called Mr Hichilema the master guide in reference to him being inducted as the master guide by his church recently, said the law would soon catch up with him. “He may delay it but the point is that HH will eventually have to appear before the police and ACC because the cases against him are overwhelming, otherwise I will take them straight before the magistrates. No one is above the law,” he said. On Friday last week, UPND Copperbelt Province chairperson, Elisha Mutambo threatened to send thousands of members to accompany Mr Hichilema for questioning at service headquarters. The follows a police summon to Mr Hichilema to appear at the Force headquarters for
questioning. Mr Tayali told the Daily Nation yesterday that just like any other Zambian, the UPND leader was not above the law. He said it was absurd for the UPND to threaten that they would organise and send thousands of members from all the provinces to accompany Mr Hichilema on the day he would be appearing before the police in Lusaka. Meanwhile, Mr Kanganja has directed all Commissioners of Police across the country to deploy police officers in strategic areas to monitor activities of UPND members and ensure their planned unlawful procession was thwarted. This is contained in a statement issued by police spokesperson Esther Katongo. “The Inspector General of Police, Mr Kakoma Kanganja has directed all Police Commissioners to deploy police officers to monitor activities of members of the opposition UPND,” Ms Katongo said. Mr Kanganja has also directed all police officers to decisively deal with all those that would want to cause public disorder during the period. According to UPND spokesperson, Charles Kakoma, Mr Hichilema was now scheduled to appear before the Police tomorrow. Mr Kakoma said in a statement that Police have informed Mr Hichlema's lawyers that he would be required at Police Force Headquarters at 10.00 hours.

By PETER SICHALI GOVERNMENT owes fuel suppliers US$727.3 million which has accumulated since 2016, the 2020 economic recovery plan has revealed. According to the plan, the debt has accumulated as a result of the price differential between the purchase price and the landed cost of petroleum products. The plan however states that Government will standardise contracts for procurement of fuel to ensure that prices of fuel are cost reflective. According to the plan, which was unveiled last week, Government’s policy was to ensure that fuel pricing was cost reflective. Arrears, the documents states, had arisen in the
recent past which was not consistent with the fuel policy stance. The plan states the debt is further exacerbated by the exchange rate losses due to the depreciation of the Kwacha to the United States Dollar. "In order to prevent the exposure of the fuel suppliers from growing, Government will implement the following during the programme period, direct sales of outstanding contract import balance to Oil Marketing Companies (OMC)," the plan said. It also states that Government will negotiate with the current suppliers to facilitate direct sales to OMCs. "Standardisation of suppliers’ contract prices, as a stop gap measure to address the growing exposure and losses,
standardisation of the contract prices of suppliers will be done with a view of ensuring that the landing cost falls below the ERB Wholesale price,” the plan indicates. It says for Government to restore self-refinancing mechanism of the open account system, there should be adherence to price reviews every 60 days. The plan says price adjustments should be effected every time the 2.5 percent trigger band in the Cost-Plus Model (CPM) is exceeded to ensure cost reflective pricing and positive yields in the sale of petroleum products. "With cost reflective pricing in place, there will be no losses and Government will be able to liquidate the exposure over time without allowing it to grow,” it states.

Anyone wanting to challenge President Lungu's eligibility would be committing contempt of court because there was a judgement in place regarding the matter, Mr. Zimba said in an interview. Mr Zimba of Makebi Zulu and Associates, said challenging the Constitutional Court’s ruling on President Lungu's eligibility was a crime because the action was
aimed at undermining the court. He said what the UPND Lusaka Province chairperson was planning to do was politics which could not be sustained at law. "The law is very clear, there is judgement as regards his eligibility, it will not go anywhere, it is politicking,” he said. Mr Zimba challenged Mr Mwaliteta to go ahead with his plans because sometimes it was important for people to see the actual thing happening. He said: "We’ll only pray that God gives us enough time to live long for us to come and see that it will not go anywhere."
