MANILA, Aug 25 (Mabuhay) – President Rodrigo Duterte has ordered the Armed Forces of the Philippines (AFP) and the Philippine National Police (PNP) to go after the Abu Sayyaf group after learning that an 18 year-old kidnap victim was beheaded on Wednesday. Recent press reports now indicate that banks are ready to begin a new push on delinquent mortgages through foreclosures and trust deed sales. Although the recession seems to have bottomed out, and house prices are no longer falling, many home owners are still behind on their payments, or sitting in homes that remain upside down in value versus debt, or both. Bottom line, home values have not yet appreciated to the point where it makes sense to stay, or pay off large delinquencies in order to avoid a foreclosure. Even with the new lower mortgage rates, few home owners will succeed in refinancing under the government’s Harp 2 program, that provides re-finance options for properties under water. For most, if your credit is compromised, or you do not have at least 40% equity, you are out of luck. Therefore a bank foreclosure may well be unavoidable during this new foreclosure wave that’s about to begin. So how does that work? When you are unable to make your mortgage payments on time, the bank starts a foreclosure process. Foreclosure is a legal procedure that involves mortgaged properties. If a homeowner defaults on his or her mortgage, by either failing to make mortgage payments or failing to follow other terms of the mortgage document, foreclosure may be the result. The homeowner relinquishes all rights to the property, and the mortgage lender takes possession of the property. Usually there is a forced sale of the property at public auction; the proceeds of this sale are applied to the mortgage debt. The most widely used remedy in dealing with foreclosure, is bankruptcy. Bankruptcy is a legal procedure that begins when an individual has a cash flow deficiency caused by debts they cannot manage. It can also protect against judgments, pay garnishments, evictions and buy time in foreclosure situations. For those with little income, a chapter 7 bankruptcy gives debtors a fresh start. All unsecured debts are discharged. If you do have a regular income that is greater than the cost of living index for your area, you can still qualify for a chapter 13 bankruptcy. The U.S. Courts’ publication Bankruptcy Basics refers to a Chap-

ter 13 bankruptcy as “an adjustment of debts of an individual with regular incomeâ€? where the debtor works with the bankruptcy court to develop a repayment plan for the debtor to follow over the next three to five years. Upon completion of the repayment plan, the bankruptcy court will discharge any remaining eligible debts. A Chapter 13 bankruptcy filing can stall or derail foreclosure proceedings. That’s because of bankruptcy’s “automatic stayâ€? provisions that force creditors to the sidelines while the bankruptcy court sorts things out. The lender can petition the court to allow it to continue with the foreclosure, depending on where you are in the foreclosure process, but it should buy you some time. The following, is from page 24 of the U.S. Courts’ publication Bankruptcy Basics: By virtue of the automatic stay, an individual debtor faced with a threatened foreclosure of the mortgage on his or her principal residence can prevent an immediate foreclosure by filing a chapter 13 petition. Chapter 13 then affords the debtor a right to cure defaults on long-term home mortgage debts by bringing the payments current over a reasonable period of time. The debtor is permitted to cure a default with respect to a lien on the debtor’s principal residence up until the completion of a foreclosure sale under state law. 11 U.S.C § 1322Š. MANILA, Aug. 25 (PNA) – Judges linked by President Rodrigo Duterte to the illegal drug trade are being investigated by the Supreme Court, Chief Justice Ma. Lourdes Sereno confirmed Thursday. Speaking in Manila for her annual meet the press, Sereno said the judiciary is still conducting a fact-finding investigation on five lower court judges. “The one referred to in my letter to the President has been suspended. Together with a formal investigation, it’s already been docketed, while others are going through a fact-finding investigation,â€? she said in response to a question by the Philippines News Agency. She was referring to Judge Lorenda Mupas of the DasmariĂąas, Cavite Metropolitan Trial Court who was dismissed in 2007 for gross ignorance of the law and misconduct. Duterte’s ‘narco list’ included Judge Antonio Reyes of Baguio City RTC Branch 61; Judge Adriano Savillo of Iloilo City RTC Branch 30; Judge Domingo Casiple of Kalibo, Aklan RTC Branch 7; retired Judge Rene Gonzales of Iloilo City MTCC; Judge Exequil Dagala of MTC Dapa-Socorro, Surigao; and deceased Judge Roberto Navidad of Calbayod City RTC Branch 32. Duterte’s public naming of the judges supposedly involved in the illegal drug trade led to a word war with Sereno, with the chief justice defending the judges and the President threatening to declare martial law, which was later clarified by MalacaĂąang.

Alvarez: Everyone will be summoned to illegal drugs probe By Filane Mikee Cervantes

MANILA, Aug. 25 (PNA) – The House of Representatives will summon to its forthcoming probe all who can shed light on the prevalence of illegal drugs in the New Bilibid Prisons (NBP), House Speaker Pantaleon Alvarez said Thursday. In an interview, Alvarez said the resource persons would likewise include personalities mentioned in the “matrix” released by President Rodrigo Duterte. “All of the people involved in the matter will be investigated so that we can have a clearer picture,” said Alvarez. Alvarez is the principal author of House Resolution No. 105 seeking investigation into the illegal drug trade inside NBP that flourished during the term of incumbent senator Leila De Lima as Secretary of Justice.

Invoking the rule on inter-parliamentary courtesy, Alvarez stressed that the House would not compel De Lima to appear before the Committee on Justice which investigate the matter. ”We won’t oblige her (De Lima) to attend. It is entirely up to her because of the existing rule called inter-parliamentary courtesy. We will provide that; we will respect that,” the House Speaker said. But even without De Lima’s participation, Alvarez said the House would press on its effort to search out the truth behind illegal drug trade in the country’s premier prison facility “We will continue to uncover the reason behind the proliferation of illegal drugs during (De Lima’s) term as justice secretary,” he said. Alvarez clarified that the forthcoming House probe is meant to find out why the drug trade flourished

inside the national penitentiary and not specifically targeted against De Lima. He likewise stressed that the House probe was not a duplication of the Senate work, noting the focus of the investigation of the Upper Chamber was on the alleged summary killings of suspected drug personalities. Meanwhile, Alvarez said the House would look into the alleged involvement of incumbent Pangasinan 5th District Rep. Amado Espino, Jr. into the illegal drug trade at the NBP and give the latter the chance to explain his side. Espino, former Pangasinan governor, was among the seven personalities named in the “matrix” released by Pres. Duterte. ”We have to look into that. We have proper committees to further inspect this problem,” Alvarez said.

