I

t is sheer desperation for relevance and endearment that Lawyer John Sangwa is making an “emolument” appeal for judges, Government Deputy Chief Whip, Tutwa Ngulube has said.

Mr Ngulube questioned why Mr Sangwa waited for the elections to be around the corner before petitioning the court. He said the move was illtimed and only meant at labeling Government irresponsible. "Having insulted judges some people want to clean

themselves and look relevant and the timing of those proceedings also is very suspicious," Mr Ngulube said. Mr Ngulube said the power to pass a law and operationalise it lies in parliament and not the court. "The issue of operationalizing the law to make the Judiciary financially independent lies in parliament," he said. Mr Ngulube said unlike going to the court, parliament must pass a law to operationalise pieces of legislation from the 2015 constitution that have not been operationalised. Mr Ngulube said it was unfortunate that Mr Sangwa wants to create an impression that Government can only do something with a court order when in fact not. "These are desperate attempts by those that have taken the matter to court to make Government look like it can only act after a court order," Mr Ngulube said.

He said the matter could have been best handled by parliament not the courts of law. Meanwhile, the Law Association of Zambia (LAZ) has applied to be joined to the matter where Mr Sangwa has petitioned the Constitutional Court seeking a declaration that the President should not prescribe the emolument of the Judges. LAZ wants the court to join it as a second petitioner in the matter. In an affidavit in support of notice of motion for an order for joinder of party, LAZ honorary secretary Sokwani Chilembo the matter falls well within its mandate under section 4 of the LAZ Act, chapter 31 of the laws of Zambia. And in a press release, Mr Chilembo explained that the petition raises serious constitutional issues that are at the core of constitutionalism and the administration of justice in Zambia.

But in response to composite affidavit in opposition to notice of motion for an order for committal Ms Chitika stated that the order of interim injunction did not specify in what capacity it was restraining Ms Zaloumis, Mr Mofu and Mr Zulu because an order of the court cannot be directed to the whole world. She insisted that the three should not be held accountable in the matter just by mere allegations that the said order was purportedly served on them. “The purported video is a few seconds long and shows nothing of what is being claimed. Further it has no sound of the events being recorded nor does it show a date or time stamp. Furthermore, the video is clearly doctored as it has music added to it as a sort of “sound track’ and the person who shot and doctored the video is unknown. No foundation has been laid for the production of the video evidence and it must be expunged from the record and disregarded by this court,” she stated. Ms Chitika said that Ms Zaloumis, Mr Mofu and Mr Zulu will be highly prejudiced

if the court dismissed her application to discharge the committal process because as already established, there is no basis upon which the court can find in favour of the committal proceedings. In the main matter, the 20 have sued party president Dr Mumba and Ms Chitika seeking a declaration that the MMD extra ordinary convention held on March 20, this year is void and that the two breached the party constitution. They also want the court to direct the Registrar of Societies to appoint an interim committee during the determination of the matter.

ACC officer under probe By PETER SICHALI THE Anti-Corruption Commission (ACC) has instituted investigations against its investigations officer for abuse of office. In a letter addressed to the Professional Teachers’ Union of Zambia (PROTUZ) obtained by the Daily Nation, ACC acting Director Rosemary Nkonde Nkhuzwayo said the investigations had been instituted against the officer. This follows a complaint from PROTUZ. Ms Nkhuzwayo said if found in violation of the ACC code of conduct, appropriate disciplinary action would be taken against him. “The Commission has instituted investigations into the matter and if found in

violation of the Commission’s Disciplinary Code, appropriate action will be taken against him in accordance with the provisions of the disciplinary code,” Ms Nkhuzwayo said. In a complaint letter dated March, 30 this year, PROTUZ General Secretary, Kangwa Musenge, accused Mr Mulenga of abusing his authority. He accused the officer of trying to frustrate the case in which his close friend Oliver Mukuwe, a former PROTUZ employee was appearing in court for alleged theft of union funds. Mr Musenge said the union had previously written to ACC to stop the officer from dealing with any matters relating to PROTUZ. The union felt the officer had personal interest in the matter because he was a close friend of Mr Mukuwe who was dismissed by the union. He said it was clear that the officer allegedly elected to mislead the ACC.

