MANILA, Nov. 7 (PNA) – President Rodrigo R. Duterte cancelled on Monday a rifle deal between the Philippine National Police (PNP) and a United States supplier, saying the country could look for another but cheaper source. The order for about 26,000 M4 assault rifles from the US has already been made but was placed on hold by the US State Department due to concerns by a US senator over alleged human rights violations in the Philippines. In a speech during the signing in Malacanang of the Executive Order on the reconstitution of the Bangsamoro Transition Commission, the President announced that he has ordered the PNP to cancel the order and said that the country could just look for other but cheaper sources. “You know, I would like to announce now that the 26,000 of

MANILA, Nov. 7 (PNA) – The trilateral agreement among the Philippines, Indonesia and Malaysia is expected to address the porous security area in the neighboring countries’ waters once it takes effect. Armed Forces of the Philippines (AFP) spokesperson Brig. Gen. Restituto Padilla said the presence of military forces in maritime areas of common concern of the three nations would secure ships passing the area, allowing trade to grow faster. Chinese investors eye 6,000-hectare tea plantation in MILF territory MANILA, Nov 7 (Mabuhay) – Interior and Local Government Secretary Ismael Sueno on Monday said he will meet with leaders of the Moro Islamic Liberation Front (MILF) to help Chinese investors set-up a 6,000-hectare tea plantation within the rebels’ controlled territory in Mindanao. Sueno said Chinese agriculture officials told him during President Rodrigo Duterte’s visit in China last month that they have found a prospective area for the tea plantation in the Autonomous Region in Muslim Mindanao. He added that the Chinese officials, including the chairman of the Bank of China, told him they have been wanting to put up a tea plantation, but they cannot do it in China because soil in their country is contaminated. MANILA, Nov. 7 (PNA) – Police personnel who fail to observe the standard operational procedure (SOP) in serving search warrants would face sanctions, the Philippine National Police (PNP) assured on Monday. PNP Deputy Director General Francisco Uyami, Jr. made the assurance in the wake of reports that police serving search warrants against slain Albuera, Leyte Mayor Rolando Espinosa at the Leyte sub-provincial jail in Baybay town last Saturday failed to observe the SOP. “The PNP assures the public that necessary sanctions will be charged on any personnel who will be found violating the standard operational procedure during the serving of search warrants,” Uyami said in a press conference at the PNP headquarters in Camp Crame. The PNP has started a probe into the incident involving the personnel of the Criminal Investigative and Detection Group (CIDG) led by Chief Insp. Leo Laraga who allegedly figured in an armed engagement with Espinosa and another another inmate, Raul Yap. Both Espinosa and Yap succumbed to gunshot wounds. Reports reaching the PNP National Headquarters showed that during the search in the detention cell of Espinosa, a small heat-sealed sachet containing “shabu” was found while police recovered 10 big heatsealed sachets containing “shabu”, 27 big heat-sealed sachets containing dried marijuana and assorted drug paraphernalia in the cell of Yap. The Scene of the Crime Operation (SOCO) Team were also able to recover one caliber Super .38 pistol in the cell of Espinosa and another caliber .45 colt commander in the cell of Yap. The search was ordered by Basey, Samar, Regional Trial Court Branch 30 Presiding Judge Tarcelo Sabarre, who issued separate search warrants for alleged violation of Republic Act No. 10591, or the “Comprehensive Firearms and Ammunition Regulation Act”, against Espinosa and alleged violation of RA 9165, or the “Comprehensive Dangerous Drugs Act of 2002”, against Yap.

In a press conference in Camp Crame, Quezon City, PNP Director for Operations Chief Supt. Camilo Cascolan said that under the PNP Anti-Illegal Drugs Campaign Plan “Double Barrel”, a total of 3,034,572 houses were visited wherein a total of 759,844 personally appeared or surrendered to authorities. Cascolan noted that of the total number of surrenderers, 704,785 are drug users while 55,059 are drug pushers. He said that a total of 34,002 drug operations were conducted wherein 33,255 personalities were arrested such that 14,085 of them are drug users and 19,170 are drug pushers. Likewise, a total of 1,795 drug personalities were killed during the police operations.

