Danville alum speaks to Hartselle FFA
By Jaylin Daniel
For the Enquirer
Hunter Garnett said began his high school career with a lack of ambition, however, with the help of an agricultural science teacher, Sandy Fields, he focused his attention in FFA which enabled him the abilities to seek out his passion of helping people as a personal injury lawyer.
Recently, Garnett has been using his education and skills in public speech in order to speak to classes at Hartselle High School about his involvement with FFA. Garnett, who graduated from Danville in 2010, grew up on his family’s farm and dedicated himself to learning how to judge livestock and maintain them. Through his time judging livestock in competitions, which consists of ranking livestock and explaining their ranks, Garnett learned how to speak in front of a crowd while being assertive. Eventually he took on several leadership positions where he was able to sharpen his skills as a boss, learning the impor-
tance of “using your time, all the time to grow,” Garnett said.
By competing in livestock judging, Garnett realized that he enjoyed speaking to people. His faith also became very important to him when he realized his passion for helping others. This led him to apply to Samford University to pursue a law degree. He graduated from Samford at the top of his class with honors, and after four years of employment as an attorney, Garnett established his own law firm, which he opened in 2021 in Huntsville. Garnett emphasizes how persistence can lead to what you feel is successful, urging students to “work hard now, so you can be comfortable later.”
His hard work has led him into a life of fulfillment in which he is able to dedicate himself to serving God while helping those in need. It was through his time in FFA and his fruitful education that he found purpose and shaped his skills to suit him in his career today. Today, Garnett lives with his wife Hannah on their mini farm in Huntsville.

‘It pains me that you got to see a blade of grass,’ judge tells convicted
By David Gambino For the Enquirer
A Hartselle man convicted by a jury last year of sodomy and sex abuse of a child under 12 was resentenced to life in prison April 9 with 1,000 years of postsupervision release after the Alabama Court of Criminal Appealsdeclaredhisoriginal sentence“illegal.”
Thomas Michael Verbosh, 62, was transferred from Donaldson Correctional Facility in Bessemer to Morgan County Jail on Friday to appearincourtforhisresentencing, courtrecordsshow.
Verbosh was incarcerated in Donaldson after he was convicted in May 2023 of one count of first-degree sodomy and one count of sexabuseofachildunder12 for actions in 2018 against a 10-year-oldfemalevictimon his wife’s side of the family, accordingtocourtrecords.
Verbosh was sentenced to life imprisonment for the sodomy conviction and 20 years imprisonment for the sex abuse conviction by CircuitJudgeCharlesElliotton June14,2023.Thesentences were ordered to run consecutively.
Alabama Court of Criminal Appeals presiding Judge Mary Windom on March 12 ordered Morgan County
Circuit Court to resentence Verbosh. “The circuit court was requiredtosentenceVerbosh to a minimum of 10 years’ post-release supervision for his sodomy conviction,” Windom wrote. “Because the sentence imposed for that conviction did not includetermsofpost-release supervision, the sentence imposed by the circuit court wasillegal.”
In Elliott’s courtroom on April 9, a shackled Verbosh stood next to his attorney, Russ Prickett, as Elliott acknowledged that state law required a stipulation of post-releasesupervision.
ElliottupheldVerbosh’slife imprisonment plus 20 years per the original sentencing and added 1,000 years of post-release supervision, “in the unlikely event that (Verbosh)isreleasedfromprison inthislife.”
“I regret I didn’t sentence you to that last time,” Elliott said. “It pains me that you got to see a blade of grass … or a tree,” he added, apparentlyremarkingonVerbosh’s travelfromDonaldson.
First-degree sodomy is a Class A felony defined by engaging in sodomy with another person by forcible compulsion, or with a person who is incapable of consent, orwithapersonwhois
under12yearsold.
AnyoneconvictedofaClass Afelonysexoffenseinvolving achildissubjecttoelectronic monitoring supervised by the Board of Pardons and Parolesforaminimumof10 yearsafterreleasefromprison, according to Alabama Code15-20A-20.
CourtrecordsshowPrickett began representing Verbosh in July 2023, after Verbosh’s conviction. Before that, Verbosh was represented by J. BrentBurney.
