Hillary Clinton

To win, Hillary should speak a little Tagalog By Andrew Lam New America Media

If all politics are local, then candidate Hillary Clinton may very well need to speak a little Korean and Tagalog in order to win the 2016 presidential election. Why? In 2014 Slate.com published a fascinating article with this headline, “Tagalog in California, Cherokee in Arkansas.” It is a survey of the languages spoken in each state. Of great political interest is the most common language spoken other than English or Spanish. In Alaska it is Yupik, In Nevada it is Tagalog (spoken by Filipinos), while Vietnamese is the third most popular language in Oklahoma, Nebraska and Texas. Korean fills that slot in Virginia and Georgia. Spanish, of course, is the second most common language spoken other than English in most states. It makes sense then that Clinton’s VP pick, Tim Kaine, made his acceptance speech for the Democratic Party’s nomination partly in See HILLARY, page 12

According to government statistics, 1.664,000 Americans filed for bankruptcy between September 2010 and September 2011. What does this mean? It means you are not alone! For many, bankruptcy provides a second financial chance. Although a bankruptcy filing will stay on your credit record for up to 10 years, it need not be the dire problem some people seem to think. First, there are laws that forbid discrimination against you if you have filed bankruptcy. Second, providing you show consistent employment history and financial responsibility, you can rebuild your credit. Our office has the expertise to show you how. Filing for bankruptcy is not hard, It’s the time leading up to that decision that is hard. You worry about what people may think. You worry about whether you can ever get credit again. Can you ever buy a car, or a house? Can you refinance your home? How do you begin to rebuild your credit so that you can move forward? You need credit to get credit but who will give you credit and trust you. Don’t worry, it’s not as difficult as you may think. While filing bankruptcy is initially considered a negative on your credit report, since it lowers your fico score, it can also help you secure new credit. How is that, you may ask? That is because a bankruptcy on your credit report also sends another message. It tells future creditors that you do not owe any more unsecured debt. Your risk of collections and lawsuits on these items have been wiped out. It also shows that your debt to income ratio has improved significantly, since you (hopefully) still have employment income, but no debt. Furthermore, if a new creditor gives you credit, it cannot be discharged in a bankruptcy for a minimum of eight years. Bottom line, it’s easy to re-establish credit. Creditors know you cannot discharge debt again, but you can afford to service new debt. Creditors can also charge you more, because of the low fico score. There is a whole industry of banks, credit card programs and retail charge cards that are targeted to consumers discharged in bankruptcy. In fact, it’s an essential criteria for the reasons given above. Never has it been easier to rebuild credit then now. You should be aware, that all three-credit reports will still contain adverse information from the time before you filed. This information may still show some of the charge offs, judgments, collection accounts and the like. However, once your bankruptcy has been successfully discharged, those debts are no longer

collectable, and new credit granters know what to look for. They see past this, focusing instead on the date of the bankruptcy discharge. Creditors will rarely update your credit reports to reflect “Included in Bankruptcy.â€? They will leave the postings as they were; since the debts are discharged, and they have already closed your account in their computer files. Remember, the credit reporting agencies do not post or unpost creditor information. That is posted directly by the creditors, who are direct subscribers to the credit reporting agencies. According to the FCRA (Fair Credit Reporting Act), only accurate debts can be listed. Your credit reports should only show the actual bankruptcy and then the debts as “included in BK.â€? What this does is to give you the opportunity to dispute the accuracy of the information on your report, and clean it up. Below are some helpful pointers so you can achieve the best possible credit reports and tips for rebuilding. Check your reports for errors Correct the errors by writing to the credit reporting agency. Apply for a few secured credit cards • Open a bank account and secure credit with a savings book • Keep employment stable • Pay utilities on time (they may also report when delinquent) How long may bankruptcy information be included in my credit report? Both the Bankruptcy Code and the Fair Credit Reporting Act (which regulates what a consumer reporting agency may include in your credit report) are federal law, so the same rules apply to all states. A consumer credit report may include information on a Chapter 7 and Chapter 13 bankruptcy for 10 years from the commencement of the case. However, those clients who follow our credit building tips, have rebuilt adequate credit to qualify for credit cards and home loans within two years of a bankruptcy discharge. For real help in dealing with debt, and re-building your credit, call the Law Offices of Paul M. Allen toda at 818-552-4500y. Consultations are free. MANILA, Aug. 2 (PNA) – Strong capital flows to the Philippines is expected to be sustained given the disappointing economic developments in advance economies. Bangko Sentral ng Pilipinas (BSP) Deputy Governor Diwa Guinigundo told reporters that the country had been receiving sustained foreign portfolio investment inflows, otherwise known as hot money due to the speed its comes in and out of the economy, in at least the last two months. Central bank data show that hot money posted net inflows of USD 72.81 million and USD 450.87 million last May and June, respectively. As of the week ending July 10, 2016, hot money posted net inflow of USD 707.55 million. Guinigundo attributed the net inflows to the possible monetary policy tightening in the US given the recent disappointing data from the world’s largest economy that include jobs and growth reports. He said these reports made some market analyst forecast the next adjustment in the Federal Reserve rates by September 2017.

Police raid Leyte mayor Espinosa’s houses; six killed

MANILA, Aug 3 (Mabuhay) – Six men were killed when authorities conducted a raid on three houses of Albuera Mayor Rolando Espinosa Sr. and his son Kerwin early Wednesday. Two of the victims died in the mayor’s house, two in the house of Kerwin who is allegedly a drug lord, and the other two in the first house of the mayor. The raid was conducted on the said houses at Sitio Tinago in Brgy. Benolho at 5:30 a.m. by combined forces of the Leyte Provincial Police Office, Regional Public Safety Battalion, and Albuera Philippine National Police. A police report said recovered during the raid were 14 assorted long firearms, 5 cal .45 pistols and riffle grenades. The slain suspects also had short firearms with them. One of those killed was a rebel who became the leader of an alleged private armed group of Mayor Espinosa. Police said the former rebel

was involved in killings in 2013, 2014 and during this year’s May elections. Local police may pursue charges against Mayor Espinosa based on the discovery of the private armed group in his properties. The elder Espinosa surrendered to authorities on Tuesday after President Rodrigo Duterte said on Monday he will give a “shoot-on-sight order” to the police if the mayor and his son do not voluntarily surrender within 24 hours. Mayor Espinosa and his son Kerwin were linked to drug trafficking and coddling. Reports say about P1.9 million worth of 237 grams of suspected shabu were recovered by authorities in a buy-bust operation last Thursday near the houses of the Espinosas. Five were arrested, all employees of Mayor Espinosa and Kerwin. The elder Espinosa on Tuesday admitted his son has links to the drug trade.

PNP chief Director General Ronald “Bato” dela Rosa on Tuesday called on Kerwin to surrender or die.

Kerwin is reportedly out of the country, either in Singapore or Malaysia, dela Rosa said. (MNS)

Duterte to name 27 local officials linked to illegal drugs: Palace MANILA, Aug. 2 (PNA) – President Rodrigo Duterte will reveal “soon” the names of at least 27 local executives allegedly involved in illegal drug activities, Presidential spokesperson Ernesto Abella said on Tuesday. ”Until now, talaga nasa kaniya iyong listahan. Pero hindi na po tatagal at ire-report na rin po niya sa publiko (The President has the list and will soon announce it to the public),” Abella said in a television interview. Abella refused to provide further details but said: “You’ll find it very interesting after his report. Hin-

tayin na lang po natin iyong report ni Presidente (We just have to wait for the President’s announcement).” Earlier, presidential legal counsel Salvador Panelo told mediamen in Malacanang that the list is composed of 27 local executives provided by the government intelligence group. ”My God, you will be shocked,” Panelo said. Panelo said President Duterte might identify the local executives either Tuesday night or Wednesday. Much like the five generals named by the President early last month, Panelo said the local executives will also be investigated.

MANILA, Aug 2 (Mabuhay) – Sen. Grace Poe on Tuesday urged President Rodrigo Duterte to immediately appoint a competent and independent civilian as head of the Philippine National Police Internal Affairs Service (PNP-IAS) amid reports that some active police personnel are allegedly involved in illegal activities. “It is high time that an independent and objective IAS should be put in place to effectively carry out its mandate in support of the renewed vigor of the PNP’s campaign to eradicate criminality by keeping the same within the bounds of the law,” Poe said in a press statement. The current head of IAS is Police Director Alexander Roldan. Poe has filed Resolution 70 calling for an inquiry into the non-implementation of Republic Act No. 8551 or the PNP Reform and Reorganization Act of 1998, which mandates that the head of the Internal Affairs should be a civilian. Section 40 of RA 8551 states that “the head of the Internal Affairs Service shall be a civilian who shall meet the qualification requirements provided herein.”

