With the surge in oil prices at the beginning of the year and the increase in government and airport taxes on a global scale, flying has rapidly become the most expensive way of traveling. Due to the fact that airway travel has become more expensive, the industry has found new competitors in countries with a good infrastructure for cars, buses, trains and even ships. We see more and more passengers preferring the comforts of a bus despite the fact that the journey may take a very long time. In this case, the trip will practically start at the moment you set foot on the bus. The same goes for car and train travel. At the very least, you can do some sightseeing instead of spending hours at an airport waiting for your departure or even worse, waiting for the bad weather to pass.

Passengers are more conscious today and have started to compare the ticket prices, the service on the airline, and even the model and make of the airplanes. In this ever growing competitive world of aviation, competing with other airlines in the bigger countries where there is an excellent infrastructure was nearly impossible. Still, many of the major airline companies are in a lot of trouble today, having to compete not only with buses, cars and trains but more importantly with low cost carriers that have found their way around the problems mentioned above. It is therefore not difficult to imagine the magnitude of the problems that these large airline companies are facing.

We are now noticing a new trend that several of the big partner airline companies are now joining forces and cooperating with train, and bus companies. We are also witnessing the creation of low cost airlines or that the smaller daughter airlines are turned into no frills low cost carriers. The next step for these large companies is to cooperate with the small airlines in order to partially control them, which will withhold low cost carriers from getting a stronghold in a particular region. On the other hand, getting into these kind of alliances with the bigger carriers is also an opportunity to enter the very important emerging markets like China, India and Brazil which will be the main areas with the number of passengers at least doubling. More accurately, IATA foresees a total of 6 billion by the year 2030. Our main condition is to keep on growing. Insel Air may be small, but we have cooperation agreements with some of the major carriers in the region, especially in the USA and in Europe. Insel Air is sure to keep track of the tough, because we will be right there when it gets going.

The Island Life If you’ve traveled to Bonaire before, chances are you’ve considered moving there. Here’s how several adventure-seekers did it, and you can, too. By Sarah Sekula

Water Woman When Caren Eckrich decided to move to Bonaire 13 years ago, she had two goals in mind: start a marine research center and find and old fixer-upper. Fast forward to today, and she’s got all of that and more. Here she has warm climes, truly great scuba diving, and the perfect community in which to raise her child. Needless to say, the island life suits 42-year-old Eckrich well. Besides the warm temps, it doesn’t hurt that she also has her dream job -- teaching scientific diving and coral reef ecology to U.S.-based college students who are studying abroad. “The students want to be here and want to learn,” she says. “Plus I get to do most of my labs in the ocean and see their faces when they experience all of it.”

Bonaire, a small island located just 50 miles off the coast of Venezuela, is known for its exquisite diving and snorkeling, so it comes as no surprise that it attracts water-loving types from around the globe. With that said, what happens when you connect with Bonaire in such a way that you decide to move there? What is it like? Are the locals welcoming? Are there things you have to adjust to? Will you miss life back home? We posed some of those questions to a few American expats, and here’s what we discovered.

From dolphins to manta rays to sharks to the itty bitty seahorses and frogfish, she’s seen it all; and it never gets old. Her favorite part is that she gets to instill a sense of wonder in her students. She’s an intense conservationist, and she tries to pass along her love for the ocean and protecting it. Plus, as a result of her surroundings, she’s taken up sailing, boating, kayaking and windsurfing. She also delights in the unusual foods served on the island. Things like goat stew with funchi, a type of mashed corn/grits, and tamarind juice. (Her neighbor has a tamarind tree that she raids every now and then.) Then, there are the farmers markets that she adores. “It’s very difficult to grow produce here,” she says. “Yet, some of these people are growing fruits and vegetables in their yards with great success. Goodness knows I’ve tried and haven’t succeeded.”

