LEGENDARY LIVING

B

L

I

S

H

E

R

A S I W R I T E T H I S , it is still “Hotober” in Texas. According to the thermometer, Fall hasn’t

quite arrived, but I’m already thinking ahead to Winter. You can blame it on our production schedule or on the fact that Fall’s transition into Winter is one of my favorite times of year.

I’m a lifelong outdoorsman. These days, though, because of competing demands, I don’t get to spend nearly enough time outside except during this time of year. When Fall runs into Winter, I make getting outside a priority. There’s something about dove on the wing over harvested fields, rutting bucks battling for supremacy in the brush and migrating waterfowl coming in for a landing over a steaming pond that energizes and calms my spirit. The juxtaposition of excitement and peace might seem to be a conflict unless you’ve started a day by having the solitude of a beautiful sunrise interrupted by the rush that comes when a long-pursued buck steps out of the shadows or a covey of quail flush in front of the dogs. And then, there is the power of relationships. On many of my best hunting trips, the only trophies I’ve collected have been the stories told and toasts raised around a campfire. Not sure whether it’s the camo, the intermittent cell phone coverage or the wood smoke, but camaraderie flourishes in the wide, open spaces. In my estimation, hunting season is reason enough to rate a favorite status, but then the holidays are draped over the top. Lisa and I have three kids, so October through December is prime time in the Alexander household. Halloween is an attention-grabber that screams “trick-or-treat smell my feet.” It’s decked out in costumes and parties sprinkled with chocolate and pumpkin spice. Although they’re slowly aging out of the trick-or-treat neighborhood festivities, I’ve got the mental snapshots of their toddler years stored for easy retrieval. Next is Turkey Day—and I’m a Thanksgiving kind of guy. It’s our tradition to gather up family and friends from near and far for a daylong celebration. While the food threatens to steal the show, it’s gratitude that’s in the spotlight. In the hustle and bustle of today’s impersonal world, it seems that slowing down to savor the good things we enjoy like fellowship and “plenty” are luxuries we can’t afford. Experience has taught me the opposite. A grateful heart is something we can’t live without. Then, there’s the beautiful promise of Christmas, which speaks to the very heart of our family. In our Judeo-Christian tradition, Christmas is the everlasting gift of hope wrapped up in light and delivered by God himself to a waiting world. Goodness knows, we can always use more light as we reflect on ways to serve others better. While each of these experiences has different trappings, they all get back to the same essential element—relationships. It’s the people—and the memories that we make with them— that matter most. The shared love and the laughter is our enduring legacy. My wish for you, during my favorite season, is that all your special ones will be within arm’s reach at your favorite place (If you don’t have an outdoor place to call your own yet, flip through this magazine and choose yours from the best in Texas. We’re good at connecting people to their dream ranches. . . .) and that the memories you create together will be colored by gratitude and illuminated by hope.

Land. It is the thing from which we come, the place upon which we live our lives and, in the end, the spot to which we return. Our relationships with land range from personal to professional, but no matter how we are bound to the land, it is likely the most valuable asset we hold; if not financially, then emotionally. Much like the care and attention we impart to our loved ones, proper management of land is critical if long-term health and prosperity are to flourish from the acres we call our own. At American Forest Management, we bring more experience, resources and trust to land management and related services than any other company in the country. When someone you love needs a caretaker, you thoughtfully seek out the very best. Your land is no different, so when the time comes to seek land management resources, our team of experts is ready to partner with you. Find out more→ AmericanForestManagement.com

haven for wildlife.

The ranch, which features rolling pastures resplendent with native grass and live oaks as well as two fields suitable for cultivation as either hay meadows or food plots, is a testimony to pioneering stewardship that can be traced back to the early 1900s when the historic ranch was founded. Throughout most of its history, the ranch was used as a livestock operation and still maintains the infrastructure of working pens, barns, a cedar stay round pen for horses and excellent water distribution thanks to two water wells and a windmill. Two additional storage tanks could be hooked up to further develop the water. Most recently, though, the low-fenced ranch has been rested and refocused on wildlife. Native game includes white-tailed deer and turkey. Free-ranging exotics such as blackbuck antelope and axis deer come and go.

headquarters compound. In addition to the ranch infrastructure, the headquarters compound includes two main ranch houses and a wrangler’s house. The original ranch house, which boasts four bedrooms and two baths, was completely updated recently to include granite countertops, wood f loors and a new heating and cooling system. Its front porch is a place people want to gather as the late evening disappears into the night. With the nearest light pollution half a county away, the night sky is majestic. For those looking to put their own stamp on Reward Ranch, the rolling terrain offers several potential building sites with memorable Hill Country views.

Texas Wildlife Association By David Yeates, Chief Executive Officer

Are you a member of the Texas Wildlife Association? If the answer is yes, then thank you. If the answer is no, then there are some things we need to share with you. TWA is many things to many people, but at our core we are an educational enterprise that illuminates the role of private landowners in wildlife conservation. Did you know our Conservation Legacy education programs reached more than 600,000 Texans last year? Let that soak in. These are TEKS-aligned lesson plans delivered to school children all over the state, delivering the message of wildlife conservation through a ladder of curriculum including quail necropsies and field trips to private ranches. Additionally, we host landowner workshops across Texas on all manner of best management practices for things such as soil health, quail or deer management and brush control as well as vital topics of interest such as eminent domain. There is no other program anywhere like Conservation Legacy. Did you know our Texas Youth Hunting Program is an official partnership with Texas Parks and Wildlife Department and is the largest program of its kind? Founded in 1996, we have grown the program so it now runs about 250 hunts per year taking about 1,400 kiddos along with their parent or guardian on a hunt. Almost all of these hunts are organized and overseen by volunteers and hosted on private property. We host hunts for everything from alligators to pronghorn antelope in every corner of the state. Additionally, we actively encourage other states to adopt our model and have successfully set up similar programs in five other states and Mexico. No program in the country does more to recruit new hunters. Did you know our Texas Big Game Awards is another official partnership with Texas Parks and Wildlife Department? Founded in 1991, the program is designed to promote awareness about wildlife management and the role that hunting plays in habitat conservation. In essence, our message is: “Hunting equals habitat.” We collect hundreds and hundreds of score sheets every season and recognize top scoring harvests for pronghorn, desert bighorn sheep, javelina, mule deer and white-tailed deer by region, typical/non-typical and high fence/low fence. We hold award banquets across the state to honor