PHL to lose P3B per hour to Luzon brownouts: Gatchalian

MANILA, Aug 3 (Mabuhay) – Senator Sherwin Gatchalian is urging the Duterte administration to immediately address the country’s unstable power situation, warning that a Luzon-wide power outage could cost the country P3.3 billion in economic productivity per hour. Gatchalian, chair of the Senate committee on energy, made the call Wednesday following the recurring power supply problems on the Luzon grid since last week. “Widespread power outages across Luzon would bring national economic productivity to a standstill. The Duterte administration must look into immediately expanding the power supply by tapping new energy resources,” he said in a statement. The senator said the estimated P 3.3 billion losses were computed from the official 2016 first quarter gross domestic product (GDP) statistics released by the Philippine Statistics Authority (PSA) earlier this year. These statistics, he said, include potential losses from industries which rely primarily on grid power, including manufacturing, retail, trade, and the services sector. Sectors which usually have the expanded capacity to rely on self-generated power, including agriculture, quarrying, and construction, however, were not included in the figure, he said. As chair of the energy committee, Gatchalian promised to prioritize measures that would stabilize Philippine energy supply. He also promised to work with Department of Energy Secretary Alfonso Cusi “to create an integrated policy and legal framework which would facilitate the speedy addition of new resources to the Philippines’s energy mix.” “We need to redouble our efforts to explore and exploit new indigenous energy resources, such as the abundant natural gas reserve in Reed Bank. Continued economic growth will depend on ensuring that our domestic industries have access to cheap and reliable electricity,” said the senator. Gatchalian said he would also push for the immediate implementation of viable strategies to bring electricity prices down. “Electricity is an integral part of contemporary Filipino life. Making reliable electricity more affordable will improve the lives of millions of Filipinos. We must work towards easing the burdens of our countrymen and countrywomen,” he said. The senator likewise affirmed his commitment to improve the functionality of the Wholesale Electric Spot Market (WESM), explaining that the Philippine Electricity Market Corporation (PEMC) and the WESM possess the tools to closely monitor trends and market fluctuations in the energy generation sector for public benefit. “PEMC and WESM can provide us with the information necessary to detect collusion and other forms of non-competitive behavior in the market. Their information can prove instrumental in protecting the interests of Filipino consumers,” he said. (MNS)

Recto to Duterte: End ‘endo’ in government, too MANILA, Aug 2 (Mabuhay) – Senate Minority Leader Ralph Recto on Tuesday urged the Duterte administration to “practice what it preaches” and end the contractual employment of up to 120,000 state workers by absorbing them as regular employees. This as President Rodrigo Duterte demanded private firms to stop hiring personnel on a contractual basis, threatening to shut down those who would not comply with the order to end the long existing practice locally referred to as “endo,” a shorthand for “end of contract.” Recto said the government should “open a pathway to regular employment for thousands of casuals who are eligible for permanent civil service.” Saying the size of casual and contractual workers in government

were “as big as the Army,” Recto said there should be an inventory of temporary state workers, including those hired through “job-order,” “emergency hiring,” and the “memorandum of agreement” schemes which are all postings that do not afford an opportunity for regularization. The last count was by the Civil Service Commission in 2010, which had found that there were 21,315 contractual workers and 97,951 casuals, running up to a total of 120,000. This does not include workers hired through job orders, who were paid through the Maintenance and Other Operating Expenses (MOOE) of government agencies, and those hired in subcontracted terms like security guards and maintenance or utility workers.

Miners claim they are ready to step up to President Duterte’s challenge MANILA, Aug 2 (Mabuhay) – Following the warning of President Rodrigo Duterte that mining companies must strictly follow stricter environmental rules or close shop, the Chamber of Mines of the Philippines (COMP) on Tuesday said its members are willing to step up to the challenge. “We continue to take the President’s statements as a challenge for us in the Chamber of Mines of the Philippines to step up our efforts and practices in adhering to the tenets of responsible mining,” the group said in a statement. During his first press conference as President, Duterte on Monday warned miners to heed environmen-

tal rules or they will be shut down as the nation could survive without a mining industry. “We will survive as a nation without you... Either you follow strictly government standards or you close down,” he said. COMP said it will abide by the stricter measures now in place. “Us in the Chamber are covered by a strict edict to safeguard our people, environment and country’s interests and we will continue to abide by the law as the President has stressed to us in the industry and support his effort to weed out the irresponsible miners who conduct their business without regard for the law,” it said.

TRAVEL

Off the grid in Negros Occidental’s Danjugan Island By Azer N. Parrocha

MANILA, (PNA) -- Can you survive a vacation without electricity? A marine and wildlife sanctuary within a 43-hectare island situated in the Sulu Sea is encouraging visitors to get as close to nature as they possibly can, minus modern conveniences. Danjugan Island, which is four to five hours away from Bacolod or Dumaguete, is described by its executive director Dave Albao as a private conservation site and marine protected area. In other words, definitely “not a resort”. It is managed by the Philippine Reef Rainforest Conservation Foundation Inc. (PRRCI), a non-government organization led by Gerry Ledesma who bought the island in 1994 for preservation. Ledesma saw how the reefs were slowly experiencing degradation and wanted to prevent further damage. The island has five lagoons and is covered with limestone forests which is home to over 74 bird species, 10 bat species, 579 fish species and many other wildlife species such as corals, turtles, snakes and the rare coconut crabs. Among the island’s star attractions is its lone Beach Stone-Curlew or Beach Thick-knee, a greybrown shorebird with a massive yellow-based bill and thick knees—thus the name. It can be found across Australia and a few other Asian countries including the Philippines. The Beach Stone-Curlew is a rare

bird, so rare that been tagged as ‘near threatened’. Albao said that Asian tourists would even fly to the Philippines on a weekend just to see the bird, take photos and fly back home. Visitors that first set foot on the island will immediately feel peaceful as it only welcomes more or less 50 guests excluding its 10-member staff. It’s the perfect hideaway from the hustle and bustle of city life. Modern conveniences such as cell service, television and running water will not be part of the Danjugan Island experience, Albao said stressing that people rely solely on natural entertainment and human interaction. If by chance a part of the island does have cell service, visitors will have trouble charging their gadgets as the island uses solar power to run lights while water is usually brought from the mainland, he explained.

The island offers simple accommodations in either the Moray Lagoon Camp or Typhoon Beach Camp. Air-conditioning units are inexistent and visitors will also be given just a bucket of water to bathe in. Albao said that the island is heavily dependent on tourism as its source of income, which is used to further preserve its biodiversity. However, he said that the priority was still conservation and not the entertainment of visitors. Of course, visitors will have enough

activities to keep them preoccupied such as boat-trips, island tours, snorkeling, kayaking to name a few. It’s a favorite among yogis and quiet-loving individuals. A number of marine and wildlife summer camps are also held to educate elementary and high school students of Southern Negros communities through its Danjugan Island Environmental Education Program (DEEP). With seven different types of ecosystems— beach forest, mangroves, lagoons, bat caves, coral reefs, seagrass beds and an open sea— students who aspire to be future ecologists and biologists have the best classroom to learn in. Those who have been to the island before would say that it receives far less attention than it ought to receive, but they also agree that it only adds to the mystique that surrounds this hidden gem in the Sulu Sea. Should you deplete all your savings to pay debts? Like most people, you’ve worked hard and have done your best to pay all your bills on time. But in life, at one time or another, all of us get into a situation where debt can be overwhelming. Money problems can easily overlap into other areas of our lives. Many people feel hopeless and powerless over their debt problems. If you are currently in debt, rather than allowing your money problems to affect your life in such a dramatic way, filing for bankruptcy protection may help you get your life back on track. If you’ve suffered a job loss, are facing foreclosure or have bills you can no longer afford to pay, Congress has enacted bankruptcy laws that can help you get your finances in order. I know that the mere thought of bankruptcy makes most people nervous so they avoid exploring their options until it’s too late. I find this unfortunate because in a lot of cases, people could have turned their situation around much sooner had they

taken the time to find out what their legal rights are. Some people wait too long to file bankruptcy even when it is their only option. In the process, they use up hard-earned assets like their retirement plan, savings accounts, etc. but in the end they realize that this was nothing more than a temporary fix to a lingering problem. Sooner or later, these people realize that they would have been better off filing bankruptcy before losing everything that they had worked so hard for. Don’t let this happen to you! If you’ve come to the end of your financial rope and don’t know what else to do, it is time to face your

debt problems with dignity and do what your situation calls for. I am not saying that bankruptcy is for everyone but after being a bankruptcy attorney for 15 years now and having represented thousands of clients in bankruptcy, what I have seen is that oftentimes, bankruptcy is THE ONLY WAY for most people in debt to get a fresh start when they are in over their heads in debt. If bankruptcy is the best option for you, you don’t need to keep living paycheck to paycheck while digging a deeper financial hole every single month. Yes, bankruptcy may be a scary thing for a lot of people who don’t understand the process but once you’ve taken the time to find out how it works and how it could help you get out of debt, you may realize that it’s actually not as difficult as you first may have thought. Dealing with financial problems can result in stress, fear and embarrassment. Maybe you hesitate

seeing an attorney for fear that you will face criticism. Remember this: With the current economy in turmoil, more and more people are filing for bankruptcy protection so you are not alone. The stigma that once surrounded bankruptcy has almost disappeared. Once you consult with a bankruptcy attorney, you may soon discover that the law is actually on your side and that you just need to let the legal process work for you. If you find yourself overwhelmed with debt problems, I’d like to help you. To schedule a free consultation, please call Toll-Free 1-866- 477-7772. We have offices in Glendale, Cerritos and Valencia. Senators join nation in extending well-wishes to 12 Filipino athletes in Rio Olympics