HH challenged to condemn violent attacks on PF cadres

HAKAINDE Hichilema should condemn acts of violence and attempted murder of innocent Zambians by his cadres in Monze, the Patriotic Front has demanded. PF media director, Sunday Chanda said the levels of intolerance and lack of co-existence exhibited towards PF members and other citizens by UPND cadres in some parts of the country for simply wearing PF regalia was saddening. Mr Chanda said in a statement that the acts have gone unpunished, without condemnation
and were being ignored by the UPND and including its leader, Mr Hichilema. “As such, we are left with no choice but to conclude that these acts have his blessing. He has tolerated violence among his cadres on occasions too numerous to mention,” he said. Mr Chanda said the recent attacks on two PF members in Monze were but one of the numerous incidences of violence perpetrated by UPND cadres. On Saturday 19th December 2020, two brothers were almost killed for wearing PF regalia by UPND cadres around 01:00 hours at a named nightclub in Monze.

"Zambians we are very good at policy formulation but poor at implementation not because of political leadership but because of administration which is the civil service," Dr Kalumba said. Dr Kalumba said there was need to modernise the civil service to make it more professional and effective. "We are good at policy formulation but the major hindrance has been the civil
service which I feel should be modernized and computerised to address bureaucracy in the civil service,” he said. Dr Kalumba said the civil service should migrate from folio system to computerise systems to enhance efficiency. "Our civil service has been pinned down to folio administration in the computer system we are still using this outdated system and this affects decision making," he said.

Foreign banks sabotaging economy? By PETER SICHALI FOREIGN Banks should be subjected to forensic audit so that they do not sabotage the economy, UPP president Saviour Chishimba has said. Dr Chishimba said foreign banks especially South African institutions were advancing the interest of the firms from their country at the expense of local companies. He said South African firms were getting loans at low rates in that country thereby disadvantaging Zambian companies who acquire loans from the same banks at higher rates. Dr Chishimba suggested that the Bank of Zambia (BoZ) should subject foreign banks to forensic audit and ensure that they retain foreign exchange in Zambia, as it was critical to economic recovery. According to him, most foreign banks were promoting the interest of foreign companies at the expense of local firms and this was tantamount to sabotage. He said some foreign firms borrowed from South Africa at low interest rates and were allowed to service the loans from Zambia thereby disadvantaging local players. “You will find that some South African company borrows money in South Africa at lower interest rates and then they are later allowed to service their loans here meaning that the playing field is not leveled. “These banks are promoting the interest of foreign companies at the expense of local firms, thereby destabilising the economy,” Dr Chishimba said. He said growth of local firms had been a challenge because foreign banks were more concerned with the growth of foreign companies at the expense of the local economy. CHAMA has no fertilizer in agro shops, making it difficult for farmers who are not on Farmer Input Support Programme (FISP) and Food security Pack to access farming inputs. Chama North sspiring Member of Parliament (MP), Yotam Mtayachalo, said there was no single agro dealer selling fertilisers in in district as only those on the E-voucher facility and some vulnerable groups under the social welfare were able to access the commodity. Mr Mtayachalo said the non-availability of fertilisers in agro shops would undermine food security in the district. “I would like to take this opportunity to appeal to the private sector to be specific the agro-dealers to consider stocking the commodity so
that farmers who are not beneficiaries of FISP can also be able to access the commodity at a reasonable price,’’Mr Mtayachalo said. He said the district has only 7,145 small scale farmers who access farming inputs under FISP against the farmer population of 26,000. Mr Mtayachalo said Government should review the implementation of FISP so that only intended beneficiaries access the facility because many vulnerable households in rural areas were not benefiting from the facility. Mr Mtayachalo said Government should also consider increasing the countrywide beneficiaries of FISP beneficiaries from one million to a higher figure in the 2022 national budget so that many vulnerable households could be captured.