Pangasinan lawmaker Espino denies link to Bilibid drug syndicate

LINGAYEN, Pangasinan, Aug. 25 (PNA) – Former Pangasinan governor Amado Espino Jr., who currently represents Pangasinan’s fifth district in Congress, denied his and former provincial administrator Rafael Baraan’s alleged link to a New Bilibid Prison drug syndicate, after their names appeared in a matrix made public by President Rodrigo Duterte early Thursday. “I am completely taken aback by this most recent pronouncement coming from no less than the President himself, that among others, Provincial Administrator Rafael Baraan and I are allegedly included in the New Bilibid Drug Matrix, which shows a connection from Muntinlupa down to (former) DOJ Sec. Leila de Lima and other officials, but for what purpose

we don’t even know,” Espino said in a statement released to the media Thursday afternoon. Rafael Baraan is the elder brother of former justice undersecretary Francisco “Toti” Baraan III, who is also included in the drug matrix. Also in the matrix was another Pangasinense, Raul Sison, a provincial board member and a native of Urbiztondo town. In his statement, Representative Espino, who reigned as Pangasinan governor for three consecutive terms, noted that the apparent purpose of the matrix was to make it appear that there is a regular flow of drug money from Muntinlupa, down the line. “First, I have never been associated with Sec. de Lima in a friendly manner, especially since she was mainly instrumental in pursuing

the investigation of a fabricated murder case against me at the height of the elections in 2012-2013,” Espino said. “Second, it is public knowledge that I am staunchly against illegal drugs, and even worked hard to secure the passage of RA 9165, otherwise known as the Comprehensive Dangerous Drugs Act of 2002, as one of the main authors.” He noted that in his nineyear term as governor, Pangasinan was relentless in its anti-illegal drug campaign, until the present. “It was during my term when a sizeable portion of the total provincial budget was earmarked yearly for the anti-illegal drugs program, and the Provincial Anti-Drugs Council and, consequently, the Municipal and Barangay Anti-Drugs Councils were re-organized and re-activated,” he added.

Taking opportunity to study under the Alternative Learning System (ALS) of the Department of Education(DepEd), 18 inmates have already passed the recent Accreditation and Equivalency Test (A&ET) for elementary and high school levels. “We are proud to see them in their togas and accepting their certificates of graduation. The 18 inmates were recently given recognition by DepEd and provincial officials at the Nueva Vizcaya Provincial Jail compound. School officials of Barangays Magsaysay, Vista Hills, Magapuy, Paitan, Ammococan and Bansing in Bayombong town along with ALS coordinators and mobile teachers of DepEd District 1 and 2 of Bayombong came to witness the program. Pasion said recognition rites were given to inmates who completed the ALS accreditation for elementary and secondary education for the years 2015, 2014 and 2013.

GPH, NDF panels agree to fast track peace agreement within a year By Joann Santiago

MANILA, Aug. 25 (PNA) – Members of Philippine government (GRP) and the National Democratic Front (NDF) peace panels have agreed to accelerate the timetable to complete work on substantive agenda to within a year. In a statement Thursday, the Office of the Presidential Adviser on the Peace Process (OPAPP) said proposals made during the simultaneous meetings held last Tuesday have been okayed by both panels. The simultaneous sessions lasted from about nine minutes to 30 minutes, with the longest reserved for discussions on the Comprehensive Agreement on Socio-Economic Reforms (CASER), deemed the “heart and soul” of the peace talks. Last Tuesday, both panels agreed to activate the Reciprocal Working Committee (RWC) and Reciprocal

Working Groups (RWG). Labor Secretary and concurrent GPH peace panel chair Silvestre Bello III Bello earlier said the GPH and NDF panels earlier agreed to hold all RWC meetings in Oslo while RWG meetings will be held in the Philippines. OPAPP said the RWC on CASER is scheduled to have its initial meeting in October 2016 “to discuss the framework and outline of the CASER, their work schedule, and methods of work.” It said the RWGs on Political and Constitutional Reforms (PCR) also agreed to have its first meeting in Oslo. The RWG on End of Hostilities and Disposition of Forces (EOH-DOF), in turn, decided to present their respective draft outlines for a Comprehensive Agreement on the substantive issue on October 24, 2016 or the next scheduled Panel meeting, whichever comes first, it said.

MANILA, Aug. 25 (PNA) – President Rodrigo Duterte on Thursday urged the military and police to be “extra” friendly to members of the Communist Party of the Philippines (CPP) and the New People’s Army (NPA) in light of their ongoing peace negotiation with the government. In a press briefing in Davao, the President expressed his willingness to free the other political prisoners. He said he is also inclined to yield to some of their demands in pursuit of lasting peace, hoping this could end years of communist rebellion in the country. The President asked the military and the police to refrain from any “bloody confrontation” and to forget the hostilities for the meantime, as peace talks in Oslo, Norway are underway. He ordered both the Armed Forces of the Philippines (AFP) and the Philippine National Police (PNP) to immediately honor the truce he had declared and cease from attacking the NPA. “So I’m joining the Communist Party of the Philippines in its desire to seek peace for this nation,” he said. “We avoid hostile actions against each other, we do not go into any antagonistic behavior in front of whoever and as a matter of fact, I am encouraging people in the government, the military and the police to be friendly with the forces of the revolutionary government of the Communist Party of the Philippines,“ he said. “As President, my main task is to seek the peace for my country. I am not a President who would enjoy waging war against the citizens of

this Republic,” he added. The President became emotional when he said that it pains him deeply to see people dying for an ideology. “Pwede naman nating mapag-usapan ng mapayapa (We can hold a dialogue in a peaceful manner), just like now. I would have just also wondered bakit kailangan pa tayo magpatayan (why we have to kill each other) for 45 years only to end up, which is really a significant event for everybody. Ngayon palang, mag-usap naman tayo. (Only now, let us talk.) And to think there’s so many lives lost both for government and on the other side,” he said. The President said issues on poverty and housing problems, which are part of the roots of the communist insurgency in the country, should have been addressed a long time ago. “That is my regret for my nation that sana noon pa ito, wala na masyadong patayan at magagamit ko pa yung pera para sa mga mahirap na Pilipino (that it should have been addressed a long time ago so that killing would have been avoided and we could have used the money for the poor),” he said. The President expressed optimism that the government’s conflict with the communists shall be resolved under his term and in his lifetime. As for the demands of the NPA, the armed wing of the communists, the President said he is even willing to release money and lands to them. “But there’s so much land in the Philippines, and I could… Sabihin lang nila (Just tell me) and I would give them everything,” he said.