Japan rating agency keeps investment grade rating on PHL

By Joann Santiago

MANILA, Aug. 3 (PNA) – The senators adopted Wednesday four Senate resolutions recognizing and commending the Filipino athletes, including 12 Olympians, who will compete in the 2016 Rio Olympics slated from Aug. 5 to 21 this year. Senator Juan Edgardo ‘Sonny’ Angara, former chairman of the Senate committee on youth and sports, introduced Senate Resolution (SR) No. 75 to extend well-wishes to the 12 Filipino athletes who will try to win the Philippines’ first ever Olympic gold medal in Rio De Janeiro, Brazil. The 12 Filipino athletes include swimmers Jasmine Alkhaldi and Jessie Lacuna; table tennis paddler Ian Lariba; golfer Miguel Luis Tabuena; long jumper Maristella Torres-Sunan; hurdler Eric Cray; marathoner Mary Joy Tabal; weighlifters Hidilyn Diaz and Nestor Colonia; boxers Rogen Ladon and Charly Suarez, and taekwondo jin Kristie Alora. Angara encouraged the Filipinos to give the same supports they gave to Filipino boxing super star and now Senator Manny Pacquiao whose fights have been watched by almost every Filipino. I expect the same support and fervor will be extended to our 12 athletes in Rio Olympics, Angara said. Since the country participated in the Olympic Games in 1924, the Philippines has not won a single Olympic gold medal. The Philippines has not also won an Olympic medal since boxer Mansueto ‘Onyok’ Velasco won a silver in the 1996 Atlanta Games. The Philippines has won a total of 9 Olympic medals so far. To fired up the 12 athletes, President Rodrigo Duterte increased their allowance from USD 1,000 to USD 3,000 during the recent send-off ceremony in Malacanang. The President also raised the coaches and officials allowances from USD 3,000 to USD 5,000. Angara also introduced RS No. 56 that was adopted by the Senate, commending Fil-American tennis player Treat Conrad Huey for being the first Filipino who qualified in the semifinal round of the prestigious Wimbledon. Huey, together with his Belarusian partner Max Mirnyi, defeated Austrian Oliver Marach and Frence Fabrice Martin, 6-3, 6-2, 7-6 (3) to advance in the semifinals of The Championship, Wimbledon held at the All England Lawn Tennis Croquet Club in London last July 7. The Senate also adopted RS No. 61, congratulating and commending Filipino surfer Philmar Alipayo for winning in the West Sumbawa Open Pro Finals 2016 Surfing tournament last July 20 in Indonesia.

MANILA, August 2 (PNA) – Japan Credit Rating Agency, Ltd. (JCR) on Tuesday maintained its “BBB+ rating on the Philippines, given the economy’s sustained robust growth, with the 6.9 percent first quarter expansion second highest in Asia. The Philippines’ Investment Relations Office (IRO) said IRC also maintained the “stable outlook on the rating, with the latter being a notch away from the “A rating. (The rating decision is based on) the country’s certain resilience to external shocks, relatively sound fiscal position and relatively sound economic growth potential underpinned by robust domestic demand, it said, citing the JRC statement. JRC forecasts a growth of over six percent for the Philippines this 2016, the lower end of the government’s six to seven percent target. This as it noted the Duterte administration’s bid to continue the Aquino administration’s economic programs, and even improve it, and to further increase infrastructure spending. The credit rater said the Philippines’ sound fundamentals, strong current account surplus and foreign reserves will continue to support the domestic economy amid negative external developments. This, as it noted the drop in the proportion of government debt bur-

den to domestic output to 44.7 percent in end-2015 from 45.4 percent in the previous year. Bangko Sentral ng Pilipinas (BSP) officer-in-charge Deputy Governor Diwa Guinigundo said the country had consistently posted fast growth rates in the region and “has proven that boom-and-bust cycles are a thing of the past. We credit our economic gains to a solid foundation that consists of decades of structural reforms, including pursuit of sound fundamentals, he said. These fundamentals – including benign inflation, healthy external payments position, and stable banking system – will continue to help the Philippines build on its gains to become a more inclusive economy, he added. Finance Secretary Carlos G. Dominguez said the Japanese credit rater’s decision on Philippines’ credit rating “is a vote of confidence in the Duterte administration’s resolve to sustain and strengthen the macroeconomic fundamentals that have transformed the Philippines into Asia’s newest bright spot. This serves as a strong impetus for the new government to pursue its 10-point socioeconomic agenda that is meant not only to keep the domestic economy on its upward trajectory but also to make it inclusive for all Filipinos, he added.

Reinventing the circus for today’s entertainment-saturated children

Century 21 Classic Estates Summer Picnic: Cerritos-based Century 21 Classic Estates and its sister companies teamed up for the companies’ annual family picnic for their employees, associates and friends at Liberty Park in Cerritos. More than 500 attended the event of one of the most successful real estate companies in California that caters to a multi-ethnic homebuyers. Shown are some of the attendees of the Hawaiian-themed tradition – (from L-R), Eugenia Delfin, Realtor Rosalie Macapagal, Annabel Washington, Ina Dahilig, Leila M and Lydia Howatt.

For over a hundred years circus has been around us and has always been associated with the summer season. At the Honda Center after wowing the crowds at the Staple Center previously, the “Greatest Show on Earth” lived to its billing as a must see entertainment fare for the summer with a massive show of spectacular talent of men whose indulgence in death defying acts looked like second nature and a parade of animals of many sizes. Death defying features, a dozen tigers and lions, beautiful horses, colorful costumes and spectacular light effects combined to make for a two-hour extravaganza that left the audience breathless. “Out of this world” which premiered at the Staples Center is Ringling Bros’ newest show and is a culmination of two years of hard work by its producer Alana Feld where running a circus is in her blood. The new circus show is actually an effort to reinvent the traditional circus to “recapture the interest of today’s entertainment-saturated children.” With the iconic elephants out of the acts, the circus took on a different mode that resulted in something different. To fill the void with the elephants out of the picture, the decision had to be made by its owners “to move the circus to the ice and give it a story line, similar to the Disney on Ice to appeal to a new generation of kids as its audience.” With the reaction of the audience to the innovation at the Honda Center show, it appeared that the formula had been a success. In spite of the new elements introduced in the show like high resolution projectors, hundreds of lighting fixtures and others, the most traditional acts still remain the heart of the show which include the breathe-taking performance of trapeze artists, lions and tigers, a ring master and skillful and physically-endowed horsemen and women. The new circus version was indeed full of innovations and a seeing the show is a must do activity for this summer season. The circus came to the U.S. in 1793 through John Bill Rickets, an English equestrian rider who used a ring and added acrobats, a rope walker and a clown to go with his equestrian act. There was no elephant being used at that time yet which only came about only in the 1800s. It has evolved with thousand innovations ever since.

Circus at Honda Center: Honda Center in Orange County became the second stop of the great tradition of circus of the Ringling Bros group which featured innovations and features to attract the new generation of kids (and their parents too). The colorful finale put an exclamation point to the two-hour show.

‘Going back in time’: A lesson in history at President Reagan’s Library On a recent three-hour tour of the Ronald Reagan Library with this author’s dear friends, Linda Concepcion - Gaa (widow of former Ambassador Willy Gaa) and college chum, Melanie De Leon, our leisurely summer day began early to avoid traffic all the way to Simi Valley, where this author has once lived six years before the Northridge earthquake. While there, this author has witnessed the construction of the 100-acre library and its progress. The Reagan Library is perched up on a “majestic “ hill with its spectacular view of Santa Susana mountains in Ventura County , overlooking as far east to the Pacific Ocean. The Reagan Library’s “lush gardens and serene setting is a replica of the White House’s Rose Garden and the White House’s South Lawn. The Library is Reagan’s legacy where visitors can participate in their yearround events and exhibits while at the same time getting immersed in learning everything about President Reagan and his values. As a Presidential Library “administered by the National Archives and Records Administration (NARA), the Reagan Library, under the auspices of the Presidential Records Act, is the repository of presidential records of President Reagan’s administration. What’s interesting for the three of us to see in the Presidential Library are “over 60 million pages of documents , over 1.6 million photographs, a half million feet of motion picture film, tens of thousands of audio and video tape, and over 40,000 artifacts. There are also more than 200 works of art and historically significant objects are displayed at the library-museum.” The first part of the exhibits include a replica of the Oval Office, where each current president decorates the Oval Office to suit his taste. Historical data has it that “on