MANILA, Nov. 7 (PNA) – Interior and Local Government Secretary Ismael Sueno on Monday ordered National Police Commission (NAPOLCOM) to conduct a parallel investigation on possible culpability of police into deaths of Albuera Mayor Rolando Espinosa and Raul Yap inside cell in Leyte last Saturday morning. Sueno said that NAPOLCOM had the top priority to initiate its own probe in the incident considering that it was the agency mandated under the law to exercise administrative and operational supervision over the Philippine National Police (PNP). “NAPOLCOM should make this (probe) as their top priority. We have to know what really transpired

on that day. We owe the family of the slain inmates and the public a factual and detailed account of the incident,” said Sueno. He also said that while he had no doubts with the Philippine National Police-Internal Affairs Service (PNPIAS) to led probe, he wanted to assure the public on the reliability of results through the authority of NAPOLCOM to conduct pre-charge investigation of police anomalies and irregularities and summary dismissal of erring police officers. “While the PNP’s Internal Affairs Service (PNP-IAS) has automatically started its own investigation, it is still necessary for NAPOLCOM to get into the picture to lend integrity and credibility to the probe and to answer involved questions behind,”

Aside from NAPOLCOM, Sueno said that the PNPIAS Headquarters (IAS HQ) and Regional IAS 8 (RIAS 8) had been working for the initial motu-propio investigation of the incident in Baybay City Sub-Provincial Jail. IAS HQ has requested both the Criminal Investigation and Detection Group (CIDG) Headquarters and CIDG Region 8 office for the names of at least 15 operatives who were involved in the operation. RIAS 8 has also conducted an ocular investigation in said jail. The process of obtaining affidavits and the review of relevant documents to determine possible violations of Police Operational Procedures (POP) is still under process.

DOTr strictly implements ‘no gifts’ policy MANILA, Nov. 7 (PNA) – Department of Transportation (DOTr) Secretary Arthur Tugade has reiterated to all officials and employees of the department to not accept gifts of any kind from individual or organization such as vendors, suppliers, customers, employees, potential employees and potential vendors or supplies to avoid conflict of interest and uphold a high standard of ethics in public service. “Soliciting or receiving any gifts is not allowed. Avoid any kind of gifts even though it was voluntarily given to you for Christ-

mas,” Tugade said at the department’s flag raising ceremony Monday. He warned that he will be “unforgiving” to all officials or employees who will receive or solicit gifts. This is one way to demonstrate the department’s commitment to treating all people and organizations, with whom it come into contact or conduct business with, impartially. “I have a way of knowing it. We expect na kidnapping will rise because of the anti-illegal drug operations,” Senior Supt. Manolo Ozaeta, head of the PNP Anti-Kidnapping Group, said. “I cannot discount what the President has told sa IBP [Integrated Bar of the Philippines]. Sabi niya on the rise ‘yung kidnapping,” he added. On Friday, Duterte said, “There’s a very low supply of

drugs now. But, nag-shift na naman sa kidnapping ang mga g*go. So bagong laro naman ito.” “We are expecting it since after the anti-drug campaign. Magkakaroon talaga ng relativity, may connection. Ibang krimen pa, hindi lang kidnapping ‘yung tataas kundi yung theft, robbery,” Ozaeta said. He added they are now monitoring at least two criminal groups using the government anti-illegal drugs campaign to get their victims. “May dalawang grupong tinutukan ang Anti-Kidnapping Group. Ang modus ay nagpapakilalang authority na may warrant ka sa drugs. ‘Pag nakuha na ‘yung tao saka kukunan ng ransom,” he said.

Ozaeta said the first group uses the name of the PNP while the other uses the name of National Bureau of Investigation. He said they are now handling two cases of kidnapping involving a Filipino and a Korean national in Metro Manila. This is separate from the six kidnapping cases earlier mentioned, Ozaeta said, adding that the families of the victims paid some P5 million to P20 million ransom. Of the six cases, the families of the four victims refused to cooperate with police while the other two were helping them file cases against the suspects. He said one of the suspects is an active police officer whom he refused to name.(MNS)

Mega rehab facility in Nueva Ecija open to both indigents and non-poor needing inpatient care, says health chief By Leilani S. Junio