those hunters as well as recognize youth harvests and first harvests. We also maintain records of those harvests by county for hunters, landowners, brokers and wildlife managers to reference. This terrific outreach program keeps hunters engaged in a positive environment. Did you know that TWA is the leading voice for wildlife matters at the Texas Capitol and with regulatory agencies? There are various groups that focus on a particular game animal or region and there are a few broader conservation groups that engage on policy at some level, but we do much more. TWA keeps a professional lobby team in place full time, operates a Political Action Committee to support candidates and elected officials who understand and care about wildlife issues and actively engages its membership to voice concerns or opinions on policy development. We are unquestionably the tip of the spear when it comes to wildlife and landowner policy in Texas. Did you know that TWA has an Annual Convention each summer in San Antonio? It is the single best collection of conservation-oriented speakers and wildlife education seminars in Texas offered alongside a top-shelf wildlifeoriented trade show and stellar auctions featuring exclusive hunts, trips, art and all things Texas wildlife. The fellowship and professional networking are great, all in a beautiful setting where we can celebrate what is so important to us all. Did you know that TWA publishes an award-winning magazine each month exclusively for its membership? Texas Wildlife includes program updates, technical guidance, research findings, hunting stories, opinion pieces and much more. We regularly hear it described as the “best wildlife magazine out there.” If you are not already a member of Texas Wildlife Association, then I hope you are convinced to become one. You can do that by going to our website at www.Texas-Wildlife.org and following the “Join Now” prompts. We need each other. Landowners and wildlife enthusiasts need organized advocates. We need the strength of numbers and the network to affect change for the betterment of wildlife, habitat and our shared outdoor heritage. Thanks for your support.

Texas Land Brokers Network By Dee Brabham , Vice President (2020 President)

Texas Land Brokers Network’s organization has really been busy the second half of the year. We are so blessed to have such great sponsors such as Capital Farm Credit, Crockett National Bank and Texas Farm Credit and as we also enjoy watching our membership continue to grow! We are already working on our 2020 schedule too, with emphasis to continue the growth of our organization and efforts to bring “excellent” speakers that not only provide beneficial information to our business but added value to our members. It’s awesome to get together each month to discuss what’s new in the business, new opportunities, discuss the latest sales and listings, but our speakers, as well as sponsors, are also key to helping us all grow our business! The cost of that benefit is priceless! In September, we had Jacqueline Davie with Lincoln Financial Advisors give us a presentation on estate planning. Great information on how property can be set up in trusts to help with financial planning and tax benefits for heirs! We had another awesome turnout at the October Sporting Clay Shootout

at Texas Premier Sporting Arms and Promatic Training Center. It’s a little unbelievable how many excellent shooters were with us, and many thanks to Capital Farm Credit for being such an integral part in helping with the event. In November, we will have the pleasure of having Senator Lois Kolkorst speaking at our monthly event. She’ll bring us the latest information and updates on all things going on, not only in the state but in Washington as well. In December, we’ll have our Christmas social and ‘white elephant’ exchange. I am really hoping not to get the ‘wild hog chow’ again this year! One thing that I would like to remind readers and our members about is the great information from the TLBN website. Under the “Useful Links” tab, there are some excellent resources that can not only help your business but are useful too, ie. a new landowner may like the “Resources for New Landowners Video” or the NRCS Web Soil Survey; there are links to all things Texas, such as Real Estate Center at Texas A&M and Texas Parks and Wildlife. Texas Alliance of Land Brokers By Clayton Leverett, President

The steady growth in the membership base of the Texas Alliance of Land Brokers ‘TALB’, which is now at 328 members [268 broker/agents and 60 affiliates], is a reflection of TALB’s commitment to excellence in the industry. Established in 1994, the Texas Alliance of Land Brokers members have professionally represented buyers and sellers of rural Texas real estate. The organization actively promotes and maintains high standards of professional conduct as well as supports other related organizations dedicated to the preservation of outdoor recreation, wildlife and private property ownership. TALB leadership focuses on the vision of its founders through an ongoing commitment to providing the members with invaluable benefits: Visibility: through the website, each member will have their listed properties marketed world-wide on the TALB website and their own TALB website with links to their personal website. Control: members have access to input their own listed property information in detail with photos on their personal website which will simultaneously go on to the TALB website. Search: a search program is available for members and the public to look within all website members’ properties using search parameters such as county, size of acreage, listed amount and others. Ethics: members agree, upon joining TALB, to conduct themselves in a professional, courteous and ethical manner. Education: a most important benefit is to provide educational opportunities to all members by having excellent speakers each

month, impending political changes that affect our industry and MCE credit opportunities. Membership Directory: each member will appear on the TALB website under the Membership tab. Website members will also appear on the TALB website front page. Luncheon Meetings: each month, a luncheon meeting is held in different towns within the general membership which offers opportunities to hear good speakers with educational topics, to conduct business, to exchange property listings information and to meet one another. Identification: members will gain identification through the visibility of our website and publications promoting TALB. As a TREC-approved Continuing Education provider, TALB is offering an advanced Farm and Ranch Practice Update course, TREC #37948, on November 21, 2019 from 8:30 A.M.–6 P.M. in Fredericksburg. This eight (8) hour TREC continuing education credit course is designed to give the real estate licensee an updated, in-depth analysis of farm and ranch best practices including discussions of water rights, market changes, mineral right issues, new legislation, the new geographic competency requirements and Broker’s Price Opinions. Check the TALB calendar on our website TexasLandBrokers.org for more information on dates and speakers. For more information about TALB, to RSVP to a monthly luncheon or to apply for membership visit our website or contact Jane Bushong Brown at (830) 640-3254 or janebrown@hctc.net.