an early October morning in 1909, President William Howard Taft became the first President to walk into the Oval office, located in the center of the south side of the West Wing. However, in 1934,during the Franklin Roosevelt administration, the Oval Office was moved to its current location within the West Wing, to the southeast corner, overlooking the Rose Garden. Then President Reagan, inspired by the West, added earthy colors, western art, including a collection of bronze saddles, and of course a jar of jelly bellies for his desk!” As we peered through the workspace, we noticed two plaques that President Reagan kept on his desk: one said: “It can be done;” and the other was “”There is no limit to what a man can do or where he can go if he doesn’t mind who gets the credit.” Walking through the Museum’s part of the Library, we experienced the numerous interactive displays in the galleries, mostly referencing a tribute to “America’s 40th President and his accomplishments, by capturing his patriotic spirit, his respect for individual liberty, his belief in global democracy and his support of economic opportunity.” Though the three of us have all been to Rome and the Vatican, the Library’s current exclusive West Coast exhibit “Vatican Splendors: A Journey Through Faith And Art,” was previously housed at the Franklin Institute in Philadelphia where the exhibit coincided with the historic Papal visit of Pope Francis. It

is a “10,000 square foot exhibition comprising one of the largest Vatican collections touring the US, including an extraordinary collection of historical and religious objects, dating back to the first century, as well as works of art by Michelangelo such as one of his signed documents and a bas relief sculpture, along with other creative works by: Bernini, Guercino and others.” The three of us felt mesmerized, feeling transported back to the Vatican, experiencing the “underground catacombs where the remains of Saint Peter were discovered while the magnificent papal chambers, on the other hand, were found above ground.” Also, among the awesome exhibits were: the re-creation of the Sistine Chapel, where we were able to view the Sistine Chapel’s ceiling 10 feet away, enabling us to experience Michelangelo’s masterpiece. Additionaly, among the impressive items on display was a bronze cast of Pope John Paul II’s hand (which we were able to grasp). Apparently, “during

the 1980’s both President Reagan and Pope John Paul II forged a faith-based friendship as they fought communism and the former Soviet Union.” Other religious and historical artifacts include: “venerated remains (bone fragments) of Saints Peter and Paul , artifacts discovered at the tombs of saints Peter and Paul, and historical objects from the modern and ancient basilica of Saint Peter’s in Rome. These objects are presented in galleries worldwide, whose purpose is to “enhance its historical and artistic significance.” Other exhibits worth noting were: a tile from the roof of the ancient Saint Mary Major Basilica in Rome, a rare letter and a signed document of Michelangelo, which showed the “tenuous relationship the artist had with Pope Julius II, who continually pushed for the completion date of the project, and Michelangelo’s response, complaining about the quality of materials from the suppliers, which the Pope had brought on to assist See LIGHTHOUSE, page 9

Senator Leila ‘lying’ De Lima Senator Leila ‘lying’ De Lima is fuming mad regarding allegations that the proliferation of illegal drugs were rampant at the National Bilibid Prison (NBP) during her term as Justice Secretary. Senator De Lima recently delivered a privilege speech where she accused some allies of President Rudy Duterte of linking her with known influential and powerful drug lords in the Philippines. However, there is a growing perception among the public that drug money was the major contributing factor that helped De Lima get into the Philippine Senate. And people were actually not surprised to hear that Senator De Lima, who is “perceived to be sympathetic to drug lords, is contemplating of initiating a Senate investigation regarding the summary killing of drug addicts and drug lords as well as their henchmen. There are at least three key men of President Duterte are ganging up on Senator De Lima’s alleged connection with powerful drug lords in the country. House Speaker Pantaleon Alvarez was quoted that he will initiate a resolution in the lower house to determine if Senator De Lima has anything to do with the unabated proliferation

him - that they were not the best quality materials for what the Pope was paying. All of the grandiose items in the “Vatican Splendors exhibit will be returned to the Vatican from which they cannot be absent for more than a year. A significant portion of the Reagan Library also includes the history and the many responsibilities of the United States Secret Service, “America’s elite federal law enforcement agency. In 1983, then President Reagan was quoted as saying: “were

9

of drugs inside the Bilibid Prison. Justice Secretary Vitaliano Aguirre, on the other hand, said that a top DOJ official is in the payroll of drug lords at the Bilibid Prison. A purported video even came out showing then Justice Secretary De Lima singing during a birthday celebration of a now convicted drug lord. It is funny to hear Senator De Lima complaining that an attack on a sitting senator is an attack on the Senate as an independent institution. De Lima must be suffering from loss of memory. Somebody should remind her of what she did to Senators Juan Ponce Enrile, Jingoy Estrada and Bong Revilla. Or better remind Senator De Lima about the phrase “You reap what you sow. Although I think that both Senators Estrada and Revilla benefitted from their pork barrel funds worth millions of pesos, De Lima, however, should have given them

a fair chance to air their side and not to resort to trial by publicity. *** Vice President Leni Robredo has expressed apprehension on the possibility of raising a huge amount of money in case she needs to defend herself in court in connection with the election protest filed by former Senator Bongbong Marcos. Marcos is claiming that massive electoral fraud, threats, terrorism, force, free-shading of ballots and abnormally high unaccounted votes/ under votes for the position of Vice President affected the results in 25 provinces and five highly urbanized cities in 39, 221 precincts. I think what VP Robredo is afraid of is the possibility that the “dagdag-bawas scheme the Liberal Party (LP) probably did for both defeated presidential candidate Mar Roxas and herself may be uncovered. Several witnesses have already came forward and testified on how they have seen, and were forced to do, to ensure that Robredo wins the VP race if Roxas fails to overcome the huge number of votes Duterte has received. We will have to see if the LP will shoulder the election protest expenses of Robredo in order to cover up the dirty tricks they employed during

the May 9 elections, which made Robredo win against Marcos. *** So far, President Duterte’s all-out campaign against illegal drugs in the country has been successful. Duterte has been in office for only five weeks, yet the number of drug addicts and drug mules who have voluntarily surrendered totaled more than 70,000. Hopefully, President Duterte and the PNP will be able to neutralize the Mexico-based drug cartel “Sinoloa, which has been using the Philippines as its transshipment arena. According to Duterte, “Sinoloa as well as the Chinese-based drug syndicate called “Triad, has been responsible for the proliferation of drugs in the Philippines. I think it is about time that the Philippine government reinstate the death penalty to deter drug smugglers from doing business in the Philippines. Capital punishment, either by electric chair or lethal injection, will help a lot in the prevention of crime against society in the country. Congress should also support Duterte in this campaign, instead of blaming him for the deaths of several drug lords in the past few weeks. We all need to rally behind President Digong to make the Philippines a better place to live in.

it not for the brave efforts of Secret Service Agents, I might not be here today. These Federal Agents, without a doubt, face dangers and perhaps tragedy, everyday. For this author, it was quite an experience to read the History of the United States Secret Service. The Agency was established “after three Presidents were assassinated: Presidents Lincoln, Garfield and McKinley, thus agents were officially assigned to protect the President. However, Presidential candidates also were given Secret Service protection after the death of Senator Robert Kennedy. The significance of the

Secret Service Agents become recognizable during motorcades, when agents travel with the President in sleek black limousines with darkened windows and advanced technologies. And, one of the Secret Service’s major responsibilities was to learn how to detect devious counterfeit money being transacted worldwide. The last part of the exhibit includes then President Reagan’s Air Force One airplane and helicopter. The history of Air Force One, Tail Number 27000, according to its brochure, was a Boeing 707 and it was accepted into the Air Force on August 4, 1972 after 200 hours of testing.

President Richard Nixon was the first president to use it in February, 1973 from Andrews Air Force Base to Chicago. This particular Tail Number 27000 has subsequently flown seven U.S. presidents: Nixon, Ford, Carter, Reagan, H.W.Bush, Clinton and W. Bush. The opportunity of going inside the cabin of the 52-passenger, plus crew of the Air Force One, used by seven of our presidents, certainly gave us the feeling of finaly grasping the outstanding and significant roles of all these leaders have done to make the United State of America a great country to live in!

Provisional waiver of unlawful presence bar expanded to cover more Immigrants The USCIS announced the final rule expanding the existing provisional waiver to allow certain family members of US Citizens and lawful permanent residents to apply for the provisional waiver of unlawful presence. 8 CFR Parts 103 and 212. The final rule goes on effect on August 29, 2016. Prior to this expanded rule, only immediate relatives of US Citizens were eligible to request provisional waiver of unlawful presence before departing the United States for the processing of their immigrant visas. This was a limited to only a subset of all individuals statutorily qualified to request a waiver of unlawful presence. The final rule expanding the provisional waiver of unlawful presence makes eligibility for the provisional waiver available to all individuals who are statutorily eligible for a waiver of the unlawful presence grounds of inadmissibility. 8 CFR Parts 103 and 212. These individuals are the parents, spouse, and son or daughter of US Citizens and spouse, sons or daughters of lawful permanent residents. The provisional waiver will also extend to the spouses and children who accompany or follow to join principal immigrants. To qualify for a provisional waiver, applicants must establish that their US citizen or lawful permanent resident spouses or parents would experience “extreme hardship” if the applicants are not allowed to return to the United States due to the unlawful presence bar. Applicants must also establish that his or her case warrants a favorable exercise of discretion and meet all other regulatory requirement. Obtaining a conditional approval