MANILA, Nov. 7 (PNA) – The Mega Drug Treatment and Rehabilitation Center in Fort Magsaysay, Nueva Ecija that will be inaugurated on Nov. 29 will be open to both indigents and non-poor drug surrenderers who need in-patient care, Health Secretary Paulyn Jean Rosell-Ubial has said. The facility, which can accommodate up to 10,000 patients, will not cater to specific types of patients, Ubial said. She expressed hope that the center would fully serve its purpose, which is to treat and rehabilitate drug dependents, whom she said are “victims” who should be given help so they could be guided back to mainstream society as productive citizens. “We want to ensure that they are provided adequate and compassionate services,” she said, noting that the facility is scheduled to open on Nov. 15 but its inauguration will follow the schedule of President Rodrigo Duterte. Ubial said that those who will be referred to the facility will be assessed by doctors and health workers from the

different local government units who attended the training courses conducted by the health department. These courses are aimed at addressing the country’s drug problem, in support of the President’s goal to curb the drug menace besetting the nation. Each patient referred to the facility will be categorized as outpatient or inpatient, she said, adding that the center is likely to attract drug dependents from nearby provinces, such as Pampanga and Tarlac. Ubial said those who can afford to pay will be charged “accommodation expenses” but “it will be free” for those who have no capability to pay. She further said that her department plans to transfer “on a voluntary basis” some patients from over-crowded drug rehabilitation facilities in Bicutan, Tagaytay and Bataan to the center. She also said that the department is considering arranging bus services so that patients’ families could easily visit them and provide them support as they go through rehab. Meanwhile, Ubial said the budget for the operation of the

facility next year will come from the General Appropriations Act of 2017. In the meantime, the health department will use its Quick Response Fund (QRF) for operational expenses, including the salaries of hired health workers. The QRF is intended for any emergency or any unplanned, unforseen eventuality in the health sector. “The fund can be (used) for any public health emergency and the (drug) surrenders we have now are considered a public health emergency,” the health chief pointed out, explaining that drug addiction is actually a mental health problem. Earlier, the health department announced that the construction of the mega rehab facility was made possible through the philanthropic act of a Chinese businessman, who expressed interest in helping the Duterte administration in its campaign against illegal drugs. The President has emphasized that the country’s drug problem has already reached a level that threatens the future of the next generation.

Across the board pay hike needs Congress nod: Bello MANILA, Nov. 7 (PNA) – The Congress has the jurisdiction over the across-theboard increase in the salary of workers, the Department of Labor and Employment (DOLE) said on Monday. Labor Secretary Silvestre Bello III noted that it is the legislative branch, not the executive department, has the best position to act on demands for a nationwide PHP125 daily wage increase, citing Republic Act 6727 or the Wage Rationalization Act.“We are into adjusting wages of our workers. But an across-the-board wage increase is not within our mandate,” he explained. Bello added, “It is under the jurisdiction of Congress. It has to go through a legis-

lative act.” However, the DOLE chief said that all Regional Tripartite Wages and Productivity Boards (RTWPBs) are under the directive to conduct wage reviews and public consultations to determine possible wage adjustments in their respective jurisdictions. “Different regions have different socio-economic conditions and cost of living conditions. We have to consider these conditions,” Bello said. “The Regional Wage Boards will continue with their reviews and consultations on the salary adjustments at the regional level. They are conducting periodic assessment of their respective regions. They will

be the ones to submit their recommendations if there is a need to increase the wage in their region,” he added. Bello said that any increase in wages will have implications on the cost of doing business, production, employment and prices. He also cited the simulation study made by the National Economic Development Authority (NEDA) on the impact of the proposed PHP125 wage increase. Based on the study, the additional wage could result in upward pressures on prices from 2017 to 2018, the strongest of which could be felt in 2017, when inflation could rise to 9.7 percent from a baseline of 2.1 percent.

MANILA, Nov. 7 (PNA) – A total of 333 Filipino nurses, caregivers will undergo six months of preparatory Japanese language training in three different venues, the Embassy of Japan said on Monday. The embassy said the participants belong to the 9th batch to undergo such training implemented through the collaborative efforts of the governments of Japan and the Philippines. ”This endeavor goes beyond their standing commitments in the Japan-Philippines Economic Partnership Agreement (JPEPA) and aims to further assist Filipino candidate nurses and caregivers in passing the Japanese Licensure Examinations after they enter and work in Japan,” the embassy noted. In his recent visit at the Technical Education and Skills Development Authority (TESDA) Women’s Center in Taguig City, Japanese Ambassador Kazuhide Ishikawa told participants that