Tourism Secretary urges Filipino-Americans to rediscover PHL MANILA, Aug 24 (PNA) -- Department of Tourism (DOT) Secretary Wanda Teo has encouraged Filipino-Americans in the United States (US) to come home and explore the beauty and wonder of the Philippines. Teo made the call during her recent working visit to the US, from August 12 to 15. She visited various states such as New York, New Jersey and California where she met with the Filipino community there. She first went to New York and New Jersey, where about 337,000 Filipino-Americans reside. She was invited to grace various festivities, which also featured Filipino celebrities.

She then proceeded to New Jersey to participate in an event attended by some 500 Filipino-Americans. “It will be great if you invite your American friends and Facebook friends to come see our world-class tourist destinations and experience genuine Filipino hospitality. Remember, there’s no place like home,” she told the small group of Filipinos in New Jersey. Teo then flew to San Francisco, California to join the “Pistahan Parade and Festival 2016” held at Yerba Buena Gardens. At least 15,000 people participated in the celebration. “Undeniably many of our fellow Filipinos experience homesickness and longing to visit our home

country, reunite with relatives and friends,” Teo said before the Pinoys in San Francisco. She said tourist arrivals from the US are expected to increase significantly in the coming years as travel and tour operators in the country have stepped up their campaign in promoting tourist destinations in the Philippines. She likewise cited the role of airline companies such as Philippine Airlines and travel and tourism agencies in boosting the country’s tourism industry. The US is the second largest source market for the Philippines, generating 15 percent of all foreign tourists last year. In her meetings with several for-

eign tourism officials, Teo discussed the hosting of the Philippines of the Miss Universe beauty pageant in January. She also tackled the efforts of the Tourism Infrastructure and Enterprise Zone Authority (TIEZA) to enhance various local tourism destinations through infrastructure and product development. She also highlighted her advocacy for the “one town-one product” concept and the Tourism Promotions Board’s (TPB) funding support to US-based marketing and promotions of Filipino culture and culinary arts. MANILA, Aug. 25 (PNA) -- The Philippine Tour Operators Association (PHILTOA) is ready to promote the Philippines at its best five months prior to the country’s hosting of the prestigious Miss Universe beauty pageant. PHILTOA is the country’s largest organization of registered tourism operators with members coming from various tourism-related sectors and establishments like travel agencies, hotel, resorts, transport companies, handicraft stores, among others. “We will put the best foot forward during this particular pageant,” said PHILTOA President Cesar Cruz.

“With our membership, we have tour operators, we have accommodation sector, we have the airlines… So using the different capacities of members and operators, we can always provide the different programs and packages for places to visit; and our hoteliers, the accommodation sector will always provide the best of course,” Cruz said. Cruz welcomed the third time the country will be hosting the major international event saying that it will definitely be a big boost to the country’s already booming tourism industry. He added that the pageant could help the Tourism department in achieving its target of 10 million to

12 million foreign tourists by 2022. He noted that the role of PHILTOA in the preparation for the pageant has not yet been finalized but he assured that his group was ready to help for the successful hosting of Miss Universe in January. Cruz said PHILTOA is willing to help in whatever capacity they can whether “in kind” or even in terms of financial assistance. “We are still waiting for the directive from the Department of Tourism and also from the franchise holder,” he said. Cruz said the 27th Philippine Travel Mart, which PHILTOA will be hosting from September 2 to 4 at SMX Convention Center, will serve

as a “preview” of what the country can offer for the various countries participating in the Miss Universe pageant. “The event is actually an inventory of what are the possible sites that our contestants for the Miss Universe beauty pageant [can visit],” he said. (PNA)

Singing priests (The Peter’s Chord) in Canada-US concert tour for a mission After their concerts in Michigan, New York, California and Canada, the singing priests from the from the Archdiocese of Palo in the province of Leyte who call themselves The Peter’ Chord, would have covered more territories than the Biblical Apostle Paul of the New Testament who did at most, four missionary journeys in his life. The Thanksgiving concert tour is wrapped in a presentation called “Moments of Grace” being undertaken for worthwhile reasons. Through the gift of music, these men of clothes, consider their journey as “an expression of gratitude, humility, and understanding” as they put their hearts in the act of gratitude on behalf of the flock of the Archdiocese of Palo, whom many of us recall as the ones who bore the most brunt of the Super Typhoon Yolanda which visited Philippines more than three years and left in its wake billions of pesos in physical damages and unimaginable miseries for the families of the close to 10,000 who lost their lives. The singing priests had found a new prayer to express their gratitude to thousands who stood by them in the hour of their flock’s unprecedented sufferings by extending material, moral, emotional and financial support to help the victims putting their lives back and infused in them a new sense of hope and faith in humanity. The catastrophe failed to crush the spirits of strong-willed Leyteños even when all else seemed hopeless. Instead, they found out that collectively they managed and were able to slowly bring normalcy to their live. A double tribute to our media friends: Larry Zabala and Tony Vizmonte Our media community here in Los Angeles mourns the recent passing of our colleague, award-winning Philippine journalist Larry Zabala, who used to write for The Manila Bulletin, the then Philippines’ leading newspaper. He was also the Press Attache for the Philippine Consulates in Singapore and Honolulu during the Marcos regime. Larry and his family moved to Los Angeles after his diplomatic career and was a media colleague since the early 80’s, when most of us in the publishing business were members of the original Filipino American Press Club of Los Angeles (1978) Inc. (FAPCLA), where we elected him President in the 90’s. As I recall, he used to write for several Filipino-American newspapers, along with contributing editorials to the LA Herald Examiner and many other Fil-Am publications. Though we were both members of the FAPCLA, Inc. then, he was subsequently elected President of the pioneering organization in the 90’s. It was during that time when media colleagues Cecile and Dante Ochoa were two of his closest friends. Following is Cecile’s fond memories of him: “Larry Zabala was the consummate writer and editor. He was particularly fond of hanging out with his journalist friends like me and my husband Dante, as well as the late Baste Catarroja, also of The Manila Bulletin, and Ludy Ongkeko as we formed and published a broadsheet in 1990 called The Los Angeles Filipino Bulletin. As UCLA and other academic institutions subscribed to our ‘Bulletin,’ he oftentimes claimed that our paper gave mainstream media the information that it sorely needed about Filipino Americans in its midst. True to what his daughter Laurie