Texas and Southwestern Cattle Raisers Association

By Katrina Huffstutler, Executive Director, Communications Services, and Jeremy Fuchs, Directer, Public Affairs Four New Staff Members Join TSCRA TSCRA members may see some new faces in Fort Worth and new names in the magazine soon. This month alone, the association has welcomed four new staff members. Katrina Huffstutler is the new executive director of communications. No stranger to the association, Huffstutler first joined the staff in 2007 as a staff writer for The Cattleman. She left in 2012 to launch her own public relations business but continued to contribute content to the association and The Cattleman magazine on a contract basis. In her new role, Huffstutler is responsible for all the association’s communications strategy, including print and digital media, public relations and social media. Ashley House is the association’s first director of leader engagement. A graduate of the Texas Christian University Institute of Ranch Management, she worked at Texas Agricultural Land Trust and Lone Star Ag Credit before joining TSCRA. House’s primary responsibilities include planning, coordinating and supporting TSCRA leadership in various activities and events. Originally from South Texas, her family still runs a cow-calf operation in Three Rivers. Trisha Caudill is the new payroll and human resources coordinator. She comes to the association from Aledo Independent School District and previously worked at the Fort Worth Museum of Science and History. Fielding phone calls in the Fort Worth office is new receptionist Jenna Proske. She grew up in La Grange and also has connections to the beef cattle industry. TSCRA Special Rangers Recover $105,000 in Stolen Property A suspect was arrested, and more than $105,000 in stolen property was

recovered after an investigation by Texas and Southwestern Cattle Raisers Association (TSCRA) Special Ranger Troy McKinney and the Fannin County Sheriff’s Office. The investigation began in June after a Fannin County rancher notified McKinney that a padlock was cut to access her property and cattle were missing. Several tips suggested the involvement of a silver four-door dually pickup pulling a red gooseneck trailer, seen in the area around the time of the theft. A description of the pickup quickly spread on Facebook, and by July 7, alert citizens notified McKinney and other law enforcement that a pickup and trailer loaded with cattle and matching that description had been spotted. The vehicle was stopped by Oklahoma authorities and the driver, Josh Briggs, 22, of Honey Grove, Texas, was arrested. The cattle onboard were indeed stolen and were returned to their owner in Oklahoma. Briggs cooperated with the investigation and McKinney was eventually able to recover seven head of stolen cattle as well as other stolen items found on Briggs’ property. The equipment recovered included a John Deere skid steer and 28-foot gooseneck trailer stolen from Bryan County, Oklahoma; a Kubota tractor stolen from Lamar County, Texas; and, a Kubota lawnmower stolen from Fannin County, Texas. Briggs turned himself in Sunday, September 15, 2019, and was booked into the Fannin County Jail. As of writing, he remains in custody pending bond. Briggs is charged with third-degree felony theft of cattle. If convicted, he could face a sentence of up to 10 years in prison, $10,000 in fines and restitution to the victim. Additional charges are pending in connection to the other stolen items.

Texas Land Markets FIND ANOTHER GE AR! TE X A S L AND MARKETS THIRD QUARTER —2019 Story By Charles E. Gilliland, Ph.D. Research Economist | Real Estate Center | Texas A&M University

Robust economic activity, buoyant oil prices and falling interest rates pushed Texas land prices up 6.6 percent as the preliminary third-quarter price reached $2,930 per acre by the end of September. Investors flocked to the high plains, and recreational users continued to buy rural properties. However, the typical size fell 23.6 percent to 1,241 acres continuing a trend to smaller acreages. Never-the-less, total dollar volume expanded to $1.4 billion driven by an increase in acreage to 478,913 acres. All of that was accomplished with 5,576 sales, well short of the 6,198 in 2018. Together these statistics point to sales of some very large acreage properties. The statewide Texas land market has reached a new vigorous high with positive price trends. Statewide results reflect positive price growth in most regions. The Panhandle and South Plains continued to post strong price growth, driven by investment buyers. Reflecting the strong economy, Northeast Texas prices climbed nearly 10 percent while the Central Texas— Hill Country and Gulf Coast—Brazos Bottom markets produced 14 and eight price growth respectively. West Texas prices perked up to a seven percent growth rate. However, South Texas prices remained stagnant posting a one percent decline. Far West Texas prices slumped 19 percent, but volume soared to nearly double the normal acreage, sending total dollar volume sharply higher. These results suggest active markets with strong upward pressure on prices for most regions. As the Fall begins, a growing gaggle of economists have begun to see cracks in the recovery that began in 2009. Despite the perceived headwinds, Texas posted record growth in personal income. Oil field activity has slowed somewhat but continues in the Permian at a rapid pace, producing high prices for large acreage ranches. Investors still desire farmland. Slower economic growth seems destined to appear sometime in the future. So, the Fed appears set to cut interest rates further. Therefore, barring some unforeseen event such as a war with Iran or a political storm, markets should continue to thrive. °

IF YOU’RE FLIPPING THROUGH THE PAGES OF TEXAS L AND, CHANCES ARE YOU’RE DREAMING OF A PLACE TO CALL YOUR OWN. Maybe you want a spot to hunt and fish. You might be ready for a second home now and a retirement home later. Or you’ve seen land hold its value, making it a stable long-term investment. Whatever your reasons, it’s wise to work with professionals who can help you find, purchase and manage your place in the country. That’s especially true if you’re new to the rural way of life.

Cullins, senior vice president of administration at AgTexas Farm Credit Services in Lubbock. “Or they may learn important information from the appraiser, like availability of water or some restriction they weren’t aware of. This could lead to a price renegotiation in which the buyer could save some money.” Farm Credit lenders with in-house appraisers tend to have fast turnaround times, too.

A Real Estate Agent Brokers and agents specializing in rural property are experts in their local markets.

“Sometimes speed is more important than cost,” Cullins says. “In some markets, you want to close as fast as possible.”

“A good Realtor is worth every penny,” says Travis McKinney, chief credit officer for Central Texas Farm Credit in Early. “They do a lot of research, and will have information for you on the property’s history, title, easements, mineral rights, flood zones and more before you ever set foot there.”

Look for a state-certified, accredited rural appraiser who specializes in your type of rural property. Those with professional designations from the American Society of Farm Managers and Rural Appraisers (ASFMRA) or the Appraisal Institute have added expertise.

One way to find a local agent is through professional organizations such as the Realtors Land Institute or the Texas Alliance of Land Brokers.

An Ag Expert Once you own land, seek advice on what to do with it. Your lender, broker and county Extension agent are all good resources.

A Rural Lender Look for local lenders that understand the nuances of structuring loans for rural property. For example, Farm Credit lenders have expertise in rural lending and agriculture, and can guide borrowers through the process of purchasing and owning land.