even if they have the knowledge and skills to be great nurses and caregivers, they could not work well without the ability to communicate with their patients and colleagues. ”To be successful in this new endeavor, you will need to elevate your Japanese language proficiency. Not only will it determine your chances of passing the Japanese national examination, but it will also make a huge impact on your overall experiences in Japan. The envoy also highlighted that the Japanese Emperor and Empress are very much interested in this program, as they have observed a Japanese language lesson being conducted for the batch 8 last January. The Japanese Embassy said the training will be held at the TESDA Language Skills Institute, at the Nihongo Center Foundation Inc., and the PAD (Personal Ability Development) Foundation Inc. MANILA, Nov. 7 (PNA) – The Department of Social Welfare and Development (DSWD) on Monday backed the Department of Agriculture’s (DA) campaign to bring healthy eating habits and diets back to every Filipino home by encouraging the consumption of brown rice as an alternative to white rice. The agriculture department’s #BROWN4goodChallenge campaign promotes the consumption of brown rice to promote good health among Filipinos, and support Filipino farmers by encouraging the purchase of their produce. The campaign highlights the National Rice Awareness Month (NRAM) this November but will be extended until

The campaign enjoins everyone to consume brown rice as it has more nutritional value than polished rice in terms of vitamins, minerals, protein, and antioxidants; helps prevent cardiovascular diseases, cancer and Type 2 diabetes; lowers blood pressure; and reduces the chance of overeating because of its higher satiety level. Caliwan MANILA, Nov. 7 (PNA) – The Department of Justice (DOJ) on Monday said it respects Senator Leila De Lima’s decision to file a petition for writ of habeas data against President Rodrigo Duterte before the Supreme Court. ”DOJ respects the right of Senator De Lima to file cases she believes should be filed. Karapatan po ‘yan ng bawat Filipino (That is the right of every Filipino.),” DOJ Undersecretary Erickson Balmes told the Philippines News Agency (PNA). DOJ Secretary Vitaliano Aguirre II earlier said that the plan of Senator Leila De Lima to file a case against President Rodrigo Duterte will not prosper. “Nothing will happen on that. She will be going against a well-established doctrine. I don’t think the SC (Supreme Court) will allow that because otherwise everybody will file cases

against the president that will waste his time,” Aguirre told reporters in a press conference last October 12. The DOJ chief made the statement after De Lima bared her plan to file petitions before the SC which seeks the issuance of a writ of habeas data and writ of amparo that will also, in effect, test the doctrine of presidential immunity from suit. Aguirre said De Lima cannot be granted privileges under the writ of habeas data and writ of amparo. “Her life, liberty or property is not in danger so these writs don’t apply to her case,” he explained. On Monday, De Lima filed a 26-page petition for writ of habeas data against President Duterte before the high court in a bid to test the President’s immunity from suit. ”This case presents a novel issue of transcendental importance: Can a sitting President wage a personal vendetta against petitioner and use the resources of his powerful office to crucify her

as a woman, a human being, and a duly elected senator in violation of her right to privacy in life, liberty and security?” the petition read. The petition stated that de Lima has been “repeatedly subjected to crude personal attacks” by President Duterte which involve the “wrongful collection and publication of her alleged private affairs and activities that are outside of the realm of legitimate public concern.” President Duterte previously tagged de Lima as responsible for the proliferation of illegal drugs inside the New Bilibid Prison (NBP) when she was then Justice Secretary. Gov’t elevates bid for gender-fair media