of a provisional unlawful presence waiver of inadmissibility is particularly helpful for individuals present in the United States without having been inspected and admitted or having been inspected or paroled since they are ineligible to adjust status inside the United States. The provisional waiver would also be helpful to individuals who entered the US under certain non-immigrant visa that has restrictions to adjusting to lawful permanent resident inside the US such as crew men who entered on a C-1/D visa. In addition, this is also helpful to spouse, sons or daughters of lawful permanent residents who overstayed their status while waiting for their visa priority dates to become current. An individual who entered the US on a fiancé k-1 visa based on a different US citizen fiancé/spouse will also benefit from the provisional waiver. These individuals would have to obtain their visa through the US consulate overseas but without an approved provisional waiver, would run the risk of not being able to return to the United States due to the unlawful presence bar. INA section 212(a)(9)(B)(i); 8 USC 1182(a)(9)(B)(i); In addition, the expanded final rules provided for the following: 1) All individuals seeking provisional waivers, including those in removal proceedings before the EOIR

must file applications for provisional waivers with USCIS. 2) Individuals are allowed to apply for provisional waivers even if USCIS has reason to believe that the individual may be subject to other grounds of inadmissibility. 3) Eliminated the proposal for temporal limitations that would have restricted eligibility for provisional waivers based on DOS visa interview scheduling. 4) Allows individuals with final orders of removal, exclusion, or deportation to be eligible for provisional waivers provided that the individual have already applied for, and USCIS has approved, an Application for Permission to Reapply for Admission into the United States after Deportation or Removal, Form I-212. However, an individual will be ineligible for a provisional waiver if ICE or CBP, after service of notice under 8 CFR 241.8, has reinstated the removal, deportation, or exclusion order prior to the individual filing the provisional waiver or while the provisional waiver application is pending. Young senior loses job and converts Chapter 13 to Capter 7 AND fights to keep house When I say young senior, I mean 60. She’s a single mom with two adult daughters who are over the age of 21. One daughter is still in college but has a part time job. The other works full time. Both daughters live with client in her house, but she does not claim them as dependents in her income tax returns. When we filed her Chapter 13 three years ago, she had disposable income of $900. However, at that time, her job security was already in question as another company had just purchased employerandheads were rolling. Client was able to keep her head for three years but lost her employment recently. Without work, she no longer has disposable income. Our first attempt to end her case was filing a motion to pay off the 33% plan by liquidating $10K from her retirement account. The Chapter 13 trustee objected to our motion to pay off the plan unless the pay off was 100%. Well, that wasn’t a good deal because her unsecured debt was about $100K which meant that client had to come up with $90K more to get a Chapter 13 discharge, that’s a 100% plan pay off. Client had two other options dismiss the Chapter 13 case, or convert it to Chapter 7 and get a discharge of $90K of unsecured debt. The problem is that for the last three years, the value of her house, just like most houses in Los Angeles and Orange County, have been appreciating significantly. We checked Zillow, which estimated the value at $400K, and REDFIN estimated it at $440K. Whereas her house only had $30K of equity when she filed for Chapter 13 in 2013, now she has equity of $160K. The other problem was that she had testified at the Chapter 13 hearing last week that her daughter was in-

dependent, although she lived with her. And she did not mention that she had a second daughter who also lived with her, a full time college student. So, the trustee concluded that her claim of homestead exemption should only be $75K, not $100K. We refused to reduce the exemption claim to $75K because the trustee was not on solid ground with her argument that debtor had testified that daughter was independent, therefore, she is not considered to be part of the family unit. We argued that the other daughter was a full time college student, therefore, unable to take care of herself. So by definition, she is part of debtor’s family unit. As a result, the homestead exemption of $100K is correct. Settlement offers and counter offers were made. The negotiations were fruitful and trustee settled for a reasonable amount to allow the debtor to keep her house. Even though debtor was not employed, she was willing to liquidate a part of her retirement account to pay for the settlement to keep her house. Daughters were willing to buy the house from her anyway later on, so she gets her settlement payment back. Nowadays, the correct value of the residence is critical to keeping the house safe from the clutches of the Chapter 7 trustee, because house values are at their peaks again. Mortgage rates have been kept very low by the Feds for a long time. The last

time house values peaked was 2007, just before the mortgage crisis, which bankrupted a lot of big banks. When the crisis hit, house values dropped by more than half. Now, all of that has been recovered, and new highs are being achieved. Therefore, a lot of factual and legal analysis must be done before deciding which path to take, Chapter 7 or Chapter 13. The second client is 72. Her husband passed away some time ago. She has a daughter who has just started college. I guess she must have married late. She now receives only social security and has no other income. However, she owes $70K of credit cards, which requires $2100 of monthly minimum payments. Her social security is $1,600. Let’s not even go further. Client doesn’t own a house. She rents for $1,000. Well, with $600 left after rent is paid, and a daughter in college, let’s just say that there’s tremendous pressure on her to budget her expenses. Obviously, there is no money to pay $2100 for credit cards every month, is there? So, she chooses to make the $70K credit cards DISSAPPEAR with a Chapter 7 petition. Just imagine the number of calls she gets everyday from these cards trying to get their pound of flesh from her. That’s no way to live no matter how old or young you are. $2100 a month for credit cards is equal to a mortgage of $400K. I mean you can literally buy a house, condo or townhouse for $400K with nothing down, instead of carrying $70K of credit card debt. Think about where you want your hard earned money to go. Would you rather be the proud owner of a house, or the proud owner of $70K of credit cards? At 72, client finally realized that

she should have gotten rid of her credit card debt a long time ago. If she got rid of them ten years ago, she would have saved up $252K now. Instead she gave $252K to her credit cards of $70K, and she still owes the same $70K after ten years! Think hard what you should do now because the earlier you get rid of credit cards, the faster you can save money and be productive again. Even at 72, it’s not too late to get rid of them, better late than never. “The Lord himself goes before you and will be with you;he will never leave you nor forsake you. do not be afraid;do not be discouraged. Deuteronomy 31:8 Lawrence Bautista Yang is a graduate of Georgetown University Law Center and has been in Law practice for thirty years. HILLARY From page 1

Spanish. His language skill will surely come in very handy when he goes stomping in battleground states like Arizona, Nevada and New Mexico. After all, getting Latinos, (along with African Americans) to come out and vote is an urgent and an absolute necessary affair. “The growth among non-Hispanic white eligible voters has been slower than among racial or ethnic minorities in large part because they are overrepresented in deaths due to an aging population,” according to Pew Research Center. “By comparison, racial/ethnic minorities – who make up 31 percent of the electorate – accounted for 43 percent of new eligible voters born in the U.S. who turned 18.” Hispanic voters surged from 23.3 million since

2012 to 27.3 million in 2016, a 17 percent growth. Yet in the swing states, where every vote counts, it would be a major mistake to not pay attention to the other minorities whose populations are growing very quickly. Korean voters in Virginia, Filipino voters in Nevada and Vietnamese voters in Oklahoma, for instance, though still relatively small groups in those states, can form a formidable voting bloc. According to Pew Research Center, Asian American eligible voters in the U.S. have increased 16 percent as well, that is, to 9.23 million in 2016. In Nevada, Filipinos make up more than half of the Asian American population, or 120,000, although many aren’t registered voters. A registration drive right now is not too late, and here’s a hint: Many read the Philippine News and Asian Journal, and they watch the Filipino Chanel’s popular bilingual news program “Balitang America,” which airs nationwide. Tim Kaine might want to get on that show, or better yet, Hillary Clinton might want to remind Filipino Americans of her record in keeping the South China Sea from falling completely into Chinese domination and that, as president, she would continue to keep it a priority. Should the Democratic campaign bother with an ethnic group, which, although growing fast, has such a low voter registration? Two words: slim margin. Think about it this way: In 2000, in that unforgettable and most controversial presidential election in modern U.S. history, George W. Bush

won against Al Gore thanks to his 537-vote lead in Florida. That razor-thin margin could have been turned around if the U.S. Supreme Court had allowed a recount and the fate of America might well have shifted away from wars, recession, debt, spilled blood and lost national treasure. So far, the Democrats have concentrated on black and Hispanic voters. Although it is true that blacks and Latinos make up formidable voting blocs and should be rallied for in every state, it is a strategic mistake for the Clinton-Kaine ticket to ignore potential sizable

voting enclaves waiting in plain sight in each battleground state. Those swing states are Nevada, New Hampshire, New Mexico, Arizona, North Carolina, Florida, Ohio, Iowa, Georgia, Pennsylvania and Wisconsin. This is a challenge in terms of political organizing. If all politics is local, then all local politics may demand increasing outreach to ethnic media and to community organizations and their leaders. In Orange County, Calif., for over a decade now, no candidate has been able to afford ignoring Vietnameseand Spanish-language media when running for public office.

fact, three hours after the firefight, some bodyguards came out and turned over several firearms,” said Espenido, who was installed as town police chief on July 18. If it is okay for PNP Chief Director General Ronald Dela Rosa for the mayor to return and function as chief executive, Espenido said it would be better for the father to quit his post. “It’s better for him to resign since he’s not fit to lead a local government unit. Everybody knows that he’s engaged in illegal drugs and leads a liquidation squad,” the official told reporters. The band of private armies is allegedly led by the mayor and his son, Rolando, Jr. known as “Kerwin.” At least six of them were killed during an encounter with the police early Wednesday morning. The police identified those killed in shootout as Ricky Gravillo of Albuera, Teresito Laro Paderanga of

Zamboanga del Sur, Richard Mato of Zamboanga del Sur, an alias Tatay from Mindanao, an alias Arman from Mindanao, and one unidentified bodyguard. “They are members of the liquidation squad. They don’t even wear bonnets when they commit crimes since they are confident that no one recognizes them,” Espenido added. The armed group are reportedly behind the killings of the town’s former police chief, a newly elected town councilor and a police asset. These killings took place between May to July this year. On Thursday, the police regional office presented to the media some 21 assorted long firearms, 16 short firearms, hand grenade, and ammunitions recovered after the fire fight, buy-bust operation and some were turned over by alleged members of the Espinosa group who surrendered to authorities.