Clergy demands orderliness during festive period
FILTH has again choked Lusaka Central Business District (CBD) following a return of street vendors with some opting to erect stands and mobile money booths on walk ways. The development has caused accumulation of filth and more disruption to pedestrians as streets have now been turned into dumpsites. The Lusaka City Council (LCC) has however warned of stern action against anyone found dumping garbage in undesignated places and erecting illegal stands along the walk ways. A check by the Daily Nation found garbage heaps along Lumumba Road near City Market with a lot of litter in most roads. LCC public relations manager, George Sichimba, said although vendors were allowed to trade in some roads in the city, they were not supposed to put up any stands along the walk ways. Mr Sichimba said some vendors were dumping garbage in the drain at city market and such has since contributed to the drain being blocked. He said despite the LCC provided skip bins, some people have continued dumping garbage anyhow now making the city filthier. He said, LCC would not allow anyone abrogating the law with impunity, but would
ensure that residents were guided by the laws of the land. “Vendors should first of all note that vending along the roads such as Lumumba road is risky and also pedestrians will be having challenges in crossing to the other side of the road because of the stands that they have started putting up,” Mr Sichimba. In an interview with the Daily Nation, Martin Changwe, who is among the people erecting metal shops, claimed that Lusaka had run out of trading place, therefore opted to put up the shops along the walk
ways. Mr Changwe said, although it was illegal putting up the stands, he had no choice because that was the only way place that was amicable for trading. Another vendor, Stephen Phiri, said all the places in the city had been taken up, therefore it was difficult for him to find a place to trade from. “All the places in the CBD have been take away and it’s very difficult to find a place, therefore we have decide put up the stands along this same way.

THE United Church of Zambia (UCZ) in Northern Province has called on the Road Transport and Safety Agency (RTSA) and Zambia Police to collaborate and intensify road patrols in a bid to prevent road accidents during the festive seasons. UCZ Northern Presbytery Bishop, Maybin Mulenga, said the government agencies should draw up a programme to jointly implement accident preventive measures during the festive period. The clergyman charged, that in most cases, people get excited during festive season, as some motorists drive carelessly and speeding after taking alcohol. Bishop Mulenga said it was, therefore, important for the two law enforcement agencies to intensify road patrols in order to preserve the lives of both motorists and pedestrians. The clergyman, who was speaking in an interview, advised motorists not to be reckless on road, during this festive season, but take extra care. He said Christmas was a period to commemorate the birth of Jesus Christ and that it was no time to drive alcohol recklessly as that was not Biblical. He said citizens must instead be exemplary in the behaviour and emulate Jesus Christ, who demonstrated humility and kindness to humanity. GOVERNMENT should set up a special relief fund for small-Scale miners to keep their businesses afloat and rebound during the Covid-19 period. This is according to the Federation of Small-Scale Mining Association president, Joseph Mwansa. Pastor Mwansa requested Government to financially assist the small scale mining industry so as to keep the sector activity afloat and rebound during the covid-19 period. "Specifically, we would like

Pastor Mwansa said on average, one mine had at least 20 workers and each worker had about five to seven dependants. He stressed that the small scale miners positively contributed to the economical sustainability of Zambia through the provision of employment, foreign exchange earnings and income for the treasury. "Therefore, this subsector requires the support of the government of Zambia amidst the negative impact of the covid19 whose effects have been devastating leading to
crippling and in worse cases closure of business entities more so the small and medium scale enterprises," Pastor Mwansa said. He indicated that the small scale miners and associated industries had been greatly impacted with the outbreak of the global pandemic of the novel Covid19. He cited that the members had not been able to market their products globally because of restrictions in travel and meetings as part of the covid-19 measures. "In as much as we appreciate the government's strides and efforts in economic recovery, we are shocked and dismayed that the Government has not assisted the small scale mining industry with financial and material aid as a way and means of mitigating against the period of covid19 despite repeated formal appeals by our Federation," he said.