MANILA, Nov. 7 (PNA) – Government further pushed its campaign to promote women empowerment and gender equality nationwide. On Monday (Nov. 7), Presidential Communications Office (PCO) spearheaded in Metro Manila a forum on mainstreaming gender fairness in Philippine government media to help achieve such goals. PCO believes both goals are essential in enabling women to become more productive citizens and better contribute in moving the country forward. “I hope this day will mark, for government workers, start of a new chapter in promoting awareness about women empowerment and gender equality nationwide,” PCO chief Sec.Martin Andanar said in a message his chief of staff Marvin Gatpayat read at the ‘Forum on Gender-Fair Media for Government Communicators.’ Citing a 2016 report, Andanar said the Philippines already ranks first in Asia and seventh globally in terms of gender equality. PCO still decided spearheading the forum as he said government itself must lead the way in further promoting equality among sexes. “Using gender-fair language is one way of ending sex-based discrimination,” he said. PCO Gender and Development Focal Point System Chairperson Enrique Tandan III agrees. Language activates people’s consciousness and promotessocialization, he also said at the forum. He noted language reflects culture as well. Among government’s earlier efforts to promote gender equality and women empowerment were establishment of the Presidential Commission on Women (PCW) and enactment of RA 9710 (The Magna Carta of Women). PCW is supporting PCO’s gender-fair initiatives, noting almost a tenth of media reports resonate with gender equality concerns. Women account for only one in four people the public either hears or reads about in media, PCW continued. Men hold nearly a third of top jobs in media, PCW noted further. “The need for gender sensibility still holds true up to the present,” PCW Chairperson Dr. Rhodora Bucoy said in a message the commission’s information officer Nikki Francisco read at the forum. Dr. Bucoy said RA 9710 discouraged discrimination against women. According to RA 9710, discrimination against women refers to “any gender-based distinction, exclusion, or restriction which has the effect or purpose of impairing or nullifying the recognition, enjoyment, or exercise by women, irrespective of their marital status,on a basis of equality of men and women, of human rights andfundamental freedoms in the political, economic, social, cultural, civil, or any other field.” “It includes any act or omission, including by law; policy, administrative measure, or practice, that directly or indirectly excludes or restricts women in the recognition and promotion of their rights and their access to and enjoyment of opportunities, benefits, or privileges,” RA 9710 also reads. RA 9710’s Sec. 16 promotes non-discriminatory and non-derogatory portrayal of women in media and film, Dr. Bucoy continued. Sec. 16 requires the State to “formulate policies and programs for the advancement of women in collaboration with government and non-government media-related organizations” and to endeavor raising “consciousness of the general public in recognizing the dignity of women and the role and contribution of women in the family; community,and the society through the strategic use of mass media.” “For this purpose, the State shall ensure allocation of space; airtime, and resources, strengthen programming, production, and image-making that appropriately present women’s needs, issues, and concerns in all forms of media, communication, information dissemination, and advertising,” Sec. 16 reads further. PCW Gender and Development Resource Pool member AllenLiberato-Espino warned about stereotyping women in media andportraying them in a bad light. “What media disseminates affects people’s thinking,” she said at the forum. She cited several product advertisements with female sexual overtones and discouraged media campaigns like these. “We’re all born with the same set of human rights - dignity isn’t attained but deserves everyone’s respect,” she said. Discrimination in media is a form of violation, she added.

Leila De Lima and others and who have testified in the House of Representatives Justice Committee hearings on the Bilibid Drug Trade, have expressed to me their grave concern over the killing of Mayor Rolando Espinosa while in jail under what can only be termed as highly suspicious circumstances. They said that, now more than ever, they fear for their lives and those of their kin,” Atty. Ferdinand Topacio said, who serves as counsel for inmates Peter Co, Vicente Sy, Herbert Colanggo, Jojo Baligad, Joel Capones, German Agojo, Jerry Pepino and Noel Martinez. to death Saturday after allegedly firing shots at members of the Philippine National Police’s Criminal Investigation and Detection Group (CIDG) Region 8 who were serving a search warrant. Topacio visited his clients Peter Co and Vicente Sy last Nov. 3. They made a follow up on their request relayed to the Bureau of Corrections (BuCor) seeking to transfer them to facility more secure than Building 14. Co and Sy were among those who were severely injured with stab wounds in a melee at Building 14 of the NBP wherein inmate Tony Co died. Topacio said he had sent a formal letter to the Bureau of Corrections (BuCor) reiterating their request. Unfortunately, his clients were still transferred to Building 14. “The killing of Mayor Espinosa struck a raw nerve on my clients in view of the fact that, since the start of the process wherein they volunteered to be witnesses, it has been their perception – which I share – that the Bureau of Corrections has taken a less than prudent attention towards their safety and well-being,” he said in a statement.

Duterte assures freedom of expression, press in PHL MANILA, Nov. 7 (PNA) – President Rodrigo Duterte on Monday assured to uphold freedom of the press and expression in the country under his leadership. In front of the newly-elected National Press Club (NPC) officers, President Duterte likened the press freedom in the Philippines to the United States where there is no pressure. ”Here in our country, press freedom is thriving, it’s working,” President Duterte said in his speech before the oath-taking of the NPC officers led by its president Paul Gutierrez at Malacanang Palace. President Duterte’s first administrative order was the creation of presidential task force that will protect members of the media from violations of their right to life, liberty and security. ”The problem here in our country is the continued killings of media people. Of course, by itself, this fundamentally hideous and wrong,” he said. The President emphasized the role of the media

as the fourth state which fights “the abuses of the first and second or third branches of government.” ”Remember that freedom of press mostly against establishment, the state and its abuses and that is why the fourth state is there to fight the abuses,” he added. Under the Administrative Order No. 01 he signed last October 11, the Duterte administration declares as a matter of policy that all of the forms of political violence and abuses of power, whether by agents or elements of the State or of non-State forces against the members of the so-called Fourth Estate must stop. The United Nations Educational, Scientific and Cultural Organization (UNESCO) said, on average, one journalist is killed every week around the world while the Committee to Protect Journalists reported that the Philippines ranks third in the world in terms of journalists killed in the line of duty.