Texas A&M AgriLife Extension agents offer information and special programs on raising cattle and managing for wildlife, for example. Such activities can help you earn income off the land while getting property tax relief in the form of an open space valuation—also called an ag exemption.

“Education is key,” says Trae’ Ottmers, senior vice president of lending at Capital Farm Credit’s Fredericksburg office. “My family has ranched for generations, but many landowners today don’t have a rural background. We can finance their property and talk about how best to manage it.”

“A lot of times people who are buying land for recreational purposes want to lease it to a local person to run livestock,” McKinney says. “A lender, Realtor or Extension agent can put you in contact with local people who will be good operators and take care of things.”

Farm Credit—a nationwide network of borrower-owned lending cooperatives—has other advantages, too. The co-ops distribute a portion of their earnings to customers each year in the form of patronage dividends, effectively lowering borrowing costs. They also offer a variety of competitive financing options for land, country homes and ag operations. A Rural Appraiser The appraisal will tell you whether property is worth the asking price—and a whole lot more. “Often, buyers who aren’t local want to make an educated offer but are not familiar with the market,” says Dave

A Financial Expert Before you buy, it’s smart to work with a financial advisor and figure out your budget. After closing, you’ll also need an accountant who understands the tax advantages of farming, ranching and owning rural land. Agricultural enterprises enable you to deduct or depreciate the cost of many assets, such as barns and equipment. You can even write off the interest on your loan. “A good question to ask accountants is do they file many Schedule Fs for their clients,” Ottmers says. “Schedule F is for farm and ranch income. If they say they don’t know much about it, then your lender or ranch broker likely knows someone who does.” °

DO YOU REMEMBER

that time when you had company coming and needed to sweep off the front porch, but your 6-year-old used the broom for a witch costume and left it somewhere in town on Halloween night, so you had to use a rake instead? Or that other time when you needed a spade to dig a hole to bury your three-year-old’s goldfish, so you bought a cheap one at the local market and the handle broke in half before it even touched the ground? Choosing an appraiser is kind of like choosing a tool: you might be able to make do with one that’s not quite made for the job, but it just won’t be as efficient or as good as it should be; or you can try to go cheap and it just won’t work at all. Whether you own a patio home in a subdivision next to Augusta National, 250 acres of Thoreau-quality hardwood on Walden Pond or 10,000 acres of prime Douglas-fir overlooking Cannon Beach, the odds are good that at some point, you’ll have to use an appraiser to determine the value of your property. All appraisers are not created equal, and choosing a good one is important, so understanding the “3 Cs”—classification, competency and cause—are crucial to selecting the right appraiser for the job. Classification Legally, an individual must be licensed or certified to work as an appraiser, and although the minimum education and experience qualifications are set at the federal level, licenses are handled by each state. Therefore, an appraiser must not only meet minimum education and experience criteria, they must also be licensed or certified in the state in which they work. It is very important that when choosing an appraiser, you make sure that he or she is licensed in the state in which the property is located, not the state in which you, or even the appraiser, are located. Failure to do so can lead to not only an invalid appraisal for you, but also legal trouble for the appraiser as they would be guilty of practicing without a license. Each state has multiple appraiser classifications tied to the levels of education, training, experience and property type set federally. In addition to the state requirements, the federal government also imposes some limits and restrictions on appraisers, particularly for federally-regulated transactions. In other words, when a lender is involved. These restrictions are related to the complexity, property type and value for which each appraiser classification is allowed to assume responsibility. Although titles may vary slightly from state to state, appraisers fall into one of four categories: apprentice appraiser, licensed appraiser, certified residential appraiser or certified general appraiser. Each level requires progressively more education and experience in addition to examinations of increasing difficulty. An apprentice appraiser, or trainee as they are known in some states, is a beginner who has completed 75 hours of introductory appraisal education and must work under another appraiser in order to gain the experience needed to work on their own. Apprentice appraisers, though they may be very knowledgeable, do not yet have the requisite coursework or experience to legally take responsibility for any assignment and must have a licensed or certified appraiser sign off on all of their work. A licensed appraiser has completed at least 150 hours of education and has at least 2,000 hours of experience over at least one year. In addition, licensed appraisers must, at a minimum, have a high school diploma or its equivalent. A licensed appraiser is able to sign off on any “noncomplex” residential property of up to four units and a value of less than $1 million but is limited to a value of only $250,000 for complex residential properties. This may mean that he or she could legally appraise your home near Augusta National or your duplex at the beach, provided neither reach $1 million in value, but could not appraise your hunting tract, your cousin’s farm, or the snow cone and CBD oil shack that your best friend’s kooky Aunt Gracie just opened up on the corner. A certified residential appraiser is essentially a licensed appraiser with a bit more experience and less restrictions. Though they are still restricted to appraising residential property, the additional 50 hours of coursework and 500 hours of experience earned over at least five years as a licensed appraiser (in addition to college coursework requirements) allows them to appraise any residential property with up to four units, regardless of complexity or value. This is the appraiser you would most likely want to hire for your Times Square condo and the quadplex you just bought in downtown Clemson to rent to college students, though, like the licensed appraiser, Aunt Gracie’s snow cone and CBD shack is still off limits to them. The fourth and most robust appraisal classification is certified general. Certified general appraisers can legally appraise anything of any value. In order to be qualified as a certified general appraiser, an individual must have at least 300 hours of appraisal education and 3,000 hours of experience over a minimum of 18 months; at least half of the experience hours must be in non-residential properties. In addition, an individual seeking a certified general classification must hold at least a bachelor’s degree from an accredited college or university. They’re the ones who legally get to appraise your cattle ranch in Montana, your 80-unit condo in Daytona Beach, your ski resort in Vale, the local country club, all the hardwood on Walden Pond, your 10,000 acres of Douglas-fir in Oregon and yes, finally, Aunt Gracie’s Snow Cones and CBD Oil.