sector for a sustainable future. This is according to the Zambia Institute of Chartered Accountants (ZiCA) president, Cecilia Zimba. Ms Zimba said the reforms should not just be aimed at achieving financial efficiency of utilities, but target outcomes such as affordable tariffs, increased access to electricity and improved quality of service. For these reforms to have a satisfactory outcome, she
said, they should focus on the long-term sustainability of the industry, strong competition in the industry and need for effective and independent regulator. She said at a press briefing in Lusaka yesterday that reforms should also focus on policy stability, availability of skills, guaranteed property rights and predictable and stable tax laws. Ms Zimba therefore demanded an update on the Cost of Service Study from
Government. Meanwhile, Ms Zimba said the irregularities identified in the Covid-19 report of the Auditor General needed to be fully investigated by Government to their full conclusion. She stressed that relevant sanctions on any erring officers must be swiftly imposed to ensure that impunity did not take root especially during such a difficult period as is the ongoing Covid-19 pandemic era.
GOVERNMENT will aggressively implement the Economic Recovery Programme (ERP) in an effort to restore economic recovery which has adversely been hit by Covid-19, says National Development Planning Minister, Alexander Chiteme. President Edgar Lungu last week unveiled a threeyear ERP which proposes measures to stimulate the economy beyond Covid-19. In response, Mr Chiteme stressed that Government would have an aggressive way of implementing and restoring economic stability, growth and manage the macroeconomics. Mr Chiteme said during the ZNBC Sunday Interview that his ministry would monitor and making sure that Government carried through with the implementation of the plan. The ERP is the successor to the Economic Stabilization and Growth Programme (ESGP) that was implemented over the period 20172019. “We are going to have an aggressive way of how we are going to make sure that this plan is implemented. We are going to make sure that we do what we are supposed to do. That is what this plan is about, it has a timeline. “This Government is going to be aggressive about this plan, this Government is so sure that if we do a proper implementation, it will be a success. It will be a success for the country as a whole,” he said. Mr Chiteme indicated expressed optimism that the ERP would achieve its strategic objections once implemented. RBZ to crack whip on auction abusers HARARE – The Reserve Bank of Zimbabwe (RBZ) says it will request the Financial Intelligence Unit (FIU) to close bank accounts of business entities that are pricing using exchange rates not linked to the ruling auction rate. The central bank said it was aware of errant businesses in the habit of using exchange rates far removed from the ruling exchange rate despite obtaining US dollars from the auction system. RBZ Governor Dr John Mangudya, addressing a Zimbabwe Chamber of Commerce (ZNCC) conference also said the bank FIU will take action against businesses that are practising transfer pricing. This comes amid fears that the delinquency by some businesses will lead to a raft of price increases that could send inflation, which appear to have stabilised, on a rampage once again. Annual inflation dropped to 401 percent in November from 473 percent the prior month, the Zimbabwe Statistics Agency (Zimstat) said, while monthly inflation is now trending below five percent. The central bank says the economy appears to be on a strong footing for recovery and growth, adding this assertion was backed by solid export performance numbers and