YASAY From page 1

Yasay was referring to the July 12 decision of the Permanent Court of Arbitration (PCA), which ruled in favor of the Philippines, as it invalidated China’s so-called nine-dash line, its basis for claiming almost the entire South China Sea. “And at the same time, we are guided and bound by the Philippine Constitution that mandates us to pursue an independent foreign policy with the paramount consideration for national sovereignty, territorial integrity, national interest, and the right to self-determination,” Yasay said. Manalo said Yasay was unable to attend the event held at the Manila Hotel due to an urgent matter. Yasay also stressed the need to

resolve the sea dispute in a “climate of trust and confidence,” which, he said, “shall only be built if all parties adhere to a set of rules and principles accepted by the international community.” Aside from Philippines and China, other countries who have overlapping claims in parts of the South China Sea are Brunei, Malaysia, Vietnam and Taiwan. Manila refers to the South China Sea as the West Philippine Sea. Yasay reiterated that PCA’s ruling was “binding” and “provides a good basis for a rules-based approach of resolving disputes” in the South China Sea. China has refused to recognize the PCA ruling. foist a lie. That is the truth,” he said. This information was among the reasons why the President has strengthened the government’s nationwide anti-illegal drugs campaign. President Duterte said that if he is not able to eradicate the illegal drugs problem it would be a problem forever. “Seven years from now, double the addicts, by the increase, then we will have the narcopolitics,” he warned. The President has repeatedly warned about the dangers on the use of shabu or methamphetamine because of its chemical components. Citing forensics’ statement, the President said a year of continuous usage of shabu would shrink a user’s brain and it cannot be resolved through rehabilitation. The Chief Executive said shabu addicts are very dangerous because

they commit crime like stealing and rape and the situation has resulted to a drug war. “You want me to fight the drug war, I am not fighting a crisis, I am fighting a war,” he noted. President Duterte earlier named several personalities allegedly were among the major players in the domestic illegal drugs industry and these include a certain Wu Tuan, alias Peter Go, who is currently detained at the New Bilibid Prisons; Peter Lim alias “Jaguar”; and Herbert Colangco. He has also exposed the names of several active and retired police officers allegedly involved in illegal drugs trade and these are retired Police Deputy Director General Marcelo Garbo and General Vicente Loot and police generals Bernando Diaz, Joel Pagdilao, and Eduardo Tinio.

You are fired!

It is a sad day when an employee hears these words. This means that difficult days are ahead. Money will be in short supply. Uncertainty will cause anxiety. The employee may suffer depression. Family relationships may suffer. In short, the ex-employee and his or her family will suffer a lot. In many instances when an employee is fired, the employee may have been the victim of wrongful termination. But what does wrongful termination mean? In the employment context, wrongful termination means unlawful separation from the job. It means the employee was fired in violation of a certain law, and/or in violation of a fundamental public policy. There are many laws and fundamental public policies that may be implicated in a wrongful termination of an employee. Some examples are: (1) Safe working conditions, (2) Prompt and accurate payment of wages, (3) Non-discrimination in the workplace, (4) A workplace free from harassment, sexual or otherwise, and many others. For example, if an employee complained about working over 8 hours in a day without getting paid overtime premium, and is fired because of the complaint, then this is a case of wrongful termination. If a female employee rejects the amorous advances of her supervisor, and then she suffers retaliatory actions, and thereafter fired, then there is wrongful termination. There are too many ways in which an employee can be terminated wrongfully, and I won't be able to list all of them here. Most of the time, a company will hide the true unlawful reason for

<28 7+( /$:

%\ &HDVDU 6 1DWLYLGDG (VT

the termination. An employee who complained that the place of work is too hot may find that the supervisor is now finding that the employee is too slow in doing the job. And after a warning and a suspension, the employee is fired. Or an employee who testified in favor of a co-employee in an EDD hearing finds out that he or she is assigned to a work shift that is really difficult, and is therefore forced to quit. Retaliation occurs when an employer reacts in an way adverse to an employee after the employee acts pursuant to fundamental public policy. When an employer cites lawful reasons for the firing of an employee, when in fact the real reason is that the employee complained about the working conditions, or that the employee rejected the sexual advances of her supervisor, then there is a case of pretext . Fortunately, California has plenty of laws that provide remedies to the employee who is subjected to wrongful termination. If it is proven that the employee has been successfully terminated, the employee may recover lost wages, past and future. She will also be entitled to recover for emotional distress and other losses. Sometimes, if malice is proven, the employer will be forced to pay punitive damages. The amount of damages that an employee may recover from wrongful termination can be significant. Sometimes, unlawful or wrongful

termination is not so easy to see. The non-lawyer may not be familiar with the "fundamental public policies" that may be involved. Sometimes, there are some deadlines and administrative reporting that have to be completed before an employee can successfully recover for damages in a civil court. What do you do when you are fired from work? When you are fired from work, consult with an employment lawyer right away. The lawyer will listen to your description of the events leading to the termination. The lawyer will also ask plenty of questions. And the lawyer can advise

OPINION

Duterte: Equality will be resolved in favor of the poor

MANILA, Aug. 4 (PNA) – Appearing before the faculty and students of the Ateneo de Davao University during the “Oya Mindanaw,” President Rodrigo R. Duterte lashed out at the oligarchs who exploit the country’s natural resources, particularly those in the mining and fisheries industry. “We are here now and we will go after mining businesses, which do not follow the standards. Even if it were a legitimate business, we can only hold so much. Whether it is legal or not, it will destroy the country,” the President said. President Duterte and Department of the Environment and Natural Resources (DENR) Secretary Gina Lopez are passionately going after mining firms that continue to practice environmentally destructive open-pit methods and corporations that are granted mining permits through money, influence and sheer greed. “I am fighting a monster. Believe me, I will destroy their clutches on our nation,” he said. The President stressed that it is not proper to grant permits solely on the basis that a mining firm can afford it. He pointed out that he is determined to put a stop to destructive mining practices, simply because the land has already taken a beating. He said, “What I am sure of, I am a worker of government. Mining is a sunset industry and also logging. It is already too late. If there were 24 hours in a day, logging is on its 25th hour. We cannot cut trees anymore.” Proud of the fact that during the elections, he refused to accept campaign contributions from individuals who had vested interests, the President feels he owes no favor to anyone and he serves not one but everyone. “The oligarchs are resisting because it will destroy the power vortex. I do not owe anyone. Many would like to maintain the status quo. I will destroy this little by little. I will open the country’s resources to all Filipinos, regardless of tribe, race or religion. We have only one nation,” he stressed. The President has time and again expressed how deeply he hates oppression in any form. He called on the people to let the government take care of the nation because it is the only one we have.

Dureza: Release of political prisoners still depends on ‘judicial procedure’ MANILA, Aug 2 (Mabuhay) – Communist Party of the Philippines (CPP) peace consultants Benito and Wilma Tiamzon are among the political prisoners who will be considered for release in connection with the resumption of peace talks between the government and the CPP, presidential peace adviser Jesus Dureza said Tuesday. Dureza, however, said the couple’s release will depend on “judicial procedure.” “[T]he Tiamzon couple were included in the list they (CPP) submitted that we have to do our best efforts for their release,” he said. “As to whether or not they will eventually be released, [that] will depend really du’n sa procedure, judicial procedure that we have to comply with. Kaya kasama sila doon kapag naituloy ‘yun at ma-comply natin ‘yung requirements ng courts for their possible release,” Dureza added. The Tiamzons were arrested by military and police personnel in Barangay Zaragoza, Aloguinsan, Cebu on March 22, 2014. They are facing kidnapping and serious illegal detention charges in connection with the four soldiers held captive by the New People’s Army, the CPP’s armed wing, for about two months in 1988. Aside from these charges, the couple are also facing cases of rebellion and crimes against humanity, including murder dating

back to 1988. Dureza said the government is exerting its “earnest effort” to make the release possible in time for the resumption of peace talks in Oslo, Norway, on August 20. “We’re doing our best right now to comply with these processes. Legal processes kasi, judicial processes ang susundin. Hindi lang basta sabihin ng Pangulo, ‘Labas na kayo diyan.’ These are cases pending in court. They are in prison,” he said. He added: “[K]ahapon nag-order ulit ang Pangulo just to find out whether kaya nating ipalabas ‘yung mga consultants nila and negotiators nila, so they’ll be there in time for the negotiations on August 20.” Dureza, however, clarified that the release of political prisoners is not a pre-condition for the resumption of the negotiations. “Walang pre-condition dito,” he said. “If you notice in the signed joint statement namin in the exploratory meeting in Oslo, isang agenda item lang ‘yun... And the language is: ‘Our panel, our side, will recommend to the President the possible release of [political prisoners from the] CPP-NPANDF.” “Best efforts na. We’re doing our best now, because we feel it’s but fair. But I’d like to make it clear, it’s not a pre-condition in the resumption of the talks there in Norway,” he added.(MNS)