In addition to sodomy and sex abuse, Verbosh was also charged with first-degree rape when he was arrested in April 2019. He pleaded not guilty to all charges in May2019. Following his arrest, Verbosh’s wife petitioned the court for a protection from abuse order on behalf of the child victim to whom she’s related.
“Defendant (Verbosh) has explosive anger issues and impending charges of child molestation and/or rape of minor child” the wife wrote inthepetition.
The victim “has disclosed that Thomas Verbosh, husband of plaintiff, has been sexually assaulting her … . When myself and the child do not return home, I fear he will become violent. He has multiple firearms in the
homeaswell.” Verbosh’swifealsoinitiated divorce proceedings against him in 2019. The complaint indicates the pair, who did not have children together, were married in 2013 and separated on April 27, 2018 —20daysafterVerboshwas arrested.
Along with “incompatibilityoftemperament,”during the marriage the wife claimed that Verbosh “committed acts of sexual intercourseand/orsexualcontact with a minor child,” accordingtothedivorcecomplaint.
In response, Verbosh denied the sex abuse allegations. Their divorce was finalizedinOctober2020.
Verbosh remained in jail in lieu of a $50,000 bond awaiting his criminal trial until, in response to a move by his attorney, Circuit Judge Jennifer Howell reduced his bond to $5,000 on May8,2019. “The State objects to a bond reduction but provided no argument,” Howell reasoned in her order. On release, Verbosh was required to have no contact with the victim and to remaininthe state.
In the fall of 2021, amid numerous jury trial delays, Howell amended Verbosh’s bond conditions to allow him to visit family for a
week in Pennsylvania, court recordsshow.Alsothatyear, the State notified Verbosh that they intended to use out-of-court statements from thechildvictim. The victim was interviewedattheMorganCounty Child Advocacy Center in April 2018 by a forensic interviewer, according to the notice. “During the interview, (the victim) made allegationsofsexualabuseagainst the defendant,” the notice reads. The notice also indicated that the victim would bepresentattrialandavailableforcross-examination.
Ahead of the jury trial, Burney moved the court to rule some evidence inadmissible, such as the fact that Verbosh “refused to takea polygraphtest.”
Burneyalsorequestedthat certain statements from the victim’s out-of-court interview be removed from evidence:“speculativestatements made by the alleged victim that the defendant had previously been incarcerated, speculative statements that the defendant had abused other children in the past, and statements from the alleged victim about the punishment that shewouldlikeforthedefendant toreceive.” Following Verbosh’s con-
viction (the jury acquitted of the rape charge) and first sentencing, Burney moved the court for a new trial in earlyJuly2023.
“The Court erred, and abused its discretion, in its rulings denying the Defendant’s attempt to admit (into) evidence that the alleged victim had made a prior false allegation to law enforcement regarding a male assailant’s attempt to abduct her,” the motion argued, amongotherpoints.
“The Court did not properlychargethejuryastothe applicable law on the credibility of witnesses,” Burney wrote. “The jury’s verdict wasagainstthegreatweight of theevidence.” Elliott denied Burney’s motion the same day with no elaboration.
Verboshhasnoothercriminal history in Alabama, accordingto courtrecords.
“Parole is still an option,” Prickett said after last week’ssentencing.“Hiscase iscurrentlyuponappeal.” Alabama prisoners convicted of certain Class A felonies, including first-degree sodomy, are scheduled for their initial parole consideration once they’ve completed85%oftheirsentence or15yearsinprison,whichever comes first, according to Alabama Code 15-22-28.

Hartselle High students learn agriscience skills from recent graduate
By Wes Tomlinson
For the Enquirer
Students at Hartselle High’s agriculture program learn how to grow plants during cold weather and how to preserve crops after they’re harvested, and their new teacher is a product of thesameprogram.
First-year agriscience teacher Austyn Randolph graduated from Hartselle Highin2020andwasactive in both agriscience courses and Future Farmers of America as a student. This year, hewashiredtoleadthe program of 85 students in gradesninethrough12.