Zabala remembered of her father, Larry was a humble man. It didn’t matter that he used to have a full career as a diplomat, he went on his daily grind, working for Fil-Am papers here in LA with his passion in writing. During his term as President of the Press Club in the 90’s, Larry linked the club with the National Press Club based in Manila, which gave him an award and recognition for his leadership. He continued the press club’s original programs including the Gridiron and Celebrity Nights. He will truly be missed by all of us in the Filipino community here in Los Angeles.� Larry is survived by his wife Susan and their three daughters. Likewise, last Wednesday, August 24th, a media colleague, Larry Pelayo called me early in the morning to announce the sudden passing of another friend/colleague, Tony Vizmonte from his home province in Nueva Ecija where he has since retired. Tony used to publish “Celebrity Chronicle,� the publication he used to promote his various entertainment-oriented events, which made people compare him to German Moreno, who not only was enterprising in his ventures, but also revered by numerous talents he has discovered. Bank forecloses on client’s house despite Chapter 13 filing Client is 47, single and a registered nurse. Her income is good at $80K a year. She has no dependents except her mom who lives with her. Despite her good income, she has a default on her mortgage for $50K. She had an affair with a married man who promised her that he would divorce his wife and marry her. That never happened. But what did happen was, client had given the guy about $50K in cash for his various business endeavors (so he claims), all of which failed so he never paid her back for the $50K. Where did client get the $50K? Instead of paying her back the $50K which she had lent to him in the name of love and romance, truth be told, she didn’t really care if she paid her back. She just wanted to be his “mujer,� his woman. The guy must have been the male version of Anna Nicole Smith who was Playboy Playmate of the year in 1993 when she met the man of her dreams, well let’s just say a half a century older than the man of her dreams, the 90-year-old billionaire J. Howard Marshall. She eventually filed for Chapter 7 in Los Angeles because of a lawsuit against her for $40M. Her husband died a year or two after they wed, from exhaustion from you know what, and left her nothing in his will. Instead, he left his $1.6 B fortune to his eldest son with his first wife. The bankruptcy judge in Los Angeles believed her testimony that she loved her husband and that her husband had orally promised her “half his fortune, if I married him.� The bankruptcy judge nullified the will and awarded her $500M of her husband’s fortune. Then everybody died. First Anna Nicole Smith’s twenty year old son with her first husband died from a drug overdose. Then Anna herself died soon after her son’s death from overdose of prescription drugs and grief from her son’s death. Then the 67-year-old son of Marshall died from an “aggressive infection�.

Eventually the U.S. Supreme Court ruled that the Los Angeles bankruptcy judge had no jurisdiction awarding Anna $500M of Marshall’s estate because that was not a bankruptcy issue. So, the $500M owner is the estate of the Marshall’s 67-year-old son who died. So what good does chasing money do for you when death surely “comes like a thief in the night� (1 Thessalonians 5:2). We don’t know the day and the time or hour of our death, do we? You can be a 4 year old having a good time in Disney world when out of nowhere a six foot alligator drags you into the water and you die. Or, you can be a twelve year old thinking you are about to be thrilled at the most awesome water slide in the world but in the next few seconds your head will be severed from your body. Youth does not guarantee that you will not die. We all know this. You can have $6B and own the largest tech company in the world with products the entire world wants, but with all your billions at your disposal, you’re not able to save yourself from dying from pancreatic cancer like Steve Jobs. Was it within his great wealth and power to invent a man made pancreas to save himself? So, great wealth, power, even absolute power cannot save you from certain death. Only Jesus Christ has proven God’s power over death as He resurrected on the third day from his death on the cross 2000 years ago on Mt. Calvary, and before that, He resurrected many people from the dead. You don’t want to die and end up some place you don’t want to be, just because you believed in a false god, do you? The time to decide is now, when you are still

Daiana Menezes divorces husband, seeks protection order Sultry Filipina-Brazilian actress Daiana Menezes has confirmed that she and husband Benjo Benaldo, former solon of Cagayan de Oro are now separated. Menezes confirmed that she and Benaldo have been separated for two years now but it was just March last year when she left the former politician. “I couldn’t make it anymore. ....I think naiintindihan niya din niya kung bakit. ... emotionally unstable, siguro? I mean hindi siguro talaga kami meant para sa isa’t isa ... Talagang I fell out of love. Decision ko talaga ‘yon,’” said Daiana. Menezes, who initiated the split, also confirmed that she already filed for divorce in the United States. For those persons who lack permanent residency in the United States and have married a United States citizen, marriage also presents an opportunity to obtain permanent residency. However, although the opportunity to obtain permanent residency arises in such situations, one must be aware of and comply with procedures in existence to obtain such status. Due to concerns that persons were becoming married to United States citizens merely to obtain permanent residence status, a two-step procedure under the Immigration Marriage Fraud Amendments of 1986 (IMFA) was set up to ensure such status was given to those only in marriages that are bona-fide and not entered into simply for immigration purposes. Under step one of the procedure, if a person is petitioned by his/her U.S. citizen spouse within 24 months after becoming married, that person is given only conditional permanent residence. Such conditional permanent residence status lasts for two years from the date on which it is granted. Step two of the procedure involves the removal of the conditional label to permanent residence status. Removal of the conditional label is initiated by filing an I-751 Joint Petition to Remove Condition to Permanent Residence (“Joint Petition”). The Joint Petition provides an opportunity for the United States Citizenship and Immigration Services (“USCIS”) to inquire as to the legitimacy of the marriage after conditional permanent residence is granted. Accord-

ingly, documentation evidencing that the marriage was entered into for bona-fide reasons should be submitted as part of the Joint Petition. The Joint Petition must be filed with the USCIS service center in the 90 days immediately prior to the second anniversary of the granting of conditional permanent residence. Typically, upon the filing of the Joint Petition, a one-year extension of the conditional permanent residence is granted. The extension affords the USCIS time to schedule an interview with the person seeking permanent residence, and to make a determination as to whether unconditional permanent residence will be granted for a ten-year period. In cases in which documentation submitted as part of the Joint Petition clearly show that the marriage is bona-fide and not merely for immigration purposes, INS may approve a Joint Petition without an interview. The procedure described hereinabove applies in situations where the marriage has not been terminated. Often, the Joint Petition cannot be filed or approved because the marriage, although bona-fide when entered into, has been terminated by divorce. May aliens become threatened of falling out of status once their marriage is in trouble because the spouse often refuse to cooperate or has filed a divorce petition. In such cases there is still hope and the prospect of obtaining unconditional