This all begs the questions: How did she end up in Bonaire? “I had friends that had done some marine research in Bonaire and heard from them about the beautiful reefs,” she explains. “I also stopped in Bonaire in 1999 while on my way from Puerto Rico to Curaçao on my sailboat. It was gorgeous and the people were friendly and the atmosphere was relaxed. After a year in Curaçao, I met a Dutch man, and we decided to move to Bonaire – I would start a small marine education center and he would buy an old house and fix it up.” Admittedly, she recalls, their first week on the island was miserable. “We were in the middle of rainy season, and the house was disgusting and full of mosquitoes,” she says. “Within a week we had a sort of refuge in one of the rooms that was mosquito-free, and we were getting the house livable. It was all uphill from there.” She also had to adjust to waiting forever at the post office or doctor’s office or immigration and not finding toiletries she was used to and having to switch over to Dutch brands. “It’s true, you have all of the same stresses as life back home,” she says, “It’s just that it’s always warm and beautiful here. Plus my work is a 2-minute bike ride from home; no rush hour traffic.” For those who would like to follow in her footsteps, her advice is to keep a few things in mind. “I have a nice job and work really hard, but the pay is low compared to a similar job in the states,” she says. “You don’t come here to get rich – you come here for a way of life that is much more in balance with nature. You get used to the nuances and adapt. “In fact, when planning a dinner party, you have to go and see what’s available at the stores that day before telling your friends what’s for dinner,” Eckrich says. “You have to be flexible. You have to wait a long time for simple services. If you bring a book and can relax instead of getting angry, life is much nicer.” At the end of the day, it helps that the locals are very friendly. “We try to go to all of the festivities every year and are friends with most of our neighbors. However, after living there for 13 years, Eckrich says her family will still never truly fit in. However, they do love learning about the different traditions, cultures and foods. One of her favorite things about the island, in fact, is the multi-cultural mix of people all living together with respect for each other. For instance, her child’s school is rather small, yet, it probably has well over 20 countries represented.

Mother-and-daughter kayakers Tina Lindeken, 50, and her daughter Terra Carstensen, 23, first came to Bonaire in 2000 from northern California on a scuba diving vacation. They liked Bonaire so much that they came back each year until 2008, when they decided to move there. By 2004, Tina was spending a lot of time volunteering with the Sea Turtle Conservation program finding turtle nests, helping baby turtles to the sea and deploying transmitters by night at Klein Bonaire, an uninhabited islet. “All of this was very rewarding,” Tina says. “I also had the privilege of snorkeling with pilot whales, dolphins and many turtles, and got to see many creatures for the first time, like slipper lobster, seahorses, and frogfish.” By 2008 when they were living on the island, Tina had dreams of owning a small family business working with the sea and nature.

“When my daughter Terra found the clearbottom kayaks, I knew this was something unique for Bonaire,” she says. “This could be our way of sharing with tourists and locals how special Bonaire’s environment is.” In turn, they brought the first clear-bottom kayaks to Bonaire, and one day while they were kayaking over the beautiful reef at Klein Bonaire, they imagined sitting on a window to the sea, and the name of the business was born: Windows to the Sea Kayaking and Snorkeling. These days, they say they don’t miss the traffic or hustle and bustle of northern California. They’d much rather wake early to ride bicycles along the clear blue water and follow the winding, narrow coastal road over the hill to Rincon, where their neighbors always take time to say bon dia (good morning) and share a smile. After that, they love stopping by the local snack bar to have an ice cold Vita Malt. They also adore time

spent on the beach, free diving and generally taking in all the natural wonders that Bonaire has to offer. Their favorite discovery on Bonaire is the Lac Cai Mangroves.” It’s like kayaking in a jungle on a desert island,” Tina says. “You glide quietly through the channels and see the fragile eco system just beneath your seat.” Here, snorkelers spot sea grass, fish, sponges, upside-down jelly fish and birds of all types. “Being able to share this experience with guests from around the world is our dream come true.” Once in a while, Tina says, she thinks about the big redwood trees, oak trees, and fir, and the fresh running water of the California rivers, but she wouldn’t trade the island life for anything. “I try to make it back to the states to visit family every year or two, but the longer I am here in Bonaire, the more I’d rather just stay.”