forex inflow figures. Dr Mangudya said in terms of the law, market players should price their products in line with the ruling exchange rate, but businesses are not complying and profiteering through exchange gains. Since the introduction of the auction on June 23, 2020, approved businesses have been buying foreign currency on the RBZ auction at the ruling weekly rate, now perched circa US$1/$81.7. But upon receiving the money, several unscrupulous business entities charge prices using rates that reflect margins between $15 and $30 over the prevailing official market exchange rate. Others, the Governor said, seek quotations in foreign countries for approved imports and manufacture invoices that reflect grossly inflated prices in order to get more US dollars from the auction. Dr Mangudya said the monetary authorities were watching and had all along been using moral suasion for compliance, but may soon request the FIU to close bank accounts of culprits.“We were trying to use moral suasion all along, and as we traverse the journey towards 2021, we now want compliance. In April, only 3, 101 foreigners landed at the Jomo Kenyatta International Airport - a 97 percent decline from last year. Between January and April, there were 392, 691 arrivals - almost half the 619, 698 tourists recorded in the same period last year. Kenya, which relies on tourism for 10 percent of the country’s GDP and nine percent of the total employment, was in trouble. What is more, the leading foreign exchange earner that generated Sh163.6 billion in earnings in 2019 was gone as a result of the coronavirus pandemic, exposing the country to twin problems on debt - the cost of existing debt and sustainability. Without dollar inflows, the shilling weakened, increasing Kenya’s dollar debt by Sh305.6 billion over the year as the Kenyan currency hit a new low of Sh111.3 against the greenback. With GDP shrinking into near-recession, the Sh7 trillion debt hit 69.2 per cent of the economy in August. “The shilling depreciation will definitely mean that we need more money to pay our debts,” said Renaldo D’Souza, the head of research at Sterling Capital. As the debt became bigger and the economy shrunk, Kenya was suddenly thrown into the group
of countries that faced difficulty in repaying debt. Ecuador and Rwanda have struggled to repay their debts while Zambia has officially defaulted alongside Lebanon, while Argentina is heading for its ninth sovereign default since independence in 1816. While the pandemic was the straw that broke the camel’s back, Kenya’s debt crisis has been cooking since the Jubilee administration took charge. When President Daniel Moi left office, Kenya’s public debt stood at Sh629 million and 60 percent of GDP. President Mwai Kibaki left a decade later with a debt of Sh1.79 trillion, but with an expanded economy to support it, putting debt at 41 percent of GDP. President Kenyatta’s Jubilee administration is set to have borrowed at least Sh6.1 trillion to implement his manifesto in 10 years in power, having inherited slightly more than Sh1.79 trillion in June 2013. In 2019, Parliament tried to stop the count, setting a Sh9 trillion debt ceiling, but since Kenya is in a deep hole, it can only dig itself deeper into the pit, and the ceiling is about to be breached. “As at August 2020, the stock of public debt stood at Sh7.06 trillion. This, together with committed undisbursed debt of Sh1.35 billion, translates to a stock of public debt of Sh8.41 trillion against a ceiling of Sh9 trillion, which implies limited space for additional borrowing,” Finance Cabinet Secretary Ukur Yatani said of the post Covid-19

Yatani said Kenya could simply not meet debt payments since we need half of all our revenues to service repayments while paying salaries, meeting county disbursement, pensions and building hospitals and schools. Due credit has to be given to the new Treasury team that inherited an almost impossible job. They have been daring and ambitious. Since 2019, when Treasury Cabinet Secretary Henry Rotich was sacked and the first director-general of the Public Debt Management Office at the Treasury, Haron Sirima, was appointed, Kenya has not borrowed from bankers or gone for the Eurobond. Treasury said it would seek to push wealthy countries and multilateral lenders such as the World Bank to cancel part of its ballooning public debt. It will also consider taking a Sh75 billion debt repayment break from G20 countries, which will reduce debt servicing costs. In addition, Kenya made its first conversion of a Treasury Bill into a long-term treasury bond, a strategy called a switch bond, which has helped the government delay the repayment of Sh25 billion. Meanwhile, the team is toying with the idea of having pension funds freeze interest payments for two years and save the state up to Sh60 billion a year, according to the Actuarial Society of Kenya, since 40 percent of the Sh1.3 trillion pension assets are invested in the government. - DAILY NATION KENYA.