MANILA, Aug.24 (PNA) – President Rodrigo Duterte has clarified that only presidential appointees who are corrupt or who have pending cases before the Ombudsman will be fired from office. In an interview at the Palace Tuesday night, the President said that the reason he issued the order calling for the courtesy resignations of all presidential appointees by past administrations was to give Malacañang a free rein in ridding government of corrupt officials. “What prompted or impelled me to run was the continuing corruption, even by government. Despite of my warning, ‘di matanggal-tanggal (the corruption) and that prompted me to issue an order,” he said. Furthermore, he pointed out that all courtesy resignations will still have to be reviewed by the Executive Department to weed out the corrupt officials. “Itong ‘yung mga (nauna) and even those others who are already in government at my behest -- for I was friendly with the government of Arroyo and of Aquino -- but corrupt, sinabi ko na stop it. E ayaw nila maniwala. Those who are really under my control, whether there is due process, if I fire you, it could only mean one thing: that you are into graft,” Duterte said. He also said that presidential appointees who are not corrupt will be spared. “I would consider all appointees of the President, na hindi naman corrupt, ‘yung huwag naman, e bakit mo aalisin yung tao,” Duterte said. As per Memorandum Circular No. 4 released August 22 (Tuesday), holdover presidential appointees are given seven days to submit their unqualified courtesy resignations. The Circular stated that only the President or the Executive Secretary, by authority of the President, may act on courtesy resignations taking into consideration the recommendations of the department or agency head concerned and in accordance with existing laws and jurisprudence. Until any action on their courtesy resignation is taken by the President, appointive officials shall continue to report for work and perform their normal duties and responsibilities.

Duterte fulfills election promise: Free irrigation starting 2017

COTABATO CITY, Aug. 24 (PNA) – Department of Agriculture Secretary Emmanuel Piñol said beginning next year, irrigation system in the country will provide water to farmers for free. Speaking to Philippine News Agency (PNA) in a phone interview, Piñol said President Rodrigo Duterte, upon his recommendation during Monday’s Cabinet meeting, has approved free irrigation for the country’s millions of rice farmers starting the first planting season in 2017. During this year’s election campaign and even before he decided to run for the highest post in the land, Pres. Duterte has repeatedly said that irrigation water should be provided free to the country’s small rice farmers to improve their productivity. Piñol said there were oppositions to the idea, especially from some officials of the National Irrigation Administration (NIA) who said that the free irrigation scheme would affect the viability of the agency since the Irrigation Service Fees (ISF) amounting to about PHP4-B every year is the source of the salaries of its workers and officials. But Piñol said “Duterte has other noble thing in mind than collecting taxes from the lowly farmers who provide food for every Filipino’s dining table.” He also said that Sen. Loren Legarda, chairman of the finance committee of the Senate, and Rep. Karlo Nograles, chairman of the appropriations committee of Congress, have separately expressed support to the President’s free irrigation commitment. He said both legislators favored the President’s idea that an allocation of PHP4-billion will be included in the NIA budget for 2017 to cover the ISF collections. However, Piñol said the President’s idea is really for small farmers who are the priority, while corporate farmers serviced by NIA will have to pay the irrigation service fees. Eliseo Sumayao, president of a farmers association in North Cotabato welcomed the good news, saying the President has made good his campaign promise. “I surely know (that) my feeling now is also the feeling of all farmers all over the Philippines who heard this good news,” Sumayao said. Piñol, a farmer by heart and deed, also lauded the President for giving importance to the plight of rice farmers, one of the abused sectors in the country but produce the country’s top food requirements.

MANILA, Aug. 23 (PNA) – “No sweat.” This was the assessment made by Presidential Adviser on the Peace Process Jesus Dureza after the first panel meeting between the negotiators of the Philippine government (GPH) and the National Democratic Front (NDF) on the on-going peace talks in Oslo, Norway. Dureza’s statement was shown by the Office of the Presidential Adviser on the Peace Process (OPAPP) to journalists through Viber video. Earlier in the day, OPAPP said panel and committee level meetings between the two parties were simultaneously done to fast track negotiations as President Rodrigo R. Duterte bids to reach a final peace agreement within six months to a year. The meetings are being held at the Scandic Holmenkollen Park Hotel in Oslo, Norway. Topics discussed during the first day of the meetings were the affirmation of previously-signed agreements; accelerated process for negotiations, including the timeline for the completion of the remaining substantive agenda for the talks - - socio-economic reforms, political and economic reforms, and end of hostilities and disposition of forces; and reconstitution of the Joint Agreement on Security and Immunity Guarantees (JASIG) list. OPAPP said among the documents expect-

ed to be re-affirmed by both parties include The Hague Joint Declaration of 1992, Breukelen Joint Statement of 1994, the JASIG, and the Comprehensive Agreement on Respect for Human Rights and International Humanitarian Law (CARHRIHL). MANILA, Aug. 23 (PNA) – Senator Leila De Lima on Tuesday said that being linked to the multi-million pork barrel scam case involving business woman and alleged mastermind Janet Lim-Napoles was “unfair,” stressing that she herself handled the cases of Napoles when she was Justice Secretary. “That’s a rehashed issue. Why do they keep digging old issues? Who is responsible for the detention of Napoles? Then they link me to Napoles? That’s too unfair,” De Lima said in a mix of English and Filipino. De Lima reacted following President Rodrigo Duterte’s earlier announcement to re-investigate the multi-billion peso pork barrel scam case involving Napoles and some senators. Duterte also claimed that he received information about a De Lima’s phone conversations between her and her driver Ronnie Dayan that revealed her links

to illegal drug trade in Bilibid Prison. The said conversation also provided information on their ATM records, Duterte said. This led Congress to call for a probe on the senator’s alleged involvement in illegal drug operations inside the prison. De Lima, however, maintained that she was never involved in drugs. “The Committee on Justice conducted also a series of hearing twice or thrice inside Bilibid. We had an ocular inspection with the Congressional committee last Dec 15 2014,” the former Justice Secretary said. “I initiated it (the probe) so why will they investigate me? I found a way to expose the drug problems there. Don’t they know that I exerted certain efforts, steps after discovering all of those inside Bilibid?” she added. De Lima refused to dwell on the topic saying that she did not find a “legitimate matter” for the purpose of the inquiry.