MPHARMA sues for K9m for supplied medical products By GRACE CHAILE LESOETSA MPHARMA Zambia limited has sued P and G Pharmacy limited demanding over K9 million for supplied medical products. Mpharma also wants the Lusaka High Court to order P and G Pharmacy that it breached the contract and damages thereof, interest on all sums found due and costs incidental to the action. In a statement of claim, Mpharma stated that in June 2019, it entered into a contract to supply various medical, pharmaceutical and aligned products to P and G Pharmacy. It claimed that in accordance with the terms of the contracts subsisting between the parties, it did endeavor to procure or import and or supply the products to the Pharmacy whose total value amounts K9, 500, 276.47. Some of the products which Mpharma alleges to have delivered on December 10, last year include Insulin Soluble 100iu/10ml, Insulin Long-Acting 100iu/10ml and Pre-mixed Insulin 30.70 100 iu/10 ml. Mpharma stated that it further delivered medical products on January 25 this year. However, Mpharma was shocked that P and G Pharmacy failed to make payment as agreed in the contract despite numerous efforts and reminders by to do so. Meanwhile, Mpharma has also separately sued Five Star Pharmacy limited demanding K1, 682,641.95 being the outstanding amount due on dispensed products.

GOVERNMENT’S decision to scrap some taxes will be positive relief on citizens because they are already overburdened, economic expert Yusuf Dodia has said. Mr Dodia said the country had many fees and charges hence the move to reduce road tax and remove some taxes would reduce expenditure by citizens. affected economies worldwide. “The decision to reduce road tax is a move in the right direction as you know Zambia has become very expensive because of too many charges and taxes that citizens are paying. “This will make it easier for many motorists to save and to move from place to place and it will of course give relief to many during Covid-19 period coupled with the exchange rate being high,” he said. And Commuter Rights Association of Zambia president Aaron Kamuti commended Government for the gesture. Mr Kamuti said that transport business has become

competitive due to the increase in the number of public service vehicles, hence making it difficult for owners to pay road tax. Meanwhile, Capital Buses proprietor Ishmael Kankara said once implemented the move would be good for the country. Mr Kankara however said authorities should ensure that it works well owing to the fact that road tax goes along with issuance. During the launch of the Patriotic Front manifesto, President Edgar Lungu announced that Government intends to reduce road tax with the aim of subsequently eliminating it.

"First and foremost communities in the mining areas should benefit and later on the royal establishments but that can only happen once foreign invasion of gold mining sites is addressed," Bishop Mambo said. He said the country was losing millions of Kwacha through illegal mining by foreign nationals. Bishop Mambo said there was need for all stakeholders to put their heads together to end illegal gold mining.

THE decision to petition the Constitutional Court seeking an interpretation on whether President Edgar Lungu is eligible to stand in this year’s general elections is my constitutional right, UPND Katuba Member of Parliament Aubrey Kapalasa has said. This follows claims by some UPND officials that Mr Kapalasa was paid to defend President Lungu’s eligibility. But Mr Kapalasa said he made the decision to petition in his capacity as a Zambian and not as UPND MP. He wondered why he was being accused of being bought when he was just defending the Republican Constitution.