Competency Now if you’re thinking, “Wow! That’s a huge range of property types for one person to appraise,” you’re right. And that brings us to the second C—competency. Being legally qualified to appraise a property type doesn’t make a certified general appraiser competent to do so. And this is where, as someone looking for an appraiser, you’ll have to do most of your due diligence. Appraisers have an ethical responsibility to be competent to appraise a property before taking an assignment. There are a number of aspects of competency, and when searching for an appraiser, it is not enough to simply ask potential appraisers if they are competent to appraise your property; it is imperative that you know enough to ask the right questions to make sure that they are. For example, let’s suppose that you do own 250 acres of hardwood on Walden Pond. Your first question to an appraiser might be something along the lines of, “Do you know how to appraise land with trees on it?” Many appraisers will tell you that they do, and that may be true. But if their experience is with multiple thousand-acre pine timberland properties in Alabama, is that really sufficient to competently appraise your smallish hardwood property in Massachusetts? This hits at the heart of several very important distinctions in competency: property type, geography and market type. First, even though pine and hardwood are both trees, they are very different; they grow differently, they are managed differently, and they are often owned for different reasons. Understanding pine trees may make one competent to appraise pine trees, but that does not necessarily translate to hardwood trees. As a generalization, large pine timberland properties are purchased as an investment for the primary purpose of earning a return on that investment. All decisions related to the value of that property are based on the expectation that the investor will earn a return on that investment. Buyers and owners of small hardwood properties, on the other hand, generally have a much different motivation for ownership. Though they may produce some income, more common motivations for owning these types of properties include recreation (hunting, bird watching, hiking, etc.), conservation, building a cabin to “get away from it all,” having something to pass down to future generations and the like. An appraiser must understand this in order to accurately assess the value of your property. Second, as the saying goes, the three rules of real estate are “location, location, location,” and geographic competency is extremely important to understand when hiring an appraiser. Going back to our Walden Woods example, let’s focus not on the property type, but on the location of the appraiser’s experience as it compares to the location of the property. I think you will agree that Alabama and Massachusetts are quite different, not only in physical characteristics, but also demographically, economically and legislatively. An appraiser from Alabama who is completely competent to appraise a property next to Talladega Motor Speedway may be completely ill-equipped to appraise the same property on Walden Pond. The Alabama appraiser may not only not know important physical aspects such as timber growth rates and the time of year when harvesting is off limits (like in Spring when the snow melts and the ground is as solid as room temperature butter), but he or she may also not be familiar enough with state and local laws, regulations and ordinances to produce a legally compliant valuation.

Finally, understanding the markets in which properties are located and in which they trade is of the utmost importance. Failure to do so makes it almost impossible to determine the correct use of the property, which in turn will prevent developing a reasonable appraisal. A potentially incomeproducing property like forestland trades at multiple market levels, all of which impact property value. At the primary level, one must understand the local timber markets—what mills are around, what products they purchase, how much do they need to purchase, and what prices are they willing to pay— in order to determine the timber income-producing potential of the property.

As an example, let’s suppose that 10,000-acre Douglas-fir property near Cannon Beach, Oregon, that you’ve been coveting for years is finally on the market, but you don’t happen to have $30–$40 million on hand to pay cash, so you have to borrow the funds. You’ve gone through a list of appraisers to determine their classifications and competencies and settled on an appraiser with a great reputation who specializes in large timber properties on the West Coast, and who also has worked with your lender before, so you feel very good about him or her. Everything goes beautifully and you purchase the property with no hiccups.

At the same time, local market factors related to land use, such as population growth rates, zoning and the path of growth to name a few, impact the highest and best use of a property. These all help to determine whether it will remain an income-producing timber property or eventually be purchased by Aunt Gracie to finally achieve her life-long dream.

Now let’s say that not long afterward, you are introduced by a mutual friend to someone from a conservation organization who says that they would like to talk to you about donating a conservation easement on your property. You really like the idea and, after doing some digging, learn that you can get a tax deduction for the value of the donated easement. You also find out that you will need an appraisal of the property before and after the easement in order to determine the value of the easement donated, and that the IRS has very strict rules that must be followed. You contact the appraiser who did the original appraisal for your purchase because they did such a good job the first time but find out that they have never done a conservation easement appraisal and are not very familiar with the IRS regulations. However, they recommend another firm that has a great deal of experience in that arena and is at the top of the IRS’s short list of approved appraisers, so you ultimately decide to hire the second firm.

A third market component that appraisers must be aware of is the type of buyers interested in a particular type of property. For instance, the buyer type for our 250-acre Walden hardwood forest is very different from the type of buyer interested in 10,000 acres of Douglas-fir plantation in Oregon. At the same time, however, if the hardwood forestland in the Northeast is 25,000 acres instead of 250 acres, the same buyer may be interested in both because buyers of properties of that size are interested in a return on investment. Understanding who the potential buyers are for a particular property type, and what motivates them, is key to an appraiser’s success and is, therefore, key in choosing the right appraiser. Cause There are a number of reasons that cause an individual to need an appraisal, and whether you need one in order to borrow money, establish a value basis for estate planning, determine the value of the conservation easement you just donated, or a myriad of other reasons, the purpose of the appraisal is an important factor in selecting an appraiser. This is closely related to competency, in that appraisers often specialize in doing appraisals for particular purposes and may not have the experience necessary to handle your particular needs.

In this example, the original firm is perfectly competent to handle the appraisal of the property for acquisition lending purposes but is not the best choice to handle the appraisal for conservation and IRS reporting purposes due their lack of experience in that particular arena. Conclusion Choosing the wrong appraiser can cost you in terms of time, money and even legal complications, so you should always put a good deal of thought and consideration to the process. If you follow the “3 Cs” and look for the right classification, competencies and sufficient experience with the area that causes you to need the appraisal, you will take the uncertainty out of finding a good appraiser. °