Duterte said on Monday he will sign the Paris Agreement on climate change which seeks to limit global warming to well below 2 degrees Celsius. ”After so much debate, the climate change (agreement), I will sign it,” President Duterte said in his message during the oath-taking of the newly-elected National Press Club (NPC) officers at the Heroes’ Hall in Malacanang. President Duterte said he decided to sign the agreement after most of his Cabinet members voted in favor of what has been described as a landmark global deal to cut harmful carbon emissions that are causing climate change. ”Because it is a Cabinet decision, I will go along with it and sign it because the vote was unanimous except for one or two. I’m one of the two who are

arguing about it,” he said. ”As I have promised you, I will not solve this problem alone. I will give it, place it on the table, give the whole of the Cabinet to vote,” he added. The President said it took several hours for the Cabinet members to discuss the issue due to the carbon emission reduction committed by the previous administration by 2030. ”What they’re asking from us is only 0.3 percent but our national law says that over the years, we will have to reduce it by 70 percent. We’ll overshoot it by a thousand miles,” President Duterte said. He said if the law will not be amended, “it imposes a more stringent and strict number.” The President initially opposed the ratification of the agreement, saying it will prevent the Philippines from achieving economic and industrial growth target.

Palace assures ‘impartial’ probe into Espinosa’s death MANILA, Nov. 7 (PNA) – Malacañang assured on Monday a transparent and impartial investigation on the death of Mayor Rolando Espinosa of Albuera, Leyte last Saturday. Presidential Communications Operations Office (PCOO) Secretary Martin Andanar made the assurance after former President Benigno Aquino III said he will monitor the inquiries into the killing of Espinosa. ”We assure everyone, including former President Noynoy Aquino, that we are one with the entire country wanting to find out the truth surrounding the tragic death of Albuera town Mayor Rolando Espinosa,” Andanar said in a press statement.

Earlier reports said that at around 4 a.m. of Nov. 5, operatives of the Criminal Investigation and Detection Group (CIDG) Region 8 allegedly killed Espinosa and another inmate, Raul Yap, while they were serving a search warrant against the two detainees for supposedly keeping firearms and illegal drugs inside the provincial jail in Baybay, Leyte. ”We expect the Philippine National Police to handle the case with utmost transparency and impartiality, leaving no stone unturned in search for the truth,” Andanar said. Andanar reiterated that the administration of President Rodrigo R. Duterte does not condone and tolerate any summary killings.

Caregiver law requires overtime pay Under California law many caregivers must be paid overtime compensation when working more than 9 hours a day or 45 hours a week. In my experience, very few 24-hour caregivers are paid correctly. With California’s increase in the minimum wage to $10 an hour, many 24-hour caregivers must be paid a minimum of $315 a day to comply with the current law. If you are working as a caregiver and paid a day rate less than $315, under California law, you are not being paid any overtime and may have a substantial unpaid overtime claim. Oftentimes, employers attempt to avoid liability by claiming the caregiver is an “independent contractor.” In most circumstances, this argument will fail as typically employers maintain significant control over the caregiver. The change in the overtime rules for caregivers became effective on January 1, 2014, when the Domestic Worker Bill of Rights (DWBR) became law. Previously,

employees who qualified as “personal attendants,” including caregivers, nannies and babysitters who worked in private households did not qualify for overtime. The DWBR eliminated the overtime exemption for personal attendants and provides that personal attendants “shall not be employed more than nine hours in any workday or more than 45 hours in any workweek unless the employee receives one and onehalf times the employee’s regular rate of pay for all hours worked over nine hours in any workday and for all hours worked more than 45 hours in the workweek.” Now, caregivers, nannies and babysitters (with limited exceptions) must be paid overtime compensation. Unfortunately, this

law does not cover IHSS workers and those caring for close family members. Under Labor Code § 1194, caregivers are not only able to recover their unpaid overtime in a civil action, but they also may recover reasonable attorney’s fees and costs. California law also provides interest and penalties for workers who are not properly paid overtime compensation. If you are working as a caregiver who is not paid overtime when working more than nine hours a day or 45 hours a week, you should consult with an attorney to discuss your rights under this law. With all the penalties, interest and attorneys fees allowed, claims often exceed $100,000 for 24-hour employees working just over 1 year. BACOLOD CITY, Nov. 8 (PNA) –The 11th Philippine Bird Festival in Negros Occidental on Nov. 24 to 27 is expected to gather about 10,000 spectators, including domestic and foreign tourists who are bird enthusiasts. Provincial Supervising Tourism Operations Officer Cristine Mansinares said the event was positioned as a tourism activity that could provide fund for local conservation efforts. “It will bring in more tourists to visit the sites resulting to more income opportunities for the community in the local bird watching sites,” she said.