Anti-immigrant groups have staged demonstrations in recent months in Johannesburg, the biggest city, and in Pretoria, the capital, demanding the mass deportation of foreigners. The provincial government of Gauteng, the nation's economic hub, wants to pass a law next year to limit ownership of businesses in low-income areas, known as townships, to South African citizens and foreigners who are fully legalised. That threatens to upend an industry of convenience stores numbering over 100 000 nationwide with annual revenue of R100 billion, according to GG Alcock, a consultant on township marketing and an author of books on
the informal economy. "Every foreign national that came to our country since 1994 must be deported," said Victoria Mamogobo, the 34-year-old chairwoman of the South Africa First party, as she demonstrated on November 27 with a group waving national flags and banners in downtown Johannesburg. "You've got people all the way from Nigeria who are here to sell tomatoes on our streets. How is that helping us grow our economy?" Since the apartheid system of racial discrimination ended in 1994, Africa's most developed economy has been a
magnet for migrants from the continent and as far afield as Bangladesh. That's sparked bouts of violence every few years, with mobs attacking and looting shops and killing foreigners – the most extreme instance in 2008 left 60 people dead and another 50 000 displaced. Today, social media helps whip up the hatred. A barrage of criticism following clashes between locals and immigrants in 2019 prompted President Cyril Ramaphosa to dispatch envoys to other African countries to calm tensions. Many of the migrants are
refugees, legally in the country and allowed to work. Some are economic migrants – many undocumented – and others, including hundreds of thousands of Zimbabweans, have been given work permits. While it's unclear how many migrants are in South Africa, estimates of the number of Zimbabweans alone exceed two million. Still, with South Africa's economy set to contract by the most in nine decades this year, unemployment at 31 percent and local elections scheduled for 2021, some politicians have found blaming foreigners for everything from joblessness to poor public services is a vote winner. Finance Minister Tito Mboweni in April said locals should be prioritised in post-pandemic recovery efforts. gas project as asset offloading continues JOHANNESBURG - Sasol has entered into a $145 million sale agreement of its shareholding in a gas-to-power plant in Mozambique, as the company continues its assets offloading drive in an attempt to boost its financial position. The company announced on Monday that the divestment in Central Termica de Ressano Garcia (CTRG), which is located on the border between South Africa and Mozambique is subject to regulatory approvals. Sasol owns a 49 percent stake in the project, and Electricidade de Mocambique (EDM), the country's state-owned electricity company holds 51 percent. It plans to sell its stake to Azura Power, one of the prominent Independent Power Plants operator in the continent.
The transaction is part of Sasol's "ongoing, strategy aligned, asset divestment programme" - and the company stated that it remains fully committed to upstream operations in Mozambique, which continue to be integral to its plans. The project was inaugurated in August 2014, and has a 175 MW capacity. Sasol has been on a asset selling spree since the beginning of the year, as it attempt to plug its debt hole and a shore up its balance sheet. In November, a 50 percent interest in its US-based Gemini high-density polyethylene joint venture was sold to its partner INEOS for $404 million. HAVE observed with a heavy heart how our politics have been polluted for personal expedience. It is for this reason that many think politics is actually a dirty game when not. It is some people who get into politics for personal endeavours and not to save the many marginalised citizens of our great nation Zambia who make our politics look and sound dirty. Politics is meant to have people who are leaders of the majority by being a mouthpiece for many. Yet what we get on a daily basis are accusations, insults and mudslinging that are not anywhere near leadership norms. One then wonders whether we really have real politicians like those of yesteryear. Where are politicians of the likes of late Harry Mwaanga Nkumbula,
Humphrey Mulemba, Nalumino Mundia, Baldwin Nkumbula, Ronald Penza, Dean Mung'omba and Paul Tembo to mention but a few on our political scenes? It is like we are now engulfed with politicians so primitive that what they know best is getting into political battles for political offices using whichever means, and not being relevant to political discourse of being people's representatives. It is for this reason that many people have even lost interest in elections resulting in electoral apathy. We as a nation need mature politics where even those in Government can offer checks and balances when the government is not performing according to people's expectations without being misunderstood and disciplined, and not only opposition political party leaders. LTHOUGH the UPND has been masquerading as the political grouping of saints, there are a number of instances when they have been found wanting. What is surprising is that the lips of officials are deliberately tied in the clear sight of impunity. The police summoned the UPND president Mr Hakainde Hichilema to appear before them over charges which were not disclosed. Even with ignorance about the purpose of inquiry, the UPND have the audacity to discredit the legitimate criminal inquiry. As a group masquerading to be law abiding, they do not see anything wrong by undermining police authority with the premeditated arrogance by the UPND and their supporters who apparently are undermining the criminal justice system. The political cadres are clearly undermining and interfering with the works of the police and we have every reason to be concerned whether UPND can tame cadres when they have the