RICHARDS OUTDOOR PHOTOGRAPHY LLC I S B U I LT O N F A M I LY , F A I T H A N D A D E E P , ABIDING APPRECIATION FOR THE MA JESTY OF THE NATURAL WORLD. “Our work exists to give God the glory for his magnificent creation and to share the hope that comes from a relationship with our Creator,” said Dave Richards, a hunting and outdoor industry manufacturers’ rep with H&G Marketing, who along with his wife, Beth, and their two sons, James, 23, and Joseph, 20, also operates the family’s Boerne-based business. While Dave’s photography has graced numerous covers for magazines such as Sports Afield, Petersen's Hunting, Southern Outdoors and Texas Parks & Wildlife magazine and illustrated the now-classic white-tailed deer management text, Observing and Evaluating Whitetails, the driving force behind Richards Outdoor Photography LLC is the family’s shared passion and gratitude, not a paycheck. “Our faith is strong—and we raised our boys to respect, conserve and appreciate the natural world,” said Beth, who uses her family’s photographs as the inspiration for her wildlife pencil drawings and paintings. “Capturing the beauty of the outdoors reminds us all to be good stewards of our rich blessings.” Focusing on Photography Dave, the son of a petroleum engineer, spent his formative years moving from oil field to oil field in East Texas, West Texas and South Louisiana. His parents, avid outdoorsmen, took their children hunting and fishing in every locale. At home, the coffee tables were littered with dog-eared copies of Sports Afield, Field and Stream and Outdoor Life. “Although no one in my family was a photographer, I grew up surrounded by wildlife images,” Dave, a Texas Wildlife Association member, said. He obtained his first camera about the time he entered middle school and began carrying it with him wherever he went. He gravitated to wildlife as subjects for his photos. “We’d go to visit my grandmother near the Wichitas in Oklahoma,” Dave said. “When the prints would come back, I’d have two pictures of my grandmother and 22 photos of prairie dogs, lizards and the coyote den up the road.” About the same time, his immediate family settled in a semirural area just north of Mandeville, Lousianna, and they stayed there through his high school years. On the weekends, he and friends would grab “shotguns, fishing poles and ice chests” and load their skiffs and explore the marshes as they made their way to Lake Pontchartrain. “For me, it’s never been hunting or fishing or photography,” Dave said. “It’s been hunting and fishing and photography— they’ve always gone together.”

LEGENDARY LIVING

As he started his freshman year at Southeastern Louisiana University, Dave upgraded to a Canon SLR camera and began selling images through a local frame shop. “It was the first time I ever connected photography with the potential to earn money,” Dave said. “I set my sights on the outdoor magazines.” Dave taught himself photography by doing it and by seeking the advice of mentors such as Wyman Meinzer, David K. Langford and Jerry Smith, who in the 1980s and 1990s was considered the “King of the Whitetail Photography.” Smith gave Dave two pieces of advice that provided the framework for his photography career. It was the era of slide photography. Smith told Dave if he was worried about spending too much money on film to quit because the only way to progress as a photographer was taking a lot of photos and throwing out all of the bad images. “I could build a house with all of the slides I threw away, but I learned to keep only the best,” Dave said. Smith also advised the then-college student to finish earning his marketing degree and get a steady job. “He told me to make photography my ‘professional hobby’ unless I wanted to live hand to mouth for the rest of my life,” Richards said. “While I worked hard at photography, it’s always been my avocation, not my full-time job.” Upon graduation in 1984, an outdoor sporting goods sales job took him back to Texas, where opportunities for hunting, fishing and photography abounded. Focusing on Family Dave and Beth met at First United Methodist Church in downtown Corpus Christi.

“She sat behind me on the last Sunday I lived in Corpus,” Dave said. “I was moving to San Antonio with my job the following week.” As they walked to the parking lot, Dave asked her to attend an outdoor trade show with him that afternoon. “She said no to the event, but she didn’t say no to dating me,” Dave said laughing. In 1988, after two years of navigating the distance between Corpus and San Antonio, they were married. Beth put her business administration degree from Bowling Green State University to work as a computer programmer, while Dave worked as a sales rep for Outdoor Sports Headquarters before becoming a manufacturer’s rep in 1992 for several outdoor companies including Leupold optics. In their off hours, Beth cultivated her creativity with arts and crafts, while Dave often took to the field to hunt, fish and photograph. “I always loved the outdoors, but initially it wasn’t Beth’s great love,” Dave said. Beth wasn’t a hunter, but she was an angler and always ready to vacation in places such as Alaska or Yellowstone. “Even though Beth didn’t always go hunting with me, she never denied me an adventure,” Dave said. “One of the great gifts of our relationship is the trust we share.” In 1996, the family grew to three with the arrival of James. In 1999, Joseph was born. Beth left her career to focus on raising the boys. The family staked a claim to a two-acre homestead near Boerne, which provided a big outdoor playground for the youngsters. “Our boys were never video kids,” said Beth, who had grown up fishing and camping with her family in Ohio, New York and Massachusetts and wanted her children to have those same types of experiences.

As small boys, they brought piles of “natural treasures” such as rocks, leaves and dirt onto the back porch and used them to build habitat for their plastic animals in the lid of a huge Rubbermaid container that held their toys. “They spent their days outside roaming around our property just being boys,” Beth said. James and Joseph began accompanying Dave to photo blinds on South Texas ranches such as the Hindes Ranch and the West Brothers Ranch before they were tall enough to see out of a ground blind. “We used to stack things in our chairs, just trying to see,” Joseph said. They learned to be quiet and be patient. On each excursion, they were rewarded with outdoor fun like plinking cans or fishing in a stock tank. “Dad always made it fun, so we were always ready to go,” James recalled. Then, after enough growth spurts, the boys got the ultimate reward—the opportunity to see everything Dave could and photograph the ranches’ superlative whitetails and other wildlife with their own cameras. “When I was finally tall enough to see out, I was like ‘Wow! This is worth being quiet for all of those hours,” Joseph said laughing. After each outing, the boys would show their photos to Dave. “Dad would always point out the good things in our photos, but he’d also suggest technical things that we could try next time,” James said. “Thanks to him, we could see progress in our images, which just kept us coming back for more.” Their outdoor experiences weren’t limited to photography, hunting and fishing. Scouting was also part of the mix, so they hiked and camped. James and

Joseph earned the rank of Eagle Scout, as had Dave and his four brothers. “Regardless of what we did, though, we always had cameras with us,” Dave said. “It is just part of who we are and what we do as a family.” Because Beth homeschooled the boys until they were in high school, the family had the opportunity to travel year-round. “When the boys were little, we went to Disney a couple of times, but they made it clear they would rather be out in nature,” Beth said. “Our family vacations turned to family photography shoots.” Together, they traveled throughout United States and Canada focusing on wildlife amidst stunning landscapes. In August, they spent a week in Montana and Canada. It was summer’s last hurrah before James, a recent graduate of Abilene Christian University returned to his job as student ministries coordinator at Christ Church in Plano and Joseph returned to Texas A&M, where he is double-majoring in entomology and wildlife and fisheries sciences. “As for me, I love the mountains,” James said. “There is something about mountains and the beauty there that make me feel especially close to God.” In 2017, they made their first trip to Africa where James had completed a seven-week internship with Kingdom DNA. Afterwards they photographed the Zula Nyala, Hluhluwe-Imfolozi Game Reserve, St. Lucia River, and the Phinda Game Reserve together. “While each trip has its own special memories, going to the west coast of South Africa, photographing all of the animals—cheetahs, giraffes, rhinos, lions, elephants and everything else—in the wild, and experiencing that for the first time together as a family was an incredible gift,” Joseph said.