Bonaire es una pequeña isla ubicada a apenas 80 kilómetros de la costa venezolana, conocida por su exquisito buceo y esnórquel. Por eso no sorprende que atraiga a amantes de la vida acuática de todo tipo y de todas partes del mundo. Pero, ¿qué sucede una vez que se haya conectado de tal manera con Bonaire que decida mudarse para allá? ¿Cómo es vivir allá? ¿Los habitantes locales se mostrarán contentos por su llegada? ¿Tendrá que adaptarse? ¿Extrañará su vida anterior? Hicimos algunas de estas preguntas a unos expatriados estadounidenses y esto es lo que aprendimos.

tener aquí el empleo de sus sueños: dar clases de buceo científico y ecología de arrecifes de coral a estudiantes de los EE.UU. que estudian en el exterior. “Los estudiantes quieren estar aquí y están deseosos de aprender,” expresa Eckrich. “Además, tengo el lujo de dar casi todas mis prácticas en el océano y ver la cara que ponen al vivirlo por sí mismos.” Ya ha visto de todo: desde delfines, mantas y tiburones hasta los diminutos caballitos de mar y peces sapo. Y nunca se cansa. Lo que más le fascina es poder transmitir ese sentido de asombro a sus estudiantes. Es una conservacionista apasionada e intenta contagiar a otros su amor por el océano y por protegerlo. Además, bajo la influencia de sus entornos, ahora practica la navegación, la navegación a vela, el kayak y el windsurf. También le encantan los exóticos platos que se sirven en la isla, tales como el guiso de cabra con funchi, que es una especie de polenta, y el jugo de tamarindo. (Su vecino tiene un árbol de tamarindo que ella “ataca” de vez en cuando.)

La mujer acuática Cuando Cáren Eckrich decidió mudarse a Bonaire hace 13 años, lo hizo con dos objetivos en mente: establecer un centro de investigación marítima y comprarse una casita vieja para renovarla. Si avanzamos al presente, resulta que consiguió ambas cosas y más. Hoy en día disfruta del clima cálido, el buceo de primera y de estar en la comunidad perfecta para criar a su hijo. Por supuesto que la vida isleña le sienta bien a Eckrich, de 42 años. Además de la temperatura, tampoco no le viene nada mal

También adora los mercados de agricultores. “Resulta muy difícil cultivar frutas y verduras aquí en la isla,” afirma ella. “Y sin embargo, algunas de estas personas lo hacen en sus jardines y con mucho éxito. Sabe Dios cómo lo he intentado yo y sin éxito.” Oyendo todo esto, uno no puede sino preguntarse: ¿Cómo es que llegó a parar aquí en Bonaire? En sus propias palabras: “Unos amigos míos habían realizado investigaciones marítimas en Bonaire y me comentaron sobre los preciosos arrecifes. Además, en 1999 hice una parada en Bonaire en camino de Puerto Rico a Curazao en mi velero. Me pareció hermosísima y me impresionaron la gente tan amable y la atmósfera relajadísima. Cuando llevaba un año viviendo en Curazao, conocí a un holandés y decidimos mudarnos a Bonaire,

para yo establecer un pequeño centro de educación marítima mientras que el compraría una casa vieja para renovarla.” Ella reconoce que la primera semana en la isla fue miserable. “Estábamos a mediados de la temporada lluviosa y la casa estaba horrible y llena de sancudos,” recuerda ella. “Una semana más tarde, habíamos creado algo así como un refugio libre de mosquitos en una de las habitaciones, mientras poníamos la casa en estado habitable. De ahí en adelante, todo fue mejorando más y más.” También tuvo que acostumbrarse a las eternas esperas en la oficina de correos, la oficina del médico o la inmigración, y a no poder encontrar los artículos de tocador a los que estaba acostumbrada y tener que cambiarse a marcas holandesas. “Es cierto que aquí hay las mismas presiones que en casa,” dice ella, “pero aquí el clima siempre es cálido y hace buen tiempo. Además, mi trabajo queda a apenas dos minutos en bicicleta; sin nada de tráfico ni hora pico.” A los que desearían seguir su ejemplo, ella les aconseja tener unas cuantas cosas en mente. “Tengo un buen empleo y trabajo muy duro, pero la paga es inferior a lo que recibiría en los Estados Unidos,” comenta Eckrich. “Uno no viene acá a hacerse rico; viene en busca de una vida mucho más en equilibrio con la naturaleza. Es así de simple.” Uno se acostumbra a las idiosincrasias y se adapta. “Por ejemplo, si se está planeando una cena con amigos, antes de anunciar el menú, primero hay que ir a los supermercados a ver qué hay,” relata Eckrich. “Hay que ser flexible. Se debe esperar mucho para servicios muy simples. Si uno lleva un libro y se relaja en lugar de enojarse, la vida es mucho más agradable.” InselAir Reaching Higher