‘The Economist’ gives PHL highest rate in migration governance study By Sammy Martin

MANILA, Aug. 23 (PNA) – Widely respected British news magazine, “The Economist,” recently recognized the Philippines for having a well-developed migration policy governance. The results are based on the findings of the publication’s research arm, the Economist Intelligence Unit (EIU). “This recognition by ‘The Economist’ of the excellent migration governance framework of the Philippines is an affirmation of the continuing commitment of the Philippine Government to promote and protect the rights and welfare of the Filipinos who chose to work abroad,” said Philippine Ambassador Cecilia Rebong, Permanent Representative to the United Nations and Other International Organizations in Geneva. In a research conducted by The Economist Intelligence Unit-Migration Governance Index (EIUMGI), the Philippines is the only country that was given the highest rate as “developed and mature” in all categories, namely: institution-

al capacity; migrant rights; safe and orderly migration; labor migration management; and regional and international cooperation and other partnerships. Countries included in the study have been categorized based on their performance as nascent, emerging, developed, and mature. The research studied 15 countries which were selected to broadly represent economic development, type of migration profile, including migrant receiving and sending countries, and geographic scope. The outcome of the study highlighted transparency as an essential marker of a comprehensive migration policy to include: clear information for potential immigrants about laws, regulations, visas and opportunities, publicly available data about migrant flows, migrant deaths and human trafficking; robust information-sharing systems between government departments, integrated programs to aid repatriation of migrants, and structured information exchange and dialogue with other countries.

Decongesting Metro Manila Now that the fight against illegal drugs is in full swing and that the police appear to be winning in its nationwide campaign against all forms of criminality, President Rodrgo Duterte is probably seriously making plans now on how to remedy the chaotic traffic situation in Metro Manila. The Duterte government has embarked an ambitious infrastructure project worth more than P300 billion in an effort to decongest the streets and major thoroughfares in Metropolitan Manila. Economic Planning Secretary Rogelio Pernia has said that the plan will be carried out in partnership with the private sector. According to Peria, the project will hopefully start by next year. The project when undertaken will be round-the-clock. Other projects in the pipeline will include, among others, the construction of railway from the Tutuban terminal in Manila up to Matnog in the Bicol region. It has a total of distance of 653 kilometers. Total cost is P68.26 billion of which public sector component is P37.76 billion. Pernia said the project is expected to start by next year. To decongest traffic along the EDSA thoroughfare, the Duterte government will construct a bridge that will link the Bonifacio Global City in Taguig city and Ortigas center in Pasig city. Peria believes that once the bridge is completed, 25 percent of the traffic in EDSA will be diverted somewhere else. With barely three months in office, Duterte has done already so much that the people has noticed the vast improvement not only in the peace and order but in the delivery of basic services by the government to the less privileged people as well. *** President Duterte is hell bent in zeroing on Senator Leila Delima’s alleged connection with drug syndicates. Despite De Lima’s repeated denials, more damaging evidences are being dug by Duterte’s men against the embattled lady senator. Francisco Baraan, former Justice Undersecretary when Delima was Justice Secretary was tagged recently by President Duterte of being involved also in drugs. He used to be both the supervisor at the Bureau of Corrections and at the New Bilibid Prisons in Mungtinglupa City. It was reported that he is a frequent visitor at the NBP in Muntinglupa. I’m a sure he goes there not to check on the inmates or on the security measures being adopted by the jail

guards to prevent riots or jailbreaks. He was probably there weekly to get his share of the “bounty” for the sale of “Shabu” reportedly cooked inside the NBP compound. DOJ officials were reportedly receiving millions on a weekly basis during the six-year term of President Benigno Aquino. No wonder, De Lima’s rumored driver/lover/ bodyguard, was able to build two multi-million peso mansions in Urbiztondo, Pangasinan. He also provided his wife money to build her own house in the Visayan region. It will be interesting to find out what Baraan and Dayan will tell the president, as well as the public, once these two men agree to testify in the ongoing Senate investigation on illegal drugs and extrajudicial killings of suspected drug peddlers and addicts throughout the country. *** It is sad and frustrating to watch and hear our inept and ill-prepared senators grill their resource persons in the ongoing senate investigations on illegal drugs. PNP Chief General Rolando de la Rosa was very articulate in answering queries from various senators regarding extrajudicial killings. Dela Rosa assured senators during the hearing that the police will respect and observe the rule of law in its ongoing campaign against illegal drugs. He, however said that policemen are not 100 percent perfect. He admitted that his men also commit mistakes, but not to the point of killing unarmed persons. Dela Rosa assured the senators that his police officers are not butchers who kill people for no reason at all. It was so easy during the hearing for anybody to know that all the senators, except perhaps Senators Panfilo Lacson and De Lima, have no clue about the extent or magnitude of the drug problem the country is facing. Too bad, Senator Mirriam Defensor Santiago would have made the investigation more interesting and more lively just by the manner on how she questions whoever is the resource person. Her term has ended and that she is also ill. I hope she will still be able to come back in the Senate to assume her post as fiscalizer.