The Focal Point Over the years, the family has traveled thousands of miles and shot thousands of images—and yet their passion for the outdoors and the artful skill of photography hasn’t waned. “In outdoor photography, nothing is constant—light changes, animals move, weather breaks—it’s a challenge to capture a moment in time as you’re seeing it,” Dave said. “Mother Nature doesn’t have a rewind.” Each of the Richards’ men brings a different perspective to their work. Dave, influenced by the magazine covers of his youth, prefers natural portraiture that captures big game in the context of its habitat or behavior shots that catch a buck curling its lip or rubbing its marking limb with its forehead gland. James is drawn to action and he strives to capture a moment in time that most people have never seen such as a bighorn sheep running with all four feet in the air. Joseph seeks out the intricacies of nature at the macro-level concentrating on things like insects, amphibians or the feather patterns of a game bird to help people consider the world from a different level. “All three of us can be in the same place on the same day for the same amount of time and we will all come back with a completely different set of images,” Dave said. Seeing the world through one another’s eyes is a crucial part of the experience. “The best part of the day is when we all come back in from the field and start comparing shots,” Joseph said. “It’s exciting to see who got that really great, unexpected shot that makes you stop and reconsider the world because it shows you something new.” Beth, who on these trips observes wildlife through binoculars to enhance the realism of her drawings, now travels with a video camera in tow and captures the scene from a fourth perspective. “The sound of their cameras clicking is the soundtrack to my videos,” Beth said. “The video allows them to see the big picture as it unfolded.” While memorable, one-of-a-kind images are definitely trophies, the ultimate rewards of their shared passion can’t be contained within a picture frame. “Joe and I are incredibly close now—and we’re very close to our parents,” James said. “Outdoor photography provided the opportunity for us to spend a lot of time together, so the really important things like our relationships and our faith had a medium on which to grow.” While photography provided common ground for the family, the photos plant seeds of awareness in others that can blossom into a conservation ethic that changes the world. “Not everyone has an opportunity to experience the majesty of nature for themselves, so our images can help promote an appreciation for what exists in God’s great creation,” Joe said. “Appreciating nature is the first step in conserving it for future generations. We’re humbled if our images can play a part.” °

Chasing Blues Through the Texas Chaparral Story by Greg Simons

After the second covey encounter with no birds in bag, I pleaded, “Guys, if you continue to hunt these birds in a gentlemanly fashion, we may never have enough birds for the quail meal that is on the dining menu for this evening.” This was the first time that these three gentlemen had hunted blue quail together, and though each were experienced quail hunters, both with blues and bobs, there was that natural tendency for each of them to not breach proper quail hunting etiquette that’s commonly held for bobwhites. The problem is that blue quail do not observe the finer gamebird principles as bobwhites; rather, they are more rogue and prone to run like members of a gang who are scattering from law dogs. I then instructed them, “Okay, amigos, on this next covey, I want all three of you to dismount the truck as safely and quickly as possible, chamber a round, and take pursuit of the birds, not worrying about if the next guy is lagging behind. Be safe but be aggressive.” As we came to a screeching halt near a water trough, with some 30–40 birds scurrying through the creosote like they were on skateboards, my tres amigos launched from the crew cab F-250 as I spouted, “If you have to pot-shoot them on the ground like cottontail rabbits, then do so. Take no prisoners.” Over the next 15 minutes I heard no less than 15 shots, watching them wind through the brush and up the side of a rocky hill covered in lechaguila, with David almost taking a spill. When they returned, they were beaming from ear to ear with 7 beautiful birds in their bag. “I think we figured how we need to play this game together now,” were the words of Jim, as he was picking thorns out of his shin.

THE BIRD Scaled quail (Callipepla squamata) is the proper common name for these birds, more often referred to by hunters as blue quail, which is derived from a bit of a bluish grey hue that you see in their beautiful plumage, which also has a flecked or scaled pattern. They have a white tuft of feathers that spike up on the top of their head, and I’ve occasionally heard people refer to them as cotton tops. Here in Texas, you’ll find blues in the western areas of South Texas, all across the Trans-Pecos, and much of the Panhandle, especially the western two-thirds of this region. Blues are a bit larger than bobs, requiring a slightly heavier load to properly anchor them. They are known as runners, and since they tend to congregate in large coveys, sometimes 30–40 birds, it’s an impressive sight to see these larger groups of birds navigating their way so effortlessly through the scrubby brush and cactus, and when you have that many birds bust into the air, it can be a startling thunder of noise. You’ll find blues in both flat country, as well as steep rocky terrain. Blues are opportunistic in their feeding habits, consuming various seeds through the course of the year, greens when the rains provide weed growth, plant fruits from various plants including prickly pear, and insects when such arthropods are available. When prickly pear tunas are red and ripe, I’ve seen blue quail with purplish faces, so they obviously find prickly pear fruit to be highly attractive, as do many other wild critters.