instruments of power. We are glad the police have shown commitment to deal with anyone who will undermine the pending questioning of Mr Hichilema. With or without the UPND sympathisers, whenever there is reasonable and probable cause to believe that there was any offence which was committed, Mr Hichilema must be questioned and if there is any basis, he must be arrested and prosecuted like any other citizen (s). If the courts will find the charges not justified, he will
walk to freedom and if they will be proved he will be convicted and possibly sent to prison like any other citizens who have been found wanting. We wish to remind Mr Hichilema’s supporters that at some point two ministers were summoned and they obediently appeared before law enforcement agencies for the charges which we believe were malicious. We are also confident that contrary to what is being asserted in other platforms, there is no breakdown which could be caused for merely
commencing prosecuting an individual. The security wings have sufficient resources and capacity to detect any possible source of agitation and we have no doubt the threats from the UPND side are mere rhetoric. Let Mr Hichilema respect the law enforcement agencies as well as his political players and he should bear in mind that his disrespectful conduct toward law enfacement agencies can make him lose the support of law abiding citizens. Our line up already has 50 people (25 male and 25 female) more so as I turn 50 years on the same wedding day. ART of the perimeter fence at Munda Wanga botanical and zoological gardens in Chilanga has collapsed, causing fear among residents around the area. However, Government has assured the residents of safety in the area near the lion’s den. Chilanga District Commissioner, Richard Ndazye, said safety measures had been put in place to ensure that people and livestock were safe. Mr Ndazye said officers at the zoo were erecting the perimeter wall and keeping
vigil of the area. He was responding to concerns circulating on social media that the fence near the lion’s territory fell due to heavy rains, posing a danger to the neighbourhood. "I am assuring the residents around Munda Wanga of safety. We want you to sleep peacefully in your homes as we will quickly rebuild the wall fence," he said. Meanwhile, Munda Wanga manager Wilfred Moonga said that the Ministry of Tourism and Arts has approved a budget of K6 million for the rehabilitation of
Munda Wanga. "The residents are safe and soon we will receive funding to do an overhaul of the entire wall fence which will have a razor wire with another returning wall inside to ensure maximum security," he added.

FIVE more secondary schools have been built in Kaputa to start operating next year, Member of Parliament, Maxus Ng’oga, has said. Mr Ng’oga has since expressed happiness that the district has received the much-needed development in the education sector. Mr Ng’onga said that more secondary schools have been built to beef-up the existing Kaputa Secondary School. He named the new sec-
ondary schools as, Nkosha, Kasempa, Kasongole, Kapepula and Kalaba which will be operational next year. UNIP goes to the polls THE United National Independence Party (UNIP) will hold its national congress in March next year, General Secretary, Kenneth Kaira has announced. Mr Kaira explained that the party has since set January 5, next year as a date to urgently harmonise intra-party relations. “There shall be amnesty for all suspensions and expulsions and no leadership changes will be effected at all levels of the organs until after the party congress,” Mr Kaira said in
a statement. Mr Kaira stressed that all members were free to contest any party position at the congress. UNIP is the oldest political party in Zambia, which led the country to independence in 1964, but lost power to the MMD in 1991. OVERNMENT has disbursed about K11. 8 million towards the Social Cash transfer programme in North-Western Province this year. Provinccal Minister, Nathaniel Mubukwanu, said that 47,177 households have benefitted from the programme out of the 55,209 targeted households. He said 3,300 vulnerable but viable families have benefitted from the Food Security Pack under the Ministry of Community Development and Social Services this year alone. Under women empowerment, Mr Mubukwanu said 2,084 women were empowered with productive grants. He said of the total number, 538 women were from Zam-
bezi, 619 from Manyinga, 651 and 316 from Mwinilunga and Ikelenge districts respectively. On health infrastructure, Mr Mubukwanu said that 51 out of the 74 health posts allocated to the province have been completed and operationalized. He said four district hospitals were initiated for construction in Chavuma, Kalumbila, Mwinilunga and Ikelenge districts. He said Chavuma and Kalumbila district hospitals have been completed while the Ikelenge and Mwinilunga hospitals are at phase one. In terms of staff recruitment, he said a total of 360 new staff were targeted to be recruited by the end of the year but that only a total of 154 were recruited. "These include 11 medical Doctors, 7 general clinical officers, 15 environmental health technicians, 8 laboratory personnel, 1 paramedic and 112 nurses," Mr Mubukwanu said.