Leni: Bongbong poll protest not my top priority MANILA, Aug 3 (Mabuhay) – The election protest filed by former Senator Ferdinand “Bongbong” Marcos Jr. is not the top priority of Vice President Leni Robredo at the moment. Robredo, who won against Marcos by a slim margin, said she is busy juggling her tasks as the second most-powerful official in the land and the head of Housing and Urban Development Coordinating Council (HUDCC). “Baseless ang accusation so siguro sa mas ano na lang, i-leave ko na lang sa abugado ko ang pagsagot. Hindi kami nag-aalala sa pag-explain kasi wala namang tinatago eh. Mas gusto ko sana makapag-concentrate sa trabaho,” she said. “Iyung HUDCC sobrang daming problema, ang daming aasikasuhin. Iyung abugado na lang mag-asikaso. Kahit pa baseless accusation, kailangang sumagot, mag-file ng pleadings.” Marcos filed his election protest last June 29, alleging that Robredo’s proclamation as vice-president is “null and void because the [certificates of canvass] generated by the CCS are not authentic, and may not be

used as basis to determine the number of votes that the candidates for vice-president received.” Marcos, who lost to Robredo by only 263,473 votes, claims the vice-presidential race was marred by “massive electoral fraud, anomalies and irregularities” such as pre-shading of ballots, pre-loaded Secure Digital cards, misreading of ballots, malfunctioning VCMs, and an “abnormally high” unaccounted votes/undervotes for the position of VP, among others. The Supreme Court, acting as Presidential Electoral Tribunal, has ordered Robredo to answer Marcos’ protest. The tribunal also ordered the Commission on Elections to preserve and safeguard records pertaining to the May 2016 vice-presidential race. Marcos earlier asked the tribunal to issue a precautionary protection order (PPO) to preserve the integrity and safety of all the ballots, ballot boxes, voters’ receipts, election returns (ERs), computerized voters’ list, audit logs, transmission results, log files and other documents and paraphernalia used in the May 2016 elections. Obama calls Republican nominee Trump ‘unfit’ to be president WASHINGTON, Aug. 3 (PNA/Xinhua) – US President Barack Obama on Tuesday called Donald Trump “unfit” to be US president amid bipartisan outcry following the Republican presidential nominee’s feud with the family of a fallen US Muslim soldier. “I think the Republican nominee is unfit to serve as president,” said Obama here at a press conference. “I said so last week and he keeps on proving it.” “The notion that he would attack a Gold Star family that has made such extraordinary sacrifices on behalf of our country, the fact that he doesn’t appear to have basic knowledge around critical issues in Europe, in the Middle East, in Asia, means that he’s woefully unprepared to do this job,” said Obama. Trump provoked bipartisan blame over the weekend after he derisively answered criticism from Khizr Khan, the father of a

Muslim American solider killed by a suicide bomber in Iraq. Khan, during last week’s Democratic National Convention, blasted Trump for his divisive remarks and proposal to temporary ban Muslims entering the country and divisive tone. The bellicose Republican standard-bearer responded by implying that Ms. Khan, who accompanied his husband on stage on the final day of the Democratic National Convention, was forbidden to speak.

Is Rufa Mae pregnant? Television and radio host Grace Lee appeared to have revealed the pregnancy of sexy comedienne Rufa Mae Quinto. Lee on Tuesday posted to her Instagram account a photo of her with Quinto. “Nothing better on this rainy afternoon than pigging out with this glowing pregnant lady. Three cups of rice for us two,” the caption read. She has since edited the post and removed the word “pregnant.” Quinto, who is engaged to be married this November, has yet to personally confirm her pregnancy. Her latest Instagram post shows her with her non-showbiz boyfriend, Trev Magallanes. The closest Quinto came to hinting about being on the way was a photo on her account of a stuffed bear she received from a friend. Many of her fans in the comments section quickly speculated that the gift is actually for her soon-to-be child. Quinto and Magallanes are set to tie the knot in a Christian wedding ceremony on November 25 at the Or-

Milby finally admitted that he is now in a relationship with Filipina-British model Mari Jasmine. “Yes, kami na. Ayaw ko na i-share ‘yung other details pero gusto ko lang i-share na yeah, kami na. I’m very, very happy,” he said. Since Jasmine is not from show business, Milby said both of them have decided to keep what they have away from the spotlight. “It becomes more complicated when Sam Milby people try to be more involved. They try to think they know what’s going on. Most of my life is in the spotlight, in the public eye. I like the fact na she’s a very private person and she wants to keep our relationship private also,” he said. Asked if he thinks Jasmine is already the woman he wants to spend the rest of his life with, Milby only gave a meaningful smile and said: “I’m hoping.” (MNS) Rufa Mae Quinto

Karla approves of Daniel, Kathryn ‘exclusively dating’ “Okay. Bongga naman ‘yon!” This was the reaction of Karla Estrada now that her son Daniel Padilla and leading lady Kathryn Bernardo are now “exclusively dating.” In an interview on Monday at the set of her sitcom “Funny Ka, Pare Ko” with Bayani Agbayani, Estrada said she sees nothing wrong with the two dating. “Minsan nakakatulong ‘yon sa trabaho. Nagkakaintindihan kayong dalawa, hanggang sa kayong dalawa ang magkasama sa trabaho,” she said. “Minsan kasi kapag mayroon kang ini-entertain na iba, tapos ‘yung isa ‘di nakakaunawa kung anong trabaho mayroon ka, doon ‘yun nagugulo, nagugulo talaga.”

Rates will likely remain relatively low till the end of 2016 The Federal Reserve policy maker might not have a choice on raising interest rates this year due to the many factors that is signaling that we still have a weak job and income growth and the economy is still on egg shells and too sensitive to a rate hike. Growth data will be revised and Fed policy makers will get two more employment reports before the next meeting, monetary policy makers said Monday in a Bloomberg Television interview in Beijing. That the Dallas reserve bank’s 2016 growth forecast will still probably call for an expansion of just less than 2 percent. September is very much on the table but I think we’ll have to see how events unfold and so it’s too soon to jump to a conclusion. The policy makers still believe the consumer will be strong in 2016, but it makes us also be very watchful for the next number of data releases to see what trend we’re on. I believe these comments are not words of confidence but caution. The financial markets, however, think that a rate rise this year is highly unlikely. And on Friday rates hit a record low as the 30-year rate reached 3.36 according to Bankrate – the record set back in 2012. A gauge of the dollar held close to its weakest level in a month after traders pushed expectations for a Federal Reserve interest-rate increase out to at least mid-2017. The Bloomberg Dollar Spot Index was little changed after sliding 1.7 percent last week, its biggest drop since April, on data showing second-quarter U.S. gross domestic product expanded at less than half the rate economists had forecast. Morgan Stanley warned the worst

is still to come for the greenback as the economy deteriorates further. “The GDP numbers were a disappointment,” said Jane Foley, a senior currency strategist at Rabobank International in London. “The markets are trying to get a handle on the Fed, on whether or not it will hike interest rates this year or whether or not it will have enough excuses to delay. So the dollar is looking vulnerable on that front.” The dollar is weak now but compared to foreign currency it still is a safe haven for investors to park their money temporarily. Dollar-yen is rebounding after being beaten up so much prior. U.S. economic data weaken to the point that a Fed rate increase next month is impossible, the dollar versus yen may break 100 this week. A year ago it was close to 125. Futures signal less than a 40 percent likelihood of higher U.S. rates by year-end. That’s down from a 49 percent probability on July 26. The first month where traders see better-than-even odds for an increase has been pushed to June 2017, from February on July 26. Investors are underestimating how many times the U.S. central bank will raise rates this year and next, but they are probably right about the pace being slower than previously thought, New York Fed Suprisingly first-time home buy-

ers accounted for only 27 percent of sales nationally in December, the lowest since the National Association of REALTORS® began tracking them in 2008. Typically, first-time home buyers account for 40 percent of the market. Why are their numbers dwindling? Housing experts point to several hurdles, such as high student loan debt, less-than-perfect credit, low employment and wage growth, and the double-digit growth in home prices this past year. First-time home buyers tend to purchase lower-priced homes, but they’re facing competition for those homes from all-cash investors. Cash purchases accounted for 42.1 percent of all U.S. home sales in December, up from 38.1 percent in November, and up from 18 percent a year prior, according to RealtyTrac. Tight credit is also preventing younger home buyers from qualifying for a mortgage to buy a home, as mortgage lenders require higher down payments. FHA loans, which many first-time home buyers turn to for the low down payment requirements, have seen their market share decrease recently after an increase in premiums and fees this year made