Hoy en día, dicen no extrañar el tráfico ni el ajetreo del norte de California. Prefieren por mucho despertarse temprano e irse de paseo en bicicleta por la costa, con sus aguas azules y cristalinas, siguiendo el angosto y ondulante camino que cruza la colina a Rincon, en donde sus vecinos siempre tienen tiempo para decir bon dia (buenos días) y compartir con ellos una sonrisa. Luego, les encanta hacer una parada en un quiosco y beberse una Vita Malt bien fría. También adoran ir a la playa, practicar el buceo libre y, en general, ir absorbiendo todas las maravillas naturales que Bonaire tiene de ofrecer.

Pero no cambiaría la vida isleña para nada. “Intento volver a los Estados Unidos cada año o dos para visitar a mi familia, pero mientras más tiempo llevo aquí en Bonaire, más prefiero solo quedarme y no irme a ningún lado.”

Despite being one of the twelve countries that make up South America, Suriname is without a doubt a part of the Caribbean. In a way, this juxtaposition is already a promise that Suriname is one of those truly unique travel destinations. It is one of the few places in the region where its people have deep roots stemming from every corner of the world, in particular, Africa, Europe and Asia. Surinameâ&#x20AC;&#x2122;s society is strongly defined by the cultural influences originating from those three continents. Unsurprisingly, a variety of languages, ethnicities, food, traditions, and religion from all over the world can be found in this former Dutch colony.

Cultural diversity

The local language, “Sranan” is a mixture of European languages such as Spanish, French, English, Portuguese, Dutch and several African languages that were introduced by the enslaved Africans. Their different ethnic backgrounds forced them to find new means to communicate with each other during slavery. Sranan lingered up until the abolition of slavery in 1863 and it still exists today. Despite Sranan’s unique origins, the main language in Suriname is Dutch, which is a result of the long period of Dutch colonization.

The people of Suriname had to overcome many adversities because of the country’s cultural diversity, yet this has driven the Surinamese to make more effort to work towards becoming one proud nation. This is a trait that makes Suriname powerful beyond measure. Visitors are always fascinated by the country’s diversity and tolerance. One of the most striking examples is the fact that the country’s largest mosque is merrily located next to a colossal synagogue. Years of learning to accept each other’s culture and religion has earned the Surinamese people the reputation of being some of the most tolerant people in the world.

The abolition of slavery marked the introduction of a new era of labour contracts in Suriname. This is when many Asians from China, India and Indonesia (in particular the island of Java) crossed the ocean to settle in this far away land. Its ethnically diverse population has earned Suriname worldwide recognition to be one of the most culturally mixed countries in the world today. This is interestingly expressed through the complex language, religion and food. There is no other South American nation that has any of the same qualities.

The range of musical instruments and the musicality brought over from various parts of the world have all contributed to what is now known as the famous “Kaseko” in Suriname. Together, one sound is created: “The sound of Suriname.” Speaking of sounds, if you listen very carefully when you travel throughout the country you’ll hear on top of all the dialects spoken by the Maroon tribes and the Amerindians, more than twenty different languages spoken, including Dutch, Chinese, Hindi, Javanese, Arabic, Portuguese, German and French.