Mr Kapalasa said he had the duty to defend and protect the constitution of Zambia as a citizen “People should learn to differentiate between politics and the constitution, why would people say I was bought when I am just defending the constitution? “It is about time people differentiated between politics and the constitution of Zambia and soon people will realise that I am doing the right thing,” he added. CREDIBLE ELECTIONS FOR someone who has often been accused of plotting to rig this year’s general elections, President Edgar Lungu is doing the unthinkable by inviting foreign election observers. This is because if indeed he had such plans or was aware of their existence, the last thing he would want are foreign election monitors. But then, this open invitation to international observers should be assurance enough to the many local cynics who doubt having credible elections that they do not have to fear. Their only fear should be their failure to convince an electorate population that is able to distinguish which of the contending parties is the lesser evil. There is the proverbial wolf that cries foul even before the first vote is cast and believes everyone is out for his neck. We would have thought that he would be among the first to welcome the invitation to foreign election observers for the August 12 Presidential and Parliamentary and Local Government general elections. President Lungu says his Government has invited various international stakeholders to deploy election observer missions to witness the general elections on August 12, this year. Mr Lungu made the disclosure at State House in Lusaka on Thursday during the presentation of credentials by the five ambassadors. In fact, President Lungu first issued the invitation last year during a virtual meeting with ambassadors and high commissioners accredited to Zambia. During Thursday’s meeting, Mr Lungu assured them that Government was committed to ensuring that the August 12 elections were held in a peaceful, free and fair manner. Zambia is a signatory to the African Union charter and a host of other organisations to which she has committed to upholding democratic principles of governance that include holding free elections. No government can escape the wrath of the people if it went against their wishes by cheating through the polls. If anything, Zambia already has a system in place to organise free and fair elections through the Electoral Commission of Zambia (ECZ) that oversees the whole electoral process from the registration of voters to the announcement of results. It does this with support from the various stakeholders, particularly the political parties. But it becomes worrying when some of the key stakeholders – political parties – start to make false allegations against the ECZ to discredit it. They fail to appreciate that the ECZ has never failed the people of Zambia before and has always been able to organise credible elections that international observers have never questioned. The nation will soon be in full campaign swing mid next month when parliament is dissolved and our hope is that all stakeholders will play their part in making the August 12 elections come and pass peacefully. They will do this by observing the laws and respecting the views of their opponents. All political parties must stick to their lanes and remember that ultimately, it will be the people who will pick who to hand over the reins of the government come August 12. And that choice must be respected amidst the disappointment of losing. After all, the victors will be the Zambians.

ZAMBIAN Fertilisers has started delivering fertiliser to farmers in its four targeted provinces under the Farmer Input Support Programme (FISP) for 2021/2022 agricultural season. OMMERCIAL banks will only loan money to individuals or businesses based on an adequate return for their investment, to reflect the risks of defaulting and cover administrative costs, the Bank of Zambia has said. In this regard, Bankers Association of Zambia (BAZ) Public Relations Officer, Miriam Zimba said a well cultivated business relationship with a customer will enable the bank provide them with financial options that best suits their financial needs. Ms Zimba explained that the terms and price of loans would vary from one commercial bank to another and would reflect on the risk and cost to the bank in providing the finance. “It is also important to remember that a loan is an amount of money borrowed

Keep tax information safe - ZRA By BUUMBA CHIMBULU TAXPAYERS should keep their tax information safe to avoid falling prey to unauthorised users accessing it through various channels using technology. For Zambia Revenue Authority (ZRA), as a custodian of tax information, confidentiality is taken seriously, says organisation’s Corporate Communications Manager, Topsy Sikalinda. Mr Sikalinda explained that this was because the organisation realised that correct information in the wrong hands was dangerous and detrimental to the owner of the information. “In this regard, all tax matters are treated with the utmost confidentiality to safeguard taxpayers’ information. “To protect taxpayers whose information is in our custody, this is why we always endeavour to exhibit high levels of integrity and confidentiality in our information dissemination dealings,” he said in an interview. He said in this technological era, taxpayers got to communicate with ZRA regarding their tax issues via

different platforms such as telephone, email, hard copy letters, and sometimes through official social media platforms. Mr Sikalinda said as much as these were the official communication channels, technology had also made it difficult to ascertain whether the one initiating the communication was the officially authorised person for the company. “So with such circumstances how do companies safeguard their confidential tax information? As we endeavour to protect taxpayers’ information it is also expected that taxpayers take precautions in safeguarding their confidential tax information,” he said. Mr Sikalinda said ZRA always carried out some basic checks when people communicated with the organisation through various platforms to seek, for example, change of login credentials or change of official contact details about a company or simply to carry out any requested change on tax account. He said this was to make sure that company information went only to the intended recipients.