The four-day festival, themed Pagpanghangkat sa aton tanan, kabuhing ilahas aton amligan,” will be held as part of the 12th Provincial Wildlife Month this November. Gina Mapua, vice president of Wild Bird Club of the Philippines (WBCP), said the festival was a means of growing the appreciation and love of the Negrenses, especially children, on the Philippine birds which were the most wonderful species in the world. try. WBCP records showed that of the 740 bird species in the Philippines, 238 are endemic or can be found only in the country. US begins testing of inactivated Zika vaccine in humans

WASHINGTON, Nov 8 (PNA/Xinhua) – A US military lab on Monday began the first of five early stage clinical trials to test the safety and ability of an investigational Zika purified inactivated vaccine. Seventy-five healthy adults will be recruited to participate in the trial at the Walter Reed Army Institute of Research (WRAIR) Clinical Trial Center in Maryland. Given the concerns for immune enhancement with other similar flaviviruses, like yellow fever and Jap-

anese encephalitis, this vaccine will be tested in some volunteers who will first be vaccinated against one of these other flaviviruses, the WRAIR said in a statement. The study is expected to be completed by fall of 2018. The vaccine in the trial contains whole Zika virus particles that have been inactivated, meaning that the virus cannot replicate and cause disease in humans. However, the protein shell of the inactivated virus remains intact so it

can be recognized by the immune system and evoke an immune response. An earlier preclinical study found that rhesus monkeys that were vaccinated with the vaccine developed a strong immune response and were protected against two strains of Zika virus. WRAIR’s investigational Zika vaccine will also be included as a part of a US National Institutes of Health trial that began in August. The NIH study will test it as a boost vaccination

to its DNA Zika vaccine, which entered Phase one clinical trials in August. That vaccine uses a small, circular piece of DNA, called a plasmid, that is injected into the arm muscle to induce an immune response. In addition, three other Phase one trials to evaluate the new Zika vaccine are scheduled to launch later this years in St. Louis University, Beth Israel Deaconess Medical Center, Ponce Health Sciences University in Puerto Rico, respectively.

Davao dad to seek national support for health budget DAVAO CITY, Nov. 7 (PNA) – The city government here is eyeing additional financial support from the national government to make its health services more efficient. “We will ask Mayor Inday (Mayor Sara Duterte-Carpio) to add to the CHO’s (City Health Office) budget or if it is not possible then, maybe we can ask help from the national government,” said Councilor Mary Joselle Villafuerte, chair of the City Council Committee on Health. At present, the CHO has a PHP17-million budget which is not even 20 percent of the city’s PHP6.1 Billion budget for this year. CHO Chief Dr. Joy Villafuerte requested PHP24 million for this year’s budget but it was slashed to

only P17 million. Villafuerte said she asked CHO how much they need to provide the necessary health services to the city and was told that the office needs PHP74 million. Maybe we can ask more from the Department of Health (DOH), she said, adding that she has already presented the itemized document signed by CHO to DOH-11 regional director Abdullah Dumama, Jr. to help lobby for additional budget for the city in their supplemental budget. Among the health programs being implemented by the city are the World Sight day, programs to prevent non-communicable disease like hypertension and heart disease. Aside from the regular

programs, the CHO needs additional budget to hire more midwives and personnel and purchase more equipment. One of the city’s longterm health plans which will require funding is to transform the 17 health centers in the city into birthing centers. But while the Department of Health (DoH) has provided the city P80 million for the purchase of more modern medical equipment needed by the health centers, the city government still needs another P80 million to upgrade the health centers into maternity centers that will be able to respond to the regular birthing requirements of Davaoeños. The approval on third and final reading of an

ordinance establishing “Systems and Mechanisms for the Implementation of the Maternal Newborn, Child Health and Nutrition (MNCHN) strategy in Davao City” is expected to further improve the city’s campaign on maternal and child care. With the MNCHN, the city hopes to improve its compliance with the United Nations’ 17 Sustainable Development Goals (SDGs) which includes child mortality reduction and improvement of maternal health. The UN’s 15-year anti-poverty Millennium Development Goals (MDGs) ended in 2015 but it introduced in January this year a more ambitious goal to banish social ills by 2030 known as the 17 SDGs.