“Dr.(Brad)Cooperwasthe principal here when I was here and still is,” Randolph said. “Most of the teachers I had are still here, too. So, I tell my students that I’ve walkedintheirshoesbefore.”
Several agriscience students were in the school’s greenhouse on Monday selling plants for their annual plantsale.Randolphsaidall 85studentswereinvolvedin growing and nurturing the plantsthatweresold.
JuniorsChesneyTaylorand Cierra Schultz have been active with the school’s FFA
program since they were in seventh grade and have been growing plants in the greenhouse since they were freshmen. They say they’ve learned valuable and practical lessons during their years studying agriscience, like how to ensure the safety of plantsduringacoldfront.
“One year, we had a cold frontthatcameinandkilled everything, so we had to learn to plant some stuff inside,”Taylorsaid.
Schultz said the damage from the cold front caused them to use new soil and build new planter boxes for theirflowerbeds.
“When we got here it was just clay dirt and we had to dig all of it out and replace it with new soil and dirt,” Schultzsaid.
According to these students, the most important lesson students can learn from the agriscience programisself-reliance.
“This program really prepares you for life,” Taylor said. “Learning how to put hard work and dedication into plants like this can also teach you skills for your future job or whatever you choose to do for the rest of yourlife.”
Taylor and Schultz were keeping notes throughout thedayMondayonthemost popular plants customers were buying. They had also introduced new plants for thesale. “I like the black mamba petunias, those are new this year,”Schultzsaid. Randolph said they sold a lot of tomato plants and impatiens on Monday morning.
“We actually had a lady
come in here and bought every flat of impatiens we had,”Randolphsaid.
Taylor and Schultz were among eight juniors in the agriscience program who received their skid steer certification last month, and they were able to use the skid steer loaders to till a small patch of ground on campus for a new school garden. “We took a layer of dirt off the ground and put it in the
flowerbeds that are located in front of the greenhouse and we had a pile of dirt to coveritbackup,”Taylorsaid. Randolph said next year they will grow vegetables like squash, cucumbers, okra, corn and a wide varietyofpeppersintheschool’s newgarden. “The main thing I want to do with that is ... to teach a canning and preservation class,” Randolph said. “Like howyoucanpickleandhow
you preserve these vegetables so once you pick them, theydon’tjustrot.” He said a nursery and landscaping course will be available for students next year, where students will be responsible for maintaining the shrubs and flowers around Hartselle High School.
“I’mworkingwiththestate right now to build the curriculum for that class,” Randolphsaid.

Chiropractor accused of poisoning wife asks judge to recuse himself
By David Gambino
For the Enquirer
AHartsellemanaccusedof poisoninghiswifewithlead fromhisDecaturchiropractic office asked the judge presiding over his criminal case — the same judge presiding over his divorce — to recuse himself amid allegations that the wife’s divorce attorney shared information with the judge about thecriminalcase, according to court filings.
Brian Thomas Mann, 34, was arrested in September 2022 after being indicted for the attempted murder of his wife. He was conditionally released from jail after posting a $500,000 bond in January. Since his release, he’s been required to wear a GPS monitor and stay in the Morgan County Jail every weekend.
“He’s been charged, he’s not been convicted,” said Huntsville lawyer Chad Morgan. “It just seems like, over there — and in some of the media — he’s already been convicted. I don’t believe in that at all. So, we’re going to fight it the best we can.”
Mannisscheduledtostand trial before Morgan County CircuitJudgeCharlesElliott on Nov. 18. He has pleaded not guilty. A bench trial in his divorce case with wife and alleged victim Hannah Pettey Mann is scheduled for Aug. 12.
Court records show Mann retained Morgan on Feb. 2. Before Morgan, Mann was represented by Britt Cauthen. Before Cauthen, Mann was represented by Bennett Driggers and Christopher Weston. All attorneys sought to amend Mann’s strict bond conditions with little success. “The law is that (bond) is supposed to be the least restrictive means to make sure the person that’s been accusedshowsupforcourt,” Morgan said. “In my opinion, having somebody turn themselves in on a Friday and get out on a Monday — and you have an ankle monitor while you’re out — isexcessive. It’snottheleast restrictive means.”