them less attractive to some. However, Fannie Mae and Freddie Mac are lending more to firsttime buyers, according to a report from Inside Mortgage Finance. The share of financing for first-time home buyers by the mortgage giants reached 19.5 percent in December, up from 14.1 percent a year prior. The move up buyers and sellers are not back in full force but we are seeing more sellers becoming new buyers, that will stimulate and balance the market from first time homeowners to million dollar buyers. Home prices are steadily increase 5-8% which is a good sign in most areas. With rates this low, homeowners are too comfortable with their payments, refinancing market has tripled in numbers due to homeowners taking advantage of these low three percent rates. Homeowners are paying down debts and home improving again. Good for the small contractors and homebuilding sector. US launches Zika vaccine trial in humans WASHINGTON, Aug. 4 (PNA/ Xinhua) – The US government has launched its first clinical trial of a Zika vaccine in humans, the National Institutes of Health (NIH) said Wednesday. The early-stage study, led by the NIH’s National Institute of Allergy and Infectious Diseases (NIAID), will evaluate the experimental vaccine’s safety and ability to generate an immune system response in participants. The vaccine will be tested in at least 80 healthy volunteers, aged 18 to 35, at three sites -- the NIH Clinical Center in Bethesda, Maryland, the University of Maryland in Baltimore and Emory University in Atlanta. NIAID Director Anthony Fauci said that his agency has worked expeditiously to ready the vaccine,

which has been shown to be “very encouraging” in animal testing. “We are pleased that we are now able to proceed with this initial study in people,” Fauci said in a statement. “Although it will take some time before a vaccine against Zika is commercially available, the launch of this study is an important step forward.” The vaccine is similar to an investigational West Nile vaccine developed by the NIAID, which was found to be safe and induced an immune response when tested in an early-stage clinical trial. It includes a small, circular piece of DNA, called a plasmid, that scientists engineered to contain genes that code for proteins of the Zika virus, the NIH said. When the vaccine is injected into the arm muscle, cells read the genes

and make Zika virus proteins, which self-assemble into virus-like particles to induce an immune response. Such DNA vaccines do not contain infectious material, so they cannot cause a vaccinated individual to become infected with Zika and have been shown to be safe in previous clinical trials for other diseases. Volunteers will be divided randomly into four study groups of 20 people each, and all will first receive a vaccination via a needle-free injector. Half of the participants will receive one additional vaccination eight weeks or 12 weeks later. The

Local health groups launch ‘Rethink Your Asian Drink’ campaign A coalition of health and community organizations recently launched the “Rethink Your Asian Drink” campaign, in an effort to bring awareness to various Asian drinks such as Boba and milk tea, that are sugary and have literally little or no value. The goal of this campaign is to empower the public and bring awareness and health concerns regarding these sugary drinks. Due to a large number of people currently suffering from high levels of Obesity and diabetes here in America, this campaign was created to provide information on the nutritional value of nearly 300 popular Asian drinks. Recent statistics show that obesity rates among children are alarming with 32 percent overweight and 17 percent are considered obese. According to a recent LA Times report, while obesity rates among Asian Americans are low, they have a higher rate of diabetes at 10 percent, as compared with 7 percent among the white population. On average, a person consumes the equivalent of 39 pounds of sugar each year from sugary drinks, which are the single, largest source of calories in the American diet. Boba drink for example, contains133 grams or 27 teaspoons of sugar. The American Heart Association recommends limiting the amount of added sugar to no more than half of one person’s daily

discretionary calorie allowance. For most women, this is no more than100 calories per day and no more than 150 calories per day for men or about 6 teaspoons per day for women and 9 teaspoons per day for men. The coalition behind the “Rethink Your Drink” Campaign includes: The American Heart Association (AHA), American Lung Association, Asian Pacific Healthcare Venture (APHCV), Asian and Pacific Islander Obesity Prevention Alliance (APIOPA), Asian Pacific Policy & Planning Council (A3PCON), Empowering Pacific Islander Communities (EPIC), Health Net, LA County Department of Public Health Planning Area 3 and 4 and Pacific Islander Health Partnership (PIHP). Speakers during the program launch were: Dr. Tony Kuo, Acting Director, Division of Chronic Disease and Injury Prevention, LA County Dept. of Public Health; Scott Chan, APIOPA and Health Initiative Member; Joni Byun, AHA Western States Affiliate Board Member and SVP of Nakatomi & Associates; and Sous Chef, Nico De Leon of LASA Restaurant, who personally demonstrated the calorie counts on their sample Boba and Milk Tea drinks. For more information on the program, visit the coalition’s website at:www.rethinkyourasiandrink.org.

remaining participants will receive two additional vaccinations: one group will receive a second vaccine at week four and a third at week eight; the other group will receive a second vaccine at week four and a third at week 20. Initial safety and immunogenicity data from the trial are expected by January 2017. If results show a favorable safety profile and immune response, a larger trial could begin in early 2017 in Zika-endemic countries, the NIH said. So far, there are no vaccines or specific therapeutics to prevent or treat Zika virus disease.

DACA remains valid as Asians urged to avail immigration relief By Abner Galino

Contrary to popular impression, President Barack Obama’s executive actionin 2012 to shield from deportation undocumented persons who came to the US when they were children, otherwise known as the Deferred Action for Childhood Arrivals or DACA, remains in effect despite a recent unfavorable decision by the US Supreme Court on the extent of executive powers to grant immigration relief to millions of undocumented immigrants. The 4-4 split US Supreme Court “one-sentence decision simply upheld the preliminary injunction issued by a Texas District Court against the implementation of Deferred Action for Parental Accountability (DAPA) and the expanded DACA programs would have provided temporary relief from deportation and work authorization for up to 5.2 million unauthorized immigrants in the US. This issue was clarified once again during a recent New America Media (NAM) roundtable forum with the White House Initiative on Asia Americans and Pacific Islanders (WHIAAPI), the United States Citizenship and Immigration Services (USCIS), leaders of non-profit organizations and members of the media in downtown Los Angeles on Thursday (July 27). WHIAAPI senior policy advisor Reva Gupta said that over 130,000 persons of Asian and Pacific Islander descent could be eligible to apply for DACA and some 16,000 of them live in Los Angeles county. Broken down, the LA numbers involve around 6,000 Koreans, 3,000 Chinese, 3,000 Filipinos and 1,000 Indians. Reacting to a question, Martha Flores, Chief of Staff of the Los Angeles Field Office, allayed the fears of would-be DACA recipients that a change in political administration may put them in harm’s way. “As an administrative office, we do not share (DACA) information with ICE and other enforcement arms of the USCIS, Flores explained. Forum moderator Odette Keeley of NAM added later on that the more individuals apply and are admitted to the DACA program, the harder it is going to be for a hostile political administration to initiate harmful political actions against them. In line with this issue, Shiu-Ming Cheer, a senior staff attorney of the National Immigration Center, said pro-immigration advocates would seek

a re-hearing of the discontinuing of the DAPA and extended DACA programs when the US Supreme Court has installed its ninth member (its traditional number of justices). Cheer said the planned split decision is widely viewed as a “non-decision and does not reflect a substantive opinion of the high court on the issue of the extent of executive powers to provide immigration relief. The possible effects of the results of approaching presidential elections to the future composition of the Supreme Court was not discussed in the forum but those who were there understood that a hostile political administration could adversely affect immigration cases that are pending or about to be filed with the High Court. Meanwhile, the Asian American Advancing Justice-Los Angeles (AAAJ-LA), through its DACA legal advocate Tiffany Panlilio, said the organization continue to assist DACA applicants for free and also help them obtain loans for the a little over than $400 enrolment fee to the said government program. Panlilio said these loans could be paid back by DACA applicants througha staggered scheme, involving small amount of payments. She added that the cost of enrolling to the program is among the reasons why there has been a low turn out among possible DACA recipients. She added that seeking the help of non-profit organizations could prevent DACA applicants from falling into immigration scams. DACA recipients Anthony Ng, a Filipino, and Michelle Yoon, a Korean, both shared their testimonies at the forum— highlighting the benefits of getting temporary reliefs from possible deportation and acquiring work authorizations. Ng and Yoon both shared the upshots of DACA benefits on them. They said they no longer fear being separated from their families and have enjoyed their new found freedoms, among them the ability to travel around the United States, being able to use acquired education in seeking good employment and getting health care benefits. “If you asked me eight years ago if I thought undocumented people could become lawyers and doctors, I would have told you no, because of the barriers that we face. But because of DACA we were able to pursue our lifelong dreams, Ng, who is a graduate of University of California-Irvine, told the forum.

Nerad, executive editorial director and executive market analyst for Kelley Blue Book’s KBB. com. “The kids involved also prefer to have a car they’re happy to be seen in, which suggests that style is part of the equation too.