HE Patriotic Front manifesto is not a mere political pronouncement but it is part of the democratic process in that it seeks to recruit an informed voter. Democracy entails that a voter is enlightened and the choice of a political party is informed by ideological persuasion devoid of other considerations. By unveiling the manifesto, the PF in essence as a ruling party is leading by example to avail the electorates every salient details by sealing the exist knowledge gaps by enhancing political literacy On the voter, a manifesto will lay the basis of accountability post elections. The PF manifesto is now a public document and the quest to popularise it, show the sense of responsibility and patriotism on the part of the oarty’s central committee. The PF leadership has taken this issue of national importance seriously in every detail to the media through available platforms. A number of experts and other eminent persons who are the reservoir of knowledge

and intellectual resources have been lined up to explain matters that flies within the ambit of their professional know how. The fact that the document has been given to various stakeholders, gives an opportunity to offer critiques thereto. The PF manifesto should

be commended for not making the manifesto an elite document, a preserve of the elite event, but it marked the beginning of the long journey of constructive engagement and in turn afford a fair opportunity to scrutinise it beforehand. The other attributes in the PF manifesto, is the

The PF manifesto has presented itself to be above board with primacy being given to the next generation rather than the next elections and the consequential government. The initiatives of popularising it gives it maximum prominence in the run up to the elections and shows that the PF is committed to public scrutiny before elections are held. To those who allege any falsehoods, they have a golden opportunity to read it and point at the specific misgivings in the document. This act of selflessness will demonstrate political maturity as opposed to making a barrage of misguided hallucinations without making substantive discourse on the veracity of the document. PACRA should up its game on issuance of cooperative certificates Dear Editor,

THE Patents and Companies Registration Agency (PACRA) is the quasi government institution mandated to register companies and cooperatives. It is a legal requirement that any company doing business in Zambia must be registered with PACRA so that it becomes a legal entity to conduct the business activities. After undergoing all the procedures for the registration of the company and by complying with the required conditions, the company or institution is deemed registered. The registration is now done online. This is the effective way of registering the company or any institution carrying out the business activities because the registration can be done anywhere other than the PACRA offices. In the case of registering the company, the certificate of incorporation commonly known as the PACRA Certificate comes out within 48 hours after the application has been approved. There is no problem when it comes to registration of companies by PACRA. However, the problem comes when registering the cooperative society. You would find that the cooperative society is registered in good time quite alright. But for the certificate to come out, it takes quite a long period of time exceeding one month in some instances. This is not right because the certificate might be required urgently. These are cases where the cooperative societies were registered in January this year and the certificates have not yet been issued up to now. When the applicant inquires about the delay on the issuance of the certificate, the officer say that thee institution doesn't have the papers on which to print these certificates. This is not only disappointing but also unacceptable. Why should this happen when things have technologically improved? People understand that there is bureaucracy in the government institutions quite allright, but this is a simple matter which can easily be resolved within a short e. To suggest that PACRA should up the game by improving on the early issuance of the certificate immediately the cooperative society is registered. Clients deserve better. It is costly to follow up the certificate at PACRA because one has to spend money on transport and other logistics. ELEMIYA PHIRI, Lusaka.