Morgan said Mann, who has no criminal history, is from the community and
has turned in his passport, is not a flight risk. “He doesn’t meet any of the criteria that would make them believe he’s a flightrisk,”hesaid.“Imean, if he wants to run, he could wander off on a Monday through Friday when he’s outside jail. That doesn’t make any sense. That makes it punitive, to me.
Andit’spunishment.Itfeels like punishment, which is not what bond is made for.”
On behalf of his client, Morgan on April 2 filed a motion asking Elliott to recuse himself from the criminal case.
“The alleged victim/wife is representedbyJerryKnight in the divorce proceedings,” the motion explains. “The defendant avers that his previous attorney advised him that Knight availed information to the Court through the divorce proceedings ex parte in referencetothiscriminalmatter.
Furthermore, Knight and Elliott are former Assistant District Attorneys for Morgan County.”
An ex parte communication, improper in most situations, is one in which an attorney for a party provides information to the judge outside of the presence of attorneys for other involved parties.
Knight railed against the allegations on April 17.
“Somebody’stellingabaldfaced lie,” he said. “I’m con-
fident that Brett Cauthen wouldn’t have communicated that to Brian Mann. I’mconfidentofthat.Idon’t know about those other two. But it was an absolute lie.”
Cauthen did not respond this past week to requests for comment.
“It was advised that the information had been relayed to (Mann) by one of his previous attorneys,” Morgan said. “And since I couldn’t get in touch with that attorney, I went and filedamotiononit, because I’m not going to keep waiting.”
Knight said he’s practiced lawandbeeningoodstanding with the Alabama State Bar for 50 years. “I would never have an ex parte conversation with a judge. Never ever.”
According to the Alabama Rules of Professional Conduct, lawyers shall not communicate ex parte with a judge or juror except as permitted by law. Similarly, according to the Alabama Canons of Judicial Ethics, a judge, except as authorized by law, should not “initiate nor consider ex parte communications concerning a pending or impending proceeding.”
Emergency protectionfrom-abuse order and temporary restraining orders are examples of lawful ex parte proceedings.
District Attorney Scott
Anderson said he knows Elliott to be more than capable and competent to handle Mann’s case.
“I know that if Judge Elliott had a conflict, or if there was even a remote possibility of the appearance of a conflict, that he would do what the law requires of him,” he said.
A judge should disqualify himselfinaproceeding, per the Canons, in which “his impartiality might be reasonably questioned, including … (having) personal knowledge of disputed evidentiary facts concerning the proceeding.”
Knight and Elliott worked together in the Morgan County DA’s Office for several years beginning in 2011.Knightsaidhedoesn’t see anything wrong with Elliott presiding over both Mann’s criminal and civil (divorce) cases.
“A jury’s going to try the criminalcase, andthejudge will try the divorce case,” he said. “I don’t see anything at all improper about the judge trying both cases.”
Elliott declined to recuse himself in an order filed on April 4. Ethics rules prohibitedhimfromdiscussing thedecisionwithTheDecatur Daily, he said. “I take issue that it wasn’t set down for a hearing, but I’m not the judge,” Morgan said. “He just straight denied it.”
Although divorce pro-
ceedings were filed ahead of Mann’s criminal case, according to Knight, the August bench trial will likely be delayed.
“I’m assuming that until thecriminalcaseisresolved, I’d have a difficult time trying a divorce case,” he said.
“He (Mann) would have a Fifth Amendment right.”
Morgan on March 27 filed a motion requesting the case be moved out of Morgan County and attached examples from 27 local and national news articles to reinforce his request.
“Duetothepublicitygiven to the case in the media, it will be impossible to find a jury … that has not been tainted by the media coverageofthiscase,”themotion reads.
Morgan on April 5 moved tocourttoliftMann’sweekend jail requirement and keephimonananklemonitor.
“Since January 2023, the Defendant has adhered to all his Honorable Court’s orders,” the motion reads.
“He has turned himself in every weekend, he has made his weekly check-ins with Morgan County Community Corrections, and he has had no contact with the victim of any kind.”
Elliott on April 8 denied the request to change Mann’s bond conditions. A decision regarding a change of venue had not been filed as of April 17.