Home loan interest deductions

One of the benefits of homeownership is to be able to deduct interest paid on mortgages. The federal government has a long-standing policy of encouraging residential tenants to become homeowners. For a residential tenant considering his income taxes, the monthly payment on a mortgaged home loan is not just a substitute for his monthly rent payment, it also reduces his combined state and federal taxes by an amount equal to 20% to 30% of the monthly loan payment, depending on his tax bracket. Real estate agents handling the sale or purchase of single family residences must be able to intelligently discuss this tax reduction incentive with residential tenants if tenants are to be persuaded to buy based on the full range of homeownership benefits. Loans that are secured as owner’s principal residence or second home. [Internal Revenue Code §163(h)]can have tax write off interest on their mortgages. Also, interest paid on equity loans secured by the property owner’s principal residence or second home is tax deductible under the home loan interest deduction rules, regardless of whether or not the loan’s net proceeds were used for personal or investment/business purposes. The loan interest deductions for the first and second home reduce the property owner’s taxable income as an itemized deduction under both the standard income tax (SIT) and the alternative minimum tax (AMT) reporting rules. In contrast, the real estate property tax deduction on the first and second homes only reduces the owner’s SIT, not his AMT. Two categories of loans exist to control the deduction of interest paid

or

on any loans secured by the principal residence or second home. These include: interest on the balances of purchase or improvement loans up to a combined principal amount of $1,000,000; and interest on all other loan amounts up to an additional $100,000 in principal, called home equity loans. Purchase/improvement loans Interest paid on money loans and carryback credit sales originated to purchase or substantially improve an owner’s first or second home is fully deductible on combined loan balances of up to $1,000,000 for an individual, and for couples filing a joint return, if the loan is secured by either home. The loan balance is limited to $500,000 for married persons filing separately. Thus, if the loan funds are used to acquire, construct, or further improve a principal residence or second home, and the loan funds collectively exceed $1,000,000, only the interest paid on $1,000,000 of the purchase and improvement loan balances is deductible as purchase/improvement interest. However, interest paid on the excess loan amounts, up to an additional $100,000, qualifies for a deduction as interest paid on a home equity loan. To qualify home improvement loans for interest deductions, the new improvements must be substantial. To qualify, improvements must:

add to the property’s market value; prolong the property’s useful life;

adapt the property to residential use. Refinancing limitations If an owner refinances a purchase/ improvement loan, the portion of the refinancing used to fund the payoff qualifies as a purchase/improvement loan for future interest deductions. However, interest may only be written off as a purchase/improvement loan on the amount of refinancing funds used to pay off the principal balance on the existing purchase/ improvement loan. For example, consider an owner who borrows $200,000 to fund the purchase of his principal residence. The loan balance is paid down to $180,000 and the owner refinances the residence, paying off the original purchase/improvement loan. However, the new loan is for a greater amount than the payoff demand on the old loan. In this scenario, interest on only $180,000 of the refinancing is deductible as interest paid on a purchase or improvement loan, unless: the excess funds generated by the refinance are used to improve the residence; or the excess loan amount qualifies as a home equity loan under its separate ceiling of $100,000 in principal. $100,000 home equity loans For married persons filing separately, the cap for the principal amount of equity loans on which interest can be deducted is limited to $50,000, half of the joint $100,000 ceiling. Home equity loans are typically junior encumbrances, but also include

proceeds from a refinance which do not qualify as purchase/improvement funds and purchase/improvement loan amounts which exceed the $1,000,000 ceiling. The proceeds from home equity loans may be used for any purpose, including personal uses unrelated to the property. Points paid to a lender to originate a loan are considered prepaid interest since points are interest that has not yet accrued. Points essentially buy down the loan’s par rate for the life of the loan to the interest rate denominated in the note. No points means a higher nominal interest rate will be stated in the note. As prepaid interest, only the fraction of the points paid which accrues monthly during each year over the life of the loan, called the life-of-loan accrual, may be deducted against that year’s income, with exceptions. When the loan amount is prepaid, any remaining un-accrued prepaid interest is deducted in the year of the payoff. In other words, if you are buying a house and paying points to buy down your rates, those points will be deductible for that year the property was purchased. But if you are refinancing and paying points to buy down rates, the points ( pre-paid interest) paid will be written off in increments depending on how long you will keep the new refinanced loans. Therefore, it’s always better to really know that there is less benefit to pay points to buy down interest rates. Assembly approves leno bill to prevent foreclosures SACRAMENTO – The Homeowner Survivor Bill of Rights, authored by Senators Mark Leno and Cathleen Galgiani, was approved by the State Assembly today. Senate Bill 1150 closes a loophole in California law that fails to provide surviving family members important protections against foreclosure that are available to other homeowners. “Surviving homeowners who legally inherit their home deserve access to accurate information about loan assumption or modification,” said Senator Leno. “Instead, grieving family members face foreclosure threats and lender red tape, adding considerable stress to an already difficult time. California must step in before more family homes are taken away.” While the California Homeowners’ Bill of Rights—approved by the Legislature in 2012—provided foreclosure relief for thousands of California families, the legislation did not protect surviving family members who own their homes but are not listed on the mortgage. These survivors report that servicers fail to provide factual information about loan details and foreclosure avoidance programs or refuse to communicate with them. As a result, many families have experienced unnecessary foreclosures. SB 1150 clarifies the responsibilities of a mortgage servicer when a borrower dies and one of the surviving homeowners wishes to assume the loan. The legislation ensures that heirs receive accurate information about loan assumption and foreclosure prevention programs. It also gives survivors a single point

of contact with the servicer and the ability to apply for loan assumption and modification. “The Assembly’s approval of SB 1150 is another step forward in California leading the nation when it comes to protecting homeowners from unscrupulous foreclosure practices,” said Maeve Elise Brown, Executive Director of Housing and Economic Rights Advocates. “SB 1150 is a pragmatic way to stop widows, widowers, and other heirs from needlessly losing their homes to foreclosure and we hope Governor Brown signs it quickly.” SB 1150 is sponsored by the California Alliance for Retired Americans, Housing and Economic Rights Advocates and California Reinvestment Coalition. AAAJ hosts ‘Endless Possibilities. Citizenship Now!’ campaign By Myrna Aquitania

“Endless Possibilities. Citizenship Now!” Campaign hosted a media forum between Asian ethnic media and Community Based Organizations (CBO) last Tuesday, August 23rd at the offices of the California Community Foundation in downtown Los Angeles. In his welcoming remarks, Stewart Kwoh, President and Executive Director of Asian Americans Advancing Justice/Los Angeles (AAAJ), welcomed all of the media and community partners who attended and he reiterated that “the goal of the campaign is to reach over 300.000 Asian immigrants in the Los Angeles County area, who are eligible to become naturalize citizens,” yet a large number of these immigrants have not pursued to become American citizens, maybe due to lack of knowledge or incentives to do so. The largest number of non-citizen Asian immigrants eligible for naturalization come from China, South Korea and the Philippines. Thus, the campaign aims to promote naturalization issues within these large Asian communities. Nasim Khansari, also with AAAJ, spoke on the importance of this campaign to educate these immigrants as well as basically assist and direct them where they can go within their community to submit their applications for citizenship. AAAJ Communications Director Randy Bunnao, spearheaded the media partner introductions and