THE United Party for National Development (UPND) has advised Government to decongest correctional facilities by pardoning more inmates that have reformed. UPND Chairman for Mines, Percy Chanda, said the correctional facilities were congested hence subjecting inmates to unsafe and inhuman conditions. Mr Chanda noted that most of the facilities were designed to hold just a small number of inmates. He was speaking in Kitwe yesterday. “With the Covid-19 pandemic, the issue of decongesting our correctional facilities should be treated as an emergency. “Inmates too require social distance and adequate bed space and not political donations. The danger of keeping inmates in highly congested facilities is not only inhuman to inmates alone but to officers and their immediate families too,” he said. Mr Chanda said all citizens were potential inmates, hence the need to decongest the facilities by pardoning many more inmates that had reformed across the country. He added that once the correctional facilities were decongested, this would lead to improved diet of inmates and provision of other services. Mr Chanda also called on the government to seriously look into the welfare of correctional officers who he said were demotivated and neglected.

The alternative word that can be used in place of energy change is energetics. Energetics is defined as the energy changes that characterize chemical reactions.

AU condemns Somalia president’s term extension ADDIS ABABA - The African Union has condemned the extension of the term of Somalia’s President Mohamed Abdullahi Farmajo and is sending a special envoy to Mogadishu to help resolve the political impasse there. The AU’s Peace and Security Council made the announcement after hours of closed-door meeting where it also resolved to mediate the crisis. A statement issued after the session on Thursday urged all parties in the country to “immediately resume dialogue on the basis of the September 2020 Agreement.” (The AU council) calls on all Somali political leaders to exercise maximum restraint

and refrain from any actions that may lead to an escalation of tensions and further undermine the stability of Somalia, the Horn of Africa region and the continent,” it further said. The agreement, signed by Somalia’s federal government and regional leaders as well as opposition parties, offered a road map to holding free and fair elections. AR ES SALAAM - Tanzania’s new President Samia Suluhu Hassan reached out to the opposition on Thursday as she vowed to defend democracy and basic freedoms which had seen a slide into autocratic rule under her predecessor. ROTESTS by athletes, such as taking a knee, will still be banned at the Olympic Games. The International Olympic Committee (IOC) had asked athletes in a survey whether its 'Rule 50' - which bans demonstrations - should change. A total of 3, 547 athletes were consulted, with 67 percent wishing to keep the Olympic podium free of protests and 70 percent keen to avoid on-field demonstrations. The IOC said sanctions for those who breach the rule will now be considered. “Rule 50” of the Olympic charter aims to stop protests and demonstrations in order to "protect the neutrality of sport and the Olympic

Real Madrid had replaced neighbours Atletico at the summit after a 3-0 win over Cadiz on Wednesday. On Thursday, goals by Angel Correa and Yannick Carrasco helped Atletico see off struggling Huesca. Diego Simeone's side are three points clear at the top with six games remaining. Atletico had apologised to fans for causing "confusion" after ending their involvement in the breakaway European Super League. They are chasing a first La Liga title since 2014 but still have to play title rivals Barcelona away. Huesca are 18th in the table, one point from safety with six games remaining. THE Premier Futsal League Cup comes to a conclusion today with PFL giants Automotive Futsal Club and Chipata Boys facing off in today’s PFL Cup final at Automotive Indoor Futsal Arena in Lusaka. Automotive are the favourites to reign supreme having claimed a double victory over Chipata Boys in the Premier Futsal League. However despite Automotive being the favourites to claim the maiden PFL Cup trophy, Chipata Boys Futsal Club coach Robson Mwitwa is confident that his charges can produce a shock against Automotive in today’s final. Mwitwa said Chipata Boys are ready having prepared adequately bearing in mind that they will face a team which is yet to record any de-

The ABSA Cup final slated for Woodlands Stadium in Lusaka promises a lot of intriguing moments as both Numba and Nyirenda, who once sat together on the technical bench at Zanaco FC lock horns in one of the biggest fixtures on the Zambian football calendar. Being among the best and most successful Zambian football coaches, both Numba and Nyirenda will aim to make history for their respective clubs when they face off in today’s final.