FOUNDATION for Democratic Process (FODEP) in Livingstone has cautioned all political players that have a tendency of disrupting media programmes to stop the vice as the country heads to the general elections next year. LAND wrangles involving the Solwezi Municipal Council and some individuals and churches that have built around airport land will soon come to an end. This follows the acquiring of a land title by the National Airport Corporation (NAC). A number of individuals and churches have built around the airport, compromising the safety of the facility. This came to light when Civil Aviation Agency (CAA) called on North western province Deputy Permanent Secretary Emmanuel Chihili last week. CAA acting chairperson, Patrick Nswana, said that following the acquiring of a land title, all those that have built around the airport will have to be relocated to other areas. He said this is for their own safety and that of the airport in an event that there is a mishap of an aircraft. "However, they need to be engaged in a manner that does not bring a lot of dispute while considering the fact that the title is superior than any other document. “So, I am appealing to the local authority to find these people alternative land, unless they have titles also," he said. He said this should be of priority hence the need to relocate them. "Imagine there is a mishap on an aircraft and rams into a

AIROBI - Kenyan doctors working in government hospitals began a countrywide strike yesterday over inadequate insurance benefits and lack of protective equipment while treating Covid-19 patients, their union said. The Kenya Medical Practitioners, Pharmacists and Dentists Union said on Twitter late on Sunday that there had been no resolution of grievances raised over the last eight months. "The Kenya government has neglected the Welfare, Safety and Health of health care workers," the union said. "No provision of medical insurance, Workman injury benefits and Compensation and lack of adequate quality PPEs." "This greatly hampers the fight against #COVID-19 in a
country with an acute shortage of doctors," it added. Kenya reported 349 new cases of Covid-19 on Sunday, with six fatalities, bringing the number of confirmed cases to 94, 500 and the number of deaths to 1, 639,
the health ministry said. The virus has been spreading to rural areas where the public health system is creaking and limited intensive care units (ICU) are full, which has led to patients being turned away,
medics reported this month. Nearly three quarters of Kenya's ICU beds are in the two largest cities, Nairobi and Mombasa. In August, doctors in most public hospitals in the capital Nairobi went on strike for a week to protest against delays in salary payments and lack of protective equipment when treating patients who may have Covid-19. Doctors working in hospitals run by regional county governments have also been staging strikes off and on since March over similar grievances. At least 14 doctors have died of the virus since the first coronavirus case in Kenya was confirmed in March, according to the doctors union. Immunity is said to be active if the body is involved in the production of antibodies and passive if the body receives ready made antibodies from an external source. Both active and passive immunity can be natural (if acquired through natural means such as getting infected, breast feeding or across the placenta from a mother to an unborn baby) or artificial (if acquired through man-made means such as vaccination or immunization).