Festivities One of the effects of the multi cultural society that draws a lot of attention is the fact that there are many festivities in this country. To start, there is the Srefidensi, Suriname’s Independence Day, which is celebrated every 25th of November. This festivity is an expression of all the different cultures that co-exist in Suriname. Most of this day’s festive activities are held on the Independence Square. Some of the things to expect are must-eat local dishes and music. You will find many of the Surinamese people beautifully and colourfully dressed in traditional clothing on this day.

Then there is the Phagwah, which literally means festival of colors. According to the Hindu belief, the good shall overcome the evil during this special celebration. Colored powders are sprinkled around in abundance. It is a moment to dance and share the Indian cuisine with cherished ones. Diwali, is another traditional Indian celebration. It is also known as the feast of light and has also found its way in the Surinamese society. Small candles and lights are lit in people’s homes all over the country. After the sunset, people come together for a walk. Torches and lanterns are taken to lighten the dark path while a young girl dressed as the Hindu goddess Lakshmi will lead the way. An enormous candle is traditionally lit on the Independence Square, which brings people together for the light ceremony. This on its own is a very special happening. Eid ul-Fitr also known as Bodo, is one of the main cultural and, above all religious festivities in Suriname. It is a three-day Islamic holiday that marks the end of Ramadan, the Islamic holy month of fasting. Muslims

celebrate by gathering with friends and family, preparing sweet delicacies, wearing new clothes, giving each other gifts and putting up lights and other decorations in their homes. The feast starts on the Independence Square before sunrise. People gather dressed in white while chanting prayers. This is quite a peaceful sight. Finally, the Surinamese pay tribute to the abolition of slavery every 1st of July. This is a festive day that will highlight many cultural elements that originate from Africa. Performances from Surinamese musical groups, strongly influenced by the music from Africa, can be enjoyed almost everywhere. People dress up in traditional Creole attire like the “koto” and the “pangi”. The most fascinating commonality of all these festivities is the fact that everyone in Suriname participates in them. Even those who have a completely different cultural or religious background are eager to celebrate with each other and that is one of the main reasons why Suriname is one of the most unique countries in the world. El idioma local El idioma local, el sranán tongo, es una mezcla de idiomas europeos como el español, el francés, el inglés, el portugués, el holandés y varios idiomas africanos que introdujeron los africanos víctimas de la esclavitud. Múltiples adversidades El pueblo de Suriname ha tenido que superar múltiples adversidades, precisamente debido a esa diversidad cultural. Sin embargo, esto ha llevado a los surinameses a esforzarse más todavía para convertirse en una sola y gran nación. Y es esta característica la que hace de Suriname un país poderoso sin medida. Sus visitantes siempre se quedan fascinados por la diversidad y tolerancia de ese país. Uno de los ejemplos más vistosos es el hecho que la mezquita más grande del país se encuentra felizmente ubicada al lado de una colosal sinagoga . Tras años de aprender a convivir a pesar de sus diferencias culturales y religiosas, los surinameses se han ganado la reputación de ser uno de los pueblos de mayor tolerancia del mundo.

“Ala Kondre ” que utiliza instrumentos de todos los diferentes grupos culturales, desde el apinti, un tipo de conga africana, hasta la tabla, oriunda de la India. Juntos, crean un solo sonido: “El sonido de Suriname.” Y hablando de sonidos, si al viajar por el país escucha con atención, oirá, por encima de todos los dialectos hablados por las tribus de negros cimarrones y amerindios, más de veinte idiomas más, incluso el holandés, el chino, el hindi, el javanés, el árabe, el portugués, el alemán y el francés.

Festividades Uno de los efectos de este multiculturalismo que atrae mucho la atención es la gran cantidad de festividades que hay en este país. Para empezar, está el Srefidensi o día de independencia de Suriname, que se celebra el 25 de noviembre. Esta fiesta da expresión a todas las diferentes culturas que coexisten en el país. En su mayoría, las festividades se llevan a cabo en la Plaza de la Independencia. Entre las atracciones que se pueden esperar figuran platos locales (que no se debe perder) y música local. Podrá ver a muchos de los locales vestidos para la ocasión con hermosas y coloridas vestimentas tradicionales. También está el Fagua (Holi, o Joli), que literalmente significa “festival de los colores”. Según el hinduismo, el bien vence al mal durante esta celebración especial en la que se espolvorean por todas partes grandes cantidades de polvos de colores. Es una ocasión para bailar y compartir platos hindúes con seres queridos.