DOH to open over P93-M hospital facility in Nueva Vizcaya BAYOMBONG, Nueva Vizcaya, Nov. 7 (PNA) – The Department of Health (DOH) is expected to open the more than P93-million additional facility for the Veterans Regional Hospital (VRH) in this town this month. Dr. Cirilo Galindez, VRH chief, said the newly-constructed facility – Out – Patient Department (OPD) building will be inaugurated on November 24. The inauguration will also coincide with the ground breaking of the proposed Training Center Building of the VRH. “With these new developments, the VRH is treading another milestone in its pursuit of quality, affordable and accessible health care to all especially the poorest of the poor,” Galindez said. The new building is expected to provide more space for patients at the VRH main building as the OPD will absorb most of the departments. The inauguration of the new OPD building and the ground breaking of the proposed TCB are expected to draw visitors from the DOH led by Health Secretary Paulyn Jean Rosell Ubial, Representative Luisa Cuaresma, Governor Carlos Padilla and Bayombong town Mayor Ralph Lantion.

Grilled Portobello Mushroom and Arugula Sandwich Recipe courtesy of Chelsey of C it Nutritionally Servings: 2 Mushrooms: 4 portobello mushroom caps, stems removed 2 tablespoons balsamic vinegar 1/2 tablespoon olive oil freshly ground black pepper 1/4 teaspoon smoked paprika Sandwich: 1 baguette (12 inches), cut into two pieces and halved lengthwise 2 tablespoons Sabra Spreads Garlic & Herb 1 roasted bell pepper 1 cup arugula Gently clean portobello mushroom caps with cloth just prior to preparation. In medium to large bowl, combine balsamic vinegar and olive oil, and whisk together with fork. Add mushroom caps to bowl and soak until mushrooms are saturated with marinade. Remove mushroom caps from bowl and place on plate. Sprinkle with freshly ground black pepper and smoked paprika. Gently coat grill, grill pan or large skillet with olive oil or nonstick spray and heat over medium heat. Sear mushrooms for about 2 minutes on each side, until cooked through and mushroom caps darken in color. Set cooked mushrooms aside. To assemble sandwich: coat bottom piece of baguette with spread. Add roasted bell pepper, arugula and cooked mushrooms. In clean skillet over medium heat, sear assembled sandwich about 3 minutes on each side until bread is heated through.

In mixing bowl, combine beets, sesame oil and tarragon then spread on baking sheet. Roast until beets are tender and browned in areas, about 25-30 minutes While beets are roasting, use same mixing bowl to prepare spread. Stir together spread, tarragon, salt and pepper. Cover bowl and store in refrigerator until beets are ready. Remove beets from oven and allow to cool slightly before assembling sandwiches Slice rolls in half and spread garlic tarragon spread on inside of each roll. Top bottom half of roll with beets, apple slices, micro greens and red onion, then top with remain ing half of bun.

Recipe courtesy of Chelsea LeBlanc of Chelsea’s Choices Servings: 4 1 tablespoon egg whites 2 teaspoons Sabra Spreads Garlic & Herb 1/2 cup panko bread crumbs 1 teaspoon chopped fresh rosemary, plus additional for garnish 1/2 teaspoon garlic powder 1/4 teaspoon paprika 1/8 teaspoon salt 1/8 teaspoon pepper 4 boneless, skinless chicken tender 4 frozen waffles 1/2 cup fresh spinach 4 tablespoons Sabra Spreads Honey Mustard 1/2 cup maple syrup Heat oven to 425 F and line baking sheet with aluminum foil. In medium bowl, whisk together egg whites and garlic and herb spread. On plate, gently mix together panko bread crumbs, 1 teaspoon rosemary, garlic powder, paprika, salt and pepper. Dip chicken into egg white mixture then into bread crumb mixture. Place on baking sheet and bake 15-20 minutes, or until internal temperature is 165 F, flipping chicken at halfway mark. In toaster oven, toast waffles until warm and crisp. Cut into fourths and top with spinach and 1/2 tablespoon honey mustard spread. Cut chicken tenders in half and place atop waffles. Top with another waffle quarter. Garnish with rosemary and serve with maple syrup.