She spoke on the basic steps in applying for US citizenship: mobilizing applications by promoting toll-free numbers in various Asian communities; educating those eligible immigrants and promoting fee waivers for those who qualify; continuous dialogue and follow-through in assisting those who need assistance in preparation for citizenship interviews where website assistance in various Asian languages is available. Finally, Ms. Chen also pointed out that according to recent statistics, there are 98, 450 legal eligible per-

manent residents from China while Filipinos have 84,659 and Koreans have 38, 639. Other Asian communities such as: Vietnam, Taiwan, India, Japan, Thailand, Cambodia, Indonesia, Pakistan, Burma, Sri Lanka, Malaysia, Singapore, Fiji, Mongolia,Tanga, Samoa and Laos also have significant numbers. Gov. Brown signs bill to decriminalize youth SACRAMENTO – Gov. Jerry Brown today signed SB 882, legislation by Sen. Bob Hertzberg, D-Van Nuys, that prohibits youths from being charged with a criminal violation for transit fare evasion and instead treats the offense through an administrative process. Criminal charges for transit fare evasions can force youths to miss school for court appearances, saddle a youth with a criminal record and, sometimes, result in a youth ending up in juvenile hall. “I applaud the Governor for signing this important bill that will prevent youths from being drawn into the criminal justice system simply because they can’t pay to ride the bus or train,” Hertzberg said. “This legislation ensures that people under the age of 18 will be held accountable if they jump transit fares – they will face fines and penalties – but they won’t be charged with a criminal violation or be locked up.” The measure is part of Hertzberg’s ongoing efforts to roll back overly harsh penalties for minor offenses that hit the poor and the working poor especially hard. Last year, Hertzberg authored SB 405, which, along with Brown’s related budget proposal, established a new traffic amnesty program. The program allows people to talk to a judge if they want to before paying fines, restores driver’s licenses to those with a payment plan and reduces exorbitant fee debts by taking a person’s income into account in setting the fine amount. In the first six months of that pro-

gram, more than 132,000 Californians have received amnesty fine and fee reductions and more than 104,000 Californians have had their suspended driver’s licenses reinstated, according to the California Judicial Council. SB 882 reduces the likelihood a youth will enter the criminal justice system or drop out of school. Research shows that when a youth makes even one court appearance during school, it quadruples his or her odds of being pushed out of school altogether. Public transportation is crucial to youths from low-income families because many rely on it to get to school, jobs or health appointments. SB 882 helps prevent youths’ futures from being derailed by a needless criminal violation and saves taxpayers money by eliminating an unnecessary burden on the courts and public safety systems. The legislation is sponsored by the Youth Justice Coalition, the Children’s Defense Fund-California and the Western Center on Law & Poverty. “The Governor and Legislature have taken a critical step to reduce the over-criminalization of children and youth,” said Alex Johnson, Executive Director of the Children’s Defense Fund-California. “Too many young people of color are being systematically locked up and locked out of opportunities for essentially being black or brown and poor. We thank Senator Hertzberg for his strong leadership to ensure that no child in California is criminally charged for not being able to pay a transit fare.”

Studio City resident gets 5 years for ‘skimming’ credit cards at gas pumps LOS ANGELES – A Studio City man was sentenced today to 65 months in federal prison for possessing more than 1,400 credit card profiles that had been stolen from consumers who used gas pumps equipped with illegal “skimmers.” Koren Robert Kechedzian, 25, was further ordered by United States District Judge Philip S. Guttierez to pay restitution of $114,135 to victim financial institutions that suffered losses when the stolen credit card numbers were used for fraudulent purchases. At the conclusion of a one-week trial in March, Kechedzian was convicted of two counts of credit card fraud (specifically, two counts of possession of 15 or more counterfeit access devices) and two counts of aggravated identity theft. The federal jury found that Kechedzian possessed two USB flash drives – which are commonly called “thumb drives” – that contained stolen credit card information. The portable drives were found at Kechedzian’s residence when federal authorities executed a search warrant in June 2013. At that time, investigators also recovered an illegal skimming device designed to be installed in gas station pumps to steal credit card data. Bank records examined by investigators established that the stolen credit cards numbers on the USB flash drives came from Chevron gas stations in Palmdale and Moorpark, and testimony at trial showed that the data on portable drives was consistent with the output from a credit card skimming device. “Stolen credit card information found in this defendant’s residence was used to obtain products at gas stations and other retail outlets,” said United States Attorney Eileen M. Decker. “The investigation also linked the defendant

to senior members of Armenian Power, a gang that has been involved in credit card schemes. This type of fraud harms millions of Americans and can be used to fund other illegal activity, which is why law enforcement is committed to uncovering these schemes and prosecuting the perpetrators.” The investigation in this case was conducted by special agents with IRS Criminal Investigation, U.S. Immigration and Customs Enforcement’s (ICE) Homeland Security Investigations (HSI) and the United States Secret Service. The investigation into Kechedzian stemmed from the discovery in 2013 of two counterfeit credit cards that were embossed with Kechedzian’s name. “Today’s sentencing sends a clear message to the defendant and others thinking about taking such action that credit card fraud will be taken seriously and the punishment will involve a long prison sentence,” stated IRS Criminal Investigation’s Acting Special Agent in Charge Anthony J. Orlando. “As credit card fraud becomes more prevalent, IRS Criminal Investigation will continue to use our forensic skills to protect consumers from fraud artists committed to taking the identities of innocent victims.” Special agents testifying at trial said that credit card fraud rings install skimming devices in gas station pumps and obtain credit card numbers from the devices and transmit the stolen data with Bluetooth technology. Customers who use these compromised gas pumps are the unwitting victims of the credit card fraud. “As this case demonstrates, those who steal the personal information of unsuspecting citizens to feed their own greed will get the justice they deserve,” said Joseph Macias, special agent in charge for HSI Los Angeles.