High brass loads offer a little more punch for blue quail, which are a little heftier than bobs. —top left Stacking rocks in water troughs is one method of creating wildlife friendly perches for birds and small mammals. —top middle Though blues do not always hold well for pointing dogs, when ground cover is sufficient, these birds can be effectively hunted with good dogs. —top right Blue quail hunting is conducive to friends who are looking for some outdoor action that is conducive to great camaraderie. —bottom

M A N AG E M E N T C O N S I D E R AT I O N S Blue quail are classic “boom-bust” critters, in terms of how the numbers can erupt in a matter of a year or two, and how they can also melt down in a given year. Part of the key in boom years is Mother Nature providing adequate rainfall at critical times of the year, especially late winter through early summer, which not only yields suitable nesting cover, but also produces a buffet of quail foods. So, what can the quail manager do to help create man-controlled needs for these birds? Provision of surface water is a great start. These dessert-type birds do metabolize a great deal of their moisture needs from the foods that they eat, but never under-estimate the importance of water for quail and other wildlife in arid regions. Earthen ponds that rely on rain-water runoff are great but are not as predictably reliable as water that is pumped up and piped into troughs. A key is making sure that birds have good access to these water sources via trough overflows or through platforms such as rocks or expanded metal ramps that allow birds and small mammals to an access perch. Cattle grazing can be an asset or a liability for blue quail, with the key being grazing pressure that is not too excessive. Hoof action from cattle can help prevent soil capping, and moderate grazing of native grasses can add to the fitness of those plants, but scalping the landscape through intense grazing pressure over long periods of time can rob the habitat requirements for blue quail and other wildlife species. Sound grazing practices in these drier, more brittle ecosystems can be central to maintaining healthy, functional ecological productivity, including habitats required for blue quail. Stocking rate and timing/amount of stock deferment are the two main considerations to a sound grazing regime.

THE HUNT Unlike bobwhites, there are not many commercial hunting operations for blue quail, so finding an outfitter who offers blue quail hunts or finding a blue quail lease is not necessarily an easy quest. As mentioned earlier, the normal style of hunting for blues is generally much different than that employed by bobwhite hunters who are more accustomed to hunting over pointing dogs. As described earlier, hunting blues is often more of a chase on foot, but hunting from buggies is relatively popular as well. Though few outfitters offer packages that involve hunting blues with dogs, Ryan O’Shaughnessy, with West Texas Quail Outfitters, has carved out a niche of offering high-end packages with welltrained dogs that are bred for hunting blue quail. Named Orvis’s Outfitter of the Year in 2018, you can check out Ryan’s information at WestTexasQuailOutfitters.com. While discussing blue quail hunts, I’d be remiss not to mention that blue quail provide excellent table-fare, with my favorite recipe being one that I cook the breast meat in a cream of mushroom base with fresh mushrooms, garlic and onions, placed over brown rice, and I chicken-fry the legs as an appetizer; book a quail hunt and try it out. . . you won’t be disappointed! ° The author, Greg Simons, is a wildlife biologist who co-owns two companies that assist private landowners with needs related to hunting programs and wildlife management. The Historic Circle E Ranch is a high-fenced hunting ranch located in one of the most sought after areas near Houston and College Station. The ranch is one of the more unique properties in the area and is a perfect combination for the outdoorsman, conservationist and cowman alike. The ranch consists of 2,096 manicured acres with a water feature around every corner. There are fertile coastal fields mixed in with thick brush, ideal cover for whitetails and exotics. There is a 60-acre lake located in the middle of the property that is home to outstanding fishing and duck hunting. The entire ranch is high fenced with multiple cross sections for managing the cattle and exotic stocks. There is an exceptional road system on the ranch that includes roads along every fence for easy maintenance. Full turn-key property with all animals and rolling stock being sold and ready for move in. Habitat The rolling terrain of the ranch is a perfect mix of large oak trees and towering pine. The pastures are all in improved grasses and provide plentiful grazing opportunities for cattle and many of the exotics. On the edges of the brush are food plots that are perfectly located near bedding areas. Mooring Creek divides the property, and large oak trees are lined on its banks making for some of the best whitetail habitat on the ranch. Across the property you will find 16 bodies of water that are home to wood ducks and migrating waterfowl in the Fall and Winter months. These bodies of water are also great habitat for the Père David’s deer, elk, red deer and Asian water buffalo. Wildlife Circle E Ranch is home to 25 species of native and exotic wildlife. Exotics: These animals are intensely managed for hunting and conservation. Many of the exotics on the ranch are highly desirable species, with females being more valuable than the males; these species are know as “Super Exotics.” Ranches across Texas are

seeing impressive returns on super exotics. Many of these species are becoming lost in their native lands and only found on Texas ranches. The ranch is cross fenced for exotic management purposes. Whitetails: The property has been highly managed with highly improved whitetail genetics. The owner has released bred does, bucks and fawns to improve the genetics of the herd. It is easily noticed that these are not your typical Central East Texas whitetails. Hunting: The ranch specializes in corporate hunting. The lodge can accommodate both large and small groups of executives. Hunting tactics range from spot and stalk to safari style, or enjoy a comfortable hunt in one of the large hunting blinds. Improvements Lodge: The owner spared no expense when building the lodge on the Circle E. The lodge has seven bedrooms and seven bathrooms. Many of the suites have large bathrooms with jetted tubs and large showers. There is a cook’s kitchen located just off of the dining area with granite countertops. The great room has 18foot ceilings with a large fireplace and plenty of room to display your trophies with a wet bar located within. Around the rock fire pit you will find plenty of room to celebrate your hunt with friends and family. There is a large bunk room located upstairs that is perfect for children. Water: There are 16 bodies of water on the ranch with one being a 60-acre fishing lake and many of them being over four acres. Off the main lake there is a pivot that is supplied with water from the lake to irrigate the coastal field. Mooring Creek transects the property providing great cover and water in the wet season. All of the lakes and ponds have been intensely managed for trophy bass and striper fishing. °

RIO BLANCO RANCH

Protected for decades by a well-known non-profit, this idyllic Hill Country ranch is being offered for the first time in seven tracts. Lying in the heart of the Texas Hill Country along the edge of the Edwards Plateau, this property boasts the iconic Devil’s Backbone ridge, a prominent geographic feature in Hays and Comal Counties. Towering cypress trees line the pristine, deep-water frontage along both sides of the Blanco River for a mile. Panoramic vistas of the surrounding Hill Country from the Devil’s Backbone and the twelve additional mesas on the ranch are unmatched. Since the mid Twentieth Century, this 1,815-acre ranch has been preserved in its natural state, evidenced by the land stewardship of the previous owners. Rio Blanco Ranch has frontage on both sides of the Blanco River. The Harry E. Bovay, Jr. low-water dam and crossing provides a cypress-lined, blue hole stretch of river for fishing, kayaking and swimming. Carpers Creek and Dutch Creek, which are located just up the river, help feed the deep water along the property’s banks. There are several water wells on the property that service the ranch amenities. 250-acre to 536-acre tracts available. $11,500 to $25,000 per acre.