Por último, el 1º de julio, los surinameses rinden tributo a la abolición de la esclavitud. Es un día de fiesta en el que salen a relucir muchos de los elementos culturales de origen africano. En casi todo rincón del país se puede disfrutar de presentaciones de grupos musicales surinameses con profundas influencias de música africana. La gente se viste con trajes criollos tradicionales, como el “coto” y el “pangui”. El rasgo más fascinante que tienen en común todas estas festividades es que todos los surinameses participan con entusiasmo, incluso aquellos de antecedentes culturales y religiosos completamente diferentes. Ésta es una de las razones que convierten a Suriname en uno de los países más singulares del mundo.

A dream come true Elvis Martinus had a dream of someday establishing a windsurf club for local kids in Bonaire. The only problem was getting funds to kick start his dream. In the year 2001 Bonaire sent a group of thirty children to the biggest North American Windsurfing Championship in Florida. The result: an unprecedented 20 trophies won by a group of until that time, unknown surfers from a tiny Caribbean island. What was also unknown to the general public was the background of some of the participants from Bonaire. How could an island of 15.000 inhabitants with limited to no resources at all and no formal training produce so many good windsurfers? Trying to find an answer to this question, the producers of the documentary film ‘Children of the Wind’ follow these surfers from their humble beginnings to world star fame. Some call it ‘The Miracle of Lac Bay.’

Rise to fame Robert McCormick, who is the co-creator and producer of the documentary, together with Daphne Schmon (also a co-creator and director of the documentary), Peter Robertson (co-creator and

Daphne Schmon is also an avid windsurfer with a BA in film production from Wesleyan University. She has also won many cinematography prices with her short films and documentaries. Peter Robertson is a leading Camera Operator with a worldwide reputation in the feature film industry. He has 25 years experience in shooting feature films with credits that include some of the cinema’s biggest franchises such as Harry Potter and James Bond. Many of the films that Peter has been involved with have won or been nominated for Oscar, Golden Globe or BAFTA awards for best cinematography

The documentary revolves in part around the success of the Frans brothers, Everon ‘Tonky’ Frans and Elton ‘Taty’ Frans, who together with their cousin Kiri Thode take the world of freestyle windsurfing by storm. Starting off as poor kids who never knew their father, the Frans brothers, then age six and seven, left home to live with their grandparents. Having little to no means for training, the boys practiced and learned to sail on broken equipment. Until one day the Frans brothers asked Elvis Martinus to borrow his surfing equipment. The rest is windsurfing history. Their willpower to become great freestyle windsurfers did not go in vain. The boys are ranked among the five greatest freestyle windsurfers in the world. It does not stop there; Bonaire is steadily producing great talent of every age in the world of windsurfing and water-sports, especially in the ProKids World Championship, which happens to have started on the island. In the documentary you will also see and hear many commentators express their amazement regarding the success of these island kids. The story also features other surfers, including Stepherd Gustowski, Jurgen Saragoza and Bjorn Saragoza. According to the creators; the documentary does not solely focus or revolve on freestyle windsurfing as other windsurfing documentaries would, but also on the more humane part. It is about how passion, determination and hard work of these children develop into great success, not only for themselves but also for the island of Bonaire. Al pensar en Bonaire, lo que le viene a la mente inmediatamente a uno son las salinas, la infinidad de caracoles y, claro está, el precioso mundo submarino, pues la isla es considerada uno de los mejores sitios de buceo del mundo. Sin embargo, nadie pudo haberse imaginado que un pescador con ambiciones y un grupo de niños iban a cambiar por completo la cara del windsurf y el surf estilo libre internacionales dejando al mundo entero en estado de asombro. La realización de ese sueño Elvis Martinus soñaba con un día establecer un club de windsurf en Bonaire para los muchachos locales. El único problema radicaba en conseguir los fondos para iniciar la realización de ese sueño. Junto con su buen amigo y veterano olímpico Patún Saragoza, empezó a pescar a fin de reunir los fondos para realizar su sueño. Y al cabo de poco tiempo lo logró; nació un pequeño establecimiento de windsurf para los muchachos de la isla: el Aquaspeed Club, posteriormente llamado el Bonaire Windsurf Place. En el 2001, Bonaire envió un grupo de treinta niños al campeonato norteamericano más grande de windsurf, en Florida. ¿Con qué resultado? Nada menos que 20 trofeos, una cantidad sin precedentes hasta aquel momento para un solo grupo, conquistados por un grupo de surfistas desconocidos proveni-

En un intento por obtener una respuesta a esta pregunta, los productores del documental Children of the Wind (Los hijos del viento), siguen a estos surfistas desde sus humildes inicios hasta que alcanzan la fama mundial, fenómeno al que algunos llaman ‘El milagro de la bahía Lac.’

Determinación El documental gira en torno al éxito de los hermanos Frans, Everon ‘Tonky’ Frans y Elton ‘Taty’ Frans, quienes junto con su primo Kiri Thode están conquistando fenomenalmente el mundo del windsurf estilo libre. Y la historia no termina allí; Bonaire sigue produciendo, uno tras otro, grandes talentos de todas las edades en el mundo del windsurf y los deportes acuáticos en el campeonato mundial ProKids, que por cierto tuvo su inicio en esa misma isla. More often than not, attorneys and other professionals involved in the area of assisting clients with the establishment of legal entities to own assets, find themselves engaged in dreadful conversations. A typical example of such a conversation would be a client experiencing financial difficulties and therefore contacting his financial planner to transfer the ownership of his sports car and beach house to a legal entity to avoid that these possessions might be confiscated. www.rudsellucas.com

These conversations are out of place, because at that particular point in time, help is no longer possible. Asset protection, or financial planning, is legal and beneficial; however, it must be implemented before areas of your possessions have come under attack. Although it is perfectly acceptable to use asset protection tools to protect your assets, at a certain point in time asset protection could be illegal. Asset protection is clearly permissible under certain circumstances; however, sometimes it is not that obvious. The general rule is that you cannot use asset protection to avoid paying an existing debt or claim. The use of asset protection tools to reduce the risk of loss forms part of proper financial planning. The use of trusts, corporations and private foundations to protect assets, is beneficial and important because it helps individuals control potential losses that might arise from their professional and business

activities. The key factor in asset protection is when and why the asset protection plans should be implemented. The term fraudulent transfer found its origin 400 years ago in England (Twyneâ&#x20AC;&#x2122;s case) when a farmer intended to defraud his creditors by selling his sheep to a man named Twyne while retaining possession of the sheep. A debtor is fraudulent as to a creditor if the debtor makes a transfer with the purpose to hinder, delay or defraud the creditor. Sometimes it is obvious that the implementation of an asset protection strategy would be considered unlawful. You must at all times retain the ability to comply with and meet your currently outstanding obligations. If you are unable to comply with an existing financial obligation and it can be proven that your asset protection plan was meant to avoid this payment, your creditor can apply to a judge to revoke your asset protection plan and confiscate the assets set aside via your asset protection strategy.

Although the law does not allow for you to use asset protection to evade current debts, it does allow you to use asset protection strategies to avoid liability from future, unanticipated creditors. A distinction should be made between existing obligations and potential future unforeseen obligations. Loans and other contracts entered into after an asset protection plan has been implemented normally fall outside the scope of fraudulent transfers, this provided you did not mislead the other party to the transaction. If it can be proven that an asset protection plan was implemented with the intent to avoid paying an existing or anticipated claim, the fraudulent rules embedded in most legal systems could be used to reverse this asset protection plan. On the other hand, it is equally clear that asset protection is both legal and effective as a means to protect your assets against future unforeseen risks.
